Burney APPOINTMENT TO OPEN SPACE AD HOC COMMITTEE: One completed Talent Bank Form for the vacancy was received in the office and forwarded to the Open Space Committee for review/vote. The Open Space Committee was also meeting this evening, but did not have a quorum and was unable to take a vote on the vacancy. Discussion tabled awaiting the arrival of G. Bittner. EARTH REMOVAL: Members were in receipt of Draft #1. The Board of S electmen has placed this topic on their August 6 th agenda; the Board discuss ed attending the August 6 th Select Board meeting. P. Bertram had concerns with the impact to existing businesses if earth removal/fill is prohibited on weekends. She would also l ike input from the Board of Health regarding groundwater analysis. M. Allison requested bot h the Bylaw and the Rules and Regulations be reviewed by the Board of Health. R. Lisio felt limiting weekend hours would be appropriate if the operations are takin g place in a residential area. Continued discussion took place and revisions will be made to Draft #1. With the presence of G. Bittner, the Board resumed discussion of the Open Space vacancy. G. Bittner made Motion for P. Bertram to be appointed to the Open Space Committee as an At-Large member, R. Lisio Seconded, all aye. MASTER PLAN: Board members viewed goals of the 2002 Master Plan. A. Burney noted the Visioning Process and Planning Goals from the 2002 Master Plan were based on recommendations fro m the late 1980’s - early 1990’s. He suggested that the Board, instead of implementing those goals, hold a visioning session with focus on implementing what comes out of a new master plan. There was discussion on assimilating the new Open Space and Recr eation Plan into the master plan as Element V, Open Space and Recreation, Natural and Cultural . P. Bertram questioned if the Economic Development Element prepared by MRPC in 2013 should be updated. There was Board discussion on what should be included in the RFP (Request For Proposal) for consultant tasks. T. Cole felt the RFP should not be finalized until the Board knows if it will receive the $50,000 grant. P. Bertram felt that an RFP should be put together with the expectation of having the full $100 ,000, and then have a works hop to review the RFP. A. Burney proposed the formation of a master plan committee, which could then transition into an implementation committee of the master plan. MASTER PLAN, Request for Proposal- See “Master Plan” above MINUTES APPROVAL , 0 7/08/19: G. Bittner made Motion to app rove, T. Cole Seconded, vote passed 4 -0, P. Boggio Administrative Assistant Minutes August 26, 2019 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:30 PM Present: Matthew Allison, Tanner Cole, Paula Bertram, Adam R. Burney Absent: Gregory Bittner ANR Plan: 190 Electric Avenue - Plan presented by Daniel Ruiz, Capital Group Properties. The land division will create two new lots; one consisting of 6.0± acres and one of 1.7± acres. The remaining property of 33.3± a cres contains a solar field. There were Board concerns as to the use of the non -buildable lot of 6.0 acres. The Board cannot endorse a land -locked non- buildable lot. A. Burney was aware, through conversations with D. Ruiz, that it was to be conveyed to an abutter to enlarge their lot, and such should be noted on the Plan. The anticipated purchaser of the 6.0 acres will be connecting it to Map 74, Lot 27. A revised Plan will be presented at the September 9 th meeting for endorsement. PUBLIC HEARING: S tone Farm- Subdivision Surety- see separate minutes. P. Bertram made Motion to take the $27,000 Surety Bond for Stone Farm Estates to complete work to bring the Subdivision into compliance with the Plans, T. Cole Seconded. A. Burney requested the Motion be amended to include a date of October 14, 2019 to allow Lisciotti Development Corporation 45 days to complete the work. P. Bertram amended her Motion to move forward to claim the Bond on October 14, 2019 in the event the work is not completed by that date, T. Cole Seconded, all aye. ECONOMIC DEVELOPMENT/ECONOMIC DEVELOPMENT COMMITTEE - Draft Committee Charge was viewed by the Board, but no vote taken as the Board would like to wait for input from G. Bittner . Discussion will continue at the Board’s Se ptember 9th meeting. SOLAR BYLAW - P. Bertram asked what were the Board’s objectives with the Solar Bylaw. The current Bylaw allows for ground-mounted systems up to 10 k W. Most homes need a system larger than 10 k W, which then places them into the larg e- scale category. A minimum of 20 acres is required to install a large -scale ground mount. Historically, there has been concern with the location of large MW solar farms within a residential area. There ha ve also b een past discussion s regarding better defined buffer zones. Further discussion tabled due to G. Bittner’s absence. ANR Plan, 190 Electric Avenue - D. Ruiz conferred with his attorney and was informed that the land conveyance doesn’t need to be on the ANR Plan for Board endorsement . The Board disagreed and requested that the lot be relabeled as a parcel being conveyed to/combined with another specified parcel. A Board meeting will be posted for Thursday August 29th, 6:00 PM for the ANR Plan. MINUTES APPROVAL: 08.12.19- T. Cole made Motion to approve, P. Bertram Seconded, all aye. 08.12.19, UNITIL- P. Boggio Administrative Assistant Minutes Public Hearing Stone Farm August 26, 2019 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:40 PM Present: Matthew Allison, Tanner Cole, Paula Bertram, Adam R. Burney Absent: Gregory Bittner The hearing was to discuss the application of Subdivision Surety to the completion of outstanding work under MGL Ch 41 Sections 81U and 81Y at Stone Farm Estates, Massachusetts Avenue. In December 2017 the developer , Lisciotti Development Corporation, came before the Board to request a red uction in the Bond for the completion of the subdivision. At that time Graves Engineering did an inspection to determine construction completeness. Graves Engineering provided a review letter to the Board enumerating outstanding construction items totaling appr oximately $27,000 for completion, therefore, the Bond was reduced with that amount to be retained. (A letter was presented to the Boar d by Donald Gurney, President of the Condominium Trust identifying the same items.) In February 2018 A. Burney sent a letter t o the Project Manager requesting items be completed by 1 June 2019. To date, that work has not been completed by the developer and no contact has been made with the Planning Office. Under MGL, the Town can claim the remaining funds and hire a contractor to complete the work. Once that work is completed, if any funds remain, they w ill be returned to Lisciotti. If the Board votes to take the Bond, the next step is to notify Lisciotti and he is given 45 days to complete the work. If Lisciotti chooses not to complete the work , Town Counsel will take steps to claim the Bond. P. Bertram made Motion to claim the funds in the Surety Bond. BUTTERFLY LANE: Subdivision Closeout - The developer was represented by Chris Crowley, Ernco Development. Construction has been completed and all houses built. An As-Built was reviewed by Jeffrey Walsh, Graves Engineering, Inc., the Board’s reviewing engin eer and a site walk held with C. Crowley, J. W alsh and A. Burney. The developer anticipates going to November Special Town Meeting for Town road acceptance. The site walk brought forth detail work that needed completion, e.g., some areas to be seal coate d, grouting on the granite, and mortar on pipes. Some trees will need to be placed. He hopes to have the outstanding items taken care, along with another review from J. Walsh, by the Board’s next meeting. The Select Board will hold its layout hearing on October 15 th for consideration for Butterfly Lane to be accepted as a public way. Bufferfly Lane has also been placed on the Warrant for November 12 th Special Town Meeting. As there will be no Board meeting October 14th due to the holiday, A. Burney suggested the Board either hold a special meeting p rior to the layout hearing of October 15th to sign off and release the Bond, or advi se the Select Board that a final review letter from J. Walsh noting items were completed would have the Board’s endorsement for the laying out of the road. A. Burney and C. Crowley will schedule a follow -up site walk with J. Walsh for October 3rd. The Board decided to hold a meeting on October 7th. ===PAGE 2=== Minutes, 09.23.19 Page 2 EARTH REMOVAL- The Board viewed the dra ft of August 12th. The draft currently states a threshold of 1,000 cubic yards; at a previous meetin g, P. Bertram was not comfortable with that number an d recommended 500 cubic yards. Board members present were in agreement with permits being issued for three years, renewable for up to two years. Discussion of yardage will continue at the October 7 th meeting. Four lots were created by an ANR Plan endorsed by t he Board in 2016. Lot 4 has already been sold. This ANR Plan alters the property lines to better accommodate septic systems. T. Cole made Motion to approve the ANR Plan for 99, 103 & 109 Youngs Road, P. Bertram Seconded, all aye. LAND ACQUISITION: Sa liba Property, Board Recommendation - The Land Acquisition Committee would like support from the Board for the purchase of the property, consisting of 318 acres, as placed on the Special Town Meeting Warrant. The Town has received both grants sought for t he purchase ; the Town’s cost will not exceed $282,000. The land w ill be for both recreational use and nature preservation. T. Cole opined that the Board would be stepping outside its jurisdiction to offer an opinion on the purchase of the land. P. Bertr am disagreed, noting that planning for the use/building within Town is contained within the Master Plan. She went on to note that there is a Planning Board member that sits on the Land Acquisition Committe e. P. Bertram made Motion that if asked, the Boar d voices its support for this land acquisition at Town Meeting, M. Thompson Seconded, Discussion: A. Burney asked for clarification; is the Motion strictly for support of the acquisition? Is P. Bertram looking for a letter of support or is it sufficient f or the Board to stand up at Town Meeting and voice its support? P. Bertram responded either of those options was agreeable. M. Thompson, aye; P. Bertram, aye; T. Cole, nay; M. Allison, aye. Vote passed 3-1. ECONOMIC DEVELOPMENT/ECONOMIC DEVELOPMENT COMMITTEE: A final draft was presented to Board members. P. Bertram made Motion that the Board adopt the Charge of the Lunenburg Economic Development Committee as drafted, M. Thompson Seconded, all aye. Members-at-Large will need to fill out Talent Bank forms. The Conservation Commission, Open Space Committee, Select Board, and Agricultural Commission will be notified that the Charge was accepted and they will need to appoint representatives. A. Burney will reach out to the Lunenburg Business Associat ion as a Lunenburg business owner also needs to be appointed to the Committee. ===PAGE 2=== Minutes 10.28.19 Page 2 SOLAR BYLAW: A. Burney provided the Board with a summary of restrictions in use by other communities as well as a chart specifying other limits such as size, acreage, and power. He is researching as to whether solar can be restricted in residential zones. There was discussion regarding the type of plant material that could be used within the array itself to minimize the amount of mowing necessary. A. Burney is awaiting response from UNITIL as to connection requirements. T. Cole remarked that if the Board is looking at solar from a planning impact, being allowable only in industrial zoning may not be in the best interest of the Lunenburg for revenue impact, e.g., having a warehouse on an industrial parcel would be more financial advantageous. Deforestation, screening, and system size are specific concerns of the Board. Discussion will continue at the next Board meeting. MASTER PLAN: Board members were in possession of the 2002 Master Plan. P. Bertram noted that the state conditionally approved the updated Open Space and Recreation Plan (OSRP). Based on the OSRP, Element V, Open Space and Recreation, Natural and Cultural, is completed. Information in the Housing Production Plan could be used towards Element III, Housing. A. Burney stressed Elements VI and VII, Community Facilities and Service, and Circulation, respectively, should be done by an outside consultant. There is currently $50,000 a vailable for master planning through Capital Planning; updating each Element will cost $12,500 +/ -. The need was stressed for public visioning sessions. Board members requested copies of the Vertex and Tappe buildings’ studies. Prior to the next Board m eeting, members will individually prioritize the Elements, provide that information to A. Burney, who will summarize for the next meeting. MINUTES APPROVAL: 10.07.19- Tabled due to agenda mis-print. COMMITTEE REPORTS: Capital Planning Committee- Will meet on Tuesdays in November. Boggio Administrative Assistant Minutes November 25, 2019 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:32 PM Present: Matthew Allison, Tanner Cole, Paula Bertram (arrived 6:36 pm), Marisa Thompson, Adam R. Burney ANR PLANS: 335 Chase Road - The applicant was represented by Larry Sabean, Hannigan Engineering. Three lots are proposed. A common driveway off Northfield Road through Lot 2 is proposed t o provide access to Lot 3. A single crossing would minimize impact on the wetlands. All three lots have requisite frontage, area, and upland. A. Burney noted as the common driveway does not split the property lines, two approvals would be required ; one from the Planning Board and one f rom the Building Commissioner. P. Bertram voiced concern that by endorsing the ANR Plan, the Board is also approving the location of the common driveway. L. Sabean asked if the Plan should be resubmitted with the d riveway easements eliminated. After ANR endorsement the applicant could submit a common driveway plan. L. Sabean inquired to the applicant’s recourse if the driveway plan is not endorsed. A driveway plan and application will be submitted for the December 9 th Board meeting, at which time the ANR Plan will also be included for Board endorsement. EMERALD PLACE AT LAKE WHALOM: Surety Release - Approximately $40,000 is still being held in surety for this completed project. The Board wanted to ensure everything on the punch list had been completed prior to fund release. Discussion will continue at the Board’s December 9th meeting. STONE FARM: Surety Write Down -All punch list items have been completed by the developer. The peer reviewer suggested the Board reta in $1,800 in the event the seed mixture doesn’t take in the spring. P. Bertram made Motion to release the remaining surety amount, less the $1,800, M. Thompson Seconded, all aye. ECONOMIC DEVELOPMENT COMMITTEE : The Lunenburg Business Association is plea sed to hear that such a Committee has been formed. Appointees are needed from the Select Board, Agricu ltural Commission and Conservation Commission. A. Burney has received a Talent Bank form for an at-large position. SOLAR BYLAW: Board members were p rovided with a compilation of buffer requirements in various communities within the Commonwealth. A. Burney presented a draft standard for buffer zones. Discussion was held regarding screening and buffer zones, along with discussion regarding pollinator species. Town Counsel noted to A. Burney that it can be required in the bylaw, but if the cost is unreasonable to the applicant, it could be challenged under Ch. 40A, Section 3. A. Burney noted that a pollinator list could be provided to applicants with the stipulation that they choose from that list. A possible option could be that if an applicant creates a pollinator habitat, either the buffer or the setback requirement could be reduced by a certain percentage. M. Allison responded that if the buffer is reduced, then the specific pollinator needs to be an appropriate screening. Some Board members noted they would like public input prior to crafting the draft bylaw. A. Burney noted it will be easier for him to write a new bylaw instead of editing the current one and suggested having a first draft in place for public input. P. Bertram suggested a survey for public input. A. Burney will prepare a draft survey for Board review. ===PAGE 2=== Minutes 11.25.19 Page 2 MASTER PLAN: The Board was in possession of R FPs (Request for Proposal) from various communities within the Commonwealth. At the last Board meeting, due to funding, members were asked to prioritize the Elements they wanted to work on. M. Thompson- Land Use, Community Facilities and Services, Housin g, Circulation. P. Bertram- Community Facilities and Services, Land Use, Housing; she noted some communities included a chapter on Sustainability, which she thought was a good idea; if not, her fourth would be Natural and Cultural Resource s. Her fifth would be Circulation. A. Burney felt that Sustainability could be its own chapter or the RFP could note Sustainability be incorporated into each Element. T. Cole- Community Facilities and Services, Open Space, Land Use, and Housing. M. Allison - Community Facilities and Services, Open Space and Recreation and Natural and Cultural, and Circulation. P. Bertram inquired if population density could be incorporated into the RFP. Community Facilities and Services and Land Use appear to be the top priority Elem ents in addition to some population projections. John Whalen, 526 West Townsend Road- Objected to the Board’s voicing that the setbacks in the Solar Bylaw were excessive. He said they had been well thought out when that Bylaw had been crafted. The setbacks were i n line with other towns in the Commonwealth. These are reasonable regulations to protect residents. MINUTES APPROVAL: 10.07.19- P. Bertram made Motion to approve, T. Cole Seconded, all aye. 10.28.19- P. Bertram made Motion to approve, T. Cole Seconded, all aye. Boggio Administrative Assistant Minutes December 9, 2019 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:30 PM Present: Matthew Allison, Tanner Cole, Paula Bertram, Adam R. Burney Absent: Marisa Thompson ANR PLAN: 322 Flat Hill Road - M. Allison made it known that his mother lives across the street f rom the subject address and that the applicant is also his colleague. He went on to note that he will no t derive any financial gain from this land division. The Plan was presented by John Boardman P.E., Places Associates, Inc. The house is located at the front of a long and narrow piece of property. This Plan creates two backland lots behind the original front lot. The lots have sufficient frontage and area. As the property is registered 61B, Recreation land , it will need to go through the Right of First Refusal process if taken out of Chapter. The Chapter Land process does not prevent an ANR Plan from being endorsed by the Board. P. Bertram requested that a memo randum be provided to the Select Board, Conservation Commission, and Open Space Ad Hoc Committee notifying them of a potential Chapter Land withdrawal. P. Bertram made Motion to approve the ANR Plan as submitted for 322 Flat Hill Road, T. Cole Seconded, all aye. P. Bertram made Motion that land use boards be notified of the potential withdrawal from Chapter, T. Cole, Seconded, all aye. 335 CHASE ROAD, Proposed Common Drive - At its November 25th meeting, the Board requested information regarding the layout and grading of the proposed common drive indicated on the ANR Plan. Plan presented by David LeRoy, Hannigan Engineering. The drive would be constructed off Northfield Road and would be alm ost 100 feet long. There is a 25 foot leveling area at 2% along Northfield Road. The drive will steepen to a grade not to exceed 9%. The drive does not straddle the lot line. It was noted that the location of the proposed shared driveway will preserve the existing fieldstone wall and eliminate an additional wetland crossing on a scenic road. P. Bertram made Motion to approve the proposed common drive at 335 Chase Road with the stipulation that the field stone wall be retained, T. Cole Seconded, al l aye. T. Cole was concerned that the replication areas could possibly be on Town -owned land. If so, the applicant w ill probably need permission from the Town and an easement to replicate the wetlands. The project still needs to go before the Conservation Commission and the Board of Health. 335 CHASE ROAD, ANR Plan- P. Bertram made Motion to approve the ANR Plan for 335 Chase Road, T. Cole Seconded, all aye. ROBBS HILL ROAD & SUNSET LANE: Proposed Common Drive - Neil Gorman, David Ross Associates noted this previously came before the Board in spring 2019. At that time it was withdrawn without prejudice for the applicant to gather more information and for the presence of a full Board. Due to the absence of a member this evening and a member vacancy , N. Gorman is requesting to reschedule to the next meeting. Board was in agreement. Application will be presented at the January 13th Board meeting. ===PAGE 2=== Minutes 12.09.19 Page 2 EMERALD PLACE AT LAKE W HALOM: Surety Release - Continued from the last Board meeting as Board members wanted to ensure all items on the punch list had been completed ; in particular the sidewalks . In reviewing the files, A. Burney noted there had originally been conflict between the developer and the Board as to the purpose of the Bond. When the project was approved, the improv ements along the waterfront o n Town property and the roadway were included in the project. There were Bond releases up to August 2014. Any final issues were for final pavement and berm repair. The DPW Di rector has no issues with the development and paving was completed to his satisfaction. Throughout construction there was no flagging of the interior sidewalks as an issue. P. Bertram made Motion to release the surety for Emerald Place at Lake Whalom, T. Cole Seconded, all aye. SOLAR BYLAW: A draft survey was available for member input. Comments had been submitted by absent member. Board members questioned #6 regarding fe ncing. There was also dis cussion on #9 as to whether solar parking canopi es should be allowed by-right. A question will be added for public input on the extent of the vegetated buffer, e.g., 50 feet, 100 feet? Edits will be made to the Survey and discussion will continue at the January 13th Board meeting.. MASTER PLAN: Some Board members were of the opinion that the Planning Board should be included in Select Board discussions surrounding the town -owned buildings. Board members requested A. Burney rea ch out to both the Town Manager and the Select Board regarding same. MINUTES APPROVAL: 11.25.19- Tabled for discussion on January 13th. COMMITTEE REPORTS: Capital Planning Committee- no meeting Storm Water Task Force- no meeting Agricultural Commission- no meeting TCP Building Design Committee- Committee approved RFQ (request for quotes). The State model gives more discretion for limiting the size of a development. There was discussion of including Low Impact Development; A. Burney noted that could be incorporated into the Subdivision of Land Rules and Regulations. Tree Clearing Bylaw: M. Allison noted Ayer has a land disturbance bylaw ; tree clearing could be added t o this. T. Cole felt open space and conservation goals could better be achieved through open space and development.
