This matter was continued from December 16, 2019 at the request of Mr. Boardman. As a summary: The owner is requesting a well variance from 50 feet to 14 feet. The owner has a large parcel of land and is proposing dividing it into three lots. One will contain the existing house and the two remaining lots will be to the rear of the property off of a common dr iveway. The lot which has the original house on it is served by a private well. Once subdivided, this well does not meet the offset requirement from the newly created common drive. George Emond stated that he does not believe that this is a variance tha t the board can grant. The owner has created this situation by subdividing the property and believes that a new well will have to be drilled. Dave Passios stated that he agrees, the owner has created this hardship. The board does grant variances in cases where there is no other alternative, but in this case it is possible to drill a new well and feels that a new well should be drilled. After discussion, and on motion by Passios and second by Emond the variance was not approved. A new well was drilled under an emergency situation. Agent Jim Garreffi reviewed the plans and new well location. Well driller Mike Sullivan verified the location of abutting septic systems. A location for the new well was found that was 100 feet from all septic systems but not the required 50 feet from all property lines. The well is 39 feet from the property line of the adjourning property to the right. Agent Garreffi spoke with Chairman Perry Jewell who allowed the installing to go forward, with the request for the offset variance to be heard at the next regularly scheduled meeting of the board. Variance requested is offset to property line from 50 feet to 38 feet. ===PAGE 2=== After discussion and on motion by Fortin and second by Emond, the variance was approved. All in favor. 134 YOUNGS ROAD Dan Proctor met with the board on behalf of the owner. This system is in failure. The existing system is pits in the groundwater. The site is small, has high groundwater and is served by an on-site well. Variances requested are offset to well – 100 feet to 82 feet Offset to foundation – 10 feet to 8.5 feet The system, as designed, is a gravity system. Abutter notification is required and green cards were submitted to the board. After discussion and on motion by Emond and second by Fortin, the variances were approved. All in favor. 66 GIBSON Dan Proctor met with the board on behalf of the owner. The system is in failure. The design for the original septic system is for a three (3) bedroom system. The assessor records indicate that the current house has seven (7) bedrooms and a total of eleven (11) rooms. In an effort to install a compliant system for the house, as it currently exists, a six (6) bedroom system is proposed. The system, as proposed, complies with all Title 5 Regulations as well as local regulations with the exception of allowing the reserve area as trenches within trenches. Trenches within trenches is allowed by Title 5 Regulations. Agent Jim Garreffi stated that maintaining the adequate spacing between the trenches for future use is challenging and is not “a fan” of granting this variance. The design for this system would be considered for increased flow and therefore should meet full compliance. The design contains a boulder slope wall with a very steep slope instead of the necessary fill for breakout. The fill can’t be installed because of the location of the driveway. On motion by Mayhew and second by Fortin, the variance was approved for trenches between trenches. Further, a boulder wall is allowed provided it is certified by an engineer. All in favor. This lot is served by a well in the front of the property. After extensiv ely testing the site, the required four (4) feet of pervious material does not exist anywhere on the site. In addition, due to the high groundwater, a sieve analysis was performed. Agent Jim Garreffi stated that this was a tough site, lots of ledge and the best soils, after testing, were found at the rear of the site. The proposed Presby system allows for less than 4 feet of soil and the proposed system is the best alternative for the site. Variances requested are a reduction of the in the amount of s oil to less than 4 feet as allowed with a Presby System by adding 2 feet of soil and the use of a sieve analysis in lieu of testing. On motion by Emond and second by Passios, the board voted to approve the variances as follows by roll call vote: Fortin: Yes Mayhew: Yes Passios: Yes Emond: Yes Jewell: Yes The variances were approved. COVID – 19 UPDATE Agent Jim Garreffi was present at the meeting to give an update. Mr. Garreffi stated that there have been many complaints that have been addressed inc luding the need for masks and gloves for employees, keeping an appropriate social distance, the number of customers allows in stores. Agent Garreffi stated that he has worked with both Walmart and Hannaford to address these concerns. Contract tracing is being done through Nashoba Associated Board of Health (Nashoba) originally with two of the nursing staff, which is now six doing contact tracing. There is a requirement for isolation for anyone testing positive for Covid-19 for a period of 14 days. In addition, anyone feeling sick is to isolate at home for a period of 14 days. A listing of contacts that are with 6 feet for more 15 minutes is created through contact tracing and quarantine for a period of 14 days, with follow-up by Nashoba. ===PAGE 3=== The Commonwealth currently has 1,000 individuals to help with contact tracing. There is a box that can be checked on the Mavis site to request help from the Commonwealth with tracing. Chairman Perry Jewell stated that there are concerns with privacy with regard to rep orting. Currently the Commonwealth decides what the regulations and guidelines are. Currently Walmart and Hannaford should require masks. Plexiglass is being installed for Cashiers The addresses are being provided to police and fire of possible or confirmed Covid-19 cases. WHITE STREET PROPERTY Leominster Housing Authority has requested an Order restricting visitors to the property. A sample of the Order has been provided stating no visitors are allowed. This sample has been provided to the board as well as Agent Garreffi Chairman Jewell stated that he feels that it should be a guideline rather than an Order. We want to protect our elderly but not at the risk of locking them down. Mayhew feels that this comes too late but would like a strong advisory rather than an Order. Edmond feels that issuing an Order is outside the scope of this Board of Health. Mayhew agrees. Passios doesn’t feel there is a strong reason to go beyond the State’s guidelines and that an advisory to the Housing Authority should be sent based on the State guidelines. Agent Garreffi will look at the wording and provide a document in accordance with board’s wishes and provide same to the Housing Authority. With regard to State reporting of Covid-19 cases. Dave Passios stated that he feels the data is seriously flawed as it comes out of DPH notification system. RUBISH REGULATIONS Any further discussion of changing the rubbish regulations for Lunenburg are on hold until a later date. 64 ARBOR STREET Passios asked about t he status of the permit for the installation of a new septic tank as agreed upon. This permit has not been applied for. Mr. Woodrow has until January 2021 to install the tank. Next Board of Health Meeting will be June 1, 2020. Chairman Perry Jewell noted that this was the first complete meeting for new member Evan Watters. The board members introduced themselves and welcomed Evan to the board. 26 RAMGREN ROAD Jack Maloney met with the board on behalf of the owner. Leslie Shultz, property owner, was also present. This system is in failure. This is an upgrade to a two family home. Variances being requested are: Groundwater offset – 4 feet to 3 feet Sieve Analysis (High groundwater level) Inlet and out let tees to 4” from 12’’. The request for the reduction in inlet and outlet tees is required because of a plumbing change in the accessory housing unit. Tee elevations are controlled by the pitch of the sewage pipe exiting the foundation and the septic tank to control the flow and must be adjusted based on the heights of outlet at the foundation and the septic tank. The water table is high so a sieve analysis was necessary. Agent Jim Garreffi has no issues with the requested variances. ===PAGE 2=== After discussion an on motion by Emond and second by Fortin, the board approved the three variances with th e condition that the variance request letter be corrected to include actual distances. All in favor by roll call vote. 23-25 HOLLIS ROAD Doug Smith met with the Board on behalf of the owner. The system is currently in failure and this proposed replacement has been designed to allow for gravity flow. The site had good soils but the water table is just high enough to require a variance. Variance requested: groundwater offset from 5 feet to 4 feet. After discussion and on motion by Emond and second by Watters, the variances were approved. All in favor by roll call vote. 120 SUNSET LANE Steve Marsden met with the board on behalf of the owner. The current system is in failure after 10 years. The tank was set incorrectly which made it run constantly, ultimately overwhelming the system. This is an existing two family home with 3 bedrooms in each side and is 60 feet above the lake. Agent Garreffi stated that the new system, as designed, is as far away from the lake as possible. The well servicing the property is on one side and septic systems on the other. The property has a steep grade. As a requirement of the permit being, approved, the existing wall will need to be checked for potability. After discussion and on motion by Watters and second by Emond, the variances were approved. All in favor by roll call vote. 717 RESERVOIR ROAD Administrative Assistant Andrea Schnepf stated that a two bedroom deed restriction was placed on this property with one bedroom in the main house and one bedroom in the unit over the garage. Inasmuch as a new, fully compliant, septic system was installed in 2017, the current owner would like the deed restriction removed from the property. After discussion and on motion by Fortin and second by Emond, the board voted to remove the deed restriction. All in favor by roll call vote. COVID UPDATE Agent Garreffi spoke with regard to the Covid update. He stated that the biggest issue being faced now is mask wearing. We are receiving many complaints that masks either are not be worn properly or not being worn at all. We try and educate as to the guideline and requirements, especially with retail establishments. If businesses continue with non-compliance, escalated enforcement could become necessary. Currently, bars can only be open with a food service license and the food must be prepared on site. No bar service is allowed. The board does have the ability to fine as well as close down a business for noncompliance when the following have been completed: Verbal warning ===PAGE 3=== Written warning Fine a maximum of $300.00/day Serve a cease and desist order Summons a business to District Court Administrative Assistant asked if the board would be will to set a dollar amount to fine a business, should that be necessary. Chairman Geor ge Emond stated that no, it would have to come before the board again before a fine could be issued. Agent Jim Garreffi stated that the Town Beach is now open. Lunenburg’s beach is unique in that you have to walk through the building in order to access the beach. He stated that they have done a good job in opening and managing the beach as there have been no issues. Hickory Hills beach was closed due to high E-Coli counts, which is unrelated to Covid 19. Agent Garreffi stated that school openings are u nder the control and direction of each individual town based on the Health conditions in that town. The reopening guidelines are available on the website. Warren Mayhew was no longer a part of the meeting. All in favor by roll call vote. COVID UPDATE Agent Jim Garreffi was not present at the meeting but indicated to Chairman George Emond that there ha ve not been significant changes with regard to Covid 19 since the board last met on July 20, 2020. ===PAGE 2=== Vice-Chairman Perry Jewell updated the board on his meeting with Town Attorney Adam Costa, which agent Jim Garreffi also attended. The meeting took place after the board of health meeting on July 20th. The reason for meeting with Town Counsel was to get guidance on when should the board escalate enforcement under Covid -19 guidelines and the steps necessary to do so. Vice-Chairman Jewell and Agent Garreffi shared the document with regard to the above from the Commonwealth. Vice-Chairman Jewell stated that the Commonwealth wants education. When there is a continued complaint the board has the ability to escalate compliance following certain steps as set ou t by the Commonwealth. Attorney Costa agreed and advised that a special meeting could be called with 48 hours. Attorney Costa stated that there is no need for the board to approve an approach as there is one already in place. Commonwealth guidelines as follows: - Complain is received - Agent visits and discusses the problem and asks that establishment complies (once) - Agent visits and if no change has been made, a written warning is sent (once) - If there is still no change and establishment is not compliant, can be fined up to $300 (3 times) - Representative of establishment is invited to come before the Board and again asked to comply - If still not compliant, a cease and desist is sent - Board takes them to court. Attorney Costa stated that although the court sys tem is bogged down at present, Covid 19 issues are considered a priority. Both Attorney Costa as well as Perry Jewell and Jim Garreffi felt that the above was in accordance with the board view moving forward. Having no further matters before the board an d on Motion by Watters and seconded by Mayhew , the meeting was adjourned at 8:45 pm. Perry J ewell then covered the ground rules for effective business and to ensure accurate meeting minutes. All voting by Roll Call Votes. 52 SPRING STREET Steve Marsden was present to represent the owner of the property. A new septic system has been designed and installed on this property and a new house (tear down rebuild) has been constructed. Previously, three residences were connected to a single well. In addition to 52 Spring Street, 54 Spring Street and 58 Spring Street all shared a single well. Wha t is being proposed is a new well that will only serve 52 Spring Street. 54-58 Spring Street will continue to share the original well. A variance is being requested from 100 feet to 90 feet for the on-site well from the new septic system. Jim Garreffi s tated that this lot is small. It originally had two old camps structures that totaled four bedrooms and were grandfathered. The two old structures were removed and one new four bedroom house was constructed. This well will serve the new four bedroom home and will be disconnected from the original shared well. Paul Fortin asked how far Lake Shirley is from this property. Steven Marsden stated that it is more than 300 feet on the other side of the road. ===PAGE 2=== After discussion and on Motion by Jewell and seco nd by Mayhew, the variance was unanimously approved by roll call vote. 73 ROLLING ACRES Doug Smith met with the board on behalf of the owner. This lot is .46 acres and is served by public water. The foundation elevations are set and cannot change. Pro viding a variance for groundwater offset from four feet to three feet keeps the mound lower and the proposed system is a better system than what is currently on the property. In addition, a variance is requested for less than 12 in ches for inlet and out let tees due to the groundwater offset. After discussion and on motion by Jewell and second by Fortin, the board voted to approve the variances. All in favor by roll call vote. 125-129 WHITE STREET Mike Andrade met with the board on behalf of the owner, the housing authority. The property being discussed is 3 single family homes that make up a portion of the White Street complex. Currently, the system for one of these single family houses is in failure. The decision was made to design a system to serve all three homes. Due to the wooded site and slope, the only place to put the system is less than 100 feet from the wetland. Jim Garreffi stated that this site is tight, has good soil and a perc rate of less than 2 MPI. It is really the only place to site the system. The only variance being requested is offset to wetlands from 100 feet to 78 feet. After discussion and on Motion by Mayhew and second by Jewell, the variance was unanimously approved by roll call vote. COVID UPDATE Jim Garreffi stated th at there are changes and amendments to Covid guideline daily. Currently, Lunenburg is seeing 1 or 2 new positive test cases a week. We continue to address complaints received from the State as well as complaints that come into our local Board of Health o ffice. We have complaints on restaurants as well as concerns about the wearing of masks. Mr. Garreffi stated that the Lunenburg town wide flu clinic will be held on October 14 th at the new Jr/Sr High School. Seniors will be from 3 pm until 5 pm and 5 pm until 6 pm will be for everyone. Nashoba is continuing to work with the schools in effort to try and mitigate overlapping Fu and Covid. Nashoba is able to vaccinate anyone over 6 months of age. Agent, Jim Garreffi, was also present. Vice-Chairman Perry Jewell prefaced the meeting with the following reading. In accordance with the requirements of the Open Meeting Law, please be advised that this meeting is being recorded and broadcast over Lunenburg P ublic Access and this meeting of the Board of Health is being conducted remotely. The Town of Lunenburg, in response to the COVID -19 (Corona Virus), is currently following the guidance from the Lunenburg Board of Health, Massachusetts Department of Public Health and the CDC regarding the virus and steps communities can take to prevent the spread and all town facilities are currently closed to the public. In accordance with the Governor’s Order Suspending Certain Provisions of the Open Meeting Law, G.L.c.3 0A, Section 20, all public meetings are being conducted remotely. The Governor’s Order, which you can find posted on the Town’s website COVID-19 Information Center page, accessed through the Town Manager’s webpage allows public bodies to meet entirely rem otely so long as reasonable public access is afforded so that the public can follow along with the deliberations of the meeting. Ensuring public access does not ensure public participation unless such participation is required by law. This meeting will f eature public comment. For this meeting the Board of Health is convening by video conferencing via Zoom and FacebookLive as posted on the Town’s website identifying how the public may join. For Zoom meetings, please note that this meeting is being record ed and that some attendees are participating by video conference. Accordingly please be aware that other folks may be able to see you and take care not to screen share your computer. Anything that you broadcast may be captured by the recording. Perry Jewell then covered the ground rules for effective business and to ensure accurate meeting minutes. All voting by Roll Call Votes. 234 S ROW ROAD Doug Smith was present to represent the owner. This system is in failure and the property is served by p ublic water. The water table is just high enough to require a variance. Variances being requested are offset to groundwater to 24” and less than 12” separation in inlet and outlet tees. After discussion and on Motion by Jewell and second by Mayhew, the variance was unanimously approved by roll call vote. 1564 MASSACHUSETTS AVENUE Doug Smith met with the board on behalf of the owner. This system is in failure. It is a good size lot and served by Town water. Variances requested are groundwater offset to 36” and a reduction in the separation between inlet and outlet tee to less than 12”. Grading on the lot will be better with the approval of the groundwater reduction variance. After discussion and on motion by Mayhew and second by Jewell, the board voted to approve the variances. All in favor by roll call vote. ===PAGE 2=== 200 PLEASANT STREET Doug Smith met with the board on behalf of the owner. This system is in failure. This is a large piece of property and currently a farm. Due to the wetness at the time of testing, a sieve analysis was done. Variances being requested are offset to groundwater to 24 inches, less than 12” for inlet and outlet tees and the use of a sieve analysis. After discussion and on Motion by Jewell and second by Mayhew, these variances were unanimously approved by roll call vote. 67 AUTUMN LANE Nick Pauling representing the owner of the property, Erin Comesana, who was also present. A building permit was submitted to make an in law apartment in the basement of this house. The bu ilding permit was denied and a request was made to meet with the board. What are being proposed are three additional rooms in the basement. A kitchen, bedroom and living room. Also proposed is converting an upstairs bedroom into an office or library, wi thout making any changes to the upstairs layout of rooms. In accordance with regulations, this proposal exceeds both the allowed number of bedrooms as well as the total number of rooms in the house. Mr. Pauling stated that they were asking for relief fro m the 10 room limit and would be willing to put a deed restriction on the property. Chairman stated that one cannot undo a bedroom. Simply changing the name to library or office is not enough. Although the currently owner is not intending to use this room as a bedroom, the possible use of the room in the future has to be considered. Agent Jim Garreffi stated that in order to approve this building permit, a 5 bedroom septic system would have to be installed. Perry Jewell stated that in order to approve this permit a wall would have to remove upstairs making one larger room out of two. After discussion it was determined that either a new 5 bedroom septic system would have to be installed to approve this permit or a wall removed to create a bigger space u pstairs. In addition, a new septic tank would need to be installed to accommodate a new downstairs bathroom. After further discussion, this building permit application in its present form was denied by unanimous roll call vote. MEETING MINUTES On motion by Jewell and second by Mayhew all previous minutes were unanimously approved by roll call vote. ===PAGE 3=== COVID UPDATE Jim Garreffi stated that there are numerous changes and amendments to Covid guideline daily. Currently, Lunenburg is still seeing 1 or 2 new positive test cases a week. Re-opening is based on risk level, specifically “red” communities as noted on the statewide Covid map. We have moved into Phase 3, Step 2 which allows the bar portion to open for the serving of food with social distancing prov isions in place. Bars opening for alcohol are still prohibited. We are allowing greater number at events and more people, up to 10 people, can now sit a table together at a restaurant. We continue to address complaints received from the State as well as complaints that come into our local Board of Health office. We have complaints on restaurants as well as concerns about the wearing of masks. Some of the biggest jumps in Covid numbers are in college student. Agent Garreffi stated that people are being testing whether they are symptomatic or not. Member Mayhew stated that 96% of patients are asymptomatic and asked where the closest “red” city was. Agent Garreffi stated it is Worcester. Chairman Emond stated that the Lunenburg town wide flu clinic wil l be held on October 14 th at the new Jr/Sr High School. Seniors will be from 3 pm until 5 pm and 5 pm until 6 pm will be for everyone. Nashoba is continuing to work with the schools in effort to try and mitigate overlapping Fu and Covid. Nashoba is able to vaccinate anyone over 6 months of age. There are 15 towns that make up Nashoba Associate Board of Health. Perry Jewell then covered the ground rules for effective business and to ensure accurate meeting minutes. All voting by Roll Call Votes. 595 FLAT HILL ROAD Mark Ferrell was present to represent the owner. This syste m is in failu re. An al ternative system is being proposed with a variance for groundwater offset from four feet to three feet. Agent Jim Garreffi stated that the soils were tough, there is a slope to the property and distances to wells had to be considered. After discussion and on Motion by Jewell and second by Mayhew, the variance was unanimously approved by roll call vote. 145 SOUTH ROW ROAD Doug Smith met with the board on behalf of the owner. This system is in failure. It is a small size lot with the surrounding lots being served by public water. Variances requested are offset to ground water from 4 feet to 3 feet. ===PAGE 2=== Agent Jim Garreffi stated that it is a small lot and this design is the best system for the lot. After discussion and on motio n by Mayhew and second by Watters, the board voted to approve the variances. All in favor by roll call vote. 455 NORTHFIELD ROAD Doug Smith met with the board on behalf of the owner. This system is in failure. This is a large piece of property. Due to the location of the well and garage and lack of soil, a Presby system has been designed. They are requesting to keep the septic tank, which will be inspected. Variances being requested are offset to groundwater for 4 feet to 3 feet. Agent Jim Garreffi stated that although it is a big lot, it was difficult to find soil. This system keep all components away from wells with no impact to the house and is the best solution for the lot. After discussion and on Motion by Jewell and second by Mayhew, these variances were unanimously approved by roll call vote. 166 S. ROW ROAD Steve Sears represented the owner of the property. This is a very small lot. There is a tie in for town water. This is two bedroom home and a Presby system has been designed. By using a Presby system, n o retaining wall is required although there will be a poly barrier installed. Variances requested are groundwater offset from four feet to 2 feet, reduction in inlet and outlet tees from 12 inches to six inches. Agent Jim Garreffi stated that because th is house is on a slab, the plumbing cannot be raised or lower ed so the inlet and outlet tee variance is necessary. He also stated that he explained that the current well could be destroyed or they could come to the board to retain the use of it for irrigation purposes. After discussion and on Motion by Jewell and second by Watters, these variance was unanimously approved by roll call vote. MEETING MINUTES On motion by Jewell and second by Mayhew all minutes were unanimously approved by roll call vote. COVID UPDATE Jim Garreffi stated that there continue to be numerous changes and amendments to Covid guideline daily. Currently, Lunenburg is still seeing 1 or 2 n ew positive test cases a week and although the risk levels in other communities are going up, Lunenburg continues to be low risk. Of concern now is youth sports and sports teams with carpooling being of concern. Situations like a group home having high numbers could change the map but that type of outbreak is self-contained. In the days up to mid-September Massachusetts was testing 20,000 to 30,000 per day. Now we are testing 14,000 to 16,000 per day. Mr. Garreffi cannot account for the change. ===PAGE 3=== The question was asked if we are testing in Public Schools. No testing is taking place in the scho ols. Testing happens if you are sick or in close contact to a Covid positive person. Nurses in schools are not doing testing. Mr. Garreffi spoke with regard to team sports, leagues and youth sports and stated again how very important it is to maintain social distancing and wear masks. Carpooling has become a problem. There are 15 towns that make up Nashoba Associate Board of Health. Lunenburg residents can do to any clinic posted on the schedule if they were unable to attend on October 14th. Perry Jewell then covered the ground rules for effective business and to ensure accurate meeting minutes. All voting by Roll Call Votes. 93 WHITE STREET Dan Proctor was present to represent the owner. This system is in failure and the property is served by public water. This is a straight forward upgrade. An offset to groundwater from 5 feet to 4 feet is being requested. By allowing this offset the system will fit better on the lot with a tighter grade. There are no wetlands on the site. Agent Jim Garr effi agreed that this is a very straight forward plan , with the best system having been designed for the lot. After discussion and on Motion by Jewell and second by Fortin, the variance was unanimously approved by roll call vote. 81 MAPLE PARKWAY Steve Sears met with the board on behalf of the owner. This system is in failure. This lot and the surrounding lots are on town water. This is a narrow lot, 100 feet wide and 300 feet deep. Half way back is wetlands and ===PAGE 2=== they also border one side. Because the water table is high, a sieve analysis was performed. Because of the extensive wetlands, there is limited space on the site to place the system. Variances requested are: Offset to groundwater from 4 feet to 3 feet Use of a sieve analysis Inlet and outlet tees less than 12 inches (to accommodate current plumbing in the house) Offset to wetlands 100 feet to 51 feet Jim Garreffi stated that this is a tough site with high groundwater. There is a limited portion of the site that can be utilized due to the wetlands. This variances being requested are a balance to lower the system to provide better grading and keep a distances from the wetlands. This is a good compromise for this lot. After discussion and on motion by Fortin and second by Watters, the board voted to approve the variances. All in favor by roll call vote. MEETING MINUTES On motion by Jewell and second by Watters all previous minutes were unanimously approved by roll call vote. COVID UPDATE Chairman George Emond commended Agent Jim Garreffi on a letter that he prepared and sent out to board members, as well as Town Administrator Heather Lemieux and members of the Selectboard with regard to Covid. Chairman Emond stated that he felt it was very well written and, if members of the board had not had an opportunity to read the letter, they should do so. Agent Jim Garreffi stated that there are numerous changes and amendments to Covid guideline daily. Re- opening is based on risk level, specifically “red” communities as noted on the statewide Covid map. Lunenburg is currently red. We have moved into Phase 3, Step 2 which allows the bar portion to open for the serving of food with social distancing provisions in place. Bars opening for alcohol are still prohibited. We are allowing greater number at events and more people, up to 10 people, can now sit a table together at a restaurant. In addition, restaurants stop serving food by 9:30 pm. Alcohol can only be served with food and all food must be prepared on site. In addition, there is a stay at home order from 10 pm until 5 am. We are seeing more cases now than we did last spring. Currently, Lunenburg is still seeing 45 to 50 new positive test cases a week. We have more people coming into contact with more people. It is important to social distance whenever you can. Wear a mask in all public locations, including parking lots, sidewalks and office buildings. Carry a mask at all times. Agent Garreffi has recommended to the boa rd that they start enforcement for all non-compliant establishments for overcrowding, seating and serving alcohol without food service. Garreffi stated that, currently, our cases are out pacing our ability to do contact tracing. The State Collaborative in now doing some contact tracing for us. He does not know what happened in the last week to push Lunenburg numbers up so high. Garreffi reiterated that you need to stay home until you get the results of your test. If you are a close contact to a known positive case of Covid you must quarantine, even if you receive a negative test. You cannot test out of quarantine. It is important to protect ourselves as we don’t know where others have been or who they have been around. We continue to address complaints received from the State as well as complaints that come into our local Board of Health office. We have complaints on restaurants as well as concerns about the wearing of masks. ===PAGE 3=== Contact tracing is showing that private gatherings are accounting for the biggest increase in C ovid numbers and leading to clusters within families. There was discussion as to the difference in numbers from Nashoba reporting to State reporting. Agent Garreffi stated that the state “sorts” out the information and corrects misreporting such as not really living in town. Agent Garreffi stated that with Special Town meeting tomorrow, he believes that all precautions are being taken. At Spring Town meeting all distances and mask requirements were adhered to. There is still an exemption for people who can’t wear a mask due to a medic al condition and he has had conversation with the Town Manager with regard to this. Member Evan Watters has been tracking Covid numbers and it makes it easier to understand the difference from week to week. Chairman Emond asked that those spread sheets be sent to the members and Agent Garreffi. Perry J ewell then covered the ground rules for effective business and to ensure accurate meeting minutes. All voting by Roll Call Votes. 72 MAPLE PARKWAY Doug Smith was present to represent the owner. This syste m is in failure, the property is a smaller siz e at a ½ acre. An alternative system is being proposed with a variance for groundwater offset from four feet to t wo feet. In addition, a variance is requested for less than 12” in the inlet and outlet tees to 6” and 2 ½ inches respectively. A soil sample was taken as the soil was too wet. Agent Jim Garreffi stated that the soils were tough and there is a high water table. The plumbing in the house can’t be raised so the inlet and outlet tee variance is reasonable. He had no issues with the requests. After discussion and on Motion by Watters and second by Fortin, the variances were unanimously approved by roll call vote. 112 SOUTH ROW ROAD Doug Smith met with the board on behalf of the owner. This system is in failure. It is a small lake lot with a pipe and gravel system being designed. The house is on a slab and will require a poly barrier. Variance being requested is offset to groundwater to 4 feet. ===PAGE 2=== Agent Jim Garreffi stated that it is a small lake lot with a high water table. The installation of a poly barrier will keep the fill on the site. They are connecting to public water and discontinuing the well. The system as designed fits nicely on the lot. After discussion and on motion by Jewell and second by Fortin, the board voted to approve the variances. All in favor by roll call vote. 1480 LANCASTER AVENUE Brian Milisci from Whitman and Bingham met with the board on behalf of the owner. This system is in failure. This system was upgraded in 2011. The water use in the home exceeded th e system as was designed in 2011 putting the system into failure. All offsets have been met. The system, as designed now, is a 6 bedroom system to meet the needs of this house. The system as designed in 2011 was for a 4 bedroom. Variances being requested are offset to groundwater for 4 feet to 3 feet, the use of a sieve analysis due to high ground water and a reduction in the 12 inch separation between inlet and outlet tees. Agent Jim Garreffi stated that the increase in the size of the system was to meet the requirements of this house. As stated, the system in 2011 was for a 4 bedroom home. This system was designed to match the house and would need to be deed restricted to a 4 bedroom home. After discussion and on Motion by Jewell and second by Watters, these variances were approved with the requirement of a deed restriction as follows by roll call vote: Perry Jewell – Yes Paul Fortin – Yes Evan Watters – Yes George Emond - abstain MEETING MINUTES On motion by Watters and second by Fortin all minutes were unanimously approved by roll call vote. COVID UPDATE Jim Garreffi stated that there continues to be numerous changes and amendments to Covid guideline daily. Currently, Lunenburg has moved from Phase III, Tier II back down to Phase III, Tier I, due to prevalence of Covid on our community. This reduces the occupancy in businesses, closes businesses and restricts others. Jim Garreffi stated that our Tier changed because of being “red” for 3 weeks in a row due to the increases in November. However, the numbers are coming down and hopefully that will continue. We continue to see transmission within families. It is very important to not have gatherings outside of our family groups, wear masks and sanitize. Quarantine information has been changed due to combined science and experience with patients in the spring. With regard to vaccine: It is anticipated that Massachusetts will have 60,000 doses by year end. Both vaccines require two shot s about 3 weeks apart. The first to get vaccine will be hospital and health care workers in a group that they can track to receive the second dose, with Nursing Homes to follow. Criteria has been set on the order in which vaccine will be distributed. ===PAGE 3=== It is anticipated that vaccine will be available so metime in the late spring or early summer for the larger population. Chairman Emond, as well as other board members commented on what a great job member Even Watters is doing charting Covid numbers for the board. Having no further matters before the b oard and on Motion by Watters and seconded by Jewell, the meeting was adjourned at 8:30 pm. By roll call vote, all in favor.
