Jack Maloney was also present. This is new construction. A septic system was designe d for this lot and the n the plan was amended, raising the system one foot. The septic permit was issued in accordance with the revised plan. When the system was installed in was installed one foot lower than the approved design plan. The approved septic permit was never picked up prior to the system being stalled. The septic permit is still at the board of health office. Because this is new construction, the septic system must be fully compliant. Chairman George Emond advised that board cannot give a variance to ground water offset on new construction. After a lengthy discussion, the board advised that this is an issue between the owner of the property and the installer of the septic system. A variance cannot be given for the one foot difference in groundwater offset due to this being new construction. The plan was designed and submitted in accordance with the rules and regulations. BAKER STREET Mrs. Paradis, owner, met with the Board. She advised that the roof repairs had been completed. She stated that the second floor, at present, was unoccupied. The remainder of the interior work was in process and she and her husband were working with the insurance company. Mrs. Paradis requested an extension in time to complete the repairs. ===PAGE 2=== After discussion and on motion by Passios and second by Jewell, the board voted to give an extension until February 28th to complete the required repairs. Row Road 132 Robbs Hill Road 56 White Street SEPTIC PERMITS SIGNED: 120 Highland Street 120 HIGHLAND STREET Jack Maloney met with the board on behalf of the owner. This system is in failure. There are no wells in the area and the property is served by public water. Although testing showed adequate pervious soil, the water table is high. A Presby system is being proposed and allows for a gravity syst em. This would further allow for the site to be graded in an manner to minimize potential runoff onto the abutting property. A groundwater variance from four feet to three feet is being requested. After discussion and on motion by Jewell and second by Mayhew, the board approved the variance. Roll call vote, all in favor. 748 PAGE STREET Chris Knuth met with the board on behalf of the owner. This matter was previously before the board. A Title 5 was completed in November of 2018. Both the system and the well tested fine but the well was less than 50 feet from the septic system. At that time, the well was tested and sanitized as part of the Title 5 inspection. The board advised that e ither the well or the septic system would need to be replaced and the decision as to which was at the discretion of the owner. ===PAGE 2=== Mr. Knuth is before the board with a design for a replacement septic system. As part of the replacement, Mr. Knuth is asking th at the existing 1,500 gallon septic tank remain. There is no information on file for a 1,500 gallon septic tank on the site although it appears to be fairly new. Mr. Knuth stated that it is reasonable to allow the tank to remain. The existing tank is 42 feet from the exiting well. After discussion and on motion by Mayhew and second by Fortin, the board voted to allow the existing tank to remain on the following conditions: 1- The installer of the replacement system certify that the existing tank is wate r tight and in good condition; 2- The well be tested by Agent Jim Garreffi 3- Well tested to ensure a sanitary seal by a certified well driller 4- The property be deed restricted as a two (2) bedroom house. Variances approved. 2020 BUDGET The 2020 Budget was available for review including an increase of 5% to the Nashoba Associated Boards of Health as well as in increase of 4 hours per week to the salary line item for the Administrative Assistant. On motion by Fortin and second by Jewell, the budget was approved, as Amended. Roll call vote, all in favor. SEPTIC LOAN Several months ago, Chairman George Emond drafted a letter to Town Counsel with regard to the expanded use of the existing Septic Loan Repair Program money. After discussion, it was determined that no further action was necessary on this matter at this time. PROPOSED CANNABIS REGUALTIONS The members of the board where provided with the proposed Cannabis Regulations as draft ed by the Planning Board. Administrative Assistant advised that the Planning Board is interested in hearing all comments and opinions with regard to these regulation from all residents of the town. This system has been in failure for a considerable amount of time. This matter came before the previously, with a permit being issued. The system was never installed. This site has very high ground water, a small loping lot, high perc rate and onsite well. The previously designed system was very expe nsive to install and the applicant has re -designed the proposed system. This newly designed system, a FAST system, includes a treatment septic tank to produce a cleaner effluent prior to discharge. This will also reduce the footprint of the leaching area by 50%. Variances being requested are less than 100 feet to a well and the use of a sieve analysis. After discussion, and on motion by Jewell and second by Fortin, the board voted to approved the variances provided that a service contract for the FAST s ystem is in place prior to the COC being issued. All in favor. 211/219 W. TOWNSEND ROAD Mark Horrigan met with the board. Mr. Horrigan owns two unimproved building lots with expired septic permits. There has been no work begun on these lots. Mr. Hor rigan is asking the board to extend these septic permits for an additional. After discussion, the board advised Mr. Horrigan that an extension is given when work has begun but cannot be finished in the required time. Because work has not begun, extensions would not be given. ===PAGE 2=== 113 SANDY COVE ROAD The owner of the property, Mike Tully, met with the board. A replacement system was designed for this property. The house is connected to town water. As part of the new system design, it was determined that there was also a well on the property. The holding tank for the well in the basement of the house. The owner would like to keep the well as an agricultural well. After discussion, the board advised that the well can remain provided it be disconnected from the residence (proof provided to the board) and a deed restriction notification be placed on the property. 9 WINTER Hill ROAD The owners of this property would like to finish space in the basement. The house currently has a total of nine rooms (includi ng 4 bedrooms) and the septic system is designed for four bedrooms. The proposed basement work would cause the house to exceed the capacity of the septic system, based on the total room count. The homeowner can increase the size of the septic system, or place a deed restriction on the house. After discussion and on motion by Jewell and second by Mayhew the board voted to allow a deed restriction of 4 bedrooms and a total of 10 rooms. NEW EVENTS APPLICATION The Select Board is in the process of creating a new permitting process. The proposed language has been provided to the board for comment. After discussion, the board is requiring that anyone applying for an Event Permit meet all Board of Health Regulations as all events are different and provide th eir proposal directly to the Board of Health. DARREN MASSEY EVENT APPLICATOINS Darren Massey has applied, through the Select Boards office, for permits to hold events at his property on Holman Street. All events held in Town have to meeting Board of Health regulations. 25 PEARL STREET The system at this property is in failure. The homeowner has not responded to requests from the Board. This matter will be marked up for hearing in Housing Court. The lot has very high seasonal groundwater so perc testing was conducted. The site slopes toward Chase Road, the well is behind the house. In order to maintain the 100 foot offset from the well, the leaching area is proposed for the front yard. To maintain the breakout fill needed for the site, a variance of one foot to groundwater is being requested. After discussion and on motion by Jew ell and second by Passios, the variance was approved. All in favor. 39 RANGELEY ROAD The owner of this property would like to replace his system, believing it is in high groundwater. A Presby system is being proposed. Because of high groundwater, perc testing was not possible so a sieve analysis was performed. The applicant is requesting a groundwater variance from four feet to two feet (Presby System), the use of a sieve analysis and a reduction in the 12” separation from the ===PAGE 2=== tank inlet tees. The separation will be 7 inches tank inlet, 4.5 inches for tank outlet, 4 inches for pump inlet and 3.8 to pump outlet. After discussion, and on motion by Jewell and second by Fortin, the board voted to approve the requested variances. All in favor. 25 PEARL STREET The owner of this property will be in Housing Court the week of May 6 th 2019. Mr. Kirouac is proposing an addition to his house at the above address. Since there are no Board of Health records, it is the Board’s practice to establish the septic system capacity (number of bedrooms) based on the Assessor’s records. The Assessor’s records indicate the house has six rooms and two bedrooms. Based on the proposal submitted, Mr. Kirouac would like to add a “seating room” and family room. Because of the number of rooms currently in the home, including an office, this requires Board approval. Mr. Kirouac has a good size lot with good soil conditions. There is a passing Title 5 from 2013. After discussion, and on motion by Fortin and second by Passios, the board voted to allow the addit ion to the house with the condition that both the “s eating room” and family room have at least six foot cased openings, which removes privacy. This system is in failure. The lot contains significant wetlands, is served by a private well as is the abutter. Variances requested are offset to wetlands and offset to groundwater . Granting these variances allows the proposed system to be 100 feet from all wells. George Emond stated that because the sewer line is 187 feet, he would like to see a cleanout added. After discussion and on Motion by Emond and second by Mayhew, the variances were approved with the addition of a cleanout. All in favor. 134 YOUNGS ROAD Dawn Proctor met with the board of behalf of the owner. This system is in failure. The lots in the area are small. Testing was completed and there is no area that would allow a 100 foot offset from the ===PAGE 2=== existing wells (both abutter and owner). Variances requested are distance to well, 100 feet to 82 feet and distance to slab, 10 feet to 3.8 feet. After discussion and on Motion by Em ond and second by Fortin, the variances were approved. All in favor. 147 COVE ROAD Doug Smith met with the board on behalf of the owner. This system is in failure. The site is served by Town water. The lot is small and has high ground water. Varianc es requested are reduction in groundwater from four feet to three feet and distance to cellar wall from 20 feet to 7 feet. After discussion and on Motion by Mayhew and second by Fortin, the variances were approved. 90 HEMLOCK DRIVE Doug Smith met with the board on behalf of the owners. This system is in failure, the house is served by Town water. The lot is on a peninsula and the shape of the lot makes is difficult to design a fully compliant system. Variances requested are offset to wetlands from 100 feet to 70 feet and offset from tank to cellar wall 10 feet to 5 feet. After discussion and on motion by Fortin and second by Mayhew, the variances were approved. 322 FLAT HILL ROAD John Boardman, Engineer, met with the board on behalf of the owner. Th e owner is requesting a well variance from 50 feet to 14 feet. The owner has a large parcel of land and is proposing dividing it into three lots. One will contain the existing house and the two remaining lots will be to the rear of the property off of a common driveway. The lot which has the original house on it is served by a private well. Once subdivided, this well does not meet the offset requirement from the newly created common drive. George Emond stated that he does not believe that this is a var iance that the board can grant. The owner has created this situation by subdividing the property and believes that a new well will have to be drilled. After discussion, it was decided that this matter would be continued until January 6, 2020 at 7 pm. 64 ARBOR STREET Matthew Woodrow (Woody) was present at the meeting together with Ryan Stober. Chairman Perry Jewell stated that the Court had dismissed the case without prejudice meaning that the board could refile and seek relief. Chairman Jewell state d however, that was not the intention of the board, but rather , the board is requesting that the septic tank be replaced in accordance with the conditional Title 5 report issued in October of 2018. ===PAGE 3=== Mr. Woodrow stated that he felt that the board sent the l etter requesting the tank be replaced at the 11 th hour. He also feels that the board has not treated him fairly and used faulty information to bring him to Court. He feels that he has been persecuted and demeaned by the Board. Chairman Jewell stated that the Board may have made errors and, at this point, would just like the tank replaced. After discussion, it was agreed that Mr. Woodrow would replace the tank. It was agreed that he could have one year, or until January of 2021 for the tank replacement. Replacement must be by a licensed installer certified by that installer. Motion by Fortin, second by Mayhew. All in favor. Motion Meeting adjourned at 8:15 pm
