Townsend Road Pond St one year renewal 48 New West Townsend Road 70 Valley Road 70 VALLEY ROAD Steve Marsden met with the Board on behalf of the owner. The sewage disposal system for this site has failed (effluent was surcharging on the day of the soil testing) and the owner would like to replace it. The lot is small, it has an elevated water table and the house and wetlands take up most of the property. The applicant is requesting a reduction of the groundwater offset from 5’ to 4’; this will help keep the system from needing a pump. The applicant is also seeking a reduction of the Board’s wetlands offset (61’ instead 100’); the re is extensive wetlands to one side of the property and a 100’ offset could not be achieved. The area is served by Town water. After discussion and on Motion by Rabbitt and second by Shea, the requested variances were granted. All in favor. 16 PEARL STREET As per Board of Health Agent, Jim Garreffi, the Title 5 inspection for this property has failed (see the draft of a letter written for the Board) due to a combination of the water ===PAGE 2=== testing and proximity of the well to the sewage disposal system. Title 5 allows the Board to pass a system if they determine “… the system is functioning in a manner to protect the public health and safety, welfare and the environment.” (310CMR15.303 (1) (c) The system serving the property is very recent, the current well is drilled (and replacing it may not solve the problem – given the small lots an d sandy soils in the area) and the nitrogen reduction technologies for small sewage disposal systems generally do not provide enough of a reduction in the nitrate levels in the effluent to solve the levels noted in the well. It was decided the most effective way to handle this situation was to treat the well water. This has been done and the water testing shows the nitrate level in the well is below the standard for a Title 5 inspection. A deed notice is required for the water treatment at the property and the letter I drafted recommends regular water testing to insure the treatment system is working. Based on the above, I don’t have a problem with the passing of this system. I’m not sure what else could be done to remedy the situation. After discussion and on Motion by Shea and second by Rabbitt, the variances were granted. This is an estate. What is being proposed is a 400 square foot Presby System. There was no Title 5 completed. Based on the soil testing completed on the site, it is Agent Jim Garreffi’s opinion that the existing system would fail a Title 5 inspection. Currently, the Board of Health has a septic permit on file for a two bedroom system. Mr. Smith would like to install a three bedroom system. Chairman Emond explained that in order to increase the flow on the system, a full compliant system would have to be installed. At the time of the previous installation, the owner stated that the home was a two bedroom home. The house has not been conveyed since that time. A fully compliant system is not possible on this lot. This house will be limited to a two bedroom dwelling and will require a deed restriction stating same. The soil testing done on the site revealed shallow ledge throughout the lot and the only spot where enough soil is in the back. DEP allows the use of the subsoil. The applicant is requesting a reduction of the ground water offset for the leaching area. This reduction will allow the replacement system to flow by gravity and keep the breakout fill on the lot. The area is served by Town water and there are no wetlands issues. ===PAGE 2=== After discussion and on Motion by Jewell and second by Shea, the requested variances were granted. All in favor. 897 NORTHFIELD ROAD – SEPTIC VARIANCES Mr. Neil Gorman met with the Board on behalf of the owners, Robin and Judy Brideau who were also present. This is a voluntary upgrade . Currently, the system is sitting in groundwater so it would be considered a failure. The site has some restrictions that make it difficult for a fully compliant system to be installed (high water table, location of the well and wetlands). The well location and wetland push the system up into the right hand corner of the house and the high water table prevented a perc test from being performed. Allowing a reduction to the high groundwater table will help minimize the fill heading toward the wetlands. After discussion and on Motion by Shea and second by Jewell, the variances were granted. All in favor. Given the site conditions, there isn’t an alternative and all wells are greater than 100 feet from the proposed system. After discussion and on motion by Shea and second by Rabbit, variances unanimously approved. LUNENBURG FARMERS MARKET Chairman Emond presented a draft copy of a Policy f or Farmers Markets and explained that it was at the request of the Town Manager that a codification of the Farmers Market rules into a policy of the board would be helpful t o provide some governance of this activity. Members Shea and Rabbitt asked why raw meats were not allowed in the draft. Mr. Emond explained that in his research he found t hat although the Massachusetts Department of Agricultural Resources listed Meat an d Poultry as acceptable, the Mass. Department of Public Health list did not and he fel t that this lack indicated that the DPH did not endorse the sale of meat. Also, Mr. Emond said that a Purdue University Extension Service “Food Safety Regulations for Farm ers’ Markets” publication (EC- 740) listed meats as “risky” and it was his feelin g that the Board would rather err on the side of caution rather than risk someone getting sick. A vigorous discussion ensued with Mr. Shea voicing his opinion that he felt that if the risk was great then other cities and towns also wou ld not allow the sale of meat, and ===PAGE 2=== further felt that since others were selling meat, i n his opinion the risk was small. Mr. Rabbit echoed his comments. Mr. Rabbit said that he felt that a Farmers Market should offer as much a variety of items as possible, and felt that meat should be sold. Comments were also heard from Mr. Matt Latanzi, a l ocal farmer who wishes to sell meat at the local Farmers Market. After further discussion, Mr. Emond offered an amended copy of the draft for motion. A motion was not forthcoming and the policy was not adopted. Mr. Shea then offered the following for consideration : “The intent of this policy is to insure that farm p roducts sold at any farmers market within the Town of Lunenburg are sold subject to th e conditions within these guidelines so as to insure the health of those who will purchase these items. Vendors of potentially hazardous foods (meat, chees e, tofu and fish) are responsible for complying with all requirements and licenses se t by the town of Lunenburg, the Commonwealth of Massachusetts and the Federal Gover nment and need to provide a certificate of their local Board of Health permit with their applications. “ Mr. Rabbitt made a motion to accept the above as th e Lunenburg BOH Policy regarding Farmers’ Markets. Mr. Shea seconded. Mr. Shea and Mr. Rabbitt voted for the policy, Mr. Emond voted against. The policy is adopted by a vote of 2 to 1. Mr. Lattanzi handed out copies of his qualifications to sell meat to the board members. HABITAT FOR HUMANITY A representative of Habitat for Humanities asked the Board for permission to park up to 6 Recreational Vehicles at Shady Point Campground fro m September 25, to October 9, which period is after the normal seasonal closing, while their group performed work in the area. The property before the board has been in Mr. Cole’s family for many years. It is just under one acre in size so meeting zoning requirements. What is being proposed is a residential structure limited to two bedrooms. Although no testing has been completed, it is intended that a system be installed that meets all Title 5 requirements and regulations however, would not meet local regulation of 100 foot offset to wetlands. (This regulation work s in tandem with Conservation Commission Regulations). Mr. Gorman and Mr. Cole would have to meet with the Conservation Commission and get their approval on a reduction to wetland. Dave Shea indicated that he would be open to a reduction in offset to wetlands as is being proposed which is 100’ required, 57’ proposed. Oth er board members are in agreement. Troy Daniels wanted to be sure that Mr. Gorman would not use the Board of Health discussion as leverage with the Conservation Commission. The Board would request a drilled well. 281 WEST STREET – RIDDLE Steve Marsden met with the Board representing the owner of the property. This is a failed system. This is a very small lot, slope, high water table and restrictions as to where a system could go because of the location of the house and pool. The system being proposed requires an easement from the adjoining property owner. In addition, a strip of land along the rear of the property we be transferred from the adjoining property owner. ===PAGE 2=== Mr. Marsden advised that an ANR Plan for the subdivision of land as well as the required easement had been submitted to the Planning Board. Due to the proximity of the septic system to the property line, Agent Jim Garreffi stated that abutters were required to be notified of this hearing. Mr. Marsden did not send the required notification. Mr. Marsden suggested that he could move the proposed septic system back marginally to meet the setback without requiring the notification. After discussion and on motion by Rabbitt and second by Shea, the Board approved the request conditioned on the ANR being approved, the easement being granted and recorded and the strip of property at the rear of the lot being conveyed. All in favor. 607 RESERVOIR ROAD – TITLE 5/WELL TESTING John and Virginia Glover, owners of the property, met with the Board with regard to the Title 5 inspection performed on their property. The report was submitted as a Conditional Pass due to the proximity of wells to the septic system. At the time the report was completed, all of the well testing was not submitted. Subsequently, well testing was completed for the three wells as described in Title 5 for fecal coliform, nitrates, nitrites and ammonia. The results of the water test complied with Title 5 although the well for 609/611 had evidence of total coliform bacteria. Agent Garreffi called the owner of the property and advised not to drink the water until he chlorinated and retest his well. Agent Jim Garreffi advised that he will send a letter to the owner of 609/611 Reservoir Road. In accordance with Title 5, the Board can accept the Title 5 as a passing report. On motion by Rabbitt and second by Daniels, the Board voted to accept the Title Report as passing. All in favor. NEW DPW STORAGE BUILDING The building permit for the construction of the new DPW storage building was submitted for signature. After review, Chairman Emond signed same on behalf of the Board of Health conditioned on there being no toilets or sanitary facilities in the building. REORGANIZATION OF BOARD Chairman George Emond stepped down as the Chairman of the Board Health. Nominations were held. Jack Rabbitt nominated Troy Daniels, nomination was seconded by Dave Shea. Mr. Daniels accepted in the nomination and was elected unanimously. Having no further business before the Board, the meeting was adjourned at 8:32 pm. ======================================================================================== DOCUMENT : 2011-09-19-agenda-862.txt BOARD : board-of-health DATE : 2011-09-19 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/board-of-health/2011-09-19-agenda-862.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_09192011-862 ======================================================================================== ===PAGE 1=== Lunenburg Board of Health MEETING NOTICE Ritter Administration Building 960 Massachusetts Avenue Lunenburg, MA 01462 978-582-4146, Ext. 430 Contact: Andrea Schnepf Troy Daniels, Chairman Dave Shea, Vice Chairman George Emond Perry Jewell John Rabbitt page 1 of 2 DAY AND TIME OF MEETING: 7:00 p.m. MONDAY SEPTEMBER 19, 2011 LOWER LEVEL CONFERENCE ROOM, RITTER ADMIN. The f irst Septic System Abandonment Permit was handed ou t in conjunction with connection to sewer on the above p roperty. Upon receipt of the completed permit by t he Board of Health office, it was noted that the destr uction of the system was not inspected and not sign ed off on. The installer stated that he had called for an insp ection but no one was available. He could not leav e the trench open. After discussion, it was decided that a letter woul d be sent to the installer advising that due to the fact that the board holds him in high regard, the board would acc ept a certification from him that the system was de stroyed. This certification would allow this connection/dest ruction to be completed, however, in the future all policies and procedures would have to be followed. 176 SUNNY HILL ROAD Doug Smith met with the board on behalf of the owne r. This system is in failure. Most of the acreage is in the rear of the property which is also wet, may contain wetlands and slopes upward. Installing the system in the back would require significant fill and a pump and pump chamber. What is being proposed is to install the system in the front of the property utilizing a three foot gr oundwater offset and the use of a cultec system. ===PAGE 2=== After discussion and on motion by Rabbit and second by Jewell, the requested variances were approved. Testing was completed in both the front and rear of the lot. What is being proposed is to place the new system on the high side of the lot ( at the rear of the property) . This would keep the new system away from the well and we tlands. The requested reduction in ground water of fset will allow the fill to for the new system to remain on the lot and not encroach on driveway. The use of a Presby system will allow a reduction in the footprint of the system. After discussion and on Motion by Jewell and second by Rabbitt, the variance was approved. All in favor. This system is in failure. This is a smal l, lake front lot. Variances for a reduction in groun dwater as well as a reduction in separation are bei ng requested. Mr. MacKenzie did not have the required proof of notification to abutters. Chairman Emond told Mr. MacKenzie that lacking proo f of notification of the abutters, the Board could not vote on the plan, but would nonetheless examine it. Examining the proposed plan, it was noted that it utilized a Presby disposal system. Agent Jim Garreffi recommended in his notes to the Board that his recommendation is that the new system serving this property include pre-treatment such as offered by a FAST or Jet system type, due t o the proximity to the well and the location of the w ell downgrade of the system. The Presby does not provide pre-treatment of effluent. If pre-treatment is not provided, Mr. Garreffi is recommending a ti ght tank. All Board members present agreed with this as sessment. Mr. MacKenzie withdrew the request for consideration of this plan. 828 LANCASTER AVENUE Chris MacKenzie met with the Board on behalf of the owner. This is an older home with the system in failure. In attempt to avoid the wetland and main tain the required well offset, the new system was designed across the driveway in the front of the pr operty. A reduction in groundwater offset as well a ===PAGE 2=== reduction in separation is requested in order to lo wer the profile of the system and maintain the driv eway grade. After a presentation of the plan a motion was made by Jewell and seconded by Rabbitt, the requested variances were approved by unanimous vote. 436 MASSACHUSETTS AVENUE Ruth Ann White met with the Board to discuss her de sire to open a Reiki practice at property she owns at 436 Massachusetts Avenue. The property is commercially zoned, presently housing a real estate business. The property was a former residence with a 3 bedroo m septic. The current flow for the office is much less than it would be for a dwelling. Ms. White’s business plan indicates 5-6 clients per week with a n average visit time of 30-60 minutes. Also much less than a residential dwelling would require. Ms. White explained that Reiki is a Japanese techni que for stress reduction and relaxation that also promotes healing. It is administered by "laying on hands" and is based on the idea that an unseen "lif e force energy" flows through us and is what causes u s to be alive. If one's "life force energy" is low, then we are more likely to get sick or feel stress, and if it is high, we are more capable of being happy a nd healthy. It is not ‘massage’therapy. Since this p ractice is not regulated, and the septic system is adequate for the proposed use, the Board has no objection to this use. On motion by Rabbitt and second by Jewell, the requested was approved. All in favor. 11 SPRING STREET EXTENSION Potential purchaser, John Cote, met with the board to discuss this property. A con ditional pass Title 5 Report was submitted. This was due to the location of the well and its distance from the septic syste m. A new well was proposed in the past but never install ed. It would not be feasible to install the well a s permitted as the present owner cannot gain access to the rear of the property. Previous history of this property showed that there had been a failed water test in the past during a previous Title V inspection. However, two subseque nt water tests showed no failure and the need for a new well was apparently non-existent. To clarify the matter again, the Board agreed that a new water test of the current well to include, but is not limited to, arsenic and nitrates will be required prior to the Board approving the conditional Title V. On motion by Jewell and second by Rabbitt, the requirement for a water test was approved. All in favor. EAGLE HOUSE Dan Proctor has been awarded the contract for the r emoval of the septic mound at the Eagle House Senio r Citizens Center. Agent Jim Garreffi met with Mr. P roctor earlier in the day. It was suggested that M r. Proctor account for all the material removed from t he mound and its ultimate destination as well as obtaining a destruction permit and soil sample. The Board was in agreement. ===PAGE 3=== ARO ESTATES Mr. Kevin O’Brien, developer, together with Brian M ilisci of Whitman and Bingham met with the Board to inform them of their plans for the development o f the old Aro chicken farm on Howard Street and to get their comments on their proposal. The initial proposal is a 94 lot cluster developmen t with all the homes being a four bedroom design. This proposal shows a layout that would require 5 separa te shared systems with residential buildings circli ng them. The areas over the systems would be used for recreational purposes. The 5 systems would have a total capacity of about 40,000 gallons per day. Mr. O’Brian is considering using shared septic syst ems as part of the development of this property and came to the board to see if that would be possible. George Emond stated that the Town of Lunenburg, Board of Health, has a regulation that requires a septic system to be on the property that it serves. This regulation would make it impossible for a shared sy stem. Further, Mr. Emond learned through a brief telephon e conversation with Robert Kimball of the Central Region DEP, that each lot would have to be proven to have the ability to support a fully compliant Title V system. Mr. O’Brien thanked the Board for its time and comm ents. Meeting adjourned at 9:00 pm.
