Erik Torgersen participated remotely under the OML Simple Extension Legislation . 
 
The Hearing was to hear and review a request under M.G.L. Ch. 40, Section 15C, Scenic R oad Designations and under M.G.L. 
Ch. 87, Section 3, Cutting of Public Shade Trees to remove five trees for equipment access for installation of a sewer line from 
the street to the house, and replacement with two Maple trees at 235 Leominster Road (Parcel 080-0040-00), Lunenburg, MA.   
 
Owner was Joseph Dignam Jr., 235 Leominster Road, Lunenburg, MA.  Applicant was William R. Proctor Inc., 390 Electric 
Avenue, Lunenburg, MA. 
 
William R. Proctor Inc. was represented by Dan Proctor.  The property owner reques ted to tie into the sewer as a result of a 
failed Title 5.  D. Proctor explained that he had cut the trees down before coming to the Planning Board.  He always thought if 
there was a sewer stub that the sewer line was to the property line ; but the trees were located in the right -of-way.  Board Chair, 
M. Allison noted a letter from the DPW Director that stated the trees were in the path of excavation and that they be replace d to 
avoid interference with the sewer connection.  M. Brenner questioned why the fiv e trees that were removed were being replaced 
by only two trees.  D. Proctor responded that trees are not planted on top of a sewer line due to root infiltration.   
 
M. Brenner made Motion to close the scenic road hearing for 235 Leominster Road, A. Reid S econded, Roll Call Vote -  
E. Torgersen, aye; A. Reid, aye; M. Brenner, aye; M. Allison, aye.
