Agent Jim Garreffi was also present. MINUTES APPROVED December 20, 2021 On motion by Jewell and second by Normandin, the above minutes were approved. All in favor. 138 HOWARD STREET Kimberly Murphy, owner met with the board . This is a failed system on public water. A Presb y system is being proposed. A groundwater variance from 4 feet to 3 feet is being requested. This lot is a fairly big lot with gravely soils and no wetland issues. Agent Garreffi was present at the meeting and had no issues with the granting of this offset to groundwater variance. After discussion and on motion by Jewell and second by Fortin, the board unanimously approved the requested variance. All in favor. 390 NW TOWNSEND ROAD The permit on the above property has expired. This permit is for new c onstruction no variances were allowed. During the course of Covid the Commonwealth of Mass enacted an emergency declaration to extend permits on a State Level. Local permits were extended for 60 days past the expiration of the emergency declaration. This permit meets all state and local codes. At the time that the extension was in place, the excavation had been done. There is now a new owner and the permit has been transfer. Based on the Commonwealth’s extension of permits and discussion of the board and on motion by Normandin and second by Jewell, the board voted to extend this permit for a period of one year or until January 10, 2023. All in favor. 1078 LANCASTER AVENUE Engineer Mark Malbag met with the board on behalf of the owner, Jeff Laundry, who was also present. This an old camp built in 1953 by the current owner’s grandfather. This is an extremely small lot on Massapoag Pond which is currently served by an old leaching pit. Mr. Malbag is before the board requesting a variance for the inst allation of a 3,000 gallon tight tank on the site. Due to the size of the lot and location on Massapoag Pond, there is no other alternative available for this property. ===PAGE 2=== After discussion, and on motion by Watters and second by Normandin, the board voted t o approve the request for the installation of a tight tank with the condition of a 2 bedroom deed restriction and a maintenance agreement in place. Further, the tight tank installation must be completed by May 15, 2022. FLAT HILL ORCHARD – MATSON Jim Garreffi was present to speak with the board with regard to this matter. Mr. Matson purch ased a portion of land from Flat Hill Orchard for a housing development . The land purchased was previously used as part of Flat Hill Orchard. As a part of the approva l for this subdivision, soil testing to determine if there was soil contamination from orchard spraying was required. This property had been used as an orchard since the 1930’s where chemicals were sprayed on the trees including phosphates, arsenic and lead. Jim Garreffi asked that testing be conducted in at least the top one foot of soil. Mr. Matson contracted with a company to complete the testing but Agent Garreffi does not believe that manner and reporting of the results are adequate. Agent Garreffi is requesting that the testing results be submitted in a form that is readable. If the results obtained are under the standards then the soils are ok. In addition, there will be wells located on the individual building lots. Those wells will also be tested for pesticides, as well as standard Lunenburg tests. COVID UPDATE Agent Jim Garreffi reported that there were 148 cases of Covid last week. The two week rolling average doubled to 148 from the previous week of 72. With the exceptionally high number of case is it becoming harder to contact trace for all cases. Nashoba has recently invested in a new system that will send out an automated text to those that test positive. The CDC is changing guidance frequently and the different guidance for differe nt groups makes it difficult. Enforcement is difficult. Mask mandates are hard to enforce. Nashoba will be holding vaccine and booster clinics and will be able to offer other vaccines besides Moderna. Having no further matters before the board and on motion Fortin and seconded by Jewell, the meeting was adjourned at 8:35 pm, all in favor. ======================================================================================== DOCUMENT : 2022-02-07-agenda-1078.txt BOARD : board-of-health DATE : 2022-02-07 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/board-of-health/2022-02-07-agenda-1078.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_02072022-1078 ======================================================================================== ===PAGE 1=== Town of Lunenburg Board of Health George Emond, Chairman Tel: (978) 582-4146, x430 Perry Jewell, Vice-Chairman 960 Massachusetts Ave. Paul Fortin Lunenburg, MA 01462 Evan Watters Contact: Andrea Schnepf Lisa Normandin AMENDED NOTICE OF MEETING Monday, February 7, 2022 – 7:00 PM Ritter Building – Lower Level Lunenburg, MA 01462 AGENDA 7:00 pm 68 Wildwood Groundwater offset 444 Chase Ave Sieve Analysis 7:10 pm 64 Arbor Street Land division MINUTES APPROVAL January 10, 2022 OLD BUSINESS NEW BUSINESS Covid Update SEPTIC PERMITS: TITLE 5 INSPECTION REPORTS: ADJOURNMENT ======================================================================================== DOCUMENT : 2022-02-14-agenda-1067.txt BOARD : board-of-health DATE : 2022-02-14 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/board-of-health/2022-02-14-agenda-1067.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_02142022-1067 ======================================================================================== ===PAGE 1=== Town of Lunenburg Board of Health George Emond, Chairman Tel: (978) 582-4146, x430 Perry Jewell, Vice-Chairman 960 Massachusetts Ave. Paul Fortin Lunenburg, MA 01462 Evan Watters Contact: Andrea Schnepf Lisa Normandin NOTICE OF MEETING Monday, February 14, 2022 – 7:00 PM Ritter Building – Lower Level Lunenburg, MA 01462 AGENDA 7:00 pm 68 Wildwood Groundwater offset 444 Chase Ave Sieve Analysis 7:15 pm 1 Valley Road Permit extension 7:30 pm 64 Arbor Street Land division MINUTES APPROVAL January 10, 2022 OLD BUSINESS NEW BUSINESS Board of Health Budget Covid Update SEPTIC PERMITS: TITLE 5 INSPECTION REPORTS: ADJOURNMENT ======================================================================================== DOCUMENT : 2022-02-14-minutes-1067.txt BOARD : board-of-health DATE : 2022-02-14 KIND : minutes OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/board-of-health/2022-02-14-minutes-1067.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Minutes/_02142022-1067 ======================================================================================== ===PAGE 1=== LUNENBURG BOARD OF HEALTH MEETING MINUTES Monday, February 14, 2022 The Board of Health met at 7:00 pm at the Ritter Memorial Building Members Present: George Emond, Perry Jewell, Paul Fortin, and Evan Watters. All in favor. 68 WILDWOOD Dan Proctor met with the board on behalf of the owner. This is a failed system that had been installed in the 1970’s. Testing showed a perc rate of 8 MPI. A replacement Presby system is being proposed. Variance requested is offset to groundwater from 4 feet to 3 feet. The property is served by public water. After discussion and on motion by Jewell and second by Watters, the board unanimously approved the requested variance. All in favor. 444 CHASE ROAD Dan Proctor met with the board. This system is in failure. The property was too wet to do test holes so a sieve analysis was completed instead and showed a perc rate of 5 MPI. The only variance being requested is the use of a sieve analysis. After discussion and on motion by Fortin and second by Jewell, the board voted to approve the requested variance. All in favor. 1 VALLEY ROAD The septic permit for this property expired in April of 2021, during Covid. The current owner of the property would like to begin installing the system and is asking for a one year extension. After discussion, and on motion by Watters and second by Fortin, the board voted to appro ve the request for a one year extension until February 14, 2023. All in favor. 64 ARBOR STREET Mr. Woodward, the owner, met with the board. He is proposing to subdivide his property retaining a lot with the current house and splitting off a building lo t. As part of this process, Agent Jim Garreffi supplied Mr. Woodward with the Board of Health regulations regarding dividing land . Those Regulations require a Title 5 report be completed on the existing house and that the requirement to ===PAGE 2=== show the location of a new replacement system must be shown on the subdivision plan . This is required to insure that required property for a replacement system is not being subdivided off. Mr. Woodrow did not believe that he should have to submit an additional Title 5 an d did not want to invest additional funds in showing where a replacement could be located. After much discussion, the Chairman, with the support of the board, again informed Mr. Woodard again that he would have to comply with Title 5 Subdivision rules by providing a current Title 5 Report and show the location of a replacement system on remainder lot on the subdivision plan. Mr. Woodrow indicated to the board that he would be resubmitting the plan with the required information. COVID UPDATE Agent Jim Ga rreffi reported that Covid cases within the Town are significantly lower. Cases are half what they had been. Nashoba will continue to hold vaccine and booster clinics and will be able to offer other vaccines besides Moderna. BUDGET The budget was prese nted to the Board. There is a substantial increase in the assessment to Nashoba associated Boards of Health. The increase is due to the yearly 5% increase as well as an adjustment for the increase in population derived from the census in 2010 to the census in 2020. Having no further matters before the board and on motion Fortin and seconded by Jewell, the meeting was adjourned at 8:35 pm, all in favor. ======================================================================================== DOCUMENT : 2022-03-07-agenda-1068.txt BOARD : board-of-health DATE : 2022-03-07 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/board-of-health/2022-03-07-agenda-1068.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_03072022-1068 ======================================================================================== ===PAGE 1=== Town of Lunenburg Board of Health George Emond, Chairman Tel: (978) 582-4146, x430 Perry Jewell, Vice-Chairman 960 Massachusetts Ave. Paul Fortin Lunenburg, MA 01462 Evan Watters Contact: Andrea Schnepf Lisa Normandin NOTICE OF MEETING Monday, March 7, 2022 – 7:00 PM Ritter Building – Lower Level Lunenburg, MA 01462 AGENDA 7:00 pm Nashoba Update 7:15 pm 1432 Lancaster Avenue Water Testing 7:30 pm 236 Cross Road Groundwater Offset, Inlet/Outlet tees, sieve analysis 71 Pleasant Street Groundwater Offset 7:45 pm Stella’s Food Service Violation 8:00 pm 72 Hemlock Building Permit MINUTES APPROVAL February 14, 2022 OLD BUSINESS NEW BUSINESS Covid Update SEPTIC PERMITS: TITLE 5 INSPECTION REPORTS: ADJOURNMENT ======================================================================================== DOCUMENT : 2022-03-07-minutes-1068.txt BOARD : board-of-health DATE : 2022-03-07 KIND : minutes OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/board-of-health/2022-03-07-minutes-1068.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Minutes/_03072022-1068 ======================================================================================== ===PAGE 1=== LUNENBURG BOARD OF HEALTH MEETING MINUTES Monday, March 7, 2022 The Board of Health met at 7:00 pm at the Ritter Memorial Building Members Present: George Emond, Perry Jewell, Paul Fortin and Lisa Normandin. Ms. Montgomery stated that she joined Nashoba Associated Boards of Health in September under a grant. The grant is to run for two years. She stated that her position/job is to support Public Health Education by interacting with all the Nashoba towns to inform and integrate the two. Ms. Montgomery has created a Newsletter to update the member towns as well as providing information and an explanation of what Nashoba does and how they do it , including substance abuse and mental health. The Board welcomed Ms. Montgomery. 1432 LANCASTER AVENUE As part of a Title 5 report that was completed to prepare for the sale of this property, a wate r test was required due to the distance between the well and septic system. The nitrate level was “8”. The drinking water standard is “10” or below however the current nitrate level is too high for Title 5 standards. Agent Jim Garreffi is recommending p assing this Title 5 report as the nitrate level is below the drinking water standard with possibly yearly testing. In as much as the Title 5 report has not yet been submitted, no action will be taken until our next meeting. 71 PLEASANT STREET Bob Proctor met with the board of behalf of the owner. This system is in failure. The property is connected to town water. Soil testing showed a perc rate of 1 MPI. A Presby system is being proposed. Variance requested is offset to groundwater from 5 feet to 3 feet. Agent Jim Garreffi stated that he has no issues with the granting of the variance and that the system will fit nicely in property. ===PAGE 2=== After discussion and on motion by Jewell and second by Normandin, the variance was granted. All in favor. 236 CROSS ROAD Bob Proctor met with the board on behalf of the owner. This system is in failure. The current system was installed in 1981 as a 3 bedroom, fully compliant system. A Presby system is being proposed. Variances requested are offset to groundwater f rom 4 feet to 2 f eet, reduction in inlet and out let tees from 12 inches to 8 inches and 10 inches respectively and the use of a sieve analysis in lieu of a perc test. Agent Jim Garreffi stated that he has no objections to the variances provided the house remains a 3 bedroom home. Bob Proctor stated that the owner does not want to do the additional work necessary to convert this home to a 4 bedroom. After discussion and on motion by Normandin and second by Fortin, the variances were granted. All in favor. STELLAS Allan Souza, owner of Stella’s met with the board. Currently the required Food Managers Certification expired last fall. Food Service Inspector Bridgette Braley advised Mr. Sousa that he had 60 days to submit valid Certification. To date, Ms. Braley has not received the certification. Mr. Sousa advised that the incorrect class was taken and wi th the onset of Covid he has had difficulty finding someone giving the course. He advised that he has tried to complete t he course on line but has been connection problems. After discussion, the board continued this discussion until their next meeting on March 21, 2022 with the understanding that Stella’s food service license could face suspension if the required Food Managers Certification submitted to Nashoba. 72 HEMLOCK Courtney Zivojinovic met with the board on behalf of the owner. The owner is proposing alterations to the home as well as finishing the basement. The property has a 3 bedroom septic currently installed. The original building pe rmit was not signed off by office staff because too many rooms were being proposed based on the size of the septic system. Mr. Zivojinovic is before the board with an amended proposed floor plan that has reduced the number of additional rooms in keeping w ith the allowable flow of the septic system. After discussion and on motion by Normandin and second by Fortin, the board approved the amended floor plan. All in favor. After much discussion and on motion by Jewell and second by Fortin, the Boar d voted to Pass the Title 5 report with the conditio n that the well water be tested yearly. Well testing to include, but not be limited to, coliform bacteri a, nitrates, nitrites and ammonia . In addition, the septic tank that is under the deck must be ma de accessible. All in favor. PERMIT EXTENSIONS 441 Country Road 205 Sunset Lane After discussion and motion by Watters and second by Fortin, the above Septic Permits were extended for one year from the date of the meeting or until March 21, 2023. As per Agent Jim Garreffi, this is based on the fact that during the pandemic the State passed legislation regarding the expiration of permits from State permitting authorities and local permitting authorities (separate legislation). The legislation is not real clear but on the local levels it provided Boards flexibility in granting permit extensions for permits which were active from the start to the end of the declared State of Emergency (roughly 3/13/20 – 6/15/21). The above referenced permits fall within this period. All future septic permit extensions will revert to Title 5 regulations. All in favor. The existing well on the property is not producing adequate water. An effort to repair/ frack the well was not successful so a new well is being requested. The abutting, vacant lot is not bui ldable, according to Ms. Valente . She is requesting an offset to property line for the new well from 50 feet to 21 feet. She is also asking to retain the existing well for gardening purposes. She stated the well will be disconnected from the house. After discussion and on motion by Jewell and second by Fortin, the board unanimously approved the requested variance. The property is vacant and the permit is due to expire this month. After discussion and on motion by Watters and second by Jewell , the board voted to approve the extension. All in favor. 36 PEARL STREET Chris Stoddard met with the board on beha lf of the owner. This is for the upgrade/repair of a two bedroom system. The property is surrounded by private wells. This property also has a private well. The system, as designed, would be 100 feet from the surrounding wells but only 65 feet from the well on site. Other than the distance to well, this plan is fully compliant with Title 5. After discussion and on motion by Fortin and second by Watters, the board voted to approve the variance. All in favor. ===PAGE 2=== COVID UPDATE Agent Jim Garreffi stated th at there is an uptick in the number of cases ag ency wide. The increase is being partially attributed to travel over school vacation week as well as the relaxi ng of mask mandates nationwide. The cases in Lunenburg have been in a steady climb. Both school s and daycares are showing an uptick. The same system for contact tracing is in place as has been in the past. At this point in time, following trends may be most important. There is no record keeping of home testing so the number s are likely much higher. Nashoba maybe offering booster shots in the fall along with the annual flu clinic. 123 CHASE ROAD Attorney Peter Campobasso met with the board on behalf of the owners. Chris MacKenzie was also present as well as owners Zachary Taylor, Zachary Taylor Jr and Julianne Taylor. Attorney Campobasso is requesting a deed restriction as to the number of bedrooms in the house, limiting bedrooms to five. This is new construction of a duplex, multi -generational home. The existing structure is to be demolished. One side of the duplex will have 3 bedrooms and one side will have 2 bedroom s. The home will be held in one ownership between the parties so will never be divided into separate ownership. At issue is the floor plan of the home and the total number of rooms, which exceeds Title 5 regulations. Perry Jewell stated that the Board grants bedroom deed restricts on existing homes and to the best of his knowledge has never issued a deed restriction on new construction. As new construction, why not make the system full compliant as is required? Owner stated that the cost to enlarge the system would be an additional $12,000 and at a minimum would require a six bedroom system. George Emond stated that he is bothered by the number of proposed room. He stated that he has been looking at this carefully including the regulations. It is a big house and exceeds Title 5 Regulations for the size of the proposed system. Perry Jewell stated that he does not want to set a precedent of using deed restrictions on new construction to circumvent Title 5 Regulations. Attorney Campobasso stated that he understands the regulations and that the deed restriction would be place in the deed and not as a marginal reference. This has been done in other towns. Even Watters stated that with the high room count, if the required size of the septic system needs to be a 6 bedroom than a 6 bedroom system is required because this is new construction. ===PAGE 3=== Applicant acknowledged that a fully compliant system would need to be installed. MINUTES APPROVED May 2, 2022 On motion by Jewell and second by Emond, the above minutes were approved. All in favor. LOT A NORTHFIELD ROAD Valerie Diagle met with the board on behalf of the owner. Ed. McSweeney, owner, was also present. The owner is proposing new construction on a newly formed ANR lot. Variance being requested is an offset of well to property line from 50 feet to 42 feet. Due to the location of wetlands and the surrounding wells and septics, the required 50 foot offset cannot be met. Reducing the offset does not impact the abutting lots. After discussion and on motion by Normandin and second by Jewell, the board unanimously approved the requested variance. All in favor. 524 NORTHFIELD ROAD Valerie Diagle met with the board. Ed McSweeney was also present. This is the remainder l ot of the Lot A Northfield Road. A replacement system is being proposed due to the spit of the property. Regulations state the existing system must be inspected, the division won’t make the lot less Title 5 compliant and show that a replacement system ca n be installed. The existing system failed due to its location in groundwater. Variances requested are offset to wetlands from 100 feet to 50 feet and groundwater offset from 5 feet to 4 feet. The system as designed will allow for a gravity system to be installed. After discussion and on motion by Normandin and second by Jewell, the variances were approved. All in favor. PORTA POTTIES SHADY POINT Shady Point has submitted their annual plan for porta potties. On motion by Normandin and second by Jewell, the plan was approved. All in favor.
