Agent, Jim Garreffi, was also present. Vice-Chairman Perry Jewell prefaced the meeting with the following reading. In accordance with the requirements of the Open Meeting Law, please be advised that this meeting is being recorded and broadcast over Lunenburg Pub lic Access and this meeting of the Board of Health is being conducted remotely. The Town of Lunenburg, in response to the COVID -19 (Corona Virus), is currently following the guidance from the Lunenburg Board of Health, Massachusetts Department of Public Health and the CDC regarding the virus and steps communities can take to prevent the spread and all town facilities are currently closed to the public. In accordance with the Governor’s Order Suspending Certain Provisions of the Open Meeting Law, G.L.c.30A , Section 20, all public meetings are being conducted remotely. The Governor’s Order, which you can find posted on the Town’s website COVID-19 Information Center page, accessed through the Town Manager’s webpage allows public bodies to meet entirely remot ely so long as reasonable public access is afforded so that the public can follow along with the deliberations of the meeting. Ensuring public access does not ensure public participation unless such participation is required by law. This meeting will fea ture public comment. For this meeting the Board of Health is convening by video conferencing via Zoom and FacebookLive as posted on the Town’s website identifying how the public may join. For Zoom meetings, please note that this meeting is being recorded and that some attendees are participating by video conference. Accordingly please be aware that other folks may be able to see you and take care not to screen share your computer. Anything that you broadcast may be captured by the recording. Perry Je well then covered the ground rules for effective business and to ensure accurate meeting minutes. All voting by Roll Call Votes. 33 BOUTWELL Dan Proctor was present to represent the owner. This syste m is in failure, the property is served by town water. A variance for groundwater offset to 4 feet is requested, soils tested at 2MPI. In addition, a variance is requested for distance to wetland from 100 feet to 68.5 feet. There are no wells within 100 feet of the proposed system. Agent Jim Garreffi stated that this is a strange lot and is made up of the leftover portions of the adjoining lots. He stated that the variances make sense and he had no issues with the requests. After discussion and on Motion by Fortin and second by Jewell, the variances were unanimously approved by roll call vote. 31 SOUTH ROW ROAD Dan Proctor met with the board on behalf of the owner. This system is in failure , but the owner is not selling . Variances being request are offset to groundwater to 4 feet, distance to wate r line from 20 feet to 5 feet and distance to foundation from 20 feet to 13 feet. ===PAGE 2=== This lots fronts on the lake and is a small, tight lot. The property is connected to public water. Agent Jim Garreffi stated that it is a small lake lot with a high water table. After discussion and on motion by Jewell and second by Emond, the board voted to approve the variances. All in favor by roll call vote. There is a well on the property , that was previously used as a potable source of water. This property h as been connected to public water and the owner would like to retain the use of this well for irrigation purposes . Dan Proctor stated that there are a lot of well still in service in this area. George Emond stated that typically wells are destroyed when connected to public wat er to avoid cross contamination with the public water supply. Inasmuch the matter of retaining the well was not on the agenda for discussion, the owner would have to come back to the board to retain the agricultural well. In doing so, a request, by letter would need to be submitted to the board and the particulars as to location, depth, etc. would have to be provided so that the board would be able to make a decision. 17 WEST STREET TERRACE Dan Proctor met with the board on behalf of the owner. This system is in failure. Testing showed 27 MPI soils. A Presby system with a pump chamber has been designed for this lot. This site is connected to public water, has high groundwater and is a fairly small in size. Variances requested are offset to groundwater from 4 feet to 2 feet, less than 12” on inlet and outlet tees. Jim Garreffi stated the design of a Presby system allows the groundwater offset of 2 feet. Because the level of the house is set, the inlet and out let tee variance is necessary. The system, as designed, is much better than the system that failed. There are no wetland or wells and he had no issues. After discussion and on Motion by Fortin and second by Watters, these variances were unanimously approved by roll call vote. MEETING MINUTES On motion by Jewell and second by Watters all minutes were unanimously approved by roll call vote. BUDGET Perry Jew ell stated that the Board has had an ongoing request for additional office hours for Administrative Assistant Andrea Schnepf. Mrs. Schnepf began with the board with 30 hours a week, but was reduced to 26 hours a week some years ago due to town wide budget constraints . In this last budget cycle, additional hours were included for Mrs. Schnepf but, due to Covid, were not acted on at Annual Town meeting in May. They were included in the November Special Town meeting. This is an increase of 6 hours per week. Andrea Schnepf stated that in addition to the hours for herself, a 5% increase was included for Nashoba Associated Boards of Health, both Nursing and Environmental. Nashoba has not had their meeting to determine the actual amount and won’t until the end of January The 5% increase is a “guesstamate”. In addition, line item amounts were moved, while keeping the overall budget at level funding of $1,750.00 ===PAGE 3=== After discussion and on motion by Watters and second by Jewell the budget was una nimously approved by roll call vote. RUBBISH PERMITS Administrative Assistant advised that board that the annual Rubbish Permits , which are due January 1 st, have been prepared. Typically, the members of the board sign the permits. Mrs. Schnepf is asking that she be able to sign the permits on behalf of the board, or type their name. Chairman George Emond stated that he would rather have the permits signed rather than the names typed. After discussion and on motion by Jewell and second by Fortin, the board unanimously approve d authorization to sign permits for the duration of the Covid crisis by roll call vote. 299 PAGE STREET Jim Morin met with the board on behalf of the owner. This system is in failure. The soils on this site are strange and they had difficulty getting good depth of soil. They tested by the old system but the soils were not desirable and ledge was found. Decent soils were found at the rear of the property with a 9 MPI Perc rate. There was also good depth of soil. Variance requested is offset to groundwater from four feet to three feet. Jim Garreffi stated that granting this variance helps with grading with the requirement of a poly barrier. After discussion and on motion by Jewell and second by Fortin, the septic variance was approved by unanimous roll call vote. The house is served by an artisan well. The owner of the house is asking to keep two wells as irrigation wells on the opposite side of the property. These wells were marked on the septic plan. These well appear to be concrete lined and do have covers although they are covered with brambles. After discussion and on motion by Jewell and second by Fortin, the request to keep the two wells as noted on the septic plan was approved with the condition that a deed restriction be place on the property, the wells have covers and are fully disconnected from the residence and are not to be used as a so urce of potable water. Unanimously approved by roll call vote. COVID UPDATE Jim Garreffi stated that there seems to be a spirt of complaints, including one from the state. Some of the complaints are second violations and Mr. Garreffi will be writing letters. The number of cases is up to about 51 for this last reporting week. Mr. Garreffi is seeing a lot of multiple cases within the same address. 40% to 45% of reported cases are home clusters. Mr. Garreffi has been meeting with the school superintendent and the schools are doing a great job of keeping the kids in school safe. Nashoba has will be receiving doses of the Moderna vaccine which will be given to first responders at a clinic on January 21 st or January 22nd. This will include fire, rescue a nd EMS. In order to provide this vaccine, new software was provided to keep track of scheduling, billing and second doses. Mr. Garreffi stated that as this point the distribution of the vaccine to the general public if very vague. As stated by Governor Baker, distribution will be in Phases with the first doses going to health care workers and those at greater risk. ===PAGE 4=== It might be late spring before vaccine is available to the general public. It is possible that vaccine distribution with be through pharmacies such as CVS and Walgreens. Currently the vaccination rate is poor, between 25% and 30% of what was expected. Many are waiting to see what other experience as far a side effects are. There are some business that are not adhering to the guidelines as put forth by the Department of Public Heath with regard to capacity, mask wearing and reporting. When Mr. Garreffi was asked if any business are at a point where they should come before the board, Mr. Garreffi stated no. Chairman Emond, as well as other board members commented on what a great job member Even Watters is doing charting Covid numbers for the board. Having no further matters before the board and on Motion by Watters and seconded by Jewell, the meeting was adjourned at 9:00 pm. By roll call vote, all in favor. ======================================================================================== DOCUMENT : 2021-02-01-agenda-1046.txt BOARD : board-of-health DATE : 2021-02-01 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/board-of-health/2021-02-01-agenda-1046.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_02012021-1046 ======================================================================================== ===PAGE 1=== BOARD OF HEALTH February 1, 2021 7:00 PM* AGENDA In accordance with the requirements of the Open Meeting Law, please be advised that this meeting is being recorded and broadcast over the Lunenburg Public Access channel. Perry Jewe ll then covered the ground rules for effective business and to ensure accurate meeting minutes. All voting by Roll Call Votes. 466 MASS AVENUE Dan Proctor was present to represent the owner. This syste m is in failure, the property is served by town water. A variance for groundwater offset to 4 feet is requested to maintain grading , soils tested at 2MPI . The surrounding properties are served by public water. Agent Jim Garreffi st ated that this is a fairly large lot with good soil. The groundwater w as higher than expected. He stated that the variances make sense and he had no issues with the requests. After discussion and on Motion by Jewell and second by Fortin, the variances were unanimously approved by roll call vote. 75 RUTH STREET Jack Maloney met with the board on behalf of the owner. This system is in failure. This property is going from a 2 bedroom system to a 3 bedroom system and meets all Title 5 requirements. ===PAGE 2=== Currently, the property is served by a shallow well with a well pump in the house. As proposed, a new well will be drilled to meet the 100 foot requirement from a septic system. Chairman Edmond stated that the new well will need to be drilled and tested before COC for the septic system can be issued. Variances requested are only one deep hole (2 are required) and distance to Lake Shirley from 100 feet to 57.4 feet. Agent Jim Garreffi stated that it is a good size lot at 1.75 acres and the soil is good. The topography slopes toward Lake Shirley. The system is more shallow and a new well will provide better water quality. Member Evan Watters questioned the difference in a 50 foot distance from a wetland as opposed to a 100 foot distance and the need for a variance. Chairman George Emond stated that the state allows a 50 foo t offset, whereas Lunenburg has a regulation that requires 100 feet. By having this regulation, it allows the board to take a closer look at what is being proposed. After discussion and on motio n by Jewell and second by Emond, the board voted to approve the variances with the condition that the well be installed and tested prior to the issuance of a Certificate of Compliance for the septic system. All in favor by roll call vote. 60 WOODLAND DRIVE Jack Maloney met with the board on behalf of the owner. This system is in failure. This house is close to the road with the existing system behind the house and the rear portion of this lot goes up in grade. Testing showed 9 MPI soils. Variances requested are less than 12” on inlet and outlet tees and distance to well from 100 feet to 79 feet. Jim Garreffi stated that due to this house being on a slab the plumbing is set so an inlet and outlet tee variance is necessary. This will be a raised system with a tank and pump chamber to a Presby system. The system, as designed, is much better than the system that failed. Agent Garreffi further stated that he does not recommend granting the well variance. Public water is available in the street and he recommended that this property be connected to public water. Jack Maloney was asked if he had discussed retaining the well as opposed to connecting to public water with the homeowner. He stated that he had not. Vice Chairman asked that this matter be continued until the next Board of Health meeting on Ma rch 15, 2021 to give Mr. Maloney an opportunity to speak with the homeowner. All Parties were in agreement. This matter was continued until March 15, 2021 at 7:15 pm by agreement of the parties. (Later changed to 6:15 pm due to Caucus) MEETING MINUTES On motion by Jewell and second by Emond, the January 4, 2021 minutes were unanimously approved by roll call vote. COVID UPDATE Jim Garreffi stated that the State will be moving into Phase 3 Step 2 because of the improvement in Covid numbers. ===PAGE 3=== The state feels that this will be good for business and that retail stores can go to a capacity of 50%. Restaurants have no capacity limit other than the distance between tables and a limit of 1.5 hours and 6 people at a table. The Governor will be looking at movi ng to Phase 4 Step 1 beginning March 22 nd and the vaccine continues to roll out. Agent Garreffi stated that although the numbers for Lunenburg are going down, Lunenburg has been stubborn with cases and is going down more slowly. Agent Garreffi stated tha t they are pushing mass vaccination sites. The thinking being that mass vaccination sites can administer the vaccine quicker, possibly bring more vaccine into the state. All of Nashoba vaccine has been reallocated to Mass Vaccination sites. Nashoba will be able to administer the second shot to those that got a first shot through Nashoba on either March 11 or March 25 th but there will be no more clinics unless more vaccine becomes available. Agent Garreffi stated that there are 11 statewide collaboratives that have been approved. In order to be a part of a collaborative, you need to be able to administer 750 doses a day/5 days a week and must be open to all residents of the state. Chairman Emond stated that the lack of vaccine in local communities is most bothersome. No matter how much vaccine the state receives, the local communities do not receive vaccine. Mr. Emond feels that 1/3 of the population of Massachusetts has been disenfranchised. The State has completely cut Nashoba’s allotment of vaccine and re-allocated it to mass vaccination sites. Mr. Garreffi stated that the difference in the State’s number and Nashoba is due to counting probable cases. Probable cases are cases that are diagnosed by other than a PCR test. 224 TOWNSEND HARBOR ROAD Doug Smith met with the board on behalf of the owner. This is an A-Frame house that was built in approximately 1955. Mr. Smith designed a plan for replacement in 2000 but it was never submitted. Mr. Smith is reactivating the plan. All properties but on e are on public water. The closest well is 65 feet away. This plan was before the Conservation Commission and it was approved. Variances requested are offset to well - 100 feet to 65 feet Offset to crawl space – 10 feet to 5 feet Offset to wetlands – 100 feet to 50 feet Jim Garreffi stated that this is a small lot and that location of the wetland knocks off the back portion of the lot. There is an existing cesspool and the system, as designed, is an improvement over what is there. After discussion and on motion by Jewell and second by Fortin, the septic variance was approved by unanimous roll call vote. 310 SUNNY HILL ROAD Dan Proctor met with the board on behalf of the owner. A new, fully compliant system has been designed so there is no need for a hearing. Having no further matters before the board and on Motion by Watters and seconded by Jewell, the meeting was adjourned at 9:00 pm. By roll call vote, all in favor. ======================================================================================== DOCUMENT : 2021-03-15-agenda-1048.txt BOARD : board-of-health DATE : 2021-03-15 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/board-of-health/2021-03-15-agenda-1048.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_03152021-1048 ======================================================================================== ===PAGE 1=== BOARD OF HEALTH March 15, 2021 6:00 PM* AGENDA In accordance with the requirements of the Open Meeting Law, please be advised that this meeting is being recorded and broadcast over the Lunenburg Public Access channel. Mrs. Caron would like to make an apartment in the lower level of the above property. The home is a high ranch or raised ranch. Currently, the house has 3 bedrooms. Mrs. Caron is proposing taking out a wall upstairs and converting 2 bedrooms into one and adding a bedroom in the basement. Due to the layout of the existing house, with the addition of the bedroom in the lower level, the house would exceed the allowable number of rooms. After discussion, on motion by Jewell and second by Fortin, the board voted to allow the construction of an apartment in the lower level in accordance with the submitted drawings , with the condition that an 8 room, 3 bedroom deed restriction be placed on the property. Agent, Jim Garreffi, was also present. Vice-Chairman Perry Jewell prefaced the meeting with the following reading. In accordance with the requirements of the Open Meeting Law, please be advised that this meeting is being recorded and broadcast over Lunenburg Publi c Access and this meeting of the Board of Health is being conducted remotely. In accordance with the Governor’s Order Suspending Certain Provisions of the Open Meeting Law, G.L.c.30A, Section 20, all public meetings are being conducted remotely. The Governor’s Order, which you can find posted on the Town’s website COVID-19 Information Center page, accessed through the Town Manager’s webpage allows public bodies to meet entirely remotel y so long as reasonable public access is afforded so that the public can follow along with the deliberations of the meeting. Ensuring public access does not ensure public participation unless such participation is required by law. This meeting will featu re public comment. For this meeting the Board of Health is convening by video conferencing via Zoom and FacebookLive as posted on the Town’s website identifying how the public may join. For Zoom meetings, please note that this meeting is being recorded a nd that some attendees are participating by video conference. Accordingly please be aware that other folks may be able to see you and take care not to screen share your computer. Anything that you broadcast may be captured by the recording. Perry Jewe ll then covered the ground rules for effective business and to ensure accurate meeting minutes. All voting by Roll Call Votes. 370 WEST TOWNSEND ROAD Justin LeClair met with the board on behalf of the owner. A Presby system is proposed. Variances requested are a groundwater offset from four feet to two feet, sieve analysis and an offset for the well from 50 feet to 35 feet (new well) Mr. LeClair stated that the property is small with high ground water. The adjoining small lot is owned by the Town of Lunenburg and would not be affected by the granting of the well variance. Jim Garreffi stated that this is a tough lot. There is no place on the lot for the well that would meet the required offset. With the small, Town owned abutting property, Mr. Ga rreffi does not believe the well variances is an issue and the well will provided a better water supply that what is there now. Because this is a tough site with tough soils, he stated that this was a good replacement. After discussion, on motion by Fortin and second by Jewell , the board voted unanimously to approve the variances by roll call vote. ===PAGE 2=== 244 PLEASANT STREET Doug Smith met with the Board on behalf of the owner. This was a previously approved plan for a Geo Flow System. The proposed plan is for a Geo Mat System with the same footprint. Although this is a different system, Mr. Smith stated that he is more comfortable with a Geo Mat. Variances requested are groundwater offset to 4 feet, inlet and outlet tees less than 12 inches (5 inches and 2.5 inches respectively), sieve analysis and offset to wetlands from 100 feet to 35 feet. This design has added a filter and a single component tank with a pump chamber and then a one foot mat. As designed, it will keep the fill within the boundaries. George Emond asked if the filter needs to be replaced. Mr. Smith replied that it does and it is easy to get to when cleaned and/or replaced. Agent Jim Garreffi stated that he is familiar with this system. It is a low profil e system that is pressure dosed and allows for an offset to groundwater. It is a good fit for this lot. On motion by Watters and second by Fortin the board voted unanimously to approve the requested variances by roll call vote. 110 SUNSET LANE Doug Smith met with the Board on beha lf of the owner. This property has a steep slope and goes rapidly downhill. This lot is at just about the end of Sunset Lane. Variances requested are offset from cellar wall, 10 feet to 3 feet and distance from a common drive, 50 feet to 8 feet (well variance). Wattles (temporary fence) will be installed 8 feet from the common driveway. This driveway was started years ago and then just stopped. A 40 ml barrier will be installed. The new drilled well will have a setback of 100+ feet from the system. Currently the well is in the basement. Jim Garreffi stated that there is not a lot of traffic on this driveway as the house is nearly at the end. The casing of the well must be sealed into bedrock. He also stated that the new situation is much better than the existing. On motion by Jewell and second by Watters the board voted unanimously to approve the requested variances by roll call vote. 60 WOODLAND DRIVE Board was notified that the owner has opted for public water. ===PAGE 3=== 809 CHASE ROAD Chris Cr owley met with the board as the new owner of this lot. There is an approved septic plan designed by Ross Associated in place but it has expired. Mr. Crowley has re -submitted the plan for re- approval. As a part of the prior approval, a variance was approved for the well (already installed) from 50 feet to a property line to 40 feet. Agent Jim Garreffi stated that the current placement of the well does not impact the abutters to this property. After discussion and on motion by Jewell and second by Fortin the board unanimously approved the re-granting of the well variance by roll call vote. MEETING MINUTES 3/1/2021 3/15/2021 On motion by Jewell and second by Emond the minutes for March were unanimously approved by roll call vote. COVID UPDATE Agent Jim Garreffi gave a Covid Update. He stated that the agency has started a homebound program for Covid vaccine. In order to qualify for this program you must need assistance to leave your home. Nashoba has 100 inoculations available spread across the Nasho ba towns. Agent Garreffi noted that it was a lengthy process to put this program in place. It is anticipated that each nurse will be able to make 5 home visits per day. There was a discussion and a request to hold Prom in the town of Lunenburg. The sta te did come out with guidance in holding a prom. Agent Garreffi spoke with the school nurse. It was decided that there is nothing about prom that incorporates social distancing so Prom will not be held. In the past two weeks there have been 17 positive tests for Covid. This is much improved from the 30 previous cases. We are waiting to see what school opening and Easter break brings. Having no further matters before the board and on Motion by Watters and seconded by Jewell, the meeting was adjourned at 8:15 pm By roll call vote, all in favor. ======================================================================================== DOCUMENT : 2021-05-03-agenda-1050.txt BOARD : board-of-health DATE : 2021-05-03 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/board-of-health/2021-05-03-agenda-1050.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_05032021-1050 ======================================================================================== ===PAGE 1=== BOARD OF HEALTH May 3, 2021 7:00 PM* AGENDA In accordance with the requirements of the Open Meeting Law, please be advised that this meeting is being recorded and broadcast over the Lunenburg Public Access channel. Variances being requested are distance to well, 100 feet to 78 feet, distance to wetland 100 feet to 44 feet. Mr. Smith stated that there is really only one possible site for the new system as the ground slopes. A wall and poly barrier will be installed. Perry Jewell asked if this proposal has been discussed with the Conservation Commission. Mr. Smith stated that it was heard by Conservation two weeks ago and it was Ok’ed based on Board of Health Approval. Agent Jim Garreffi stated that because it is such a tough site with wetlands that what is being proposed is much better than what is there. With the wells and slope this is a reasonable design. ===PAGE 2=== After discussion, on motion by Jewell and second by Watters, the board voted unanimously to approve the variances by roll call vote. 30 GILCHREST STREET Chris MacKenzie met with the board on behalf of the owner. Mr. MacKenzie is proposing a Presby system. They are unsure of where the current system is. A groundwater offset from four feet to three feet is being requested. There is no pump chamber for the system. George Emond asked what the perc rate was and Mr. MacKenzie advised 7 mpi Agent Jim Garreffi stated that there is not information on where the current system is. Th is is a part of a land division and the property must be brought to current code. The property is served by public water. The plan as proposed is a good solution for the lot. On motion by Jewell and second by Watters the board voted unanimously to approve the requested variances by roll call vote. 250 LANCASTER AVENUE The owners amended their building permit to meet requirement so there is no need to meet with the board. HOLMAN STREET The owner revised their building plans to reduce the number of rooms and meeting regulations so there was no need to meet with the board. MEETING MINUTES None Approved COVID UPDATE Agent Jim Garreffi gave a Covid Update. The rolling average over the past 2 weeks is yellow. The positivity rate in Lunenburg has dro pped from 4% to 2.5% and the past week ending April 30 th saw only 5 positive cases. Hopefully this is a trend. Active cases and positivity rates within the Commonwealth are also trending down. There have been a lot of changes statewide. The outside mas k order is being lifted provided you can still maintain a social distance. There are standards on activities so you need to look at the activities so see if masks are required. With regard to sports, it depends on the sport and gives exemptions. Governor Baker has laid out a path leading forward. ===PAGE 3=== May 10th – Large venues can have more attendees. Theme parks can open, amateur sports can begin and singing indoors is allowed (church) among other changes. May 29th - Street festivals and agricultural fairs c an open. Beer gardens can open. You can be served only at a table but food is not required among other changes. August 1st – Commonwealth is fully open. Mr. Garreffi stated that this plan does provide a path for citizens. It is important for people to get vaccinated. It is important also that policy makers are eliminating restrictions based on much lower Covid number. He believes it is a nice balance to get back to normal. Chairman George Emond welcomed new member Lisa Normandin to the board. 249 PLEASANT STREET Doug Smith met w ith the Board on behalf of the owner. This is a small .29 acre, tight lot with high groundwater. This system is designed with fill and will take up the whole back yard. Mr. Smith noted that upon review by our review engineer and agent, Jim Garreffi, it was determined that the math calculations were incorrect. Mr. Smith believed that groundwater was at a lower level closer to the house, which is not the case. He further stated that Bob Proctor will be g oing into the house to see if the plumbing in the h ouse can be raised. If this is possible the tank would be higher and they would be able to meet the variances as asked for on the current plan and variance letter. The current variances requested in accordance with the submitted plan and variance letter are offset to groundwater to 24 inches, tank inlet and outlet tees less than 12 inches, pump inlet and outlet tees and the use of a sieve analysis to determine perc rate. ===PAGE 2=== Agent Garreffi stated this is a tight lot with high groundwater. The lot slopes awa y from the house toward the solar farm. Because of the high groundwater variances to tank outlets are requested. Mr. Garreffi suggested that the Board approve the worst case scenario so that this matter can be resolved tonight without the need to come be fore in the future. If Mr. Proctor inspects the house and the plumbing cannot be raised, the alternative will have been approved. This would include the requirement for monolithic tanks and rubber boots as the tanks would then be in groundwater. Chairman Emond stated that he is not comfortable with approving variances without know the situation with the house or approving variances or a plan that is not presently before the board. He would be willing to approved the variances are as originally presented in accordance with the plan before the Board. Mr. Smith stated that is doesn’t know if the inlet and outlet tee requests will change but they will get as close as possible. Mr. Garreffi suggested that the Board modify the request to reflect the possible change and vote to approve and if it is possible to raise the plumbing it will only get better. In this way, this can then move forward. Mr. Smith agreed to monolithic tanks and rubber boots no matter the situation. Chairman Emond stated that he is not comfortable with what ifs or maybe’s. He is willing to approve these variances as originally submitted and should there be a change, this matter would have to come before the board again with a new plan and new variance requests. Upon motion by Jewell a nd second by Watters, the board unanimously approved the requested variances as originally submitted with the condition of monolithic tanks and rubber boots. All in favor by roll call vote. MEETING MINUTES April 5, 2021 May 3, 2021 On motion by Watters and second by Jewell, the minutes were unanimously approved by roll call vote. COVID UPDATE Agent Jim Garreffi gave a Covid Update. The rolling average over the past 2 weeks is gray . The positivity rate in Lunenburg has dropped significantly. Governor Baker announced that due to the fact that cases statewide have dropped significantly and vaccine is widely available, Massachusetts will be open beginning May 28 th. The changes made today by Governor Baker are staggering. ===PAGE 3=== Masks are no longer required inside or outside. Businesses can open to full capacity with all industries open. Agent Garreffi stated that this has been done 2 months early and has taken out the interim steps. He believes that this step forward is a good one. He stated that people need to look past the headline and understand where there are still restrictions in place. Member Fortin asked if our next meeting will be in per son. No, not until after June 15 th so our second meeting in June could be in person. Evan Watters congratulated Lisa Normandin on her election to the board and welcomed Paul Fortin back to the board. 7:00 pm at the Ritter Memorial Building Members Present: George Emond, Perry Jewell, Paul Fortin, Evan Watters and Lisa Normandin . Agent Jim Garreffi was also present. MINUTES APPROVED August 16, 2021 On motion by Normandin and second by Jewell, minutes were approved. All in favor. 42 PEARL STREET Brandon Ducharme met with the board together with the owners, Joanne and Butch Magurn . A new well is be ing proposed. Currently, the existing well at 37 feet is too close to the septic system and needs to be relocated. This is a very tight lake front lot. A new drilled well, steel cased and is sealed to bedrock is being proposed. Offset variances are requested as follows: Leach field – 100 feet to 61 feet Septic Tank – 50 feet to 45 feet Sewer Line – 50 feet to 30 feet Property Line – 50 feet to 41 feet. Jim Garreffi stated that what is being proposed is better than what is there and he has no issues with the variances being approved. Lisa Normandin asked wh at would happen to the old well. Chairman Emond stated that it will be decommissioned. After discussion and on motion by Normandin and second by Jewell, the board unanimously approved the requested variances. All in favor. 284 LANCASTER AVENUE Tom Alonzo and Christine Foltz, owners, met with the board. The owners are proposing construction of a garage on a slab foundation on their property. It was always a plan to include a garage on this property. The septic system on this site has a septic tank and pump chamber, which are downslope from where they are proposing to build the garage. The garage will be attached to the home and accessed through an already existing door. Regulations require 10 feet distance from the proposed garage to the septic tank. They are proposing a 6.5 foot offset. ===PAGE 2=== Chairman Emond stated that he has no issues with the request inasmuch as the septic tank and pump chamber are down slope from the proposed garage and the c ost of moving the tank and pump chamber would be substantial and create an undue hardship. Vice-Chair Perry Jewell stated that he does not feel that the construction of a garage with the reduction in offset would pose an increase in environmental concern and further the moving of the tanks is not easily feasible and would be costly. After further discussion and on motion by Fortin and second by Normandin, the board voted to approve the variance. All in favor. 30 WEST STREET TERRACE Dan Proctor met with the board on behalf of the owner. This system is in failure. Testing was done with a 5 MPI perc rate. The lot is small and is served by public water. A Presby system is proposed. Variance request is for groundwater offset from 4 feet to 2 feet. Jim Garreffi stated that he has no issues with the request. After discussion and on motion by Normandin and second by Fortin, the variance was approved. All in favor. COVID UPDATE Agent Jim Garreffi gave a Covid Update. Lunenburg is seeing a large number of positive cases and an increase in cases in family groups. This past week there were 12 cases at 4 addresses. Mr. Garreffi stated that he does not have an explanation for the increase in Lunenburg. Labor Day there were 6 cases in one household. We are seeing cases in churches, daycares and large gatherings. Some are not answering the call from contact tracers. Currently there are no mandates in Lunenburg. 5 WALLIS PARK Jim Garreffi stated that the tenant contacted him in February for a housing inspection. The landlord had put in a mini split for heat, but it couldn’t keep up. There were also mice. The Landlord asked for an extension to complete the work but did not respond to Mr. Garreffi when asked for an update. A letter was sent and was responded to today stating that the repairs have been completed and is ready for inspection. Mr. Garreffi will report back after inspection. 441 TOWNSEND HARBOR ROAD Jack Maloney met with the board on behalf of the owner. The house is being torn down and rebuilt on the same footprint as trees came down and crushed the house. A Presby system is proposed. Testing showed a perc rate of 2 MPI. The existing house was a two bedroom, and the plan will be amended for a new two bedroom to be re-built. The property is a lake ===PAGE 3=== front lot served by public water. Variances requested are offset to wetland from 100 feet to 59 feet and groundwater offset from 5 feet to 3 feet. Jim Garreffi stated that this is a dog leg shaped lot with a high water table. A 2 bedroom deed restriction will need to be placed on the property. After discussion and on motion by Jewell and second by Normandin, the variances were approved with the need for a 2 bedroom deed restriction. All in favor. 360 FLAT HILL Jim Garreffi stated that this property is a lot that is being split off of Flatt Hill orchard. The purchaser is proposing 8 building lots on this 22 acre site. The concerns moving forward are what contaminants are in the soil as this property was utilized as an apple orchard with sustained pesticide use. Perry Jewell asked if this area is served by public water. Jim Garreffi said no, that private wells would need to be utilized. The houses in this area with wells have low water quality and low water capacity. A letter was sent to the developer stating that soil testing would be required to determine if there are any contaminants including arsenic. If contaminants are found, mitigation would need to take place. 35 PLEASANTVIEW Joe Brogna, owner, met with the board. He is proposing to construct a new 2 car garage with a greenhouse above it. There is a 4 bedroom septic permit on the property which would allow a total of 9 rooms. Currently there is also an in-law apt above the existing garage. Jim Garreffi explained the definition of bedrooms and total rooms by Title 5 definition and explained that Mr. Brogna’s house was currently (without any additional space) at or above the allowable number rooms in accordance with the existing septic permit. Mr. Brogna shared pictures of his house and the Board of Health and Building Department files were reviewed. After further discussion it was determined that Mr. Brogna’s house was already at the maximum number of rooms. Unless the number of rooms in the house can be reduced, a building permit for the additional living space cannot be approved unless the septic system was expanded to allow for the additional rooms. The board rejected the request without prejudice and advised Mr. Brogna that he could resubmit his request with either the allowable number of rooms or an expansion of the septic system. 71 WILDWOOD Nichole Kirouac met with the board on behalf of the owner. An addition to an existing house is being proposed that exceeds both the allowable bedrooms as well as the total number of rooms. This house has a 3 bedroom septic. ===PAGE 4=== As currently presented, even with the changes that were made to present for the meeting, the addition exceeds what is allowable for both bedrooms and total number of rooms. Possible solutions were discussed such as removing walls. A revised plan will be submitted for review in keeping with this discussion and a reduction in room count. Having no further matters before the board and on Motion by Normandin and seconded by Watters, the meeting was adjourned at 9:05 pm, all in favor. ======================================================================================== DOCUMENT : 2021-10-18-agenda-1057.txt BOARD : board-of-health DATE : 2021-10-18 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/board-of-health/2021-10-18-agenda-1057.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_10182021-1057 ======================================================================================== ===PAGE 1=== Town of Lunenburg Board of Health George Emond, Chairman Tel: (978) 582-4146, x430 Perry Jewell, Vice-Chairman 960 Massachusetts Ave. Paul Fortin Lunenburg, MA 01462 Evan Watters Contact: Andrea Schnepf Lisa Normandin NOTICE OF MEETING Monday, October 18, 2021 – 7:00 PM Ritter Building – Lower Level Lunenburg, MA 01462 AGENDA 7:00 pm 30 Johnson Street Offset to wetland, groundwater offset 7:10 pm 195 Rolling Acres Offset to groundwater, sieve analysis, inlet and outlet tees 7:20 pm 186 White Street Groundwater offset 7:30 pm 61 Upland Tight Tank Approval 7:45 pm 68 Laurel Lane House Complaint MINUTES APPROVAL October 4, 2021 OLD BUSINESS NEW BUSINESS Covid Update SEPTIC PERMITS: TITLE 5 INSPECTION REPORTS: ADJOURNMENT ======================================================================================== DOCUMENT : 2021-10-18-minutes-1057.txt BOARD : board-of-health DATE : 2021-10-18 KIND : minutes OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/board-of-health/2021-10-18-minutes-1057.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Minutes/_10182021-1057 ======================================================================================== ===PAGE 1=== LUNENBURG BOARD OF HEALTH MEETING MINUTES Monday, October 18, 2021 The Board of Health met at 7:00 pm at the Ritter Memorial Building Members Present: George Emond, Perry Jewell, Evan Watters and Paul Fortin. MINUTES APPROVED 30 JOHNSON STREET Chris MacKenzie met with the board on behalf of the owner. This system is likely in failure as it was installed in 1985 and is a leaching pit . This is a small lot and has a perc rate of 2 MPI . What is being proposed is a gravity system with a pump chamber . Variances requested are offset to wetland from 100 feet to 70 feet and a groundwater offset from 5 feet to 4 feet. The existing house on the property is to be torn down and a new structure will be built on the same footprint. There will be no change in the number of rooms. Jim Garreffi stated that the proposed system is more compliant that what is existing at this site now. It will be greater than 100 feet from the existing well and have a four foot offset to ground water . He has no issues with the proposed plan. After discussion and on motion by Jewell and second by Fortin, the board unanimously approved the requested variances. All in favor. 195 ROLLING ACRES Dan Proctor met with the board on behalf of the owner. The septic system would most li kely be in failure due to high groundwater. This is a large lot served by public water. Because of the rainy summer, the soil was too wet to perc so a sieve analysis was used. A Presby system is being proposed. Variances requested are offset to groun dwater from four feet to three feet, sieve analysis and inlet and outlet tees at less than 12 inches. Agent Jim Garreffi requested changes to the plan. He requested that the back of the slope be stabilized by moving the tank downhill . This would also a llow the tanks to move out of the groundwater. Provided the changes were made to the plan, he had no objections. After discussion and on motion by Watters and second by Jewell, the board voted to approve the variances, with the changes to the plan. All in favor. 186 WHITE STREET Kevin Ritchie met with the board on behalf of the owner. This system is in failure and a Presby system is being proposed. The property is served by public water. ===PAGE 2=== Variance being requested in accordance with DEP Presby approval is groundwater offset from 5 feet to 3 feet. After discussion and on motion by Fortin and second by Watters, the board unanimously approved the request. All in favor. 61 UPLAND AVENUE Jim Moran met with the board on behalf of the owner. The system is in failure. Soil testing was done on the site and there is no area where there is sufficient pervious soil (2+ feet) to design a system. Title 5 Regulations do not allow for a system design where the minimum cannot be met. Mr. Moran is proposing the use of a Tight Tank as the only alternative for a replacement system on this property. Agent Jim Garreffi said that after doing substantial testing on the site, there is no area to place a septic system. The only alternative is a tight tank. A tight tank requires the approval by the board as well as a deed notification and an operation and maintenance contract. After discussion and on motion by Fortin and second by Watters the request was approved. All in favor. 68 LAUREL LANE A housing inspection was performed at this address at the request of the tenant , which request was made on September 18, 2021 . An Order to Correct was issued to Elizabeth McColligan, the owner of the property. Ms. McColligan requested a hearing before the board in accordance wit h the Order. Ms. McColligan met with the board to discuss and request and extension of time to repair the issues noted on the Order. The Summary Process Agreemen t signed in Housing Court by the Tenants on Sept ember 17, 2021 states that tenant will pay rent for the months of October, November and December and vacate the property on or before December 31, 2021. Ms. McColligan is requesting an extension until after the tenants vacate to make the repairs with the exception of smoke detectors, which had been scheduled. One of the violations requires application for a variance to Housing Code for ceiling height, which was discussed at the meeting. Chairman George Emond told Ms. McColligan that the board understood her position and a letter requesting the variance would be sufficient and she would not need to appear before the board again. After discussion and on motion by Jewell and second by Fortin, an extension to complete repairs was given until January 21, 2022. All in favor. COVID UPDATE Agent Jim Garreffi gave a brief Covid Update. ===PAGE 3=== Positive cases saw a decline in the past 14 days from 84 to 58 cases. Households still represent the majority of the cluster cases in town. A cluster is defined as two or more cases at a single address. Having no furt her matters before the board and on Motion Jewell and seconded by Watters, the meeting was adjourned at 8:10 pm, all in favor. ======================================================================================== DOCUMENT : 2021-11-01-agenda-1058.txt BOARD : board-of-health DATE : 2021-11-01 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/board-of-health/2021-11-01-agenda-1058.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_11012021-1058 ======================================================================================== ===PAGE 1=== Town of Lunenburg Board of Health George Emond, Chairman Tel: (978) 582-4146, x430 Perry Jewell, Vice-Chairman 960 Massachusetts Ave. Paul Fortin Lunenburg, MA 01462 Evan Watters Contact: Andrea Schnepf Lisa Normandin NOTICE OF MEETING Monday, November 1, 2021 – 7:00 PM Ritter Building – Lower Level Lunenburg, MA 01462 AGENDA 7:00 pm 398 Sunset Lane Well variance – offset to property line (lake) 7:10 pm 326 Flat Hill Well variance – offset to property line 7:20 pm 68 Laurel Lane Variance – ceiling height 7:30 pm 909 Northfield Rd. MINUTES APPROVED 398 SUNSET LANE Greg Roy met with the board on behalf of the owner. A well variance is being requested. This is a demolish and rebuild. There is an existing shallow well. What is being proposed is a new artisan well. Currently, the well is 16 feet from the property line. What is being proposed is an artis an well 34 feet from the property line (shore line of the lake). Variance requested is property line offset to well from 50 feet to 34 feet. Jim Garreffi stated that the existing leach area will be used for the new hou se (3 bedroom installed in 1985) and a small retaining wall is proposed between the leaching area and the driveway. In order to maintain 100 feet from the leaching area and the proposed new well, the well will be less tha n 50 feet from the property line (lake). The granting of this variance will not affect any abutters. The proposed well is an improvement over what is presently existing. After discussion and on motion by Jewell and second by Watters, the board unanimously approved the requested variance. All in favor. 326 FLAT HILL ROAD Ken Matson, owner, met with the board. When the as -built was submitted for the well at the above location, it was drilled too close to the property line (less than 50 feet). Mr. Matson’s explanation is that there was an error made as to where the property line was separating the two lots. Mr. Matson owns both lots. Mr. Matson stated that the location of the well does not have an effect on either lot. Mr. Matson is requesting an offset to property line for the well from 50 feet to 35 feet. Agent Jim Garreffi stated that the lot is large and the well location should not affect abutting lots and does not see a problem with granting the requested variance. After discussion and on motion by Fortin and second by Watters, the board voted to approve the variance. All in favor. 909 NORTHFIELD ROAD James and Irene Rivers met with the board. They are proposing an addition to their residence. The addition, as proposed, will exceed the total number of bedroom allows as we ll the total number of rooms allowed in the structure. ===PAGE 2=== The board advised that the septic system on this property is in excess of 50 years old. In addition, because of soil testing on the adjacent lot, it would appear that the system at this house would b e in the groundwater. Chairman George Edmond told the Mr. and Mrs. Rivers that the board could not further consider signing the building permit without a Title 5 Report being completed. Should the report pass, they would still need to reduce the room cou nt to meet requirement and a deed restriction would need to be placed on the property. After discussion, Mr. & Mrs. Rivers advised that they would be discussing putting an addition on their house before moving forward. MARSHALL PARK Greg Roy met with the board to discuss the replacement septic system at Marshall Park. Dave Passios was also present. Mr. Roy stated that testing had been completed at the park and the most suitable place found was in the location of the old bath house. In designing a syst em, in the space available, he has determined that using a Presby System that would fit into the topography as well as the groundwater, a 1,000 gallon a day system can be designed. A 1,000 gallon day system would support 200 people per day using the facilities. After discussion and a consensus of the board, Mr. Roy is moving forward with designing a 1,000 gallon per day Presby System. 68 LAUREL LANE A hearing on this matter was continued until after the first of the year.
