Absent: Erik Torgersen The Hearing was to hear and review an application for site plan approval and st ormwater management permit under Chapters 250 and 204 respectively of the Code of the Town of Lunenburg for a contractor yard, personal improvement building, and office building at 1325 Massachusetts Avenue . Owner- 1325 Mass Ave Realty Trust Daniel C. & Jean M. Proctor, Trustees, 1325 Massachusetts Avenue, Lunenburg, MA; applicants- Daniel & Jean Proctor, 1529 Massachusetts Avenue, Lunenburg, MA . The owners/applicants were represented by Greg Roy, Dillis & Roy, 1 Main Street, Lunenburg, MA. G. Roy summarized past permitting on the property; an earth removal permit by the Select Board, in conjunction with the earth removal permit, a stormwater management permit and site plan approval with the Planning Board ; Conservation Commission Order of Conditions ; MEPA certificate ; temporary curb cut access from DOT ; special permit from the Zoning Board of Appeals for the use of a contractor yard on the back of the site ; and a Zoning Board of Appeals special permit for dimensional variation for land disturbance within the water supply protection district. The owners had filed for a permanent curb cut access, which was in review with DOT. The owner had been working for approximately the last three years to remove the earth mat erial from the site. As the site was commercially zoned, the owners intended to develop it commer cially. Toward the front of the site would be two buildings; an office and personal improvement. The contractor storage yard would consist of leasable bay s/units. It was stressed to the Board that the bays were intended for “tradesmen” use, small business owners, etc. Not open storage of earth materials. A grading and drainage plan was reviewed. A landscaping and lighting plan was also viewed. A letter (on file in the Planning Office) was submitted by abutters Gerry and Dale Erskine, 1331 Massachusetts Avenue. It was read into record by Kathy McWilliams. Mike Rash, 74 Townsend Harbor Road - He had concerns with the size of the building to the rear of the site; he felt it belonged in industrial zoning. He also felt the hours of operation set by the Zoning Board of Appeals should be reduced. M. Allison noted that operation hours were set by the Zoning Board of Appeals and did not fall under the juri sdiction of the Planning Board. For the benefit of the audience, A. Burney summarized what would fall under the purview of the Planning Board. ===PAGE 2=== Minutes, 1.9.23 1325 Massachusetts Avenue Page 2 M. Allison inquired if the contractor storage bays had vehicular access – yes. Discussion would take place between the owners and the Sewer Commission regarding floor drains. D. Proctor noted there would be fencing to the rear of each storage bay consisting of a six foot high chain link with privacy slats. M. Allison asked if D. Proctor was amenable to erecting the same along the property lines ; D. Proctor said he would prefer to plant arborvitae. D. Proctor mentioned that the abutters at 68 Townsend Harbor Road asked him to extend the elevated berm (as part of earth removal) and to loam it so they could plant wildflowers; he was agreeable with that request. M. Allison inquired if D. Proctor would be amenable to setting up a fund that abutters would be able to draw on (through a third party) for plantings t o fill in gaps along the property line. D. Proctor responded that he felt what he would be planting w as adequate. The pole lights would be downward facing, dark sky compliant. M. Allison asked if he would consider a smaller Morton building. D. Procto r responded that he went with what was most economical for him. Kathy McWilliams, on behalf of the Erskine’s, requested an architectural rendering of the site at build -out. M. Burney Land Use Director Marjorie J. Boggio Administrative Assistant Minutes March 13, 2023 Meeting Posted: Yes Place: Town Hall, 17 Main Street, Lunenburg, MA Time: 6:00 p.m. Present: Matthew Allison, Matthew Brenner, Amanda Reid, Timothy Willsmer, Adam Burney Absent: Erik Torgersen ANR PLAN: 451 Mulpus Road, Lot B3 - Plan presented by Stan Dillis, Dillis and Roy. The Plan eliminate d a lot line . It went from three lots to two ; creating Lots B3 and 10A. T. Willsmer made Motion to endorse the ANR Plan for 451 Mulpus Road, A. Reid Seconded, passed unanimously. APPOINTMENTS: Proposed Zoning Bylaw Change - Charles Venezia, 1402 Massachusetts Avenue made a presentation. He opined that self - storage had been a previous allowed use, but was not any longer. He would like to see the use added back in. A. Burney provided clarification – the self-storage facility on Electric Avenue was approved in 2016. At that time the Building Commissioner determined that , even though not listed in the bylaw as a use, it was similar enough to those permitted. During that same timeframe the Board was working on the creation of the Use Table. The Use Table listed uses explicitly listed in the zoning bylaw and self -storage was no t discussed by the Board . It was not included in the Use Table, nor the bylaw, so if a use is not listed, it is prohibited. The individual inquired if the Board would put a warrant article on for town meeting allowing the use. A. Burney provided the Boa rd with some possible definitions and specified that it could be a permitted by special permit from the Zoning Board of Appeals in commercial and office park/industrial zoning. Three possible definitions were provided. Board consensus was to go with, “A building or group of buildings of a controlled -access and/or fenced compound that contains compartmentalized and controlled -access stalls or lockers for the storage of customers’ goods or wares”. M. Brenner made Motion for the Land Use Director to prepare a warrant article for self -storage as discussed, A. Reid Seconded, passed unanimously. 360 Flat Hill Road - The developer was represented by Shane Matson. The Board’s Decision contained a Condition for the completion of stormwater facilities prior to o ccupancy. The developer wanted to market the houses, but was unable to plant in the rain gardens due to the season . He was looking for Board approval to put up a bond for completion of the stormwater facilities, thereby allowing him to move forward with selling the houses. The developer provided the Board with a detailed estimate for review and possible approval. The developer knew the work needed to be done and was looking for a way to accomplish that without violating the Board’s Decision. If approve d by the Board, a tri party agreement would be put in place for 21 Watt Street (Lot 7), 19 Watt Street (Lot 8), 71 Watt Street (Lot 6) and 360 Flat Hill Road (Lot 1). The Board was amenable to putting tri party agreements in place for the four lots. Documents would be prepared for Board endorsement on March 27 th. MASTER PLANNING SERVICES: Three firms were interviewed at the Board’s February 27 th meeting; Weston & Sampson, OverUnder, and J M Goldson. The Board needed to rank the firms. If the highest ranked firm was within the allotted budget, the Board could choose that firm. If the first choice was over budget, the next qualifying firm would get the contract if it was within budget. Board discussion ensued over the various pros and cons of the thr ee firms. Board members handed their ranking sheets to A. Burney who would work with the Assistant Town Manager to check references and price proposals. ===PAGE 2=== Minutes, 3.13.23 Pg 2 COMPREHENSIVE PERMIT APPLICATION: Pond View Commons, LLC, Howard Street - No updates. Burney had a brief meeting with Rami el Samahy, AICP, Principal, last week. They discussed general scheduling/kickoff. The firm intended to come to Lunenburg mid -May for a tour of the Town. The Board anticipated a public forum in early -June. A. Burney suggested to the Board that he be the main contact person, meeting with the firm every other week and providing updates to the Board at its regular meetings. He inquired if the Board wanted to form a Master Planning Committee or would the Planning Board take on that role . The Committee would probably meet monthly/every 6 weeks to review information from OverUnder and then provide response to OverUnder. M. Allison brought up the possibility of adding a third Board meeting monthly dedicated to master planning. If a Committee was formed, A. Burney recommended it consist of 7 -9 individuals, e.g. two Planning Board members, representation from the S elect Board, Council on Aging, Parks Commission, Finance Committee and citizen -at-large. The Board was in favor of the formation of a Master Planning Committee. At the next Board meeting A. Burney would provide the Board with a proposed structure of the Committee . ATM May 6 – Zoning Article Update - See hearings noted above. Aquifer Protection District - At annual town meeting May 2022 the Board had proposed some changes to the District (this was at request of the Water District due to a DEP update). Th at article did not pass. At that time some residents of Hickory Hills Lake (located in Zone I) asserted that if the article passed, the Board would be over -regulating what they could do on the Lake. This evening , A. Burney opined that the Town did not need to regulate Zone I; DEP and the Water District did their own regulating. DEP d id not require Zone III to be regulated, but the Town ha d regulations on Zone III. Zone II was the zone that needed to be regulated. DEP had a 2011 model bylaw with language geared to Zone II. The Town’s bylaw was dated in the early 1990’s. A large -scale commercial business located on Leominster Shirley voiced interest in developing the property across the road from its current location. The desired property was in Zone III which would require significant regulating. A. Burney proposed that the Board adopt the 2011 DEP bylaw which would allow more flexibility to the Town. A. Burney had spoken with the Water District Superintendent who voiced his support of matching the DEP standards. A. Burney would provide Board members with both DEP’s model bylaw and the Town’s existing bylaw . ===PAGE 3=== Minutes, 4.10 .23 Pg 3 MEETING SCHEDULE: April 24- Hearing, 39 Main Street May 6, 9:00 a.m. - Town Meeting May 8 May 20 – Town Election May 27 ONGOING ITEMS: Zoning for MBTA Communities – Action Plan - A. That sub -committee would then come back and report to the full Committee. The consultant would do a lot of work off -line and then come back and present it to the full Committee. M. MJTC- No report DIRECTOR’S ITEMS: Site Plan Approval- One of the concerns that came out of the Economic Development Committee (EDC) meeting (see above), was that a change of use required site plan approval before the Planning Board. An EDC member noted that spaces under 1500 square feet usually have similar parking requirements and a change of use could be an administrative process through the Building Commissioner. This would allow small businesses to move into spac es without a 4 -6 week delay normally involved in the site plan approval process. To accomplish this would require a change to the zoning bylaw. A. Burney recommended the Board wait for the new Building Commissioner to come on board later this month befor e proceeding. A process needed to be developed which was approachable for a lay person, yet also enforceable for the Building Commissioner.
