There is an exiting system on site which was shown by Dan Proctor who outlined the history of the property. Mr. Proctor noted he had a permit in hand by the Board of Health. RB examined the grading and the work within the limits of the no disturb zone which will be about 10 feet and that the wattles will be the limit of work. JR noted that based on th site inspection he feels there is no other place to put it. There was no public comment, TD move to approve an Order of Conditions. CC seconded and the commission approved the motion by unanimous roll call vote. CONTINUED FROM PREVIOUS MEETING: Please be advised that the Town of Lunenburg DPW has filed a Request for Determination of Applicability in accordance with Massachusetts Regulations 310 CMR 10.00 and Chapter 239, Wetland Protection of the Town of Lunenburg zoning bylaws for property located at 520 Chase Road (Lunenburg DPW). The proposed activity includes the replacement of the existing underground storage tanks and fleet vehicle dispensers with new aboveground storage tanks and new dispensing equipment. The project will involve replacement of the refueling surfaces with new concrete.. Emailing a PDF is also an option on request by emailing lcc@lunenburgonline.com Robert Colluccio and Jack Rodriquenz appeared on behalf of the DPW. Mr. Colluccio outlined the project for the Conservation Commission and its relation to the wetland resource area. He outlined the tanks that would be installed and that they would now be above ground. He outlined the improvem ents within the fuel dispensing area. The tanks and any underground piping will be double walled and equipped with sensors. There is no work within the buffer zone. There is no increase nor impact in impervious surface. The project is utilizing the town funding from a grant program. RB noted that he feels there should be further protections due to the proximity of the work to the brook. JR inquired as to the locations of the pumps in relation to the riparian zone. He also asked about droplet capturing. Mr Colluccio indicated the control barriers. JR also examined alternate locations. Jack Rodriquenz examined the alternate locations and he noted and illustrated the large amount of work increase that would be required. He also noted that there would be vehicle traffic on the remainder of the site that would be prohibitive. He further outlined the safety and filling requirements. He noted that this is not a standard gas station in regard to the fact there is not a heavy volume of traffic in an out of the pump area like the gas pumps. He further outlined that the existing location was optimized to allow DPW and police vehicle traffic. KJ feels this is important to move on as rapidly as possible to get the tanks out of the ground. The above ground tanks area a better alternative and more readily observable and that the area proposed was the only area that it could be safely completed. He feels there would be more safeguards in place. CL noted that while he supports JR’s comments he also understands the constraints to the town that KJ outlined. He also noted that his understanding that it was committed at town meeting to move this out of the area of the Mulpus. CL expressed concern that an alternate location could be examined. He feels a Notice of Intent is appropriate. TD had visited the site and he does not think there is a sufficient alternate location. RB feels this is a good opportunity to control stormwater and should have better mitigation. BP felt the commission should focus on the fact that there is an improvement on spill containment, and he would be willing to vote on it. CC agreed that there is more detail needed and would like to see a notice of Intent . JR requested a site walk. ===PAGE 4=== David Passios 56 Whiting Street. He was asking for the deadlines involved in funding. Mr. Rodriquenz noted that there is a signed contract with the state and that there may be a deadline extension. The current location of the fuel tanks was examined. Mr. Passios expressed agreement with examining alternate locations. BP noted that a professional engineer should be on the site walk. RB noted that the commission should not be selecting the alternate site but rather determine if the site proposed is acceptab le. KJ noted the public safety officials have already noted that it has been determined the location on the site is optimal and feels the location is already optimal. JR noted that there is a whole new set of variables now on the site that he feels have not been considered. KJ noted that there is a visibility component that will be present on that part of the site that is not present in other locations spoke of. CL feels that a Notice of Intent should be required. BP feels choosing sites is beyond the commission scope. He feels additional detail can be covered on the RDA process. RB noted that DEP will be part of the NOI process. TD feels the NOI is appropriate. CL moved for a positive determination. Mr. Colluccio stated that he feels the location is optimal and that if there is a Notice of Intent filed would the commission require alternate locations. JR seconded. JR did state during the discussion that a site walk could clear the items expressed without a vote. CL feels the pumps should be moved out of the area. The roll call vote was all in favor except KJ who voted no. CONTINUED FROM PREVIOUS MEETING :Pursuant to MGL ch 131, s 40 and Lunenburg Wetlands Bylaw and regulations as listed in chapter 239, Wilbur Abbott III has filed a Notice of Intent for the construction of a common driveway within the 100 foot buffer zone at 335 Chase Road. Application and supporting documents are available for review at the Conservation Commission office by calling 978-582-4147 ext 431 by appointment. Emailing a PDF is also an option on request by emailing lcc@lunenburgonline.com Chris Anderson appeared before the commission with the revised site plan. He outlined the revisions to the plan. He noted that the stream originally outlined change noting that there is no wetland upstream changing the designation. He further outlined the use of a retaining wall to save the amount of trees to be cut, He noted that the stream as it is no longer jurisdictional does not require replication. He outlined the analysis of the capacity of the pipe to handle the flow and was able to confirm that the pipe was modified to ensure that the flow would be handled as a 24 inch pipe that will accommodate the 100 year storm event. He did note there will be additional rip rap added to the crossing for scour protection. He requested a waiver for the 50 foot no structure zone to accommodate the retaining wall which eliminates the need for any intrusion into the 30 foot no touch zone. He outlined the stabilization technique to be utilized. RB analyzed existing conditions’ asked TD about his prior suggestion about flipping the house around. MM explained the change in jurisdiction. Mr. Anderson noted the reasons for the current house location ion relation to a 30 foot no touch zone that no longer exists due to the stream reclassification and the title V issues. RB examined potentially moving the grading uphill. Mr. Anderson noted that in order to do that as he had examined that there would be a raising of the structure and the overall grading of the toe of slope would not wind up changing significantly. He did outline erosion and stabilization procedures for the slopes. RB asked if there could be some boulders dropped n the 50 foot zone. Mr Anderson requested that the boulders be looped around in order to accommodate the installation of a well. BP asked if anyone went to Mass DOT for the design of the storm drain. Mr. Anderson noted that DOT would not have any design on a road this old and did walk the storm drain areas. BP indicated he was not in favor of the boulders at the 50- foot line. MM noted the will review the erosion/seed mixes. There was no public comment. A motion was made to approve the driveway with the addition of the boulders within the 50 foot zone and the stabilization ix to be determined by the administrator by KJ and a second by BP the roll call vote was unanimous to approve. ===PAGE 5=== CONTINUED FROM PREVIOUS MEETING :Pursuant to MGL ch 131, s 40 and Lunenburg Wetlands Bylaw and regulations as listed in chapter 239, Wilbur Abbott III has filed a Notice of Intent for the construction of a single family home with a driveway and septic within the 100 foot buffer zone at 335 Chase Road Lot number 2. He outlined that the screening operation was moved out the zone II and III and there will be no storage of fuels within that area as well. He also outlined the revisions that were made by the applicant to address DEP and commission comment. The Planning Board closed on the stormwater permit on Monday evening. He outlined the required soil borings and related the results to the commission. There was no public input. BP moved to approve the plans. KJ seconded and the commission vote unanimously to approve. Appointments : Neil Gorman informal discussion concerning potential construction at 238 Fire Road 16 Neil Gorman and Butch Magurn presented an information plan showing a plan for a single family home and its relation to the wetland resource areas. He outlined that there was a wetland area reviewed with MM noting that there is a wetland subject to local by law. He was asking for commission input in order to decide to proceed with the filing. RB examined the hydrologic connection between the lake and the ===PAGE 6=== isolated area. It was noted that there is a rare species habitat. It would be noted that it would go to MESA review. It was noted that there is an exiting road way which would not require major modification. MM recommended that the MESA review be completed prior to the filing of the NOI. Mr. Gorman noted areas of existing pervious surface that could be removed. CL noted the history of the site and confirmed the existence of the impervious pad. CL indicated he was concerned about any modifications of the 30 foot no touch zone. JR asked if the cart path was a public Right of way. Mr. Gorman noted it was private property. JR had spoke about relocating the garage and place it out of the foot zone. TD noted he was opposed to any work within the 50 foot zone. The septic system location was examined. Mr Magurn noted that they are current lake residents and are sensitive to the concerns in the lake and the remainder of the 13 acres would remain undeveloped. He noted that areas closer to the residents were steeper sloped areas and the proposed location of the proposed pushed maximize the flat parcel. They will propose more information. Appointment: Field Change Jon Hogue- MM outlined the field change He will monitor the construction. BP moved to approve the change. JR seconded and the commission vote unanimously to approve with TD abstaining. ENFORCEMENT Violations (Enforcement Actions and Administrative Hearings). 1. EO- 179/183 Island Road- continued discussion and administrative hearing MM outlined the history of the site and the enforcement actions. RB asked the commission to addressed the outline for remediation. MM noted the survey was underway. TD feels the survey is a critical component and it should be used to contribute to a resto ration plan. The lake is currently to high for the removal of the sand. BP noted that the sand should be removed. He feels the sand should be removed. He noted the stone wall is 44 feet to the water now and not 50 feet. He further noted that there should b e remedial planting done for the displacement of any BVW and fining is in order. CL noted that then report should be amended to add the fact that the 44 feet from wall to shore was no t an issue. KJ wants to wait for the survey to be completed. JR asked if there could be an incentive added for a fine. BP feels a revegetation plan should be discussed and approved by the commission. Joseph Obrien noted that he contacted Stan Dillis and will have the survey required by the commission added. He will have the high-water mark. MM felt adding the BVW as Mr O’Brien outlined was a good idea. The commission confirmed it agreed with the direction of re-staking the wetland. Mr. O’Brien noted that the sand still on the area that was altered was the remains of the sand from the original pile and he can get rid of it now and scrape it to the loom layer. He asked if it could be regraded and seeded. He noted that he would have the engineer draw on the shrubbery. He offered to start planting bushes now. CL feels we need to get everything documented prior to the start of work. He feels that there was grading of the 50 foot area and feels that there should be some survey work done on the grading that had happened. RB noted that plans approved in May 2019 did not have that level of detail. JR reviewed photos he had taken of the site. It showed grading within the waters edge and the retaining wall by the edge showing what appears to be a modification to the wall. JR asked that the sand be removed now. Paula Bertram noted that there was 3 abutters to the properties that can no longer access the water and that she felt the wattles were insufficient. Joan Pease noted that the revegetation should not consist of lawn and that it should be replanted as soon as possible. Mr. Obrien consented to allow MM to contact survey . He will initiate contact by both writing and phone calls. 2. EO-164 Page Street – Continued actions – to be removed by May 2020 noted nothing has been done to date MM to send out an administrative notice by a motion of CL and a second by TD. AGENDA Call to Order Announcements Public Comment Comments are to be limited to 3 minutes and on a subject matter under the direct jurisdiction of the commission. Comments about current agenda items are to be made during the comment period of the specific agenda item Appointments/Hearings –commences at 7 PM all members present- meeting called to Order by Chairman Bursch there was no public comments Appointments: 1. Mark Bursch Proposed work on 150 Cross Road RB recused himself. Mark Bursch noted where the work was proposed. TD noted that a new RDA would be appropriate. There will be no work within the 50 foot buffer zone. RB noted that he agreed with TD. CL requested that there were three trees that were substantial and requested that they be indicated on the sketch. Mark Bursch noted he would work on the filing with MM. 2. 72 Hemlock – map with tree plantings No plans had been presented and it was moved to the next meeting 3. E-Cert DPW Culvert at Chase Road at DPW facility at 520 Chase Road. Brian Marchetti and Jack Rodriquenz was present. Brian presented pictures and a drawing. He narrated the details of the pictures to show the current conditions of the site. Brian outlined the stream crossing standards and noted the actual standards would be about a 12-foot-wide culvert. He designed a culvert that accomplishes the 1.2 times bankful width featuring a 13-foot-wide culvert and showed details of such. The bottom of the exiting culvert would be left in place to continue to act as the bottom. He outlined how the required wildlife crossing would be inc orporated into the design. He outlined erosion protection that would be utilized during the installation and how it would work. RB asked how far upstream would have to be disturbed. He asked how long it would take to complete construction. Mr. Rodriquez could not estimate an exact time but would start immediately upon arrival and that he would do one half of the culvert at a time to allow for continued access. Mr Marchetti explained how the culver comes in sections and how the sections can be installed one section at a time. CL noted the plans looked good. He had presented pictures he had taken of the inside of the culvert and that a portion of the bottom was missing a nd asked if the missing part would affect the use of the culvert in the plans. Mr. Marchetti noted that the remaining could be pulled if necessary, leaving the bottom exposed and would work effectively. CL reviewed the pictures he took of the culvert top and felt there was time. Mr. Rodriquez explained that the culvert needs to be replaced right away. CL asked about the timing of the plan on filing for the Notice. MM explained the work would need to be complete within 30 days under the emergency certification and that it could be added to the Notice of Intent. CL noted we may wish to consider having a separate Notice of Intent. RB asked for a narrative for remediating the stream bed. TD expressed a concern of what precipitated the failure of the cover. He noted that as the bottom is now gone the material moving would result in a moving and shifting of the structure and the open bottom would not have that issue. He wanted to note how he could prevent future scouring with an open bottom. Mr. Marchetti noted that the depth of the footing needed be re- examined and adjusted if the current culvert bottom was to be removed. BP noted that the open shelf could be used as a wildlife culvert and what would now happen if the culvert bottom was now open bottom. Mr. Marchetti noted that even with the bottom modified the width would prove the openness to allow the wildlife corridor to be maintained. KJ noted ids 30 days enough? Mr. Marchetti could not provide a definite answer. RB requested the 1.2 ration should be maintained regardless of the bottom and if it could not, they should reconvene to address it. There was no public comment. A motion to approve the emergency certification was made with potential modifications to the bottom was made by TD with as second by KJ a roll call unanimous vote approved the emergency certification. 4. LSIC annual meeting with the commission Wendy Gendron, Dominic Merengolo and Joanna Bilotta were present to address the conservation commission. Dominic presented the year end data. He spoke about the treatments over the course of last year and the weeds targeted. He noted that there was a total of 70 acres treated and there was no algae treatments necessary. There was a post treatment survey in September. CL asked about the future potential of fanwort and the use of clipper. He noted the report called for mid-July for the timing and asked about the difference in the mechanism for delivery. Dominic noted that sonar kills the entire body and roots of the plant. Clipper would only kill the foliage and a small amount of the root ball. Clipper is more economical. Ms Gendron noted there was a maintained habitat with the current aquatic plant makeup. She noted to control growth both drawdown and chemical treatment should be effective to control growth. She reviewed 16 years of data. She examined trends over times and the different methodologies used by different ===PAGE 3=== consultants used. She noted the drop in clarity in 2005 and 2006. She compared areas of depth less than 6 feet (drawdown effected areas) and other deeper areas. She compared the differences in methodologies between Geo Syntec and Solitude in calculating biomass and density. She did note that there was no pre- drawdown data to compare with. She did note that its former use as a reservoir which may have affecte d the shoreline due to repeated drawdown by nature of the reservoir. She explained the makeup of the species diversity and richness and the statistical methodologies utilized. The natural variabilities of the species makeup was also explained. She did note a higher diversity in the drawdo wn zone likely due to the presence of seed producing plants. IT was noted that while the treatments were successful in the removal of Eurasian milfoil, there was also an impact of Robbins pond weed and coontail. She recommended the survey of the 66 points should continue to be analyzed. She recommended that areas of robbins pond weed be avoided for treatment. Coontail would recover more quickly. JR reviewed the statistical data with Ms. Gendron. CL reviewed the history of the drawdown of a period of 2002 to 2006. He did note that there was no drawdown the year before and a smaller drawdown last year and those data points would be int eresting to show. CL inquired as to the depths used for analysis drawdown verses no drawdown. She had used an average of 6 feet. RB asked about the pretreatment survey. Dominic indicated that he would be able to have the survey ready for the June 17 meeting. The LCC highlighted the need to have the survey data in advance of the review/meeting. CONTINUED FROM PREVIOUS MEETING :: Pursuant to MGL ch 131, s 40 and Lunenburg Wetlands Bylaw and regulations as listed in chapter 239, Doug Acker has filed a Request for a determination for the removal of trees without stumping within the 100 foot buffer zone at 11 Willow Circle.Application and supporting documents are available for review at the Conservation Commission office by calling 978-582-4147 ext 431 by appointment. EO- 179/183 Island Road- continued discussion and administrative hearing Seth Donahue and Joe O’BRien. Seth Donahue outlined the as-built he outlined the propose re-planting and the restoration notes concerning construction phasing, monitoring and erosion protection. RB asked that the wetland line that was drawn and asked about maximum height, Seth noted that the dam was close to maximum height. JR noted that the boards were not totally in and reached maximum capacity until last week. JR noted that the measurement point is critical. RB examined a grade change between the high-water mark now and if the grading was presented. Seth indicated that there was no measurement within the water area. RB noted that there was still 2 six inches boards not placed in yet and there is now a 12 inch difference. And he would want to see the edge of the lake re-surveyed. He feels the shoreline has been altered. He feels that as a result the location of the 50 foot no build zone and 30 foot no disturbance zone and now the wall is 44 feet from where the water was at the time, ===PAGE 4=== they did the measurement. The moving of the wall back should be considered. He also noted that switch grass could be removed, and lady fern added instead. MM recommended that he feels sweet pepperbush should be removed. Seth indicated that he feels the wall location was in compliance with the issued order and the new zone location is not his clients fault. JR noted a new property line, that dock is too long and there was an added second dock. TD applicant was aware of his own work and asked MM about restoration of the shoreline. It was noted it would have to be during drawdown. The Commission continued this matter to the next meeting to allow the owners representative to overlay the survey plan on the 2019 Ortho Photo to allow for better interpretation of predevelopment versus current conditions. Appointments/Hearings –commences at 7 PM RB called the meeting to order Appointments: Mark Bursch Proposed work on 150 Cross Road MM noted the file was actually not closed out, he had rejected the request in the fall as there was still the land that needed to be stabilized. TD chaired as RB recused himself. TD reviewed the proposal discussed at the last meeting with the commission. BP has no problem allowing it as a field change and noted it was mostly outside the 30 and 50 foot zones. CL noted that it should be made clear on the drawing what amount of trees are going to be cleared and remain. CL would like to see the grade noted as well on the plan. JR asked of this will be permeable? Mr. Mark Bursch noted it will be grass and garden only. Motion to accept as a filed change with the additional that the trees to remain and be noted along with a note on the grade change was made by KJ with second by CC and a unanimous roll call vote to approve the motion. 1. 72 Hemlock – map with tree plantings plan needs signature and date and type and size of trees to be placed.to be placed on the next meeting. CONTINUED FROM PREVIOUS MEETING: Pursuant to MGL ch 131, s 40 and Section 239 of Lunenburg General By -law ( Wetland Bylaw) DPW has filed a Notice of Intent for the replacement of Culverts at Sunset Lane and Northfield Road. Emailing a PDF is also an option on request by emailing lcc@lunenburgonline.com. The calculations were reviewed by the commission. It appeared that the pre and post development was essentially Identical. TD Concurred. It was noted by RB that this was the last item required by DEP. CL examined the calculations would like to ask the engineer questions or conduct a peer review and was skeptical of the calculations. TD noted that the biggest difference was in the resistance of the pipes between pre and post and noted that the interior of the pipe would accommodate more flow efficiently. JR asked If the pipes had a stack configuration. It was noted that it was side by side. He would like to ask the engineer a couple of questions of the engineer. BP noted he was ready to vote as an engineer put his stamp on it. A motion was made to issue an Order of Conditions by KJ and a second by TD. CL inquired about the open bottom and the current culvert as is appears to not meet the stream crossing standards. MM noted that a critter crossing was added to the plans. The motion as approved by a unanimous ro ll call vote of the commission. RB noted that there would be no increase in impervious as the under portion of the deck is concrete. It was also noted by BP has gutter drains leading to a dry well. TD noted that he had no issue with the proposal in question. He no ted that there was a gazebo on site within the 30 foot no touch zone. That was not on the plans. The applicant noted that it could be addressed on another application. CL agreed with the applicant. BP made the applicant aware that he would have to start a whole new application and wanted to ensure he understood that. Mr. Yawo r noted that his research indicated that he built the gazebo area met regulations. TD understood the applicant understood the applicants concerns, he noted with the applicant the actual Lunenburg By-law regulations. TD was concerned that we should address it upfront now and amending the file. RB noted the options of either moving forward with the application now or addressing it in the future. CL noted that he would be amenable to the application being modified after reconsideration. JR asked if the Gazebo was movable. Mr Yawor indicated it was placed where it was due to the size of his lot. He indicated that he attempted to do everything correctly. KJ noted that we should allow the application should move forward and place the other issue on another agenda. TD noted the construction of the actual gazebo. He noted that the members were impressed by the construction and felt that it could be granted a variance and should be considered by the membership in total. It was determined the Gazebo structure should be removed. A motion was made to issue a negative determination for the deck reconstruction as proposed with the stipulation that the Gazebo needed to be removed and the area restored to prior condition of grass by a motion of KJ with a second by BP and a unanimous vote by the commission. A new overlay plan was provided. Discussions focused on the dock location proposal. Concerns regarding the location and length of the dock were expressed by the LCC and Hickory Hills Associations representatives. The proposed 6 ft. wide path to the dock was new to the plan. There was consensus to allow a 4 ft. permeable pathway to the dock. Reduction of width was proposed. Questions were raised regarding the extent of the alteration of the location of the shoreline. Although there was some consensus that the shoreline was pulled back, it was generally supported that the shoreline should remain where it currently is as it provides more lake bottom. Any fill that was added needs to be removed. The location and size of the dock was not finalized pending Hickory Hills Association review and approval. TD does not support the new dock ===PAGE 4=== location since the tree has already been removed to allow the original proposed location. It was noted that Hickory Hills had approved the original location and is currently reviewing the new proposal. Key items to be included in approval were: 50 ft. deed restriction (wall can stay in place), replacing tree (2 for 1) removed for dock, remediation per plan, reduced walkway, removal of material added to lake bottom. Please email for zoom information or consult the town calendar for the agenda information to be posted June 1 2020. Paul Grazewicz appeared for the applicant. He presented photos that is alleged to show no flow for 4 days. RB noted the pictures show flow and stream stats shows it has sufficient water shed. He noted that the stream had been rebuilt and that there is a created impediment. He also noted that there was construction of the Gulf station upstream which had the stream controlled during stormwater installation resulting in the natural impediment. TD voiced agreement. Cl also voiced agreement. JR also voice agreement. Andrea Laford agreed with the conservation members and asked what are the implications of perennial versus intermittent streams. It was noted that jurisdictional areas and the limits of 10 percent of the land for development would apply. MM noted flows in the photos. TD made a motion for a positive determination and RB seconded and the commission voted unanimously. Pursuant to MGL ch 131, s 40 and Lunenburg Wetlands Bylaw and regulations as listed in chapter 239, Ken Matson has filed a Notice of Intent for the construction of a single family home at 63 Cross Road Application and supporting documents are avail able for review at the Conservation Commission office by calling 978-582-4147 ext 431 by appointment. Please email for zoom information or consult the town calendar for the agenda information to be posted June 1, 2020 Anthony Cleaves represented the applicant. Mr Cleaves reviewed the plan and the Notice of Intent with the Conservation Commission. TD asked how the applicant intended to grade the site with respect to removal of trees versusu remaining. Mr. Cleaves noted the erosion control was the limit of work and the trees would only be removed up to then. There may be some tre es save along the lot line if possible depending on grading. JR asked about demarcation, which was agreed to. RB asked if the frontage grading was humped up to keep drainage from running off the driveway. Mr. Cleaves noted it was so as RB noted so the vegetation would receive the flow. RB asked if the driveway grading could be adjusted to sheet flow off of the sides instead of allowing it to increase on the down hill slope. Mr. Cleaves reviewed the cross pitch he currently has and noted he can add a more distinct cross pitch. Charles Kimball, Son in Law to Marylin McMillan who confirmed that Charles was represented. Mr Kimball noted it was his opinion the brook going through the property was perennial. Mr Kimball and Mrs McMillan discussed the culvert construction history. Keith Kimball requested that the commission have some type of report regarding the stream status. He noted his historical anecdotal flows of the stream. MM noted the stream was not on the USGS map and noted that according to regulation the commission would have to prove the area is perennial and that the commission cannot have the applicant change the status of the unmapped stream. David Riley noted that the stream doesn’t stop flowing. RB asked when the lot was subdivided and it was noted that it was recent. JR wanted to conduct another site visit based on the abutters representations. TD asked if the abutters filed an RDA if they could get a stream ruling. MM noted that it was possible however the caveat to that was they would have to submit technical evidence as anecdotal was not acceptable under regulation. CL agreed that a site visit was necessary, BP asked MM what impact would the perennial stream designation have on the plans. MM noted that the normal 10 percent thresholds under the rivers act would apply. Mr Cleaves noted that the lot was 3.8 acres in size and the disturbance proposed would be well under 10 percent, not triggering a thresholds. He further noted that the GIS database doesn’t show the stream or any other designation of extra protection. Keith Kimball noted that even though it was t on the map, the culverts show a lot of flow AND 75% of the lot was wetlands. He offered to research whatever funding was needed to determine if the stream was intermittent or perennial. He noted as of 1991 the conservation commission required the culvert. Mr Cleaves noted a larger culvert may have been required to meet stream crossing standards and not due to stream status as intermittent versus perennial. BP asked MM if a site walk would change anything. MM noted the commission would have to provide actual hard evidence. CL asked Mr. Cleaves with the 21,000 square fee t ===PAGE 4=== of disturbance was within the riverfront. Mr Cleaves noted that 14,000 was within the buffer zone and 2500 square feet was within the 50 foot. He noted that the 30 and 50 foot buffer zones provide good protection. RB echoed the concerns of Jack and Carl a nd felt the stream should be more closely examined. Mr Kimball noted the stream comes from lake Whalom, through the woodruff property and into the cattacoonemaug brook. Dave Passios applauded the commission for taking the time to examine the abutters concern. JR noted that we should take some data and go to DEP for their input. TD noted that the watershed of 1 square mile could be utilized to see if it a stream. JR stated that there were three abutters who’s concerns should be addressed and perhaps we should consider the offer to pay for a study from one of the abutters. BP expressed a concern that even though the commission should go and look at the stream and where a potential riverfront could be however, but where do we go from there and what would calculations show if we could actually complete it timely.
