Meeting Minutes Tuesday March 12th, 2019 Ritter Building Call to Order: At 7:08PM Present: Chairman McGrath, Corcoran, LaVeck and Dwyer Review of Minutes: Minutes from the meeting on February 12th were read and approved. Correspondence: McGrath read letter to Mass Historic regarding Old Primary School Old Business: McGrath met with Burney regarding the CPA. Burney said that the state only matches $1 for every $6 now contributed, and so thought that there would be little interest. Also spoke with him about the BoS requesting a demo permit for the old primary school. Burney informed them that the APDC would have final say. Heather LeMieux had contacted McGrath about a walk- through, and will coordinate with facilities manager. The Commission discussed the Vertex report, and the attitude of the BoS. Burney also explained that the Demo Delay bylaw time extension went to the Attorney General’s office for a review period of 90 days. Afterward it will return for ratification by the historic commission and APDC. The Commission further discussed the process and weakness of the bylaw, particularly with respect to the Battles house on 68 Elm Street. 136 Leominster Road: A sample of the soffit material was provided, as requested. Though it was late, it completed the require- ments for the CTA. The Commission voted to issue a certificate of completion. Brian Corcoran, Member. Meeting Minutes Tuesday March 14th, 2019 Ritter Building Call to Order: At 7:00PM Present: Chairman McGrath, Corcoran, LaVeck and Dwyer Review of Minutes: Minutes from the meeting on March 12th were read and approved. New Business: Charles and Sally Dyer appeared to support their application for a CTA at 876 Massachusetts Avenue. The application was to reroof their barn with either colored steel roofing or asphalt shingle. The barn is of peg and beam construction. It age is un - known, but the barn was moved to its current location sometime after the civil war. The commission approved the application as written, with the option to use either roofing material. Mike Brule appeared to support an application for the house at 92 Leominster Road. The alteration would be a like-for-like re- placement of the architectural shingle roof. He brought photographs and sample materials to support the application. The appli- cation was lately submitted, since the posting of the agenda. As a procedural matter, LaVeck motioned that the APDC deliberate on the matter. Corcoran seconded and the motion passed. Approval of the application then likewise passed. Chairman Mc - Grath agreed to put “Review of CTA’s” as a regular feature on future agendas, so that the Commission could deliberate on any applications that come before it. Old Business: McGrath reported that he had been coordinating with D & G graphics on the design of the signs for the APD. He intended to confer with Rodriquenz regarding selection of materials. Old Primary School: The Commission conferred on its observations from the site visit on 4-4-19. Kit Walker of the DPW had shown the commission around the building and discussed his efforts to preserve it as well as ongoing problems he faced. The BoS and town Manager had taken no action to comply with the APD bylaw regarding Demolition by Neglect. The Commission unanimously agreed to draft a letter to the BoS and Town Manager, and to send a copy to the DPW as well. The letter shall in- form them that action on this matter is overdue, and include a list of items that specifically require immediate attention. Meeting Minutes Tuesday May 14th, 2019 Ritter Building Call to Order: At 7:01PM Present: Chairman McGrath, Corcoran, LaVeck and Dwyer Review of Minutes: Minutes from the meeting on April 9th were read and approved. New Business: Dawn Marshall appeared for administrative review of a plan for a second-story apartment in the barn at 42 Main Street (the Jones House). The APDC had questions regarding her proposal, but no serious concerns that would require revisions. Old Business: McGrath presented a design of the APD road sign and an aluminum/polymer laminate material sample. The commission re - viewed the design and recommended edits. Old Primary School and Brooks House: LaVeck reported on proceedings from town meeting. Permission for the Select Board to sell the Old Primary School was narrowly defeated. The town granted permission to sell the Brooks house building, but appar- ently the house does not have its own lot, so permission to sell the property on which it is situated was denied. LaVeck felt that discussion on the topic created more confusion than clarity. The APDC then discussed the issue of demolition by neglect of the Old Primary School, and how to procure funding for neces- sary maintenance. Brian Corcoran, Member. Meeting Minutes Tuesday June 11th, 2019 Ritter Building Call to Order: At 7:03PM Present: Chairman McGrath, Corcoran, LaVeck and Dwyer Review of Minutes: Minutes from the meeting on May 14th were read and approved. Correspondence: McGrath had stopped at the town manager’s office to inquire if there was any plan of action to bring the town into compliance with the APD bylaw regarding Demolition by Neglect of the Old Primary School. LeMieux sent a courteous reply, but gave no indication that any decision had been made, or course of action intended on the matter. The APDC concluded that it had better explore other options to preserve historic properties owned by the town. McGrath also spoke with Mr. Rodriquenz of the DPW about the Old Primary School, who informed him that he had done a walk- through with and architect some years ago, and found the basic structure sound. But even at that time he felt that the interior would need to be gutted. He had no funds or resources allocated for the preservation of the building. New Business: Officers were elected for the year. By unanimous vote, Richard McGrath will remain Chair, James LaVeck Vice-Chair, and Cullen Dwyer recording clerk. LaVeck noted that the Ritter Building sign was missing. Old Business: McGrath presented an updated design for the APD road signs. Some did not care for the font used. Dwyer proposed to present various fonts to choose from for the next meeting. Old Primary School and Brooks House: With still no action from the Town Manager’s office or the Select Board, the APDC dis- cussed strategies for preserving disused town properties. LaVeck reported that he would be joining the Capitol Planning com- mission this year. He believed that all available funds were spoken for this year, but that funds for the maintenance of historical town properties could possibly be allocated from the general fund in 2020. He will learn more about the process in the coming months. Corcoran believed it might be helpful to get a contractor’s estimate for the work needed to preserve the roof, parapet and down- spouts of the Old Primary School. McGrath agreed, and will get permission from the DPW for the contractor to inspect the prop- erty, and also for volunteers to clear vegetation. ===PAGE 2=== As care of town properties is officially the duty of the town manager, LaVeck intended to speak with Town Counsel. He wanted to review the APDC charter, and get advice on the extent of its charge and whether or not it would be overreaching its authority by getting a contractor to estimate the costs of repair and upkeep of the Old Primary School. As the town had voted to authorize the Select Board to sell the Brooks House building, town manager LeMieux said she intended to draw up a bid package to sell the house. Dwyer opined that the house was of greatest historical value left in its present loca- tion. He agreed to review the video from the joint workshop with the Select Board, and record the details that were discussed regarding selling the house for use as a private residence in its original/current location. McGrath agreed to talk to Mr. Burney regarding the same. Regarding the bid package, the APDC agreed to inform LeMieux that removal of the building would not be allowed without stipulations; namely: that the house would remain under the jurisdiction of the APDC’s CTA application process, regardless of where it was moved to, that the house would remain in the town, and that possession of the house would revert back to the town if the conditions imposed were not fulfilled within a certain period of time. Brian Corcoran, Member. Meeting Minutes Tuesday July 9th, 2019 Ritter Building Call to Order: At 6:58PM Present: Chairman McGrath, Corcoran, LaVeck and Dwyer Review of Minutes: Minutes from the meeting on June 11th were read and approved with certain clarifications. Old Business: Town Properties- Old Primary School LaVeck reported on discussion and public comment from recent Select Board meetings. One town resident had presented plans and a concept drawing of how the property might be used, which involved removal of the building. In LaVeck’s opinion, the inac- tion of the Select Board regarding maintenance of the Old Primary School stemmed from a general feeling on their part that they needed a complete plan for all the town properties, including the possible move of town offices to the T.C. Passios building and re-use plans for the Town Hall and Ritter Building. They seemed reluctant to devote resources to efforts not part of that plan. Partly for the benefit of Lunenburg Ledger reporter Matthew Stewart (who attended the meeting), McGrath and Dwyer reviewed the APD bylaw and guidelines regarding demolition by neglect and enforcement measures. Brooks House: Dwyer reviewed notes taken from the APDC’s joint workshop with the BoS on January 15th. At that time, Land Use Director Burney said that since the Brooks house had been disused as a single family home for more than two years, the village district bylaw would require a variance to reinstate such a use. The house shares the same lot as T.C. Passios, and would need to be subdivided to create a separate lot. Access from Massachusetts Avenue would require a curb-cut from the Mass DOT, which might be denied due to safety and space issues between the library and high-school. Access to the property via the library parking lot might be possible, though that would remain a practical and political hurdle. In sum, he felt that there were significant obstacles to re-use as a single family home, and that the historic character of the building would make it unat- tractive to home-buyers anyway. Adams mentioned that the Tappe study estimated the cost of demolition would be $30-40K, and moving the house would be about $30K. McQuaid noted that the Tappe study was for restoring buildings to “current use” and did not really apply to this situation. He also noted the town’s past record as a negligent land-lord, and thus cautioned against rent- ing the building. Finally, McQuaid mentioned that off-site parking for residences was permitted in the village district, and might be an option for the Brooks House. After some discussion, Corcoran concluded that despite the difficulties, selling the Brooks House as a single family residence would still be best way to preserve the property and its historical value. The clerk will contact the planning board to pursue the next steps. ===PAGE 2=== LaVeck suggested approaching the town manager to allocate funds for future maintenance of historic town properties. McGrath thought that a letter should be drafted for this purpose. After some discussion, it was agreed that the APDC would first seek advise from the Town Manager. Next Meeting: Tuesday, August 13th, 7PM Adjourned: With no further business before it, and APDC adjourned at 8:07PM ======================================================================================== DOCUMENT : 2019-08-13-agenda-553.txt BOARD : architectural-preservation-district-commission DATE : 2019-08-13 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/architectural-preservation-district-commission/2019-08-13-agenda-553.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_08132019-553 ======================================================================================== ===PAGE 1=== ======================================================================================== DOCUMENT : 2019-08-13-minutes-553.txt BOARD : architectural-preservation-district-commission DATE : 2019-08-13 KIND : minutes OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/architectural-preservation-district-commission/2019-08-13-minutes-553.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Minutes/_08132019-553 ======================================================================================== ===PAGE 1=== Town of Lunenburg Architectural Preservation District Commission Richard McGrath, Chairman Jim LaVeck, Vice-Chair Cullen Dwyer, Clerk. Brian Corcoran, Member. Meeting Minutes Tuesday August 13th, 2019 Ritter Building Call to Order: At 7:05PM Present: Chairman McGrath, Corcoran, LaVeck and Dwyer Review of Minutes: Minutes from the meeting on July 9th were read approved. CTA’s: An application for a CTA at 909 Massachusetts Avenue (the Harley House). The application was not entirely clear to the board, and some questions lingered as to what was being approved. Chairman McGrath attempted to contact the applicant dur- ing the meeting, but was unable to make contact. Decision on the application was tabled until the next meeting. Old Business: Town Properties- Old Primary School LaVeck reported on his discussion with the town counsel, which advised him that the APD bylaw is written so that enforcement requires resort to a court. This legal action would need to be authorized by Select Board. As it seems unlikely that the Select Board would authorize legal action against itself or the town manager, town council had little to offer in the way of options to force action on maintenance of the Old Primary School. One remedy discussed would be to change bylaw by vote at town meeting, so that it would authorize APDC to asses fines for non-compliance. Another option discussed would be to ask the building commissioner to enforce an order to act. However, as Lunenburg current- ly has no Building Commissioner, this did not seem like a very promising route. LaVeck motioned that the clerk draw up a cease and desist order to the Town Manager and send a copy to the Select Board regarding the demo by neglect of Brooks House. Brooks House: Dwyer announced that the the APDC was on the Planning Board’s agenda for September 9th. He planned to attend and explain APDC’s position on the Brooks House: namely that the best option would be to sell the house for use as a private residence. He hoped to discuss the process and steps required to subdivide lot, provide parking, easement, and to re-zone the property to this end. APD signs: McGrath is still working of getting correct proof for the sign layout. Brian Corcoran, Member. Meeting Minutes Tuesday September 10th, 2019 Ritter Building Call to Order: At 7:00PM with all members present. Review of Minutes: Minutes from the meeting on August 13th were read approved with certain clarifications. CTA’s: An application for a CTA at 909 Massachusetts Avenue (the Harley House) was reviewed with the applicant (John Kypri- anos) present. The sliding door in question is on the west side of the house toward the back. The material he selected was vinyl. LaVeck motioned to accept the application, Corcoran seconded and all voted in favor. Old Business: Town Properties- Old Primary School In a recent meeting of the Select Board, the future of the Old Primary School was discussed. LaVeck reviewed the video record- ing of the meeting and expressed dismay at M. Jefferies apparently disrespectful comments toward the APD bylaw. Another revelation from the Select Board meeting was that, due to typesetting errors, certain portions of the APD bylaw were never sub- mitted to the State Attorney General’s office, and so were never ratified by the state of Massachusetts. The omission included the definition of Demolition by Neglect. LaVeck had noticed the omission and notified the Town Manager, Land Use Planner, and Cerk by email back on November 15th, 2017; but the problem was never rectified. LaVeck also noted that the town’s current capital 5-year plan includes funds for demolition of the Old Primary School in 2023-2024. At 7:40 the APDC went to recess, and reconvened at 7:50 in the Bilotta Room of Town Hall to meet with the Select Board. Facilities Manager Kit Walker had submitted an estimate to the Select Board amounting to a one-time expenditure of almost $11,000 for the items requested by the APDC to arrest the deterioration of the Old Primary School. M. Jeffries noted the discrepancies between the bylaw passed at town meeting and the version submitted to the State. He agreed with T. Alonzo that the evening’s discussion should proceed with the assumption that the problem would be resolved and that the version passed at town meeting was the one in operation. LaVeck expressed his displeasure at M. Jeffries’ previous comments, and Jeffries apologized, explaining that his comments were not intended as LaVeck had taken them. T. Alonzo noted that the troubles with the Old Primary School stemmed from the town’s lack of consensus as to what to do with it. He asked if the APD wished to preserve the building, and McGrath replied in the affirmative, noting its architectural and historical value. D. McQuaid saw little value in the building, citing the cost to renovate it to modern standards. But P. Luck had spoken to Ron Dion who was optimistic about its potential. K. Adams noted that attempts to convey the property had been three times rejected at town meeting, strongly indicating that the town wanted to keep the property. She also noted that the property had been neglected even before its disuse. It was also noted that the Old Primary School building was still covered under the town’s liability insurance. ===PAGE 2=== With the discussion concluded, the APDC retired to allow the Select Board to deliberate on the matter. Brian Corcoran, Member. Meeting Minutes Tuesday October 8th, 2019 Ritter Building Call to Order: At 7:00PM with all members present. Review of Minutes: Minutes from the meeting on September 10th were read and approved. Ron Dion was present to clarify that he was not a pro- fessional builder. Correspondence: The Town Manager sent an electronic letter to the APDC to clear up the confusion over the APD bylaw. She explained that the town clerk made a formatting error when the bylaw was sent to the Attorney General’s office, obscuring parts of the document including the definition of Demolition by Neglect. She also acknowledged that LaVeck had noticed the omission and notified her at that time. She is currently taking measures to correct the issue. She had discussed the matter with Town Council, who was of the opinion that the error would not affect the validity of the law passed at Town Meeting. McGrath sent letter to Paul Holtz at Mass Historic asking for advice on economic feasibility of renovating a building like the Old Primary School and bringing it up to modern building codes. New Business Ron Dion was present to discuss the Primary School. He had followed Select Board meetings, carefully reviewed the Vertex study, and personally inspected building. He had found few real problems with the building in the report or in his inspection. Dion said that claims of mold contamination and the dilapidated state of building are greatly exaggerated by certain members of the select board. He also discovered the building permit for last roofing job 20 years ago. He expressed annoyance at lack of basic maintenance on the building. Dion also said it was very well-built and has unique historical character for the town center. LaVeck noted that K Adams was preparing a warrant article for the Special Town Meeting on November 12th 2019 for a non- binding resolution to demolish the Old Primary School. The Special Town Meeting conflicted with the APDC regular meeting time, so the board voted to reschedule the meeting for No- vember. The planning board included discussion of the Brooks House with the APDC on their 9-23-2019 agenda. The APDC was notified via the Lunenburg email system, but for various reasons no members of the APDC attended the meeting.
