PUBLIC COMMENT: Chairman Toale reminded everyone the polls for the Special Election to State Senate were still open until 8:00 Ms. Luck thought it was wonderful to see so many citizens at the Special Town Meeting and inspirational to hear a variety of voices expressing their opinion on matters of import to our town. It was gratifying to hear folks add their voices to the conversation this town has been having for many years about the disposition of town uldings and land. The conversation moved front and center in 2013 when the Board of Selectmen determine hat a building reuse committee should be formed. Newly elected Selectman Jamie Toale grabbed the torch an enlisted architects, planners, businessmen and other protessionals to work together to tind possible solutions to the town's building surplus and the need for adequate municipal office space. They took charge to find ways to utilize town resources to find the most economical way to carve out practical office space at the lowest cost to taxpayers. They reported their findings to the Annual Town Meeting in 2016. It seems that was an awakening for some residents who joined the conversation especially at this Special Town Meeting. The hope is they stay engaged and help the town comes to grips with how to get what we need at a price we can afford. She noted the decorations at the gazebo and common look great and thanked everyone who helped put them up. The Lunenburg Family Giftmart is planning their ninth annual event in mid-December by invitation only to residents who use the Lunenburg Food Pantry and through the Lunenburg School District and local churches. Donations of unwrapped gifts are displayed for invited guests to shop for their families free of charge. Last rear Giftmart helped more than 130 Lunenburg families enjoy their holiday. Giftmart accepts new unwrappec gifts for children or adults of all ages in their donation boxes located around town through December 7". More information is located at http://www.lunenburggiftmart.com/ Katie Adams, 40 Williams Drive, commented on the findings of the building reuse committee between the years of 2013 to 2016. APPOINTMENTS: License Violation Hearing- Embers Pizzeria-84 Lakefront Drive Mr. Toale explained the hearing process. Owner Kenneth Ricker and Officer John Morreale Jr. were sworn in by Chairman Toale. Officer Morreale read aloud the narrative; The following is a summary of events from Thursday, September 21, 2017 between 5:00 p.m. and 9:00 p.m. Officer Tocci and I conducted an alcohol enforcement initiative utilizing a twenty year old party who is known to this department. The purpose of the initiative was to ensure that businesses in town that were licensed to sell and pour alcohol were properly checking the identification of their patrons and no underage sale was takino place. Specific guidelines were given to us by Sergeant Jack Hebert who is trained in this topic. The underage operative is known to the officers of the department and is considered to be trustworthy and reliable. He was dressed appropriately for his age without attempting to present himself as older or younger than he was. He wore a green Bar Harbor Whale Watch t-shirt, light brown khaki pants and black boots. A picture was taken of the party's attire. He was instructed to enter stores and bars and to attempt to purchase alcohol without ===PAGE 2=== to advise inem or the violation. Mr. Ricker stated he has video and it happened. The bartender has been relieved of her duties and we had a representative of one of the area alcohol training companies come in and retrain the staff. We have been open for three and a half years and we have had a lot of these done and we passed all of them. There is nothing I can really say. We have taken all the necessary steps to ensure it doesn't happen again. She (the bartender) was under the impression it was one of the kids in the kitchen that has a beer after work. Mr. Ebersole stated based on other hearings we have had, other establishments have established written policies and have things posted. Ricker responded that they also have that. I have written policy that we have always had. Ms. Peterson should have a copy of that in the files. We take our livelihood seriously and we can't have this stuff happen; that is why she (the bartender) no longer works for us. She understands and she felt terrible too. It is just the way it is. Ms. Luck asked if this was their first violation. Ricker confirmed. Mr. Toale closed the hearing. Motion: R. Ebersole That a liquor license violation did occur on September 21% at Embers Pizzeria Motion: R.Ebersole That the Board issues a written warning as this is the first offense 2": P. Luck Vote: All in Favor 2nd: D. McQuaid Vote: All in Favor Mr. Toale stated Ricker would be notified by mail of the warning adding they appreciated that he appreciated the seriousness of this. Ricker stated he did and appreciated the warning. He added hopefully he wouldn't be back. Ricker exited the meeting. Ms. Patel is very experienced and has been involved in alcohol retail sales for about ten year. She is TIP certified and has not had issues with underage service in other stores. The operation will be the same as it currently is now; no changes to hours. She expects to have 2-3 employees that currently work there now too. Ms. Luck asked for confirmation that everyone who serves liquor has to be TIPS certified. Mooradian stated it ===PAGE 3=== INTERVIEWS/APPOINTMENTS/RE-APPOINTMENTS RESIGNATIONS Resignation of Assistant Town Clerk, Tina LePage Ms. Lemieux stated this is to notify the Board that I received the resignation of Ms. Page on November 20th. Her last day was December 1s!. The position is being advertised internally. The posting expires Friday and I will be advertising to the public sector if we don't receive any interest internally. Ms. Lemieux wanted to thank Ms. LePage for all the work that she did while employed with the town. TOWN MANAGER REPORT Ms. Lemieux reported the walking tour of the five municipal buildings was held on December 2°. There were about 30 attendees who heard about the current condition of each building and were able to see firsthand the conditions of the buildings and were able to ask questions along the way. We received positive feedback and appreciation that we held the tour at the end of the tour. Town Facilities Charrette: • First Charrette: The first charrette of a series of charrettes on Town Facilities will be held on Thursday, December 7*' at 7 p.m. at the MS/HS Collaborative Room A130. This will be an opportunity to share ideas, envision, and build consensus around the future use of town buildings/land. We will do hidingsland, We wildo breakout groups and discuss the development options for each of the buildings and have a visioning component tor town center tocused on the town buildings/land. An important goal is to increase public participation on this topic. The event is advertised on the website, has been sent to the Lunenburg Ledger Facebook page, the Lunenburg Facebook page, and the Sentinel will have an article prior to the event as well. Complete Streets Prioritization Plan: We held our first meeting today with the consultant we hired to complete the prioritization plan. In attendance was the DPW Director, Police Chief, Fire Chief, Land Use Director, School Superintendent and myself. This was an opportunity for each official to identify possible projects that would eliminate possible hazardous intersections, assess ADA accessibility, pedestrian and bicycle safety and enhance transit. The next step is to set a date for the public outreach portion to hear feedback from other public officials as well as the public on areas in town that would increase safety and accessibility for all modes of travel for people of all ages and abilities. I would recommend we use the January's Board of Selectmen January 9*h workshop meeting to hold this forum. The Board concurred on the date. Ms. Lemieux will inform the consultant and she will begin advertising the workshop date. My Town Government: In the near future we will be switching over to an electronic agenda and meeting posting method using software called My Town Government. The website address is http://www.mytowngovernment.org Tina LePage, former Assistant Town Clerk, started this process this month, putting all the board, committee, commission and regional information into this new system with the memberships of each of the boards and their regular meeting locations. The person who is responsible for posting the agenda for each board, committee or commission will be given a log-in and password so that they can post meeting agendas 48 hours prior to the ===PAGE 4=== racites Director Jonn Londa to discuss what would be involved for permitting the Passios kitchen as a commercial kitchen. As it stands now, the Board of Health would require that in order to permit the facility, the Town would need to be the lead permit holder and any business owners using the facility would also need to be permitted under the Town's licensed facility. Each business would require their own separate locked refrigeration units and businesses would not be allowed to bring in any of their own equipment, such as an extra commercial oven. Depending on the type of business operation, it may require the dishwasher to be operational which would then trigger requiring a grease permit from the Sewer Commission. Permitting the facility in this manner would prohibit certain types of businesses from operating out of that space and put the Town at more risk. She recommended a joint meeting between the Board of Health, Sewer Commission and this Board to discuss the process of permitting it as a commercial kitchen and how to lessen the liability for the town as well as utilizing the space to benefit our local businesses. Mr. Ebersole asked for the state law that requires the Town to be the lead permit holder in advance of meeting with the Board of Health and Sewer Commission. Announcements: Mis. Lemieux announced the Summer Street project bids have been postponed until February 6, 2018. Today we received certification from the Department of Revenue that the fiscal year 2018 tax rate was set at $19.70 per thousand dollars of valuation. This is down 28 cents from fiscal year 2017. Mr. Toale noted public access cable taped that municipal building walking tour; it is also up on Youtube. The Town Manager and he will be meeting to plan the charrette. Ms. Lemieux announced the ratification of the collective bargaining agreement between the Lunenburg Professional Firefighters PPFM Local 4358A and the Town. Both parties have voted to ratify the agreement, which is for three years starting on July 1, 2017 and ending July 1, 2020. The main provisions of the agreement are as follows: There was a market adjustment for the fiscal year 2018 wages and a 2% cost of living increase for fiscal years 2019 and 2020. It provided for two additional paid holidays that will be consistent with the other unions and the non- union employees. The agreement reduced the recall period for employees that were laid off from 2 years to 18 months. A new position of Firefighter/Paramedic was added to the compensation schedule. It established a flat stipend for a member of the unit less than the rank of Captain who is assigned as the department's Fire Prevention Officer and provided clarification on statutory updates to certain articles within the agreement. Special Town Meeting approved the transfer of $13,884.22 from the Salary Reserve line item in the current year's budget to cover the first year of the contract.
