Prokowiew suggested that the Protective Bylaw Definitions contain both lot and parcel.  G. Bittner noted that Town Counsel and A. Burney have different interpretations of the Lake Whalom Overlay District. A. Burney responded that Town Counsel is working on an opinion letter regarding the dens ity issue for the January 23 rd Hearing Continuation for a proposed project within that Overlay. He went on to note that if the Board is looking for a decision, it should be requested by the Board and not an individual member.  G. Bittner noted there was discussion of a Complete Streets workshop at a Select Board meeting. A. Burney added that the Select Board is planning a workshop on the Pavement Management Program which will also include the Complete Streets Program, stormwater management, etc . Once the new Town Manager is on board, that will move forward. P. Bertram noted that under the Unified Work Program, MPO is willing to work with Lunenburg.  G. Bittner opined it would be beneficial to the Board to have pending items listed on future agendas.  G. B ittner wanted to make the Board aware that one of the agenda items for the Select Board January 10 th meeting is marijuana cultivation. Kenneth Chenis, Mbr. David Prokowiew, Mbr. 15* Tel: (978) 582-4147 Fax: (978) 582-4353 960 Massachusetts Avenue Lunenburg, MA 01462 Adam R. Burney Land Use Director Minutes Public Hearing Asian Imperial, 5 Electric Avenue January 9, 2017 Meeting Posted: Yes Time: 6:30 PM Place: Town Hall, 17 Main Street, Lunenburg, MA 01462 Present: Matthew Allison, Chair, Damon McQuaid, Vice Chair, Gregory Bittner, Kenneth Chenis, David Prokowiew, Adam R. Burney The hearing opened at 7:32 PM with the reading of the legal notice published in the Sentinel & Enterprise December 26, 2016 and January 2, 2017. The Public Hearing was to hear and discuss an application for Site Plan Approval under Section 8.4. of the Protective Bylaw of the Town of Lunenburg for construction of a parking lot at 9 Electric Avenue (Map 074, Parcel 0009) and a building addition at Asian Imperial Restaurant, 5 Electric Avenue (Map 074, Parcel 0008). Senior Project Manager Robert Oliva, David E. Ross Associates, inc. represented the Applicant- Min Xu, d/b/a Asian Imperial. Also in attendance was Pete Pelletier who will be the general contractor for the project. The owner has purchased the property at 9 Electric Avenue for the purpose of constructing additional parking for the restaurant. The two lots combined will be approximately 41,000 - 42,000 sq. ft. There are currently thirty-three (33) parking spaces. The restaurant has thirty (30) tables and sixteen (16) places at the bar. The existing driveways at 5 Electric Avenue will be maintained. The house at 9 Electric Avenue has been demolished. The proposed new parking lot will have a driveway connecting to the existing driveway at 5 Electric at both the rear and the front of the lot. After reconfiguration there will be a total of fifty (50) parking spaces. On November 22, 2016, the Zoning Board of Appeals granted a Special Permit for a dimensional variation for parking setbacks. (The plan presented to the Zoning Board of Appeas was for fifty-two (52) spaces.) As a result of the proposed expansion to the front of the restaurant, the parking in front of the restaurant will be regraded for accessibility. The handicap parking will be moved from in front of the restaurant to across the parking lot. Currently there is an underground detention system which connects to the system in the street. An additional underground system is proposed under the new parking lot which will connect to the street. Lights are proposed at the two islands leading into the new parking lot. There is an existing wall between 5 and 9 Electric Avenue which will be modified and a wood guard rail placed on top. A wall is proposed at the back corner of the new parking lot starting at approximately seven (7') feet dropping off with grade towards the front of the lot. Landscaping is shown on the plan. There is no walkway from the upper to the lower parking. K. Chenis is concerned with vehicles entering the site and pedestrians walking from the upper parking lot down to the restaurant.. Applicant to look at options. There is no information available yet on the floor plan of the building addition; possibly add six (6) tables and ten (10) seats at the bar. With thirty-six (36) tables and twenty-six (26) counter seats, forty-nine (49) parking spaces are required. Currently proposed are fifty (50), but possibly one (1) may be lost for pedestrian access. At this time, no spaces have been designated pick-up only. G. Bittner would like to see a complete proposal to include parking and seating. He is concerned with individuals parking where it is not allowed and would like to see something done to make those areas unattractive for parking. Applicant to look at. Applicant to file a Notice of Intent with the Conservation Commission. Trees will have to be provided in the parking lot per Protective Bylaw, Section 6.4.3.e)9.a. D. Prokowiew would like an elevation drawing of ===PAGE 2=== Minutes Asian Imperial Electric Avenue 01.09.17 Page 2 the building front. The applicant has been holding off on getting too involved with the building, instead concentrating on the parking. K. Chenis is concerned that with a proposed addition to the building, there still won't be enough parking. In David Ross Associates Inc. response letter dated January 9, 2017, R. Oliva responded to Graves Engineering Inc. review letter dated January 3, 2017. Issues brought forth as follows: 1. Tree specifics will be added to the revised plans. Building Commissioner letter dated January 3, 2017 also notes that the number of trees does not comply with the Protective Bylaw Section 6.4.3.e. (9). 2. Two bicycle spaces will be added to the revised plans. 3. Future discussion as to whether or not the applicant shall be required to submit a photometric plan as the site abuts residential property. Two (2) pole mounted fixtures are proposed in a central location of the parking area and will comply with Protective Bylaw Section 8.4.5.1.k. 4. Add surveyor's stamp to Sheet 2. As a 40- vs. a 20- scale plan was done, all buildings within two hundred (200) feet of the site were not shown. Revised plan will include a smaller scale detail to show all buildings within 200'. 6. All driveways within three hundred (300') feet of the site were not shown. If required by the Board, a smaller detail can be provided. 7. All existing trees six (6') feet (typo - should be six inches) in diameter and four (4) feet above ground not shown. Applicant will request waiver. 8. Handicap accessibility needs to be addressed. 9. Underground detention system does not meet the required two-foot offset to ground water. Applicant is unable to meet the offset given site grading for the proposed parking lot. The detention system will be revised to include a closed system using solid wall pipe or some other system to prevent infiltration. Applicant unable to meet recharge for the site. There will be further discussion regarding the increase of volume runoff. 10. Stormwater Checklist must be stamped and signed. 11. Revised plan will include a fence along the top of the wall where its height is in excess of four (4) feet. 12. Applicant needs to file with the Conservation Commission. In response to the Building Commissioner's letter of January 3, 2017, the applicant will look at the safety of the restaurant entrance in regards to patrons and vehicles due to the distance of only twenty-four (24) feet between the end of the parking space and the building. Plantings will be provided between the proposed parking lot and the abutter for screening from vehicle lights. The applicant requested a waiver from a photometric plan. G. Bitter would like to see some parking dedicated for take-out only. Public comment: Alan Graham, Electric Electric Avenue-Supports the project. His only concern is with the noise and shielding of the lighting onto his property. R. Oliva noted that the fence between the proposed parking and the abutter will run approximately one-half the distance along the property line. Arborvitae is also proposed to be planted. Paula Bertram, 312 Townsend Harbor Road- Concerned with stormwater and groundwater recharge. She opined the applicant needs to look at permeable pavement. She is also concerned with the handicap accessibility from the upper lot if the two lower designated spaces are occupied. R. Oliva noted handicap parking will be to code and that there is still the lower lot, which may have an available space. He has discussed recharge options with Graves Engineering Inc. A compromise may be adding an additional level of treatment to the stormwater system. Summarization was provided to the applicant and Board as to action items- issue of recharge, drainage, interior layout and use of restaurant addition, landscaping, and pedestrian access from the upper parking lot to the restaurant. R. Oliva requested the hearing be continued to the February 130 Board meeting in order to work on above issues. K. Chenis wants a mitigation system so the recharge can be utilized and also meet the two (2) foot offset. R. Oliva proposed various types of units, e.g. stormceptor, vortecnic, etc. ===PAGE 3=== Minutes Asian Imperial Electric Avenue 01.09.17 Page 3 Peer Review Consultant Jeff Walsh, Graves Engineering Inc., noted there is no protocol by DEP to replace the two (2) foot offset, e.g., no additional treatment. In theory, for this project not having a form of groundwater recharge, the best management practice would be a filtering mechanism, but that requires vertical elevation. The Applicant will appear before the Conservation Commission as there will be some minor work within the 100 foot buffer zone. P. Bertram- Questioned if the stormwater standards could still be met if some of the parking spaces were eliminated, yet still maintain those required for the restaurant. R. Oliva responded that he graded the two drives going into the upper parking as low as possible. The only way to meet the offset would be to raise the parking lot. He will come up with the best compromise possible. Even without the restaurant addition, the parking is still needed. M. Allison commented that the dimensional requirement chart on page 3 of the site plan does not note lot coverage. R. Oliva to look at. K. Chenis noted that if a larger green area was created in the upper parking and no restaurant expansion was allowed, this could possibly help mitigate the water issue. R. Oliva responded the offset issue would still exist. R. Oliva will look at. K. Chenis, Motion to continue Hearing to February 13th, Second, D. McQuaid, G. Bittner discussion to include list of items- continued discussion with abutters to address concerns, stormwater discussion, take-out parking spaces, encouragement of traffic flow, more information on addition in regards to seating. Kenneth Chenis, Mbr. David Prokowiew, Mbr. THENBURO MAST 118 AICORPORATED Tel: (978) 582-4147 Fax: (978) 582-4353 960 Massachusetts Avenue Lunenburg, MA 01462 Adam R. Burney Land Use Director Minutes Public Hearing 691 Chase Road January 9, 2017 Meeting Posted: Yes Time: 6:30 PM Place: Town Hall, 17 Main Street, Lunenburg, MA 01462 Present: Matthew Allison, Chair, Damon McQuaid, Vice Chair, Gregory Bittner, Kenneth Chenis, David Prokowiew, Adam R. Burney The hearing opened at 6:37 PM with the reading of the legal notice published in the Sentinel & Enterprise December 26, 2016 and January 2, 2017. The Public Hearing was to hear and discuss an application for Site Plan Approval under Section 8.4. of the Protective Bylaw of the Town of Lunenburg for construction and operation of two street hockey rinks at 691 Chase Road (Map 021, Parcel 0003). Applicant, Richard Breau made his presentation. His desire is to install two street hockey rinks in two phases. The first immediately with a three-sided building approved by the Board of Health and a parking lot. In the fall he would install lights and then install the second rink either next spring or summer. He is asking for the following waivers: Drainage Calculations Impact Reports Traffic Stormwater Fiscal Environmental Community Plan Stamped by PE 40 Scale Plan Zoning Table Parking Plan Proposed Facilities Tree Information Traffic Information Limit of Work Photometric Plan Locus Plan - Existing Plan - Erosion Plan ===PAGE 2=== Minutes 691 Chase Road 01.09.17 Page 2 Many of the above waivers are being requested for financial reasons as he and his wife are financing this project personally. By doing so, he can keep fees down. He plans on doing clinics with children, getting involved with the ice hockey team, and holding leagues. Leagues will range from children age four (4) to age sixteen years plus (16+). He would also do adult, co-ed, and women's leagues. G. Bittner noted the design submitted to the Planning Board is slightly different than that presented to the Zoning Board of Appeals. R. Breau responded it was redesigned so there is nothing in the wetlands or buffer zone. The boards are four (4) feet high, with a twelve (12') foot fence around the back. The three (3) handicap parking spaces (near the three-sided building) will be paved and painted. A. Burney noted there will have to be accessible pathways through the site. R. Breau will do 3-4 foot wide pathways. D. Prokowiew inquired if everything will flow towards Chase Road. The rinks are slightly pitched toward both sides. Rinks are processed gravel, then 3-4 inch tar asphalt base, then a plastic deck mat. Thirty-six (36) parking spaces are proposed. D. Prokowiew inquired if the parking could be expanded. R. Breau noted that teams consist of ten (10) children so there would be fifteen-twenty (15-20) vehicles per rink. He went on to say that many parents drop their children off and then come back later to pick them up. Games would start at approximately 6:00 PM during the week. Weekends would be approximately 9:00 AM - 5:00 PM. The Zoning Board of Appeals approved the Modification of a Special Permit for operating hours of Monday - Friday, 3:00 PM - 10:00 PM and Saturday and Sunday, 7:30 AM - 9:00 PM. Light shutoff time would be by 10:15 PM after the 9:00-10:00 PM game. (G. Bittner thought that the Zoning Board of Appeals hours of operation for Saturday and Sunday were 7:30 AM - 8:00 PM.) D. Prokowiew was concerned with lighting being a nuisance to residents across the street on Windermere Drive. R. Breau responded that once he is ready to install lights a representative from the light company will come out to the site to advise him. The lights will be directed towards the rinks with shielding. He has been quoted 400 watt lights at 20-22 candlelight. The light company will test the lights at the Leominster rink, and if that is determined to be sufficient, R. Breau will purchase the same wattage. As the Leominster rink is older and darker, he may decide to go up to 1,000 watt lights. A. Burney noted the proposed light located on the southwest side of the first rink lines up with Windermere Drive. That will need to be taken into account when the lights are designed so there will be no interference with the intersection with Chase Road.K. Chenis asked if any trees on the road side were being taken down. No. A. Burney noted that if the Board was concerned that the rink excavation would have the potential to cause silt flow, it could condition a hay bale line along the edge of excavation to ensure there is no siltation. D. Prokowiew referred to the Fire Chief's email which notes that ambulance access is tight. R. Breau will put in a spot for turnaround near the handicap parking and will probably eliminate three (3) spots near the first rink. The parking plan indicates 36 spaces. K. Chenis suggested the parking be redesigned with spaces located in the center, face to face, with the road circling the parking lot. This would provide ambulance access and eliminate the necessity for 3-point turns for drop offs. D. Prokowiew inquired as to how the boundary of the parking lot will be marked. R. Breau responded that he would probably have pillars in the middie and roped off. K. Chenis asked what will prevent gravel silt from running into Chase Road during a rainstorm. R. Breau responded that there will be a 30 ft. paved entrance (note: the plan indicates 40 ft.) with a crushed stone swale on the side to act as a French drain. The plan does not show any lights in the parking area. R. Breau noted there would probably be one spotlight on top of the three- sided building. Board responded that will be pretty far away from the parking lot. R. Breau responded that he tentatively plans on closing by 7 PM in the spring and everyone should be off the property before it gets dark. The Board would like to see this application altered to be a single phase one-rink project with a modified parking lot and that R. Breau return to the Board for a modification at the time of construction of the second rink and also any other design element changes. The current requested waivers remain. M. Allison asked about the dispersion of rainwater on the rinks. The rinks pitch two (2") inches side to side; water will flow into the grass and processed gravel. M. Allison suggested R. Breau ask Whitman & Bingham about gravel recharge along the sides. Board requested a landscape plan. ===PAGE 3=== Minutes 691 Chase Road 01.09.17 Page 3 G. Bittner inquired if R. Breau will want to erect a sign at the site entrance. A. Burney recommended R. Breau include that as part of this Site Plan Approval. A. Burney noted that when the parking lot is redesigned R. Breau needs to comply with the Protective Bylaw, Section 6.4.3.e)9.a. which states "On at least three sides of the perimeter of an outdoor parking lot containing 20 or more parking spaces, there must be at least one tree for every eight parking spaces abutting the perimeter; such trees must be spaced to that some part of a parking space is not more than 30 feet from the center line of a tree". It was noted that the Police Chief did a speed study and count and noted there was already a lot of traffic on Chase Road - 4,600+ cars in 24 hours on the southbound side only. There was no public comment. The hearing was summarized for the benefit of the Board and the applicant, providing specific comments for the applicant's action. Issues to address include adequate parking, parking lot traffic flow, showing paved areas (both ADA and walkways), putting anascaping on paper including trees for parking area, and putting the sign on paper. Parking lot lights will be included in Phase 2. R. Breau noted that he would probably put up the parking lot lights when he puts up the rink lights. For purposes of this iteration of the site plan, if approved by the Board it would be for the parking lot, rink, porta potty and pro shop, minus lighting. An entrance gate for security purposes will be annotated on the revised plan. He will contact the Fire Department regarding the type of lock so they will have access. The lighting and photometric plan would be part of the modification for the second rink. Per the Agent to the Board of Health "the existing well shown under the parking lot shall be discontinued - a permit from the Board of Health is required". In order to address concerns, R. Breau requested a continuance to the February 13, 2017 Board meeting. Motion, K. Chenis, Second, G. Bittner to continue Hearing to 6:35 PM, February 13, 2017. All aye. Hearing recessed 7:32 PM. Burney Absent: Kenneth Chenis (The hearing scheduled for February 13th was postponed to this date due to inclement weather.) D. Prokowiew disclosed to the Board that his family members are patients of Dr. Walker. The Public Hearing was to hear and discuss an application for Site Plan Approval under Section 8.4. of the P rotective Bylaw of the Town of Lunenburg for the creation of a sixteen-space parking lot at 119 Massachusetts Avenue (Map 076, Parcel 0047). The Applicant John Walker DMD/Walker Orthodontics was represented by Greg ory Roy, Ducharme & Dillis Civil Design Group, Inc. (DDCDG). There is an existing parking lot at the rear of the site (compliant with zoning) and the Applicant proposes to add an additional parking lot with 16 spaces at the front of the site due to internal traffic congesti on. The front of the site is Commercial zoning and the rear is Residence A. The existing septic system has been decommissioned as a connection to public sewer was made in the fall of 2016. The existing Massachusetts Avenue curb cut will be utilized. The parking area will have a handicap space. There is good sand and grav el for an underground infiltration system for the parking lot drainage. Landscaping details comply with the Protective Bylaw. A revised site plan was submitted on February 8 th in response to Graves Engineering, Inc. (GEI) review letter of February 3 rd. Upon reviewing the February 8 th submittal, GEI submitted a February 15 th review letter. Outstanding matters noted by GEI are : 1) DDCDG needs to revise the site’s screening alo ng the southwest property line to comply with Section 6.4.3.d. )3. of the P rotective Bylaw. DDCDG is requesting arborvitae instead of a board fence. There was Board discussion over screening the entire southwest property line or just th at portion of th e property line where the parking lot will be located. Board consensus was the Applicant screen the portion of the property line where the parking lot will be with non -deciduous plantings and, 2) the plans are to be prepared using both hori zontal and vertic al datum. G. Roy noted the plans were initially set up to correspond with the old septic plans so the Applicant is requesting the Board waive the requirement. The following waivers from Board Rules and Regulations for Site Plan Approval & Special Permits were requested. Section 4.1.f.2) – plan at a scale of 1”=40’ Section 4.1.f.2) – plan at North American Datum 1983 and North American Vertical Datum 1988 Section 4.1.h – Traffic, Transportation and Circulation Impact Report Section 4.1.h – Public Services and Fiscal Impacts Report Section 4.1.h – Environmental Impact Report ===PAGE 2=== Section 4.1.h – Community Impact Report Minutes 119 Massachusetts Avenue 02.27.17 Page 2 A full stormwater analysis was included in the application. M. Allison noted that the horizontal datum is important for entering data into the GIS. G. Roy will set up. Motion, D. McQuaid, that given the scale of the project, to accept the waivers, with the exception of the horizontal datum, Second, D. Prokowiew, discussion- none, all aye. Jill Normandin, 321 Electric Avenue – concerned with removing vegetation in residential/commercial neighborhoods. Will the large trees on the side of the road be removed? No, those trees are in the Commonwealth’s right-of-way. Motion, G. Bittner to close the Hearing, Second, D. McQuaid, all aye. Hearing closed 8:05 PM. Burney Absent: Kenneth Chenis (The continuations of this Hearing to January 23 and February 13, 2017 were postponed due to Board meeting cancellation s as a result of inclement weather. ) The Hearing is to hear and discuss applications for special permit under Section 4.12. Lake Whalom Overlay District and site plan approval under Section 8.4. of the Protective Bylaw of the Town of Lunenburg for a 22-unit townhouse development at 274 Prospect Street, Map 98, Parcel 10. The Applicant was represented by Wesley Flis, Whitman and Bingham Associates (WBA). WBA letter dated February 27, 2017, subject: Request to Withdraw Without Prejudice was presented to the Board. W. Flis noted there have been some documents from Town Counsel and the Building Commissioner submitted to the Planning Board since the last Hearing, and after reviewing those documents, the Applicant wants to withdraw his application. A. Burney added that the Applicant wants to assess their options for the site. The application is 38 days into the 90 day timeclock taking into account continuances from the original Hearing date of September 12, 2016. D. McQuaid had issues with a Withdrawal without Prejudice due to what the neighbors have been through ove r the past two years. W. Flis responded that the original letter from the Building Inspector is a lot different than the letter from Town Counsel and that if the Applicant had been aware of Town Counsel’s opinion earlier, they probably would not have subm itted for Site Plan Approval. A. Burney emphasized that this is not the same Applicant that submitted the previous application . This would be the third continuation on this application, but now the Applicant is asking to withdraw. This application was o riginally heard on September 12 th, continued to October 24 th, continued to January 23 rd but due to inclement weather and meeting cancellations, this has been the first time the Applicant has been back before the Board. Town Counsel’s opinion has not yet b een discussed by the Planning Board. Motion, D. McQuaid, to accept Withdrawal without Prejudice, Second, G. Bittner, discussion - G. Bittner recommended the Board not take action tonight as he feels the need to speak with Town Counsel, and to discuss the Withdrawal without Prejudice at the next Board meeting. D. Burney Absent: Kenneth Chenis (The continuation scheduled for February 13 th was postponed to this date due to inclement weather. ) The Public Hearing was to hear and discuss an application for Site Plan Approval under Section 8.4. of the Protective Bylaw of the Town of Lunenbur g for construction of a parking lot at 9 Electric Ave nue (Map 074, Parcel 0009) and a building addition at Asian Imperial Restaurant, 5 Electric Avenue (Map 074, Parcel 0008). Senior Project Manager Robert Oliva, David E. Ross Associates , Inc. represented the Applicant - Min Xu, d/b/a Asian Imperial . R. Oliva noted tonight was to be a continuation of the Hearing, but the Applicant is now submitting a request to Withdraw without Prejudice. ( David E. Ross Associates letter dated February 10, 2017 .) The Owner/Applicant wishes to reevaluate a course o f action with the property and may return to the Board with a revised plan at a future time. Discussion ensued. If the Applicant withdraws, the proposed upper parking lot cannot be used because it would not meet the parking requirements; the Applicant would have to take some kind of action to prevent parking in the upper lot. It was suggested that the Hearing remain open and the Applicant come in and have a discussion with the Board. R. Oliva noted that he could convey to the Applicant that the area will no longer be useable for parking, but G. Bittner was concerned as vehicles are already parking outside of the designated parking, individuals will continue to park cars in the upper lot. In reviewing the current application G. Bittner found deficiencies with the existing plan , e.g., restaurant seating, snow storage and landscaping. The upper lot will need to be stabilized through vegetation. A. Burney recommended that the Board take the withdrawal under advisement and ask th e Applicant to talk with the Board. At that time the Board could either accept the Withdrawal or modify it to an extension. D. McQuaid inquired if the Board accepts the Withdrawal, would the parking then become an enforcement issue with the Zoning Official as no approval was issued by the Board ? Yes. G. Bittner wants to work with the Applicant to address the issue and recommended continuing the Hearing for discussion with the Applicant to come to an agreeable plan . D. McQuaid opined that it would be strange to continue the Hearing as no work is being proposed. M. Allison brought up possibly waiving the fee if the Applicant return with another application, but G. Bittner opined that if that discussion takes places, it should be at the time of the new application. ===PAGE 2=== Minutes Asian Imperial Electric Avenue 02.27.17 Page 2 G. Bittner is concerned with the lighting now shining onto the abutting property with no buffer in place and also wants the Zoning Enforcement Officer made aware that the upper parking lot can no longer be used. A. Burney said that could be addressed outside a hearing. Motion, D. McQuaid, to accept the withdrawal without prejudice, but to notify the Zoning Enforcement Officer of Board concerns with the site being used as parking, in addition to some issues in the existing Special Permit such as seat count, snow storage, and landscaping, Second, G. Bittner , discussion- would the abutting site have to be stabilized? Yes. D. Prokowiew requested that a letter be sent to the Applicant noting the Board would like a discussion with her. The lighting situation also needs to be addressed. All aye. Hearing closed 7:04 PM. Document used: David E. Burney Land Use Director Minutes Public Hearing 274 Prospect Street (cont’d) March 13, 2017 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:38 PM Present: Matthew Allison, Damon McQuaid, Gregory Bittner, Kenneth Chenis, David Prokowiew, Adam R. Burney Also Present: Joel Bard, Town Counsel The Hearing was to hear and discuss applications for special permit under Section 4.12. Lake Whalom Overlay District and site plan approval under Section 8. 4. of the Protective Bylaw of the Town of Lunenburg for a 22-unit townhouse development at 274 Prospect Street, Map 98, Parcel 10. The Applicant was not represented. A Request to Withdraw Without Prejudice was presented to the Board at the February 27, 2017 Hearing continuation. A brief summarization of the project’s history was given. The Building Commissioner had previously submitted a letter to the Board noting that the Board had purview to approve the appropriate density for the site. At the request of the Applicant, the Building Commissioner issued a subsequent letter stating eight (8) units per acre were applicable to 274 Prospect Street. As a result of that letter, Board consensus was to petition August 2016 Special Town Meeting to remove th e Lake Whalom Overlay District; the Article did not pass. Following STM, Town Counsel submitted an opinion letter to the Planning Board refuting the opinion of the Building Commissioner and stated he did not feel the proposed site qualified for application under the LWOD. Before approving the Applicant’s request for Withdrawal Without Prejudice, the Board was seeking Town Counsel’s opinion that the Applicant is not eligible under the LWOD. Town Counsel opined there are no ten (10) acres parcels left in the LWOD; the Applicant is not eligible for a waiver as they don’t have ten (10) acres. He went on to note that ultimately it is up the Bo ard to interpret the LWOD Bylaw. The Board inquired as to what action should be taken if the Applicant reapplies. Town Counsel responded that the Board should accept and act on the application to avoid the risk of a constructive grant . During the hearing process, the Board could take a position and at that time deny the application as not qualifying under a special permit. Town Counsel noted that if the Board remains silent, it is deemed to be With Prejudice; then the Applicant will be under a two - year ban from bringing the same project back. If an application is submitted within those two years, it has to be materially different. If the Board accepts Withdrawal Without Prejudice, the Applicant can reapply at any time. Motion, D. McQuaid, to accept the Withdrawal Without Prejudice, Second, K. Chenis, all aye. Lot Monuments 5.2.1. No building permit shall be approved for a new dwelling unit until existing permanent or new permanent monuments, a minimum of thirty (30) inches in length, have been installed defining a lot A. Burney noted this is an old way of marking property and marking property is more GPS-based now. There was lengthy Board discussion on Section 6.2. with some Board members for retaining the Section and others for deleting the Section. K. Chenis agreed that this is not commonly done, but was looking for solid information that it is not done in other communities. M. Allison disagreed with repealing and opined that it is important for right-of-ways and property that may be deeded to the Town. D. McQuaid did not think retaining the Section was critical, but opined it should go to Town Meeting and let the citizens make that decision. G. Bitter opined retaining the Section could lessen property line issues in the future. Burney Absent: Matthew Allison The Hearing opened with the reading of the notice published in the Sentinel and Enterprise on April 10, 2017 and April 17, 2017. Article To see if the Town will vote to amend the Zoning Bylaw, to add Section 4.18 Temporary Moratorium on the Sale and Distribution of Recreational Marijuana, or take any action relative thereto. 4.18 4.18.1 Purpose: Temporary Moratorium on the Sale and Distribution of Recreational Marijuana. By vote at the State election on November 8, 2016, the voters of the Commonwealth approved a law regulating the cultivation, distribution, possession and use of marijuana for recreational purposes. The law provides that it is eftective on December 15, 2016 and the Cannabis Control Commission is currently required to issue regulations regarding implementation by March 15, 2018 (see Section 11 of Chapter 351 of the Acts of 2016). Currently under the Zoning Bylaw, Recreational Marijuana Establishments and Marijuana Retailers are not a permitted use in the Town and any regulations promulgated by the State Cannabis Control Commission are expected to provide guidance to the Town in regulating Recreational Marijuana Establishments and Marijuana Retailers. The regulation of Recreational Marijuana Establishments and Marijuana Retailers raise novel and complex legal, safety issues and the Town needs time to Recreational Marijuana Establishments and Marijuana Retailers and address such novel and complex issues, as well as to address the potential impact of the State regulations on local zoning and to undertake a planning process to consider amending the Zoning Bylaw regarding regulation of Recreational Marijuana Establishments and Marijuana Retailers and other uses related to the regulation of recreational marijuana. The Town intends to adopt a temporary moratorium on the use of land and structures in the Town for Recreational Marijuana Establishments and Marijuana Retailers so as to allow the Town sufficient time to engage in a planning process to address effects of such structures and uses in the Town and to adopt provisions of the Zoning Bylaw in a manner consistent with sound land use planning goals and objectives. ===PAGE 2=== Minutes, TM Warrant Article, 04.24.17 Page 2 4.18.2 Definitions. Burney Absent: Matthew Allison The Hearing opened with the reading of the legal notice published in the April 10 and April 17, 2017 editions of the Sentinel & Enterprise. The Hearing was to hear and discuss an application for Site Plan Approval under Section 8.4. of the Protective Bylaw of the Town of Lunenburg for construction of an office and garage for a municipal water supplier at 496 Massachusetts Avenue (Map 073, Parcel 0004). The Applicant, Lunenburg Water District, was represented by Anthony Cleaves, Whitman & Bingham Associates. The Water District currently has an office located off Rt. 13, but wishes to construct a new office and garage. The office will be 2,400 sq. ft. and the garage 6,000 sq. ft. The building will be oriented on the site such as to hide its size from Massachusetts Avenue. Individuals passing by on Massachusetts Avenue will see only the front of the office. The site is approximately 7 acres. A utility easement crosses the property on the west side and along the rear of the site. The site will be accessed with a new driveway from Massachusetts Avenue just west of the existing curb cut. There will be a total of 14 parking spaces located at the front and sides of the building. The building will be surrounded by pavement. The dumpster area is proposed on the west side. Fuel source will be propane; there will also be an emergency generator. Water will be municipal. Sewer service will be from an on- site sewage disposal system. To limit the use of catch basins and manholes, sheet flow on a majority of the site will be to grass swales, as well as catch basins, and a stormwater basin. Flow that is not captured by the infiltration basin due to elevations will go into a catch basin at the bottom of the driveway into a water quality unit piping into an area on the side of Massachusetts Avenue. Permits have been filed with MA DOT for tying in utilities and a curb cut. The Conservation Commission has issued an Order of Conditions as a portion of the project is within the 100-foot wetlands buffer. Septic plans have been submitted to Nashoba Board of Health. G. Bittner inquired if the existing culverts on the road are adequate, meanwhile noting that he is aware the Applicant is only responsible for what is on their site. A. Cleaves responded that with the stormwater components they will be putting in place, it will decrease the rate of runoff leaving the site and will not make the situation any worse. K. Chenis asked about the holding tank for the garage and where the water is going. As there is no municipal system to tie into and this is a garage with overhead doors, the plumbing code requires floor drains. The floor drains will go into a 1,500 gallon tight tank with floats and a high water alarm system. Peer review was done by Jeff Walsh, Graves Engineering Inc. A. Cleaves went through the review letter of April 14, 2017 (on file in the Planning Office) and verbally provided his responses. ===PAGE 2=== Minutes Public Hearing, 496 Massachusetts Avenue Page 2 #1-Parking calculations will be revised to be in accordance with the Protective Bylaw of the Town of Lunenburg. #3- Professional land surveyor stamp to be added to Sheet E1. #4- The plans indicate an assumed datum as existing conditions were done by another engineering firm prior to Whitman & Bingham's involvement. The Applicant is asking for a datum waiver; to re-survey will set the project back. It was noted by the Board that they had recently waived vertical datum for another project, but did not waive horizontal datum. #5 & #6-Applicant asking for a waiver from showing all buildings within 200 feet of the site's property lines and showing existing driveway openings within 300 feet of the site's property lines. Applicant brought forth the possibility of doing a separate plan just to show driveway locations. #9- Soil testing information will be submitted for the test pit located at the infiltration basin. #10- A four (4) foot deep wick drain within the infiltration basin is standard detail for Whitman & Bingham Associates. This will provide a connection during frozen conditions. J. Walsh noted that he understood the reasoning behind this request, but stated that the depth of the wick drain needed to be revised to satisfy the groundwater offset or clean sand could be used instead of stone in the wick drain. A. Cleaves will revise. #11- A. Cleaves will submit documentation to support the sizing of the Stormceptor unit. #12- Drainage Analysis and Checklist for Stormwater Report in the Stormwater Management Report will be stamped by a registered professional engineer. #13- The existing depression for stormwater passage that the Applicant plans to enlarge is too close to Massachusetts Avenue. The Applicant will relocate contours; the 98 contour was shown too close. #14- J. Walsh had concerns with low-clearance vehicles (e.g. lowbed semi-trailer) bottoming out upon entering the site due to the driveway's low point and then the rise. A. Cleaves noted that he had checked it out and there would be no problem. If there was a lowbed delivery, which rarely happens, it could park on the side of Massachusetts Avenue and be unloaded from there. Lowbed trailers are not part of the District's normal operation. #15- A north arrow needs to be added to some of the sheets/maps. #16- Location of existing and proposed trees lines will be provided. #17- Soil absorption system has been submitted to Nashoba Board of Health for review. K. Chenis inquired if there was a lighting plan. A. Cleaves noted that a waiver has been requested. Proposed light locations are shown on Plan Sheet P1. Most of the lights will be wall mounted. There will be two pole lights; one at the site rear and one where the access drive comes into the parking area. All outdoor lighting will be dark sky compliant. G. Bittner inquired if 14 parking spaces will be adequate even though that is more than required by the Bylaw. A. Cleaves responded there are 5 employees and 14 spaces will be more than enough. G. Bittner asked if there will be any signage on Massachusetts Avenue. Yes, 20 feet off the right of way. There are no sign specifics available at this time. Hours of operation will be 7:30 AM - 4:00 PM. Temporary stockpiling areas are for erosion control during construction. The following waivers were requested. Board Rules and Regulations for Site Plan Approval & Special Permits Section 4.1.f.2)- Plan scale of 1"=40'. A. Cleaves will add one zoom out page showing the surrounding area. K. Chenis, Motion to grant waiver with the inclusion of a single page that has a site overview showing the surrounding properties, Second, D. Prokowiew, all aye. Section 4.1.f.22)- Photometric Plan. K. Chenis, Motion to grant waiver based on Notes A and B on Plan Sheet P1 noting Board requirements, Second, G. Bittner, all aye. Section 4.1.h)- Impact Reports- Level of Service Analysis, Trip Generation, and Community Impacts. K. Chenis, Motion to waive Level of Service Analysis, Trip Generation, and Community Impacts, Second, D. Prokowiew, all aye. ===PAGE 3=== Minutes Public Hearing, 496 Massachusetts Avenue Page 3 There was discussion regarding the Applicant's request to waive the datum. Board consensus was that the NAVD 1988 vertical could be waived, but not the NAD 1983 horizontal. The Applicant will pick three control points for the horizontal datum. K. Chenis, Motion to waive requirement for vertical datum, Second, D. Prokowiew, all aye. Applicant will provide a plan showing buildings within 200 feet and existing driveway openings within 300 feet of the site's property lines as noted in review letter #5 and #6. A. Cleaves noted the plans showing the architectural elevations. D. McQuaid noted that lately the Board has been requesting prospective views from applicants, but as this project is off the road, he is not as concerned. A. Cleaves responded that the building orientation is such that the front of the office is what people will see from the street, not the garage. A design for the proposed radio antenna will have to be submitted. Protective Bylaw of the Town of Lunenburg, Subsection 5.3.1.3. specifies a maximum height of 55 feet. The Applicant will confer with the Fire Chief and then request the maximum height they anticipate. G. Bitiner would like to know the type/kind of trees that will be provided and would also like to see more landscaping. A. Cleaves felt that due to the building's distance from Massachusetts Avenue, the landscaping was adequate. Motion, G. Bittner to continue Hearing to May 8, 2017, 6:30 PM, Town Hall, Second, D. Prokowiew, all aye.
