Appointment : Rene Trakimas- annual approval for Sunrise Stables Harvest Ride After examining the map, KJ moved to approve permission to use the property for the annual event. CC seconded and the motion was approved unanimously. Appointment: 70 Oak Ridge Road, Plantings- continued at the request of the owner Appointment: review of change of scope at 914 Flatt Hill from prior negative determination. -Charles Hadju appeared before the commission. The previous approval was for foundation work on the inside of the home only. Due to unforeseen factors. The Building office had to adjust the work to include digging an 18 inch trench to allow for insulating. RB was of the opinion it was a field change as long as the owner left any stockpiles away from the rear of the house and that any disturbed areas would be covered or seeded. The Commission allowed this as a filed change with the conditions that the dock be removed this winter and there would also be no elevation changes. CL was concerned about the issue of process. RB noted this was ot a true foundation and as such originally didn’t require a notice of intent. This was approved by a motion of KJ and a second by JR Pursuant to MGL ch 131, s 40 as amended and the Town of Lunenburg Wetlands Protection and Municipal Bylaws a public meeting on a CONTINUED Notice of Intent by Mike Nault of MJN Realty Trust for the construction of a single family home within the buffer zone at 141 Hemlock Road. NOTE: COMMISSIONER RABBIT IS RECUSING FROM THIS MATTER Jon Fortune appeared on behalf of HHL. He identified areas requiring attention, mostly coves and spoke of harvesting with DASH. RB requested downstream flow rates and that they be listed on one document that can be used as a reference. Lake analysis was reviewed. RB recommended that HHL start a dialogue with Mass Wildlife. MM will contact to see if Mass Wildlife is willing to come to a meeting. Tim Lecuivere of 148 Hemlock disputed the validity of the application stating that there was no board vote of HHL. Paul Fortin of 13 Birch Island Way also stated the same. Doug Waters of 80 Horizon Island Road wanted to know what the what the second response was from Caleb Slater and wanted to know if questions or concerns can be submitted in writing. Paul Fortin noted concerns about both wells going dry and sensitive/rare species habitats that were not taken into consideration. The Commission continued to September 19, 2018 with a motion of KJ and a second by cc. The commission unanimously approved the motion. David King represented himself and noted the work and relative locations to the commission. He noted the TIki hut is 52 feet from the water at closest point and the proposed stairs will be on sono tubes. The Commission also discussed a proposed restoration of a pre-exiting wall. Cl had questions as to what constitutes a pre existing wall and the legitimacy of allowing remnants within the water to count as pre-exsiting. KJ asked if the wall was tiered. MR kind noted between 1 and 2 feet equal to the height of the shoreline grade. MR. King also noted the work on that portion will only be during drawdown. RB noted it was obvious the applicant shows the wall was there. JR wondered if the remnant now serves a different purpose. The Dock proposed is aluminum with sections that snap in together and wheel sitting on lock pins. There is a ramp that sits on the wall 4 feet long. A question was raised about tiles proposed in front of the tiki hut that would go slightly within 50 feet of the lake. It was noted that they were proposed to be placed on the ground with space in between to allow permeability. Marro, Kenneth Jones Conservation Administrator MINUTES Billotta Meeting Room 17 Main Street Lunenburg, Ma 01462 Sept 19 2018 at 7:00 PM Call to Order Chairman Bursch called meeting to order. All present except BP and CC Announcements JR announced that at the Stillman fair the storm water booth had 4 individuals sing the talent bank form for conservation. Public Comment Neil Gorman from David Ross and Associates presented the commission with 2 lots owned by John and David Saliba. The configurations had 2 options that would be presented to the ZBA. After examining them, MM recommended the commission support option 2 ( One common driveway for all lots ) The Commission requested a more formal letter and they will add to the agenda to ratify a letter of support. Appointments/Hearings –commences at 7 PM Appointment: Robbs Hill Conservation Area– Gary Gouldrup proposed management plan.- Gary Gouldrup was in attendance. He commenced the appointment by speaking to the commission and re -capping the project at the small town forest. He then outlined the forest stewardship program and the process the commission pursued in order to obtain approvals for the harvest at small town forest (STF). RB asked him what was the main target of the STF harvest. GG replied that a small percentage thinning of declining, sick or disease infested trees. At the request of RB, GG outlined his education and experience in the field of forestry. CL disclosed he owns land abutting the Robbs Hill conservation area. In speaking to the cutting plan, GG noted that the majority of the high value timber was remaining on suite and that the proposed plan removed declining and diseased trees. Rick and Linda Hillson highlighted proposed skidder trails on a map. GG was asked how trees were going to be cut in the interior of the parcel. GG outlined the process of using a feller buncher on site. GG strongly recommended the walking of the small town forest so he can show the details of skid trails and the interior portion of the cut. In response to Linda Hillson’s question on the skid trails it was clarified by GG that the trees would be dragged out bu the skidder eliminating the need for turnarounds, thereby reducing the amount of skidder trail. The issue of the 20to 40% of tree harvesting was in reference to a controlled basal volume and not necessarily the number of trees relative to the total. GG outlined the goal of overall species diversity on a long term basis and not actively managing the area it becomes susceptible to disease, weather concerns and the establishment of a monoculture. Rick Hillson stated he did not like the terms harvest or farm. It was also questioned if the only motivation for the activity was for profit only, The Commission clarified goals for the forest health made over a long term period. RB stated that the trails used in the small town forest management plan were not called in as part of the equation for Robb’s Hill. Lisa Lento of 782 Flatt Hill Road expressed her feelings that the area should not be touched and forest lands should be left to manage themselves. She enquired if this was the only area to be touched. GG noted the southern parcel due to the sensitivity of the area, ===PAGE 2=== would not be touched. Bruce Man of 463 Burrage Ave expressed feelings that the trails would be devastated and wanted to know if the area would be cleaned up. Donna Lambert of 520 Burrage stated she agrees with Dr. Man’s statements. Gg outlined the process of an actual harvest, areas cleaned and some spotty debirs le ft for habitat value. Paula Bertram of 321 Townsend Harbor Why Robbs Hill was chosen after the small town forest. RB noted it was chosen due to age and poor condition of forest area due to weather impacts. He noted the area would only be shut done for one month. Bid packages would also include accessibility trails. Charles Venezia of 1402 Mass Ave. asked how repairs would be made. The commission responded that some areas would be left to be open meadow and that the harvest would be done towards the goal of wildlife habitat enhancement. Carolyn Lussier of Valley Road expressed an opinion of economic concerns. George Martin of 522 Burrage Ave spoke of ATV’s not allowed on conservation land and felt that allowing the harvest activity amounted to usage discrimination. The Commission noted it would address that with town counsel. MM asked GG what would happen within the next 30 to 50 years if the town did nothing. GG respinded the forest would decline. After some further discussion on the same outlined issues, the commission continued this item and arrived at no decisions regarding the disposition of this matter and would continue to consider it. DOCUMENTS CONSIDERED BY THE CONSERVATION COMMISSION WAS A Notice of Intent BU DAVID OSOFF AND A PLAN BY BEAUCHMIN ENGINEERING ENTITLED “ SITE PLAN”. Pursuant to MGL ch 131, s 40 as amended and the Town of Lunenburg Wetlands Protection and Municipal Bylaws a public meeting on a Notice of Intent by David Osoff for an addition within the buffer zone at 46 fire road 12. The public is invited to attend. David Osoff, Rachel Raboin and Tim Beauchmin appeared before the commission. The explained the addition and the orientation to the resource area which was on the front and back sides of the lot due to the location on a peninsula. Among the discussion was the need to remove a triple stemmed oak tree on the left side of the home. MM noted that he wanted to see the erosion control moved to the opposite side of the road in order to protect the wattles from being destroyed during construction. kRB noted that wattles should be added at the base of the wall by elevation 306 to protect runoff from travelling down the st reet. The fieldstone wall is proposed to be rebuilt. The foundation for the addition is a full foundation. Some of the excavated materials will be used for backfill. CL inquired as to the remaining fill. The applicant committed to i t being removed off of the site. Cl also ===PAGE 2=== asked if only the one section of tree stem can be removed with the others left in place. The applicant noted that 2 arborists came to look at the tree and it is not stable due to advanced age and shallow roots. After questioning of the siza and placement o f the addition, Ms. Raboin revealed that the placement was due to the need for the stairs to be located to allow her to traverse between floors due to an illness/. The applicant did agree to plant shrbs within the area of the tree as mitigation. KJ moved to isse an Order of Conditiuons with the special conditions: 1. Erosion protection would be added at the base of the driveway. 2. The plan would be amended to show any stockpile areas. 3. There would be a project schedule submitted prior to construction. This was seconded by BP and the commission voted to approive wth JR abstaining due to late entry into the meeting. DOCUMENTS PRESENTED FOR CONSIDERATION WAS A NOTICE OF INTENT FORM 3 AND SUPPORTING DOCUMENTATION. Emailing a PDF is also an option on request by emailing lcc@lunenburgonline The meeting will be held in the Bilotta meeting room 17 Main St second Floor on October 17, 2018 at 7 PM. The public is invited to attend. John Fortune related a conversation that he had with Caleb Slater on October 4, 2018. Issues addressed were concerns over compliance with the withdrawal rates, timing and the amount of water left under the proposal being less than 50% of the lake volume. The GEIR calls for an 11/1 drawdown requirement and the Landowners Association is proposing October 15 as means to allow residents to do shoreline maintenance. Judith Schmitz from DEP noted the timing was a critical issue and needs to be thoroughly examined and that the volume of water is a major factor in the evaluation of this drawdown. BP noted that he would like the commission to consider a 5 year order of conditions. He also noted that the landowners and MM need to work out a sample scheduling. RB was proposing an incremental drawdown to 4 feet with data from the start to end date of the drawdown with an annual meeting to review the effectiveness and decided if deeper drawdowns are warranted. This would establish baseline. TD is not in favor of the original drawdown presented and likes the shallower approach. RB indicated that his research indicates there is no baseline procedure established for evaluating depths. Cl note similarities to Lake Shirley BP moved to continued to the November 7 meeting to allow for MM and the landowners to plan for sampling, KJ seconded and the commission voted unanimously. DOCUMENTS PRESENTED FOR CONSIDERATION WAS A NOTICE OF INTENT BY MICHEAL GORMLEY AND A PLAN BY WITHMAN AND BINGAHM ASSOCIATES ENTITLED NOTICE OF INTENT SITE PLAN. Old Business – Robbs Hill Conservation stewardship and maintenance plan ( if any update)- Lyn Mann requested a stewardship workshop be held on a night separate from a meeting. BP felt it could be held on a meeting with a light agenda.
