ANR PLANS: 111 Mulpus Road- The applicant was represented by Stan Dilli s, Dillis & Roy. The property, consisting of ~18 acres, would be divided into three conforming lots and a parcel to the rear which would be conveyed to a conservation entity (possibly the town of Lunenburg). P. Bertram made Motion to approve the ANR Plan for 111 Mulpus Road, M. Brenner Seconded, Roll Call Vote- P. Bertram, aye; M. Brenner, aye; T. Cole, aye. Vote passed 3-0. 360 Flat Hill Road - Both the applicant Ken Matson, Matson Homes II, Inc. and agent Alf Berry were present. The Plan was initially presented at the April 12 th Board meeting leaving the Board with questions concerning wetlands and access to lots. A. Berry responded that all lots had the required frontage and the applicant was working with the Conservation Commission regarding the w etland issues. The Building Commissioner verbally conveyed to A. Burney that he was of the opinion the applicant complied under Section 250- 5.1. B.(3) as the two lots to the east of the proposed Lot 7 were pre -existing, nonconforming. T. Cole inquired a s to the changes that were made to a new plan received this date. A. Berry noted the changes showed the trees along Flat Hill Road. A. Burney brought to the applicant’s attention that both a stormwater ===PAGE 2=== Minutes 04.26.2021 Page 2 management permit and a scenic road permit would be required. M. Brenner made Motion to approve the ANR Plan for 360 Flat Hill Road, P. Bertram Seconded, Roll Call Vote- P. Bertram, aye; M. Brenner, aye; T. Cole, aye. Vote passed 3-0. APPOINTMENT: 37 Youngs Road, Tri Town Landing, Di Minimis Change - Bill Hannigan, Hannigan Engineering, Inc. represented the developer. The developer w anted to relocate the fire lane seven to ten feet to the north ; further away from the existing playground. The Fire Department was in favor of the change. The currently approved location, located too close to the playground, would require a retaining wall adjacent to the playground. The developer also wanted to inform the Board that they would be constructing a ten (10) foot gazebo with a side walk extension. M. Brenner made Motion to accept the di minimis change of the fire lane at Tri Town Landing, P. Bertram Seconded, Roll Call Vote - P. Bertram, aye; M. Brenner, aye; T. Cole, aye. Vote passed 3-0. PUBLIC HEARINGS: North End Subaru, 757 C hase Road- Continuance requested by applicant to make changes to the plan based on comments received from Graves Engineering, Inc., the Conservation Commission and the Zoning Board of Appeals Hearing. P. Bertram made Motion to continue the Hearing to May 10th, 6:35 p.m., M. Brenner Seconded, Roll Call Vote - P. Bertram, aye; M. Brenner, aye; T. Cole, aye. Vote passed 3-0. P. Bertram made a comment in regards to the previously approved ANR Plan for 360 Flat Hill Road; noting that in reviewing the ANR Handbook, a Planning Board could consider topographical issues, e.g. wetlands, in reviewing ANR Plans. She went on to request that the Board hold a workshop devoted to ANR Plans. T. Cole was in agreement with a workshop. M. Brenner expressed that in an AN R workshop he previously attended, it was noted that needing wetland approval was not a sufficient reason to deny an ANR. 101 Pleasant Street- see separate minutes BRIGHTFARMS: Phase 1 Land Development Plan - A review letter was received from Graves Eng ineering, Inc. noting concerns with the modified Phase I plan. The Phase I plan proposed to raise the building’s finish floor elevation by seven f eet, reconfigure the drainage infrastructure and modify the site grading. Boggio Administrative Assistant Minutes Public Hearing 101 Pleasant Street April 26, 2021 Roll Call conducted by Adam Burney, Land Use Director: Tanner Cole, present; Paula Bertram, present; Matthew Brenner, present. Absent: Matthew Allison, Erik Torgersen Meeting Posted: Yes Time: 6:52 p.m. The Hearing , via Zoom video conference, was to hear and review an application under Chapter 325 Subdivisi on Regulations, Article III, Section 325-3.4. Definitive Plan of the Code of the Town of Lunenburg for a six-lot subdivision consisting of six duplex buildings at 101 Pleasant Street (Map 095, Parcel 0003), Lunenburg, MA. Owner/applicant was MA Pleasant LLC, P O Box 903, Ashburnham, MA. The applicant was represented by Trevor Fletcher, Graz Engineering. The south side of the site was Residence A zoning while the north portion was Commercial. The project would be completely contained within residenti al zoning. The commercial portion would be subdivided off and attached to land on Massachusetts Avenue. The proposed roadway would remain private with a HOA (Home Owners’ Association) created to maintain the road. Each duplex would be served by an on -site septic system with the site being served by town water. Utilities would be located underground. There were extensive wetlands throughout the site, which affected the roadway design. There was a wetland crossing at the entrance with water flowing unde r the gravel path via three stone wicks. The roadway would be raised and lined with two retaining walls. Water would flow under the roadway via three 12 inch diameter culverts. Stormwater would be treated via catch basins, swales, sediment forebay, infi ltration basins and a detention basin. A review letter by Jeff Walsh, Graves Engineering, Inc. (GEI), was issued this date. As all involved parties had not reviewed the letter, GEI did not go through the letter in great detail, but did point out some i tems. Lots 2, 5, and 6 had paved portions of the parking spaces and maneuvering aisle within the 25 foot parking setback. There was only one streetlight proposed ; at the project’s entrance. Drainage calculations needed to be submitted. Sight distance e xiting the site needed to be improved. The curb radius at the entrance partially blocked the driveway on the abutting property. Retaining walls were proposed in the right-of- way on each side of the proposed roadway; they should be moved outside the right -of-way allowing Lunenburg utilization of the shoulder as intended, e.g. possible future utilities, snow storage. Drainage pipes required at least three (3) feet of cover ; the applicant proposed 2.3 feet. Pre- and post - hydrology maps were not available for review. Infiltration and detention basins needed to provide sufficient access for maintenance equipment. ===PAGE 2=== Minutes, 04.26.2021 101 Pleasant Street Pg 2 The DPW Director’s review memorandum stressed that the DPW did not have the resources for mainte nance of the project’s stormwater collection system. The O&M (Operation and Maintenance Plan) did not specify who would be responsible for maintaining the system. A. Burney explained that an O&M puts forth the process and schedule for the maintenance, bu t would not necessarily identify the responsible party. The O&M Plan needed to be updated and possibly reviewed by Town Counsel. The requested waivers were listed on the cover page of the subdivision plan; the applicant needed to submit a formal letter requesting those waivers and the benefit to the public. Gregory Bittner, 32 Sandy Cove Road - Inquired if there would be an affordable housing component with the residential subdivision as there would be more than ten (10) units. A. Burney expanded up on that comment, stating that under the zoning bylaw, any residential development of nine (9) or more units required 10% of the units to be affordable. For a residential subdivision, a form of financial security would be required with the Town in the ev ent any of the work was not completed by the applicant. Both G. Bittner and representatives of 182 Massachusetts Avenue voiced concern with the applicant keeping everything open and honest. Andrea Adams- She was representing her mother who resided at 39 Pleasant Street. She was developing comments on the project, to include comments on the roadway. She opined that the project was significantly encumbered by wetland issues. G. Bittner- Inquired if there was an active road cut moratorium that would have to be taken into consideration. The applicant previously stated that the proposed roadway would remain private with a n HOA created to maintain the road. T. Cole inquired if that could be memorialized through the subdivision approval process. A. Burney maintained that would have to be with the agreement of the applicant, but he would also verify with Town Counsel. P. Bertram questioned if the Board did not have the authority to impose the roadway ownership through the approval process, would it b e able to require a different stormwater management system from the applicant. As the development is only twelve (12) units, M. Brenner voiced concern with the maintenance coming under an HOA. The applicant requested three waivers; all three Board memb ers present were not in favor of waivers for new developments unless there was a compelling reason. T. Fletcher asked for confirmation as to whether the 25 foot setback was from the property line or the street line. A. Burney responded that he would request an opinion from the Building Commissioner. A. Burney recommended the applicant submit justification for the requested waivers and when the Board next met on May 10 th they could vote on both the requested waivers and the setback. This would let th e applicant know if he needed to redesign the subdivision. P. Bertram made Motion to continue the Hearing to May 10, 6:35 p.m., M. Brenner Seconded, Roll Call Vote- P. Bertram, aye; M. Brenner, aye; T. Cole, aye. Vote passed 3-0. Town Meeting - Follow-up for him to discuss the proposal he made at Town meeting concerning Article 28. APPOINTMENT: 84 Lakefront Avenue, Embers Pizzeria - Request for Waiver for Site Plan Approval - Property owner James Xarras noted he received a special permit for dimensional variation from the Zoning Board of Appeals to add a second floor to the restaurant. He was attempting to increase the restaurant size to maintain social distancing and follow CDC guidelines due to COVID -19, yet still maintain economic stability. He would remain within the same footprint. The Board noted parking was a concern as the number of spaces directly in front of the restaurant was limited. J. Xarras asserted o ff street parking would be available along Lakefront Avenue. P. Bertram noted the proposed building addition would not increase the occupancy; it w ould just allow for additional distancing requirements. M. Brenner inquired if there was a possibility the occupancy load could be increased at some point in the future, thereby creating a parking issue. A. Burney noted that if the Board approved a waiver, it could also include Conditions. J. Xarras responded he would agree to a deed restriction limiting ===PAGE 2=== Minutes 05.10.2021 Page 2 capacity to 98 persons. T. Cole requested specificity as to what the applicant was request ing to waive as no parking was s hown on the submitted plan. He also noted that, to be precise, the applicant d id not own any parking spaces ; all the parking space s along Lakefront Avenue were public property. There were 40 parking spaces within walking distance of the restaurant. P. Bertram made a Motion to approve the requested waiver for site plan approval for 84 Lakefront Avenue, Embers Pizzeria, with the stipulation that a deed restriction be put in place limiting the number of seats to ninety-two (92), M. WORKSHOP: Master Plan , RFP- A. Burney was informed by t he Assistant Town Manager , as the contract would be under $50,000, this would be an Invitation For Bid (IF B), requiring the Town to accept the lowest qualified bid. The Board had the discretion to determine the qualifications and also needed to determine what it expected the bidders/consultant to supply. C. Public Services and Facilities should include a listing of town documents for review by bidders /consultant. P. Bertram questioned why, in IV. Deliverables, the town/Planning Board would be looking for a draft of initial findings. She was looking for the completion of two Elements from this contract and wanted to know what tangible items the town/Planning Board would have at the end of the process . T. Cole inquired if the Open Space and Recreation Pla n could be used for the majority of the Open Space Element. A. Burney noted it could possibly cover a portion of Cultural Resources also. T. Cole opined that a good portion of the 2002 Master Plan goals would still be relevant today. P. Bertram wanted i nclusion of how the consultant felt the Master Plan would be implemented. A. Burney responded that normally Implementation would cover the entire Master Plan. The Goals and Objectives, and Implementation Elements, usually happens after all the other Elem ents have been completed. At this point, the Board was only looking at two Elements. P. Bertram responded she anticipated defined objectives from Land Use and Facilities. Andrea Adams noted she had been involved in the writing of master plans in other communities and opined that public hearings/open workshops would be beneficial for community input into the objectives. DIRECTOR’S ITEMS: Review Letter Regarding Board Member - The Board viewed the draft letter, which would be sent to the subject Board member, by both regular and certified mail. Town Meeting, Follow -up- The parking bylaw passed, but the lot size correction for two -family dwellings did not pass. David Maki, 384 Townsend Harbor Road, stressed at Town Meeting there was a housing crisis a nd a hardship would be created by increasing the lot size for two-family dwellings. D. Maki was present at the Board meeting and proposed a definition change ===PAGE 3=== Minutes 05.10.2021 Page 3 whereby a two-family dwelling could be either up and down or side by side. Under the current bylaw, a two -family dwelling was required to share a common wall. This would require side by side units with a larger footprint and create more impervious surface. M. Allison was not against removing the side by side restriction . D. Maki declared that it could be difficult for individuals to find a lot 1.5 times the size required in the zoning district i n which it was located. P. Bertram opined that the lot size correction proposed at town meeting was too restrictive. She went on to state that the definition of two -family wouldn’t allow for accessory housing unless the property contained the appropriate lot area. M. Allison disagreed, stating there was not an area requirement for an accessory dwelling. A. Burney elaborated, s tating there was a definition for accessory dwelling – allowed by right , with restrictions, anywhere there was a primary dwelling. D. Maki was requested to formalize his proposal for the Board. Library Detention Basin - No Operations and Maintenance (O&M ) Plan was available. A. Burney spoke with the Conservation Administrator and was informed that the presence of cattails was not a concern. They were an aggressive species, but not invasive. He went on to note that in the Stormwater Task Force annual bmp inspections, the town’s consultant reviewed the basin, stated it looked good and only needed minor maintenance. A. Burney would also be consulting with the DPW Director. Absent: Erik Torgersen Meeting Posted: Yes Time: 6:57 p.m. The Hearing continuation, via Zoom video conference, was to hear and review an application under Ch apter 325 Subdivision Regulations, Article III, Section 325 -3.4. The continuation this evening was specifically for review of the applicant’s requested waivers and a discussion of the parking setback. The applicant was represented by Paul Grasewicz, P.E., GRAZ Engineering, LLC, and David Plunkett, Esq. Three waivers were listed on the cover page of the site plan: 325- 5.4. Sidewalk Requirement 325- 4.2.B(5) Intersection Radius at Pleasant Street 325- 4.2.E.(1) Dead End Street Maximum Length of 650’ At the initial hearing of April 26, the applicant was requested to formalize the requested waivers. Sidewalk Requirement- P. Grasewicz said the proposed road was a “minor” street, not requiring a sidewalk; therefore he opined the waiver was not required. Intersection Radius- P. Grasewicz stated the applicant met the 30 foot radius requirement on the south side of the project, but the regulations required curb radius plus tangent on each end which placed the project within the driveway of an abutter. The engineer would work to eliminate the need for that waiver by locating the road more northwest to gain the full curbing on the right hand side. Dead End Street- Chapter 325, Subdivision Regulations, have a maximum dead -end road length of 650 feet; the proposed road had a length of 843 feet. Due to wetlands the applicant would not reach useable dry land until 300 feet into the site. Shortening ===PAGE 2=== Minutes, 05.10.2021 101 Pleasant Street Pg 2 the road would result in the loss of lot(s). It was noted that Butter fly Lane, a previously approved subdivision, had a road length of ~765 feet. M. Allison inquired if there was an advantage to Lunenburg to grant the waivers. P. Grasewicz responded the availability of additional housing. M. Allison opined there was no public benefit and that the applicant(s) for Butterfly Lane provided access to conservation land. Attorney Plunkett emphasized the more housing available, the increase in housing affordability. He went on to stress that the increase in the length of the road was not to increase the number of housing lots, but due to the layout of the land. T. Cole noted that under Chapter 250, Zoning Bylaw , 10% of the units would have to be affordable. He opined that waivers should be reserved for pre -existing non-conforming applications. He emphasized that the applicant was aware of the wetlands when he purchased the property and thus, the applicant should have proceeded accordingly. P. Bertram was concerned that the 200 additional feet of pavement would have a significant stormwater impact. M. Brenner asked for confirmation for a waiver to be granted, in addition to a site/topographic condition, a public benefit had to result from the granting of a waiver. A. Burney responded that the Board Rules and Regula tions for Site Plan Approval & Special Permits contained such, and would review the subdivision regulations for same. Andrea Adams, 118 Green Street, Woburn, MA - She spoke on behalf of her mother who resided at 39 Pleasant Street. Noted she had worked a number of years in the planning field. She viewed the subdivision regulations and noted guidance to the applicants specified it had to be in the public interest. She went on to opine that the reason for the road length was to maximize the financial benefit to the applicant. Gregory Bittner, 32 Sandy Cove Road - Echoed A. Adams’ comment that the applicant wanted to maximize the financial benefit and that the project would not be in the interest of Lunenburg. Attorney Plunkett- Stressed that the proj ect was also undergoing a hearing with the Conservation Commission at which wetland issues would be addressed. P. Bertram stated that the applicant would also have to be granted a stormwater management permit from the Planning Board. P. Bertram made Motion to deny the requested waiver from the Code of the Town of Lunenburg, Section 325-4.2.E.(1), T. Cole Seconded, Roll Call Vote- P. Bertram, aye; M. Brenner, aye; T. Cole, aye; M. Allison, aye. Vote passed 4 -0. T. Cole brought to the applicant’s atte ntion the DPW memorandum that was discussed at the April 26 th Hearing. The applicant had previously informed the Board that the road would remain privately owned and went on this evening to stress that in redesign the retaining walls within the right of way would be removed. A. Adams- She inquired if the applicant should withdraw its application due to denial of the waiver, and concerns from both the DPW Director and Graves Engineering, Inc. Attorney Plunkett responded that the applicant would request a hearing continuance. P. Grasewicz requested a continuance to June 28 th. A. Burney would send him the appropriate paperwork to sign and return. Once filed with the Town Clerk, the time clock would freeze between filing and June 28th. G. Bittner- Requested he be supplied with any new data that came into the Planning Office regarding this project. T. Cole made Motion to continue the hearing to June 28, 2021, 6:35 p.m., M. Absent: Erik Torgersen Meeting Posted: Yes Time: 8:01 p.m. The Hearing , via Zoom video conference, was to hear and review applications for site plan app roval and stormwater management permit under Ch. 250, Section 8.4. and Chapter 204 respectively of the Code of the Town of Lunenburg for construction of four 2 -unit townhouse buildings totaling eight (8) units at 711 Massachusetts Avenue Lt 4 (Map 0 59, Par cel 0030), Lunenburg, MA. Owner/applicant was EF Realty, LLC, 654 Elm Street, Leominster, MA. The owner/applicant was represented by Wesley Flis, Whitman & Bingham Associates, hereinafter “W&B” and Eric Fowler, EF Realty, LLC. W&B was designing the project around environmental issues as there was a perennial stream on the western side of the property with associated wetlands. It was noted that the March 10, 2021 Zoning Board of Appeals approval was for two 4 -unit townhouse buildings totaling eight (8) units. The application filed with the Planning Board was for four 2 -unit townhouses totaling eight (8) units. The change was made to accommodate parking between the buildings instead of at the front of the site. There would be two parking spaces per unit. W&B would consult with the Building Commissioner/Zoning Official as to the change in layout from the Zoning Board of Appeals approval. There would be six three -bedroom and two two -bedroom units. The site would be serviced by municipal water and s ewer and there would be a private sub-surface drainage system. A stormwater basin would be located on the westerly side of the site and there would be swales throughout the site. The Board viewed unit architecturals. M. Allison brought up that the per ennial stream was a cold water fishery . He also had concerns with the project location due to Massachusetts Avenue being heavily travelled, the site entrance located on a curve with a nearby road intersection, and also located across the street from a day care center. Board members mentioned various stormwater items; the proposed gate valve in the detention basin , whether or not the applicant planned on having monitoring wells, and the proposed wick drain. It was anticipated that the forthcoming peer r eview would address those items. ===PAGE 2=== Minutes, 05.10.2021 711 Massachusetts Avenue Pg 2 Evergreen screening was proposed on a portion of the east si de of the site , which would assist in shielding house #733 from vehicle lights exiting the site. The site was also at a lower elevation (6-7 feet), which would help to block headlights. As Massachusetts Avenue is a state highway, an access permit for the drive would be required from MA DOT. P. Plans had been revised in response to Graves Engineering, Inc. review letter dated March 17, 2021. The revised plans and response letter were not received by e ither Graves Engineering, Inc. or in the Planning Office in enough time for the Board to review prior to this evening’s hearing. At a Zoning Board of Appeals hearing on April 14, 2021, a special permit was granted to continue the pre -existing nonconforming use. The Board impresse d upon the applicant that delivery vehicles needed to be able to navigate the site without using parking on the side of the public way or backing in off Chase Road. Absent: Erik Torgersen Meeting Posted: Yes Time: 7:30 p.m. The Hearing , via Zoom video conference, was to hear and review an application for a stormwater manage ment permit under Chapter 204 of the Code of the Town of Lunenburg for property located at 150 Holman Street (M ap 0 39, Parcel 00 02), Lunenburg, MA. Owner/applicant was PSG Realty 225-259 LLC, 133 Leominster Shirley Road, Lunenburg, MA. The owner/applicant was represented by Brian Marchetti, McCarty Engineering, Inc. The property consisted of ~18 acres, which would be divided into seven (7) ANR (Approval Not Required) lots ranging from 40,000 square feet to ~3.5 acres. Lots 1 and 2 would have a common drive off Holman Street as would Lots 6 and 7 off Northfield Road. All driveways would be routed to either roadside vegetated swales or rain gardens and rooftops would be routed to dry wells on each lot. The Board was in receipt of Graves Engineering, Inc. review letter dated May 24, 2021; which B. Marchetti proceeded to address. Items addressed were in the categories of Section 204 – Stormwater Management: NPDES Phase II Permits, hydrology computations & MassDEP Stormwater Management, and general eng ineering comments. The Plans would be revised to address the review comments. P. Bertram was concerned with enforcement of the maintenance and inspections required for the drywells, rain gardens and swales. Pea stone diaphragms (stone trench) would fu nction as sediment forebays. B. Marchetti responded that the Conservation Commission would require a notice of intent and order of conditions for each lo t. The Drainage Report included an O&M (Operations & Maintenance) Plan containing an inspection form to be filled out annually by individual property owners and submitted to the Conservation Commission. P. Bertram requested the applicant provide the Board with a SWPPP (Stormwater Pollution Prevention Plan) and stressed to the Board that it should begin r equiring maintenance reports. M. Allison inquired as to the process since the applicant was requesting a stormwater permit for seven (7) lots that had not yet been created. A. Burney responded that the Board would be unable to approve the stormwater permit until the ANR Plan was presented. P. Absent: Matthew Brenner Meeting Posted: Yes Time: 7:19 p.m. The Hearing continuation, via Zoom video conference, was to hear and review an application for a sto rmwater management permit under Chapter 204 of the Code of the Town of Lunenburg for property located at 150 Holman Street (M ap 039, Parcel 0002), Lunenburg, MA. Owner/applicant was PSG Realty 225-259 LLC, 133 Leominster Shirley Road, Lunenburg, MA. The owner/applicant was represented by Brian Marchetti, McCarty Engineering, Inc. In response to Jeff Walsh, P.E., Graves Engineering, Inc. hereinafter “GEI” , review letter dated May 24, 2021, the following changes were made to Lots 5 and 6. Lot 6 was revised to accommodate a four foot retaining wall, which would allow ~15-17 feet of clear width along the property line to the retaining wall. Grading along the northern edge of Lot 5 was revised to accommodate a small swale for runoff from the north. The se changes would prevent stormwater runoff originating on abutting properties from running onto Lots 5 and 6. As these lots would eventually all be under separate ownership, P. Bertram was concerned with stormwater maintenance on the individual lots. B. Marchetti responded that all lots had been approved by the Conservation Commission on June 7, 2021 with conditions that each individual deed contain ed a provision into perpetuity for the homeowner’s annual completion of a maintenance inspection form . Th is form was contained in the Operation and Maintenance Plan (O&M Plan) and would be submitted annually to the Conservation Commission. P. Owner/applicant was Empire Management Corporation, 171 Great Road, Action, MA. The owner/applicant was represented by James T. Almonte, RLA, Principal, Land Design Collaborative , hereinafter “LDC” and Brian Lafferty, Empire Management Corporation . Plans had been revised in response to Graves Engineering, Inc. review letter dated March 17, 2021 and the applicant received a follow -up review letter from Graves Engineering, Inc. on June 11 th. Comments from the last Planning Board meeting were also incorporated into the revised plans. The last Plan the Board received was revised to May 5th. J. Almonte noted the last plan revision was on May 19th; the Board was not in receipt of that Plan. At a Zoning Board of Appeals hearing on April 14, 2021, a special permit was granted to continue the pre -existing nonconforming use. Jeff Walsh, P.E., Graves Engineering, Inc. hereinafter “GEI”, summarized his June 11th review letter. There was a large sub - surface infiltration system at the front of the building that would receive roof runoff. The plans showed a four inch (4”) diameter pipe to the drainage system ; ye the hydrology model stated six inches (6”). The Plan needed to be revised to sh ow a six inch (6”) pipe to be consistent with h ydrology computations. Soil testing for the sub -surface infiltration system had not taken place due to the building’s location and potential impact to business operations. GEI would like to see confirmatory soil testing at some point, preferably no later than start of construction. GEI was comfortable with the turning maneuvers on the site. The current septic system would be utilized, which was designed for 63 employees. A Title 5 inspection wou ld be required prior to occupancy of the new building. There was some Board concern that the system could possibly fail a Title 5 inspection due to its age. It was noted that the Planning Board did not have authority over the septic system , but if a new system was required, the Board’s approval might require a modification. ===PAGE 2=== Minutes, 06.14.2021 North End Subaru, 757 Chase Road Pg 2 P. Bertram inqu ired as to stormwater maintenance; J. Almonte noted it was included in the Stormwater Report. P. Bertram would like the stormwater permit to specify conditions for maintenance and require maintenance reports be provided to the Board. GEI noted that he served on a Conservation Commission which required applicants to annually report to the Commission what happened the previous year rather than have administrative staff receive documents at all different times of the year. Requested waivers were as follows: Section 4.1 f. 2)- Datum Requirements. When Empire Management took over the property in 2005 the existing conditions plan at that time was prepared on an assumed datum. Any renovations/improvements since that time were performed on an assumed datum. Three benchmarks have been set on-site and the applicant would like to continue on an assumed datum. M. Burney Land Use Director Marjorie J. Boggio Administrative Assistant Minutes June 28, 2021 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:30 p.m. CALL TO ORDER: Present: Tanner Cole, Matthew Allison, Paula Bertram, Matthew Brenner, Erik Torgersen, Adam R. Burney BOARD COMMENTS : P. Bertram noted that she would no longer be able to participate in the Economic Development Committee as she was already overextended. ANR PLANS: Fire Road 16- The Applicant, J & A Realty Trust, was represented by Peter Knox. J & A owned ~1 3 acres at 238 Fire Road 16. The ANR Plan would transfer Parcel A consisting of 3,168 S.F. to 272 Fire Road 16. A shed, owned by 272 Fire Road 16, was located on J & A property ; the creation of Parcel A would place the shed on the proper owner’s property. P. Bertram made Motion to approve the ANR Plan for Fire Road 16, M. Allison Seconded, all aye. 830 Massachusetts Avenue - T. Cole announced that he was an abutt er to the property, but had no financial interest. The Applicant, Corinne Scouten, was represented by Greg Roy, Dillis & Roy. The parcel consisted of ~7 acres. The frontage of th e property was located in the Limited Business/Residential District with the remainder in the Residence A District. The Applicant wished to create Lot 2, consisting of ~2.42 acres, to the rear of the property. This would be a reduced frontage lot. It was noted that the width of the existing house, from side lot line to side lo t line did not conform to the zoning regulations. G. Roy responded it was pre -existing, non-conforming. A. Burney noted there was no defined width through a business , nor lot size specified, in Limited Business/Residential. A. Burney understood that in the past, the Building Commissioner ha d told people to follow the requirements for Residence A District. (To be discussed at a future Board meeting.) Board consensus was to seek input from the Building Commissioner prior to endorsing the ANR Plan. The B oard also noted that the division would make the existing lot more non-conforming. G. Roy stressed that if there was a required lot width in Limited Business/Residential, the Applicant would have to comply; but there was not a required lot width through t he building . He went on to explain that towards the rear of proposed Lot 2, there would be 175 feet from side lot line to side lot line. Both A. Burney and G. Roy would consult with the Building Commissioner. The Plan would be carried forward to the July 12th Board meeting. 260 Falulah Road - The Applicant, Fitchburg Redevelopment Authority, was represented by Bill Hannigan, Hannigan Engineering. The property was located in both Fitchburg and Lunenburg. The prior business encroached onto the land of the Fitchburg Redevelopment Authority. Parcel B (in F itchburg) would be conveyed to the remaining land of Fitchburg Redevelopment Authority (Parcel C). Parcel A (in Lunenburg) would be conveyed to 134 Crawford Street in Fitchburg. The Plan would give th e Fitchburg Redevelopment Aut hority additional frontage on Crawford Street . P. Bertram made Motion to approve the ANR Plan for 260 Falulah Road, M. Brenner Seconded, all aye. ===PAGE 2=== Minutes 06.28.2021 Page 2 Old Shirley Road/Leominster Shirley Road (portion of Map 142, Parcel 0007) - The Applicant, Heirs of Paul J. Keating, was represented by Bill Hannigan, Hannigan Engineering. 305 Leominster Shirley Road was previously before the Board for site plan approval. The proposed project was for a change of use a nd at that time the Board granted a waiver from site plan approval. With this ANR Plan, Parcels A and B would be conveyed to the land of Paul Foley, as Receiver (for the previous owner), to form Lot 1 with frontage on Leominster Shirley Road. B. Hannigan’s client, GVC Construction, intended to buy the property once Lot 1 was created. Keating would sell land to GVC Construction to do away with the encroachments at the site rear that extended into Parcel A . The Board voiced displeasure with GVC Constructi on as its requested waiver from site plan approval had been granted, based on the site that existed at that time . Approval of the ANR Plan would change the configuration of the site . M. Brenner made Motion to approve the ANR Plan for Old Shirley Road/Leo minster Shirley Road, E. Torgersen Seconded, Roll Call Vote- E. Torgersen, aye; M. Brenner, aye; P. Bertram, aye; M. Allison, nay; T. Cole, aye. Vote passed 4 -1. B. Hannigan stated he would speak with his client regarding the Board ’s concern. At the ti me of the application for site plan approval, the DPW Director voiced concern with sight distance. A. Burney would speak to the DPW Director regarding this issue. PUBLIC HEARINGS: 101 Pleasant Street- See separate minutes. 711 Massachusetts Avenue- See separate minutes. Burney The Hearing continuation was to hear and review an application under Chapter 325 Subdivision Regulations, Article III, Sec tion 325-3.4. Definitive Plan of the Code of the Town of Lunenburg for a six-lot subdivision consisting of six duplex buildings at 101 Pleasant Street (Map 095, Parcel 00 03), Lunenburg, MA . Owner/applicant was MA Pleasant LLC, P O Box 903, Ashburnham, MA. The applicant was represented by David Plunkett, Esq. Also present w ere Danny Gardner, one of the principals of MA Pleasant LLC and Paul Grasewicz, Graz Engineering. As a result of comments from the April 26 th and May 10 th hearings, the Plan was reduced from six (6) to four (4) lots. No waivers would be requested. The road would remain privately owned and there would be a homeowners’ association that would maintain the road. P. Grasewicz noted the road length was reduced to comply with the subdivision regulations. Reviewing engineer Jeffrey Walsh, Graves Engineering, Inc., here inafter “GEI”, review letter of June 28th noted items that still needed addressing; mainly drainage. There were also review concerns from the DPW D irector that needed to b e addressed. M. Allison questioned the DPW Director requesting 12” catch basin outlet pipes if 8” would be sufficient. A. Burney responded that in theory, if the road remained private, that would not be an issue. A. Burney w ould confer with the DPW D irector as to his requirement. The roadway entrance was shifted to the north to allow for curbing and to negate impeding the driveway of an abutting property owner. GEI noted the review letter of June 28 th covered all outstanding concerns. He did address the wall height at the drive entrance. The exposed retaining wall on the right would be approximately four feet high and on the left, five feet. He recommended guardrails on top of the walls. In response to M. Allison’s earlier questioning of the 12” p ipes, he noted the closest reference he could find was that Section 5. 3.D.(3) of the subdivision regulations called for a minimum diameter of 12 inches for a sub drain. (In other communities he usually saw a requirement for 6 inches.) T. Cole inquired as to the timeclock status on the project. The extension was recorded with the Town Clerk on May 17 th. The project is currently at 81 days. ===PAGE 2=== Minutes, 06.28.2021 101 Pleasant Street Pg 2 Greg Bittner, 32 Sandy Cove Road- Inquired if the Board would be requiring any additional documents, e.g., snow storage in the event it would affect drainage. He also wanted to ensure a financial security would be put in place in the event the Applica nt did not complete the work. Andrea Adams, prior resident of Ple asant Street- Noted her comment letter supplied to the Conservation Com mission on June 14th. She had concerns with the homeowners’ association maintaining the roadway, and was of the opinion that maintenance could possibly fall on the Town by default. Regardless, whether private or public, the street would have to meet the requirements for a public way. She suggested a percentage of the sale price of each unit include the beginning of an escrow account for t he homeowners’ association. Attorney Plunkett had a format that he used for homeowner association agreements. He would forward it on to A. Burney for review by Town Counsel. A continuance was requested to July 12 th. M. Brenner made Motion to continue the hearing to July 12th, 6:35 p.m., P. Bertram Seconded, all aye. The majority of concerns centered on drainage/stormwater management. The Plans would be updated to addre ss those issues. GEI was also looking for more information on sight distance as it was inadequate for a driver exiting the site and looking left towards the center of Town. A daycare center was also located across the street from the site and the site was located clo se to the intersection of Che stnut Street and Massachusetts Avenue. GEI suggested consideration be given to relocating the drive more to the west. T. Cole noted the site was located in the watershed protection district. Burney Also Present: Tree Warden Rob Oliva The Hearing was to hear and review a request under M.G.L. Ch. 40, Section 15C, Scenic Road Designations and under M.G.L. Ch. 87, Section 3, Cutting of Public Shade Trees for the cutting of approximately three (3) trees and construction of four (4 ) driveways onto five (5) lots, with Lots 2 and 3 sharing a common drive at 360 Flat Hill Road (Map 087, Parcel 0025), Lunenburg, MA. Owner/applicant was Matson Homes II Inc., 129 Mason Road, New Ipswich, NH 03071. Ken Matson, Matson Homes II Inc. noted two (2) trees, and possibly a third, would have to be cut o n the common driveway for Lots 2 and 3; two (2) replacement trees would be planted. As Lots 2 and 3 were reduced frontage, T. Cole inquired if each lot required its own access inst ead of a common drive. A .Burney clarified that a common drive was allowable. Wherever portions of the stone wall had to be removed to create the driveways, K. Matson would incorporate those stones back into the wall.
