Burney was reaching out to various town bodies regarding a meeting for discussion of the anticipated project. Zoning for MBTA Communities - A. Burney was seeking clarification from the Board that it did not intend to make an effort to comply. Board members had differing opinions ; T. Cole felt it should be more of a community decision instead of a Planning Board decision due to possible financial implications to the Town, M. Allison indicated opposition to compliance, and M. Brenner felt working towards compliance was acceptable with the understanding that the Board could stop if it so desired. A. Burney noted an upcoming planning assistance grant from the state up to $50,000 with a 25% match. He had discussion with the Town Manager of filing for the grant and looking for money to hire a consultant to work through the initial stages. Burney was working with Town Counsel on the preparation of a 40B workshop. Scenic Road Construction at 360 Flat Hill Road - Susan Whalen, an abutter to the site, contacted A. Burney and informed him that the applicant started reconstructing the ends of the stone walls. It was her opinion that the stone wall had not met the expectations of the Board’s Scenic Road Decision and that the wall was too constructed/planned as compared to the typical stone walls in Lunenburg. She also voiced concern as to the driveway width. A. Burney was to confirm that the width was appropriate. M. Allison informed the Board that he was an abutter and it was also his opinion that the wall did not fit the character of a stone wall. He went on to state that the opening was in excess of thirty (30) feet. The Scenic Road Plan ind icated twenty-four (24). Susan Whalen, 377 Flat Hill Road - Agreed with M. Allison that the reconstruction did not reflect the existing style of the wall. If there were extra stones left over, she inquired as to how they would be used. It was also noted that Unitil had a pole petition in front of the Select Board to locate a new pole in fr ont of Lot 2; that petition was withdrawn. A. Burney expected the applicant would return to the Board to realign the lot lines to use the existing pole for electricity to Lots 2 and 3. S. Whalen inquired as to the drainage on Lot 4. A. Burney spoke to the builder; none of the Cultec Chambers had been installed. She also noted that the applicant was violating the construction hours. A. Burney would view the site and follow up on the abutter’s concerns. MEETING SCHEDULE: June 13- Hearings- 494 Electric Avenue June 27 ONGOING ITEMS: Zoning for MBTA Communities Zoning, Infrastructure and Master Plan Pond View Commons, LLC BOARD COMMENT: M. Allison - Opined that there was a lack of communication/information distribution between various boards/commissions. He brought this forth as a result of the Planning Board not being made aware of the pole petition on a scenic road. ADJOURNMENT: M. Brenner made Motion to adjourn, M. Allison Seconded, Motion passed. Burney Land Use Director Marjorie J. Boggio Administrative Assistant Minutes Public Hearing, 245 Holman Street May 23, 2022 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:43 p.m. Present: Tanner Cole, Matthew Allison, Matthew Brenner, Amanda Reid Adam Burney Adam Burney participated remotely under the Act relative to extending certain COVID-19 measures adopted during the state of emergency. Absent: Erik Torgersen The Hearing was to hear and review an application for a stormwater management permit under Chapter 204 of the Code of the Town of Lunenburg for six lots at 245 Holman Street . Applicant- Harbor Classic Homes, LLC, Leominster, MA. Owner- Bray Ave 9, LLC, Leominster, MA. The applicant was represented by Brian Marchetti, McCarty Engineering. This was a 10 -acre parcel on the corner of Holman and Northfield (aka 245 Holman). The parcels had been designed for, and received approval from the Board of Health for septic systems. Lots 1 and 5 would be served by a common driveway, as would Lots 3 and 4. The applicant was meeting all the required MA DEP standards for stormwater management except for the peak flow rate. Lunenburg’s bylaw required 60% total phosphorus (TP) removal and retention of runoff of 1.0 inch. Lot 5 was the only Lot that did not meet those requirements as the groundwater level was really high. Even with rain gardens the applicant could not attain a two foot separation to groundwater. A waiver was requested for Lot 5 for the 60% TP removal. A pea stone diaphragm was provided for Lot 5. Water would sheet flow off the driveway, be treated through the pea stone diaphragm and continue to discharge to the west and north to an existing drainage channel. Lots A, 1, 2, 3 and 4 would each have a pea stone diaphragm and rain garden. Peer review was provided by Graves Engineering, Inc. (GEI), Worcester, MA. M. Allison asked for the overages on not meeting the rates for Lot 5. Two different points of analysis were used for the site. There was no drainage infrastructure in either Northfield Road or Holman Street . The majority of runoff from Lots A, 1 and 2 would flow to Northfield Road then to the drainage ditch at the southwes t. Runoff from Lots 3, 4, and 5 would flow to a drainage swale to the north and then to a river. T. Cole asked if there was any alternative to pea stone diaphragm and rain garden for Lot 5 to allow the applicant to meet the groundwater offset. B. Marchetti responded the only other solution would be to raise the entire site. Of concern to the Board were the pre- and post- development peak runoff and the waiver request from the 60% treatment of TP on Lot 5. Also of concern was the project’s proximity to Mulpus Brook causing a possible detrimental effect to Hickory Hills. B. Marchetti emphasized that it still met both DEP and Lunenburg stormwater regulations. T. Cole remembered doing the ANR Plan and a common drive but did not recall if both common drive s were approved by the Board as neither split the lot line. Both T. Cole and A. Burney recalled the Board approving the common drive for Lots 1 and 5. Board members were interested in viewing the previously Board-endorsed ANR Plan. M. Allison made Motion to continue the hearing to June 13, 6:05 p.m., M. Brenner Seconded, Motion passed. A one-year extension was requested to the Site Plan Approva l that was filed with the Town Clerk on July 13, 2021. Construction had not begun due to escalating costs, shortage of skilled laborers and shortage of vehicle inventory. M. Brenner made Motion to extend the expiration date of the Site Plan Approval to J uly 23, 2023, A. Reid Seconded, passed unanimously. REQUEST FOR DE MINIMIS CHANGE: Lunenburg Central, Leominster -Shirley Road- The owner was represented by Chris Anderson, Hannigan Engineering. Two de minimis changes were requested. One to the underground storage system , which originally was an arch chamber system for stormwater detention, but due to materials delay a product modification was proposed. A concrete galley system was proposed for a replacement. The second requested change was relative to the installation of a curtain drain. During construction the site experienced significant groundwater influx from the abutting wash ponds on the Keating property. During preliminary testing , groundwater was not encountered at levels the applicant was currently seeing. Unbeknownst to the applicant there was a ditch that flowed through the property that was used as more of a relief drain. As a result of leveling of the site, the level of water in the pond started to rise. This negatively impacted the groundwater in the area. For long-term viability of the stormwater system, the applicant proposed to install a curtain drain that would run along the westerly property line to intercept any high groundwater that occurred. The sub drain would be set 3 -4 feet lower than the underground storage system. Any groundwater that was captured would be transmitted under the building to the opposite side of the site and follow the same general path as the original ditch. Both requested changes were reviewed and approved by Jeffrey Walsh, Graves Engineering, Inc. M. Brenner made Motion to approve the requested De Minimis changes for Lunenburg Central, Leominster Shirley Road, A. Reid Seconded, passed unanimously. Below Agenda items taken out of order. PUBLIC HEARINGS: 494 Electric Avenue, Il Forno- See separate minutes. Northfield Road & Holman Street (aka 245 Holman Street) - At the applicant’s request, M. Applicant/owner D&A Lunenburg, LLC, 494 Electric Avenue. The applicant was represented by Christopher Anderson, Hannigan Engineering. The project had recei ved Zoning Board of Appeals approval for a dimensional variance for the building addition. A tent was erected for seating during the COVID restrictions. As a tent, it was not functional for outside seating during the colder months. The tent was approxim ately 30 x 60 feet; the new building would be 30 x 50 feet. It would add additional floor area, but not increase seating due to spacing that would be in place. The following letter was received and read into record. “We are unable to attend tonight’s Lunenburg Planning Board meeting and ask that this communication be read in support of Michael Mohamed, owner of Il Forno Restaurant location 494 Electric Ave Lunenburg, MA, regarding his application to make the tented area of the restaurant a permanent st ructure. We are the main abutters to this property owning both 480 Electric Ave and 15 Kirby Avenue. Mr. Mohamed has been a collaborative and respectful neighbor. He is a community minded business owner who is considerate of his neighbors and the commun ity he serves. We have agreed in collaboration and at the request of neighbors to fence the back of 15 Kirby Ave between our properties. We are in support of Mr. Mohamed’s application. Sincerely, Michael R. and Tammy D. Lovewell, 579 Reservoir Road, 480 Electric Avenue, 15 Kirby Avenue. One of the reasons for the requested fencing was due to possible vehicular lights from the restaurant parking lot into 15 Kir by Avenue (residential property). Linda Perenzin, 20 Pierce Avenue - She was c oncerned with overflow parking into the residential area. She had cleared a portion of the land across the street from her property for visitors. She went on explain that her water line came from Leominster and the shutoff was located in the portion of the property sh e had cleared. Patrons to the restaurant were parking there. She was aware that the property didn’t belong to her, but stressed that neither did it belong to D&A Lunenburg LLC. A. Burney pointed out that Pierce Avenue was a public way and individuals were not prohibited from parking on public ways. ===PAGE 2=== Minutes, 494 Electric Avenue Page 2 Michael Mohamed, 494 Electric Avenue (Il Forno) - He stated that he did not have the authority to tell individuals they could not park on Piece Avenue. He offered to er ect No Parking signs across from L. Perenzin’s property. The Board noted he did not have the authority to erect No Parking signs on property he did not own. Code of the Town of Lunenburg, Section 250-6.1. Off-street parking and loading areas , required one space per three seats plus one space per employee on the largest shift. The restaurant had 134 seats and 48 parking spaces. Seating capacity was not increasing; only floor space. At the time this project was permitted , parking calculations were base d on the number of tables . This section of the bylaw was updated in May 2021. David Rodgers, 84 Highland Street- Spoke in favor of the application. M. Allison stated he didn’t feel the submitted plan was appropriate for site plan review as the curre nt tent was larger than the proposed permanent structure. He was of the opinion that a plan should be submitted sh owing the permanent structure and offsets to the property line and existing building. The Board reviewed the below requested waivers f rom the Board Rules and Regulations for Site Plan Approval & Special Permits. Section 3.7- Review by Consultants Section 4.1 h- Impact Reports Section 4.1 f 2)- Plan prepared at a scale of 1”=40’ Section 4.1 f 8)- Showing existing and proposed utilities Section 4.1 f 16)- Existing significant trees Section 4.1 f 20)- Traffic data Section 4.1 f 22)- Photometric plan Section 4.1 f 23)- Architectural elevations The Board requested erosion/sedimentation control s. The applicant would provide live loading for the soils. The front of the site drained towards Electric Avenue. A silt sack would be provided in the first catch basin. Burney Land Use Director Marjorie J. Boggio Administrative Assistant Minutes Public Hearing 43 Summer Street June 27, 2022 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:49 p.m. Present: Matthew Allison, Amanda Reid, Matthew Brenner, Adam Burney Absent: Erik Torgersen Tanner Cole participated remotely under the Act relative to extending certain COVID -19 measures adopted during the state of emergency The Hearing was to hear and review application s for site plan approval and permits under Chapter 250 Sections 8.4., 4.15. and 4.8. respectively of the Code of the Town of Lunenburg for an adult-use marijuana facility. The applicant, Uma Flowers, was repres ented by Attorney Valerio Romano. Also in attendance were co -founders of Uma Flowers, Priyanka Patel and Tejal Patel ; project engineer Ian Ainslie, Meisner Brem Corporation (MBC) ; and various Uma Flowers representatives on-line. The proposal was for an a dult-use marijuana retail facility. MBC revised the plans to address any issues per the June 24 th peer review letter from Graves Engineering, Inc. (GEI). The principal building was approximately 4,200 sf and in use as a restaurant/tavern. A secondary ac cessory building on site was used as a residence. In order for the project to be approved, the use of the residential building would be discontinued. There were two existing curb cuts on Summer Street and one on Youngs Road. All curb cuts would be two -way. Portions of the existing parking and principal building encroached onto the Summer Street Right of Way. Approximately 9,000 sf of on -site pavement would be removed. This would remove the encroachment on Summer Stree t and improve traffic circulation. A perennial stream was located on the east side of the site. MBC would create more of a buffer to the existing brook through plantings. The majority of the paved area drained east towards the stream. The grade rose to create a ridge before dropping of f to the stream; therefore, the end result was runoff becoming trapped and ponding near the eastern edge of pavement. In addition to reducing pavement an infiltration trench woul d be constructed in the area where the ponding occurred. Uma Flowers planned to abandon the use of the accessory building. If they chose to utilize the building in the future, they would return to the Board. A security plan was submitted to the Police Chief for review. Hours of operation would be 10:00 a.m. to 9:00 p.m. Monday through Thursday, 10:00 a.m. to 10:00 p.m. Friday and Saturday, and 10:00 a.m. to 6:00 p.m. on Sunday. Uma Flowers met with the Fire Chief who requested a Knox Box. Both the Fire and Police Chiefs would have keys for access to the facility. T. Cole aske d if the Board needed to approve any signage. There was an existing sign along Summer Street which would be refaced for the new business. Product delivery would be made to the side door of the facility. The delivery individual would be escorted to the r eceiving vault by an Uma Flowers employee. Once the delivery was accounted for , the driver would be escorted back to the exit door. The dispensary would occupy approximately 2,900 of the 4,200 sf building. The remainder of the building would be vacant. Parking calculations were based ===PAGE 2=== Minutes, 43 Summer Street Pg 2, June 27, 2022 on the 2,900 sf of usage. The Board had concerns with not knowing the possible future use of the remaining square footage in the principal building and the vacant residenti al structure. The applicant was applying for three permits: a Special Permit for the use, a Special Permit for work within the Floodplain Overlay District, and Site Plan Approval. The Board could condition tha t future development return for permitting as the approval would be restricted to the cannabis retail establishment only, and A. Burney was of the opinion that it could also be noted the establishment was permitted under the Commercial District and that would provide future information to Boards assessing future applications that they be made under that same zoning district. Linda Morin, 151 Youngs Road- She voiced concern with an unknown potential future commercial use of the two vacant spaces. Attorney Romano requested a continuance to the Boa rd’s July 11 th meeting. Burney noted in the Use Table that motels were by right in the Comme rcial District and he believed the Board would prefer motels to be by special permit. The subject would be added to the next Board agenda. Common driveways were by right in Lunenburg if it met the stated criteria. As A. Burney researched surrounding com munities, he found many required special permits for common driveways. The Board needed to find a balance of w hat it felt was reasonable. If it chose to continue with the by right, it could incorporate more specificity into the construction. Over the past few years, common driveways in Lunenburg caused more trepidation than benefit. Would the Board be open to more than two lots on a common driveway? A. Burney pointed out that a fee could be set for common driveways. Discussion would continue at future Board meetings. The Hearing was to hear and review a request under M.G.L. Ch. 40, Section 15C, Scenic R oad Designations and under M.G.L. Ch. 87, Section 3, Cutting of Public Shade Trees to remove five trees for equipment access for installation of a sewer line from the street to the house, and replacement with two Maple trees at 235 Leominster Road (Parcel 080-0040-00), Lunenburg, MA. Owner was Joseph Dignam Jr., 235 Leominster Road, Lunenburg, MA. Applicant was William R. Proctor Inc., 390 Electric Avenue, Lunenburg, MA. William R. Proctor Inc. was represented by Dan Proctor. The property owner reques ted to tie into the sewer as a result of a failed Title 5. D. Proctor explained that he had cut the trees down before coming to the Planning Board. He always thought if there was a sewer stub that the sewer line was to the property line ; but the trees were located in the right -of-way. Board Chair, M. Allison noted a letter from the DPW Director that stated the trees were in the path of excavation and that they be replace d to avoid interference with the sewer connection. M. Brenner questioned why the fiv e trees that were removed were being replaced by only two trees. D. Proctor responded that trees are not planted on top of a sewer line due to root infiltration. M. Brenner made Motion to close the scenic road hearing for 235 Leominster Road, A. Reid S econded, Roll Call Vote - E. Torgersen, aye; A. Reid, aye; M. Brenner, aye; M. Allison, aye. APPOINTMENT: Karen Chapman, MRPC - With the assistance of MRPC, Lunenburg had applied for a grant through the state for compliance with MBTA Communitie s zoning requirements. After input from rural communities, DHCD (Department of Housing and Community Development) made some change s to the compliance guidelines and issued final guidance in August. The requirement for 750 units no longer applies. The De finitions also changed with the addition of “adjacent small town”, which is the category for Lunenburg. Only 5% of the community’s housing count would have to be multi -family units; this would be 240 units. Lunenburg would have to zone for 240 units at 15 units per acre. Up to 10% of the units could be affordable housing. (That would be superseded by Lunenburg’s inclusionary housing of 15 %.) K. Chapman believed that if a community had a 40R District, which Lunenburg does, th en it could have up to 20 %. The Action Plan deadline is January 31, 2023 with the District Compliance deadline being December 31, 2025. MRPC w ould be trained on the compliance model. There is also a draft model bylaw on the MHP (MassHousing Partnership) website. The requirement could also be met through an overlay district. A. Burney felt that Lunenburg’s challenge would be the infrastructure outside of a sewered area that goes along with this density. PUBLIC HEARINGS: 3 Lancaster Avenue- See separate minutes. M. Brenner made Motion to approve the Site Plan Approval for 3 Lancaster Avenue, A. Reid Seconded, Roll Call Vote- E. Torgersen, aye; A. Reid, aye; M. Brenner, aye; M. Allison, aye . 235 Leominster Road- See separate minutes. M. Brenner made the point that anytime the Board approved something along a scenic road, it made the road less scenic, e.g. taking down five trees , but replacing with only two. A. Burney responded that instead of coming to the Board, D. Proctor could have simply walked away. M. Brenner stressed that he did not have a problem with D. Proctor’s application , he was just using it as an example. A. Burney explained that t he town did not have a scenic road bylaw, and therefore ha d no capability to enforce. M. Brenner made Motion to approve the s cenic road application for 235 Leominster Road, E. Torgersen Seconded, Roll Call Vote - E. Torgersen, aye; A. Reid, aye; M. Brenner, aye; M. Allison, aye. COMPREHENSIVE PERMIT APPLICATION: Pond View Commons, LLC, Howard Street - Board members had been provided with the application for review and comment. A. Burney recommended Board members give particular attention to th e requested waivers in reference to the Aro Estates subdivision approvals. Members will review the application for continued discussion at the next meeting. BOARD DISCUSSION: Section 250-6.4., Driveways & Entrances- Discussion would continue at future Board meetings. ===PAGE 2=== Minutes, 9.12.2022 Page 2 Section 250-4.1, Use Table – Motels- An article would be placed on the warrant for fa ll special town meeting. The article would change motels from being allowable by right in the Commercial District to requiring a special permit from the Z oning Board of Appeals. M. Brenner made Motion to put forward a warrant article with the discussed c hange to the Use Table, A. Reid Seconded, Roll Call Vote- E. Torgersen, aye; A. Reid, aye; M. Brenner, aye; M. Allison, aye. Records Storage Memo f rom the Lunenburg Municipal Building Design Committee (LMBDC)- The memorandum addressed future records’ st orage by digitization to minimize the cost of constructing space for long -term record storage. A. Burney noted that record storage would still continue to grow though as building records must be maintained as long as a building is standing. Electronic re cords are not considered archivable by the state of Massachusetts. The Planning Office, in addition to paper copies, requires digital submissions of applications. A. Burney noted there were at least 70 boxes of Planning Office documents in the attic dating back to the 1950’s which would require digitization. He questioned who would determine what gets digitized and who does it. Most planning submissions are required in large -document format, i.e., 24” x 36”. The office did not have the equipment to sca n that size; h ow would those documents be scanned? A. Burney would submit comments to the LMBDC by the requested date. MINUTES APPROVAL: M. COMPREHENSIVE PERMIT APPLICATION: Pond View Commons, LLC, Howard Street - The Board reviewed the comprehensive permit (40B) application paying particular attention to the requested zoning waivers as they pertained to the 2019 Board-approved Subdivision plans . A. Burney would clarify with town counsel that the waivers were applicable to only the nineteen acres contained within the 40B application. The 40B modification to the Subdivision would be the erasure of the individual lot lines , which would create two large parcels for the 40B and the modification of one road to eliminate a cul de sac and introduce a curve. As allowed by the 40B application, the applicant modified the approved Subdivision plan, revising lot lines and layout of the subdivision ways. The Board expressed concern with the proposed building height of 65 feet; due both to the maximum height zoning requirement of 38 feet and the anticipated lack of privacy to abutting private homes. M. Brenner was concerned that the individuals residing in the 40B would drive on the road as if it were a high -speed road and not residential. This would also cause a decrease in the pedestrian traffic. There were concerns with the narrowness of the road and the safety of children playing in the neighborhood. Four hundred two (402) parking spaces were being allotted for the 200 apartments. A. Reid felt that was underestimated. Members recommended that the Zoning Board of Appeals (ZBA) vote on all waiver requests individually. ===PAGE 2=== Minutes 9.26.22 Page 2 The applicant had requested a waiver of the following conditions of the Subdivision Decision : Conditions 2 and 3 to the extent they suggested a prohibition against the construction/occupancy of multi -family residential buildings. Condition 4 covered the bond requir ement for the Subdivision road. The subdivision roads would service the three large buildings proposed in the 40B. At some point in the future, the applicant could possibly want t o turn the roads over to the Town. The land was currently under the covena nt of the Subdivision. In order to obtain building permits and financing the lots would need to be released. A. Burney was under the impression the applicant was asking to skip the placement of surety and get the lot releases for the lots covered under t he 40B. Condition 5 required the applicant to obtain any permits, licenses, or approvals required by the Subdivision. Condition 6 stated that the applicant would not get a building permit without approval by the Board of Health. That would be superseded by the introduction of a sewer system. Condition 7 covered the requirement for Conservation Commission approval. Condition 8 required the applicant to maintain the Subdivision roadways, utilities and stormwater management facilities, until the Town acce pted the roadways. Condition 9 required the roadways to be accessible at all times via plowing, sanding and other repairs. Condition 10 specified emergency vehicle accessibility for single -family dwellings. There would be no single -family dwellings in t he 40B. Condition 11 specified hours of construction. Condition 12 allowed for site inspection by Town officials to ensure compliance with the Conditions of the Board’s approval. Condition 13 called for a pre -construction conference with various Town of ficials. Condition 14 required the applicant’s compliance with any Town permit, license, approval, etc., prior to construction within the subdivisions. A. Burney stressed to Board members that the building permit would not get issued without the preceding compliance to Condition 14 . It would be recommended to the ZBA that a condition specify the applicant’s compliance with any Town permit, license, approval, etc., prior to construction within the 40B. Condition 15 required adherence to all Town bylaws, rules, regulations applicable to subdivisions. The importance of the above Conditions would be stressed to the ZBA. It would be up to the ZBA as to how these necessities were incorporated into the 40B. Condition 18 defined “applicant” and that the Decision would be binding and enforceable against same. Condition 19 specified that any violation of the Planning Board’s Decision would cause rescission, modification or amendment of the Board’s Subdivision approval. Condition 20 referred to a Board of Healt h letter, which stated the developer would be required to have subsurface soil absorption systems and potable water. Condition 24 required phasing of the subdivisions. Condition 25 was the conveyance of land to the Town for conservation purposes. The con veyance would be required prior to the issuance of any building permits. Condition 26 covered a land conveyance to the Town for access to the Town Forest. Again, this had to take place prior to any building permits. The land conveyances laid out in Conditions 25 and 26 would take place at the north end of the Subdivision. The portion in #25 was approximately 40 acres and contained the headwaters of the Mulpus. In #26 it was a small parcel leading from the approved right s-of-way to the Town Forest to th e north and west of the development. This would allow the Town greater access to lands it currently owned. A. Burney stressed that neither of the parcels were located withi n the 40B site; therefore, he did not understand why the applicant requested a wai ver. This would be stressed to the ZBA. M. Brenner noted that the applicant had agreed to convey land to the Town prior to any construction. The 40B should not change that conveyance. Condition 28 covered the construction of age -restricted homes/lots within the subdivisions. M. Allison recalled with the Subdivision’s approval the Board wanted to front-load construction of the age restricted homes in the event the applicant was unable to build out to maximum capacity. A. Burney would prepare a memo randum to the Z BA. As the Board did not have a scheduled meeting prior to the ZBA’s continuation, two Board members would individually review the memorandum to ensure A. Burney had covered the Board’s salient points. A. Burney would include stormwat er guidance in the memorandum. M. Brenner made Motion for Land Use Director Adam Burney to write a memorandum to the ZBA containing all salient points the Board discussed and prior to sending to the ZBA, two Board members would review and approve, A. Reid Seco nded, Roll Call Vote- A. Reid, aye; M. Brenner, aye; M. Allison, aye. Board consensus was that A. Reid and M. Brenner would review the memorandum. BOARD DISCUSSION: Section 250-6.4., Driveways & Entrances- Tabled Northfield Road, Parks Commission Pr operty- The Board was in receipt of correspondence from Ana Lockwood, Chair of the Lunenburg Park Commission. For the benefit of the audience, the letter was read into record. Lunenburg anticipate d a project for 361 Massachusetts Avenue , but to date there ha d not been a formal application . 361 Massachusetts Avenue abut ted a Lunenburg Park property at 961 Northfield Road. The Park Commission would like the Planning Board to negotiate for an easement access from 361 Massachusetts Avenue to 961 Northfield Road for the benefit of town residents. Not knowing how ===PAGE 3=== Minutes 9.26.22 Page 3 Lufa Farms (the proposed project) w ould respond, A. Burney responded that it c ould depend on various factors, e.g., layout of the project, location of the fields and buildin gs, etc. As the proposed project was anticipated to be both an indoor and outdoor grow, with heavy machinery there would be a concern for pedestrian traffic via the easement. A. Burney would put the proposal forth to a project representative. An additio nal complication would be that Lufa Farms would be utilizing an access easement through the Hannaford and WalMart plaza on Massachusetts Avenue . Future problems could be the maintenance and upkeep of the access easement. Brooks House, APDC Inquiry - The Board was in receipt of correspondence from Cullen Dwyer, Chair of the Architectural Preservation District Commission (APDC). Tony Sculimbrene, speaking on behalf of the APDC, noted that the APDC viewed the Brooks House on Massachusetts Avenue as a sign ificant contributor to the historic character of the Architectural Preservation District (APD). The APDC was asking the Board for various options for utilizing the Brooks House. The APDC’s letter propose d various options, e.g., turn back into a single fa mily house, relocate the building, utilize as a commercial building, etc. T. Sculimbrene asked the Board if it had knowledge as to why the Brooks House was located apart from other residential propertie s in the vicinity. A. Burney believed that the Brooks House was a farm at one time with the land that the school now sits on being farmland. Before the Town ma de a decision to demolish the house, the AP DC wanted to make sure all possibilities were considered. A. Burney would respond to the APDC’s letter p roviding the options from a zoning perspective. Chair Cullen Dwyer arrived at the end of the discussion and reiterated what R. Sculimbrene had stated.
