Burney Land Use Director Marjorie J. Boggio Administrative Assistant Minutes January 10, 2022 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:00 p.m. Present: Matthew Allison, Erik Torgersen, Adam Burney Paula Bertram participated remotely under the Act relative to extending certain COVID -19 measures adopted during the state of emergency. Absent: Tanner Cole, Matthew Brenner ANR PLANS: 44 Northfield Road - The Plan was present ed by applicants John Harrison, Lunenburg, MA, and Tim Sullivan, Lyndeborough, NH. A. Burney informed the applicants he had been contacted by the owner of the abutting property who informed him that the existing sewer tie in for #44 was located where the applicant was proposing the driveway for the new lot. That is something that would be taken up with the Sewer Commission, and was not relative to the Board’s endorsement of the ANR Plan. P. Bertram made Motion to approve the ANR Plan for 44 Northfield Road, E. Torgersen Seconded, passed unanimously. 41 & 47 Reservoir Road - The applicant was represented by Brian Marchetti, McCarty Engineering, Inc. The ANR Plan, which created Lots 9A and 10, was originally endorsed by the Board in January 2020. The My lar was picked up by the applicant and then misplaced; therefore, the Plan did not get recorded at the Registry of Deeds. The applicant was requesting the Board endorse the identical plan this evening for recording at the Registry of Deeds. P. Bertram made Motion to re-sign the Plan for Reservoir Road, E. Torgersen Seconded, passed unanimously. APPOINTMENTS: Lunenburg Central- Presentation by William Hannigan, Hannigan Engineering, Inc. Request for De Minimis Change - The applicant submitted a request for a De Minimis change to the Site Plan approved by the Board. During the title review it was determined that a portion of the property to the rear of the site was formerly owned by the MBTA. There was a clause in the railroad’s deed that prohibited any structures from being built on the old parcel. The retaining wall proposed by the applicant extended into that parcel and the applicant was concerned it could be considered a structure . In addition, no work or grading could be done within 30 feet of the MBTA line without obtaining a permit from the MBTA. It was expected this would be a lengthy process. The applicant was requesting an adjustment to the grading at the rear of the site to provide for the 30 foot buffer. To that end, they would be adding a retaining wall along the rear access drive. With the Board’s approval of the De Minimis change, the applicant would be able to redo the grade, stay out of the 30 foot offset, and build a retaining wall. The Board requested a formal review from Graves E ngineering, Inc. prior to taking a vote to approve the De Minimis changes. As the applicant had an upcoming property closing date of January 18th, it was requested if the Board would ===PAGE 2=== Minutes 01.10.2022 Page 2 approve the De Minimis changes subject to the approval of Graves Engineering, Inc. P. Bertram made Motion to approve the De Minimis change s contingent on a peer engineering review to ensure compliance with sound engineering practices, E. Torgersen Seconded, passed unanimously. Tree Cutting- Follow-up- The Board viewed photographs showing that the tree cutting at the Reservoir Road intersection had been completed per the Board’s Decision. Boggio Administrative Assistant Minutes Public Hearing 225 & 259 Leominster Shirley Road March 14, 2022 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:12 p.m. Present: Tanner Cole, Matthew Allison, Adam Burney Paula Bertram and Erik Torgersen participated remotely under the Act relative to extending certain COVID -19 measures adopted during the state of emergency. Absent: Matthew Brenner The Hearing was to hear and review applications for a stormwater management permit and site plan approval under Chapter 204 and Chapter 250, Section 8.4. of the Code of the Town of Lunenburg 225 & 259 Leominster Shirley Road. (Map 146, Parcels 15 and 14 respectively), owner/applicant PSG Realty 225-259 LLC, 133 Leominster Shirley Road, Lunenburg, MA. Representing the owner/applicant PSG Realty ( Steven Powell ) was Brian Marchetti, McCarty Engineering, Inc. PSG Realty received a special permit for dimensional variation from the Zoning Board of Appeals as the building did not conform to setback requirements, due to the parcel’s unusual shape. PSG Realty planned to construct a 12,300 sf 7 bay garage and reshape the parking areas to provide for better trucking service, maneuverability, and enhanced stormwater management and landscaping. A septic system was located on the property and the building was served by a public well. There was no stormwater infrastructure and all runoff was flowing onto Leominster Shirley Road to existing infrastructure in the vicinity of Route 70. The site consisted of approximately 2.36 acres with almost 85% of the site impervious. The existing garage will remain operational until the new building is buil t. Parking spaces would be located on the right side of the property for employees and visitors. The main body of the building would be the garage, with the office located on the left hand side. PSG Realty would maintain the setbacks approved by the Zon ing Board of Appeals. There was approximately 84,000 sf of impervious area; this would be reduced by approximately 4,000 sf. The existing septic system would stay in operation during construction, but the existing well would be decommissioned. PSG Realty would be proposing, to the Water District, an extension of the water main from Keating on Reservoir Road all the way to Route 70. PSG Realty was aware that the building could not receive an occupancy permit unti l the water main was extended. The proposed site would be graded for a stormwater collection system. Catch basins would be located next to the office and on the eastern portion of the site. The infiltration basin was proposed to be located where the current septic system is locate d. Due to th is, PSG Realty asked for the stormwater soil testing to take place during construction. Catch basins are located along Leominster Shirley Road and there is a pipe network for stormwater infrastructure along Leominster Shirley Road. Once the ne w DPW Director is on board, PSG Realty will work with that individual to locate that infrastructure for tie -in. The septic system would be reconstructed. ===PAGE 2=== Minutes, 225 & 259 Leominster Shirley Road Pg 2, March 14, 2022 Due to cancellation of the February 28 th Board meeting, PSG Realty had the opportunity to revise and resubmit plans based on review from Graves Engineering, Inc. (GEI). Based on GEI review, remaining outstanding items were:  Non-compliance of the pavement setbacks; however, the proposed improvements better organized the sit e, curb cuts, and improved landscaping along Leominster Shirley Road.  Soil testing had not been performed; however, B. Marchetti responded that was due to the current septic system being located under a paved area within the footpr int of the proposed infiltration system. With Board approval, soil testing would be conducted once the replacement septic system was constructed. M. Allison had concerns with the recharge being proposed over the existing septic. Given the footprint of the existing building and location of new building, little room was left for naturally existing soils. B. Marchetti noted t he footprint of the septic system would be over -excavated and removed. The soil was very sandy and depth to bedrock was not a conce rn; t here would be significant depth of natural soil. In viewing Board of Health plans, the existing system was very shallow. The existing system was located on the right side of the parcel; the proposed system would be located on the left side of the si te. P. Bertram inquired if soil testing had been done at the proposed location of the septic system. It was done a while ago by PSG Realty and based on the soils excavated at adjacent properties, the sand was deep. The system would be sized per vehicl e bay and office. In reviewing department comments, per the Board of Health Agent, P. Bertram requested the Board’s Conditions specify dust mitigation. Per Stormwater Permit Standard Conditions, the stormwater infrastructure needed to be installed, and functional, at the beginning of site work . As PSG Realty would be placing the drainage system where the septic system was located, A. Burney made the Board aware that this would be an alteration to the Standard Conditions. Some Board members voiced co ncerns not knowing whether there would be a well or public water, the timeline on the Water District’s approval as to the extension of the line, soil testing not being performed in the location of the proposed septic system, and what would happen to the st ormwater during construction as the stormwater system would not go in until after construction. B. Marchetti responded that the building could be installed first as that would go where there is currently pavement. He str essed that a SWPPP (Stormwater Pol lution Prevention Plan) would be submitted and sediment and stormwater would ha ve to be controlled during construction. The application for extension of the water main was filed with the Water District in summer 2021 and was currently under review. B. Ma rchetti stressed that some of these issues were building permit issues and a building permit would not be issued until these items were finalized. T. Cole suggested that the hearing be continued until PSG Realty had a decision from the Water District. B. Marchetti strongly felt that the Water District would agree to extension of the main. A. Burney recommended the hearing be continued to allow time for resolution of some of the outstanding issues. M. Allison made Motion to continue the hearing to Marc h 28, 6:05 p.m., P. Absent: Matthew Brenner The Hearing was to hear and review a request under M.G.L. Ch. 40, Section 15C, Scenic Road Designations and under M.G.L. Ch. 87, Section 3, Cutting of Public Shade Trees to remove trees and a 50 foot section of stone wall for a new driveway at 780 Northfield Road (Map 038, Parcel 0017), Lunenburg, MA. Owner/applicants were James and Allison Lattanzi, 331 Marshall Road, Fitchburg, MA 01420. J. Lattanzi noted he and his wife owned Hollis Hills Farms in Fitchburg, a short distance from the Lu nenburg line. 780 Northfield Road was the site of Pierce’s Christmas Tree Farm property , which J. Lattanzi had purchased . He would be oper ating both businesses which required significant travel of farm equipment between the two locations. He had concerns with the intersection of Northfield Road and Chase Road as it was historically dangerous. He felt that dealing with that intersection posed high risk to his equipment, himself and his staff. If he was allowed the new farm access road, he could avoid that intersection. He would remove four trees that were in the Town’s easement, and open up that section of stone wall to enter the property. The Conservation Administrator had noted to A. Burney that was considered agricultural land under normal impro vement and therefore w as exempt from conservation review. J. Lattanzi noted he had also spoken with the Tree Warden, who noted he had no issues with the tree removal. T. Cole opined that a 50 foot wide drive was rather excessive. J. Lattanzi responded t hat the drive itself would not be 50 feet wide, only the road opening. This would accommodate the turning of his farm equipment. Board members decided to schedule a site visit to get a better understanding as to location of proposed drive and trees be ing removed. The visit was scheduled for Monday March 21st, 5:00 p.m. M. Owner/applicants were James and Allison Lattanzi, 331 Marshall Road, Fitchburg, MA 01420. J. Lattanzi recently purchased this property after leasing it for the past 10 years for a haying o peration. Four to five acres at the southernmost portion of the property are used for haying. The current ingress/egress is opposite an intersection and on a dangerous curve in Lancaster Avenue. The proposal was to move the ingress/eg ress further south. The one tree J. Lattanzi wished to remove was located in the center of the proposed drive. Ch. 87, Section 3, Cutting of Public Shade Trees to remove 21 trees and prune 2 trees along Leominster Road under the Unitil Reliability Project. Owner/applicant was Unitil, 357 Electric Avenue, Lunenburg, MA. Unitil was represented by Keith Caribo, Manager of Electric Operations, and Dave Clapham, Forestry Supervisor. Circuit 30W30 was one of the two circuits that fed Lunenburg; the back side of West Street, down Lancaster Avenue, the center of Lunenburg, and down Leominster Road. To help the reliability of its facilities this project was to re -conductor down Leominster Road to Kilburn, Goodrich and over to Lancast er to make a circuit tie. Once completed, there would be four different ways for Unitil to feed its facilities. One of the roads that would be most impacted would be Leominster Road so D. Clapham took a look at what needed to be done for the most reliability and the least impact. The trees ranged from three inches to thirty plus. Some of the proposed trees already had contact with the existing power li nes. The trees earmarked for removal/trimming had been marked. Poles would be replaced and lines wo uld be placed three to seven feet higher than the current placement. There would be a one for one replacement, working in coordination with the Tree Warden. M. Burney Land Use Director Marjorie J. Boggio Administrative Assistant Minutes Public Hearing 780 Northfield Road March 28, 2022 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:14 p.m. Present: Tanner Cole, Matthew Allison, Paula Bertram (arrived 6:05 p.m.) , Matthew Brenner, Adam Burney Erik Torgersen participated remotely under the Act relative to extending certain COVID -19 measures adopted during the stat e of emergency. The Hearing continuation was to hear and review a request under M.G.L. Ch. 40, Section 15C, Scenic Road Designations and under M.G.L. Ch. 87, Section 3, Cutting of Public Shade Trees to remove trees and a 50 foot section of stone wall fo r a new driveway at 780 Northfield Road (Map 038, Parcel 00 17), Lunenburg, MA . Owner /applicants were James and Allison Lattanzi, 331 Marshall Road, Fitchburg, MA 01420. J. Lattanzi requested T. Cole recuse himself from the hearing under M.G.L. 268A C onflict of Interest regarding a perceived financial interest. T. Cole declined to recuse himself, stating he did not see a financial interest. Board members conducte d a site walk on Monday March 21 st. Subsequent to that site walk , J. Lattanzi submitted an updated plan showing where the proposed driveway would be located. The proposal was the removal of 40 f eet of stone wall and three trees. At the site walk T. Cole requested the applicant remove only 30 feet of stone wall. The applicant opined that th e 40 feet would be safer to allow for the turning radius of farm equipment coming from a narrower roadway entering onto Northfield Road. One of the proposed trees to be removed was within the 10 foot area T. Cole did not want disturbed. The applicant opi ned the tree , if not removed, would impede the entering of farm equipment even if the drive was reduced to 30 feet. P. Bertram asked for clarification on the turning radius of the farm equipment as she also felt 30 feet would be sufficient. The applicant responded that a hay bailer and hay wagon was upwards of 80 feet in length. Northfield Road was narrow so a wide entrance would be needed for swinging into the site. T. Cole noted the land has been in agricultural production and already had an existing access. The applicant noted with the change in ownership, the type of equipment has changed. The applicant viewed this as a safety issue. M. Brenner stated his home proximity to the site and questioned if he should recuse himself; A. Burney responded he lived well outside the radius and it would not be necessary. Nancy Yasko, 146 West Townsend Road- She inquired as to the proposed use of the property. She went on to note that in 2018 earth removal took place on the site. At that time there were issu es with pollution, air quality, and dust. She had the understanding that more earth would now be removed from the site ; she did not want residents on Northfield Road to go through what she did in 2018. T. Cole responded that this hearing was strictly for a scenic road, but that he would steer N. Yasko in the right direction for her concerns. ===PAGE 2=== Minutes, 3/28/2022 780 Northfield Road Page 2 Tom Alonzo, 284 Lancaster Avenue (also a Select Board member) - Due to safety concerns; he was in favor of permittin g the scenic road permit. The applicant, in response to N. Yasko , noted that he intended to continue with the farming use on the site. There was no intention of earth removal. T. Cole reiterated his concern with the proposed drive width. P. Bertram inquired as to the amount of land disturbance that would be required to put in the road. J. Lattanzi responded the roadway would be a maximum of 50 feet wide for approximately 225 feet. Although P. Bertram would prefer a width of 40 feet instead of 50, she would not withhold approval if J. Lattanzi felt he needed 50 feet from a farm perspective. M. Brenner opined that every time something is approved on a scenic road, it becomes less of a scenic road , but not having any farming knowledge, if J. Lattanzi stated the equipment needed 50 feet, he was in agreement. M. Allison made Motion to close the hearing, P. Bertram Seconded, Roll Call Vote - M. Brenner, aye; P. Bertram, aye; M. PUBLIC COMMENT: M. Allison noted that on Sat urday March 26 th the Select Board held a site walk at the Village at Flat Hill concerning the ongoing drainage issue. PUBLIC HEARINGS: 225 & 259 Leominster Shirley Road- See separate minutes. Hearing closed. A draft Decision would be prepared for the next Board meeting. A. Burney noted he would remove the Condition specifying installation of drainage system prior to construction based on discu ssion at the initial hearing. 780 Northfield Road - See separate minutes. Hearing closed. M. Allison made Motion to approve the scenic road application for 780 Northfield Road as presented, P. Bertram Seconded, Roll Call Vote - M. Brenner, aye; P. Bertram, aye; M. Allison, aye; E. Torgersen, aye; T. Cole, aye. Passed unanimously. A Decision would be prepared for the next Board meeting. DECISIONS: 1255 Lancaster Avenue- The Board reviewed, edited, and endorsed the Decision. Unitil- The Board reviewed, edited, and endorsed the Decision. DISCUSSION: Zoning, Infrastructure and Master Plan- M. Allison requested this agenda item. He inquired as to the status of the proposed 40B on Howard Street. The applicant requested to extend water and sewer 2 -3 miles beyond where it currently exists for the benefit of supplying services to the proposed 40B . M. Allison felt the residents in that area should be made aware of the possibility of the 40B going through and how it could affect them. He was of the opinion that the line should be made available to all residents located along that 2 -3 mile stretch. If the line is to be “forced” on the Town, the Town should look at how (the expense) to make it a fully serviced line. Board members commented that was a question for the Sewer Commission. A. Burney added that if it was a “private” line (strictly for the proposed 40B), the installation would be the developer’s financial obligation; this would prevent any other connections. If the line was “publi c” (available to all residents along that line), the financial obligation would fall to the Town. If public, it would ha ve to meet the betterment standards for the residents along that line and it would have to be wanted by at least 75% of the people on that line. The Town would also have to vote to approve extending the SSA (sewer service area ). T. Cole noted if the line was public and all the residents along it could tie in, it made a significant impact on development of the parcels in that area. At this point, there was not enough information for continued discussion. The Board would wait to see whether the State approved or denied the 40B. MINUTES APPROVAL: P. Bertram made Motion to approve all minutes listed below, M. Allison Seconded, Roll Call Vote- M. Brenner, abstained; P. Bertram, aye; M. Allison, aye; E. Torgersen, aye; T. Cole, aye. DIRECTOR’S ITEMS: Warrant Articles for Annual Town Meeting - The three proposed Board Articles were submitted to the Town Manager. The Water District Superintendent would be in attendance at the Board’s hearing on April 11th for the Articles. Zoning for MBTA Communities - Legislature passed requiring any MBTA community to have a zoning district of reasonable size in which multi-family housing would be permitted as of right. A minimum density of 15 housing units per acre was required. If an MBTA community d id not comply it would no longer be eligible for funding from the Housing Choice Initiative, local Capital Projects Fund and Mas sWorks infrastructure program. Lunenburg was considered an MBTA adjacent community as Fitchburg, Leominster and Shirley ha d MBTA stations. Lunenburg would be required to have a district of 50 acres that would support 15 units per acre. This would provide a minimum of 750 housing units. The Board was provided with the timeline for compliance. By the end of 2022, DHCD w ould have to be notified that Lunenburg was not in compliance, but a plan would have to be submitted as to how Lunenburg would reach compliance. For comparison, A. Burney informed the Board that Emerald Place had 8 units per acre on 22 acres. The requirement would be more than twice the size and density of Emerald Place. A. Burney recommended the Town work towards compliance and in the meant ime he and the Town Manager would explore the financial impact of the grant programs that would be shut off from Lunenburg if it did not comply.
