Call to Order - Chairman opened the meeting at 6:32 p.m. and read the pandemic notice as posted on the agenda. 2. Review/ Approve 12/15/2020 Minutes – Bob Pease made a motion to approve the minutes, Paula Bertram seconded. Voted in favor by roll call vote: Bob Pease, Paula Bertram, Brandon Kibbe. Voted Against: None Abstained: Lynne Man (she had not yet reviewed) Sarah Cammer (she was not in attendance). 3. Discussion with Tax Collector Regarding Tax Title Process - Myleen Mallari, Tax Collector, provided the Committee with an overview of the Tax Title Process. Ms. Mallari explained that in accordance with MGL Chapter 60, if taxes are not paid within 14 days of demand, the Collector can then give 14 days’ notice of intention to exercise such power of taking. In Lunenburg notice is published in the newspaper. If taxes are not paid following notice, the notice of taking (lien) is recorded in the registry of deeds. At that point in time the Tax Collector can then enter into an agreement with the property owner for payment. Six months after the taking, if the taxes are not paid, the Town can petition the land court to foreclose on the property. The court then conducts a title examination and notifies all interested parties of the petition and provides 45 days to redeem or to challenge the legality of the taking. If the taking is not redeemed or successfully challenged the Court will issue a decree which vests interest in the parcel to the Town. Notice of Foreclosure must be recorded. Once the decree/foreclosure has been recorded, the Town can then sell the property at auction or can sell a bundle of tax title properties to another entity through an RFP process within one year of the foreclosure. The Town has the option of setting a reserve price and is not obligated to accept bids if they are not satisfactory. If the Town wishes to retain the property, that can be announced at the auction and the auction for that parcel adjourned. The Committee questioned the status of numerous properties that are listed as “owners unknown”. Myleen responded that those parcels must be researched further and suggested that we reach out to the Assessors to get more information. Myleen informed the Committee that parcels classified as land of low value is a different process; the threshold is $15,000. In the case of land of low value, the requested is submitted to the Commissioner of the Department of Revenue. Bob Pease asked if there is a manual that outlines the process, Myleen responded affirmatively and will investigate if the manual is available as public information. ===PAGE 2=== Page 2 of 3 Bob Pease informed the committee that he had inquired about the status of 1529 Mass. Avenue which is surrounded by Conservation land and it appears that the tax taking process may have not been done correctly. The Committee thanked Myleen for attending and providing an overview of the process. 4. Continuation of General Municipal Land discussion regarding parcels of interest for potential designation for conservation, open space, or recreation purposes –Brandon Kibbe suggested that we review the list and identify parcels that may be of interest for municipal purposes. Committee developed a list of parcels to investigate further including: • 51 Parmenter • 0 Shirley Reservoir Lake • 0 Fire Road 12 • 860 Reservoir • 26 Sunset Lane • 725 Goodrich Street 66 West Street – It was noted that this parcel is essentially utilized as conservation land currently and is littered with trails. This property was originally acquired as a site for a new school and was eventually conveyed to the care and custody of the Board of Selectmen. The property is relatively flat and could be utilized for conservation purposes and/or parks. Lynne said she had attempted to take a look at the property but could not find a way to access. Brandon urged committee members to go out and view and noted that Dave Prokoview had advocated for this parcel to be conveyed to conservation. Brandon will reach out to Dave for additional information. 225 Pleasant Street – This property was acquired in 1997 as mitigation for the parcel that was utilized for the building of the primary school which was prime agricultural soils. This property is currently being hayed possibly by a private party. Brandon noted that the Town may have some liability if there is not a legal agreement in place in the event of an accident. 104 Fairview – This property was acquired in 1999 as part of the Chapter 61 withdrawal process. The Agricultural Commission has expressed interest in parcels that are viable for agricultural uses. It may make sense for this parcel to be placed back on the tax roles provided it could be conveyed with an agricultural restriction. Paula will investigate the parcels on lake Shirley, 860 Reservoir, 0 Lake Shirley and 725 Goodrich Street. Mike will investigate the 225 Pleasant Street Parcel and Brandon will reach out to Dave Prokoview regarding the West Street parcel. Bob will attempt to GPS the trails on the West Street parcel. 5. Public Comment – Bob Pease informed the Committee that the Town Manager had reached out to him and Brandon to determine where we are in this process. One member of the Board of Selectmen has expressed in interest in being involved. Committee noted that prior to reaching out to the other Boards and Commissions we will notify the Board of Selectmen. Sarah volunteered to attend a Selectmen meeting when appropriate. Bob informed the committee that he will be meeting with Adam Costa to discuss the process for transferring land to the care and custody of the Conservation Commission. The ===PAGE 3=== Page 3 of 3 Commission will continue to pursue 1529 Mass. Avenue. Brandon commented that when parcels are transferred to the Parks Commission it must be dedicated to recreation like conservation lands. Brandon had researched many parcels when compiling the open space plan and has numerous deeds which he will attempt to download for committee members. 6. Adjourn – Paula Bertram made a motion to adjourn at 8:28 p.m. seconded by Sarah Cammer, voted unanimously by roll call. Review/ Approve 01/19/2021 Minutes – Bob Pease made a motion to approve the minutes, Lynne Man seconded. Motion passed unanimously by roll call vote. 3. Reports from Committee members on research regarding history and additional information regarding several pieces of “General Municipal” land a. 104 Fairview Road (“Woodruff” parcel) – Mike Toohill forwarded an overview of the MEPA process. Bob Pease is working on getting the certified vote and minutes and vote of the 1998 Town Meeting in which the citizen authorized acquisition of this parcel. b. 225 Pleasant Street - Brandon commented that the Woodruff property may have been acquired for mitigation of the Pleasant Street property. Bob Pease will investigate this parcel further. c. 671 West Street – Bob will research this parcel. d. 860 Reservoir Road/725 Goodrich Street/0 Shirley Reservoir – Paula informed the Committee that she had spoken with Doug Cameron from the DFW Fishing and Boating Access division and he was very interested in assisting with improvements to provide access to Lake Shirley. Parcels must be municipally owned. Mr. Cameron indicated he would be interested in viewing any parcels on Lake Shirley that could provide public access. Bob Pease will forward Paula list of properties. Mr. Cameron explained that if they move forward with creating public access, the Town would have to enter into a land agreement that would protect the public access use in perpetuity. They would provide engineering and fund any improvements. Paula informed the Committee that years ago there was a Title Search done on Lake Shirley and the title was cloudy, Paula will try to track down further information for the Committee. Paula explained that she was not able to find the deeds for all these parcels, Brandon suggested that Paula investigate adjacent properties. 4. Other notes/comments/reports from members regarding “General Municipal” properties - Bob Pease commented that the Open Space committee may wish to pursue investigating “land of low value”. Bob also informed the Committee that he had reviewed the list of land provided by the assessors as belonging to Lunenburg, owner unknown and last known owner and identified parcels with connection to or of possible interest to the Conservation Commission. Bob has also researched the deeds for existing conservation land to determine if the deed specifies the land is to be used for conservation. According to Counsel, the deed must so state and be filed in the Registry of Deeds which is not the case for some parcels. Bob has developed a proposed action plan for lands of Conservation Interest; he provided an overview of his proposal, he noted that this plan has not yet been reviewed and adopted by Conservation Commission (he will be presenting to the Commission). Bob is in the process of finding the date of acquisition, the old votes and finding the Town Clerk’s certificate. Lynne Man will work with Bob on this project. Bob also informed the Committee that the Assessor’s use code on some parcels is not correct, several properties currently classified as conservation should not be. ===PAGE 2=== Page 2 of 2 5. Conservation Commission update- Trails Grants – Trail maps have been created for each of the 11 conservation properties which were showed to the Committee. Different trail colors identify trails by use. The trail markers that are put on the trees will coordinate with the trail colors on the map. Trail head and intersections will be identified with maps. The trail markers have been ordered. Five abutters have been contacted to determine if the trails can be identified on the map, two abutters have refused. Brandon asked about the encroachment on the North West Town Forest, nothing has been done as of yet. There has been interaction with the Zoning Agent and Conservation in Townsend. Bob commented that Mary Wilson from the Lunenburg Snowriders has been an amazing help. Bob asked Paula if the trail on Woodlands drive is used by snowmobiles, Paula asked Mel (Tom) Bertram, President of Lunenburg Snowriders, was able to provide an answer. Mel looked at the trail, and confirmed that this is a current trail. 6. Conservation Commission update- Land Use Rules - Bob informed the Committee that the Commission was trying to update the land use rules which has now become controversial. Some members of the Commission property that are in favor of allowing hunting on two parcels and some members that want to eliminate bow hunting on some parcels. Brandon voiced his support for allowing hunting on Conservation land. Paula said she had done a lot of research on how many communities allow hunting on conservation land and that DFW owns an enormous of land adjacent to Hickory Hills properties that allows hunting. Ana said that hunting does restrict other activities, snowmobiling is great and the members help maintain the land, but hunting requires more caution. Brandon commented that hunting is highly regulated and that there are very specific season. Mr. Kibbe also noted that there are very few hunting accidents and most are hunters hurting themselves or others of their party. Sarah commented that this discussion is a microcosm of the planned discussion at tomorrow nights Conservation. Sarah said she is glad that this is a limited roll out, Lynne said she does not particularly like it and that she walks out on conservation land every day where bow hunting is allowed; she puts on an orange vest and walks. Lynn is a little more uncomfortable with firearms but is happy to hear that it would be limited 7. Public Comment - no public comment. 8. Next meeting date- March 16, 2021, 6:30 p.m. 9. Brandon Kibbe requested that the spelling of Mike Toohill be corrected in item 3a. Motion passed unanimously by roll call vote. 3. Lake Shirley Improvement Corporation Discussion Regarding Parmenter Road Parcel (Out of Order) – Joanna Bilotta of the Lake Shirley Improvement Corporation (LSIC) explained that the LSIC is looking for a place to hold recreational lake events, they used to use Camp David and since it closed they have been looking for another venue. Joanna became aware that the Open Space Committee was looking at the Parmenter Parcel owned by the Town and the LSIC would be interested in utilizing this property. Brandon explained that the Committee is in the process of looking at the entire list of Town owned general use properties to see if public use makes sense or if use by other Town Departments is appropriate. He added that the Committee is looking at the Parmenter Parcel but has not yet put forth a recommendation. Joanna said that the LSIC is looking for a beach for lake residents similar to the beach at Island Road on Hickory Hills Lake . Currently the LSIC is paying $40,000 -50,0000 a year on treatments to maintain the lake and they would like to continue swimming lessons for children , which used to be held at Camp David. Ana pointed out that although LSIC does pay for lake treatment the Town pays to maintain other aspects of the Lake and the only public access is through Shady Point which is very limited and individuals have to pay. Sarah indicated that while she understands that the Corporation puts a lot of effort into the lake , access to the lake would be of interest to everyone in the Town. Joanna explained that LSIC is looking for a parcel for use by the Association, not the public. Paula noted that Hickory Hills Lake is private land owned by Hickory Hills Landowners Inc. and all costs for maintenance are paid for by the residents. Repairs to the Dam on Lake Shirley were funded by the State with the stipulation that there be public access, the only “access” currently is through Stump Cove which is not easily accessible. Ownership of the Lake is unclear as there is a cloudy title. Paula added that giving a town owned parcel to a private group is not an option without a public auction, she noted that public access would not exclude LSIC. Brandon reiterated that the Committee is currently doing an inventory and coming up with recommendations. 4. Chase Road and Northfield Road, Map 33, Parcel 6, and Map 38, Parcels 17 and 24.2, Agricultural Preservation Restriction (APR) Update – Brandon explained that Pierce Tree Farm is looking to put an Agricultural Preservation Restriction on this parcel at Spring Town Meeting. This would be a permanent restriction and the land would remain in private ownership. The APR would be sold to the State and then ownership would be transferred to Dick Violette of Dicks Market Garden. The APR program provides the bulk of the funding for the parcel which is approximately 99 acres. Cost of the ===PAGE 2=== Parcel is $665,000 and the Town would be responsible for funding a 10% match. Ana said that looking at the map this parcel does not have a lot of frontage and therefore development opportunity would be limited, she also noted that public access is limited and indicated she though making the land public would be a better option as it abuts the Saliba parcel. Brandon explai ned that the Open Space plan talks about the importance of preserving agricultural land. Lunenburg is unique in that we have large APR parcels. One of the main hinderances to preserving agricultural use is the cost of the land and the taxes. The APR pr ogram allows for reduction of costs and increases the viability for agricultural use. This is not an open space tool, but rather a farm preservation tool. Bob Pease said that this is a great program and made a motion that the Open Space Committee endo rse this article at Town Meeting, Paula Bertram seconded. Motion passed unanimously by roll call vote. 5. Review Lake Shirley Parcels – Paula said she had not had a chance to do any additional review. Bob Pease will resend Paula the list of parcels owned by the Town on Lake Shirley. 6. Review Oliver lot (374 Page Street) – Bob Pease told the Committee that this parcel shows up in the Assessors Database as Conservation however there is no title on record and this parcel is in the middle of a residential area. Bob is continuing to research this parcel but in his opinion the Town should clean up the title and sell the parcel. Paula asked how you clean up title? Brandon said that it is a difficult process, you have to make a strong effort to find a ll owners and then go to land court to establish title. Brandon asked if Bob had consulted with Town Counsel, Bob is meeting with Counsel on the 22nd. Bob will consult with Counsel about the process to clear title. 7. Public Comment – None. 8. Next meeting date- April 20, 2021, 6:30 p.m. – Brandon will be out of Town on April 20 th, following discussion meeting was moved to April 13, 2021. Brandon will make sure there is a Zoom license available. Dave Prokowiew would like to make a presentation to the Committee r egarding the Pleasant Street Parcel & West Street. 9. Adjourn – Paula made a motion to adjourn at 7:20 p.m., seconded by Ana motion passed unanimously by roll call vote. Call to Order - Chairman opened the meeting at 6:33 p.m. and read the pandemic notice as posted on the agenda. 2. Minutes- Review and Approve 03/16/2021 – Bob Pease made a motion to approve the minutes of March 16, 2021, Lynne Man seconded. Motion passed unanimously by roll call vote. 3. Presentation from Whalom residents regarding conservation of general municipal lands at 671 West Street and 225 Pleasant Street – David Prokowiew and Eric Hinds presented a PowerPoint presentation to the Committee which is attached and made part of these minutes. Brandon Kibbe explained that these 2 parcels of land are some of the largest town owned parcels in a heavily populated area. The Open Space plan identifies the need for equity of access to recreational open space in all areas of the Town. The West Street parcel is approx. 40 acres of wetland and woodland with a pond. There are several existing trails on this parcel. Currently there is adequate room for a parking area for 3 or more vehicles at the trail head. This area could be expanded with the removal of dead trees. There are several rustic crossings (planks, tires etc.) on the property that need updating. Approximately 10 years ago some abutters were able to purchase a portion of this parcel to add to their existing lots. There are 2 possible access points, 1 at Pratt Street and the other at Pleasant St. Ext. Bob Pease noted it will be important to ensure access before transferring responsibility. The area identified in the presentation as “The Western Loop” is actively traveled by snowmobiles, mountain bikes and four wheelers. There is one certified vernal pool in the area of West Street, it is unclear as to whether or not it is on the Town owned property. The Pleasant Street parcel is 66.55 acres and abuts the solar field. Approximated 40 acres of the property is fields. According to Mr. Prokowiew, the owner of the solar fields is amenable to discussing the creation of trails to allow connectivity to the West Street Parcel. This parcel lends itself to rectangular fields, identified as a need in the open space plan. A portion of this property is currently hayed. Mr. Prokwiew noted that since the pandemic many walkers are utilizing this land and the West Street parcel. Eric and Dave indicated they would be willing to provide labor to clean up the properties and enhance access to the land. Bob Pease noted that the residents need to take an active role in transferring property to other departments and applauded Dave & Erics efforts. Brandon Kibbe stated that first the Committee should reach out to the Selectmen and then to other departments to determine if the parcels would fill a need. If no other department sees an active need the recommendation would be to place these parcels under Conservation or Parks, or a combination thereof. Paula Bertram made a motion to reach out to the Board of Selectmen through the Town Manager, the Planning Director and the various committees represented on the open space committee to consider these 2 parcels for open space and recreation, committee members will report back to the Open Space Committee at the next meeting. Seconded by Bob Pease. Passed unanimously by roll call vote. 4. Update on general municipal lands at 860 Reservoir Road/725 Goodrich Street/0 Shirley Reservoir Road – Paula informed the Committee that she has been researching town owned land on Lake Shirley. 860 Reservoir Road is clearly owned by the Town as it went through the taking process, the tax title process was begun in 1970 on the 725 Goodrich Street parcel however it does not appear it was completed. Previous ownership of several of the adjacent “owner unknown” parcels is unclear. Paula will do further research and report back to the Committee. ===PAGE 2=== 5. Revision of Land Use Plans for Lane & Table Rock properties – Bob Pease explained the Conservation Commission was looking at updating the land use policies on conservation parcels it was discovered that both these parcels indicate that bow hunting is only allowed by special permit. Bow Hunting is allowed by right on all other conservation property. The Commission will seek to revise this policy in the future which will require a public hearing. 6. Questions for Town Clerk about minutes and town meeting actions – Bob Pease told the Committee that he will be meeting with the Town Clerk to research Town meeting actions on parcels listed as general municipal land. Brandon requested that Bob look for the actual town meeting vote on the Woodruff parcel and the Town Meeting actions for 225 Pleasant Street. 7. Future Meeting with Assessor - Bob noted that several of the parcels currently identified as owner unknown could be taken as land of low value and he will be meeting with the Assessor to discuss. The Committee will continue the process of reviewing and prioritizing parcels. 8. MassGIS Training – Lynne Man has signed up for the MassGIS training session and requested that any member has specific questions that they would like to ask, please email them to her. 9. Committee administration (terms, membership) – Brandon said that he reached out to Adam Burney and currently there are not terms for open space members. Some of the committee members are appointed by their various commissions/committees/boards (i.e. Planning Board, Conservation, Parks). Current at large members are Brandon, Mike, Lynne and Sarah. Sarah questioned if we want to establish a more formal process with terms, it may be prudent to see if other people would like to serve. Ana noted that the Board of Selectmen have been discussing the nominating and reappointment process. Paula commented that she believes continuity is important. Brandon informed the Committee that Eric Hinds has submitted a talent bank expressing interest in servicing on Open Space. Bob noted that the Committee would welcome Eric’s input as a non-voting member. 10. Adjourn – Paula made a motion to adjourn at 8:34 p.m., seconded by Lynne motion passed unanimously by roll call vote.
