Also present was Selectman Bob Ebersol to assist the Commission at its first meeting. Officers were elected by unanimous vote: Richard McGrath- Chair Jim LaVeck- Vice Chair Cullen Dwyer- Recording Clerk Certain errata were noticed in the town bylaw as ratified: 1) The bylaw states that the APD consists land within the Lunenburg Village District or within the Lunenburg Historical District (or both). The map attached to the bylaw shows the APD as only the Historic District. Mr. Ebersol commented that the map currently attached to the bylaw stands and defines the district. Land Use Director Adam Burney is currently working to draw a corrected map. 2) There is certain confusion in the wording of the bylaw as to how many members the APDC shall have: five or six. 3) In section 8, one passage reads “thirty(45) days”. The passage should read “forty- five(45) days”. The bylaw will need to be amended to correct these mistakes at the Town Meeting in May 2016. There was also discussion regarding the APDC having less than its proposed number of members. Mr. Ebersol commented that the BoS was concerned that having too many residents of the APD on the APDC might lend an anti-development bias to the board. At present the BoS has no viable additional candidates for the APDC. Since “Demolition by Neglect” is forbidden by the bylaw, there was some discussion of how we would enforce this rule, and whether the intentions of the violator might be a factor in the enforcement. No conclusions were reached. The Commission recognized its obligation to provide design guidelines for alterations of existing contributing properties in the APD. These must be brought before public hearing and accepted by the BoS within 180 days of this meeting. McGrath agreed to contact Mass Historic to obtain an example of ===PAGE 2=== historic design guidelines. LaVeck agreed to contact the Town of Ipswich and research other towns with historic preservation bylaws to see if he could find a set of guidelines to serve as our model. The Commission also resolved to meet on Saturday the 16 th at 8AM for a site visit of the APD, to help the APDC formulate design guidelines. Mr. Ebersol recommended that the APDC inform the police of its intentions and to carry identification. Mr. Ebersol also suggested that all members acquire and use Town of Lunenburg email addresses for all APDC-related business. The APDC agreed to have its next meeting on Jan 19 th , 2016 at the Ritter Building. McGrath agreed to contact the police about the site visit, and to contact the Town Clerk to post the next meeting. 8:30PM Meeting Adjourned. ======================================================================================== DOCUMENT : 2016-01-19-agenda-525.txt BOARD : architectural-preservation-district-commission DATE : 2016-01-19 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/architectural-preservation-district-commission/2016-01-19-agenda-525.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_01192016-525 ======================================================================================== ===PAGE 1=== Architectural Preservation District Commission Meeting1. ======================================================================================== DOCUMENT : 2016-01-19-minutes-525.txt BOARD : architectural-preservation-district-commission DATE : 2016-01-19 KIND : minutes OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/architectural-preservation-district-commission/2016-01-19-minutes-525.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Minutes/_01192016-525 ======================================================================================== ===PAGE 1=== Town of Lunenburg Architectural Preservation District Commission Meeting Minutes, January 19, 2016 Approved: 2-9-16 Richard McGrath- Chair Jim LaVeck- Vice Chair Cullen Dwyer- Recording Clerk 7:10 Meeting called to order with all members present. Mr. Dwyer was not able to print out the minutes from the previous meeting, so approval of minutes was forestalled until next meeting. Members discussed ideas generated from the APD site-visit on 1-16-16. Mr. Dwyer presented notes on his own reflections from the site visit, which the board agreed would be helpful moving forward. (See supporting document “Reflections from Site Visit, 1-16-16”) The board recognized that many repairs and improvements that would effect the overall appearance of the building would not require a building permit, and therefore would fall under exemption 6b of the bylaw. Mr McGrath resolved to learn what needs or does not need a building permit. The board agreed that it should consider specific topics before drafting design design guidelines for the APD, including: Roofs: shingles and materials, dormers and roof additions, skylights, solar panels, windmills, vents, heat traces, chimneys, roof pitch, antennas and communication improvements, weather vanes, cupolas. Facades and sides visible from public way: siding (clapboards, aluminum, vinyl, brick and stucco), windows, doors, decks, porches, balconies, steps, railings, exterior lighting, patios, walkways, trim, ballisters, foundations. For Design Guidelines regarding signs, the board must first review the Village District Bylaw to see what guidance that document offers. Design guidelines will be written to cover the majority of cases. The APDC will retain the right to make exceptions to preserve the unique historical character of a building. The appeals process described in section 13 of the bylaw is still unclear to the board, and requires further research. The board will meet again at 7PM in the Ritter Building on 2-9-16 8:30PM Meeting Adjourned. It was agreed that it would be a good idea to include a review of architectural styles found in Lunenburg. Also, the idea of including a flow chart to guide users through process. Certain temporary structures are exempt from the Lunenburg APD bylaw. The board recognized the need to generate a list of possible temporary structures, and delineate guidelines on how long and how big they may be before they are not exempt from the ADP bylaw. It must also draught design guidelines for temporary buildings that are not exempt. The board then discussed how the APD design guidelines might mesh or conflict with the VDB. The board recognized the need to first create an outline for the APD guidelines. The idea was proposed to hire a consultant to help the board identify architectural building styles in the Lunenburg APD. McGrath said he would check to see if the APDC had a budget available for such measures. Jim LaVeck suggested that the APDC build its own website, explaining the powers and duties of the APDC. The board discussed the guidelines from the Ipswich APDC. They provide a valuable framework. The Lunenburg APDC will need to strengthen section IV, to give specific treatment of topics like roofs, sheathing, foundations etc. It will need to give specific recommendations, tell property owners what to avoid, and explain what the APDC forbids. The Ipswich APDC guidelines contain photographs and examples of important historic buildings. A similar review was deemed valuable for the Lunenburg guidelines. To that end, Richard McGrath will contact the assessor’s office for existing information and photographs, and recover the existing materials gathered for Lunenburg’s Survey of Historical and Architectural Resources (work in progress). The board then turned to the Lunenburg APDC bylaw and discussed the details of the application process: what forms were needed, when and how property owners would be contacted, time frames, and how internal and official documents would be stored and recorded. Using the Ipswich guidelines as a model, the board members will each individually draught Lunenburg’s guidelines for sections I and II, and compare draughts at the next meeting. The unapproved minutes from the meeting on 3-29-16 were not printed out and McGrath tabled their approval until the next meeting. Public Comment: None. New Business: McGrath informed the board that, though it is still not entirely prepared, the APD bylaw is now operational. The APDC will begin accepting applications for Certificates to Alter. Richard will prepare forms for applications to be reviewed and approved before the next meeting. Old Business: The board reviewed the latest draught of the flow chart prepared by Corcoran. This involved a close reading of sections 7 and 8 of the bylaw, much discussion and interpretation of how the wording in the bylaw would be codified in regular procedure. It was recognized that stone walls were specifically protected in the bylaw, but that demolition of a stone wall would probably not require a building permit, and would therefore be exempted from APDC oversight. The board recognized that special procedures would be needed to deal with these situations. The board reviewed design guidelines contributed by members in fulfillment of section 9 of the bylaw. Hard copies were distributed covering topics of roofs, cellars and foundations, temporary buildings, and alternate versions of sections 1 and 2 of the guidelines. The board agreed to read these over and discuss them at the next meeting. Old Business Land Use Director Adam Burney attended the meeting to offer input on the draft of the APDC guidelines. He felt that the document the Commission had put forward was not usable and not ready to present to the Board of Selectmen. He praised the style guidelines that the town of Ipswich had published for their APD. He also recommended that the Lunenburg APDC follow their lead: by publishing rules, regulations and procedures separately from the style guidelines. He further suggested finding a published and widely available guidebook on architectural styles, and using it an authoritative reference for the guidelines. Finally, Mr. Burney presented his own recommended outline of the documents, and promised that he would submit the beginnings of a draft to the APDC in the coming weeks. Review of Minutes Minutes from 9-13-16 were read, voted on and approved. New Business: The Commission discussed the contraction and restoration work that had been taking place on Leominster rd. A stone wall had been taken down for underground work, but afterwards re- stored. The APDC had not been notified. McGrath had discovered that permits for this type of excavation were granted not by the building inspector, but by the Department of Public Works. This was noted by the commission as being of procedural importance. Adjourned 8:40 PM Postscript: these minutes approved at 11-8-16 APDC meeting. Respectfully Submitted, Cullen Dwyer, recording clerk
