PLANNING DIRECTOR’S REPORTS/NEW BUSINESS: 198 Summer Street- Director presented Applications for a Special Perm it and Development Plan Review for a new use at 198 Summer Street. The Applications were presented at this meeting. The Applicant is United Solutions, pr incipal, Edward Zephir. The company is purchasing the land and structures f rom Dietrich Associates. United is located in Leom inster, MA, Sardis, Mississippi, and Gilbert, Arizona and is a supplier of plastic house wares. The Leominster site will t ransport plastic pellets to the property by rail car. The pellets will be stored in the cars until transported to the manufacturing fa cilities. The product, when manufactured, will be returned to the Lunenburg bui lding site to be stored and distributed to United’s customers. The Company’s short- and long- range plans are to assemble and pa ckage finished plastic products on the property for distribution to its customers. Within five years, United will perform injection molding at the property. Storage silos w ill be needed at that time. United will also be looking to present a building p lan for additional space. Presently the operation will need to run 24 hours/day, 7 days/week. Director reported on a preliminary te ch meeting as noted for information at Applicant’s request. Discussion was on permits needed; especially fire permits, traffic concerns, sewer allocation, parking, etc. ===PAGE 2=== minutes 1-25-10 page 2 Ethics Commission- Director noted third correspondence from Kopelman & Paige Attorney Brian Riley clarifying the issue of designation of the position as Special Municipal Em ployee instead of a particular individual. Clarifi cation was also given regarding the 800 hour requirement, which is not an accumulation of all reviews, but for individual re views. The question regarding allowing the peer reviewer to present to the Planning Board, the Attorney states, “while a c onsulting engineer is serving as a peer review consultant to the Planning Board, a partner from his or her firm may appear a nd represent a client before the Planning Board, but only if that particu lar matter will not be acted upon in any way by the consultant. The consultant may not review or comment on his partner’s project, evaluate any plans, etc”. Complete correspondence on file in Planning Office. A Select Board member present at the meeti ng noted she was uncomfortable with the Town Attorn ey’s response to the issue and requested input from Planning Board membe rs. Copies of Attorney Riley’s three letters will be sent via electronic mail to the members. Director noted that the Special Mu nicipal Employee is a Select Board appointment. Green Community Task Force- Director reported that a meeting was held with Fe lipe Schwarz, Grant Consultant appointed by the State to assist the Town in becoming a “Green C ommunity” under the criteria set forth by the State . The issue is mainly the Stretch Code, which will be discussed at the next m eeting. DEVELOPMENT STATUS REPORTS: Emerald Place at Lake Whalom- Progress reports show the following: December- r ip rap construction entrance, grubbing and stockpiling of stumps, fuel containment area constr ucted, construction of temporary sedimentation basi ns; beginning January- continued stripping and stockpiling of loam at Road way “A” and “P” Access Road, stump grinding, commen cement of roadway fills (weather permitting); mid-January- stripping and stockpiling loam at building footprint areas, c ommence exporting excess topsoil and subsoil. Overburden will be removed. Tri Party Account has been set up. Unit numbering is being prepared by the Building Department Stone Farm- Progress reports indicate continuing work on unfini shed units. Tri Town Landing- Great Bridges is finalizing paperwork and closings with Department of Housing and Community Development (DHCD). Questions posed regarding the proposed fire road behind the buildings as a mitiga tion measure and requested by the Fire Chief. The question of easem ents arose. Research noted that since it is Town-o wned property, and will remain Town-owned property accessible only by the D epartment of Public Works (DPW), and Fire and Polic e Departments, only a license to construct will be necessary. It was f urther noted that as this proposal is in Phase 3 of the project, construction of a fire road will not be initiated until that time. ( Noted on plan is wording “proposed easement”- this can be corrected if found a concern.) Presently the Planning Board has no know ledge of the developer for Phase 3. Question also posed concerning water; Fitchburg will be the supplier through the Town of Lunenburg Water Department (letter on file). Bakaysa, Joanna L. Bilotta, Th omas W. Bodkin Jr., Robert J. Saiia, Nathan J. Lock wood, Marion M. Benson Chair opened the Public Hearing with reading of the legal advertisement published in the Sentinel & En terprise 2/8/10 and 2/15/10. The Hearing was to hear and discuss a Spe cial Permit under Section 4.7. and a Development Pl an Review under Section 8.4. of the Protective Bylaw of the Town of Lunenburg for 198 Summer Street (Map 117, Parcel 34) for new use of storage, distribution and manufacture of plastic pr oducts. Owner is Dietrich Industries, Inc., 200 Ol d Wilson Bridge Road, Columbus, OH 43085. Applicant is United Comb & Nov elty Corp., P.O. Box 358, 33 Patriot Circle, Leomin ster, MA 01453. Presenting for the Applicant was Patrick Slattery, Patrick Slattery Architects. Mr. Slattery gave a b rief history of the site, noting that a Special Permit was issued for Dietrich Indus tries to occupy the building in 1992 for the manufa cture of metal frames, which subsequently lasted about 15 years. Mr. Slattery w as involved in all building upgrades as the archite ct for Dietrich, and therefore, knows the building well. The Planning B oard was previously approached by Mr. Slattery and Brian Milisci of Whitman and Bingham for possible building expansion at the rear, which was approved by the Board. Mr. Milisci oversaw work related to the detention pond, drainage sites, etc. The curre nt building simply needs a new tenant. Building co nsists of an office area, large open warehouse area, potential for possible a ddition and possible potential for United to having molding machines and on- site manufacturing. Truck slots that Dietrich used will be in-filled. Existing loading dock will rem ain. Truck scale remains. Current building size is 65,800 square feet. Build ing has sewer. United plans to currently use the p roperty for enclosed storage and distribution of plastic products, with possible manufacturing at a future date. Edward Zephir, President, United Solutions, noted w hen his father started the business in 1919 it was originally United Comb & Novelty Corp.. The business has progressed from co mbs, novelties, etc., to plastic house wares. The product is manufactured in Leominster, MA, Mississippi, and Arizona. Plast ic pellets will be transported to the Lunenburg sit e by rail car, and then loaded onto trucks for distribution to other United facili ties. The finished plastic products will be stored in the building and transported to United’s customers. Mr. Zephir would like to add m achinery in approximately five (5) years. At the o nset, there will be fifteen (15) persons doing forklifts and loading of trucks. There will be regular truck traffic to unload the rail cars. The site comprises 11 acres so there is the possibility for future expans ion. Mr. Saiia inquired as to any hazardous waste. Mr. Zephir responded that the only permit he will need from Lunenburg is for storage of the propane tanks that are used to fuel the forklifts. The plastic is FDA approved. Mr. S lattery noted that all the machines are self-contained with no outflow to the sewer system. Sewer Commission has inquired as to a wastewater plan. Mr. Zephir noted that major use will be individuals usi ng bathrooms. Water system is closed-loop. ===PAGE 2=== Minutes, Public Hearing, United Solutions February 22, 2010 Page 2 Planning Director read Findings into record. 1. Ross Associates; Eme rick R. Bakaysa, Planning Board Chair; Joanna L. Bi lotta, Thomas W. Bodkin Jr., Nathan J. Lockwood, and Marion M. Benso n, Planning Director. Member Robert J. Saiia was a bsent. Attorney Tillotson introduced the Plan, noting it s howed nine separate subdivisions under 25 acres. N oted was that these subdivisions were phases with the following acreage and number of lots: Phase # Acreage # of Lots 1 24.2± 21 2 13.9± 13 3 24.9± 20 4 24.9± 21 5 24.3± 22 6 20.4± 9 7 24.6± 17 8 10.5± 6 9 22.7± 2 Designing Engineer Mr. Milisci explained each phase and how it would blend into the overall developmen t of 189 acres. Noted were temporary cul-de-sacs that would disappear as the next phase was built. The end result would be a project of 131 units on 40,000 square foot lots with two entrances off Howa rd Street. A concept of a well water supply was sh own on Phase 9 to supply the water for the project and could be extended to tie in with the Lunenburg’s Water District water li ne 2 ½ miles away. Mr. O’Brien noted each phase would take 1 ½ - 2 years t o complete. Comments from the Planning Board included disappoi ntment, noting the project was the same with no ope n space or recreational facilities with 20-acre phases and pla ns for four-bedroom homes. Noted also was lack of attention to rural area roadway impact and questioned no alternative plan, including common septic and cluster design. Town Hall, 17 Main Street, Lunenburg, MA 014 62 Time: following Public Hearing Continuation ROLL CALL: Emerick R. Bakaysa, Nathan J. Lockwood, Joanna L . Bilotta, Thomas W. Bodkin Jr., Robert J. Saiia, M arion M. Benson PUBLIC HEARING (cont’d), Emerald Place at Lake Whal om- See separate minutes. Chair called general session to order at 8:05 PM. Chair called for discussion by Board members on the Modification request for Emerald Place at Lake Wha lom. Chair stated from his perspective, the Modification was in compliance and the Planning Board should mo ve forward with approval. Mr. Bodkin quoted Section 4.12.1.1. of the bylaw wh ich states the purpose of the Lake Whalom Overlay D istrict. He was not trying to rekindle controversy, but felt that movin g units from Parcel B to Parcel A would impact traf fic. Also, the property history has not been taken into consideration other than in the street names. The original plan called for a clubhouse on the lakefront, instead, now there will be 12 units. From a histor ical perspective, the clubhouse is the last referen ce point. The decision the Board makes tonight will have a lasting effect on t he shoreline. Future traffic density is unknown; n ot knowing what will be placed on the commercial parcel. Mr. Bodkin Jr. en couraged the Board members not to approve the Modif ication. Mr. Saiia questioned Mr. Bodkin Jr. if he felt traf fic impact would be more than when amusement park w as open. Mr. Bodkin Jr. felt the Board should stay with the original approv ed plan. Chair disagreed. The only way the traffic was an i mpact, was that it would take a different route. D ensity would not change. He reminded the Board the Lunenburg citizens had not w anted a large building on Parcel B. The developer has relocated units from Parcel B to Parcels A and C. Mr. Lockwood felt the engineering changes were posi tive. He agrees with Mr. Bodkin Jr. that developme nt of the commercial parcel will probably bring a net increase in traffi c, but will be subject to a traffic study at the ti me of development. The developer shouldn’t be penalized for lack of historical chara cter, i.e., clubhouse, after the developer has made substantial investment in the property. . Chair noted the 2006 Findings noted kiosks or other memorabilia associated with the Park located withi n the development or along the lakefront. There is also, adjacent to Pa rcel B, a vacant parcel in Leominster. He would pr efer to see the Lunenburg parcel developed to benefit the tax base and the ci tizens of Lunenburg, vs. development of the Leomins ter parcel which Lunenburg will have no control over. Mr. Bodkin Jr. feels the Board has a chance to guid e the process the correct way and needs to envision 15 years from now. He thinks 12 villas are shortsighted in terms of the o verall project. He also inquired as to status of j oint Planning Board and Board of Selectmen meeting relative to the waterfront. Chai r responded that is under Board of Selectmen jurisd iction. ===PAGE 2=== Minutes, 8-9-10 Page 2 Ms. Bilotta thanked the developer for the 2% purcha se price discount that will be offered to returning veterans and those purchasing the over 55 units. She was in agreement with Mr. Bodkin Jr. in preferring a clubhouse inst ead of villas, but also felt that, legally, Mr. Bodkin Jr. may not be correct in disapproving the Modification based on the criteri a he voiced. Mr. Bodkin Jr. thought it would be beneficial for h im to view a rendering. Mr. Crossen responded that the villa height was lower than a clubhouse. The developer has tried to incor porate feedback from every level; the Pierce Avenue constituency, acquiring the Newman parcel, and lowering of the 55 foot heig ht of garden-style units. Chair made Motion to approve the Modification as su bmitted. Second, Mr. Saiia. Roll Call Vote- Mr. B odkin Jr., nay, Ms. Bilotta, aye, Mr. Lockwood, aye, Mr. Saiia, aye, Mr. Bakaysa , aye.
