Burney Land Use Director Marjorie J. Boggio Administrative Assistant Minutes January 27, 2020 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:30 PM Present: Matthew Allison, Tanner Cole, Paula Bertram, Marisa Thompson, Adam R. Burney ANR PLANS: 871 & 915 Northfield Road- Plan presented by John Harrison, 915 Northfield Road. Fifty feet of frontage will be taken from 871 Northfield Road and added to 915 Northfield Road. 915 Northfield Road will be divided into three lots; Lot 1A, 2A, and 3. Lots 1A and 2A will have access via an existing common drive; Lot 3 will have its own access. P. Bertram made Motion to endorse the ANR Plan for 871 and 915 Northfield Road, T. Cole Seconded, all aye. 41 & 47 Reservoir Road- Plan presented by Steve Ballard, Whitman and Bingham Associates on behalf of 155 Reservoir Trust. Both proposed lots have reduced frontage, but the required area. Due to the location of wetlands, a common drive is proposed . The common drive will run along the property line. M. Allison questioned, as the creation of this division will give a total of ten lots, does affordability come into play. A. Burney responded that would be a determination of the Building Commissioner. His (A. Burney) opinion was that would apply to a planned residential area, subdivision, etc.; not a series of lots. The Board viewed the 2015 endorsed plan that created the first nine lots. Brian Marchetti, McCarty Engineering noted when the ANR was endorsed in 2015, 155 Reservoir Rd only owned the front half, and not the 25 acres in the back parcel. Lot 9 was not developed and there was an easement to get to the back parcel. Board members wanted to get input from the Building Commissioner as to the 10% affordability with the creation of the tenth lot. A. Burney responded that even if the affordability comes into play, it does not affect endorsement of the ANR. P. Bertram made Motion that a letter be sent to the Building Commissioner informing him of the prior subdivision into nine lots and requesting a determination if the creation of this tenth lot triggers the 10% affordability threshold under the Bylaw, T. Cole Seconded, all aye. T. Cole made Motion to approve the ANR Plan for 41 and 47 Reservoir Road, P. Bertram Seconded, all aye. COMMON DRIVE PLAN: 41 & 47 Reservoir Road- Brian Marchetti, McCarty Engineering, presented on behalf of 155 Reservoir Road Trust. A common drive is being proposed as a perennial stream bisects the property; the common drive will minimize impact. The common drive straddles the lot line, and then veers away due to the wetlands. An Order of Conditions has been received from the Conservation Commission for the installation of a culvert. The DPW Director, in his review, n oted the current roadway moratorium. A 2-inch main water connection is being proposed to service the back two lots; the property owner will work with the DPW Director. The Fire Chief stressed that the culvert be substantial enough to support heavy vehicl es. The Town’s heaviest fire vehicle is 44,000 lbs. The culvert is delivered to the site pre -manufactured and will exceed a 50,000 pound rating. As the drive is over 1,000 feet in length, a 40x40 paved turnaround is provided. Given that the proposed shared driveway attempts to meet requirements of the bylaw as far as feasible due to the lot constraints, P. Bertram made Motion to approve the proposed common drivew ay for 41 and 47 Reservoir Road with the stipulation that the culvert meet a minimum vehicle weight of 50,000 pounds and that it be so certified, M. Thompson Seconded, all aye. ===PAGE 2=== Minutes 01.27.2020 Page 2 PUBLIC HEARING: 1325 Massachusetts Avenue- see separate minutes. Hearing was continued to February 10 th. APDC CHAIR: Brooks House D iscussion- APDC Chair Richard McGrath, 22 Cushing Lane , and APDC Clerk Cullen Dwyer, 76 Main Street, noted the APDC has the understanding that the Brooks House is to eventually go on the market, and once sold, removed from the site. The APDC feels this is unlikely to happen. They anticipate it will eventually be demolished, at a cost to the Town. They are looking for Board guidance on creating a lot that conforms to zoning which would allow the building to remain on site. There was Board discussion of an ANR Plan, but that would have to be initiated by the Select Board as the property owner. The Board asked A. Burney to send a letter to the Select Board requesting a meeting for discussion of the Brooks House, Library, and the school buildings as to ex isting uses and the future sustainability of those uses. The Board feels it would be beneficial for both the APDC and the TCP Building Design Committee to be invited to that meeting. Scenic Road Violation – Holman and Northfield- As members of the Histo rical Commission, R. McGrath and C. Dwyer noted a stone wall had b een removed fro m a portion of Northfield Road ( a designated scenic road). They had contacted the Conservation Commission and were informed that a letter would be sent to the contractor that bulldozed the site. A. Burney noted there are no penalties that can be levied as the Town does not have a scenic road bylaw. The Board was of the opinion that a scenic road general bylaw, to include fines, should be created. EARTH REMOVAL BYLAW: Board was in possession of a new draft. Approval criteria were clarified that will not diminish the Board’s subjectivity. A neighborhood’s character can be taken into consideration, e.g. a heavily traveled area versus a more rural road. There was discussion of separate articles for town meeting, i.e., one article which would move the granting authority from the Select Board to the Planning Board; another article would be the proposed bylaw. A. Burney will seek legal input. He sent both the proposed bylaw and rules and regulations to the environmental safety compliance officer and operations dir ector at Keating and received a favorable response. Discussion turned to the Earth Removal Rules and Regulations. There was discussion on establishing a threshold that would trigger a soil testing requirement by a licensed professional soil evaluator. There was discussion on quarry operations and whether or not to write separate rules and regulations or allow the Board to waive the six -foot high water table require ment. M. Allison suggested that there be separate regulations for earth fill and earth removal. A. Burney suggested doing a regulation for removal at this time, then come back at a later date for a regulation on fill. Board consensus was to go with a threshold of 1,500 cubic yards to trigger a permit . Discussion will continue at the next Board meeting. RULES & REGULATIONS GOVERNING THE SUBDIVISION OF LAND: Tabled until after Warrant closes in March. MGL CH. 41, § 81D, MASTER PLAN: In speaking with engineers during the 2020 MMA Annual Meeting , A. Burney received both positive and negative input concerning a population projection. Based on comments received, his suggestion is to go with UMass Donahue Institute. A. Burney clarified what the Board is requesting and will keep the Board updated. MINUTES APPROVAL: 01.13.2020- P. Bertram made Motion to approve, T. Cole Seconded, all aye. COMMITTEE REPORTS: Capital Planning Committee- Recommendation for FY 2021 forwarded to the Finance Committee. Storm Water Task Force - A Task Force member noted that Hickory Hills has a stormwater sub-committee under its lake management group. They are hiring a consultant to look at the main lake. P. Bertram noted that they prepared a n educational brochure which she will send to A. Burney for public distribution. Agricultural Commission- No quorum available. Commission has a vacancy. TCP Building Design Committee- Meeting scheduled for January 29th to interview firms that responded to the RFQ. Open Space Ad Hoc Committee- The Committee feels they should not have a representative on the Economic Development Committee as stated in the Charge ; the appointments are better suited to other Town departments. A. Burney clarified it does not necessarily have to be a member of the Open Space Committee. They could appoint someone from outside the Committee. Land Acquisition Committee- no report MRPC- no report MJTC- No Board representative. ===PAGE 3=== Minutes 01.27.2020 Page 3 DIRECTOR’S ITEMS: Stormwater Bylaw: A. Burney pointed out the Board needs to discuss fees and any changes to the measurable goals. Discussion tabled to February 10th. Mr. O’Brien, property owner on Howard Street, contacted A. Burney to propose a possible change to his Approval. He is proposing one-bedroom, senior apartments. A. Burney noted new zoning would be required due to the project density , and suggested a new bylaw be written, similar to a PRA (planned residential area) bylaw that could be applied Town -wide. Another approach would be a friendly comprehensive permit where Mr. O’Brien and Lunenburg could partner for a local initiative project MEETING SCHEDULE: February 10- Earth Removal, Stormwater, 1325 Massachusetts Avenue Continuation February 24- ONGOING ITEMS: Lunenburg Code, Section 250- 4.15., Solar Energy Systems- Lunenburg Code, Section 250- 6.1., Off Street Parking & Loading Areas- MGL, Ch. 41, Section 81D, Master Plan- BOARD COMMENT: M. Burney Land Use Director Marjorie J. Boggio Administrative Assistant Minutes Public Hearing 1325 Massachusetts Avenue January 27, 2020 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 7:00 PM Present: Matthew Allison, Tanner Cole, Marisa Thompson, Paula Bertram, Adam R. Burney The Hearing was to hear and discuss a stormwater management special permit under Ch. 204 of the Code of the Town of Lunenburg for an earth rem oval project at 1325 Massachusetts Avenue, Map 062, Parcel 0003. Owners/Applicants are Daniel and Jean Proctor, 1529 Massachusetts Avenue, Lunenburg, MA. Owners/applicants were represented by Frank McPartlan, Ducharme & Dillis Civil Design Group, Inc. (‘DDCDG’). The project calls for the removal of 50,000+/ - cubic yards of material. The site is mostly grassed with woodlands along the perimeter . A single family residence is located on the lot. A twenty foot buffer, to remain untouched and wooded, wil l be maintained along the property lines. The site will be graded to a large flat 1% pitched area, which will drain to a stormwater management area (a basin with infiltration capacity) on the west side of the property . That will discharge into the existi ng wetland buffer. An earth removal permit has been received from the Select Board. As the site is zoned commercial, the property owner wanted t he stormwater management area designed to capture runoff from the earth removal as well as any impervious area that may occur with future development. The basin has been designed up to a 100 -year storm. The basin has been created with forebays, one at each end and one in the middle. Three manholes are proposed for any future development. The outlet structure i s designed to promote groundwater recharge. The site will not discharge to any critical area. During earth removal, a double row of silt fence will be placed along the wetland side of the property. Slopes will be stabilized with erosion control matting. The flatter areas will be stabilized with wood chips until seeded. A gravel access drive will be constructed once approval is received from MassDOT. P. Bertram disagreed with DDCDG’s comment that the site would not discharge to any critical area. S he had looked at the ACEC (Areas of Critical Environmental Concern) map and opined that this address falls within an ACEC. The map of the Cowdrey area shows an ACEC going down Townsend Harbor Road and across Massachusetts Avenue. P. Bertram has concerns with pre- and post- development stormwater and is of the opinion that the Board should be looking at this from both the earth removal viewpoint and possible future commercial development. She felt the Board is only looking at a small portion of this project, while there is a large r one coming. A. Burney responded that the Board can only act on the current application, not something that may take place in the future. DDCDG reiterated that the basin was designed to handle 77,000 s quare feet of impervious s urface. P. Bertram noted d rainage calculations were available, but a full stormwater plan was not done as the project meets pre - and post - requirements. She also questioned if there was sufficient hydrology information. P. Bert ram inquired as to a planting plan. DDCDG responded that plantings are shown on the Earth Removal Permit Plan. ===PAGE 2=== Minutes, 1325 Massachusetts Avenue Page 2 D. Proctor noted he will be doing a site walk with abutter Dale Erskine to determine what trees are to remain. Arborvita es will also be planted along her property line. P. Bertram is looking for a sequencing timeline for stormwater stabilization. DDCDG responded erosion control barrier s will be installed first along the limits of the property . Where earth is to be removed, the basin will be constructed first . P. Bertram would like this documented. A. Burney noted an email he received f rom abutters Gerry and Dale Erskine, 1331 and 1335 Massachusetts Avenue. They had concerns with noise, dust, duration of project, and buffer materials. Full email is on file in the Planning Office. A. Burney noted most of their concerns are with earth removal, not the stormwater management. A peer engineering review letter was also received from Graves Engineering, Inc. (GEI) after th e close of business. A. Burney summarized that review letter for the Board. GEI had no issues with compliance to the Stormwater and Storm Sewer Bylaw. There were review comments relative to Hydrology Computations and Stormwater Management and general en gineering comments. Review let ter is on file in the Planning Office. P. Bertram would like to see screening and proposed stabilization on a revised plan . She is also looking for assurance that the project complies with best management practices for an ACEC and wants a vegetation/planting schedule and sequencing schedule. DDCDG requested the hearing be continued to February 10, 2020. A. Burney will relay the Board’s questions/concerns to GEI for response. P. Bertram made Motion to continue the Hearing to February 10 th, T. Cole Seconded, all aye. Hearing recessed 7:50 PM. Burney PUBLIC COMMENT: T. Cole noted a conversation he had with a n individual in the health and human services field regarding permitting of child care facilities. There is a vacant building on the Lunenburg/Fitchburg line, but a child care facility is unable to locate there due to the building’s proximity to a retail marijuana facility. ANR PLAN: 425 West Townsend Road & 100 Howard Street - T. Cole recused himself. Propose d Parcel A of 240 SF at 100 Howard Street will be combined with 425 West Townsend Road. The addition of the 240 SF will create a buildable lot of 30,000 SF, which is required for installation of a septic system to serve a three bedroom house. P. Bertram made Motion to approve the ANR Plan for 425 West Townsend Road and 100 Howard Street, M. Thompson Seconded, all aye. PUBLIC HEARING: 1325 Massachusetts Avenue- see separate minutes. EARTH REMOVAL BYLAW: There was discussion as to how the new bylaw will be presented at town meeting. P. Bertram inquired if the existing bylaw has an abutter notification requirement. If not, it should be included. Dra ft provided to the Board this evening has 1500 cubic yards triggering a permit application. Other changes were made to the bylaw c overing requirements if a permit is not required. Draft Rules and Regulations were also reviewed with particular attention paid to soil testing. Katey Adams, Select Board . She is questioning the Planning Board working on these details even though the Select Board is the permitting authority. She feels there is no purpose to the ongoing planning. She suggested that the permitting authority for earth removal be moved from the Select Board to the Planning Board at town meeting. A. Burney needs to confer with Town Counsel. The draft will be supplied to both the Select Board and current permit holders for comments. A. Burney suggested public discussion be scheduled for the first Board meeting in March. There was discussion on standards for screening. Initial permits will be issued for one year, with renewal possible up to two years. Public hearings shall be required both for the initial permit and permit renewals. A. Burney will make noted changes to the bylaw in preparation for public discussion at th e Board’s March 9 th meeting. Board discussion of the rules and regulations will continue at the Board’s February 24 th meeting. ===PAGE 2=== Minutes 02.10.2020 Page 2 STORMWATER BYLAW: The Board wants to emphasize LID (Low Impact Dev elopment) planning and design i f at all feasible, but make it a requirement in the vicinity of Type A and Type B soils. Burney Land Use Director Marjorie J. Boggio Administrative Assistant Minutes Public Hearing 1325 Massachusetts Avenue February 10, 2020 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:40 PM Present: Matthew Allison, Tanner Cole, Marisa Thompson, Paula Bertram, Adam R. Burney The Hearing continuation was to hear and discuss a stormwater management special permit under Ch. 204 of the Code of the Town of Lunenburg for an earth removal project at 1325 Massachusetts Avenue, Map 062, Parcel 0003. Owners/Applicants are Daniel and Jean Proctor, 1529 Massachusetts Avenue, Lunenburg, MA. Owners/applicants w ere represented by Frank McPartlan , Ducharme & Dillis Civil Design Group, Inc. (‘ DDCDG’). DDCDG presented a revised Plan to address issues brought forth at the January 27 th Hearing by both Board members and Graves Engineering Inc. ( ‘GEI’ [ reviewing engineer ] ). GEI review letter of February 10, 2020 acknowledged that issues ha d been resolved; letter is on file in the Planning Office. The construction sequence was updated. The loam screening and stockpile locations were indicated on the Plan. Straw wattles are proposed on the east side of the site. P. Bertram has concerns with this project in regards to ACEC (Area of Critical Environmental Concern). She is also concerned with the environmental impact of this project. The Board was in receipt of a letter from the Conservation Administrator stat ing “…the ACEC standards listed in the regulations (301 CMR 12.00) clearly show that the standards do not apply to your proposal. As your proposal does not include the filling or direct alteration of wetlands…it would not trigger any threshold that would require oversight by DCR or M EPA…” She noted she had communicated with the Conservation Commission Chair and states he informed her that the project does require a MEPA review and ENF. She does not want to vote on this project until the Board hears form the environmental agencies that have jurisdiction. Greg Roy, DDCDG - Noted that they are seeking three permits - earth removal f rom the Select Board, Stormwater Management from the Planning Board, and also a permit from the Conservation Commission. The Applicant cannot move forward with the project unless all three permits are in place. For a Board/Commission to make its approval contingent upon another approval is immaterial. He stressed that the Applicant has met the requirements of the Zoning Bylaw and went on to note that the project was over-designed to ensure transparency to Lunenburg that there would be a Phase 2 to this project. This Hearing is only for a stormwater management permit; any future commercial development will again require a hearing before the Board. Alan Dantonio, 4 Townsend Harbor Road- Has concerns with runoff and environmental hazards. Dan Proctor, 1529 Massachusetts Avenue - Noted currently runoff comes off the hill untreated and goes into the wetlands. Why should he put in an extensive basin to treat everything? 44% TSS (total suspended solids) will be provided in a stormwater management area of 6,000+ cubic feet. P. Bertram emphasized that once in Phase 2, the runoff will be going over a paved ===PAGE 2=== Minutes 02.10.2020 1325 Massachusetts Avenue Page 2 surface instead of a field. D. Proctor responded he is doing everything required by law. P. Bertram does not feel doing only the minimum required by law is sufficient for an ACEC. Greg Roy- Noted if you’re not in an ACEC you have to treat ½ inch of runoff over the impervious area and the 44% TSS removal prior to recharge is not tripped. If in an ACEC, water quality volume goes up to one inch, and you have to remove 44% TSS prior to infiltration. They cannot discharge more water, peak rates, more than the pre -developed condition. Best management practices must be employed on -site. The only state permit required for this project is for access. The state will issue a temporary permit for gravel removal which will expire. A new permit will be re quired for a new project. At that time they may have to file with MEPA. Bonita Martin and Mark Rzeznikiewicz , 68 Townsend Harbor Road , and Clifford Smith, 70 Townsend Harbor Road - All voiced concern with noise and dust from the proposed project. P. Bertram inquired as to the duration of the screening operation. DDCDG responded as needed as long as topsoil is being removed. D. Proctor noted it is specified in the earth removal application; they can haul material out for 8 -10 days then they screen, spread, and seed. P. Bertram asked if a more permanent barrier, other than silt fences and hay bales, could be placed for wetland protection. It was emphasized to the audience that this Hearing is for stormwater management , not gravel removal. Katey Adams, Peninsula Drive- Opined it is difficult to know what data is needed as there is no firm end point for the proposed project. Jean Proctor, owner of 1325 Massachusetts Avenue- Emphasized she and her husband do not yet know what the “end point” will be. They are very invested in Lunenburg and are complying with the Town’ s statutes. Mark Rzeznikiewicz, 68 Townsend Harbor Road - His property value will drop. The Board needs to remain aware of the “human” aspect and not just the technicalities. A. Burney noted it is a judgment call by the Secretary as to whether or not the MEPA process is required. DDCDG, on behalf of the Applicant, requested the Hearing be continued to the Board’s February 24 th meeting. Greg Roy, DDCDG wanted clarification on the Board’s request for additional information fo r the continuation. P. Bertram wanted review comments from DEP. The Board is also waiting for the Conservation Commis sion to close its Hearing, which will not occur until the Commission gets the DEP No. DDCDG will also try to get a firmer answer from MEPA. M. Allison requested the gap between the north and south silt fences be closed. He al so asked that the length of the access road be annotated on the Plan. T. Cole made Motion to continue the Hearing to February 24th, 6:35 PM, P. Bertram Seconded, all aye. Hearing recessed 8:16 PM. Burney PUBLIC COMMENT: Hans Wentrup, 418 N W Townsend Road- Inquired as to Board progress with updating the solar bylaw and if there would be an a rticle at annual town meeting. He had previously submitted a citizen petition at annual town meeting for some language change and that the permitting authority changes from the Planning Board to the Zoning Board of Appeals. M. Allison responded that the solar bylaw is currently on hold as the Board focuses its attention on other bylaws Below Agenda items taken out of order. PUBLIC HEARING: 1325 Massachusetts Avenue- Ducharme & Dillis Civil Design Group, Inc. (‘DDCDG’) letter dated February 24, 2020 requested a continuance to March 9, 2020 on behalf of the Applicant. P. Bertram made Motion to continue the Hearing to March 9, 2020, 6:35 PM, per the applicant’s request, T. Cole Seconded, all aye. 1325 MASSACHUSETTS AVENUE- Waiver Request from Site Plan Approval: Attorney Bowen, 1686 Massachusetts Avenue spoke on behalf of the A pplicants, Daniel and Jean Proctor. He reference d DDCDG letter dated Feb ruary 20, 2020, subject: Change of Use Site Plan Approval Waiver Request . He is of the opinion that a site plan is not required at this time as there has been no change of use. After the earth removal, there may be a change of use. P. Bertram would like to know how the Building Commissioner arrived at his change of use determination. She would like the Board to continue its discussion once correspondence has been received from the Building Commissioner. Atty Bowen does not feel it is necessary for that input, or even for the Board to agree with him. The waiver should still be con sidered on the basis of the other points bulleted in DDCDG’s letter (on file in the Planning Office). P. Bertram feels there are portions of Code of Lunenburg , 250-8.4. Site Plan Approval, which would apply. She is concerned with screening and would like additional landscaping to protect the neighbors. Atty Bowen responded that perimeter screening is already addressed. He believed additional screening c ould be addressed in the ongoing stormwater review as opposed to having the Applicant go through an additional application for Site Plan Approval. P. Bertram responded that stormwater does not address vegetation; that is through site plan approval. A. Burney emphasized that site plan approval looks at the final use of the site, which in this case would be how the earth removal is managed and operated . Site plan approval is usually intended for commercial or industrial development and not earth removal. Discussion will continue at the Board’s March 9th meeting. ===PAGE 2=== Minutes 02.24.2020 Page 2 496 MASSACHUSETTS AVENUE: Request for De Minimis Change - The Lunenburg Water District is requesting a change in slope. The slope on the westerly side (right side of building) is 3:1, as previously permitted by the Board. The Water Dist rict would like to change it to a more gradual 4:1. The rear of the site will remain at a 3:1 slope due to the power line easement. P. Bertram made Motion to approve the De Minimis change at 496 Massachusetts Avenue for a proposed change of slope from 3:1 to 4:1, T. Cole Seconded, all aye. EARTH REMOVAL BYLAW & REGULATIONS: Daniel Proctor, property owner of 1325 Massachusetts Av enue voiced his f rustration regarding communication between Town Departments and applicants/contractors. Board viewed a new draft of Earth Removal Rules and Regulations. New edits will be made; a dditional screening language added to 5.2. , hours of remo val operation 8:00 AM to 4: 30 PM, Monday through Fridays in residential zoning. Hours in other zones would be determined by the Planning Board. A. Burney will make these and other edits, to the draft. The Board will plan on having a public discussion on the general bylaw at its March 9th Board meeting. STORMWATER AND STORM SEWERS BYLAW: As a result of Board discussion and submitted comments from Board member P. (‘DDCDG’). At the previo us Board meeting the Applicant was informed that the Building Commissioner considered the earth removal a change of use that would constitute a site plan approval. This was then confirmed in the Building Commissioner’s letter dated March 2, 2020. Given the in-depth review process that has been ongoing with the stormwater permit, the Applicant , in a February 20, 2020 detailed letter to the Board, requested the requirement for site plan approval be waived. The stormwater permit application packet addressed many of the standards outlined in Code of Lunenburg, Section 250- 8.4. P. Bertram noted that the purpose of site plan approval is to ensure the project will “ not result in a detriment to the neighborhood or the environment”. She had numerous questions as to how the earth removal operation will take place; e.g. staff on -site facilities, dust control water supply. She stated the Stormwater Handbook requires a minimum of three deep holes in the proposed location of the infiltration basin. DDCDG responded that the revised plan indicate d test pits, which took place in February. She also question ed the location of abutting wells/septics and perc rate. She expressed concern with the review done by peer reviewer, Graves Engineering, Inc. (‘ GEI’); that some re quirements under the Stormwater Handbook were not initially performed and not noted in GEI review . Attorney Bowen, 1686 Massachusetts Avenue (attorney for the Applicant) addressed the Building Commissioner’s opinion memorandum regarding change of use. Atty Bowen asserted that the Building Commissioner did not state a site plan approval was “required”, only that it “could” warrant a significant change. Daniel Proctor noted there is typically a porta potty on site, there will not be any construction trailer s or office on site. For watering during dust, there will be a water truck (specified in the Earth Removal Permit), calcium flakes and Town water at the house located on the property . P. Bertram made Motion to deny the waiver request, T. Cole Seconded, a ll aye. D. Proctor requested a bulleted listing of all the Board’s concerns. Public Hearing- see separate minutes PUBLIC FORUM: Earth Removal Bylaw and Rules and Regulations - A. Burney gave a presentation noting the reasons for changing the bylaw, one of them being that earth removal would be better suited to a Land Use Board for permitting rather than the Board of Selectmen. There was a comparing of the existing bylaw and the proposed bylaw. The proposed bylaw increases the threshold for the amount of removal that would trigger a permit. Most earth removal permits will likely need a stormwater permit at some point, and if a Land Use Board is the permitting authority, this would allow for a single hearing. The proposed bylaw also allows for separate Rules and Regulations (‘R&R’) which would cover the permit application, public hearing process ===PAGE 2=== Minutes 03.09.2020 Page 2 and regulating the earth removal operation. Bringing earth into a site that may be shipped out or otherwise used would not be considered earth removal. T. Cole asked A. Burney to discuss native earth in terms of processing. Earth removal would be defined as taking native material out of the ground. P. Bertram made Motion to add the word “native” (in front of earth material) to t he definition of Earth, T. Cole Seconded. Discussion- M. Allison had concerns that it could still affect the neighbors and the local roads. All aye. Mark Bursch, 20 Buttonwood Place- Opined that the bylaw threshold of 1,500 cubic yards was too low. If a resident wished to do something on their property, the y would incur a financial impact with the cost of the permit and the hiring of an engineer. He felt the permit triggering threshold should be 5,000 cubic yards. The Board responded it had set a hi gher threshold than most communities. M. Bursch also felt the screening requirements in the R&R were too restrictive. He asked the Board to define site plan approval and its purpose. Once it was defined to him, he disagreed with the Board denying the wa iver for 1325 Massachusetts Avenue. He believed that as the Applicant did not know the final use of the site, a site plan approval should not be required. A. Burney responded that the Building Commissioner determined earth removal was a change of use fro m the current residential use of the property and was listed in the Code of Lunenburg, Ch. 250- Section 250-4.1., Use Table. Dan Proctor, 1529 Massachusetts Av enue- Requested clarification of the permit renewal process. He had concerns as the separation of ground water in current permits was four (4) feet. The proposed R&R specified no material removal within any elevation less than six (6) feet above seasonal high water table . Did that mean when his permit c ame up for renewal, that he would have to submit a new plan? A. Burney responded that in existing permits the Board could waive the six (6) feet. This also brought up the concern with new requirements for screening, but A. Burney noted that all current permit holders met the proposed screening. D. Proctor inquired if the proposed bylaw passe d would a ll earth removal over 1,500 cubic yards potentially require site plan approval as earth removal was a change of use in the Use Table. Bob Proctor, 99 Pleasant Street - Questioned the R&R offsets of 100 feet to a public way and 50 feet of any lot line. If an individual ha d a small lot to begin with, this would limit the allowable area for earth removal . P. Bertram responded that the Board is being less stringent than the surrounding communitie s. B. Proctor expressed that more and more permits are being put in place in Lunenburg, creating a financial burden on the residents. John Esposito, Mulpus Road- It is his opinion that the threshold of 1,500 cubic yard was too low; it should be 5,000. P. Bertram requested if anybody in the audience had specific instances where adherence to these R&R would be problematic, to please bring them forward. D. Proctor- Responded that the more restrictive it becomes, contractors will just tell themselves it’s not worth it. M. Bursch- Suggested the Board re -look at earth removal as a change of use. If it require d site plan approval, that is an added expense for the applicant. Katey Adams, Peninsula Drive - As a Select Board member, came to the realizat ion that the current bylaw was not being enforced. If it was, it would be more restrictive than the proposed bylaw as the current threshold is 10 cubic yards. She felt it was in the best inter est of Lunenburg to work on this proposed bylaw and R&R instead of st icking with the current bylaw. She inquired if the threshold was 5,000 cubic yards and the property was located in a water protection zone, how could the area be protected if the earth being removed is less than 5,000 cubic yards? M. Allison remarked that these R&R are to help Lunenburg. Numerous permits are sometimes the cost of doing business. The bylaws are to protect the residents; both those that do business in Town, and those that do not. ===PAGE 3=== Minutes 03.09.2020 Page 3 P. Bertram ha d concerns with the six (6) feet to g round water. A. Burney said there w ould be time to address that concern as that was covered in the R&R; only the bylaw would go to warrant for Annual Town Meeting. The main concern in the bylaw was the resident-preferred threshold of 5,000 cubic yards. A change could be made on Town Meeti ng floor if necessary. The Board will plan on reviewing the R&R to ensure an up to date draft will be available for citizens to view at Town Meeting when the bylaw is voted on. There was discussion of changing the groundwater offset from six (6) to four (4) feet. There was discussion of the cost entailed by current permit holders to comply with the R&R. Tom Alonzo, 284 Lancaster Avenue - Believed that if both the bylaw and R&R are available at Town Meeting, the citizens w ill be overwhelmed. He suggested that the Board keep the bylaw article, but tell the citizens that the R&R will be discussed at a future date. REMOVAL FROM CHAPTER, RIGHT OF FIRST REFUSAL (ROFR): 322 Flat Hill Road- M. Allison stated that the property was located across the street from his mother’s residence , but that he had nothing to gain financially from the removal from Chapter . The property owner wished to remove 10.5 acres from Chapter 61B. P. Bertram made Moti on to notify the Board of Sele ctmen that the Planning Board did not recommend the Town exercise its Right Of First Refusal, T. Cole Seconded, all aye. 57 & 63 Cross Road - P. Bertram made Motion to notify the Board of Selectmen that the Planning Board d id not recommend the Town exercise its Right Of First Refusal, T. Cole Seconded, all aye. Tract A, Holman Street & Northfield Road - This property was located at the northwest corner of Holman and Northfield. T here would be a removal of 8 acres, leaving 92 .8 in Chapter . T. Cole’s understanding was that to go through the Right Of First Refusal, there need ed to be a bona fide offer without contingencies ; this Purchase and Sale Agreement (‘P&S’) contained contingencies. A. Burney responded that prior to Boar d/Commission review, Town Counsel review ed all ROFRs for statutory compliance. 24.(f) of the P&S states, “ BUYER will deliver to SELLER a Town approved ANR Plan for Lots 1 and 2, and a Town approved plan for Lots 3, 4 and 5 prior to the date BUYER sells th e first lot from Tract “A ” . P. Bertram made Motion to notify the Board of Selectmen that the Planning Board did not recommend the Town exercise its Right Of First Refusal. 24.(h) was also noted which addressed possible adjustment of lot lines for the lo cation of acceptable wells. This raised Board concern that this could increase the acre removal from Chapter to accommodate well location. The Board requested a letter be sent to the Select Board noting concerns with the P&S, i.e., Condition (h), propert y description, lack of engineer stamp on plan, and possible reconfiguration of land to be withdrawn from Chapter. P. Bertram withdrew Motion. P. Bertram made Motion that such letter be sent to both the Select Board and the land owner, T. Cole Seconded th e Motion with amendment to involve Town Counsel, P. Bertram accepted and Seconded amendment. T. Cole wanted feedback from Town Counsel that this constituted a bona fide offer and P. Bertram wanted input from Town Counsel regarding the possible lot reconfi guration. All aye. Howard Street & West Townsend Road - Board was unable to discuss and recommend as a member was absent and one of the Board members present was the owner of 100 Howard Street. STORMWATER AND STORM SEWERS BYLAW: The CEI stormwater consultant questioned if the Board wanted Applicability to apply to disturbances of only 40,000 square feet or greater , or should it also specify development and redevelopment such as subdivisions and site plan approval. D.(5) exempted the Town from the sto rmwater permit if work was outside MS4, but not inside the MS4. Board members disagreed and felt if the people had to comply the Town should also. The consultant suggested a Low Impact Development (LID) bylaw , separate from the Stormwater Bylaw, could be put in place. The LID bylaw could apply to a disturbance within an area smaller that the 40,000 square feet. Discussion to continue. MINUTES APPROVAL: 02.24.2020- P. Bertram made Motion to approve, T. Cole Seconded, all aye. ===PAGE 4=== Minutes 03.09.2020 Page 4 COMMITTEE REPORTS: Capital Planning Committee- no report Storm Water Task Force- no report Agricultural Commission- no report TCP Building Design Committee- no report Open Space Ad Hoc Committee- no report Land Acquisition Committee- no report MRPC- P. Burney Absent: Marisa Thompson The Hearing continuation was to hear and discuss a stormwater management special permit under Ch. 204 of the Code of the Town of Lunenburg for an earth removal project at 1325 Massachusetts Avenue, Map 062, Parcel 0003. Owners/Applicants were Daniel and Jean Proctor, 1529 Massachusetts Avenue, Lunenburg, MA. Owners/applicants w ere represented by Frank McPartlan , Ducharme & Dillis Civil Design Gr oup, Inc. (‘ DDCDG’). DDCDG presented a revised Plan to addre ss issues brought forth at the February 10 th Hearing continuation. Revised plans show ed an increase in buffer from 20 to 50 feet on the north and east sides of the property. As a result of the increased buffer, the yield of earth removal f rom the parcel would be reduced. The Applicant now anticipate d removing 25,000 cubic yards instead of the original 50,000. There w ould also be additional screening along the north property line. At the abutt er’s request, s creening on the east side ha d been changed f rom arborvitae to white pine. DDCDG summarized its February 28, 2020 letter (on file in the Planning Office), which addressed comments f rom the Planning Board, Conservation Commission and M assDEP. Above the soil erosion fencing at the top of the basin , temporary sediment basins would be constructed on an as needed basis. P. Bertram raised concerns she wanted addressed; e.g., the infiltration rate , the depth of the borings , the location of the sep tic system for the nearest abutter in proximity to the end point of the infiltration system. She wanted to see the test pits overlaid on the basin. As stated in previous meetings, DDCDG stressed that the stormwater system ha d been over-designed, even mor e so now in light of the reduction in yield of earth removal. DDCDG requested the Hearing be continued to the next Board meeting on March 23, 2020. P. Bertram made Motion to continue the Stormwater Hearing for 1325 Massachusetts Avenue to March 23, 202 0, 6:35 PM, T. Cole Seconded, all aye. Hearing recessed 7:28 PM. MEETING SCHEDULE: Discussion ensued regarding the upcoming meeting schedule due to COVID -19 legislation that has been enacted allowing for the pausing/delaying the period of time set forth by statutes. A. Burney recommended that the Board hold off on meeting unless they fe lt it necessary to continue doing permits via virtual meetings. P. Bertram was of the opinion that unless there is something that would prohibit the Board from a v irtual meeting, as long as the Board has all the necessary information, it should proceed with meetings. There was discussion of the Board ’s response concerning support that the Historical Commission was seeking for the Community Preservation Act (CPA). Not all Board members were in favor of supporting the CPA at Annual Town Meeting. T. Cole opined that the Board should endeavor to move permits along digitally for the benefit of the applicants, but if appli cants are more comfortable presenting their projects by conventional means, i.e., Board meetings held as usual in Town Hall, that would be the preferred method. Board consensus was to not hold a Board meeting on April 27th. The next Board meeting will be scheduled for May 11 th. DIRECTOR’S ITEMS: Annual Town Meeting, Update- Currently scheduled for June 13, 2020. May 11- Public Hearing, Borrego Solar, 190 Electric Avenue Stormwater and Storm Sewers Bylaw- discussion with CEI consultant BOARD COMMENT: T. In accordance with the requirements of the Open Meeting Law, please be advised that this m eeting is being recorded and broadcast over Lunenburg Public Access and this m eeting of the Planning Board is being conduc ted remotely. The Town of Lunenburg, in response to the COVID -19 (Corona Virus), is currently following the guidance from the Lunenburg Board of Health, Massachusetts Department of Public Health and the CDC rega rding the virus and steps communities can take to prevent the spread and all town facilities are currently closed to the public. The Governor’ s Order, which you can find posted on the Town’s website COVID-19 Information Center page, accessed through the Town Manager’s webpage allows public bodies to meet entirely remotely so long as reasonable public access is afforded so that the public can follow along with the deliberations of the meeting. Ensuring public access does not ensure public participation unless such participation is required by law. This meeting will feature public comment. ANR PLANS: 71 Wildwood Road- The applicant Gerard Croteau, 55 Wildwood Road was represented by Frank Preston, Whitman & Bingham Associates. Mr. Croteau was mistaken as to the locat ion of the property line and thought he owned more land ; therefore, he made an agreement with the owner of 71 Wildwood Road to purchase 0.714 ± acres. P. PUBLIC HEARING: 190 Electric Avenue- see separate minutes. ===PAGE 2=== Minutes 06.08.2020 Page 2 STORMWATER BYLAW: Nick Cristofori, Comprehensive Environmental Inc. (CEI), is the consultant to the Stormwater Task Force and has been assisting in updating the Stormwater and Storm Sewers Bylaw to bring the Town into compliance with the MS4 Permit. He noted few changes needed to be made to the existing bylaw. Changes made were mostly for clarification. The major change was to update the stormwater standards to match the Permit. Under D. Applicability, P. Bertram asked if more LID (Low Impact Develo pment) recommendations should be incorporated into the Bylaw per CEI recommendation. CEI responded some communities have LID handbooks to point applicants in the right direction . P. Bertram’s goal is not just to meet the MS4 standards, but to make a posi tive impact on stormwater contamination. CEI’s interpretation of D. is that any development, regardless of amount of disturbance, will be required to meet these regulations. He opined it eliminate d the one acre threshold and t ied it to anything that incr eased stormwater runoff , e.g., building a garage. This would pull in a lot more projects than a one acre threshold. It would be at the Board’s discretion if it wanted to trigger a permit at less than one acre. CEI felt it would be good to have some sort of acreage as a trigger. A. Burney noted that stormwater compliance was required through site plan approval. T. Cole wanted the Board to stay with the one acre requirement. At a future time, an LID bylaw could be created which could trigger a smaller t hreshold. Board was in agreement with leaving D. Applicability as is, which complied with EPA requirements and kept it strictly to the MS4 Permit. P. Bertram felt municipal, state and federal agencies ( D. Applicability [5] ) should not be exempt from th e regulations. It was decided to eliminate D.[5]. P. Bertram felt the language of F.(2) Standards. should be altered as the Board has not always required 100% compliance with the Massachusetts Stormwater Management Policy. Is it required or does the Board have the ability to lessen those regulations? CEI will review as there is no longer a Massachusetts Stormwater Management Policy , but the Massachusetts Stormwater Handbook. MINUTES APPROVAL: 04.13.2020- P. Bertram made Motion to approve, T. Col e Seconded, Roll Call Vote - P. Bertram, aye; T. Cole, aye; M. Allison, aye. Vote passed 3-0. 04.13.2020, 1325 Massachus etts Avenue - P. Bertram made Motion to approve, T. Cole Seconded, Roll Call Vote - P. Bertram, aye; T. Cole, aye; M. Allison, aye. Vote passed 3-0. DIRECTOR’S ITEMS: Annual Town Meeting, Update- Scheduled for June 13th. Baker Brook (Tri Town Senior Living Facility), Update- A building permit was issued for this, the final building. The developer expected construction to take 16-18 months. A. Burney will prepare paperwork for the State for the Density Bonus Payment. Endorsement of Plans While Meeting Remotely - Discussion ensued authorizing a single individual, e.g., Board Chair, Land Use Director, Board Clerk, to endorse Board-approved plans. P. Bertram was in favor of same, but T. Cole was opposed. Board members will need to come into the office to sign plans. Endorse Site Plan, 1325 Massachusetts Avenue - The final plan was revised to include the changes from the conclusion of th e public hearing. Discussion of Restaurant Outdoor Seating- With the commencement of the Phase 2 Reopening Plan, restaurants are allowed to serve on outdoor patios. A. Burney was approached by some Lunenburg restaurants that would like to initiate outdo or serving. A. Burney and the Building Commissioner discussed allowing this through temporary modifications to site plan approvals. T. The Hearing was to hear and discuss a stormwater management special permit under Ch. 204 of the Code of the Town of Lunenburg for a 2.4 MW photovoltaic system located at 190 Electric Avenue , (Map 077, Parcel 0014), Lunenbu rg, MA. Applicant- Borrego Solar Systems, Inc. 55 Technology Drive Suite 102, Lowell, MA. Property owner - Lunenburg Solar LLC, 259 Turnpike Road Suite 100, Southborough, MA. The applicant was represented by Brandon Smith, Borrego Solar Systems, Inc. The project was permitted by the Board in 2019. They hope to pull a building permit this year, hence the st ormwater permit application. The stormwater permit application was reviewed by Graves Engineering, Inc. (GEI) in letter dated June 3, 2020 . Borrego responded to that review in letter dated June 8, 2020 received in the Planning Office after the close of business. P. Bertram inquired of any changes to stormwater since the Board’s approval in March 2019. Borrego noted slight changes had been made upd ating calculations based on field observations. P. Bertram also inquired what type of stormwater structure this would be classified as under the Stormwater Handbook. Borrego responded a dry detention basin; within 72 hours of a storm ===PAGE 2=== 190 Electric Avenue, Borrego Solar Minutes 06.08.2020 Page 2 event the basin is supposed to be dry. The dry detention basin is to the south with a swale running to the north. The outlet structure is a culvert. Since the 2019 approval Borrego has done more tree surveyin g. As a result, some of the areas of wooded cover have been fine-tuned. Consequently the basin has been slightly enlarged and is now approximately 35 X 55 square feet. There is a large rip rap area to slow down the flow. Post construction/ post stabilization is a grass field. When it rains, the rain will be diverted to the basin. The goal is to ensure there is not a large quantity of water coming off the site. The basin will catch some of the water to cut down the peak flow. During construction, washing and refueling of vehicles w ould take place; most likely in the turnaround area on the east side of the site. P. Bertram had concerns with this due to the limited decontamination of stormwater in this plan. Borrego responded this would take place in an upland area and be surrounded by erosion control measures. P. Bertram noted those measures are not indicated on the plan. The plan will be updated to indicate same and re-reviewed by GEI. T. Cole questioned what updates had been made based on field observations. Borrego d etermined there was a slight modification to what was actually on site. The HydroCAD model was modified for more accuracy as to what was actually on site. There was no change to the tree clearing lines. The property line was also fine-tuned. P. Bertram made Motion to continue the stormwater permit hearing for 190 Electric Avenue to June 22, 2020, 6:35 PM, T. Cole Seconded, Roll Call Vote- T. Cole, aye; P. Bertram, aye; M. Allison, aye.
