Bakaysa, Chair, James A. Hallo ran, Joanna L. Bilotta, Robert J. Saiia, Thomas W. Bodkin, Jr., Marion M. Benson, Planning Director Chair opened the Public Hearing Continuation with t he reading of the legal advertisement published in the Sentinel and Enterprise on May 4, 2009. The Hearing Continuatio n was to hear and discuss an application for Approv al of a 135-lot Definitive Subdivision Plan entitled Aro Estates, located on t he northerly side of Howard Street in the northwest portion of Lunenburg consisting of four parcels. Owners are 460 Howard Street Realty Trust, 460 Howard Street, Lunenburg, MA, John and Judith Aro, 318 Howard Street, Lunenburg, MA and O’Brien H ouses, 18 Cassimere Street, Andover, MA. Applicant is O’Brien Homes, Inc., 18 Cassimere Street, Andover, MA. Chair introduced Board members, Planning Director, Review Counsel from Kopelman & Paige, and Recording Secretary. As this was a continuation, Chair informed the audience tha t it would be limited to new issues; issues brought out at the initial Hearing would not be rehashed. Chair noted abutter concern s from the initial Hearing as follows: Water/Septi c/Wells- Effect on water supply with additional 135 houses, was Aquifer stud y done, runoff increase, increased flow in the thre e main waterways, additional water runoff as a result of raised septi c systems, and well contamination by new septics. Traffic/Roads- New roads too close to abutting properties, condition of Howa rd Street – cannot handle increased traffic, N. W. Townsend Road – narrow and poor condition, would the new roads be public o r private, what would be the width of the new roads ? Utilities- would they be underground, would they be upgraded? Other concern s are- provisions for parks or greenways, safety of the neighborhood children in relation to traffic, mitigation, bedroo m count, impact on Town services, access to trails, building timeline, Hazardous waste study on farm, fire management , sidewalks pr oposed? The Applicant, O’Brien Homes, was represented by Br ian Milisci, Whitman & Bingham Associates, 510 Mech anic Street, Leominster, MA. Mr. Milisci noted Whitman & Bingh am Technical Review letter dated May 8, 2009, submi tted to the Planning Office on May 8, 2009. This is a response letter o n information received to date. He inquired if Cha ir wished him to read into record as he did not know whether or not Board memb ers had reviewed letter. Planning Director Marion Benson noted that each Board member was in possession of the Technical Rev iew letter as of this date. Mr. Milisci also noted that the Plan had not been revised and there have been no new studies. T he Chair asked him to go through the letter for the benefit of the audience. Item 1), first paragraph follows: the applicant un derstands that the plans do not meet the requiremen ts of Section 5.6. of the Lunenburg Protective Bylaw – Cluster Development. Section 5.6. requires that 50% of a proposed subdiv ision on a tract of land of 25 acres or greater in the Residence A, Residenc e B or Outlying Zoning Districts is to be set aside as open space. In exchange for the open space the minimum lot area is decreased to 30,000 ft in the Residence A and Outl ying Zoning Districts and 60,000 ft in the Residence B Zoning District, e ffectively mandating a form of cluster development. The proposed “Aro Estates” lies within the Outlying Zoning District. The minimum lot area requirement in the Outlying D istrict is 40,000 ft. The proposed project includes the construction of a 4-b edroom single-family dwelling on each lot to be ser viced by individual septic systems and wells. Massachusetts DEP Title V Regul ations (310 CMR 15.000) requires that any lot withi n a nitrogen sensitive area is to provide 10,000 ft of land area per 110 g allons per day (GPD) of wastewater flow. The propo sed lots qualify as being in a nitrogen sensitive area due to the fact that each lot is to be serviced by individual septic systems and wells. The Title V wastewater flow rate per bedroom is 110 GPD. There fore, each proposed lot has to have a minimum lot a rea requirement of 40,000 ft to meet the Title V Regulations, renderin g the “benefit” of section 5.6. unavailable to the applicant. ===PAGE 2=== Public Hearing Minutes Aro Estates Howard Street May 11, 2009 Page 2 Chair asked for any comments from the Board. Mr. Bodkin inquired that the bylaw 5.6.3. states t he minimum is a 30,000 square foot that a cluster d evelopment could contain 40,000 square foot lots, the applicant would then b e able to have both house and sewer system on lot. Mr. Milisci responded yes. Ms. Bilotta asked if the submission complies with S ection 5.6.3. She did not see any reason to go th rough the remaining paragraphs if the submission did not meet Section 5 .6. Mr. Milisci responded they did answer that in the T echnical Review; the submission did not meet Sectio n 5.6.3. Mr. Halloran had no comments. Mr. Saiia had not comments. Chair noted that Section 5.6. Cluster Development w as originally brought forth by the Planning Board t o the Town to help preserve the rural character of the community. Any thing developed in excess of 25 acres would preserv e 50% for open space. There has been no change in the intent. Number 1. of The Directives for Preparation of a Definitive P lan of Aro Estates , Received and Filed with the Lunenburg Town Clerk Au gust 12, 2008, states: “The Applicant shall have a plan in the definitive stage reviewed under Protective Bylaw of the Town o f Lunenburg, Section 5.6. Cluster Development.” Chair concurred with Ms. Bilotta, that the Applicant has not yet met the int ent of Section 5.6. and sees no reason to go any fu rther into the seven page Technical Review submitted by the Applicant. Mr. O ’Brien had an opportunity to come forth at this con tinuation with a revised plan and chose not to. Mr. O’Brien, 18 Cassimere Street, Andover, MA- Beli eved he did not have to follow Section 5.6. as the Board approved the Preliminary Plan last summer. There were four mont hs when they weren’t part of the discussions. He c ame in to a meeting with an ANR lot, the plan was discussed, the Board said they would have a meeting and get back to him, and at the next Board meeting it was approved. The Approval says that th e Board approved that Plan pending compliance with 5.6.; frankly the Board should have disapproved the Plan so there would not be any format to follow. That’s the reason he had his engineers draw up the Plan the way it is. Chair responded that specific Directives were given that the Definitive Plan had to comply with 5.6. Mr. O’Brien noted things would have been clearer if he was able to be at the meetings. The Board told him it would get back to him. When the Board got back to him it was to say that the Preliminary Plan had been approved, but he had to follow 5.6. Ms. Bilotta noted that Mr. O’Brien stated the Board approved his plan without 5.6.3.. She then noted that he did get the Directive in writing that the Plan was approved based on the Directive that he follow 5.6.3. Mr. O’Brien respon ded that he brought in a conventional plan on the Preliminary. The Board ap proved a conventional plan. Mr. Bodkin noted to th e audience that a Preliminary Plan Approval locks in the zoning for t hat parcel of land. The property is rural in natur e and it seems that the Applicant’s strategy has been to get off on the wro ng foot. Mr. Bodkin agrees with the Chair in terms of the bylaw. One hundred thirty five (135) units will generate probably 1,00 0 vehicular trips per day. The road supported a ch icken farm for the better part of its existence. Any developer looking to develop in Lunenburg needs to look around the Town and see the makeup of the Town. Mr. O’Brien may come back another day with a plan. We want to preserve the rural character of our Town. Chair asked for comments from the public. Mike Sauvageau, 191 Elmwood Road- Noted that he wa s both the Building Official and the Zoning Officer for the Town of Lunenburg. He fully concurred with Attorney Bodkin . Mr. Sauvageau is the Zoning Officer in the Town and Attorney Bodkin is absolutely right, The Board gave the Applicant a gi ft by approving the Preliminary Plan to freeze the zoning. It sounds like Mr. O’Brien had the Directive. Mr. Sauvageau referred to his review letter of March 23, 2009: At the Planning Board’s request, I have reviewed the Definitive Subdivision Plan “Aro Estates” dated February 19, 2009. Please be advise d that the subdivision plan referenced above is in violation of “The Prote ctive By-Law of the Town of Lunenburg” Section 5.6. Cluster Development amended through May 3, 2008. More specifically, th e subdivision violates Section 5.6.3: Intensity. His opinion is that they’re ===PAGE 3=== over-designing what they are allowed to build. Mr. O’Brien designed this project for failure. If som eone came before Mr. Sauvageau with a 40,000 sq ft lot in Residence A an d they need 60,000 sq ft to do a two-family, but as k for a building permit to ===PAGE 4=== Public Hearing Minutes Aro Estates Howard Street May 11, 2009 Page 3 put a two-family on a 40,000 sq ft lot, he’d have t o deny it. Attorney Bodkin is correct. (Note- Ch air wanted to make it perfectly clear that Mr. Bodkin was present as Thomas Bodkin, citizen of Lunenburg, not providing any legal adv ice to the Board. Mr. Sauvageau noted he was only addressing him by his t itle out of respect and not in his capacity of an a ttorney. He knows that this evening Attorney Bodkin is a citizen and membe r of the Planning Board.) Mr. Sauvageau also noted the Applicant is over- designing what he’s able to design. Ms. Bilotta made Motion to postpone the hearing on Aro Estates. Mr. Bodkin, Second. All aye. Ms. Benson asked Chair if the Board was taking a vo te on Aro Estates during the Hearing or at the Boar d meeting immediately following the Hearing. Chair responded- at the mee ting. Rennie Shattuck, 396 Howard Street- Asked if there would be a speaking for/against session. He wished to make the following comments- “I bought land and built in Lunenburg bec ause I wanted woods, flowers, and animals to go wit h the quiet of being in the countryside. You have bought land, Mr. O’Brien , and technically you can do most anything you wish with your land, though it may not fit with the area and is not what the peopl e in the area desire. Those of us who are already residents have tried to maintain a quiet, countryside atmosphere. We have ideals about how we want to live. Beside buying la nd and stating very simply a strong desire to make money, what have you to offer as a potential neighbor? Is it the poten tial 135 homes with 135 wells and 135 septic systems that will deny us of t he wooded land, that will possibly cause us to go w ithout water in our wells or polluted wetlands from excessive septic sewage? Wh at about the excessive noise from heavy equipment a nd large trucks on our roads during development of the land? What abo ut the influx of people which could mean building a new school and increasing the need for other Town services? Will your development be the only place where taxes are raised to pay for these things? As a good neighbor, why are you putting on e of your roads to the development in my front yard and flatly stating no change to the Plan can be made? Where are my right s? As a neighbor, what concern have you stated or shown about those of us who already live here except to ‘make money’? W ith an attitude like that as a neighbor, who wants you as a neighbor?” Gary Entwistle, 259 Howard Street- He has lived in Lunenburg for four years. As a former Zoning Board of Appeals member in Townsend, he has seen situations like this before. Sometimes financial greed overrides. When he live d in Townsend, he was the sixth house in a 125-house development. Eighte en-wheelers came up the road every thirty seconds f or the first few years. The road got to the point that water lines going to 15 of the houses were damaged by heavy trucks on t he road. Howard Street cannot handle it; it already has cracks. If the Pl an was approved, there would be construction vehicl es, supply vehicles, the road isn’t wide enough and cannot be widened. The Town doesn’t need a development that may not be able to sell. The economy is too bad. In a former career he sold chemicals to e gg farms; the soil will be dangerous. Chair asked Ms. Bilotta to repeat her previous Moti on. Ms. Bilotta made Motion to end the public disc ussion for Aro Estates. Second, Mr. Saiia. Chair asked for any discussio n. Mr. Bodkin noted this Plan is not right for the Tow n of Lunenburg. Mr. O’Brien had the right to submi t this plan, which was judged solely on its merits. At some time in the f uture he may submit another plan, which will be rev iewed on its own merits. Town Counsel, Attorney McKertich asked if the Motio n was to end the session on this Hearing or to clos e the Public Hearing. Ms. Bilotta noted it was to close Public Hearing. No more comments. All aye. Public Hearing for Aro Estates closed at 7:06 PM. Audio recording on file in Planning Office. Bakaysa, Chair, James A. Hallo ran, Robert J. Saiia, Thomas W. Bodkin, Jr., Marion M. Benson, Planning Director Absent: Joanna L. Bilotta Chair opened the Public Hearing with the reading of the legal advertisement published in the Sentinel and Enterprise on June 15 and June 22, 2009. The hearing was to hear and dis cuss a revised plan under Section 5.6. Cluster Deve lopment and a Development Plan Review under Section 8.4. of the P rotective Bylaw of the Town of Lunenburg to constru ct sixty-six (66) dwelling units off the south side of Northfield Roa d between Massachusetts Avenue and Northfield Road. The Applicant was represented by Kent Oldfield, Bou cher Construction, Leominster, MA. The original pl an was presented to the Planning Board approximately 1 ½ - 2 years ago. Th e main change with this revision is a location chan ge to the sewer line after discussion with the Conservation Commission. Sewer line goes from high point at pump station, down al ong Pope Road, behind Mass Ave Motors, and then discharge to a lateral th at was built when sewer was put in along Massachuse tts Avenue. Applicant also requested a Determination of Applicability fro m the Commission. Drainage location for each lot h as been solidified. Number of lots and development size has not changed . A Tech Meeting was held February 2009 with traff ic being the main issue. Traffic plans are in-process with Mr. Scull y, MS Transportation System, Inc. and will have to be approved by Reviewing Engineer Steven Marsden. Offsite improvements will be a deceleration turning lane from Chase Road int o Northfield Road, possible 4-way intersection and a stop sign and lan e improvements at Northfield and New West Townsend Roads, a flashing yellow beacon with a mast arm at Chase and Northfie ld Roads. Warning signs have been requested. Plan submitted to Sewer Commission this date. Pump station design requeste d by DPW Director Mr. Rodriquenz is similar to one designed for The Meadows. Planning Director Marion Benson noted tha t as traffic plans are not finished, there will be a hearing continuance. Reviewing Engineer Steven Marsden, Marsden Engineer ing, noted the change to the sewer line will not im pact on Maple Parkway residents, but will run along Pope Road. H e also noted serious attention will need to be give n by MS Transportation System to traffic safety. Mr. Bodkin inquired as to a walking trail easement on the site. There are walking easements throughou t the property. Mr. Oldfield responded that it would be accessed from P ope Road and walking trails would be maintained thr ough the site. Applicant has spoken with attorney for the Water Di strict, and has been granted emergency means of egr ess on Pope Road. (There had been a past on-going issue trying to det ermine who owns Pope Road. Eminent domain was take n in 1967 by the Water District. Applicant’s attorney said Applican t owned to the center of the road, but since it was taken by eminent domain, Applicant still did not have rights onto road.) Po pe Road is currently spotty paved to the water tank . Will be plowed at all times for emergency access. Is currently gated with a “b reak-away” gate. Mr. Halloran asked where traffic would be entering/ exiting development. Mr. Oldfield responded ingres s/egress was off Northfield Road. ===PAGE 2=== Minutes Highfield Village Public Hearing, 6-29-09 Page 2 Mr. Oldfield noted this application is a Definitive Plan, submitted under Section 5.6. Cluster Develop ment, with lot sizes of 30,000 – 50,000 sq ft. Chair asked for comments from the audience. Ann Marie Mead, 91 Maple Parkway, asked if, and whe n, sewer would come down Maple Parkway. Mr. Bakays a referred her to the Sewer Commission. David Colvin, 92 Maple Parkway asked if the sewer l ine would be near Maple Parkway. Mr. Oldfield resp onded no; first house will be approximately 850 feet from Mr. Colvin’s pr operty. Pat Kelly, 117 Chase Road asked if Pope Road was a walking trail. Mr. Oldfield stated it was not. It was taken by eminent domain and currently owned by the Water District fo r access to the water tank. It is not a public way , but Applicant’s attorney states the abutters have right to the center of the road on the side they live on. Gary Kelly, 117 Chase Road asked how close sewer wo uld be to Pope Road and if the Water Department was okay with blasting that close to the water tank Mr. Oldfield responde d twenty five (25) feet from the road on the Applic ant’s side. Test pits have been done and there is enough depth for a water lin e. Water line will be 5 feet down. Some blasting may have to be done for sewer line. Pat Kelly noted that at the first Public Hearing (J uly 2007), there had been some concern with houses being built too close to the telecommunications tower on the water tank and want ed to know if there had been any changes. Mr. Oldf ield responded there is no “fall zone” as the towers are located on the top of the tank. Ronald Smith, 110 Old Farm Road noted there is a To wn-owned 50 foot strip along the east side of the p roperty and inquired if there would be a Town right of way to the conservat ion land. Mr. Smith feels it would be advantageous for the Town to have frontage access as there are almost 60 acres. Ms. Benson noted that is a Conservation Commission issu e. Mr. Smith would also like to see increased signage as Northfield Ro ad is a fast and heavily traveled road. Ms. Benson noted that once MS Transportation System has finished plans, there wil l be a hearing continuation. Pat Kelly asked if Pope Road was wide enough for em ergency access. Mr. Oldfield responded it is suffi cient width and will be maintained. Gary Kelly asked if Pope Road would be used during construction. Mr. Oldfield noted only to bring in large items, i.e., manholes, pipe lines. Steve deBettencourt, 200 Pleasant Stre et was under the impression that when Wal-Mart was built, road could be used to access back property. Mr. Oldfield and Ms. Benson responded that the Wal-Mart site is private ly owned and that the same inquiry was made of the Wal-Mart owners at the time of building, and the owners were adamant abou t not allowing access through their property. Steve deBettencourt inquired as to why another pump station. Mr. Oldfield responded that as far as si ze goes, it was being designed to possibly take the rest of Northfield Ro ad at a later date. Northfield Road and beyond cou ld tie into it by gravity. The Northfield Road side of the site (1/3) will utilize the pump station, and the Massachusetts Avenue sid e (2/3) gravity to Massachusetts Avenue. Pat Kelly asked if project would be in phases. Mr. Oldfield responded two phases. Carl Luck, 50 Sunset Lane asked how pump station lo cation was determined. Mr. Oldfield responded for possible ANR (Approval Not Required) lots on property owned by J ohn and David Saliba north of the site and future u se on Northfield Road. It is also typically located at high point. Mr. Oldfield noted that one of the Applicants, Mr. Saliba, requested that the large lots that are not part of the cluster development be situated as such to maintain Alfred Hirsch’s blu eberry field intact. No proponents or opponents. ===PAGE 3=== Minutes Highfield Village Public Hearing, 6-29-09 Page 3 Mr. Bakaysa asked for a Motion to continue Hearing to the next Board meeting. Mr. Oldfield noted that Mr. Scully stated he would have traffic plans within two weeks and the c lients are also anxious to get started. Mr. Marsde n noted both the Fire Chief and the Police Chief want to review the intersectio ns at a Tech Meeting prior to another hearing. Mot ion was made to continue the hearing to July 27, 2009, 7::00 PM, Mr. Saiia, Second, Mr. Bodkin, Motion passed. Hearing recessed 7:45 PM. Audio recording on file in Planning Office. Bilotta Chair opened the Information Meeting with the readi ng of the legal advertisement published in the Sent inel and Enterprise on June 23, 2009. The Information Meeting was to hear and discuss an application for a Development Plan Review under Section 8.4. of the Protective Bylaw of the Town of Lunenbu rg for repair of machinery and operation of a servi ce establishment at 100 Pleasant Street. The Applicant, Michael DeLuca, 74 Bolton Woods Way, Bolton, MA was represented by Steven Marsden, Mars den Engineering. Mr. Marsden noted subject property and abutting lot are subject to a special permit and a Zoning Board of Appeals (ZBA) hearing was held approximately two weeks ago. The property owner, Mr. Livergood (Cross Stone Realty Limited, 37 Crosby Road, Ashburnham, MA), and the holder of the special perm it (GR Construction) did not show at the hearing; t herefore, it was continued to July 22 nd . Applicant is requesting a continuance to the nex t Planning Board meeting as he is waiting to make s ure the zoning application is okay and things are satis factory to the Building Official. Septic plans ha ve been submitted to Nashoba Associated Boards of Health. Ms. Benson noted she had received a telephone call from the ZBA Chair noting concerns. Tenant never r egistered use with the ZBA. Sprinkler system never installed correctly. Once property is separated into two lots via an ANR (Approval Not Required) Plan, issues can be resolved. The Applicant, Mr. D eLuca, will address problems, clean up the area, an d Mr. Marsden anticipates having photographs showing such at the continuation . Ms. Benson noted a new ANR is being submitted du ring this Information Meeting at the Building Official’s request which pr ovides 100 feet of frontage on Lot A for a conformi ng lot. Current plan shows 99.78 feet. Lieutenant Ricci, Fire Department noted Department’ s concerns: No bell on fire sprinkler system. Fire sprinkler systems needs monitoring. Fire sprinkler coverage updated. Fire sprinkler corrosion test needed. Heating system flue pipe and power vent needs evalu ation and repair by certified oil burner technician . Fire extinguishers need inspection. Occupant in basement not registered with town and n o permits for same. Other upgrades and/or permits needed dependent on s pecific occupancy. Rear lot under use by GR Construction shows many ar eas of small spills in dirt. Evidence of vehicles being stripped on premises. Cutting and welding not permitted outside of masonr y garage. ===PAGE 2=== Minutes 100 Pleasant Street Information Meeting, 6-29-09 page 2 Mr. Marsden feels all items are fairly addressable and has already discussed them with both the Applic ant and Building Official. The hearing was to hear and dis cuss a Modification to the 40R application under Se ction 4.13. Tri Town Smart Growth District, Protective Bylaw of the Town for a Development Plan Review for a 204 unit apart ment complex at 37 Youngs Road, Lunenburg, MA 01462. Great Bridge Properties, LLC (applicant) and David Fedeli (owner) were represented by William Hannigan , Hannigan Engineering, Leominster, MA. Also in attendance we re Chris Davies, Great Bridge Properties, William C aselden, Great Bridge Properties, and Attorney Mark Bobrowski. The Modification is for minor revisions. DHCD (Dep artment of Housing and Community Development) has r equested elevators be included within each building; therefore, cost h ad to be offset elsewhere. This was accomplished b y combining buildings and reducing the total number of buildings from eight t o six. DHCD also requested more open space, which will be attained due to the elimination of buildings. Internal traffic lay out has changed allowing for better vehicular flow. There will be 33 units in five buildings and one building with 39 units. Project will be divided into three Phases with two building s per Phase. The water main will be constructed along the access road to the To wn land for Buildings 1 and 2 during Phase 1. In P hase 2, it will be extended to the remaining four buildings. Sewer line will b e an E-One system. Each building will have its own “mini pump station” which will tie to manholes. It will then go to Youngs Ro ad, across the bridge and tie into Fitchburg’s sewe r connection. Two low- pressure sewer lines will be constructed along the access road to the flushing manhole on Youngs Road. One for the project and one for the Town’s use. Lighting reduced due t o reduction in number of buildings. Landscaping ar ound each building. Items in original plan rollover into revised plan w ith change being configuration to layout which chan ges configuration to utilities. Applicant hopes for funding by FY 2010 for a late-s ummer ground-breaking. Once Phase 1 is underway, A pplicant will work on funding for Phase 2. Phase 1 will stand nicely on its own while waiting Phases 2 and 3. Mr. Bodkin wanted to know where the bus stop is loc ated. Mr. Hannigan indicated near development entr ance for school bus. There is already an active public bus line on Summe r Street. Development is within ¼ mile to satisfy the transportation element of a 40R. This was reviewed with MART (Montachusett Regional Transit Authority). Attorney Bobrowski n oted the three necessary elements for a 40R- 1) transportation wit hin ½ mile, 2) areas of highly concentrated develop ment and 3) highly suitable. Mr. Bakaysa inquired if there would be a sidewalk t o Summer Street. Mr. Hannigan noted there are no s idewalks on Youngs Road; there is a sidewalk system within the develop ment. ===PAGE 2=== Minutes Tri Town Landing Public Hearing, 6-29-09 Page 2 Mr. Hannigan noted there had been a previous misper ception regarding the Youngs Road Bridge (pedestria n bridge). Mass Highway wanted the bridge repaired/rebuilt to get t he utilities from one side to the other, originatin g in the original sidewalk concept to carry the utilities to the development. The water and sewer lines would be hung under the bridge. It is now known that the bridge was not a temporary fix. It is a p ermanent fix. The Town owns the bridge and the onl y requirement the Applicant now has is that the structural engineer design the hanging system which is much less than a pedestrian bridge. The Applicant will then submit the calculations to the Town for a pproval. The mechanism available for a pedestrian bridge no longer exists. Reviewing Engineer Steven Marsden noted he is looki ng for the Maintenance Agreement, Operating Agreeme nt, and Cross Easements for access road. Drainage has been revie wed and is fine. Applicant has drainage base so ea ch Phase will stand on its own. Joan Morin, 48 Youngs Road noted that newspaper art icles states Applicant looking for federal funds th rough the stimulus package. Affordable has been reduced from 80% to 6 0% of median area income. When did Section 8 come i nto play? Section 8 people don’t have to have any income and she felt police officers would be there all the time. Was the development still a 40R? Mr. Castleden noted program Applicant trying to use to fund project is 60% of median area income . Financing would have a stricter income cap than the 40R statute, but it doesn’t change the underlying 40R status. Financin g going forward is impossible to predict. Mr. Bakaysa stated that Sec tion 8 is a program to help individuals be able to find an affordable place to live and insures that the landlord gets paid. The key to any project, no matter what type of tenant, comes down to the property management. Ms. Benson and Reviewing Engineer Stev en Marsden previously viewed one of Great Bridge Pr operties projects and were very pleased with the cleanliness, landsca ping, open space, and building condition. Mr. Davi es noted they are audited bi-annually; by DHCD as a minimum. Steve deBettencourt, 200 Pleasant Street inquired a s to building height, building accommodations for s chool bus stop, and pull- off for the bus. Mr. Bakaysa stated no change to b uilding height; buildings just longer. Modificatio ns under discussion were drainage changes and number of buildings. Board Ap proval states building height has to be less than 5 0 feet. Mr. Hannigan and Ms. Benson noted building height of 44.63 feet. There will be an internal sidewalk system which l eads to the bus stop, along with the possibility of building a closed shelter a t the stop. Closed shelter would have to be discus sed with Building Official. School buses will not contract to go onto private p roperty. Mr. deBettencourt did not feel having the sewer in a small strip was a good idea. The Town would need an easement to access the property at the rear of the development. Mr. H annigan noted driveway is on both project land and Town land. A cross easement will be developed between the Applicant an d the Town for the road to go over both properties. Applicant will lay a second sewer line for the Town’s use across the bri dge thereby putting a mechanism in place if the Tow n eventually develops land. Mr. Marsden noted the Applicant is making th is development as user-friendly as possible within the purview of the area they are working in. Mr. deBettencourt inquired as to fencing during Pha se 1 to secure site. Mr. Hannigan noted the existi ng fencing will remain, but be replaced as the project moves forward. Road str iping on Summer Street and Youngs Road improvements will now take place in Phase 1 versus Phase 2. DPW Director, Mr. Rodri quenz is looking into funding for Summer Street imp rovements. No proponents or opponents. Ms. Benson read Findings into record. 1. The Lunenburg Planning Board finds that the new sub mittal contains minor modifications. 2. The Lunenburg Planning Board finds the Approval for 204 units in three phases was approved in Developm ent Plan Review under Chapter 40R on January 29, 2007. 3. The Lunenburg Planning Board finds the applicant re ceived a letter dated December 10, 2008, from the F itchburg Waste Water Treatment Facilities Commission grantin g 45,000 gallon per day. 4. The Lunenburg Planning Board finds the Town of Lune nburg is extending its IMA (Inter-Municipal Agreeme nt) with the City of Fitchburg to extend water to the site. An IMA agreement has been reached and a verification l etter will be sent to the applicant shortly. ===PAGE 3=== Minutes Tri Town Landing Public hearing 6-29-09 Page 3 5. The Lunenburg Planning Board finds that an Order of Conditions was signed on January 21, 2007. A modi fication request as an Amendment to the Order of Conditions has been presented to the Conservation Commission. 6. The Lunenburg Planning Board finds a receipt of MEP A (Massachusetts Environmental Policy Act) ENF (Environmental Notification Form) certification was received on November 24, 2006. Notice of Project Change (NPC) has been presented. Mr. Hannigan noted NPC not nee ded on project. Sentence will be deleted. 7. The Lunenburg Planning Board finds the purpose of t he modification proposal is requested by DHCD (Depa rtment of Housing and Community Development). A red line draw ing was enclosed with the request. Modification is under Section 4.13.15.1 Protective Bylaw of the Town of L unenburg. 8. The Lunenburg Planning Board finds changes listed a s follows: A. Finds inclusion of elevator was offset by reduction of number of buildings from eight to six in Phase 1. B. Finds building orientation adjustment shows that Bu ildings 1, 3, 4 and 5 are larger in size. Building s 2 and 3 are combined, with rental office and club house in Building 2. C. Finds utility modification is proposed to keep inte nt of approved project by providing a mechanism of future utilities by constructing the water main in Phase 1 to serve Buildings 1 and 2 and be placed along the access road to the Town land. D. Finds water main will be constructed to the second entrance to the project and extended into the proje ct to service the four remaining buildings. Main on acce ss road will be extended to an accessible location for future connection. E. Finds connection to the municipal sewer system will be accomplished by use of low-pressure sewer main and a series of E-One pump systems. Each building would have an independent system consisting of four pumps with dual pumping capacity. The low-pressure sewer line constructed in the first phase will ser vice Buildings 1 and 2 and be placed along the access ro ad to Town land. In the second phase the low-press ure sewer line will be extended into the project to ser vice the remaining four buildings. F. Finds drainage has been modified due to changes in the building orientation. Revised Drainage Analysi s and Report has been submitted. G. Finds parking adjustments due to new orientation of buildings show changes to the layout of the on-sit e roadway system. Traffic flow through the site has been improved and provides the ability for more ope n space. Police and Fire Departments concurred with this at the June 11, 2009 Tech Meeting. Provision has also been made for reserve parking space (see plan on file in Planning Office). H. Finds the parking layout will be reviewed in the pl an presentation for Phases 2 and 3. I. Finds that the red-line submittal of the Overall Bu ildout and Building Envelope of the project is main tained. The modification of the building layout moves build ings further away from the residents along Youngs R oad. J. Finds that the modification shows that the bridge o f Youngs Road has been fully reconstructed (plans o n file with Department of Public Works) and utilities serv ing the site can be “hung” off the bridge, thus eli minating the need for a sidewalk. K. Finds the sidewalk proposed to be constructed along Youngs Road to Summer Street has been eliminated. L. Finds that the applicant has reviewed with regional transportation authority MART (Montachusett Region al Transit Authority) that the location of the project to the nearest public transit route conforms to th e requirement of having “access” to regional transpor tation. ===PAGE 4=== Minutes Tri Town Landing Public Hearing 6-29-09 Page 4 M. Finds that utilizing a low-pressure sewer system wi ll eliminate the previously proposed section of gra vity sewer to be constructed on the west side of Baker B rook. Provision for the Town and area residents to span Baker Brook with a separate section of low-pressure sewer has been included in the design. N. Finds that mitigation proposals will be addressed o ver time. The first 100 feet of the access road to the Town land will be paved as part of the first phase. The remaining portion will be constructed with roadway grindings until completion of the second phase. O. Finds that the fire access land along the rear prop erty line (on Town land) will be constructed of a g ravel base and topped with grass. Ms. Benson read Directives into record. The Applicant shall be accountable for all notation s in the original Approval, received and filed with the Lunenburg Town Clerk January 31, 2007, except items re-addressed in the Modification Plan, dated September 28, 2006, revise d through May 28, 2009, and received in the Planning Office June 2, 2 009. Mr. Hannigan noted revision date of June 24, 2009, and received in Planning Office June 25, 2009 via most current plan submitted to the office. Dates to be changed. Mr. Bakaysa asked for a Motion to approve Findings and Directives with corrections. Motion, Mr. Saiia , Second, Mr. Bodkin, all aye. Attorney Bobrowski inquired if Cross Easement, Oper ating Agreement, and Maintenance Agreement would be a prerequisite to occupancy. Ms. Benson noted yes. Hearing closed at 8:50 PM.
