Almonte of Land Design Collabrative representing Empire Management. J. Almonte gave an overview of the proposed project and a request for an extension of the existing Order of Conditions. The project was approved in 2001, all permits (Planning, Zoning, etc. ) have all expired. Nothing has changed and all permitting requirements have been resubmitted. H. Jamie stated that although her comments are not a part of this discussion, H. Jamie was at the site for a site inspection and to the right side of the current structure there is an additional building where she observed vehicles being washed on the property. The wash water appeared to flow toward the adjacent wetland resource area. While H Jamie was there she met with chair M. Proctor from the Board of Health, who had presented on site with the same concern. Staff indicated that this had been their practice for many years, even though there was a violation issued last year and a cease and desist was issued, which was completely disregarded. There were soaps, detergents, grease, oils and other pollutants that have the potential to impact adjacent resource areas. Also I want to preface this when considering an extension of an existing Order of Condition, if the property owner cannot abide by current standards of the Wetlands Protection Act, it leads me to believe that they lose their right to receive their extension until they remediated these ongoing issues. I recommend that the Commission direct the property owner to immediately discontinue this activity. If the practice continues after notification, I recommend that the Commission authorize the issuance of a formal Notice of Violation and pursue appropriate enforcement action. J. Almonte assured the Commission that all car washing activities on the property have ceased. A letter will be sent of a pre-warning of enforcement if activities continue. Brian Lafferty of Empire Management, owner of the property, was present. The dealerships rent the property. A statement that this will not happen again, there will be no more car washing at the facility. H. Jamie stated that she was at the property and she witnessed the washing of cars. Topography is such that the highest point washes to the lowest point. Car washing was at the highest point washing into the lowest point, which is a wetland. H. Jamie respectfully stated that she witnessed the car washing and spoke directly to the entity washing the cars. Violations are sent to the name and address listed in the public records of the Town of Lunenburg. Motion: M. Wilson, to approve the extension to Order of Conditions for 3 years Second M. Larouche Vote: M. Wilson – AYE M. Larouche – AYE A. Burnap - AYE J. Pewtherer – AYE T. Doucette - AYE d. Certificates of Compliance: None e. Notice of Project Change: None 8. ENFORCEMENT a. Violations, Enforcement Actions, and Hearings: i. 1168 Mass Ave Rear H. Jaime notice from DEP. They advised the Commission should move forward with an Enforcement Order to best address the situation. They are requesting that the Enforcement Order require the following: An evaluation of the property for all the wetland resource areas and reviews that quantify all the altered wetland resource areas, the evaluation to be conducted by a qualified wetland professional and the evaluation should ===PAGE 5=== include subservice soil analysis of sufficient depth throughout the site, including areas along the stream and areas that confirm through the ORAD. DEP recommends that this deliverable is due no later than 30 days of the issuance of the Enforcement Order. They are also asking for the submission of a restoration plan, which includes surveyed topo plans and a description of the unpermitted work and the areas to be restored. They want written confirmation of the intent to comply with the Order within 5 business days of the date the Enforcement Order is issued. They recommend that the Commission review the bvw delineations associated with the ORAD so we can confirm the bank resource area associated with the intermittent streams and that it is still present on the property and should be included in the evaluation. The 2 year time frame to inforce violations is nearing the end. We have reached out to the property owner numerous times, it took a long time to get DEP out there and made numerous attempts in various ways to contact the property owner without a response. They seem to wants to work on this but are not being pushed enough so that they are present something to resolve the issues. DEP wants an Enforcement Order issued and H. Jamie is in favor of doing same. Motion: M. Larouche, to Issue Enforcement Order with DEP Recommendations Second T. Doucette Vote: M. Wilson – Recuse M. Larouche – AYE A. Burnap - AYE T. Doucette – AYE J. Pewtherer - AYE b. Emergency Certifications: None c. 9. NEW BUSINESS a. Updates: None Commission Open Discussion M. Wilson – Mass Recreational Trails Grant Program is a good source of funding for the Commission to do conservation land improvements. This year we applied for two separate grants. One for the Table Rock parking area and the permitting work that had been done by Mass Recreational Trails and one for installation of the Rayno property parking area with engineering and permitting done by Recreational Trails. Unfortunately we were not awarded grant money. It appears grants funding is down this year. They had 121 applications and funded 50. A lot of the ones funded were funding for rail trails and bigger ticket projects. Federal Funding has gone away. We can apply again next year. Rayno property might be a property for state funding grants. T. Doucette stated he appreciates the work done although grant funding was not approved. Mention was made that M. Wilson did most of the work on grants. b. By-Law Discussion H. Jaime continued to a later meeting. 10. OLD BUSINESS a. Conservation budget: i. Massey Tract H. Jamie stated that this property is a part of the Forest Legacy Program and that North County Land Trust is helping the property owner. The Director of North County Land Trust and Town Counsel talked regarding what is required by the Town. Town Counsel advised that they had a conversation with and our Town Manager J. Warren who is differing to the Commission with regard to a question regarding the deed. North County Land trust is requesting a commitment of 25% of the cost of a Title Search and Title Insurance, of which 75% will be reimbursed by the Federal Government. According to Town Counsel, the total cost of Title Insurance and Title Search is below $5,000 of which the Commission would be responsible for 25%. M. Wilson suggested that these funds come from the Timber Rights Account. Motion: M. Wilson, to approve 25% of the funds necessary for title search and title insurance for Massey property as a part of Forest Legacy Program (through North County Land Trust) Second M. The engineer was not available. Mr. Rotti was present for the PERC test. Mr. Rotti is familiar with the plan, and a more detailed plan was uploaded recently. When members of the commission did the site walk, it was difficult to make where on the property the septic was going, so the uploaded plan is much better. Mr. Rotti stated that the existing septic system is in the rear of the house; the proposed system will be on the side of the house at a higher elevation and as far away from the wetlands as possible, which are at the rear of the ===PAGE 2=== house. H. Jamie stated that she met the engineer at the site in late fall. They worked together to find the best and most appropriate side for the new system. R. Proctor stated that with regard to the Planning Board, they have met the requirement of review engineers, Graves Engineering. Currently, the only outstanding issue as submitting a draft HOA document to be reviewed by town counsel. R. Proctor stated that the letter from Graves was uploaded to the portal as well as the most recent plan, which has no changes. If there are no further questions from this commission, a request was made to close this hearing. T. Doucette asked what the HOA is in regard to. R. Proctor stated that the HOA covers basically everything and has been submitted to town counsel. These are townhouses. The Planning Board is primarily concerned with the common driveway themselves including snow plowing and maintenance. T. Doucette asked if the draft HOA was uploaded. R. Proctor was unsure of it was uploaded to the portal as it is a draft. If it has not been, he will upload the HOA draft document. M. Larouche stated that R. Pewtherer – AYE e. 701 Reservoir Road NOI-26-21 (Continued from 7/1/26) Notice of Intent by the Reservoir Recreational Trust for the construction of a new concrete boat ramp on Lake Shirley at Shady Point R. Proctor (Dillis & Roy) was present for the applicant who stated that a DEP number was received with comments relating to quantifying impacts. R. Proctor stated that in addition to the boat ramp, they were also proposing some shoreline stabilization improvements by way of a wall. They are soliciting quotes for a wildlife habitat evaluation. This is required when you alter greater than 50 linear feet of a shoreline. Also, there was a question as to the impervious area for the project as it related to stormwater. R. Proctor stated that the comments were just received and he will be working through them and submit revised materials. R. Proctor stated that he is asking for a continuance. Rich Pearson, 75 Ruth Street was present through zoom who stated that he is totally in favor of this project. The owner is generous to the lake community in many ways and to the larger Lunenburg community as well. H. James stated that she has received two letter of support. One from Andrew Storm and one from Joanna Bilotta, who is the president of the Lake Shirley Improvement Corporation. Also a letter from Carl Luck with concerns. Andrew Storm, 715 Flat Hill Road, was present and stated that he supports the project as stated in his letter (will be upload to the portal). The boat ramp is an invaluable resource to the promote access to the lake. Carl Luck was present at the meeting. C. Luck stated that he submitted his concerns by letter. They do have a commonality with DEP concerns but I do support his project. The ramp does need to be improved and it is his hope that it is done in the best way possible. Mr. Luck would like to see pervious pavers used for the ramp. At the last meeting it appears to have a significant increase in the impervious area within 50 feet of the lake. R. Proctor stated that they will be addressing the impervious question and will be coming back with an answer to that and will be formalizing same in a letter. D. DeFazion of 31 Fire Road was present at the meeting and stated that she has seen several commercial or State boat ramps and they are all concrete and has concerns about pavers being able to handle the traffic. This is a revamp of the existing ramp and due to wear and tear needs upgrading. D. Defazon is also in favor of this project. Chair Pewtherer stated that she wanted to echo the sentiment that she is hearing that the applicant has worked really hard to protect the trees and shoreline in the past and is continuing to do so now. Carl Luck stated that in his letter he has concerns about power loading boats, which rips up the bottom of the lake and would like to see some restriction on power loading boats. Mr. Luck is also concerned about the amount of solid wall around the lake. Most of the walls have been stone walls so that the habitat is not disturbed. C. Luck stated that the in the past the Commission has pushed people toward stone walls. J. Pewtherer stated for clarification that power loading is using the boat’s motor to get the boat on the trailer rather than using a winch. Chris Coffin, owner, stated that they do not allow power loading and we do have signage that we don’t allow it but we can’t catch everyone. Jamie is proposing amending the Wetlands Protection Bylaw (Article XXI) – specifically the section governing filing fees to more clearly state: - The Conservation Commission shall establish and amend its fee schedule by vote of the Commission; and - The adopted fee schedule shall be maintained by the Commission and made available to the public. Additionally, to remove actual dollar amounts included in the bylaw and instead reference the fee schedule adopted by the Commission. J. Pewtherer stated that now it is very hard for the Commission to change fees because it requires a Town Meeting vote. This would enable the Commission to change fees with a vote of the Commission. M. Larouche stated his support for the change in bylaw and fees schedule. M. Pewtherer stated she would like to continue this discussion until there is a full board. Kim Duffy of 1479 Mass Avenue was present at the meeting. She shared that she was recently at the Cowdry and the red trail along the river is completely overgrown. She is suggesting that if a group is looking for a project, the area needs to be cleared out. There is also a need for a foot bridge to cross the water. J. Pewtherer asked when she was there and K. NEW PUBLIC HEARINGS All hearings are pursuant to MGL Ch 131, s 40 as amended and the Town of Lunenburg Wetlands Protection and Municipal Bylaws: a. 108 Sunny Hill Road: NOI-26-24 Notice of Intent by Jacqueline Rager for a driveway crossing of isolated wetland area (BYLAW ONLY) Chris MacKenzie (Dillis & Roy) was present for the applicant. An additional duplex unit is being proposed for this property at the back with an existing residential structure in the front. The proposed duplex will have its own septic system, which it Title 5 compliant for new construction. The proposed septic system is a Presby System which allows for a smaller leach field footprint. In order for a Presby System to be utilized, they would also have to show that a standard system could also be used. M. Wilson stated that she feels the board would also like to see the plan of that system, which was unavailable. In order for the development of this duplex to take place, a wetland crossing of approximately 692 square feet is required. The proposal would be to replicate 692 square foot to account for the wetland crossing at a 1:1 ratio. This property is mostly wooded and trees would have to be removed to construct the driveway, proposed duplex and septic system. A rain garden is being proposed together with the appropriate erosion controls to mitigate the wetland crossing. Discussion about poor drainage already on this roadway was discussed. It was suggested that C. MacKenzie contact DPW to see if they have any ===PAGE 2=== questions about the placement of the driveway and concerned residents should participate in that discussion. There were questions about the topography of the proposed septic system and possible run off from that. M. Wilson stated that she would like to see additional mitigation in the form or a retention pond and/or a water garden higher up on the driveway to capture runoff from the driveway. T. Ducette and R. Burch were in agreement M. Burch does not want to see, over time, open ground running and erosion into the isolated wetlands. The Commission is requiring a construction schedule with the stabilization and replication done during the construction phase with the driveway constructed at the same time as the rain garden and prior to the construction of the building. The replication area must be monitored over 2 growing seasons by a certified wetland replication scientist. M. Wilson stated that there are a number of abutters that are concerned about how much, if permitted, would this project contribute to the current flooding problem. Colleen Kostich of 119 Sunny Hill Road stated that the proposed driveway is right across from her house and her concern is flooding and there are huge flooding problems in this area. C. Kostich stated that she does not have a problem with the project but does not want this development to negatively impact the huge flooding problems that already exists. Pictures were shared of the flooding on the roadway and properties from the storm this past Monday. There was discussion about a possible catch basin at the base of the driveway but it was determined that without further information, that could not be required. H. Jaime stated that the Commission touched on many of concerns but based on where the septic system is proposed, there are concerns how runoff from the leaching area and reserve area has been accounted for and to confirm that the replication area will not receive concentrated discharge or altered hydrology from the septic system. She is looking for mitigation and is in agreement with a 2:1 ratio for mitigation. H. Jaime was also in favor of contacting DPW with regard to the drainage already in place. R. Burch stated that he would like to see an additional replication area on the other side of the driveway as well as the one on the plan, acknowledging that this is an isolated wetland. M. Wilson stated that a construction schedule needs to be added to the site plan as well as the requested water garden as discussed. Motion By: M. Doucette to continue to 9/2 Second: R. Burch Roll Call Vote: R. Bursch, AYE, A. Burnap – AYE, M. Larouche – AYE, T. Doucette – Aye, M. Wilson - AYE b. 157 Goodrich Street:NOI-26-25 Notice of Intent by Stephen Violette for the construction of an irrigation pond G. Roy (Dillis & Roy) for the applicant who stated that and Order of Conditions was granted to construct a drive up to the location of the proposed irrigation pond. That driveway has been constructed and is close to completion. This irrigation pond will be used to irrigate this portion of S. Violette’s farm. Pursuant to the Wetlands Protection Act Section 10.35, subsection E, 20,000 sf of bordering wetlands can be converted for the purposes of an irrigation pond. The concept and location was laid out by the USDA. The wetlands were previously delineated. The irrigation pond will be completely isolated. The location will be excavated and will be lower than the wetland. The pond will utilize the existing water table as the water table close to the surface. They will be dewatering as a part of excavation. The dewatering line will run along the edge of S. Violette’s field to the top of the property where it will not interfere with anything using the existing topography. In addition, they are proposing to build and access road not only for construction but also to be permanently left in place for access to the irrigation pond. M. Wilson asked it this parcel had to be in farm use. G. Roy stated that he is unsure, however USDA is involved in this project and they provided the schematics and plans for this. M. Wilson questioned erosion controls for the new driveway. After discussion it was decided that the lower portion of the driveway would require erosion control. M. Wilson questioned the depth of the irrigation pond which is about 15 feet with a natural soil bottom. Discussion took place regarding surrounding ponds and the impact of the proposed new pond on existing ponds. G. Roy feels that the proposed pond is isolated but will report back to the Commission. The discussed how much water would be drawn from the pond. G. Roy stated that the plans were laid out by USDA and he will provide the information to the Commission. The question was raised as to the use of the instant lot for the irrigation pond. R. Bursch stated that when the driveway was approved it was for a future ===PAGE 3=== residence. G. Roy stated that the lot does conform to the requirements for a residential lot however, the other access driveway for this farm is in a very difficult place on Lancaster Avenue. In the future, this driveway could function as the residential driveway. At this time there is no proposal for a house on this property. The question was raised as to whether there would need to be a change in use in farming to use the exemptions. G. Roy will get back to the Commission with the answer. P. Whitney of 137 Goodrich Street was present at the meeting. P. Whitney has concerns that the proposed pond with drain her existing certified wildlife refuge. G. Roy stated that it is their job as engineers to make sure that when any project involving water is proposed, that it does not at the property boundaries does not change anything. Based on what is known of the groundwater characteristics, there is enough tributary area that feeds both P. Whitney’s Pond and the proposed pond and the construction of the proposed pond will not adversely affect P. Whitney’s pond. P. Whitney stated that she want assurances that there will be no disturbances to her pond. G. Roy it is always a concern and has been a concern including with USDA involvement. The project was laid out so not to adversely harm the hydraulic characteristics of P. Whitney’s pond. The question was asked as to what the recourse would be if the proposed pond adversely affected P. Whitney’s current pond. That would result in a civil dispute between abutters however G. Roy stated that they would be taking all the precaution during planning and design of the proposed pond so that would not happen. Motion By: T. Douchette to continue to 8/19 Second: M. Zach stated that based on conversations from the last meeting he has included a planting list. He also addressed the stream crossing standards and updated the crossing. Instead of the proposed culverts, they have been replaced with open bottom box culverts which won’t disturb any wetland as it sits just outside of the wetland. This meets or exceeds the general standard of the stream crossing. There will be no wetland filling or need for replication and leaves the stream sides intact. The construction sequence is noted on the plan. DEP’s comments were with the previously proposed culvert not being sufficient and the current plan has rectified this. R. Bursch stated that he wants to make sure that all the stabilization and plants are in place at the time that the culvert is installed. That condition will be written into the Order. In additional a 2 growing season supervision will be in place. Motion by: T. He has gone ahead and scheduled two local carpet people to give a number of what it would cost to replace the carpet to get an idea should we want to replace them. T. Doucette said that he did inspect and could tell there had been pets there but for a competitive rate there is opportunity to secure a custodian for the property. M. Wilson agrees that there are other ways to deal with odor that might be cheaper. H. Jaime reached out to the Town Manger with regard to the discrepancies between our facilities manager and was hesitate to have someone occupy the property at this point. H. Jaime feels that it is in the best interest for everyone to sit down and say this is how we are going to move forward and this is how we are going to do it and where the funds are coming from and show how it can be done. There is a lag between what the house brings in and what can be done to update it. H. Jaime asked for anyone that would be available to add context to attend the meeting. M.
