As part of that approval, the board required that the second residence on the property be “stripped down” to studs so that it could not be us ed as a residence in the future but only for storag e purposes. At this point in time, the tight tank has been inst alled and the camp renovated into a year ‘round residence. The board is being asked when they are requiring that the second residence be converted in to storage space. After a review of the original minutes, it was dete rmined that the additional residence must be conver ted into storage space prior to a Certificate of Occupancy being issued. This system is in failu re. This is a small, lake front lot. Variances for a r eduction in groundwater as well as a reduction in separation are being requested. On December 19, 2011, when this matter was original ly heard, Mr. MacKenzie did not have the required proof of notification to abutters. Chairman Emond told Mr. MacKenzie that lacking proof of notificati on of the abutters, the Board could not vote on the pl an, but would nonetheless examine it. Examining the proposed plan, it was noted that it utilized a Presby disposal system. Agent Jim Garreffi recommended in his notes to the Board that his recommendation is that the new system serving this property include pre-treatment such as offered by a FAST or Jet system type, due t o the proximity to the well and the location of the w ell downgrade of the system. The Presby does not provide pre-treatment of effluent. If pre-treatment is not provided, Mr. Garreffi is recommending a ti ght tank. All Board members present agreed with this as sessment. Mr. MacKenzie withdrew the request for consideration of this plan. Mr. MacKenzie is again before the Board with the sa me plan utilizing a Presby System and no pre- treatment. Mr. MacKenzie did provide the required green cards. Mr. Mackenzie stated that adding pre- treatment to the system would add considerable cost . Agent Garreffi stated that due to the proximity of the new system to the surround wells, he is still r ecommending pre-treatment. Mr. Garreffi further st ated that we have to assume that this will become a year round residence and there is potential to contamin ate the surrounding wells. After further discussion it was decided that the Bo ard has not changed their decision of December 19, 2011 requiring pre-treatment to be added to this system. ===PAGE 2=== On Motion by Jewell and second by Shea this matter was continued until Monday, March 5, 2012 at 7:00 pm. 53 EASTERN AVENUE Russ Wilson of R. Wilson and Associates met with th e board, together with Owner Jim Russell and Bob Donal. This system is in failure. Like most of Ea stern Avenue, shallow depth to ledge was noted on t he property. Extensive testing was conducted on the l ot, he location of the system is in the area where the most soil is available. The house is served by pub lic water. The only other alternative would be a t ight tank. After discussion and on motion by Jewell and second by Passios, the variance was approved. All in favor. 263 ELMWOOD ROAD Attorney Louis Levine, together with resident Cindy Berry Howe and friend Sharon Taylor met with the board to discuss business that is being conducted a t 263 Elmwood Road. Ms. Berry lives at 265 Elmwood Road and shares a driveway with 263 Elmwood Road. Mr. Levine stated that Mr. Albertini, of 263 Elmwoo d Road, runs a business called Foam Alone, Inc. Because there is a shared driveway, this causes tru cks to travel along the driveway at all hours of th e day and night. According to Attorney Levine and Agent Jim Garreffi , this matter was brought before the Zoning Board of Appeals. Due to a possible conflict of interest on the part of Lunenburg Building Inspector Mike Sauvageau, who lives on Elmwood Road, Ed Cataldo, L eominster Building Inspector conducted the inspection on behalf of the Zoning Board of Appeals . Mr. Cataldo did not find any violations. The zoning Board of Appeals asked for further informati on and Mr. Cataldo provided information sheets. Agent Garreffi also provided the Zoning Board of Ap peals with information. Mr. Levine advised that there is no written record of Mr. Cataldo’s inspect ion. He further advised that he is frustrated with the lack of reports and information available on this matter. Mr. Levine acknowledged that the Fire Safety Office r made a site visit and found that there were no hazardous materials stored on site. Neither the rep ort of Mr. Cataldo nor the Fire Safety Officer were available for the Board to review. Further, Attorn ey Levine provided the Board with a copy of the Lunenburg Zoning Regulation that requires disclosur e of hazardous materials to both the Fire Departmen t and the Board of Health. After discussion, it was decided that the Board wou ld request the following information from Mr. Albertini: What material is being used How the material is being stored How the material is being transported What is done with leftover material A listing of the chemical composition Once this information is received, the Board will again review this matter. Meeting Adjourned 8:42 pm. ===PAGE 3=== Subsequent to the meeting being adjourned, Ms. Lind a Gilmette, tenant at 605 Mulpus Road, addressed the board with a request for minutes of the meeting on February 6, 2012. The home has a four bedroom septic system and currently has four bedrooms with a total of 9 rooms. What is being proposed is an a ddition to include a great room, study and a sun ro om. This would bring the total number of possible bedrooms above the allowed four. The owner asked if a deed restriction could be plac e on the home limiting it to four bedrooms. Chairm an George Emond explained that the only instance where a deed restriction is considered by the board is i f the room count is existing. It would not be considered for new construction. After discussion, it was determined that the buildi ng permit would be signed if the openings to the st udy and sun room were opened up to be greater than four feet and no doors were placed on the opening (case d opening). It this way, there would be no “privacy” in these rooms. The owner agreed to this revision. The building permit was signed subject to the agreed revisions. 425 LEOMINSTER ROAD The property owner, Mike Hayes met with the board t o discuss putting and addition onto this home. Currently, this home has a three bedroom and a tota l of seven rooms. What is being proposed to add a den with a bedroom over. One current bedroom would be removed to allow the addition but keep the bedroom count at three. ===PAGE 2=== After discussion, the board allowed the addition pr ovided that the openings to the existing office and den, which currently qualify as bedrooms under Title V, have at least four foot cased openings. There can be no further additions to this home without the upgrade of the septic system. KERRY SPEIDEL Town Administrator, Kerry Speidel, met with the boa rd to discuss the budget and upcoming changes to hours and personal for the land boards. Ms. Speide l provided the board with a number of different alternatives for the staffing of the land boards based on the funds available. The Board noted that the Board of Health Administra tive Assistant is not funded, in its present form, in either balanced budget or the override budget shoul d it be passed. At best, it is funded at 20 hours per week as a combined position. Chairman George Emond stated that the board believe s that in order to complete their responsibilities as charged by law, the Board of Health needs to be a s eparate entity with a dedicated Administrative Assistant and not a combined position. Further, th at according to statute, the Board has the power to appoint and set the salary of their employees. Als o that the two positions that are being reduced fin d it difficult to accomplish all that is necessary in th e time allotted and to reduce it more would make it impossible to complete the necessary tasks. After discussion, the Board advised that all positi ons in the land boards should be equal with all pos itions being retained and available hours divided equally between the four administrative assistants. Under the balanced budget this would mean that each administr ative assistant would work 27.5 hours. Vice- Chairman, Perry Jewell, stated that with an overrid e of this magnitude, should it pass, all positions should be re-instated. If they cannot all be reinstated t o their present level, the available hours should b e divided equally between the four administrative assistants, with each working 30 hours per week. Ms. Speidel stated that she would take this under advisement. 35 BOUCHER ROAD Greg and Lori Menafo, owners, met with the board to request putting an addition on their home. Currently, this is a split ranch with three bedroom s and a finished basement. There is an additional bathroom in the basement. What is being proposed i s the additional of a great room with a garage underneath and a master bedroom. One original bedroom would be eliminated to keep the bedroom count at three. With the lower level of the home being f inished to include a bathroom, the Chairman, George Emond, advised Mr. and Mrs. Menafo that they were a lready over the limit for what could be considered bedrooms and total rooms in the home. The finishin g of the basement was done with a permit and signed off on by the Board of Health Agent at the time. After a lengthy discussion and on Motion by Jewell and second by Rabbitt, the board voted to place a deed restriction on the property limited same to th ree bedrooms. Once the deed restriction is signed and recorded, the building permit for the addition can be signed. There can be no further additions to th is house. All in favor. LOT 1, SEQUOIA DRIVE Owner Dan Pierce and Chris MacKenzie of Whitman and Bingham met with the board to discuss an expired septic permit on the above lot. The well i n question is the original well that was on this si te prior ===PAGE 3=== to subdivision. The Well is 39 feet from the prope rty line. Mr. Pierce is asking that the variances that were originally granted for this lot be granted again. The variances requested are: Inter-fingering of the reserves trenches and well l ess than 50 feet from a property line and a public way, 39 feet is proposed. After discussion and on motion by Jewell and second by Rabbitt, the variances were approved. All in favor.
