This system would be considered a failure due to the estimated high ground water. The site has high ground water, is flat and the location of the structures on the site made designing a replacement system a challenge. Variances requested are offset to groundwater from four feet to three feet and reducing in inlet and outlet tees. After discussion and on Motion by Jewell and second by Fortin, the variances were approved. All in favor. 245 WEST STREET Gerald Lane met with the board. There have been ongoing issues with an outdoor wood fired burner on the site. The smoke from this device has been migrating into the neighbor’s yard and getting into their garage. Unlike woodstoves these devices work on a thermostat and have a tendency to smolder between demand for either heat or hot water. Once a call for heat, the fire reignite and the emission for the smoldering fire exit the unit until and normal burn is achieved. Agent Garreffi has viewed the site on a number of occasions and has not been able to document an issue with the opacity of the smoke but this unit meets the offset requirements in the regulations enacted in 2008. The affected owner’s complaint is based on 310CMR Section 7.00 – Air Pollution A cease and desist order was issued by Agent Garreffi after discussions with DEP. Before the cease and desist could be lifted the unit would have to operate so as not to cause a condition of air pollution. ===PAGE 2=== After discussion, the board agreed to lift the cease and desist under the condition that it would only be for a limited time to ascertain whether an attempt to solve the problem with air pollution had been achieved. Should the burner be moved, stack raised or trees trimmed in an effort to remove the issue of air pollution, a request would be made to Agent Jim Garreffi for approval. Once completed Agent Garreffi would be present when the burner was lit to determine if the change in situation eliminated the condition of air pollution. TC PASSIOS SCHOOL CAFITERIA Agent Jim Garreffi provided an update on the possible use of the TC Passios School Cafeteria as a community kitchen. His response follows. Since your meeting on this matter I have spoken to the Town Administrator and a selectman. I emphasized the need for more information on what is envisioned for the site. Once the Town had a plan for the site the Board could provide a more complete review of the proposed operation with regards to the regulatory requirements. Listed below are my previous comments to the Board. Bridgette and I visited with the Manager of the Worcester Food Hub (regional kitchen facility); they have a fully functional kitchen that can be used by the public as a commercial kitchen. Here are some major points regarding their operation. 1.) It is a managed facility, the Manager schedules individuals to use the kitchen and is present during all hours the facility is open (9-5, M-F). 2.) Only one individual is allowed to work in the kitchen at a time. 3.) The facility is licensed by the Board of Health and the individuals are licensed by the Board of Health. 4.) Individuals go through an application process with the Food Hub prior to getting permitted by the Board of Health; the Board of Health does a preopening inspection before issuing individual licenses. The facility sends a quarterly report of all permittees using the facility; he mentioned that they have had individuals who go through the permitting process, obtain a permit but never use the kitchen – they work out of their house (the kitchen has a nominal cost ($25/hour)). 5.) Any on-site food storage by individuals is in locked cages. At that time variances for offset to wetlands, off to property line and offset to cellar wall were approved. There is a new owner of the property that wished to re-design the system in a way that will be less of a burden on the property and will reduce the number of variances required. The new system design requires offset to wetlands (shoreline) and requires the use of a monolithic septic tank. This is a long narrow lot with water on two sides. The new design moves the system the proper distance from the house put closer to the water. This new location grading does not require a retaining wall. After discussion and on Motion by Fortin and second by Jewell, the changes and associated variance were approved. All in favor. BUDGET The yearly budget for Board of Health was prepared. The budget is level funded with an increase to salary based on employment contract and a 5% increase to Nashoba Associated Boards of Health also based on agreement. After discussion and on motion by Fortin and seconded by Jewell the budget was approved. All in favor. This system is in failure. Soil testing showed a shallow depth to ledge throughout the lot and high groundwater. The system, as proposed, is in the area of the lot with the deepest soil but there is no area on this site with the required 4 feet of soil. Therefore, variances for inlet and outlet tees and less that 4 feet of pervious soil are requested as the new system would offer the best option for the repair of the system. This system is in failure due to high ground water. The lot is small and irregular. A variance for a reduction in offset to groundwater is being requested from 5 feet to 4 feet is being requested. This will allow better grading on the site. After discussion and on Motion by Pa ssios and second by Fortin, the variance was approved. All in favor. 1190 NORTHFIELD ROAD Neil Gorman met with the board on behalf of the owner. This system is in failure due to high ground water. This lot also has a steep slope. A Presby system is p roposed. DEP allows a groundwater reduction of up to 2 feet for replacement system. Variances being requested are reduction in offset to groundwater from 4 feet to 2 feet and offset to wetlands from 100 feet to 69 feet. After much discussion and on motion by Mayhew and second by Jewell, the variances were approved. All in favor. 157 TOWNSEND HARBOR ROAD Doug Smith met with the board on behalf of the owner. This system is currently in failure due to the high ground water. ===PAGE 2=== In addition to high ground water this site has a steep slope. The plan proposes a variance in reduction to offset to groundwater from four feet to 3 feet and less than 12 inches for inlet and outlet tees. After discussion and on motion by Fortin and second by Mayhew the variance was granted. All in favor. 71 HIGHLAND STREET Doug Smith met with the board on behalf of the owner. This system is in failure. There were very few test holes on the lot that provided the required 4 feet of pervious soil. The area where the proposed leaching area is located provides a consistent 2 feet of pervious soil, the minimum allowed by DEP. In addition, due to the high ground water a reduction to less than 12 inches for inlet and outlet tees is being requested. After discussion and on motion b y Passios and second by Mayhew, the variances were approved. All in favor. 113 SANDY COVE ROAD Doug Smith met with the board on behalf of the owner. The system on this property is in failure. This lot has high ground water and the existing sewer pipe exits the back of the house. In addition, the adjoining lot has irrigation well. A variance for reduction in groundwater offset from 4 feet to 3 feet is being requested, as well as a reduction in less than 12 inches for inlet and outlet tees. After discussion and on motion by Fortin and second by Mayhew, the variances were approved. All in favor. LANNI ORCHARD The owners of Lanni Orchard , Jerry Lanni Sr., Tony Lanni, Mario Lanni and Attorney Cella were present at the meeting. Lanni Orchard has filed for an APR (Agricultural Preservation Restriction) on their property. This would mean that the property located within the APR could only be used for agriculture and no other purpose. The plan was prepared by MDAR . There was an article at Town Meeting a nd this was approved for funding. The plan was submitted to the Planning Board who has view this as and ANR subdivision of land. Based on that determination, it was questioned as to whether the remainder land or land left outside the APR designation was sufficient to support a repair of the septic system on the commercial building, also outside the APR designation. There is also a utility easement running through the remainder land. After much discussion and on motion by Passios and second by Mayhew, th e board voted to allow the APR to proceed, however, if, in the future, DEP determines that this division of land falls under subdivision r ules, Lanni Orchard would have to fully comply with all current reg ulations and are proceeding with the project at their own risk. Variances being requested are groundwater offset from 5 feet to 4 feet and the system less than 100 feet from a wetland, proposed 57 feet. This system is not in the River Front Zone. Plumbing is on the side of the house where the new system is being proposed. After discussion and on Motion by Jewell and second by Fortin, the variance was approved. All in favor. 64 ARBOR STREET Matthew Woodward, owner, met with the Board. ===PAGE 2=== Chairman George Emond stated that this matter was placed on the agenda beca use at their meeting on June 4, 2018, the board did error in stating that an existing system has to be four feet above the water table. Mr. Woodward was correct in that an existing system just need s to be above the high groundwater level and not 4 feet above groundwater. Mr. Woodward stated that he did not feel that the previous minutes as approved and posted reflected what transpired at the meeting. Mr. Emond further stated that the error made does not change the outcome with regard to this property. Member Perry Jewell also stated that this error did not change the situation with this property. There is an old 500 gallon septic tank and a newer d -box as well as a d iscrepancy in the configuration of the leach field. Chairman Emond stated that previousl y, the board gave Mr. Woodward the option of having a witnessed Title 5 as an alternative to replacing the system. Mr. Woodward has not availed himself of that option. 145 WOODLAND Bob Proctor met with the board on behalf of the owner. This system is i n failure. The property is served by public water. This lot is small and has high ground water. Variances being requested are a reduction in groundwater from 4 feet to 3 feet as well as less than 12 inch separation between the inlet and outlet tees. The proposed system is designed for two (2) bedrooms. After discussion and on motion by Passios and second by Mayhew, the variances were approved with the condition that a two (2) bedroom deed restriction be placed on the property. All in favor. 169 PENNINSULA DRIVE Bob Proctor met with the board on behalf of the owner. The system on this site is in failure. This lot is small, has a significant amount of wetlands and two buildings that take up a large portion of the site. Variances being requested are offset to groundwater from five feet to four feet , less than 12 inch separation between inlet and outlet tees, offset to garage slab from 10 feet to 8 feet and offset to house slab from 10 feet to 5.3 feet. After discussion and on motion by Mayhew and second by Fortin, the variances were approved. All in favor. 950 CHASE ROAD The property located above is without water. The owner has made arrangement to have a new well drilled. The exact location from the property line is unknown although it is m ore than 15 feet but less than 30 feet. ===PAGE 3=== After discussion and on motion by Passios and second by Fortin, the board voted to allow the installation of the well to go forward. A variance for the exact placement will be grated once the distance is known. All in favor. SEPTIC LOAN PROGRAM Members of the board would like to consider using the money currently in the Septic Loan Program for other than the repair of private, low income, residential dwellings. The board would only consider expanding the use of this money if they retain control over the funds. Both Chairman George Emond and member Dave Passios have met with Town Counsel to discuss this. After discussion, the board would like to move forward with discussing the possibility of using these funds in an expanded way and will be speaking with Town Counsel to ascertain how that might be accomplished.
