Appointments/Hearings –commences at 7 PM Appointment: Field Change 72 Hemlock Drive – Mr. Jenkin appeared before the commission. MM noted the vote on the motion approved did not include the agreed replanting of the trees. CL noted the replacement standard was 2 to 1 based on size. The applicant. Four saplings will be acceptable The owner will mark the plan and MM requested the marked plan be returned for Tuesday January 28, 2020. This matter will resume on February 5 , 2020 at 7 PM at 960 Mass Ave by a motion of KJ and a second by BP with a unanimous roll call vote to approve. Pursuant to MGL ch 131, s 40 and Lunenburg Wetlands Bylaw and regulations as listed in chapter 239, Bill & June Hudson have filed a Notice of Intent for the replacement of a septic and the cutting and replanting of trees within the 100 foot buffer z one at 90 Hemlock Drive. She noted the notice of In tent was for the septic system replacement. Bill Hudson noted the old tank was 20 feet from the water. Mrs. Hudson noted the fire place in the rear of the building lot will be removed. Mrs. Hudson noted that they intend to replant and replace mountain laurel. JR asked for further detail as to where the Laurel would be removed. They indicated no removal of the Laurel was planned however there is some dying. TD noted trees close to the water on the North side by the water do not need to come down. The owner indicated that they will leave them in place. TD noted a replanting plan would help the commission with guidelines. Mrs. Hudson noted the majority of the planting will take place around the lake frontage portion of the lot . The owners indicated the desire to leave the southern edge open to allow for the sun. CL noted that he saw some trees that appear undamaged and wondered why they needed to come down. BP felt that specifics on the plan indicating removal versus what will remain in place is preferable. TD indicated that due to the number of trees to be removed, a planting plan outlining species and location of replanting should be further explored. CL noted that some trees may not need to be removed. He asked to go on a site visit with MM as to what trees can remain. MM agreed it would be easier to mark what may need to remain. JR noted the roots stay within 30 feet in the areas where the s eptic is not going to be worked on. RB noted that there is no erosion protection on the plan and that needs to be added. He specified by the tank s will need to be added. Bill Hudson noted David Ross is performing survey. RB noted that there is no elevation on the plans. TD noted the c hanges to grade needs to be shown on the plans. There is grading around the leach field noted currently on the plans. It was noted the remainder of the ground work , such as removal of pavement, will need to be added. MM noted he will go to the site with Maryann Dipinto tentatively on January 24 th. Mrs. Hudson noted that there will be follow-up plans for the garage addition that will show removal of impervious. BP noted the square footage of the impervious to be removed in total should be noted on the plans. CL moved to continue the meeting to February 5, 2019 at 7 PM at the Ritter Building. CC seconded and the commission voted unanimously. Pursuant to MGL ch 131, s 40 and Lunenburg Wetlands Bylaw and regulations as listed in chapter 239, Dan & Jean Proctor have filed a Notice of Intent for the removal of earth and storm water management within the 100 foot buffer zone at 1325 Ma ss Ave. Application and supporting documents are available for review at the Conservation Commissio n office by calling 978-582- 4147 ext 431 by appointment. Emailing a PDF is also an option on request by emailing lcc@lunenburgonline, the meeting will take place at the Town Hall, Bilotta Meeting Room, 2nd Floor at 7 PM on January 15, 2020. The public is invited to attend. Frank McPartland and Dan Proctor appeared before the commission. Mr McPartland outlined the elevation changes and the amount of earth to be removed. TD examined the detention basin, the outlet structure and the ability of the basin to retain and infiltrate. Mr. McPartland outlined the storm water events that would infiltrate and the ones that would overflow. It was noted based on questions by TD and BP that the basin has no bedrock undern eath. Mr. McPartland outlined the grading to the inlet of the basin. It was determined that 3 acres will be made level (about half of the property according to Mr McPartland). KJ asked if the land was going to be subdivided. Mr. Proctor sated not at this time, however it may be in the future. Mr. McPartland outl ined the work located in the 100 foot buffer zone and the 50 foot no structure zone. There is no work within 30 feet. TD clarified the tree line of exiting versus remaining post development as shown on the plans. It was noted the basin would be grassed. JR asked where the emergency overflow would be routed to. It was noted it would be to the wetland in the event of a 100 year or greater storm. TD noted that the post development flow would be dramatically slowed down going to the basin. Mr. McPartland noted the design was based on a full development of the site and not the interim condition as proposed at this site. CL examined the larger storms and the retention in the d-basin of such. It was clarified that any discharge to the wetland will be dramatically slowed down to the wetland more than the pre-existing. JR clarified if full development would change the effectiveness of the basin. The answer was that the basin was designed already assuming full buildout. JR also examined the water routing to the wetland with the applicant to ensure the wetland would not lose a water sou rce. Mr. McPartland noted the hydraulic regime post development would maintain the amount of water. TD examined a bifurcated outlet and Mr McPartland noted that the option was examined, and it was determined it would make no difference to the water source to the wetland and would actually incur intrusion to the 50 and 30 foot restricted buffer zones. KJ examined the route of the drainage by Route 2 A.TD asked about the limits of erosion protection. Mr McPartland pointed out page 3.0 of the plans and outlined the erosion control. BP noted that there would be an earth removal permit necessary. KJ noted that the earth removal would take some time and examined the stabilization phasing and erosion control maintenance. KJ asked about the construction schedule. Mr. Proctor stated a firm timeline hasn’t been established however, it could be a season and a half. He further stated that due to a large potential project in Fitchburg he could use 90% of this material and the hope would be to be in and out of there in one year. CL asked after development, and in the future if the development could be re-examined. MM noted under DEP policy on stormwater allows for a revisit of the entire stormwater system. TD asked to have the 77,000 square feet of impervious the initial design is for be n oted on the plans. RB noted the excavation of four phases of development and examined the general sequencin g. He recommends ===PAGE 3=== the sequencing and the basins should be in place prior to phase four be added to any order of conditions. RB noted he did not see a maintenance and annual reporting schedule and that it would need to be reviewed prior to approval. 1331 Mass Ave Dale Erskin: An abutter inquired about old growth trees and fencing. Mr Proctor noted that new trees will be replanted in the area of her concern but not before the earth removal is complete.TD asked for a replanting plan. BP asked for a schedule of the replanting as well. The hearing was continued to the February 5, 2020 meeting at 960 Mass Ave. at 7 PM by a motion of JR and a second by CL. With a unanimous roll call vote to approve. Mr. Katurnia explained the project and the circumstances that required him to appear before the commission. TD noted the site inspection on 2/1/2020 and expressed no concer n. JR expressed concern that safety railings may be in order. Mr. Katurnia stated that railings would require him to go into the ea rthen section of the hickory hills dam. John Fortune of 50 Hemlock Drive and Hickory Hills Dam operator outlined the phase 1 inspection with his engineer and he also inspected the steps and the engineer recommend that the stairs be left in place. He agreed with the assessment Mr Katrunia made regarding the installation of railings. BP inquired how many docks along the dam. Mr Fortune noted it is 3 and as the houses are sold they will be removed and subsequent owners will not be able to use the current areas. They are free standing Docks. Katey Adams 39 Peninsula Drive spoke to concerns about access to the dam. She ===PAGE 2=== reiterated the point Mr. Fortune had made regarding grandfathering. Mrs. Hudson sowed the plans and outlined the varieties. KJ explained the results of the site visit with himself, CL and Matt Marro . Mrs. Hudson explained which trees were marked that were dead and were going to be removed. She outlined the n umber of trees to be planted versus removed. KJ noted the site walk resulted in confirmation as to what was dead and what was viable and he also noted that in his opinion, there are way too many trees on the property, which is what is causing the other tre es to die and the property was heavily populated due to lack of maintenance. He also noted that with the remaining the majority of the shad ing would remain. TD reviewed where new lawn versus trees would be established. Ms. DiPinto noted that the areas of r e-planting were picked up by a surveyor. It was noted the garage originally on the submission was withdrawn from consideration by the applicant. John Fortune 50 Hemlock Drive spoke in favor of the project as proposed. A motion was made to approve an Order of Conditions by BP and seconded by CC with a unanimous vote to approve. CONTINUED FROM PREVIOUS MEETING: Pursuant to MGL ch 131, s 40 and Lunenburg Wetlands Bylaw and regulations as listed in chapter 239, Dan & Jean Proctor have filed a Notice of Intent for the removal of earth and storm water management within the 100 foot buffer zone at 1325 Mass Ave. Application and supporting documents are available for review at the Conservation Commission office by calling 978-582-4147 ext 431 by appointment. Emailing a PDF is also an option on request by emailing lcc@lunenburgonline, at the Ritter Memorial Land Use Building on February 5, 2020 at 7 PM. The public is invited to attend. Frank McParland and Daniel Proctor appeared on behalf of the applicant. Mr McPartland outlined the proposal and outlined the proposed erosion control. He noted to the commission where the loom would be screened. He noted that the overall approach with storm water is met. He reviewed the report from Graves Engineering that was provided to the planning board. He reviewed the operation and maintenance manual with the commission. Mark Rzeznickiewicz of 69 Townsend Harbor Road he expressed concerns about how the development would affect his septic system and expressed concerns about the removal of vegetation and where would the storm water wind up. Mr. McPartland explained the storm water design principle used. JR examined the slopes with Mr. McPartland who indicated a 3 to 1 slope is less likely to erode. Bonnie Rzeznickiewicz expressed concerns about aggravation of flooding. She also pointed out where she has observed a wildlife corridor that is within the area. TD no ted that according to the plan, there may be a reduction of runoff to her property. Pamela Anzaldi of 70 Townsend Harbor Road, questioned the abutter notification process. TD explained the notification process. She asked if the Commission works in conjunction with the planning board. TD explained the jurisdiction and limits of commission authority. She questions the location of 20 feet being used as a setback. She urged the commission to conduct a site inspection. She expressed concerns about the length of time to the project.TD noted that there would be another site visit on Saturday February 15, 2020 as the meeting would be continued due to the lack of a DEP number. Clifford Smith of 70 Townsend Harbor Road He also examined the drainage and the erosion protection. He reviewed the water flow and noted that the driveway receives runoff from the applicants property and noted he was told he would need to resolve a trench. TD noted that the proposal would likely reduce runoff to his driveway.BP examined the contours on the local GIS and noted that the contours indicated TD was correct in his assessment. Mr. McPartland examined the plan with Mr. Smith and illustrated where the post development runoff would travel. Mr. Smith inquired about added vegetated screening and noted that nothing was there. Katey Adams of 39 Peninsula Drive felt that the cross section, if available would show a different picture. Ms. Adams noted that it is currently agricultural land for a very long period and t hat it was not farmed. BP noted that farmed land may have traces of herbicide and pesticide if farmed and felt that as it was pasture plan it would not have those attributes. Ms. Adams noted that the history of the horse farm may have a history of high nitrogen and phosphorus. Mr. McPartland noted the differences in rate of application of nutrients and chemical treatments on farms. He noted the storm water management would remove a great amount of nutrients. Ms Adams brought up the critical area of environmental concerns. MM noted that as there is no proposed wetland alteration proposed the ACEC standards would not be applicable to this file.KJ noted that the he checked the maps and that there was significant development alre ady in zone II . Ms. Adams felt that the plan wasn’t complete enough to obtain an actual picture of the impacts.TD noted that it was a large amoun t of alteration. Ms. Adams outlined the aquifer protection by-law and stated the need to review it further. Ms. Adams expressed ===PAGE 3=== concerns that the site may not be able to be adequately managed in the event of a large storm event and expressed concern over impacts to the wetlands and adjacent lands. TD stated that he realizes this is a large project, however he feels that the engineer did a wonderful job of planning comprehensively. Dan Proctor noted the history of how he acquired the land. He stated that being in the septic system business that he could state confidently the proposed work would have no effect. The first three hearings notices were read into the record and heard in block form as it was the same property and the same development proposal: Chris Anderson from Hannigan Engineering appeared before the commission. He noted current conditions to the Commission of the land and the resource areas. Mr Anderson noted that the common driveway will require a wetland crossing and outlined the details of said crossing and the replication area. He outlined the construct of the retaining area and the construction of a retaining wall to help protect from snow storage or dumping occurring wither within the wetland or the replication area. Along with the driveway there are 2 lots proposed for single family homes. He requested a waiver from the 30 foot no touch zone for lot 2. He outlined that the grading within this area was designed to balance stormwater runoff. Lot 3 was also outlined and the construction within the buffer zone. He noted there would be no additional work within the 30 foot no touch zone and therefore no waiver on this lot would be requested. BP asked as to the reason for a beehive grate. Mr Anderson outlined the reason. BP also asked about the source of the stream and why the pipe was 18 inches. Mr. Anderson spoke of the flow on the site and the 18 inch was design to carry any flow condition. TD indicated he noted on the site walk the site was flowing heavily. TD asked why an open box culvert was not proposed. MR Anderson noted that due to conditions of the stream at the crossing point it was noted that an open bottom culvert would present potential frost issues. CL requested that there should be a maintenance agreement for the culvert. BP noted the bee hive grate could be blocked. Mr Anderson referred to the detail of the culvert and noted that is a redundant feature. BP examined the are of the 30 foot zone. Mr. Anderson outlined the grading required and detailed the post development stormwater flow it was designed to enhance.TD noted the amount of cuts and fills and asked if it would be balanced out. Mr. Anderson noted that some fill may have to be brought in. CL asked why was necessary to work in the 30 foot no touch zone and why could things not be moved out. Mr. Anderson noted that alternative placements were examined and it was driveway considerations for the grading to allow for safe use of the driveway. Mr Anderson offered to take a second look a the house location for lot 2 to examine the potential of moving the grading out of the 30 foot no touch zone.TD asked if any tree clearing was needed. Mr Anderson noted that there is some proposed and noted where on the plan it was. TD asked for the trees greater than 6 inch caliper to be marked both on the plan and in the field. BP expressed an interest as to where the stream originated. TD asked the commission if there was any issue on lot 3. The Commission indicated none. KJ summarized the issues that should be addresses on lot 2. CL asked about proposed activity within the 50 foot zone. Mr, Anderson noted there was some grading changes within both lots. CC asked if there was any detail concerning the replication area proposed. It was noted the detail was not yet completed. TD asked if grading on 30 that could not be removed if some type of mitigation for intrusion in the 30 foot could be added. JR asked if the stream was perennial. It was noted it did not appear on the USGS mapping. CL asked if there as any method for flow calculations for the stream to justify the culvert. Mr. Anderson noted the other pipes in the same stream were 18 inches and the pipe was sized appropriately. There was no public comment. The meeting was continued to the meeting of March 4, 2020 at 960 Mass Ave. A site inspection was scheduled for February 29, 2020 at 9 AM. They requested areas of impacts and trees to ne demarcated in the field. The motion to continue was made by JR and seconded by KJ with a unanimous vote to ===PAGE 3=== approve the motion. Apparently he surmised it would as the applicant presented a MEPA filing the afternoon of the 19 th.He also outlined his conversation with DEP. Mr. McPartland outlined the difference between the Zone II and the Zone III and the required documentation. He outlined the allowed and prohibited uses within the zone II and zone III lines and noted that as they were in the allowed zone III lines you can clatter up to 50% of the land and they were preparing documents to that effect. MM noted that the 44% under sate Zone II and the ACEC appeared to be met. Mr. McPartland noted that the storm-water would be designed to meet the standard by using storm water catch basins. CL asked about the maintenance plan o the storm water. It was noted the storm water maintenance plan would be amended to clear that the plan was applicable to future owners. TD asked about procedures concerning dust control during the removal process. Dan Proctor noted that the water trucks will be onsite and calcium flakes will be on site. JR noted particle sizes and high winds should be addressed and concerns about weekends and if there would be any monitoring on site. TD noted there would be more information needed to address DEP concerns. The information needed to satisfy DEP concerns expressed in a phone call made to the office in the late afternoon. Mark Rzez asked about the specifics on the storm drains. Mr. Proctor outlined the storm-water schematics for the site as proposed by his engineer. CL noted the maintenance plan and the scheduling. MM noted that the deed will also have the storm water plan on it. Katey Adams asked what the procedure was for certifying the vernal pool. She also pointed out that the zone III issue may change in percentage if the residential lot is zone off. Alan Dantonio was concerned about his back yard and claimed he was not notified. He expressed concerns about runoff and stormwater on his property. TD noted that it was his opinion was that the engineer has done a good job on site design to address the storm water concern. Mr. Proctor noted his test pits were 16 feet deep and if rock was encountered, they would not remove it. Mark Rzeznikiewicz noted to the commission that it had been established that there would be no blasting, The meeting was continued to the March 4, 2020 meeting by a motion of BP and a second by CL with a unanimous vote to approve the motion. AGENDA Call to Orde r 7:00 PM: Meeting called to order with RB presiding. All members were present. Staff present. RB read open meeting law temporary modifications ordered by the Governor in response to COVID-19 pandemic. RB outlined the remote application particulars and procedures for both telephone and the computerized participation. Announcements Public Comment Comments are to be limited to 3 minutes and on a subject matter under the direct jurisdiction of the commission. Comments about current agenda items are to be made during the comment period of the specific agenda item Appointments/Hearings –commences at 7 PM Appointment: Proposed Eagle Scout Project Eagle Scout : Drew Tobin presented his proposed project which is a proposed bat house (4) at the Hollis Road pollinator habitat and will be mounted for posts. He will be fundraising on his own. KJ noted if he needed assistance to let MM know. Mr Tobin noted the reasons for posts are the result of the bats not preferring areas with branches and they tend to prefer sunlight. Based on a question by RB, bats have a diet of mosquitoes and will provide a public benefit. The may start date may be delayed due to the current pandemic issue. There was no public comment. KJ moved to approve the project CC seconded and the commission voted unanimously by roll call vote. Appointment: Hickory Hills Land Management Hickory Hills: John Fortune presented on behalf of Hickory Hills. Mr. Fortune narrated the study work by the private Consultant – ESS Group. They presented the association with a 5-year management plan. Solitude lake Management will be performing the work. ESS has recommended whole lake treatment for the fanwort. Solitude has recommended an April treatment. Concentrations of Flouridone will be maintained at 20 ppb for four applications. Glyphosate will be added for the area of American Lotus. There will also be removal of existing roots, sediments and seeds in the fall of 2020. BP asked about why the early application was necessary. Mr. Fortune noted that the early application is advantageous as catching the plants while they are younger in the growth phase is more effective. Joan Please and Paula Bertram also spoke to the prevention of growth and algae problems as an advantage. CL asked for an elaboration as to what boosters are. Mr. Fortune noted the boosters were meant to maintain level of chemical to allow for effective action Cl asked what the upper limit is. Mr Fortune noted it was 250 ppb. The levels are maintained to allow for effective kills of fanwort but not native weeds. Paula Bertram noted that Solitude will also be doing a pretreatment survey to update the data. CL asked about native species that may ===PAGE 3=== be of concern. Mr Fortune noted the diquat may kill some of the natives in small areas however the dosages are limited in scope per area of lake to allow for that side effect to be minimized. Paula Bertram noted that there is now mermaid weed in one cove that may also be killed as a part of the project. JR asked if the old harvester can still be used later in the season and if the diquat is still scheduled in late May or June and the answer was yes. Paula Bertram noted that the 5 year comprehensive plan is going to be forwarded by ESS. RB expressed concerns that the scope may be too large than was anticipated. TD noted that he was not concerned with the scope and that he feels the association has gone over and above. BP noted that he is aware of all of the outreach and education and outreach and that anyone that uses the lake is aware of what was proposed and was approved by the residents in a vote. Catie can see the argument about the size of the scope and that she feels that there was enough information generated that she felt comfortable with allowing it to go forward. CL asked RB to clarify his position. He feels that tis is a very large scope that is not normally approved without a public hearing and an amendment to the NOI. CL felt that he hasn’t had much time to review the details and there may need to be some fine tuning. CL asked what monitoring is gong ot be done and the amount of sampling and the notification process for each of the steps as they are implemented. JR indicated he in support of the plan and it should move ahead. He feels that there was 2 expert firms that were very thorough. JR indicated that an extra meeting of the residents approved of the work to be done by a large majority at a great expense to the landowners. KJ wanted to hear Mr. Fortunes response to CL’s questions, however he feels there is enough information to move on to a vote tonight. TD asked if there was going to be a downstream impact to the vegetation as far as mortality. Mr. Fortune responded that the information was sent in March. He out lined the sampling would be performed before during and after. He noted that there should be no impacts to downstream waters and plants as there would be a very low dose applied and will dilute out at the outlet of the dam. It is not expected to be a major issue. Paula Bertram outlined the informational process to the residents and emphasized that there is a time issue with the application being needed by April 30th. There were prior meeting scheduled in March and due to current circumstances the commission couldn’t act. Resident of 158 Highland Road fully supports the efforts and requested the Commission act. BP moved to approve the notification as sufficient. JR seconded. CL noted that he does support the concept and wishes not to delay it. CL requested if they could have an update in mid June. Mr Fortune stated yes he would be glad to do the update. The commission approved the motion by 6 yes and RB abstained. EO- Emerald Place Beach- update (to be made in the spring of 2020) – BP had submitted a picture and saw the site and noted no sign of erosion. The picture was taken 3 days ago. CL asked if BP looked further down the beach area. BP noted the whole beach was flat. TD moved to close out the EO. KJ seconded and the commission voted nanimusly n the motion. 3. EO- Town of Lunenburg Fire Road 12 ENF 2019 Updates( If any) 4. EO- 179/183 Island Road- MM recommended the progress as-built and a remedial plan within 30 days. JR would want to see the remedial plantings be done as soon as practicable. He was not adverse to pulling back the material now. MM recommended that we should have a firm deadline within 30 days for a notice of intent and engineering plan. CL noted that he was wondering how an engineer can quantify the work within the water. TD noted that there was grading specifically in the lake bed and that there is a need for the engineered plan. He asked that the pandemic contingency be taken not account. JR asked of MM could list the violations. Paula Bertram urged the commission that while she could understand the issues surrounding the pandemic however the violation is egregious and that the commission shouldn’t wait. Joan Pease also expressed the same concerns as Mrs. Bertram elaborating that there is still a concern for erosion and wash down of the fill in the bottom of the lake. RB proposed that the applicant be contacted that we are requesting an as built be produced as soon as possible with a quantification of allowed activities and violations. The applicant is to be advised to have the documents ready for the 15th of April. There will be an administrative hearing. RB noted that erosion protection should be placed.
