Board members had hoped to see a proposal of the direction the Applicant was moving toward s. It was noted that this evening’s continuation was in anticipation of the Applicant bringing forth possible concept ual layouts . Motion, D. Prokowiew, to a ccept extension request to Januar y 23, 2017, Second, G. Bittner, Discussion- Board members voiced frustration with the time that has lapsed with this project and asked A. Burney what is a reasonable timeframe to allow projects to continue. A. Burney responded that is usually dependent on the project and the time needed to move through iterations and f inalize a design. Six months or longer is not unreasonable if there are concept changes; all aye. MINUTES APPROVAL, 9/26/16- Minutes signed. Motion, D. McQuaid, Second, K. No articles submitted by the Planning Board. Public Records Law, 11.10.16 Information Session -November 10, 2016 information session presented by KP Law. A. Burney and M. Boggio will attend. 200 Reservoir Road, Ch. 61B - Property owner requesting removal of recreational use (Ch apter 61B) for land located at 200 Reservoir Road. Board endorsed a five -lot ANR Plan on July 25, 2016. There are no purchase offers at this time. The property owner’s intent is to convert the land to residential zoning and offer the lots for sale. If interested, the Town would have to hire an appraiser to determine the monetary value to use as a basis for the Town’s purchase. The land is located adjacent to land owned by the Water District and is also in front of the Sportsman’s Club. K. Chenis inquired if any of the property is currently being used for recreation . He is also aware of nume rous trails in that area, but unsure if they are located on this specific property. G. Bittner noted the Conservation Commission’s recommendation to the Select Board is not to pursue the purchase of this property. Board consensus was to get the input of the Open Space Ad Hoc Committee before formulating its response to the Select Board. Complete Streets Program- VHB (Vanasse Hangen Brustlin Inc.) and the DPW Director were in front of the Select Board for a Complete Streets program discussion to see if the Town should consider adopting a Complete Streets Policy . If the Town intends to pursue, the Planning Board would need to review its Rules and Regulations for the Subdivision of Land to ensure the design elements are in agreement with the policy. There w as discussion as to whether or not the policy would have to be adopted Town-wide or could it be individually by Zoning District . (It could be beneficial in the Village District.) Board members noted the possibility of creating a “sidewalk fund”, i.e., in lieu of a developer constructing sidewalks in a residential development, that money could be placed into a sidewalk fund for the Town to utilize. (No action is required by the Planning Board at this time. This was just for informational purposes.) 9 Electric Avenue, Zoning Board of Appeals Hearing - This property has been purchased by the owner of Asian Imperial who is seeking a Special Permit for construction of additional parking ad jacent to the existing restaurant. The owner also wish es to expand the front of the existing restaurant. If the Special Permit is granted by the Zoning Board of Appeals, the Applicant will then have to appear before the Planning Board. The Board was in support of the petition. ===PAGE 3=== Minutes 10.24.16 Page 3 MEETING SCHEDULE: November 14- November 28- Special Town meeting – no Board meeting December 12 December 26- Town Offices Closed – no Board meeting G. Bittner requested that the Board add one to two additional meetings approximately every other month due to no Board meetings on Monday holidays. Motion, K. Chenis that the Board adopt a quasi-policy that in the event of Monday holidays or other Monday events that cause the Board to skip a meeting, instead of cancelling the meeting, defer a week and postpone to the next Mo nday that the Board can meet, S econd, G. Bittner. Discussion ensued as to scheduling conflicts for various Board members. K. Chenis made an Amended Motion to be before or after where practicable, Second, G. Bittner, all aye. PUBLIC COMMENT: Citizen David Rodgers commented that he feels Town Boards/Commissions/Committees are looking over everyone’s shoulder and acting like “Big Brother”. BOARD COMMENT/CONCERNS: G. Bittner- Brought up changing speed limits (noting specifically by the Town Beach) u nder the Municipal Modernization Bill. A. Burney noted that this would require bill adoption by the Select Board. He also suggested G. Bittner talk to the police chief to see if this is reasonable or would be more problematic. D. McQuaid- In response to D. Rodgers’ comment above, n oted that he is in support of reusing existing facilities and that the Board is here to help the people. D. McQuaid- Noted a presentation at his workplace on pervious paving systems that can sometimes remove the need to have stormwater systems. A. Burney inquired about removal of contaminants. D. McQuaid responded that it is a layered system of crushed gravel, using the earth to filter. M. Allison- Noted CPTC presentation he attended on Writing Reasonable and Defensible Decisions. Lunenburg, MA 01462 David Prokowiew, Mbr. Adam R. Burney Land Use Director Minutes Public Hearing 1034, 1048 & 1054 Northfield Road October 24, 2016 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:52 PM Present: Matthew Allison, Damon McQuaid, Gregory Bittner, Kenneth Chenis, David Prokowiew, Adam R. Burney The Hearing was to hear an d discuss a request to create a stone wall entrance at 1048 and 1054 Northfield Road (Map 037, Parcel 0011), and to remove a shade tree at 1034 Northfield Road (Ma p 037, Parcel 0012), under M.G.L. Ch. 40, Section 15C, Scenic Road Designations and under M.G.L. Ch. 87, Section 3, Cutting of Public Shade Trees. These are the remaining three lots from a Board-endorsed ANR Plan in July 2016. Applicant Ronald Smith, 110 Old Farm Road, made the presentation. Lot 1 (1054 Northfield) trees are on the westerly side below the hill on Lot 5. There are no established trees in the jurisdiction of the scenic road. Only young scrub trees will be taken. The largest is probably of a six inch caliper. Lot 2 (1048 Northfield) has one singular tree R. Smith would like to remove . It sits a pproximately three feet off the road and probably has a 20” ( twenty inch ) caliper. The driveway will go in that basic proximity. There is a n open culver t where the property lines meet. R. Smith ’s partner has spoken with the DPW Director and the Applicant plans on making some improvements to the culvert. The structure under the ground will not be changed. Pipe will be put in to make it safe r. M. Allison inquired as to the potential of a common driveway for Lots 1 and 2. R. Smith noted that none of the current prope rty owners have any desire for a common drive. M. Allison noted the remains of a stone wall at Lots 1 and 2 . R . Smith responded all that is left there is the rubble base. He plans on rebuilding that stone wall and possibly forming a mouth of stone at least six feet back from both sides of any driveway to give it an entrance. Lot 3 (1042 Northfield) has a circa 50-60 year oak, located approximately five feet from a short steel rod. This steel rod denotes the property line between Lots 3 and 4 . R. Smith wishes to keep at least 30 feet between driveway s since they will not be shared. To avoid having a driveway in close proximity to a tree root mass of a circa 100 year maple on Lot 4, he would like to keep the drive closer to the property line. This requires the removal of the noted oak tree (located off of the right of way) on Lot 3. (The property owner of Lot 3 does not have an issue with removal of the noted oak.) If the oak is removed, this will lower the grade, and the 100-year maple would survive. Motion, K. Chenis, to close the Hearing, Second, D. McQuaid, all aye. Hearing closed 7:21 PM. COMMITTEE REPORTS: Stormwater Task Force - Met with individual who will be assisting in preparation of the MS4 permit and Notice of Intent. Capital Planning Committee- No report – Board representative not available. School Building Committee- Expected school completion in D ecember. MSBA (Massachusetts School Building Authority) will hold an audit once all invoices are received. Green Community Task Force (GCTF)- No report. MJTC- October 19th meeting held due to time-sensitive amendment for land purchase by December 1 st for the Twin Cities rail trail. As a result, budget changes have been made to the TIP (Transportation Improvement Program) . One of the discussion items was to push the Summer Street project out one year from FY2017 to FY2018. MRPC- No report. Open Space Ad Hoc Committee - Agenda was posted for discussion regarding 200 Reservoir Road, Ch. 61B. A quorum was not available for the posted meeting, so an informal discussion took place instead. The Committee felt that the property was viable only for the Water District as the Lunenburg Water District owns property directly abutting 200 Reservoir Road. The Water District Superintendent noted to A. Burney that the District did not see any real value to the Town purchasing the property. The subject parcel is also directly adjacent to the Lunenburg Sportsmen’s Club. Firearm regulations prohibit discharge 500 feet from an occupied dwelling and 150 feet for a travelled way. Consequently, some Board member s voiced concern with the possible shutdown of a long-term club if the property is taken out of Chapter and sold as residential lots, but that falls outside the Board’s area of consideration for ROFR. Motion, K. Chenis, to convey to the Board of Selectmen there is no impact on planning and land use in passing over the First Right, Second, D. Prokowiew, all aye. Definitions and Use Table - Drafts distributed to the Board. The Use Table contains what is currently in the prose of the Protective Bylaw of the Town of Lunenburg . The overlay districts will be added to the Use Table. G. Bittner requested Use Table be edited to note whether special permit is required by Planning Board or Zoning Board of Appeals. K. Chenis provided A. Burney with a sample table from another commun ity. He also noted that the Board’s definitions should not be in conflict with the Commonwealth’s definitions. The Board had a lengthy discussion of Definitions Draft 2. There was discussion on whether or not to allow drive-through windows; possibly mak e it an accessory use allowed only in specific districts or have it permitted only by special permit. Have a definition for curb -side service? Two-Family Dwelling will exclude over/under as this is no longer allowed under the Building Code; must be side by side (A. Burney will verify with Building Official) . Multi-Family Dwelling will be edited as garden apartments are allowed over/under. A Mixed -Use Definition will be added. Town House will be capped at five dwelling units. The Building Official rec ommended that the detached option should be removed from Accessory Dwelling as this then creates two separate dwellings. K. Chenis opposed this as it then means you cannot have an in -law apartment over a detached garage. K. Chenis opined that Educational Use precluded vocational schools – A. Burney to check. Add mental health services into Hospital. Public Utility – add in licensing by the DPU. A separate definition will be created for movie theaters. Minor edits will be made to Private Club and Private Camp. The definition of Agriculture was taken from the Town’s Right-to-Farm Bylaw. There was discussion as to the possible inclusion of maple sugaring. A. Burney will check. Veterinary Hospital will be broadened for “prevention of animal health cond itions” instead of “prevention of animal diseases” and type of animals will be expanded. Veterinary Hospital will also be divided into small and large. A more in depth look will be taken into Restaurant and Restaurant, Carry -Out. A definition will be cr eated for establishments where individuals pay for services/training, e.g., karate studio. Drive-Through Window will be changed to Drive -Through Service and will specify individual remaining in the vehicle. A. Burney will compare the Commonwealth’s defin ition of Bed and Breakfast to see how it compares with the Town’s definition. Gasoline Service Station will be changed to Fuel Service Station. Vehicle detailing will be added into Car Wash. Repair Shop will be edited to delete “household, rather than b usinesses”. Industrial Parks will be edited to specify “two or more separate lots or industrial buildings ” in place of “two or more separate industrial buildings”. Distribution – change “distribution” to “shipment or movement”. Public Records Law, Info rmation Session- A. Burney and M. Boggio attended November 10 th Information Session presented by KP Law.
