BOS Policies and Procedures — Ms. Speidel produced a paper copy of the BOS Policies and Procedures and commented that there were a many items that were outdated and also a number of things that did not need to be included un this anymore. Ms. Bertram stated that she had begun looking at the outline format and that she would be happy to compare the two and then modity the outline. After discussion it was decided that after Ms. Bertram has had a chance to update the outline they would meet again, in between the regularly scheduled BOS meetings, to work on the Policy and Procedures before they present it again to the Board of Selectmen. This should be done sometime in early February. 2. GASB #45 Valuation Update - Ms.Speidel explained that the GASB #45 requirement came into affect for the Town of Lunenburg on July 1, 2008. This is an accounting requirement which requires the Town to quantify its other post employment benefits liability. Recently there have been concerns on quantifying health insurance liability for retirees. Currently the Town only funds the present cost of health insurance but each year the employee accrues benefits, which the ===PAGE 2=== employer provides a certain percentage towards that premium when the person retires. Ms. Speidel said that at present time the Town is not setting aside funding for anything other than the current year's liability, and is not required to do so by the State. She feels that in the next 5 - 10 years the State will require towns to set aside funding for this liability. Ms. Speidel reviewed sections of the report with the Board members. 3. Review CM 101, Performance Measurement, Initiative - According to Ms. Speidel, the Budget Working Group had recently had a significant discussion concerning introducing Performance Measurements to the Town of Lunenburg to help benchmark what other communities similar to Lunenburg are doing. The International City Management Association has put together a program entitled "CPM 101". Currently there are 175 communities across the United States that participate in this program which consists of 1000 performance measures across 18 service areas that are being tracked. This is a data base that is available to members of the ICMA for purchase at a cost of $995.00 per year. Ms. Speidel stated that although there is no money in the budget for this purchase she would like to use monies from the savings that have been incurred through initiatives with the Town's Insurance Provider, MILA, which add up to approximately $7000 for this purchase. Training will be available in a couple of weeks. 4. Minutes/Warrants/Action File Issues - Minutes: None Warrants - 01/3/12 (3-12) $132,361.30, 01/04/12 (39-12) $141,563.90 and 01/05/12 w#14P $610,118.38 signed Action File Issues - None 5. Town Manager Reports: Update on Street Light Issue; Update on October Storm; Update on Temporary Fix to Mulpus Road/Townsend Harbor Road Intersection - Ms. Speidel updated the Board on the Eagle Heights project. There was also $7329 in grants/rewards from MIIA received by the Town by taking part in free training sessions and optional building inspections. Annual License Renewals - Central Mass Power Sport, 19 Massachusetts Avenue, has not submitted the completed paperwork necessary for license renewal. This has been an ongoing request from the BOS and after discussion the Board saw fit to begin the process of revoking their license for Class 1 & Class 3 Automotive on the next business day. Mr. Matthews responded yes and reminded those present that this would be just a preliminary discussion. ANNOUNCEMENTS - None APPOINTMENTS 7:00 PM Consideration of PILOT with Mass PV1, LLC, for 651 Chase Road Solar Farm - Attorney Scott Fenton, who is representing Mass PV1, LLC explained that he was there this evening to ask for a PILOT Agreement in lieu of taxes for a 6 mega watt solar project to be located at 651 Chase Road. His reason for this request is because the taxes that would be assessed on the property would be higher than the profits coming in. He asked the board to appoint the Town Manager to negotiate a PILOT Agreement. Gus Abalo, from Mass PV1 explained that their purpose is to sell energy back to Unitil and that he would like to work with the town to negotiate a PILOT Agreement. After discussion among the board members and the applicant, it was decided that more information was needed from the Assessors office in order to have further conversations about this project. Harold Scheid, Principal Assessor, also spoke in saying that the town must explore whether the project would be considered personal property or real estate, because they would potentially be taxed differently. Mr. Scheid will gather more information from PV1 and then will present his findings to the BOS at a later meeting. CURRENT BUSINESS 1. Discuss appointments to School Building Committee - Ms. Speidel explained that the MSBA (Massachusetts School Building Authority) has asked the Town of Lunenburg to put together a School Building Committee to move forward with the renovation or construction of a new school building. According to Town Bylaws and the MSBA requirements, the committee will consist of 12 individuals, with 9 members voting. These members should have specific background within the Town organization or should be individuals who have a background in engineering. architecture and construction. Ms. Speidel has been working with School Superintendent Loxi Jo Calmes on this project and together they have come up with a list of candidates for consideration. She also explained that the appointments under the Town Bylaw are joint appointments made by the Selectmen and the Town Moderator. This information has been submitted to the Moderator but as of this meeting she has not heard back from the Moderator. Any appointments that the Selectmen may make this evening are contingent upon the Moderator's approval as well. Ms. Speidel presented to the board with a slate of candidates to be appointed to the School Building Committee and they are as follows: Kerry Speidel, David Matthews, Mike Mackin, Colleen Shapiro, Loxi Joe Calmes, John Londa, Joe Dillon, Mike Barney, Todd Blake, Richard Cohen and Nathan Lockwood. Mr. Sund seconded the motion. Discussion followed the motion with concerns voiced by Mr. Alonzo regarding prior appointment procedure. Generally the BOS interview the individuals who are being considered. He said that he has met most everyone that has been presented except for Todd Blake and Richard Cohen. Ms. Speidel said she would invite them to the next BOS meeting. Mr. deBettencourt was also concerned about waiting for the Moderator to return to complete the joint appointment. Ms. Bertram withdrew her motion at this time. Mr. deBettencourt accepted the withdrawal. All board members were in acceptance. 2. Consider adoption of State-Wide Mutual Aid program - Continued to the 1/17/12 BOS meeting. 3. Update on Lake Shirley Dam Inspection, other issues - DPW Director Jack Rodriquenz began his presentation by introducing the new DPW Administrative Assistant, Amanda Moore. Mr. Rodriquenz presented a brief slide show to report on the current status of the dam. Overall, the evaluation determined that the dam is in satisfactory c although there is a concern with a wet spot at the left downstream area of the dam. They will continue to I place stakes in this area. This will be a "team effort" between the DPW, Lake Shirley Improvement Assoc U le Dam Keepers. Ms. Bertram requested that any reports/data compiled by the Gate Keepers be forwarded onto the BOS, po Slide yearly, so that it can be at hand in case of an emergency with the dam. shor 4. Committee Report - Ms. Bertram reported that she attended the Planning Board meeting the previous ‹ ere discussion was held concerning the proposed Solar Farm Project on Electric Ave/Pleasant St. She said that. • many abutters present who were concerned with potential issues such as storm water, property values, and buffer zone. The proponent is proposing an interconnection application with Unitil to which Unitil is favor- -aid that according to the developer, if the two projects go through as proposed, than the potențial municipal project will not be possible. Ms. Bertram feels that the band width for solar power in the community will be breached. There also seems to be a discrepancy between the Planning Director and the proponent's opinions and information on this project. Ms. Bertram would like the BOS to look into this further. Ms. Bertram also stated that there was a Master Planning Workshop that focused on the Town center. She said that they were looking for feedback from various Town boards and the public regarding goals and objectives in the Town center and how it can move forward. Once she receives the overview from Planning Board member Nathan Lockwood she will forward it onto the BOS. Discussion about a Master Planning survey being developed and circulated to the public ensued, focusing specifically about the pros and cons of this survey being paper or electronic. Mr. Mathews ended this committee report with assuring concerned abutters about the entrance to the 2"d Solar project, which is listed as being on Electric Avenue. He stated that it really wasn't the entrance but rather just the entrance for the land owner via Electric Avenue. The entrance is actually on West St. and Pleasant St. by the big open field. He encouraged interested parties to attend the January 23d Planning Board meeting concerning this project. Discussion among the board members was held concerning Solar Bylaws and the impact they have upon communities. 6. Department Reports - None 7. The Town can now go through the process of submitting expenses for reimbursement. They are still waiting for a final bill from AshBritt for storm clean up. They are also working on gathering comparative data with the December 2008 ice Storm and the current October storm. Update on Temporary Fix to Mulpus Road/Townsend Harbor Road Intersection - DPW Director Jack Rodriquenz reported that both a "Do Not Enter" sign and an "Enter Here" sign have been placed at the appropriate places at this intersection. They have also placed the Fire Departments large lighted sign in the area which warns of the dangerous intersection to drivers. He also stated that he has spoken to a representative from David Ross Associates who would like to expand upon the plan developed by a group of Hickory Hills residents to reconfigure that intersection. OLD BUSINESS 1. Review request to extend Cell Antenna Lase by T-Mobile for Town Hall location- continued to 1/17/12 meeting 2. Approval of Annual Business Licenses - Ms. Speidel reported that there has been no progress on last week's license renewal and that unless something happens between this BOS meeting and the first BOS meeting in February they will be looking to begin proceedings to revoke the license. Ms. Bertram voiced her concern over the amount of time that this business has been operating without a license and she feels that a hearing should be held before the February meeting to revoke the license. Mr. Alonzo, and Mr. Sund spoke in support of her application. Mr. deBettencourt questioned what type of product Ms. Christopher would bring in to compliment the items that she has now. Ms. Christopher told him that she was not looking to become a large retailer but rather would like to bring in what her customers are requesting and items that would go into the gift baskets which are made at her establishment. Mr. deBettencourt seconded the motion. On vote, motion carried 5 in favor, 0 opposed. CURRENT BUSINESS 1. Consider adoption of State-wide Mutual Aid program - Ms. Speidel explained that the next item up for consideration was the request to adopt the state wide mutual aid laws. She said that the Police Chief, Fire Chief and DPW Director have all reviewed both of these state wide mutual aid programs and they are recommending that the town opt into these programs. There are two laws that are at issue here and they are the state wide Public Satety Mutual Aid Law and the state wide Public Works Mutual Aide Law. Ms. Speidel has surveyed a number of neighboring communities and they are either in the process or have already adopted these laws. She explained that by opting into these laws, the town will have access to mutual aid with any other community in the state that has adopted these laws as well. The public works law would allow requests at any point in time for equipment loan, not just for emergencies, which would mean that the town could request a particular piece of equipment to borrow, not rent. This will be a state maintained data base. The public safety mutual aid law will be strictly for emergencies. Ms. Speidel recommended that the board adopt both of the state-wide mutual aid laws. Police Chief Dan Bourgeois and Fire Chief Scott Glenny were on hand to answer any questions pertaining to this program and did so when asked by Mr. Alonzo. Mr. Alonzo made a motion to adopt the State-wide Mutual Aid laws as written as Mass GL. C40, S4J which is the state- wide Public Safety Mutual Aid agreement and Mass GL. Ms. Speidel stated that to the best of her knowledge, none have been submitted, but she is hopeful that they will receive at least one bid from one party that has remained interested throughout the whole process. 3. Committee Report - Mr. Sund reported that the Capital Planning Committee met last Thursday to review any requests that have been made by town departments. He said that they had made one preliminary cut on a request and are getting it needled down into different sections and have not prioritized it. They have been following the Town Manager's instructions that they are not looking at any financing on this whatsoever, it is on a need basis only. Their directive has been to just look at the needs. They should be close to a final recommendation within the next few weeks. Mr. Matthews requested that the BOS review that before they get to that point. There were many department requests and Mr. Sund reviewed each department's request along with the CPC recommendations with the board. Mr. Alonzo reported that the Budget Working Group met last Wednesday and they discussed what they will do as far as the proposed 2 ½ override. They are looking at the Town Manager's five year budget projection and are investigating ways on how they can sustain a level service budget to all items listed in the report. ===PAGE 3=== Mr. deBettencourt reported that the DPW building was just about 99% ready to be moved into. They are waiting for a few punch list items to be completed. 4. Department Reports - None 5. This is scheduled for the February 7, 2012 BOS meeting. OLD BUSINESS - 1. Review request to extend Cell Antenna Lease by T-Mobile for Town Hall location - Not discussed 2. Approval of Annual Business Licenses - Ms. Speidel reported that after last week's license discussion concerning Central Mass Power Sports she reviewed the issue with Town Counsel, who confirmed that its license has expired. There is no need to revoke their license and they will proceed under regulations that are allowed for businesses operating without a license. The procedure will be to notify them that they are operating without a license and if it continues there will be a criminal complaint filed. Ms. Bertram spoke and said that considering that every attempt has been made to get this business to comply, and they have not responded, that she would prefer to have a Constable serve the notification to this business rather than it being sent certified mail. Bilotta Meeting Room, Town Hall as scheduled with David Matthews, Steven M. deBettencourt, Paula Bertram, Tom Alonzo, Carl "Ernie" Sund and Town Manager Kerry Speidel present. Regular Meeting opened at 7:00 PM with the Pledge of Allegiance. PUBLIC COMMENT Mir. Alonzo reported that today the MUN! Bill was voted favorably out of the joint sub committee and now it goes to the full house and is on point in this session. He thanked the joint sub-committee, including Senator Flannagan, for voting favorably for it. Mi. Matthews thanked the Council on Aging and the people at the Eagle House for moving ahead themselves and removing the old septic mount from behind the building. Mr. Matthews recognized and thanked Boy Scout Allen Parker on his Eagle Scout project at Veteran's Memorial Park. Mr. Parker replaced the old wooden posts with granite. Dave Prokowiew, 733 West St, had questions concerning the solar project on Electric Ave. He wanted to know if the town had adopted the Green Communities recommendations and he also had concerns about "as of right" language being included in the town bylaws. Mr. Matthews said that we have not gone through the whole process of being a "green community" yet. Mr. Alonzo also commented and said that the town, at Town Meeting, had adopted as of right, solar capabilities in the town. Mr. Matthews also said that there is an opportunity to update that bylaw and that the BOS would be working with the Planning Board and Green Communities task force to work out an update to it. Mr. Prokowiew asked who the ultimate authority as to whether or not this project goes forward. Mr. Matthews said it goes to the Planning Board, to the Zoning Official and if there is a push back it would go to the Zoning Board of Appeals. He also stated that with the "solar" it is a little more restricted and currently in the bylaw there is not a lot of protection in place. The town had adopted an early version of the bylaw and then the state came out with a newer version about a year later which the town had missed. He explained that once a plan has been submitted to the Planning board, they have to work with the existing Zoning that is in place. Mr. Prokowiew questioned the timeline of changing the bylaw. He was told it has to be changed at town meeting. Mr. Alonzo stated that the Chairperson to the Planning board has reached out to the BOS to work toward a modification and a change in the current solar bylaw to place restrictions on it that are not currently there. To change the bylaw successfully would take time. ANNOUNCEMENTS - APPOINTMENTS 7:30 PM Presentation by VHB Engineering on Summer Street Alternatives Analysis - Representatives from VHB (VanasseHangenBrustlin), Patricia Domigan, Laura Castelli and Steve Derdarian, presented a slide show update of the plans to renovate Summer Street. Explained in the presentation were the deficiencies that have occurred in the pavement, sidewalks, drainage failure etc. Three plans were presented to the BOS: Option A of one lane in each direction of the road, Option B of two lanes in each direction, and Option C of a center turn lane. Improvements to the green space were also presented. The Mass Department of Transportation has approved $6.4M dollars to cover this project. After the presentation Mr. Matthews opened the meeting up to residents for comments. Cheryl LeBlanc, 17 Summer St, spoke in saying that she liked Option 1. She said that the Lunenburg police sit in front of her house a lot of times to prevent crashes and that this was going to save a lot of lives. Ed LeBlanc, 87 Summer St, said that Plan 1 looks fantastic for the area for safety. He said that the traffic is all over the street and that there is no focus on the street. He thought this was a great step forward. Joe Smalley, Owner of Daewoo North was concerned with the project impeding access to his business and others. Ms. Domigan explained to him that these are just concept plans and they are looking to stimulate the economy and not to put people out of business. She said that they will be working with Mr. Smalley, other business owners, and residents to make sure that they have access in and out of their businesses appropriately and safely. ===PAGE 2=== Discussion ensued among the board members on which options they preferred and timelines. Mr. Matthews thanked VHB for their presentation. CURRENT BUSINESS 1. Open Warrant for Annual Town Meeting, May 5, 2012- Ms. Speidel suggested that the BOS open the warrant for the May 5, 2012 Town Meeting this evening and close on Monday March 5, 2012 at 4PM. Mr. Alonzo moved that they open the Annual Town Meeting Warrant to be closed at the end of business day at 4PM on March s*. Mr. Sund seconded the motion. On vote motion carried, 5 in favor, 0 opposed. 2. Minutes/Warrants/Action File Issues - The following minutes and warrants were presented for approval. 1. Minutes - None 2. Warrants - AP $361,684.28 AP $367,840.89 3. Action File Issues - None 3. Committee Report - Ms. Bertram stated that she had attended the pervious evenings planning board meeting and would like to follow up on questions relative to the solar farm. She stated that Unitil has received applications already that will consume 3% of alternative energy and would like to get clarification from Unitil as to how these projects will impact the town project on the land fill. She also would like clarification on the Chase Rd/West Townsend Rd project to make sure that there is no issue with fluctuation of power because of the where the proposed projects/substations are located. She would like to know where we are at with the order of application and if another project will have a detrimental effect on our project. Ms. Speidel will follow up with Unitil on all of these issues. Mr. Alonzo said that the budget committee had met to discuss the amount of funds to be asked for, for the override at Town meeting in May. Ms. Bertram stated that she could not attend the Montachusett Metropolitan Planning Organization dinner as she will be out of State. She requested information on this meeting from the Town Manager because she is interested in serving on this board. She would like another representative from the BOS to go in her place. Mr. Sund will attend the meeting. 4. Department Reports - None 5. Town Manager Reports- Ms. Speidel attended the MMA meeting and reported that it looks very favorable given the economic condition. There was a release of what some of the Cherry Sheet accounts will look like and for. Lunenburg in FY13 the Chapter 70 will increase in excess of $500,000. over this current year which is great news. The Governor is also proposing to level fund general government unrestricted aide if there is an excess at the close of FY12. They will give a supplemental payment to level fund the town. Ms. Speidel has not received any specific information on Health Insurance renewal but has received the assessment from the Worcester Regional Retirement System and that came in higher than expected. OLD BUSINESS APPOINTMENTS/RE-APPOINTMENTS/RESIGNATIONS - 1. Ratification of Police Sargent Appointment - Ms. Speidel presented a notice of her appointment of Officer Michael Luth to the position of Police Sargent for the Lunenburg Police Department. The appointment was made based upon the recommendation of the Police Chief and it has her full and complete support. Mr. Matthews stated that there is a new promotion policy within the department and it was negotiated with the union. This new policy was followed through and it came to this recommendation. He stated that there are a number of officers who are ready for this next step so in the future when openings come forth we will have very good candidates to the fill the ranks. Mr. Sund made the motion to ratify Officer Luth to the position of Sargent. Mr. deBettencourt seconded the motion. On vote motion carried, 3 in favor, 2 abstaining (Alonzo, Bertram). Mr. Alonzo explained that in his abstention he does not want it to reflect on Officer Luth. He thinks that he will make an excellent Sargent as would the whole slate of candidates that the Chief put forward. He feels that if they do ratify as this board, it supports not only the choice but also the process and the policy that the Chair had outlined and as a member of the board he feels that there were some miss-steps in that process. Ms. Bertram explained that her abstention was for the same reasons that Mr. Alonzo had just outlined. ===PAGE 3=== EXECUTIVE SESSION - 1. Mr. Alonzo moved that the board go into Executive Session Under M.G. L. Chapter 39, Section 23B (3), to discuss strategy with respect to collective bargaining or litigation if an open meeting may have a detrimental effect on the government's bargaining or litigating position. Also to conduct strategy session in preparation for negotiations with non-union personnel; to actually conduct collective bargaining and contract negotiations with non-union personnel not to return to open session. Ms. Bertram seconded. On vote motion carried 5 in favor, O opposed. Meeting adjourned at 8:30PM. Bilotta Meeting Room, Town Hall as scheduled with David Matthews, Paula Bertram, Steven M. deBettencourt, Tom Alonzo, Carl "Ernie" Sund and Town Manager Kerry Speidel present. Regular Meeting opened at 7:00 PM with the Pledge of Allegiance. PUBLIC COMMENT - David Prokowiew, 33 West Street, informed the Board that he had attended a Planning Board/Green Communities Task Force meeting the prior night where he was allowed to give suggestions concerning amending the Town's Solar Bylaw. He felt it was a good meeting and updated the Board on what was discussed. He would still like to see more people from the town involved with this issue because the existing permitting loophole is causing many problems which could affect everyone in the town. He also said that he had shared a guide with Ms Speidel and Ms. Bertram called Local Officials Guide to Zoning & Land Use for Renewable Energy. Mr. Matthews thanked Mr. Prokowiew and his group for their involvement in this matter. Ms. Bertram commented that she read the article that Mr. Prokowiew had given her and thought it was a great article and should be shared with the Planning Board and all of the BOS. ANNOUNCEMENTS - Mr. Alonzo made an announcement that the Friends of the Lunenburg Public Library will be sponsoring classes given by the Agbekor Drum & Dance Society on February 11 from 11AM-12 Noon and from 1-2PM. There will be a performance given by the class on February 12 from 1-2PM. Mr. Sund announced that sadly one of Lunenburg's dear citizens, Paul Porter, had passed away. He read all of Mr. Porter's impressive past achievements which included being a member of the Lunenburg Police Department for 46 years, being a member of the Marine Corps Devil Dogs and serving on various town committees as well as the American Legion. Mr. Sund said that we have lost a good citizen who was very dedicated and his thoughts and prayers will always go out to him. APPOINTMENTS CURRENT BUSINESS 1. Warrant, Annual Town Meeting, May 5, 2012 - revote closing date to 03/26/12 - Ms. Speidel apologized for suggesting a bad date for the closing of the warrant. According to the Town Charter the warrant has to be kept open until 42 days before town meeting, which would make the closing date March 26. Mr. Alonzo moved that they change the closing date of the town warrant, as recommended by the Town Manager to 4:00 p.m. on March 26, 2012. Mr. Sund seconded. On vote, motion passed, 5 in favor, O opposed. 2. BOS Policies & Procedures - Ms. Bertram had prepared a document by formatting and scanning the text to a standard document and had forwarded it to Ms. Speidel. There are some lengthy policies which Ms. Bertram would rather not retype and she is looking for that information in word form documents, or scanning them with a scanner that is capable of OCR scanning, which would be the easiest way to do this. Ms. Speidel said she should be able to finish that up tomorrow and have it put back on the agenda for next week. 3. Request to consider adoption on Open Meetings Law, Section 20 (d), Remote Participation - Ms. Speidel stated that the BOS had received a request from a member of the Sewer Commission to consider adopting the section of the open meetings law that allows for remote participation. She said that State Law allows for remote participation at public meetings if it is adopted by the BOS with conditions. She also stated that you cannot use remote participation to gain a quorum. Conditions are as follows: (1) Remote participation is allowed via telephone, internet or satellite enabled audio or visual conferencing so long as the participants are clearly audible. ===PAGE 2=== (2) It's allowable if participants can't physically attend a meeting due to illness, disability, military service, or geographic distance. (3) It's allowed as long as the Chair announces at the beginning of the meeting who is remotely participating. Ms. Speidel had sent out an email to Town Boards and Committees to see who was in favor of this and she received a 3-1 response margin in favor of remote participation. There were some concerns raised and they were further definition of "disability, geographic distance" etc. Other concerns were of being able to see the participants and not just hearing them through a telephone. It was also expressed that this would not be appropriate for Executive Session. At this time the BOS reviewed all issues that may cause concerns with adopting this policy. Questions were raised about the capability of being able to connect to visual conferencing in different meeting areas. Also discussed was the number of times that a person would be able to use the remote participation option. This item will be discussed again at a future meeting. 4. Minutes/Warrants/Action File Issues - The following minutes and warrants were presented for approval. 1. Minutes: None 2. Warrants - 2/7/12 W #46-12 $267,464.97 2/1/12 W # 45-12 $467,603.24 2/8/12 W # 47-10 $547,085.32 Presidential Primary warrant 3. Action File Issues - None 5. Committee Report - Mr. Sund said that he had attended the prior evening's joint committee meeting with the Planning Board and Green Communities Task Force. He also attended the Public Access Cable Committee meeting and reported that they are proceeding along with their programming. He also mentioned that he attended the Montachusett Planning Organization meeting where Selectman Paula Bertram was elected as the Sub-Region Representative. Mr. Alonzo reported that the Budget Committee met on Friday where they focused their discussion on the Chapter 70 changes. Mr. Matthews reported on the School Building Committee meeting and said that they elected Mike Mackin as the Chair, Mark Ericson as the Vice Chair and Colleen Shapiro as the Clerk. They have just started the process and are looking forward to working with the MSBA. 6. Department Reports - The Town Manager presented two license (Mass Ave Motors Inc., & Chapdelaine Truck Center ) with "typos" which needed to be re-signed. Ms. Speidel presented the BOS with two more licenses to be approved for Central Mass Motor Cycle Ltd./Central Mass Power Sports. They are for a "Class 1 Sale of Second Hand Motor Vehicles" and a Class 3 Motor Vehicle Junk" license . Ms. Speidel said that she has received all of the paperwork which was required of the business, all of their prior issues have been resolved, and they are ready to be approved. Mr. Alonzo moved to approve the Class 1 License and the Class 3 License for Central Mass Motor Cycle LTD and Central Mass Power Sports doing business at 19 Massachusetts Ave. Mr. deBettencourt seconded. On vote, motion carried, 5 in favor, 0 opposed. Ms. Speidel announced that there is a new schedule for solid waste pickup which allows for Monday - Friday pickup from the vendor, Casella. The vendor said that all households were notified but the Town Manager's office has received phone calls from the public who were not notified. Ms. Speidel said that anyone who has not had their trash picked up to call the BOS and they will arrange for it to be picked up on an alternate day. Discussion ensued regarding the fact that the BOS thought there would be more information from the vendor, in terms of a formal proposal, before this trash pickup schedule began in the town. A "reverse call" will be made to Lunenburg residents informing them of the schedule change, and it will also be published in the Lunenburg Ledger. The BOS made an apology to the residents who were negatively impacted by this change. Ms. Speidel said that there have been some questions regarding the Municipal electric aggregation with Unitil concerning the new rate that went into affect in January, and the fact that anyone who did not "opt" out of the program would see the new rate reflected in their service in January. Phone calls have been received from the public saying that their electric ===PAGE 3=== bills (received January) did not reflect the new rate. Ms. Speidel said that the reason being was because those bills were actually for December 2011. She said that anyone that had questions could call the BOS office. Ms. Speidel brought up the fact that there had been questions regarding the town's solar project on the landfill and whether or not the other two solar projects that are going through conservation and planning will have an impact on the town's ability to connect it to the Unitil project. In the net metering, Unitil is required to purchase 1% of their historical load in renewable energy and an additional 2% from municipal generation. The other two projects (Chase Rd. & Pleasant St.) that qualify for facility projects have no impact on the "caps" Ms. Bertram brought up the fact that she was at the planning board meeting, where this was discussed, and there were questions raised about the ability of the circuits in that area being overloaded. Mr. Sund responded that the developer for that project has requested from Unitil an engineering study on the power feed to that project, and it was determined that it would be a substantial amount of money to "feed it" to Unitil. Ms. Speidel said that John Londa and the town's attorney have had extensive conversations with the developer and have received the preliminary impact analysis back, which is a lengthy process. She is not sure that the number is public at this point but that it is sizeable. She stated that she would like it to be completely clear that Unitil is accessing 100% of the cost of these interconnections to the projects and that there is no negotiation to these costs. 7. Town Manager Reports Update on Regional Dispatch- Ms. Speidel reported that last fall, Lunenburg had entered into the inter-municipal agreement to provide regional emergency dispatch services. As of this meeting, it will consist of a four community region (Lunenburg, Ayer, Devens, & Lancaster). Two committees have been formed in accordance with the inter-municipal agreement (operations & executive). Lunenburg's primary representative is Fire Chief Scott Glenny and the secondary rep. is Police Chief Bourgeois. Ms. Spiedel is the Appointee to the Executive Committee and has been to all of the meetings. She reported on all of the progress of the Operation Committee meetings. OLD BUSINESS APPOINTMENTS/RE-APPOINTMENTS/RESIGNATIONS - 1. Resignation: Sandy Flanagan, COA: Mr. Matthews read a letter of resignation from Council on Aging board member Sandy Flanagan. Mr. Matthews stated that the BOS appreciated her service to the COA board. EXECUTIVE SESSION - 1. Being no further business, Mr. Matthews called for a motion to adjourn the regularly scheduled meeting to go into Executive Session under M.G. L. Chapter 39, Section 23B (3), to discuss strategy with respect to collective bargaining or litigation if an open meeting may have a detrimental effect on the government's bargaining or litigating position. Also to conduct strategy session in preparation for negotiations with non-union personnel; to actually conduct collective bargaining and contract negotiations with non-union personnel. Mir. deBettencourt moved to adjourn the meeting. Motion was seconded by Mr. Alonzo. The board voted unanimously to adjourn the meeting. PUBLIC COMMENT Ms. Bertram reminded everyone that the Town Caucus will be held on Monday, March 19" at the Turkey Hill Middle School at 7PM. Ms. Bertram stated that at that time she hopes to be nominated again for the BOS office and that the last six years she has spent as a Selectman has been incredibly rewarding and that she hopes she has the honor of serving the Town of Lunenburg for another term. Mr. Alonzo congratulated the Lunenburg High School Boys Basketball team who played well in the recent tournament by making it to the semi-finals, and having a successful season. ANNOUNCEMENTS APPOINTMENTS 7:15 p.m. Updates on negotiations with Borrego Solar for Town Solar project at Landfill - John Londa, Facilities Manager updated the BOS on the progress of moving toward a contract with Borrego Solar. They have received a copy of Unitil's report on the generator interconnection impact study and the estimated cost to upgrade the Unitil system for a 1.5MW solar array at $902,600. This includes updates to distribution lines, replacement of two breakers for a closing control, communications systems, and primary meter structure. He stated that Borrego thought that the 1.5MW was not do-able with that much overhead and asked Unitil to go back and look at supporting a smaller system. Borrego is looking at supporting a 1MW system with Unitil and they are expecting an answer back from Unitil within the next 2 weeks on a reduced scale project. Borrego has been in contact with the Lunenburg Assessor's office concerning the taxes and they are looking at a tax of $55,000. The contract document is currently with Town Counsel but cannot move forward until the issue of the size of the system is resolved. Mr. Londa stated that the interconnection application process is a lengthy process but continues to move forward. 7:30 p.m. Update on EPG Solar Project - Mike Borkowski & Robert Babcock, Managing Partners from EPG Solar were present to give an overview of the proposed solar project on West & Pleasant Streets. Mr. Borkowski explained that the original plans had solar panels fairly close to abutter's properties, which also encroached on wetlands. They have been working with the Planning Board and Conservation Commission to readjust their plans. Revised plans included pulling the project further back from the abutters, adding a significant vegetation plan, adding drainage swales and pulling all panels out of the wetlands. Mr. Borkowski stated that they feel that these compromises allow them to continue forward with the project as well as alleviate some of the concerns of the neighbors. Ms. Bertram questioned the interconnection costs with Unitil. Mr. Borkowski told her that they have been in communication with Unitil and the interconnection costs are within the realm of financial viability for the project. There was discussion concerning the drainage swales and Mr. Babcock explained how they planned on using core logs that will sit in a trench to aide in this process. Mr. Sund asked if EPG would be opposed if they were asked to put this project in another location due to the abutters concerns. Mr. Borkowski replied that they have shown in the past that they are willing to do anything they can do, to work with the town to help progress the project, and that they would be happy to engage the town. He also said that they would be happy to sell the town discounted electric as well. Mr. deBettencourt questioned what the schedule of maintenance on the property would be. Mr. Borkowski said that they have had dialog with certain neighbors about the maintenance of the field and that it would be done as such so as the public could still have access to the town property and walking paths. ===PAGE 2=== Ms. Bertram stated that she still remains concerned that this is a large scale project, in a residential area, and she questions whether or not this is the appropriate area for this to be placed. She feels that there are other areas in town that are more suitable and thinks that we need to explore this. Mr. Matthews agreed with Ms. Bertram and asked if EP would perhaps consider another location in a few months. Mr. Borkowski replied that they want to continue to do what is best for the town in moving the project forward. He said that if the town is willing to work with them and present those different options then they would be more than happy to work with the town on them. Kristin Barnes, 634 West Street, had questions about the core logs regarding why they were not being planted and how long they will last. Mr. Babcock answered in saying that they do not need to be planted and that they will eventually become overgrown with the natural growth that is around them. The logs will in time degrade leaving behind a dirt hump which will turn into a berm. Maintenance of these berms will be the responsibility of the project owner. Dave Prokowiew, 733 West Street, commented that he was excited to hear the suggestion of moving the project. Milree Keeling, asked if EPG was purchasing or leasing the land, to which Mr. Borkowski replied that they have a 30 year lease. He said that there is a bond in place that states that after the lease is up, everything is taken out of the ground and the land is returned to its natural field state. Ms. Keeling also asked if there were any toxic elements to this project that could be released if a panel should break. Mr. Borkowski said that there are no toxic materials in the panels. He said that the project is fully insured for the replacement cost if anything should break. If things are not repaired then the bond can be revoked. Ms. Keeling questioned if they would be paying taxes on this project to the town to which Mr. Borkowski responded yes they would be paying personal property taxes to the town which will have a significant impact to the town financially (over $100,000 per year). Ms. Bertram questioned the fire hazard possibilities to the panels. Mr. Babcock told her that the panels don't generate the type of heat that would make them burn. He said that all of the emergency services have access to the gate, they know the location of the parts that theoretically could catch fire, and they have the ability and instructions to be able to shut everything down. Bill Belisle, 642 West Street, was concerned about what the geological ramifications might be on his well due to the heavy hammering of pilings into the ground. The representatives from EPG said that there would be no consequences to his well due to that process. Mr. Belisle also questioned how close the project would be to his property line and what it would do to the water table. Mr. Borkowski told him that they were at least 75' from his property line and that it would not affect the water table. Mr. Prokowiew cautioned the BOS on the questions they were asking EPG on the set back distances and locations of fences in the wetlands. Mr. Borkowski assured the BOS that there were no fences in the wetlands. Ms. Bertram asked if the revised plan had been submitted to the planning board to which Mr. Borkowski answered yes they were submitted over a week ago but they have not had any comments back. Mr. Alonzo commented in saying that this was a commercial project that should have been better sited which was the town's oversight in putting together the current bylaw. He hopes they can come to a different location but commended EPG for being forthcoming in their answers and in working through this with the town. CURRENT BUSINESS 1. Change of Owner, Common Victualer License - Mr. Mike's Lunenburg - Mr. James Fagan spoke and said that he was there this evening on behalf of the Global Montello Group Corp., which is the entity that will now own the Energy and in connection with corporate restructuring the title to the property along with the license needs to be held in a different name. The day to day operations will all remain the same. Mr. Alonzo motioned to approve the change of owner of the current Common Victualer License at Mr. Mike's in Lunenburg at 131 Mass Avenue. Ms. Bertram seconded. On vote, motion carried, 5 in favor, 0 opposed 2. Elena's Gourmet Grocery, All Alcohol License - Ms. Speidel explained that there had been an error in the previous All Alcohol License which had been applied for in January. The application had been filled out under the wrong name and submitted to the ABCC who did not take action on it but rather they classified it as an upgrade of an existing ===PAGE 3=== license. The existing license is held in the name of the corporation and not in the owner's name individually so it was kicked back to the owner. The owner is now reapplying for the same license as a corporation. Mr. Alonzo moved to approve the All Alcohol License for Elena's Gourmet Grocery Inc.. Ms. Bertram seconded. On vote, motion carried, 5 in favor, O opposed. 3. Adoption of Section 20(d) of the Open Meetings law to allow for Remote Participation - Discussion among the board members about the cost of implementing this law at this time was held. Mr. Matthews requested that the Town Manager obtain more information on what the cost to the town would be to make this happen. Ms. Speidel will bring this information to the PACC meeting and to the IT Director to see what input they can provide and will report back to the BOS in a few weeks. 4. BOS Policies & Procedures - Mr. Matthews stated that it would be better to look at this again after the May Town Meeting. Ms. Bertram stated that she has been reviewing the policies and procedures and that there is still a lot of clean up to do. She has some general comments that she would like to circulate to the other members through the Town 5. Minutes/Warrants/Action File Issues - The following minutes and warrants were presented for approval. 1. Minutes: There were no minutes although Ms. Speidel stated that she had sent an advertisement to town employees seeking someone to record minutes for the BOS meetings on a regular basis. 2. Warrants - AP $257,494.07 AP $31,434.87 Deduction Warrant $379.948.39 Payroll $591,886.08 3. Action File Issues - None 6. Committee Report - Ms. Bertram reported that she attended her first MPO meeting on 2/8/12. She said that the majority of the meeting focused on amendments to the 2012/2013 T.I.P which includes the Summer Street improvement program. The other topic discussed was the current evaluation criteria being used to determine if a project gets placed on the T.I.P. MRPC will be circulating this information electronically to communities to get their feedback. She also said she met with Brad Harris from MRPC to learn more about MPO organization, how it works, and the different programs that they offer to communities. Ms. Betram also attended a Planning Board meeting that focused on the solar bylaw draft. Another issue brought up at the Planning meeting was 263 Elmwood Road and the issue of potential hazardous material being stored at that site. She said that the Fire & Police Chiefs did a "walk through" inspection of the site and found no hazardous material at that property, but had not made a written report of it. She thinks that if the town agencies have done inspections that they need to put it in writing to memorialize that, and get it to the individuals who express concerns. Ms. Speidel stated that she contacted the Fire Chief and he said that there is a written report on this matter. She will put together the report packet and circulate it to the BOS. Mr. Matthews asked Ms. Bertram why the Planning Board still lists Pleasant Street and Chase Road in the solar bylaw draft as chosen sites by right. Ms. Bertram stated that she has not attended a meeting where they have talked about the sites that are included and has not read the proposed bylaw yet. There will be a special Planning Board meeting to talk about the draft bylaw this Thursday. Mr. deBettencourt said that there is a 15% increase in sewer fees and customers are concerned. He said that the Sewer Commission is supposed to be self-funded and they are trying to achieve that goal by using their free cash but that has not worked out yet. He said that when Fitchburg and Leominster sewer rates increase, so do Lunenburg's. Mr. Sund made a request to establish a Memorial Day Planning Committee to plan the annual Memorial Day celebration. He said that the Veteran's Organization has been in charge of this in the past but the membership has decreased. He believes it is important to honor the men and women who have served this country in the military services and would like to see this established by the end of the month. Ms. Speidel will look into the process of establishing this committee. Mr. Alonzo said that the Finance Committee meeting to review the Town Manager's Budget with Department heads was delayed due to snow. They have a full schedule and will begin this Thursday at 7PM in the Town Hall, and it will be ===PAGE 4=== televised. He urged people to attend and said that this is a good opportunity for people to become involved to see what is being funded or not and how it all affects everybody in the community at large. Mr. Matthews reported that the Budget Working Group met last evening and after months of reviewing the budget they a il pared thanie Bos and the foe recons trad support an operating budge. orit in artown 5 out 10l read the state average for property tax bills and the override is needed because state funding has been cut significantly and the local revenues do not keep pace with inflation. 7. Department Reports - None 8. Town Manager Reports- Ms. Speidel had distributed to the BOS the Town Manager's FY2013 Proposed Budget information which included a financial forecast, override numbers, information on creating a new stabilization fund, impact items etc.. and she reviewed it with them. She stated that she would like to "tweek" this budget a little more before it is put onto the website. Discussion among the board members ensued regarding getting the information out to the public so that they can fully understand the $2.2M override impact on the town. The public was also urged to seek out the information about the town and school budgets that are available to them via the internet. OLD BUSINESS APPOINTMENTS/RE-APPOINTMENTS/RESIGNATIONS - None Larry Marshall, 985 Mass Avenue, spoke and said that he and his wife are the proponents on the Jones House and they were in attendance to see if the BOS had any questions regarding the Jones House purchase before Executive Session this evening. Mr. Matthews asked about the easement for the driveway and Mr. Marshall said it was for a driveway turn around. Mr. Marshall also said that the Historical Commission had a question on the sewer connection to the house and recommended that the BOS discuss this in Executive Session. Dave Prokowiew inquired as to when the budget reports would be available online. Ms. Speidel said she would have them on tomorrow. EXECUTIVE SESSION - 1. Under M.G. L. Chapter 39, Section 23B (3), Mr. Matthews moved that the BOS go into Executive Session, not to return, to discuss strategy with respect to collective bargaining or litigation if an open meeting may have a detrimental effect on the government's bargaining or litigating position. Also to conduct strategy session in preparation for negotiations with non-union personnel; to actually conduct collective bargaining and contract negotiations with non-union personnel. Ms. Bertram moved to go into Executive Session, not to return. Mr. Meting adored at 850 pinte, motion carried, in favor, 0 opposed. Bilotta Meeting Room, Town Hall as scheduled with David Matthews, Steven M. deBettencourt, Paula Bertram, Tom Alonzo, Carl "Ernie" Sund and Town Manager Kerry Speidel present. Regular Meeting opened at 7:00 PM with the Pledge of Allegiance. PUBLIC COMMENT The meeting began with public comment from the board. Mr. Sund read a letter he had written to Ms. Speidel concerning the disruptive behavior of people who attended the Planning Board meeting on 3/8/12. He felt that the board was not given the proper time to clearly discuss the issue at hand and in his letter he suggested that the meeting be rescheduled and any votes taken be disqualified until a properly conducted meeting can take place. Discussion among the board members occurred with the consensus being that the meeting did not need to be rescheduled unless the Planning Board felt the need to do so. Ms. Bertram commented on the Girl Scouts celebrating 100 years saying that they celebrated on March 9' with "World Thinking Day" and then on March 11" there were approximately 200 Girl Scouts, past and present, that gathered at the Lunenburg High School track at 3PM to participate in a "World Wide Promise Circle". Dave Prokowiew, 733 West Street, said that he was at the 3/8/12 Planning Board meeting which Mr. Sund attended and he felt that the Planning Board members invited the interaction from the people who were in attendance. He said that if they got a little out of hand it is because they are very passionate about their cause. Mike Mackin, 26 Cortland Circle, read a letter which he had emailed to the Lunenburg Finance Committee and to the BOS which he had written in support of the proposed Proposition 2 ½ override for the Town of Lunenburg. ANNOUNCEMENTS - None APPOINTMENTS 7:10 PM Report from Engineer on Townsend Harbor Road/Mulpus Rd - DPW Director Jack Rodriquenz updated the BUs on the progress of the Townsend Harbor Ra/Mulpus Ra situation. Mr. Jesse Johnson, Engineer from David Ross & Associates, spoke and said that they sent out a survey crew to find documentation on property lines and deed research. He presented composites sketches on possible solutions to realigning this intersection and explained each scenario to the board. There were many questions from the board members in reference to cost, aesthetics, traffic counts and "T" stop concerns. Board members agreed that a "3" stop scenario would not be feasible. Mr. Johnson said that there was no cost to the project yet, it all depends on the number of stops that are made at the intersection and that putting a cost to the project would be the next step. Mr. Matthews commented that this was a good starting point for this project. Dave Passios, 56 Whiting Street, asked about the possibility of having sensors put into the roadway along with a sign 200° down the road reading "Stopped Traffic" instead of reconfiguring the whole intersection. Bob Saiia, 32 Sandy Cove Road, expressed concerns with the proposed stop signs and said that there must be an easier solution to the reconfigurations at this intersection. Ms. Bertram will check with the Hickory Hills Landowners Association as to how much involvement they would like to have in the project, in terms of regular mowing maintenance. ===PAGE 2=== Mr. Matthews said that there was enough information now to put some costs together for designing a "1"or "2" stop intersection. MRPC (Montachusett Regional Planning Commission) will be asked to do a traffic count at this intersection also. 7:30PM Earth Removal Permit Application, Powell Stone & Gravel - Mr. Matthews read into the record the Notice of Hearing concerning the application submitted by Powell Stone & Gravel for an Earth Removal Permit for 151 Leominster Shirley Rd. Lunenburg MA. Mr. Jesse Johnson, Engineer from David Ross & Associates, spoke on behalf of Powell Stone & Gravel in asking for this permit. He said that the application is necessary for creating grades on the site plan that are already approved by the Lunenburg Conservation Commission and the Lunenburg Planning Board. He estimated that 50,000 cubic yards of surplus would need to be removed from the site. All of the site plan approvals have been submitted to the BOS. Steve Powell from Powell Stone and Gravel spoke and said that the project would probably be completed this year. He also stated that at this location there will be material coming in and out for the next several years. The material in question is just surplus that needs to be removed to bring the grade down. Perry Jewel, 20 Sunset Lane, congratulated Mr. Powell and his entire operation on the great business that they run. His concern was with barriers being put in place to keep run off from entering Lake Shirley down stream. Mr. Alonzo made a motion to approve the Earth Removal Application for 151 Leominster Shirley Rd. Ms. Bertram seconded the motion. All board members were in favor, motion carried. CURRENT BUSINESS 1. Summer Street Improvement Project - Ms. Speidel stated that there was an engineer/public information session held in January for this project and that there are three different alternatives for improvements to Summer Street. She believes that the board was leaning towards the alternative that had the center turning lane but that there was no vote taken at by the board. The project cannot be advanced any further until the board decides on which alternative they would like to pursue and also until there is additional funding received for the project. Ms. Speidel would like the board to consider presenting a warrant article at Town Meeting to appropriate Lunenburg's share of the 20% design fee from the Zoning Incentive Stabilization Fund. She stated that MRPC, through its TIP, will fund construction with grant funding, but they have not been successful with getting grant funding for the design of the project. Ms. Speidel said that Senator Jennifer Flanagan will work to amend the State Transportation Bond Bill to include 20% of the design funds for this project at the appropriate time. This bond bill will not come up until FY14 and it is good for five years. The cities of Leominster and Fitchburg are already covered for their share of the design. Mr. Matthews stated that it is a significant amount of money but just paving the road again would cost considerably more money. He feels that going ahead with this project is a step towards a long term solution. DPW Director Jack Rodriquenz said that repaving was not an option. The problems with the substructure of the road and the antiquated drainage problems are ongoing and he encourages the board to go with Ms. Speidel's suggestion. This warrant article will be added to Town Meeting, no motion was needed. 2. FY2013 Budget & Override - Ms. Speidel had prepared a slide show presentation on the subject of the FY013 Budget & Override and she reviewed each section with the board. All inforr Ms. Speidel stated that she wanted to be perfectly clear that the $2.2 M overr the Finance Committees. This override is permanent and hopefully will suste After the slide presentation Mr. Alonzo commented that this was an excelleni presemauon and very accurate. Mr. Sund thanked the Town Manager for providing all the information and questioned if the override is passed, why was funding for the IT Department and land use offices not being restored. Ms. Speidel answered by saying there is a computerized work order system in place for IT requests. It is very accurate and the number of requests that come in do not support the IT position. In regards to the BOH/Conservation position she has a gut feeling. She has surveyed neighboring communities that are comparable in size, that have one full time person, in particular the Town of Littleton, that serve both of those departments and it works quite well. She would also like to see uniformity to hours in those offices. ===PAGE 3=== Ms. Bertram thanked the Town Manager for the presentation and stated that she did a fantastic job. She is concerned with the loss of the BOS Chief Administrative Assistant and she feels that with monies being restored to the BOS, a Human Resource person should be reinstated or perhaps restore that position in a new role. She also said that she is happy to see another position reinstated to the DPW department. Ms. Bertram asked that the Town Manager to retouch on the issue of restoring funds to the Senior Center and Library. Ms. Speidel responded that first of all the Chief Administrative Assistant position would be restored at a different classification with a significantly lower salary. It would be converted with the primary duties being in Human Resources and special projects. She said that the restoration to the Senior Center and Library would essentially be restoring the 10% cut. Mr. deBettencourt questioned the funding for a Recording Secretary in the land use offices and he was also concerned with who would be left in the IT Department. Ms. Speidel responded that the IT Director is full time, there would be an assıstant at 1/3 time, and the schools have additional IT personnel. In regards to the Recording Secretary, Ms. Speidel said that she has had conversations with both Chairpersons of BOH and Conservation about the cuts in general but no specific conversation with them about the Recording Secretary. Dave Shea, Board of Health member spoke in saying that the BOH was shocked with the budget recommendations. He is worried that they will not be able to provide a good level of service with the proposed cuts. His concern is that he doesn't think the person they will have, will bring that kind of experience with them. Perry Jewel, Vice Chairman Board of Health, voiced that he is troubled that even with the $2.2M override, there are no funds being set aside to restore the reduction at the BOH and Conservation Board. He went on to plead his case that the BOH needs a viable assistant. He said that there are many more things the BOH could be doing but they can't do it with 31% less in department resources. Mr. Alonzo, Mr. Matthews and Ms. Bertram all made individual pleas to the Townspeople to support the Override. Mr. Matthews stated that he did not think that they were ready to vote on the Override this week but he would like to get it done by next week. Bob Saiia, 32 Sandy Cove Road, made a request to get the word out elsewhere besides the website, and to simplify the dollars and cents of what the Override will actually mean to each household. Mike Mackin, 26 Cortland Circle, gave a website address for the Lunenburg Citizens for Fiscal Responsibility for the public to go to for more information on the Override. 3. BOS Policies & Procedures - None 4. Minutes/Warrants/Action File Issues - Minutes: 1/3/12 BOS signed Warrants - Accounts Payable w54 (2/13/12) $909,673.98, Payroll Deduction Warrant w55 (3/14/12) 326,026.02, Payroll Warrant $660,245.95 w19p12 (3/12), License from BOS meeting 3/6/12 signed Action File Issues - Mr. Alonzo was concerned that the Lunenburg Library's answering machine has the wrong hours of operation on it. Also the Library website does not have the Library Board of Trustees listed and that it would be a good thing to have listed. 5. Committee Report - Mr. Sund rented that the Cahle Committee met last evening and approved a change to its Bylaws which were submitted change Mr. Matthews said the High Sc ednesday and that the last meeting was cancelled due to weather. Alsc ....... i vi hugur poultation last week and will be meeting with the Lunenburg Finance Committee on Thursday night. ===PAGE 4=== 6. Department Reports - None 7. Town Manager Reports: None OLD BUSINESS - None APPOINTMENTS/RE-APPOINTMENTS/RESIGNATIONS - None Mr. Matthews asked if there was any more Public Comments from the Board or the Public Dave Prokowiew 733 West St. asked the Town Manger about the section of the FY2013 budget presentation concerning the increase in the Police/Fire IOD, (Injured on Duty) he didn't think she covered it. Ms. Speidel said it was similar to Workman's Comp except it's for Police and Fire. There is a higher risk in these fields so it is a separate insurance. EXECUTIVE SESSION -M.G. L. Bilotta Meeting Room, Town Hall as scheduled with David Matthews, Steven M. deBettencourt, Paula Bertram, Tom Alonzo, Carl "Ernie" Sund and Town Manager Kerry Speidel present. Regular Meeting opened at 7:00 PM with the Pledge of Allegiance. PUBLIC COMMENT Mr. Matthews opened the meeting and thanked the people who attended the Town Caucus. He also congratulated Ms. Bertram for running for a seat on the BOS again and said that he hoped everyone comes out to support her. The meeting began with public comment from the Board. Mr. Alonzo reminded people that the deadline to register to vote in the May elections is on Friday April 13, 2012 by SPM. He announced that the Boys and Girls Club will be conducting a Recycling Funding Drive where you can turn in used ink cartridges, toners and small electronics. They will receive money from the Funding Factory for what ever they turn in. Mike Mackin, 26 Cortland Circle, said that at the Town Caucus which was held on 3/19/12 there were no candidates standing for the vacant School Committee seat. He urged the citizens of Lunenburg to participate and said that the deadline for collecting the required forty-five signatures on a petition for candidacy is March 29, 2012. ANNOUNCEMENTS - None APPOINTMENTS 7:00 PM Update from Unitil on Vegetation Management Plan, John DiNapoli & Sarah Sankowich, System Arborist - John DiNapoli, Muncipal & Community Services Manager for Unitil began the presentation of their 2012 Vegetation Management program. He introduced Sarah Sankowich, System Arborist for Unitil. Ms. Sankowich presented Unitil's 2012 Vegetation Management program plans for Lunenburg. Ms. Sankowich informed the Board that they have increased funding in Massachusetts to $1.2M and that the work that will be done includes pruning, hazard tree removal, along with some reliability related pruning and removal work as well. They have changed the clearing specifications for the pruning cycle to 10' side clearance. They are also inspecting all of the lines that are being pruned for hazard or risk trees. She said that they have "just shy of" 35 miles of work scheduled within the Town of Lunenburg. Unitil has hired contractors to do the work for them and they will be dropping off notification cards to residents before they begin work in their area. The Board asked questions regarding debris removal and liability. The Board thanked both Ms. Sankowich and Mr. DiNapoli for the information. 7:30 PM DPW Building Committee, Close Out Report - Jack Rodriquenz, DPW Director recognized and thanked all who were involved in the building rehab project at the DPW. Dave McDonald, DPW Building Committee Chair, also thanked all involved in the project. He then followed with a slide program about the project. The presentation included before & after pictures of the inside of the building and garage. Improvements to the building were many and they included items such as a new fire alarm system, heating system and carbon monoxide detector along with new garage doors, and T-5 light fixtures. The office/reception area, bathrooms and break area were all modernized and improvements to the stairway/mezzanine area were made. In the process they also gained a larger garage area. Cost effective measures were taken into consideration while this project was evolving. Savings in garage door purchase, furniture rehab, Unitil rebates and acting as their own Clerk of the Works produced significant savings. This allowed for $44,194., out of the $1.3 M which was allocated for this project, to be turned back to the Town of Lunenburg. ===PAGE 2=== Mr. Matthews thanked the committee and everyone that worked on the project and stated that the Town will benefit from this project for many years to come. Mr. Alonzo also thanked everyone involved and said it was hearting to see such a team event and that they all deserved to be praised and hopes that people can recognize that. CURRENT BUSINESS 1. Remote Participation at Public Meetings Policy, continued to 04/17/12, pending input from the Public Access Cable Committee. 2. T-Mobile Antenna Lease Renewal for Town Hall location - Ms. Speidel informed the Board that T-Mobile has leased space on top of the Town Hall building for their antenna for close to ten years and it is now time to renew the lease. Currently they pay rental fees to the Town of approximately $32,000 per year on a monthly basis which increases 3% each year. T-Mobile is looking to extend the lease for five years with two, five year renewal terms, with an option for the Town to terminate the lease if the Town so chooses. They would like some relief in the rent. Ms. Speidel proposed to the Board that the first year be held at a flat rate of $2687.83 per month and in the second year it would increase again by 3% per year, as it does under the current lease terms. She said that town counsel has reviewed the lease renewal and Ms. Speidel recommends that the Board approve the renewal of the lease with T-Mobile. (See attached information) Ms. Bertram made a motion that they renew the lease as presented by the Town Manager. Mr. deBettencourt seconded the motion. On vote, motion carried 5 in favor, 0 opposed. 3. FY2013 Budget & Override - Ms. Speidel reminded the Board that tonight's meeting is the meeting that was determined to be the appropriate time for the Board to take a vote to whether or not forward the override question to the Town Clerk for inclusion on the ballot at Town Meeting. She also provided the board via email with a sample of the language that would be appropriate to act upon. Mr. Matthews said that he thought the Board was more than ready to vote on whether or not to include it in the warrant. He feels the Board has a duty to bring this to the citizens and that it is their decision in the end as to whether or not it moves forward. He opened it up to the Board for further discussion. Ms. Speidel wanted to explain further the information which was presented at the last meeting concerning the FY2013 budget & override, specifically on how the $2.2M would be allocated through a five year period, and what the Town would look like in the in the coming years if the override did not pass. She provided this information with a slide presentation. Ms. Speidel is hopeful that the approximate $485,000 in State aid, which had been cut from the Town, would be reinstated and that this would help sustain the proposed override for six years or maybe longer. This override would represent a little more than an 11% increase in tax burden which is still 10% lower than the state wide average. She also explained to the Board all the cuts that could ultimately happen if the override does not pass, which would be cuts to ambulance services, road work, Library, Senior Center, Police/Fire, schools and the reduction in the hours of operation for Town offices. After the slide presentation discussion and questions from the Board members concerning the override ensued. A motion was made by Mr. Alonzo that the Board forward an Override Question to the Town Clerk for inclusion on the Ballot for the Annual Town Election in the amount of $2.2M. Ms. Bertram seconded the motion. Mr: deBettencourt confirmed that the vote was solely to establish a ballot question. On vote, Motion carried, 5 in favor, 0 opposed. Mr. Matthews voiced his concern with the line items in the budget cuts. He would like Ms. Speidel to have another discussion with the Land Use offices about the issue of consolidating the departments. ===PAGE 3=== Ms. Bertram questioned if they had looked at consolidation in other departments. She would like to see some sort of organization chart with hours of personnel to see if there are other opportunities to combine other departments as well. Troy Daniels, 94 Main St, had questions on the property assessments and wanted to know if they were projected to change. Ms. Speidel said that they are using the current assessment and they will be used throughout FY16 & FY17. He also mentioned that he is a former member of the Lunenburg Board of Health and that he wanted to know how combining the Conservation/BOH positions would directly affect the BOH. His thought was that the town needs a better explanation as to what was going on there. He said that the decision on the combined positions should not directly effect the decisions of the BOH. He stated that the public would be better served if they knew what went on at the BOH and knew the difference between the Town/ Local BOH and the Nashoba Board of Health. He also said that according to the town charter, going out into the field and signing permits was not the function of the position which is being spoken of. Ms. Bertram was concerned with combining assessment of the Nashoba Board of Health with the local BOH. She said that they have always been a separate assessment and should remain that way. Ms. Speidel said that the budget recommendation is being presented in the same form as always and that the Nashoba Assessment is clearly distinguished from the appropriation for the Board of Health. Brent Benson, Flathill Rd, read a letter in support of the $2.2M Override. He spoke of how the failure to support this override, will severely hurt the Town. He feels it is the fiscally responsible decision and asks the board to support the override decision. Dave Prokowiew, West St, asked about options to increase revenues if this is not done. Ms. Speidel replied that options are limited. They would be local receipts, property tax, State aide, excise tax, & permits/licenses/fees/fines. Mr. Alonzo made a motion to support the $2.2M override as presented tonight and various times by the Town Manager. Ms. Bertram seconded the motion. On vote, motion carried, 3 in favor, 2 opposed [deBettencourt, Sund] Discussion: Mr. Sund said that he feels that people can't afford the override and that they will move out of town. Mr. Alonzo made a plea to the people that if they cannot afford it, then don't vote for it. Ms. Bertram feels the responsible thing to do is for the board to vote for this and then bring it to the ballot for the voters to decide. 4. Minutes/Warrants/Action File Issues - The following minutes and warrants were presented for approval. 1. Minutes: 1/10/12 BOS & 3/13/12 BOS 2. Warrants — Accounts Payable w56-12 (3/20/12) $117084.74 Action File Issues - none 5. Committee Report - Mr. Alonzo stated that he was unable to attend the School Committee meeting of last Thursday. • Update on School Building Committee Activities - Mr. Matthews said that the School Building Committee had met, and with input from the MSBA after comparing surrounding towns, came up with a number for the feasibility and schematic design study of $750,000. The reimbursement from MSBA still needs to be determined. The timeline to bring the results of the study to Town Meeting could be in May 2013 and the forecast for construction to start could possibly be in 2015 or 2016. He stressed that this is a very early timeline. Mr. deBettencourt and Ms. Bertram expressed concern with the high cost of this project considering that this is not the final design plan. Loxi Jo Calmes, School Superintendent spoke and explained that this includes the price of a Project Manager who would continue on through the duration of the project. She said the basis for coming up with this number was a lot of research on existing projects and consultation with the MSBA. Mrs. Calmes agreed to present a more detailed report at the next BOS meeting. ===PAGE 4=== 6. Department Reports - None 7. Town Manager Reports- • Recruitment Process for new Fire Chief & Police Chief-Ms. Speidel informed the Board that both the Fire and Police Chief will be retiring this summer. She has put together a proposal for advertising of the positions that would follow the same procedure that they would do for any of their other openings. This would begin with an internal advertisement period followed by an external advertising period if needed. She chose dealing with the issue of hiring for Fire Chief due to the fact that Chief Glenny will be retiring first in July 2012. Ms. Speidel drafted a schedule for recruitment and job description for the board to review. (See attached) Mr. deBettencourt questioned why the internal and external advertisement was not done at the same time. He feels that if they advertise together, you will get the best candidate out of them both. Ms. Speidel replied that the Town has a history of how it advertises for positions and she was following that process. Historically, positions are advertised in house first, and if they have a suitable candidate than an appointment would be made. If there was no suitable candidate internal then they would advertise external. After discussion it was suggested that the positions be advertised internally and externally at the same time. Ms. Speidel said she will amend the advertisement to include the salary range because it will have an impact on the number of external applicants who will be applying. OLD BUSINESS - None APPOINTMENTS/RE-APPOINTMENTS/RESIGNATIONS - None Mr. Matthews asked if there was any more public comments from the board or the public. Mr. Alonzo asked Mr. deBettencourt what his reasons were for not supporting the override to which a spirited discussion arose between board members concerning this matter and other comments that were alleged to have been said several years ago by Mr. Alonzo. Ms. Bertram said she was approached by a citizen with questions about the position that is opening up in the Assessor's office and asked the Town Manager if it was full time. Ms. Speidel replied that the position was in the Treasurer/Collector's office as part-time and it will be filled at a lower level position. Ms. Bertram would like to research when looking at other part-time benefit positions, is there an opportunity to maximize one of our existing employees and leverage our existing personnel. She hopes to have these conversations before town meeting. Dave Prokowiew, 733 West St., questioned how volunteer and paid positions are advertised. Ms. Speidel said that it is advertised on the web site and through the talent bank. Mr. Prokowiew suggested that a more centrally located way of advertising should be put in place. FY2013 Budget & Override; Preliminary Information on Impact of Future School Building Project- School Superintendent Loxi Jo Calmes, along with School Committee member Mike Mackin and Director of School Facilities John Londa were present to provide more detailed information on the $750,000 Feasibility & Schematic Design article for the proposed school building project. Slide packets which included Statement of Interest, OPM Responsibilities, Projected Costs and Tentative Timeline were distributed to the board and were reviewed with them. (See attached) Discussion about the items attached to the $750,000 cost of the project and the reimbursement rate ensued. The Board thanked the Ms. Calmes, Mr. Mackin and Mr. Londa for their presentation. 2. Review & Recommendations on Town Meeting Warrant Articles- The Town Manager stated that she would be looking to send the warrant to the printer by April 11, 2012. All articles need to be numbered in the order that the Board would like to have them presented in, on the warrant, by that time. Anything presented or voted on after next Tuesday's meeting will not be printed in the warrant. Board members reviewed and discussed the articles along with their numbering sequence. The final draft of the warrant will be available at the end of the week. Ms. Speidel also stated that she forwarded to the Town Clerk a note indicating the vote taken at the last BOS meeting to forward the override question for inclusion on the ballot. She stated that while the Board voted on a total amount of $2.2M, it did not vote on the specific distribution. This will need to be done as both the Ballot Question and Town Meeting Vote will reference the document known as the "FY2013 Town Manager's Override Budget". She suggested that next week will be a good time to take the final vote. Ms. Speidel prepared an Organizational chart showing Town Hall and Ritter building employees positions and hours which the Board had requested at a prior meeting.. Discussion among the board returned to the ballot question that references the town manager's override budget proposal. Mr. Alonzo suggested that a reference be put into the town manager's override budget article, so that people are clear on what we are talking about, and that it's open to discussion, so that they know that they are not only voting to approve the allocations but also the budget items themselves. ===PAGE 2=== Ms. Bertram asked if information had been received yet from Conservation and BOH regarding the proposed changes to their departments, which the Board had requested the Town Manager acquire. Ms. Speidel said that she requested information from both boards and has received some preliminary information back from Conservation. She has not received much information from the BOH due to a problem with their data base which has prevented them from producing any reports. Ms. Bertram stated that she had spoken to the Chairperson of the BOH and that the problem was not with the data base but simply that the information has not been entered into it yet. Ms. Speidel will speak to the BOH Chairperson about this matter again. 3. Establishment of Memorial Day Committee - Ms. Speidel has researched the Towns by-laws and charter to see if any process/requirement is required to form this committee and she could not find any. She has not had a chance to put together a Charge for the committee but will do so by the next BOS meeting. Mr. Sund spoke and said he would like to establish a permanent Memorial Day Committee for the purpose of celebrating this holiday. He would like the people who serve on this committee to be from the School, Senior Center, Police, American Legion or a veteran. School Superintendent, Loxi Jo Calmes, has already volunteered to be the schools representative. 4.
