As well as a bunch of caterpillars. A volunteer takes photographs that M. Larouche shared. The pathways are fully mowed. Always looking for more volunteers for things like watering or weeding. The Pollinator Habitat is located at 123 Hollis Road. d. MACC Fall Fundamentals Frenzy Registration is Open: No update 4. NEW PUBLIC HEARINGS a. 260 Falulah Road- CAOC-25-2 A Request for Amended Order of Conditions by Fitchburg Land Property Owner, LLC for the reduction of scope and size of originally approved 367,000 sf warehouse building to 183,500sf warehouse structure. Bill Hannigan from Hannigan Engineering represented the applicant. The project is half in Fitchburg and half in Lunenburg. Soil borings identified buried material not conductive to structurally supporting the building, so they eliminated the building in that area. Drainage plans have been adjusted accordingly. The new plans also include an improved 2:1 slope for runoff in an area that was previously a 1.5:1 slope. M. Wilson noted that the NOI number was not listed on the agenda, making it more difficult to see what was originally approved. J. Pewtherer found it in OpenGov as record 1283 (prior to using workflow naming). R. Bursch asked if there was a change to the riverfront disturbance. B. Hannigan indicated it had been significantly reduced and discussed the technical reasons that resulted in dropping the building by 2-2.5 feet and then shared the updated table. A comparison of the 2022 version and the 2025 version indicates no substantial change. Considering the building changes are all outside of the riverfront area, this seemed reasonable. Motion: M. Larouche, to approve on the condition the new documents showing the grading changes are uploaded to OpenGov. Second [Vote: M. Wilson M. Wilson - AYE A. Burnap - AYE C. St Germain - AYE T. Doucette - AYE M. Larouche - AYE J. Pewtherer - AYE R. Work will also include the expansion of the existing septic system on site and associated grading. Justin LeClair represented the applicant. The location is also known as the Pat Brody Shelter. ZBA approval has been received, and they are on the agenda for the Planning Board. They still need to go before the Board of Health. All structural work is outside the 50-foot zone. The septic expansion gets as close as 32-feet to the wetlands. M. Wilson noted that during the site walk she noticed the flags were not blue as expected. Neither were the flags marked or numbered. J. LeClair explained the erosion control plans and indicated that this had also been a ===PAGE 3=== DEP question. M. Wilson noted there is a valley between the two high points and expressed concern about erosion here during construction and would like better erosion control in place. J. LeClair agreed. R. Bursch also noted the D-series does not connect, but it was done six years ago. Discussion followed about needing the site properly delineated before approval while acknowledging the planned work appears to be outside of the wetlands. There was general agreement that the delineations from this firm do not generally meet our expectations. Motion: M. Wilson, to approve on the condition that the erosion control barrier be extended to wrap around the septic site. Second Vote: C. St Germain M. Wilson - AYE R. Bursch - NAY C. St Germain - AYE T. From 07-16) A Determination of Applicability by Melissa Cannavino for the renovation of a patio, stairs, and walkway within the 50-foot buffer zone of Hickory Hills Lake. Ryan Proctor (Dillis &Roy) represented the applicant. R. Proctor reminded the Commission that this is an after-the-fact filing and that they were coming back with a revised remediation plan as requested at the last meeting. He reviewed the new plan. The new plan takes the landscape ratio from 1.8:1 to 2.75:1. M. Wilson acknowledged the improved plans but also noted that the updated plans were received late for them to approve and suggested a deadline of the Friday before a meeting to have all items uploaded to OpenGov. R. Bursch requested a timeline for the planting and walkway removal with a 1-year and 2-year update to ensure the survival of the plant material. A letter stating the plant material has survived would be sufficient. M. Wilson suggested a 12-month overall timeline as this is a retroactive situation. R. Bursch suggested 90 days. Motion: R. Bursch, for a negative determination with the following conditions: 90 days remove the walkway and get vegetation in place 1-year and 2-year plan status updates based on the date of planting. Matt Marro represented the applicant. Christopher Stoddard (Royalston) is the new engineer on the project and re-evaluated all the plans. R. Bursch wondered why the wall will not stay at the 30-foot? M. Marrow explained it will be from the base of the slope up to three feet, essentially an exchange of surfaces. The existing wall will be replaced because the applicant is concerned the stones will start coming out. The new wall will be of the same composition. M. Marro confirmed the intent is to do work during a drawdown and expects that to be part of the conditions. He explained that the proposed new dock would be a 40x4 wheeled removable dock. R. Bursch stated he was not in favor of building a new wall inside the 30-foot zone. --Missing Motion vote info? -- d. 390 Howard St- (Cont. The DEP number was not listed in the NOI results page on the Energy and Environmental Affairs Data Portal, which means the Commission cannot process the request at this meeting. This is part of the larger 4-lot project at the corner of Kilburn Street and Leominster Road. They were granted a special storm water permit to collect runoff in a basin totally within the 50-foot zone and completely outside the 30-foot zone. DEP questions have been addressed. (Site address confusion, storm water management, operation and maintenance.) C. St Germain had clarifying questions regarding the operation and maintenance requirements. R. Proctor went into further detail as to the requirements. It is unclear who is responsible for conducting the inspections. R. Proctor explained that in the absence of a Homeowners Association, the homeowner is responsible for meeting these requirements. Public comments: John Carroll of 803 Leominster Road, an abutter, had a question regarding the existing gravel driveway and how they plan to install the stormwater drain across their easement. J. Carroll explained he installed multiple pipes, and the new owner may be able to use these instead of disrupting the driveway. J. Proctor agreed to discuss this with the new owner. Motion: | C. The project will address eutrophication, improve aquatic habitats that support fish and wildlife species, and restore the natural capacity of the resource area to protect the interests identified in the Wetlands Protection Act (M.G. L. c. 131940) Matt Ladewig (TRC) represented the Town. Also present were Christopher Ruth (Facilities, Ground, & Recreation) and Karen Menard (Park Commission). M. Ladewig presented the project. The focus is on Town Beach and the non-native species with high biomass. The State has designated the lake category 4C. The proposal is a combination of hand, diver and DASH ===PAGE 3=== clearing as well as systemic herbicide approved by the State. If necessary, an Algaecide would J. Pewtherer wondered why chemicals are needed if we are hand pulling. M. Ladewig explained it had to do with density. Hand clearing is good for small areas. C. Ruth added that it is also cost related. It was noted that we do not have the authority to close the lake, but we would close Town Beach. There is no date in mind, this has already taken two years to get to this point. The project will also be filed in Leominster. The 5-year contract request is to reduce the ongoing cost to the town. It is also standard for this type of management program. J. Pewtherer wondered about notification to the residents. It would likely be social media notification. Public comment: children. Benjamin Carroll (Team Sunshine) represented. This is a 5-acre lot not visible from the street. J. Pewtherer noted there was no erosion control on the plan and that the Administrator has asked for double erosion control. She would like a straw waddle with a silt fence. B. Carroll indicated that no tree work is necessary. A site walk was conducted. R. Bursch wondered if the wetland ended at the bank of the brook. Reviewed the power infrastructure. A previous submission was made under RDA-24-2 with the same plan. Plans seem to be inappropriately uploaded. M. Wilson wondered if a previously approved RDA defines the wetlands for 3 years, as does an NOl. It was decided to check with Herlin Jaime. Motion: R. Bursch, to continue to September 17 Items to be addressed: ===PAGE 2=== Second Vote: Double erosion control measures to include silt fencing and straw waddles 2. Dan Wolf (David Roth & Associates) represented the applicant. There is no DEP number available, so we cannot vote on the item, just review it. The property is known as Lot C on Chase Road. A previous NOI has expired with only part of the work completed. D. Wolf reviewed the remaining planned work. It was confirmed that the base for the septic had already been graded under the old Order of Conditions. If the fill mound is in the 100-foot buffer, it will need erosion control. Erosion control lines could be clearer in the plan. D. Wolf agreed to extend erosion control to the limit of work as displayed by R. Bursch. Motion: Second Vote: R. DEP number has been issued. Responses have been submitted to DEP. The proposal is to demolish the existing house and rebuild further away from the lake. M. Wilson was unsure about the decision about straw waddles and was told they had been added to the plan. M. Wilson wanted to ensure the note stating it would not have straw waddles had been removed. The applicant demonstrated the updated plan. M. Larouche and R. Bursch were not at the previous meeting and had not filed Mullin Rule documentation, meaning there was not a quorum for this item. This required the applicant to re- present all the information from the last meeting. This review identified the elimination of the stockpile closest to the lake. Motion: Second Vote: R. A tree fell on the house and the tree service said several additional trees needed to be removed. Herlin reviewed the property and wants 16 trees removed. The applicant wants to remove 20 trees. Herlin stated this is a safety concern and needs to be corrected immediately. M. Wilson wondered what will remain once all these trees are removed. M. Larouche wanted to know if the stumps would remain in the ground and the applicant indicated they would be cut as low as possible but no grinding. M. Wilson used Mass Mapper to demonstrate tree coverage and wondered about replacement requirements. R. Bursch wanted to know when they would come down. the applicant said immediately. He also requested a diagram indicating which trees on the property are involved in the project. M. Wilson suggested we let the applicant proceed due to safety concerns but then plan for a 2:1 replacement with full documentation. R. Bursch agreed but with a stipulation that if the removal is not completed by the next meeting that the applicant returns with a full plan. The applicant asked what a diagram would need to look like and wanted details. R. Bursch shared a handwritten diagram from another applicant. Motion: R. NEW PUBLIC HEARINGS a. 763 Northfield Rd- NOI-25-19 Video link A Notice of Intent by the Town of Lunenburg-DPW for the replacement of the deteriorated culvert at the Northfield Road crossing over Mulpus Brook to mitigate further deterioration, prevent potential flooding caused by the existing undersized culvert, and meet the Massachusetts River and Stream Crossing Standards to the maximum extent practicable. The proposed culvert replacement is a 38-foot, 4-foot diameter precast reinforced concrete piped culvert with precast headwalls at both pipe ends. The proposed culvert will match the existing culvert's alignment. Matt Lundsted (Comprehensive Environmental) represented the Lunenburg DPW and described the project. DEP file number is 208-1358. DEP wondered why only a 4-foot pipe is planned. M. Lundsted will be responding that there is little 'head space' with little 'fluvial geomorphic advantage' to going to a larger pipe. M. Wilson noted she did not find a wetlands delineation report. M. Lundsted said they were attached to the paper copies dropped off and the Town should have uploaded them. J. Pewtherer found this information in the NOI starting on page 81. DEP wanted to know if the property owner of 763 Northfield was aware of the work. It was confirmed that Jessica Santos is the owner and is on the abutter list. Additional DEP comments were read and the proposed responses shared. J. Pewtherer requested details on the wetlands mix plan as the notes provided are not very detailed. M. Wilson asked for the ratio for the replication. M. Lundsted indicated 2:1. Erosion control is staked compost filter tube at each quadrant as they conform better to this topography. M. Wilson wanted the limit of work identified. M. Lundsted agreed to add this to the plan. M. Wilson stated the intent is straight-forward but that we cannot give permission to work on someone else's property as well and concern about how the 30, 50, 100 lines were drawn. This is in addition to the limit of work concern previously noted. M. Larouche wants Herlin's review. Motion: M. Wilson, to continue to the October 1 meeting with the following requirements: 1. Updated delineation and explanation of delineation 2. Property owner permission or DPW Director explanation as to why it is not needed 3. Herlin's review of the site and project 4. Greg Roy (Dillis & Roy) represented the applicant, who was also present. G. Roy reviewed the project. He confirmed we had a voting quorum due to the timeframe involved. He then reviewed the plan changes required because of the peer review. He also noted the Planning Board has now approved the project which also conducted a peer review. He went over all 9 points from the review, which have also been uploaded to OpenGov. M. Wilson asked for the replication ratio which is 1.6:1. She also noted that since the is replication, there should be a two-year monitoring requirement. The updated plans have been sent back to the peer reviewer for comments. A. Burnap noted that there was a suggestion 560 Mulpus Road to shift the driveway east. G. Roy stated they shifted it as much as possible since it is already at the 1200-foot maximum length mark. J. Pewtherer reminded the Commission of the question that was raised at the last meeting, and she found that an RDA becomes a three-year delineation just like an NOI. M. Wilson noted that the limit of work is not indicated on the plan. This will become a condition if approved. The PVC was noted as being "Schedule 40" which is a type and not a size. M. Wilson suggested we make a condition that the PVC be no larger than 2 inches. Motion: M. Wilson, for a Negative Determination with the following conditions: 1. Pewtherer confirmed that all debris has been removed; most has been and will be addressed at the next meeting. It was noted that any purchaser of the property that wanted to build in the area would need to file a project. J. Pewtherer wanted H. Jaime to comment on the erosion request. J. Pewtherer also noted that no vote can be taken because this was not advertised. 215 Sunset Ln- NOI-25-3 Ryan Proctor (Dillis & Roy) represented Dave Fari who was also present. The project was approved in May, but the Order of Conditions was not created until October. The owner proceeded with the project. H. Jaime visited the site and agreed erosion controls were in place and recommended no enforcement action. M. Wilson asked what the actual violation was that raised the issue. There was a complaint that sediment was being deposited into the street after a significant rainstorm. J. Pewtherer visited and did not see the erosion blanket. It was noted that the blankets are installed after all work is completed, which is not the case. J. Pewtherer decided to remove this from Violations. b. Emergency Certifications: None 8. Doucette - AYE T. Doucette - Abstain T. Doucette - Abstain ===PAGE 2=== A public hearing on a Notice of Intent by SafStor Real Estate Co.,LLC for a project that involves floodplain fill and associated compensatory floodplain compensation. Greg Roy (Dillis & Roy) represented the applicant and presented the project. Site historically used as an auto dealership. Paved acreage is .995 acres (of 1.15 acres). The only concern is bordering land subject to flooding (as defined by the Wetlands Protection Act) based on the newly published 2025 FEMA flood maps. The proposal is to convert the existing use to a proposed 4-story climate-controlled self-storage facility. All units will be accessed internally. The remaining property will be green space and flood compensation storage, reducing impervious area by about 14%. Special Planning Board permits will be required, and it is expected the stormwater calculations will be peer-reviewed by the Planning Board. This review may be of interest to the Conservation Commission. G. Roy reviewed the responses they will file to DEP questions received. Since the impervious area is being reduced, it was requested that the Commission find it not necessary to conduct a Wildlife Habitat evaluation. T. Doucette wanted to know if the trees behind the property are coming down. G. Roy indicated some will come down, and he will identify which in further meetings. R. Bursch wanted to know how far it was from the edge of work to the 100 ft boundary. G. Roy will return with that in formation. M. Wilson did a satellite image check and calculated 500 feet. R. Bursch also asked for the 100-foot flood plain elevation. G. Roy responded "366". C. St Germain wondered why G. Roy suggested the flood plain calculations went too far. G. Roy explained it was based on the FEMA numbers versus the converted numbers to 1988 values. J. Pewtherer wondered if this area was affected by the flooding in July and September of 2023. G. Roy did not know. Motion: Second Vote: R. Bursch, to continue to the December 3 meeting. M. Wilson R. Bursch - AYE A. Burnap - AYE M. Wilson - AYE J. Pewtherer - AYE C. St Germain - AYE T. Digging necessary water and retention pits. Installing necessary silt fence and hay bales. Robert Hart presented the project. The existing dwelling uses pond water for domestic water. Proposing a well for reliable source of water. H. Jaime conducted a site visit. A permit was obtained from the Board of Health. Need Conservation permission because it is within the buffer zone. J. Pewtherer shared uploaded documentation. H. Jaime recommendations: 1. Install sediment controls 2. Silt fence, hay bales prior to construction and maintained until full stabilization. 3. Retention pits must be contained within upland areas 4. No slurry or drilling water can be discharged toward Lake Shirley. 5. Stockpiles must be covered and located outside of the 50-foot buffer. 6. The shed will be set on concrete blocks that are 8 × 8 × 4. Ken McNamara (480 Mulpus Road) presented the project. J. Pewtherer shared available documentation. M. Wilson confirmed that no trees will be affected. H. Jaime notes did not raise any concerns. R. Bursch noted the perennial stream on the GIS map and recommended the shed be outside the 100-foot riparian zone. K. McNamara stated that the slope of the land is too steep to move closer. R. Bursch suggested continuing the hearing until H. Jaime can visit the site and verify the location of the 100-foot line with the applicant. Motion: R.
