The current sy stem is a leach pit in the groundwater and is in failure. This is a very difficult site. The lot i s small, surrounded by wetlands and has a high wate r table. A JET system is being proposed. There are numerous variances being requested: Setback from leach field to property line, setback from component (tank) to slab, setback to wetlands, offset to ground water (4 feet to 2 feet), sieve an alysis, reduction in the number of deep holes. The only alternative to the system being proposed would be a tight tank. Notification to abutters of Title 5 Variance reques t, offset to groundwater four feet to two feet in conjunction with a reduction in offset to wetlands, was provided by Mr. MacKenzie. After discussion and on Motion by Jewell and second by Fortin, the requested variances including the Title 5 variance were approved. All in favor. 401 HOLLIS ROAD Chris MacKenzie and Bob Proctor met with the board. This system is in failure. The lot is served by town water. The ground was wet on the day of testi ng and a perc test could not be done. A soil sampl e was submitted for testing and a sieve analysis is b eing requested in lieu of a perc test. In addition , variances reducing the offset on inlet and outlet t ees to less than 12 inches and offset to groundwate r are requested. A new tank is required. ===PAGE 2=== After discussion and on motion by Jewell and second by Passios, the requests were approved based on th e plan as proposed. All in Favor. 28 KIMBALL STREET Doug Smith met with the board of behalf of the owner. This system is in failure. This lot is very small with high ground water and the existing structure takes up a good portion of the lot. The lot slopes to the back of the house. The designer has proposed the use of a Presby leaching area which allows, by its DEP approval, up to a 2’ reduction in the groundwater offset. The designer is looking for that approval as well as offset reductions for the leaching area from the property line (7’ instead of 10), septic tank from the property line (5’ instead of 10’) and the septic tank from the cellar wall (5’ instead of 10’). The reductions allow a system to be sited on this lot while minimizing surface run off onto the abutters. Since the area is served by Town water and the affected abutter is on the uphill side of the grading (should not affect the abutter) I don’t have a problem with the request. On motion by Fortin and second by Passios, the variances were approved. All in favor. Chairman Em ond read correspondence sent to Town Manager Kerry Speidel asking for an opinion from Town Couns el as to whether or not the Select Board could take control of the monies currently being held by the B oard of Health. Chairman Emond read the response which was given orally to Ms. Speidel which did not answer the question posed. . The Chairman gave a brief history of the grant for members who were not on the Board at the time. He also noted that several years ago he had discussion s with the EOC several years ago on the possibility of using the repaid portion of the Grant to maintain t he Sewer System since there had been few inquiries over the years. Those who did inquire were directed to several other agencies where outright grants without repayment might be available. Mr. John Perk o, who had worked on the program during its inception, responded that it would be an appropriat e use since it would address sanitary waste issues, but could be only used for maintenance or repair of exi sting sewer. Expansion of the system would not be appropriate. The plan was not followed up because of objections of one of the Board members. ===PAGE 2=== Perry Jewell stated that he feels that the Warrant Article makes is appear as if this is a new program . Mr. Jewell does not believe that the response reviewed from Ms. Speidel addresses the original question of whether or not the Select Board can take control of money already under the control of the Board of Health. Chairman Emond stated that he made an inquiry on Tu esday May 24 th asking Ms. Speidel if Counsel had responded to the legality of Article 22. No respon se had been received at that time. Later that week, Ms. Speidel responded that Counsel had responded that t he BOS could establish such a revolving fund, with the caveat that it would be unusual to do so. The r esponse did not address the core issue of whether t he BOS could capture the funds from the BOH. Chairman Emond spoke with Ms. Speidel for clarification, which to date has not been received. Perry Jewell stated that he has four major concerns with Warrant Article 22 as follows: 1. This matter should have been brought to and discussed with the Board before moving forward. 2. What is the driving desire or need to address this issue by warrant article at Annual Town Meeting? 3. Town Counsel has not answered our original question as to whether the Select Board has the right or power to take control of the funds. They are grant funds given specifically to the Board of Health. 4. The feeling that the Select Board is getting involved in and taking control of every aspect of town government. The members of the Board are in agreement with these four major concerns. Chairman Emond also stated that he has seen a recent pattern of the Select Board involving themselves in the affairs of other Elected Boards and Committees and is concerned that this interference is possibly responsible for the lack of interest of our citizens in volunteering for public service and participation in town government. At the end of the discussion, on Motion by Jewell and second by Fortin, the board voted to authorize Dave Passios to speak on behalf of the Board of Health at the Annual Town Meeting to be held on Saturday, May 2, 2015. Mr. Markey is requesting a well variance as follows: Setback from a property line, 50 feet required, 25 feet proposed. Currently, there is a commercial structure that is served by public water. Mr. Brianas is proposing t o construct a new building, which will include a rest room. The cost of running public water to the new building is prohibitive. He is proposing to drill a well which will only serve the new building, keeping the existing building on public water. Mr. Garreffi has concerns with cross con tamination between the well and public water as wel l as contamination from chemicals stored in the new building. The sanitarian at Nashoba that handles food service is Bridgette Braley and she can issue the permits as necessary. Meeting adjourned at 8:05 pm SEPTIC SYSTEM GRANT Chairman Emond discussed the history of this grant. At this point in time there are two options for t he use of this money, either in the repair/ maintenance of a current system or in the re-loaning of the f unds to Lunenburg town residents. In addition, management of the grant can be internal or through an outside agency. Dave Passios discussed the criteria for lending the money to residents, as follows: 1. Defining a needs area 2. Establishing income criteria 3. Whether the program would include utilizing the funds for tie into sewer. ===PAGE 3=== 4. Loan would be repaid on conveyance. 5. There must a Title 5 Inspection completed showing a failed system and certified by the Board of Health. 6. Mr. Markey advised that he has redesigned the plan and both the proposed building and existin g building will now be served by the well and publi c water will be disconnected from the existing struct ure. Mr. Markey is requesting a well variance: distance from a property line from fifty (50) feet to (25) feet. Agent Jim Garreffi advised that he does not see a p roblem with the granting of this variance with the following three conditions: 1. That the well does not negatively affect the abutter. 2. The Lunenburg Water District certifies that the cur rent connection to the District system has been disconnected from the existing building. 3. The engineer provides a revised septic plan showing town water being disconnected from the existing building. Public sewer is available to the abutting property. Chairman Emond suggested that if, at any time, the abutter needs the use of the 25 feet, then an agreement must be reached or the well discontinued. A releas e from the current property owner of the abutting property will eliminate this condition. David Passios clarified that this is an either/or situation. Either the owner of 1259 Massachusetts Avenue obtains a releas e from the current owner of the adjoining property if at any time in the future, that owner needs the use of the 25 feet lost because of this variance, u se of the well would be discontinued and a connection to the Water District would be made. ===PAGE 2=== After discussion and on Motion my Passios and secon d by Jewell, the variance was approved with the above condition. SEPTIC SYSTEM GRANT Chairman Emond discussed the history of this grant. 4. Loan would be repaid on conveyance. 5. There must a Title 5 Inspection completed showing a failed system and certified by the Board of Health. 6. Mr. Sweeney is subdividing the property into four lots and asking if the board will entertain a well variance of less than fifty feet on one o f the lots. A plan was shown. The placement of the proposed lo t will not affect any of the adjoining lots. The members of the board stated that they would not have a problem with the request when it was submitted. 647-649 RESERVOIR ROAD – PRELIMINARY VARIANCE DISCU SSION Dan Proctor met with the board on behalf of the own ers, John and Robin Sodano who recently purchased these properties. The Sodano’s own both properties . 647 is a larger lot with a fairly new septic sys tem. 649 is a very small lot with a two bedroom cottage with an existing system 30 feet from the lake. The larger property (647) is .61 acres and the smaller property (649) is .34 acres. The larger property i s not big enough to deed the required property to the smaller lot. The well serving the system is most likely less tha n fifty feet from the existing system. Mr. Proctor is asking that the leach field for the smaller propert y be placed on the larger property with an easement for same being granted. Perry Jewell asked if what was being proposed was a shared system. Mr. Proctor stated that what is being proposed is not a shared system. They are asking t hat the leach field be placed on the adjoining prop erty and an easement granted. Dan Proctor stated that t he system on the smaller lot is mostly likely in fa ilure and Mr. and Mrs. Sodano are anticipating that the c ottage will be occupied. The owners of the propert y would like to keep the two lots in separate ownersh ip. Passios asked if the present owners were aware of the problem when they purchased the property. They responded with a yes. Chairman Emond stated that the board has a regulation that states that the septic system must be on the lot it serves. ===PAGE 2=== After discussion it was the consensus of the board that should this request would be denied if an offi cial request was made of the board. 338 SUNSET LANE – PRELIMINARY VARIANCE DISCUSSION Jeff Viviano, the prospective owner of the property met with the board. Also present was the current owner, Alton Cole, as well as Carl Luck and Sally Luck. Mr. Cole gave a history of this lot. His family ha s owned this lot in excess of sixty-five years. It was his family’s intention to build on this lot, but at thi s point in time there is no one in his family that is interest in building on this lot. Mr. Cole advised that he had met with the board in 2011 to ask if the board would consider a reduction in the offset to wetlands. At that time board responded that yes, they would con sider a variance. Prospective buyer had come before the board in Augu st. At that time, the concerns voiced over the improvement of this lot included protecting Lake Sh irley from increased nitrates that a location of le ss than 100 feet could cause. Mr. Viviano stated that he is proposing building a two bedroom. Mr. Vivia no stated that he is also scheduled to meet with the C onservation Commission. At a recent Conservation meeting, the plan for the location of the house was approved after a shoreline mediation, contingent u pon a revised plan being submitted. Mr. Viviano did research to find a system that would more adequately protect the wetland. Mr. Viviano is proposing a Microfast system which would further tr eat the effluent and he discussed the science of th is system with the board. Mr. Viviano provided handouts describing the system and how it works. Perry Jewell agreed that this system vs. a conventional system would reduce nitrates. Agent Jim Garreffi stated that this would be the fi rst time this type of system is being proposed specifically to reduce nitrates. The data shows th at nitrates will fluctuate and further, that this t ype of system does not perform equally well in colder weather. Sally Luck, abutter at 352 is not in favor of granted the requested variances. Ms. Luck is concerned about her well. Agent Jim Garreffi stated that Ms. Luck has a drilled well and should not be affected by th e system. Carl Luck also lives on Lake Shirley and is a membe r of the Conservation Commission. Mr. Luck stated that the Conservation Commission has no comment on septic system matters. Mr. Luck stated that the Board of Health has regulations for a reason and wo uld like to see them enforced with the understandin g that waivers are granted for repairs. Chairman Emo nd stated that the variance request process allows the board and opportunity to review each plan on its own merit. After much discussion the board took a vote to see if the members would look favorably on variances fo r this system, namely a reduction in the offset to we tlands from 100 feet to 54 feet and trenches within trenches. George Emond voted no, all other board members were in favor with the understanding that when a revised plan was submitted it would not deviate from what was discussed at the meeting. ===PAGE 3=== 136 SUNNY HILL ROAD Dan Proctor met with the board on behalf of the owner. This is a difficult site and the system is in failure. They are requesting a reduction in groundwater offs et from four feet to three feet as well as a sieve analysis. Agent Garreffi stated that he believes that this is a reasonable solution for the failed system. After discussion and on motion by Jewell and second by Passios, the variances were requested. All in favor. 32 BOUCHER ROAD Doug Smith met with the board on behalf of the owne r. This system is in failure. This is a very smal l lot that is wet. Testing was completed in the open are a and it was not successful. Testing was next done in the wooded area of the lot in an area in excess of fifty feet from the wetland. The current placement of the proposed system is in the best possible place on this lot. After discussion and on motion by Jewell and second by Fortin, the variances were approved. All in favor. 129 ROLLING ACRES ROAD Dan Proctor met with the board on behalf of the own er. This is a small lot, the system is in failure. A groundwater offset from four feet to three feet is being requested. After discussion and on motion by Passios and second by Jewell the variance was approved. All in favor. 140 FLYNN ROAD Agent Jim Garreffi discussed this property with the board. The owner of this property tried to deep t he well on this site. In the process, the well collapsed. A new well needs to be drilled on the other side. It is the only place on the site that a rig can get in to drill a well. Placement of the new well requires the following offsets: Property line offset from 50 to 15, offset to septic system, 85 feet. After discussion and on motion by Jewell and second by Passios, the variances were approved. All in favor. All in favor. 223 PLEASANT STREET Chris MacKenzie and Bob Proctor met with the board on behalf of the owners. This system is in failure . The water table is very high which prevented a perc test. A variance for the use of a sieve analysis is being requested. Because of the high water table, a groundwater offset from 4 feet to 2 feet is being requested. In addition, because of the size of the lot, a reduction in the distance from the septic tank to the cellar wall from ten feet to six feet is being requested. After discussion and on motion by Jewell and second by Passios, the variances were approved. All in favor. 466 W. TOWNSEND ROAD The prospective owner, John Romano, met with the board. A new well was drilled on this property. The old, shallow well, has been fully disconnected but not destroyed. Mr. Romano is requesting to retain the old shallow well to be used for irrigation purposes. The newly drilled well has tested positive for arsenic and now has a filtration system installed. If the new well was used for irrigation purposes, the substrate used for filtration would deplete quickly. Chairman George Emond discussed and explained why typically only one source of water is permitted on a lot. He further stated that should the second shallow well be allowed to remain, that there could only be ===PAGE 2=== one spigot connected to the well and there be a deed notion that the shallow well is to be used for irrigation only and is not a potable source of water. On motion by Jewell and second by Fortin, the request to keep the second shallow well was granted with the above conditions. After discussion and on motion by Passios and secon d by Jewell, the variance of offset to property lin e from 50 feet to approximately 25 feet was approved. He further stated that should the second shallow well be allowed to remain, that there could only be ===PAGE 4=== one spigot connected to the well and there be a deed notion that the shallow well is to be used for irrigation only and is not a potable source of water. On motion by Jewell and second by Fortin, the request to keep the second shallow well was granted with the above conditions. All in favor. 727 WEST STREET Chris MacKenzie and Bob Proctor met with the board on behalf of the owner. This is a difficult site a nd the system is in failure. Ground water is at 20 in ches. They are requesting a reduction in groundwat er offset from four feet to three feet as well as a sieve analysis. Agent Garreffi stated that he believes that this is a reasonable solution for the failed system. After discussion and on motion by Jewell and second by Passios, the variances were requested. All in favor. 570 LEOMINSTER ROAD Dan Proctor met with the board of behalf of the own er. This system is in failure with high ground wat er. Although this lot is large, is has a significant sl ope making compliance difficult. A reduction in th e groundwater offset from 4 feet to 3 feet, will help with breakout grading. After discussion and on motion by Jewell and second by Fortin, the variances were approved. All in favor. SEPTIC SYSTEM LOAN PROGRAM Dave Passios provided an update on the Septic Syste m Loan Program. Mr. Passios has had an opportunity to review the available files in the bo ard of health office as well as the information rec eived from neighboring towns. Mr. Passios suggested that a working session meeting be scheduled to discuss the guidelines that will be implemented as well as the documents required. After discussion, a date of November 9 th at 7:00 was scheduled. Meeting adjourned at 8: 45 pm. ======================================================================================== DOCUMENT : 2015-10-06-agenda-940.txt BOARD : board-of-health DATE : 2015-10-06
