This is a potential ANR subdivision of the property for 171 Arbor Street. In 20013 the Board of Health granted a well variance for less than 50 feet to a property line for the well located at 155 Arbor Street. As a part of the proposed subdivision of the abutting property, the owners are attempting to rectify the non-conformance and are proposing a land swap, which would increase the rear setback to 79.9 feet. Additional, the owners of 177 Arbor Street are conveying a 1,429 square foot piece of property at abuts the side yard. They are proposing to place a deed restriction to may this additional land to make this property undevelopable. Allowing the land swap and deed restriction will provide a 46.5 foot undisturbed buffer to the on well located at 155 Arbor Street. The property that with potentially be divided through an ANR is 171 Arbor Street. After discussion and on motion by Proctor and second by Fortin, the board voted to approve the 28 foot offset to one property line with the understanding that as a part of the ANR there will be an additional 50 foot buffer as well as the 17 foot offset being reduced to 13 feet with the addition of a 46.5 foot buffer that will never be developed. This is al l in accordance with a deed restriction that will be recorded in conjunction with the proposed ANR on 177 Arbor Street. All in favor. 413 HOLLIS ROAD Chris MacKenzie met with the board on behalf of the owner. The existing system on this property is in failure and there is high groundwater. A Presby system is proposed. Because of the grade and the location of the existing pluming, a variance is required for inlet and outlet tees less than 12 inches. Variances requested are: Groundwater offset from 4 feet to 3 feet The use of a Sieve Analysis Inlet and outlet tees Use of an IA system ===PAGE 2=== After discussion and on motion by Fortin and second by Proctor, the variances were approved. All in favor. 43 BROWN ROAD Chris MacKenzie met with the board on behalf of the owner. This system is in failure with groundwater at 36 inches with 6 MPI perc. A replacement system has been designed. Variances requested are: Offset to groundwater: 4 feet to 3 feet Inlet and Outlet tees After discussion and on motion Proctor and Second by Fortin, the variances were approved. All in favor. 499 NORTHFIELD ROAD Justin LaClair met with the board on behalf of the owner. This property is the Pat Brody Cat Shelter. The owner is proposing to build a 1,000 square foot addition to include 7 new cat rooms (kennels under Title 5 definitions) to the shelter to provide more rooms the shelter cats. Currently the septic system is designed for a three bedroom residence, 6 kennels, 5 employees and 1 surgical room. The owner of the shelter owns addition land which increases the size of the lot by 2.82 acres. This additional land eliminates the need for a recirculating sand filter. What is being proposed is an increase the leach area to allow for the increase in flow. After a lengthy discussion the board advised that they would support an expansion of the existing septic system rather than a completely new system. As this was an informal discussion, no vote was needed. BUDGET The Board of Health Budget as propo sed includes a 10% for Nashoba Associated Boards of Health as well as the contractual increase for Admin Asst. Andrea Schnepf. All other line items remain the same. On motion by Proctor and second by Fortin, the board voted to approve the budget. Due to reduced water in their shallow wells, these adjoining neighbors are drilling new artesian wells and abandoning the shallow wells on the respective properties. Because they are using the same w ell driller and permissio n is necessary to traverse 73 Round Road to access 57 Round Road, this requests are being heard together. Variances Requested: 57 Round Road offset to property line from 50 feet to 12 feet 73 Round Road offset to property line from 50 feet to 22 feet After review of plans and discussion, and on motion by Proctor and second by Emond, the board voted to approve the variance request on 57 Round Road from 50 feet to 12 feet and 73 Round Road from 50 feet to 22 feet. All in favor. 90 YOUNGS ROAD This property has a new 2 bedroom system without variances. Due to Title 5 Statutes, all septic systems that are less than 3 bedroom system require a deed restriction by voted of the board. After discussion and on motion by Proctor and second by Emond, the 2 bedroom deed restriction was approved. All in favor. 110 BURRAGE STREET Haley Ward, on behalf of MDO Partners, LLC, submitted a Preliminary Subdivision Plan entitled Pine Ridge Estates for review. The property is located at 110 Burrage Street, which was/is owned by the Penniman Family and is the subject of DEP clean -up due to contamination as well as monitor ing of surrounding wells for contamination. After a lengthy review by Cara Olejarz of Nashoba, Jim Garreffi of Nashoba as well as the board, and on motion b y Proctor and second by Fortin, the subdivision plan was denied based on the potential residual contamination of the property. The board may revisit this project with more information provided which will need to include but not be limited to: All DEP information, including clean-up location noted on the subdivision plan; Extensive testing of the entire site; ===PAGE 2=== Complete DEP flies including final disposition; Some narrative solution to potable water for the site. All in favor. Notes provided by Cara Olejarz, Agent, Nashoba Associated Boards of Health 110 Burrage St - Subdivison A preliminary submission for a subdivision at the above-mentioned property has been submitted. I am working on potential comments for the subdivision submittal and will have them available for Monday’s meeting. I have attached some additional information to give background information on this property, including summary results of water monitoring. The property has a Release Tracking Number (RTN 2-15139). The property is approximately 56 acres. The property is associated with a release of volatile organic compounds (VOCs). The property was also used for sewage disposal in several sewage disposal pits. Two (2) of which were the focus of assessment activities are located in the western portion of the property. According to the Post Temporary Solution Status report, dated December 2024 by Cushing, Jammalo & Wheeler, Inc, the “site” is approximately one (1) acre of the 56-acre property. At some point between the late 1960’s and early 1980’s, an undetermined volume of “industrial waste” was disposed in one of the former sewage pits (designated as Pit No. 1). On November 4th, 2003, sub-surface soil samples were taken in the vicinity of pits #1 and #2, which revealed two (2) VOCs were detected in two (2) of the nine (9) samples above the reportable concentration. The VOCs identified were tetrachloroethene and trichloroethene. The results were 14.8 parts per million (ppm) and 10.9 ppm, respectively. The reportable concentrations are 0.5 ppm and 0.4 ppm, respectively. In 2004, sixteen (16) drums were discovered which were partially filled with an unknown material. These drums were removed and transported for disposal. In 2005, approximately, 30.15 tons of drum carcasses and contact soil were transported off site for proper disposal. There are two monitoring wells on the property that have been tested since 2004. The last water tests results in 2023 were non-detect for VOCs. The wells have not been tested since then. Two properties that are served by private wells within 500 ft from 110 Burrage St agreed to having their water tested. Other properties within this area either declined the testing or did not respond. These two properties are 77 Burrage St and 131 Burrage St. The results from the pre and post treatment samples from 724/2023 to 10/16/2024 are attached. Most of the results are under the Massachusetts Maximum Contaminant Level (MMCL). There was one occurrence in June 2024 at 77 Burrage St where the result for trichloroethylene ===PAGE 3=== exceeded the MMCL. These wells are being treating by a Point of Entry Treatment carbon filter (POET) that the owners of 110 Burrage St are providing. In 2021, the monitoring wells at 110 Burrage St were tested for PFAs. The total for all PFAS compounds detected was 20.3 which exceeds MassDEP’s GW-1 drinking water reportable concentration which is 20 ng/1. The monitoring well that was tested is beyond 500 ft from all known drinking wells, so the level was not reportable. 77 Burrage St was also tested for PFAS, and the results were below the MMCL. CENTRAL MASS MOSQUITO CONTROL Andrea Schnepf has been in contact with Tim McGlinchy, Executive Director of Central Mass Mosquito Control to get a clear understanding on how member towns pay for Mosquito Control. Mr. McGlinchy stated that he will contact Mass Department of Revenue to get a clear answer. The Central Mass Mosquito Control website has a YouTube presentation that provides information on the program and what is provided to towns and cities. Andrea Schnepf will forward this presentation to the board by email. 142 WHITING STREET A Stipulation is in place for the repair o f the property. Agent Cara Olej arz reinspected the property on February 25, 2025. Several violation had been corrected. The owner stated that work was scheduled for repair on February 26, 2025 and will address the mold on March 4, 2025. Additionally, a permit application for the porch has been submitted. The work is currently on hold due to outstanding bills/taxes on a different property. The owner has reach out on several occasions regarding access issue to the property. The occupant has been adamant that she needs to be present at the time of repairs. Ms Olejarz have informed the occupant that this is not a requirement of the housing code. The owner has continued to provide reasonable notice in an attempt to make repairs. Per recommendation by Town Council, given the progress of repairs and issues with access to the property, town council has reco mmended extending the stipulation another 30 days. Town council is reaching out to the owner’s attorney requesting a time for the repair once the permit issued. Ms. Olegarz has scheduled a reinspection for March 5, 2025. A reminder that caucus is Monday, March 10th at the high school. Board Goals and Central MA MOSQUITO CONTROL be discussed at the March 17th meeting. This system is in failure. This is a small lot with gravely soils and is served by public water. There are no other options for a replacement system Variances requested: Offset to foundation from 10 feet to 5 feet Offset to wetland from 50 feet to 18 feet Two deep holes – no land available for deep hole Use of an IA system A Geomat system with a Singular tank is being proposed. The will enhance nitrogen removal from the effluent. This system will require a maintenance agreement. After discussion and on motion by Fortin and second by Proctor, the variances were approved to include a 2 year maintenance agreement. All in favor. RUBBISH REGULATIONS The Lunenburg Board of Health Rubbish regulations were created at the time the Lunenburg landfill was closed and Lunenburg moved to rubbish collection. The spirit of the regulations was to oversee residents home waste and recycling. There has been a change in the way Lunenburg now handles building permits as they have moved to an online program. The application is now captu ring construction waste which was not the intent of the Rubbish Regulations. Construction waste falls within the building code. To that end On motion by Proctor and second by Fortin the board voted to have the Lunenburg rubbish regulation pertain only to household waste. All in favor. TOWN COUNSEL OPEN HOURS On motion by Fortin and second by Proctor, the board voted to allow Nashoba Agent Cara Olejarz access to Town Council open hours when necessary. All in favor. ===PAGE 2=== 142 WHITE STREET Nashoba Agent Cara Olejarz provided an update. The was an in-person hearing on Friday. At this point in time we are at a stalemate with regard to interior repairs. The owner is having difficulty gaining access to finish repairs. Counsel has tried to intervene. There was discussion about filing an injunction to gain access but it was not felt that that would be appropriate at this time. 110 BURRAGE STREET The developer’s response to our denial did not answer any of the board’s questions nor did they provide any further information. Andrea Schnepf will make arrangement to sign up for counsel hours to discuss this matter. SHADY POINTE CAMP GROUND Shady Pointe Campground submitted their annual request for porta potties based on previous volumes. On motion by Proctor and second by Fortin, the request was approved. The paper work was never completed to generate a Certificate of Compliance. In completing the paperwork it was noted that the septic tank was not swapped out for a 1,500 gallon tank. There was conflicting information on whether it was required. Steve Anderson did swap out the septic tank but noted that he could only meet an offset to foundation of 7 feet. Regulations require 10 feet and a 3 foot variance would be required. After discussion and o n motion by Proctor and second by Fortin, the variance was approved. All in favor. BURRAGE STREET – PENNIMAN PROPERTY Andrea Schnepf reported that Cara Olejarz and Andrea Schnepf were able to set up a meeting with town counsel with regard to the proposed subdivision on Burrage Street. Two members of the board, two members of Nashoba and Andrea Schnepf were present. The board will be issuing a letter stating that there is not enough information to approve this project. They are proposing adding a 3 season porch to their home. On reviewing the file, it was noted that the number of bedrooms as well as the total number of rooms are in excess of what is allowed with their 3 bedroom septic system. The additional rooms were construction with the appropriate building permits. What is being requested is a 3 bedroom deed restriction be placed on the primary residence to allow them to move forward with a building permit for the 3 season porch. After discussion and on motion by Rudd and second by Pir ro, the approval of a three bedroom deed restrict was granted. All in favor. 177 BURRAGE STREET Cara Olejarz advised that someone is interested in purchasing the property at 177 Burrage Street, which is across the street from 110 Burrage Street and also owned by the Penniman family. There is a trailer on the site as well as an existing well. Ms. Olejarz is asking that the board require not only the standard well test be performed on the existing well but would also like testing for PFAS as well. After discussion and on motion by Rudd and second by Fortin, the board voted to require PFAS also be included in the well testing. All in favor. 143 ISLAND ROAD Marc Patacchiola, owne r, met with the board with regard to a housing order. Mr. Patacchiola has repaired a majority of the violations cited but is requesting the following be considered by the board: 1 Rescind requirement for a cook top; 2 A variance in the required unobstructed light from outdoors in a bedroom; 3 Extend time to repair downstairs shower leak; 4 Extend time to provide home insurance paperwork. They had applied to Nashoba Associated Board of Health to drill two water wells on the property. Nashoba is unwilling to approve the permits and had requested that the Board discuss and approve. The applicants stated that they would like to use these well as test wells and also believe that the property has been cleaned up. The board advised that according to DEP the property has been cleaned up to a point that it can remain as open land. In order to be developed it would require more oversight by DEP. After discussion it was decided that monitoring wells could be utilized without obtaining a well permit from anyone. They are withdrawing the well permit applications. FIRE ROAD 12 There was an additional complaint received by the town manage r with regard to the above. Board members had the opportunity to ride around the lake and did not find anything that would support the anonymous complaint. No further action by the board is required. Because of the distance between the well and septic system (less than 100 feet) a we ll test was preformed that showed a level of nitrates high er and 5 ppm. This nitrate level is a flag for Title 5 but below the drinking wa ter standard of 10 ppm. This matter is before the board for review and to determine if this is a passing report. The board reviewed the information from the inspector and agent. The drinking water standard for nitrates is 10 ppm and this standard is set for a sensitive population (infants). No coliform bacteria was noted in the well with recent testing. After discussion and on motion by Rudd and second by Fortin, the Board voted to accept the Title 5 report as a passing report with the following conditions: 1) the well on this site shall be tested annually for nitrates and the results submitted to the Board of Health with the sample to be drawn by the Board of Health; 2) the requirement for annual water testing shall be agreed to between the parties. Failure to provide annual water test results will result in a failing Title 5. If the nitrate level in the existing well exceeds 10 ppm , the well water can be treated or a new well installed. All in favor. 150 TOWNSEND HARBOR ROAD Variance requested: Use of an IA system, groundwater offset. After discussion and on motion by Fortin and second by Rudd, the variances were approved. The dishwasher would need electric available. Electric is not currently available for the dishwasher. The owner is in the process of hiring an electrician to make electric available. The discussing included the large increase to member town ’s assessment. Causes cited the rising cost of health insurance, increase in salaries, shutting the nursing service as well as the town of Littleton leaving Nashoba and additional discussion about the ongoing State pension issues. Jim Garreffi stated that there are presently 3 bills before the legislature to try and resolve the pension issues. MINUTES APPROVED December 6, 2025 February 2, 2026 March 16, 2026 1491 MASS AVENUE Dan Proctor met with the board to request an offset to wetlands less than 100 feet. This is a new building lot. The property is served by town water. Offsets are 100 feet to 90 feet of the primary system location and 100 feet to 60 feet on the reserve area. Andrea Schnepf spoke with the Conservation Administrator , Herlin Jamie, who indicated that she did not believe the Conservation with have an issue with the variance. After discussion and on motion by Rudd and second by Jewell, a roll call vote was called as follows: Rudd – yes Pirro – yes Jewell – yes Proctor – recuse Variance was approved. 3 CHASE ROAD Owner Tim Robichaud met w ith the board. There was a housing complaint open on a basement apartment. All issues have been resolved except how the living space can be advertised. The space was rented as a studio apartment with storage space. The current tenant is using the stora ge space as their bedroom. The storage space has no windows. The landlord is asking that the apartment be deemed a studio apartment with the tenant utilizing the space however they see fit. After discussion and on motion by Pirro and second by Jewell, t he board voted to make this apartment as studio apartment. All in favor. 41 NEW WEST TOWNSEND ROAD ===PAGE 2=== Carla Laventure, owner, met with the board on an outstanding housing complaint. All violations have been completed with the exception of water seeping into the unit. A sump pump was installed but there is still water seepage. Mrs. Laventure stated that there was a large snow bank making the situation more difficult and the water table is high. There is a French drain surrounding the property. Board member suggested making sure the French drain is working properly, sealing the foundation, amongst other suggestions. After discussion and on motion by Jewell and second by Rudd, the board granted an extension until May 18th at 4:30 pm at which time a solution must be provided. All in favor. PARKS COMMISSION USE OF SEPTIC REPAR FUNDS In August of 2021 the Board of Health voted to allow the use of the Septic Repair Funds (old grant money) be used to replace/repair the septic system at Marshall Park. Alt hough there was a design plan for a new septic system approved, the project was never completed. There are no current plans to move forward with any projects at Marshall Park. After discussion and on motion by Rudd and second by Pirro, the board voted to take back the use of the Septic Repair Fund for use by the Board of Health. All in favor. Mrs. Jordan is unwell so Mr. Scott Doucette, a neighbor is present in her place. Also present were Laur en Passerelli Eric Powell and Kim Duffy. Mr. Doucette read a letter Mrs. Jordan sent to neighbors in April 2026 stating concerns about the development of the Penniman property on Burrage Street. There was a request to include this property in the Lunenburg Water district, which was denied. There are 2 monitoring wells on the property currently that cannot be converted to drinking water wells without the approval of either Nashoba Associates Boards of Health of the Lunenburg Board of Health. At this time, nothing has changed and approval will not be given. The applicant can apply through DEP, which request has been denied in the past. In the count by Agent Cara Olejarz, there are too many rooms on the total property, requiring a deed restriction. After discussion, it was determined that the ADU is two rooms but what is being used as a storage space is in fact heated and can be considered living space. This requires a deed restriction limiting the house to 4 bedrooms and 10 rooms total. On motion by Pirro and second by Rudd the board voted to allow a 4 bedroom, 10 room total deed restriction. All in favor. 20 PINE ACRES ROAD The property is in failure. The system proposed is a pipe and gravel system with the only variance required being a ground water offset. They are building a new house and replacing the existing shallow well. The property is 1.2 acres but is only 100 feet wide. This is a replacement system on a small lot with estimated groundwater at 60” making it impossible to install a fully compliant system. At the time of testing, the soils were wet so a sieve analysis was utilized. The old sys tem is being dug out with the replacement system being installed is in its place. A poly barrier is being stalled. Variances requested are: Offset to wetlands: 100 feet to 34.5 feet Offset to well: 100 feet to 80.0 feet Use of a sieve analysis Perry Jewell noted that Agent Cara Olejarz’s notes stated that a water test was suggest prior to a Certificate of Compliance being issued. After discussion, motion made by Fortin and second by Jewell to approve the vari ances with the condition that a water test be completed prior to the issuance of a Certificate of Compliance. All in favor. 222 WEST TOWNSEND ROAD The contractor met with the board on behalf of the owner. This is the “remainder” property of an ANR that consists of the original house and barn. The house was built in 1880. A new 4 bedroom septic system was just installed. The owner is renovating the house and will have 4 bedrooms but the house has 11 original rooms. The owner is requesting a deed re strict for 4 bedroom with a total of 11 rooms to match the original layout of this house. After discussion and motion by Rudd and second by Jewell, the request was approved. All in favor. ===PAGE 2=== LOCAL VARIANCE REQUIRED FOR AN IA (INOVATIVE) SEPTIC SYSTEM The Town of Lunenburg has a local variance requirement for all IA systems . This variance has been in place for a considerable amount of time. All of the innovative systems are approved by DEP, some of which have become a standard for septic installation. The board discussed allowing a letter request, similar to a request for a groundwater offset, to be allowed for the approval of an IA system. After discussion and on motion by Rudd and second by Fortin, the board approved a letter request for the approval of an IA system. All in favor. The tenant is requesting the old well be retained for: Irrigation Car Washing (future) Fire Suppression (future) Agent Cara Olejard stated in her comments that she has concerns with Car Washing prior to the installation of an industrial holding tank due to prior complaints of car washing draining into the Town’s storm drains and most recently into the wetland. A site plan showing the proposed car washing area as well as the proposed industrial wastewater hold tank is needed. The following documents are required: Documentation that the existing well has been disconnected from the potable water systems and buildings; A site plan showing the proposed car washing area; Plans for the proposed industrial wastewater holding tank; and Conditioned on the installation of the holding tank prior to any car washing on site . After discussion and on motion by Fortin and second by Rudd, this matter was continued until August 17th at 4:30 pm. All in favor. 48 ISLAND ROAD Danny Hernandez, owner, was present at the meeting. Mr. Hernandez has had public water connected to the house but would like to retain the well for irrigation purposes. After discussion and on motion by Jewell and second by Rudd, the board voted to allow the existing well to be used for irrigation purposes with the receipt of a document showing the house has been completely discounted from the house. All in favor. OLD PRIMARY SCHOOL – 30 SCHOOL STREET ===PAGE 2=== The Food Pantry is in discussions to find a new location due to the decommis sioning of the Passios School. One of the options and the most available location is the Old Primary School land. When the school was decommission and eventually knocked down, the decision was made to retain the septic system for future use as a park. A Title 5 was completed. The system is a pump system. The pumps need replacing as well as the property being reconnected to public water. There is a stub at the end of the street. What is being proposed is using funds from the Board of Health Grant Fund to repair the system for future uses as a park. Short term, the system could be used for the temporary site of food bank. The food bank is proposing temporary trailers. If the food bank does decide to move forward, they would need to provide the Board of Health with a site plan of their proposal. In addition, they would need a food service permit through Nashoba Associated Boards of Health. After discussion, and on motion by Rudd and second by Fortin, the board voted to allocate up to $50,000 for the repair of the septic system at the Old Primary School for the temporary use of the Food Pantry (with conditions) and future use of a park.
