He also mentioned that the Chief of Police will hold a coffee hour at 11AM before the open house. APPOINTMENTS 7:00 PM - Request for Approval of Wine & Malt Beverage License, Honey Farms, Inc., 134 Leominster- Shirley Road: Vern Johnson, Vice President of Operations for Honey Farms, Wilfred landoli, President/CEO of Honey Farms, and Tracy Epstein, Manager of Honey Farms located at 134 Leominster Shirley Rd, came before the BOS to request approval for a Wine & Malt Beverage License for the 134 Leominster Shirley Rd. location. Mr. Alonzo asked when the opening date was and what the hours of operation were. Mir. Johnson replied that they are targeting 10/25/2013 for opening and the store would be open 24hrs. per day. Mr. Ebersole asked if the Manager had a CORI (Criminal Offender Record Information) check. Ms. Speidel replied that there were two submitted, one has come back, and they would need to submit one for the Manager. This is the last Wine & Malt license that is available in the Town. Mr. Toale asked what the hours of the alcohol license would be. Mr. Johnson replied 8AM-11PM Monday through Saturday and on Sunday 12Noon - 8PM. The Manager of this location is TIP certified Ms. Bertram asked what the appropriate verbiage would be to use in the decision regarding the CORI returns. Ms. Speidel suggested that you make it contingent upon the receipt of a clean CORI. If there is anything that is noted, it should be brought back to the BOS in accordance with the BOS policy. ===PAGE 2=== Ms. Bertram moved to approve the Wine & Malt Beverage license for Honey Farms Inc., located at 134 Leominster Shirley Rd contingent upon the receipt of a clean CORI for the one that is outstanding and upon receipt of a clean CORI for the Manager. Mr. Matthews seconded. On vote, motion carried, 5 in favor, 0 opposed. Mr. Johnson questioned the notification from MA State Lottery Commission regarding the Keno to Go at Honey Farms #93, 134 Leominster Shirley Rd Ms. Speidel replied that the BOS did receive notification that the Lottery Commission has authorized Keno to Go at that location and asked if the licensing authority had any comments. Board members discussed where the different Keno locations were in Lunenburg and were all in agreement that there would be no concerns from the BOS regarding this matter. APPOINTMENTS/RE-APPOINTMENTS/RESIGNATIONS 1. Ratification of appointment of Peter Lekaditis to position of Police Officer 2. Ratification of appointment of Bradley McNamara to position of Police Officer Police Chief Marino came before the BOS to recommend appointment of Peter Lekaditis and Bradley McNamara to positions of full time Police Officers to fill vacancies caused by attrition. Chief Marino spoke very highly of both candidates and gave employment/education backgrounds on each of them. Chief Marino requested that if the BOS ratifies these appointments, they become effective on 1/10/2014, because the Police Academy begins on 1/13/2014 and he would need a letter of appointment to assure a seat at the academy. Mr. Alonzo commented to say that he has the highest regard for Chief Marino's ability along with the Town Manager to find and groom people through the reserve program to get them to the point of Police Officer. He went on to say that the Chief and the Town Manager's track records have been excellent and he fully supports both of these appointments. Ms. Bertram moved to approve the recommendation to ratify Peter Lakaditis and Bradley McNamara to positions of full time Police Officers. Mr. Matthews seconded. On vote, motion carried, 5 in favor, 0 opposed. CURRENT BUSINESS 1. Notification from MA State Lottery Commission regarding offering Keno to Go at Honey Farms #93, 134 Leominster Shirley Road: Discussed under 7:00 PM - Request for Approval of Wine & Malt Beverage License, Honey Farms, Inc., 13 Leominster Shirley Road. 2. One Day Liquor License for North Leominster Rod & Gun Club, 11/15/2013: There were no representatives from the North Leominster Rod & Gun Club present to speak to this request. Mr. Alonzo spoke that this event was going to be for a Meat Raffle to be held at their location at 1501 Lancaster Ave on 11/15/2013 from 6PM-11PM. This has been reviewed and approved by the Police Chief. Ms. Bertram moved to recommend approval of a one day Liquor License for North Leominster Rod & Gun Club on 11/15/2013. Mr. Matthews seconded. On vote motion carried, 5 in favor, 0 opposed. 3. Request for Voluntary Toll, Turkey Hill Lions Club, 11/16/2013 from 8:00 a.m. - 2:00 p.m., town center & Whalom locations: There were no representatives from the Turkey Hill Lions Club present to speak to this request. Ms. Bertram spoke to say that as a member of the Turkey Hill Lions Club she will recuse herself from this vote. Mr. Alonzo explained that his is an annual event and is one of the many tolls in Town that are exercised from various organizations. He went on to say that the Turkey Hill Lions Club is well recognized in Town, they do excellent work, he personally supports this request and would entertain a motion for their voluntary toll day. Mr. Matthews moved to approve the Turkey Hill Lions Club request for a Voluntary Toll on 11/16/2013 from 8AM-2PM at the town center and Whalom location. Mr. Ebersole seconded. Discussion: Mr. Toale spoke to say that he supports the event but wants to remind the board that they had made a commitment to develop Policies & Procedures for "tolls" Mr. Alonzo agreed and mentioned that he hopes that permission would be contingent that they speak to the Police Chief, everyone where reflective clothing, and nobody under the age of 18 would be collecting. ===PAGE 3=== Ms. Speidel said that the Police Chief did review this request and those are the standing requirements for tolls. Mr. Alonzo called for a vote. On vote, motion carried, 4 in favor, 0 opposed. 4. Request from B&H Corporation to stay Order of Suspension for Mickey Shea's pending outcome of appeal to ABCC: Ms. Speidel reviewed the board that on 9/17/2013 the BOS voted to suspend the license of Mickey Shea's for violations of local regulations. The suspension is for two days on 10/18/2013 and 10/19/2013. The license holder has the ability to file an appeal with the ABCC (Alcoholic Beverages Control Commission) within ten days of receiving the notice of decision of the board. The license holder did supply the board with a copy of the letter that he sent to the ABCC requesting an appeal. The BOS has not received back confirmation from the ABCC that the request was approved and/or meets the requirements of the petition. Ms. Speidel attempted several times to contact the ABCC to see if they had received this request but was unable to speak with anyone in charge of this matter. She was successful in reaching a person today at that office and was told that the new Coordinator of Appeals was not in the office today. Ms. Speidel requested that Town Counsel check into this matter and apparently there is only one person who is in charge of appeals. Ms. Speidel went on to say that she could not confirm if the appeal was received, but has no reason to believe that it wasn't sent. Ms. Speidel explained that in the past Town Counsel has advised that you stay while the appeal is in process. When the ABCC hears the appeal and if they over turn the board's decision, it's easier for the Town to deal with if the license holder hasn't served the suspension. Town Counsel has suggested that the board consider setting a deadline of perhaps noon tomorrow to hear back from the ABCC. If it is confirmed that the appeal has been received, then the suspension for 10/18/2013 and 10/19/2013 will be stayed until after the appeal. If we are not able to confirm that the appeal was timely filed then the suspension will stand. Ms. Bertram moved to set a deadline of 12 Noon on October 16, 2013 to receive confirmation from the ABCO that the appeal filed by B&H Corporation d/b/a Mickey Shea's has been received. If it is confirmed that the appeal has been received, then the suspension for 10/18/2013 and 10/19/2013 will be stayed until after the appeal. If we are not able to confirm that the appeal was timely filed then the suspension will stand. Mr. Matthews seconded. Discussion: Mr. Toale questioned the letter from Mr. Herrick which requested various items which would aid in building his case for an appeal and if they were required to be in before the appeal or was it a date he was looking for. Ms. Speidel replied that both the license holder and the Town would receive notice that the appeal was filed and at that same time it is likely that we would be given a date for the hearing. This is a public records request that we would have to comply with and we have already answered that request. He does not need these materials to get a date for an appeal. The timeline to file an appeal is ten days from the date the license holder receives the notice of decision. Mr. Alonzo noted that the request for public information included a list of any and all disciplinary actions taken by the BOS or previous BOS against licensed alcohol common victuallas. Mr. Alonzo told Mr. Herrick that his establishment was one of them and when he asked him the night of his hearing if he had ever been in violation he gave an incorrect answer and that he had been cited for violations of his liquor license in the past. Mr. Alonzo asked for a vote on the motion. On vote, motion carried, 5 in favor, 0 opposed. 5. Minutes/Warrants/Action File Issues Minutes: Mr. Ebersole requested a correction on the Executive Session minutes dated 10/8/2013. He said that it is listed as "collective bargaining" and it is actually "negotiation with non-union personnel". Mr. Alonzo asked Mr. Ebersole to make the note, and they will initial it on the way back. Warrants: #20-14 10/15/2013 $240,953.74 Action File Issues: Mr. Ebersole inquired if there was any response from Town Counsel regarding the complaint concerning the Town Election. ===PAGE 4=== Ms. Speidel replied no and that she would put in a request tomorrow. School Building Committee; Sewer Commission; MA Broadband: Board of Health - No Report Building Reuse Committee - No Report Capital Planning Committee - Mr. Toale reported that they are meeting every Wednesday and will be meeting with the Fire Dept. tomorrow. Finance Committee - Mr. Toale reported that at the last meeting School Building Committee made a presentation where they also discussed finances. The Town Manager also made a presentation. Library Board of Trustees-No Report MPO- Ms. Bertram reported that they will not meet again until November. Planning Board- Ms. Bertram reported that she attended the last meeting and MRPC (Montachusett Regional Planning Commission) gave a presentation on the Village Center By-law which is being reviewed along with parking issues in the center of town. Also discussed was funding under the Unified Planning Work Program through MRPC for zoning and walk ability planning along with creating a MART (Montachusett Area Regional Transportation) hub in Lunenburg. Other highlights were the current work that MRPC is doing on the Village Center which is being funded by a DLTA (Dedicated Local Technical Assistance) Grants, information regarding economically viable businesses was presented. Ms. Bertram would like this information funneled to the Building Re-use Committee. The Planning Board will be investigating additional DLTA funding for looking at commercial and industrial development in the Leominster/Shirley Road Area. The Planning Board also asked for a timeline on the Primary Building and Ms. Bertram told them they are still waiting for information from RCAP Solutions. PACC- No Report School Committee- No Report School Building Committee- Mr. Matthews reported that a sub-committee has been set up to look at the design/finishes to see if they could reduce costs in some of the areas that will not be reimbursed by the MSBA (Mass School Building Association). They met last Thursday and will meet again on 10/24/2013 Mr. Matthews added that part of the reimbursement from MSBA is an extra 1.72 points out of 2 for building maintenance. If you look at some of the deferred maintenance, as we wait for the project to be flushed out, you might think that the building has been poorly maintained but the reality is that the average MSBA reimbursement for maintenance is 1% and we are at 1.72 and there has been a lot of work done by Mr. Londa and his staff with short money to keep it a useable building. Sewer Commission- No Report MA Broadband- No Report Proclamation: Lunenburg Women's Club- 100 Year Anniversary: Not Discussed Proclamation: United Nations Day 2013: Mr. Alonzo read into record the United Nations Day Proclamation 2013: The United Nations: In Everyone's Interest which proclaims October 4, 2013 as United Nations Day in the Town of Lunenburg. (See attached) ===PAGE 5=== Mr. Alonzo announced that in negotiations over the past few weeks the board has successfully negotiated a renewal contract with the Town Manager. Highlights of the new agreement are as follows: • The Salary of the Town Manager will increase to $125,000 per year from the current $122,039 per year. This salary will remain in force for all 3 years of the contract. • On December 1s' of each year of the contract there will be $2500 paid in a deferred compensation plan to the Town Manager • A change in the evaluating instrument was made to read "Should the Town Manager receive an overall rating by this board of "commendable" she will receive as a performance bonus, not to be added to next years base salary, of 1.5%. If the Town Manager should receive an overall rating by this board of "outstanding" it would be a 2.5% performance bonus of base salary." • Should the contract not be mutually renewed there would be no severance paid. Mr. Alonzo spoke to say that he has been very happy working with Ms. Speidel and that the change in the presentation of all of the financial and budgetary items has been extraordinary in the highest caliber. MS. Speidel has done an excellent job maintaining all of the work that needs to be done considering the overall decrease in purchasing power, a reduction in staff, all in the face of increasing State regulations on all fronts. He said that he is very pleased that they have come to another 3 year agreement. Mr. Mathews mentioned that over the past several years the Town Manager has forgone pay increases and has given a lot back to the Town that she was contractually obligated to. He went on to commend her for doing more, with less, in her office and said that she has proven to be of great value to this Town along with professionalizing Town Hall. He looks forward to working with the Town Manager for the next 3 years. Ms. Bertram spoke and said that she agrees with her fellow board members and looks forward to working with Ms. Speidel. Her professionalism and dedication is truly appreciated. Mr. Toale spoke to say that he also agrees with the board's comments but also appreciates Ms. Speidels sense of humor and positive spirit. Mr. Ebersole added that Lunenburg has come a long way in its Charter process with CAFO (Chief Administrative Financial Officer) changing to Town Manager and it's his goal to do what the this board is charged to do which is to stay in the policy level where ever possible and utilize the Town Manager's skills and background to do the management of the Town. He looks forward to working with Ms. Speidel through that process. Ms. Speidel spoke and thanked the board for the opportunity to serve the community and she looks forward to working with the board for the next 3 years. 4. Town Manager Reports or Department Reports: Mr. Alonzo mentioned that the Open Space Committee requested that a team be assembled to look at Open Space issues that maybe arising and would like to have a BOS member serve on that team. Ms. Bertram spoke and offered her services to serve on that team. Mr. Alonzo said that he would act as a "second" to attend meetings that Ms. Bertram could not attend. 8:00 PM - Joint Meeting with Public Access Cable Committee: Mr. Alonzo announced that the BOS will continue the regularly scheduled meeting in a "round table" setting not to be televised. He invited the public to stay along with the press if they wished Mr. Ebersole asked if this would be the meeting format when they meet with other committees. Mr. Alonzo replied that he thought that this should be the way to do it. They will be discussing issues such as By-laws and feels that this would be hard to present in a live meeting without visuals. Mr. Ebersole spoke and said that regarding next week's agenda item on Existing & Future Debt Service, he would like the Town Manager to explore looking at another option to finance the School Bullding project. He suggested perhaps doing interest only or reduced payment during the time period when other exempt debt is on the books so that later on there may be an opportunity to reduce the burden. ===PAGE 6=== Ms. Speidel replied that she could put that request together and advised the board that it is the BOS along with the Town Treasurer that actually determines how the project is financed and the term of the bond. Mr. Matthews reminded the public that input on this decision is welcome from the Finance Committee or anyone in the public who has an interest in this project. Mr. Alonzo reminded the board that there will be a BOS workshop meeting on October 29" to discuss Policies & Procedures. Ms. Bertram announced that they would now be moving into the non-televised meeting with the Public Access Cable Committee. Mr. Alonzo opened the Joint Meeting with Public Access Cable Committee (PACC) at 8:07PM and asked the PACC if they would please open their meeting at this time. The Public Access Cable Committee called their meeting to order at 8:08PM. In attendance: Chairperson Lance May, Vice Chairperson Rhonda Lisio, Secretary Fred Crellin, Troy Daniels, & Program Coordinator Jo McLaughlin. Lunenburg Board of Selectmen". Mr. May's belief is that the Selectmen appointment of Mr. Daniels is not valid due to the fact that the PACC did not meet to recommend this appointment to the BOS. Mr. Ebersole spoke and reaffirmed to the PACC that they now have 4 board members. 2. Financials - process by which information is shared with members, approval of purchase orders & invoices, budget & policy development, documentation & adoption process Discussion: PACC makes purchases by going out to bid and by following the procurement procedure. They remain concerned that their funding future is uncertain and have conflicting views on how their budget should be spent either for staffing or equipment. Ms. McLaughlin mentioned the fact that it is very time consuming for staff to train volunteers on how to operate equipment. She presented the BOS with a PAC Overview report that she had prepared, which has not been officially adopted by the PACC. PACC members will receive a copy at their next meeting. (See Attached) Ms. Speidel stated that the PACC has $250,000 in their budget and wonders why they have uncertainty of spending for extra staffing and equipment The BOS recommended that the PACC get a recommendation from the Town Manager on how to receive their budget. Some suggestions were to put forth a budget article at Town Meeting, make a budget report through the Town Report, or be considered as an Enterprise Fund The BOS suggested that the PACC develop a policy for setting permanent board meeting dates and times for their committee. Mr. May mentioned that they have a monthly calendar which shows all programming needs of the Town and it is reviewed with the staff. Town Boards/Commissions will be surveyed on their thoughts on televising their meetings. Policies should also be developed concerning equipment use by Town departments. 3. Open Meeting Law- Update on requirements for agendas, executive session, minutes & quorum: Discussion: PACC & the BOS discussed the definition of quorum and the confusion of what the legal definition is. According to the Open Meeting Law a quorum is considered a majority of the total membership, whether those seats are filled or not. The PACC is a 7 member board, which until recently had only 3 members. With the recent appointment of Troy Daniels to the PACC they now have 4 members which constitutes a quorum. ===PAGE 7=== PACC members voiced their concerns with the difficulty their board is having filling board vacancies. Suggestions were made for PACC to familiarize themselves with the Open Meeting Law updates, perhaps change the membership to a 5 member board at the next Town Meeting and to publicize the need for new members through Public Service Announcements and at all BOS meetings. The BOS suggested that a short job description be developed of what a PACC board member's responsibilities would consist of to aid in recruitment of new members. In regards to agendas Mr. Ebersole suggested that the Town Clerk be contacted for "agenda examples" that would comply with the open meeting laws. Mr. Daniels reminded the PACC that concerning minutes, they need to be made available for the public to review and that if it is recorded in the minutes "see attached document", that document or copy of must be submitted with the minutes. BOS thanked the PACC for coming forward this evening. Mr. May asked for a motion to close the PACC Meeting. Mr. Crellin moved to close the meeting. Ms. Lisio seconded. On vote, motion carried, 4 in favor 0 opposed. Meeting ended at 9:38PM. Being no further business Mr. Ebersole moved to adjourn the BOS meeting. Mr. Matthews seconded. Bilotta meeting room at Town Hall as scheduled with Chair Person Tom Alonzo, Vice Chairperson Paula Bertram, Dave Matthews, Jamie Toale, Robert Ebersole, and Town Manager Kerry Speidel. Regular Meeting opened at 7:00 PM ANNOUNCEMENTS: Mr. Alonzo mentioned that the Planning Board would like to announce that they have a public survey which concerns the updating of the Master Plan. It is being serviced by the site SurveyMonkey.com and there are paper copies available at Town Hall, Ritter Building, Library, and the Eagle House. Mr. Alonzo announced that there will be a Public Forum concerning the proposed Middle/High School on 10/30/213, 7PM, at the High School. The public was encouraged to attend. 7:00PM PUBLIC COMMENT: Frank Hartnett, Development Director of the Catalano Companies, Local Dunkin Donuts Franchisees, came before the BOS to request a Common Victuallers license. He stated that all of the paperwork required is in order and that the Operations Manager mistakenly did not submit the application in the proper amount of time. Mr. Hartnett would like the BOS to approve this license before their grand opening on Thursday. Mr. Alonzo spoke to say that the BOS did receive notification of this today, and in order to do this they would need to call an Emergency Meeting, which he was unsure if this situation qualified. He explained that licenses require that the board review the application and they have a specific time frame in which they like to review them. Mr. Matthews stated that there were emails today concerning this matter to see if the board could take this in a meeting in public session, but in accordance with the Open Meeting Laws this would require a 48 hour posting of the meeting. The board felt that there was still some information outstanding and there are limitations in the Open Meeting Laws to what can be done. Mr. Alonzo spoke and said that procedurally and by State Law they could not accommodate this request before the Thursday Grand Opening. This request will be added to the 10/29/2013 BOS agenda. Proclamation: Lunenburg Womens Club- 100 Year Anniversary: Christine Lattanzi, representing the Lunenburg Womens Club, came before the BOS to accept the proclamation. Mr. Alonzo read into record the Proclamation regarding the Lunenburg Womens Club 100 Year Anniversary and thanked the Womens Club for all of the work that they do. (See Attached) Ms. Lattanzi thanked the board for this recognition. Commendations: Police & Fire Dept.: Police Chief James Marino and Fire Chief Patrick Sullivan came before the BOS to present Commendations of Bravery to members of their respective departments for an incident which had occurred on the Whalom Lakefront. Chief Marino described the events of that day: which involved a pickup truck crashing through a fence into the lake which ultimately became completely submerged. ===PAGE 2=== If not for the heroic actions of the Police and Fire personnel in helping the victim to escape from the vehicle this would have become a fatality. Chief Marino and Chief Sullivan recognized Officer Charles Deming Jr., Officer Deven Z. O'Brien, Lieutenant Scott Dillon, Office Peter W. Lekaditis and Firefighter Matthew Glenny for their courage and for putting their own lives at risk to save the victim. Officer Deming, Officer O'Brien, Officer Lekaditis, Firefighter Glenny, and Lieutenant Dillion stepped forward and were introduced to the board and public. Mr. Alonzo spoke to say that all involved did a brilliant job and that nobody knows that more than the victim. He congratulated them all on a job well done. He added that this is a testament to the kind of people that wẹ have on the force and you could not ask for more from the people who serve in those departments. All board members expressed their thanks and appreciation to both the Police and Fire Departments, not just for their actions on that day but for their teamwork and exemplary work that they do every day. Halloween Trick-or-Treat House, Thursday, 10/31/2013, 6:00 - 8:00 p.m.: Mr. Alonzo announced the official Trick or Treat hours in Lunenburg as Thursday 10/31/2013 from 6-8PM. Board & Committee Vacancies: Mr. Alonzo announced that there are 3 vacancies on the Public Access Cable Committee (PACC) and described the qualifications for the applicants. Interested parties should complete a Talent Bank form and return it to Town Hall. APPOINTMENTS CURRENT BUSINESS 1. Approve Surrounding Community Agreement with the Cordish Company, Mass Live! Casino Project: Attorney Jonathan Silverstein from Kopelman and Paige came before the BOS to discuss the recently negotiated proposed Surrounding Community Agreement between the Cordish Company and the Town of Lunenburg. He explained that this provides surrounding community status which hopefully will give the Town a "leg up" when the Community Mitigation Fund has begun to be administrated by the Massachusetts Gaming Commission. This fund will be populated by both license fees and gaming taxes from the various gaming licensees as the facilities begin to operate. If the Cordish Company receives the Category 2 license (Slots Only) to operate in Leominster, they will immediately need to pay a $25M license fee and from then on will pay 49% of their gaming revenues to the State. Of this license fee, 10% will go into the Community Mitigation Fund which will be specifically set aside for communities that may feel impact from the gaming facility. As the Category 1 facilities (Larger Casino) open up they will pay a 25% gaming tax per year on all of their gaming revenues and 6.5% of that will also go into the Community Mitigation Fund. Category 1 facilities also will be paying 10% of their $85M license fee into that fund. Mr. Silverstein continued by saying that the developer felt very strongly, after studies were done by them, that the actual impacts to the surrounding communities other than Lancaster, MA, would be minimal. In order for the Town to try to disprove that, they would have to expend a significant amount of money to show differently. Mr. Silverstein described the major benefits of the agreement as follows: 1. The actual impact fee that the developer would agree to was $5000 per year. 2. Anytime the Town is required to provide a mutual aid response to the facility or if there is a public safety call in the Town of Lunenburg that requires the resources of the Public Safety entities, the developer will pay the cost of that response. The Town will have 60 days to submit the itemization of those costs. 3. A pool of funds will be created from a percentage of their gaming revenues above a certain threshold which will increase after certain thresholds are met. This pool will be divided equally among each surrounding community that voluntarily enters into this agreement. ===PAGE 3=== 4. The Developer has agreed to cooperate with the Town in seeking reimbursements from the Community Mitigation fund along with any other fund which may develop such as a Public Health Fund, Transportation Fund, or any other fund that is established that could provide benefits to the Town as a surrounding community. 5. There will be job preferences for the communities that sign on to this agreement, secondary to Leominster as their Host Community, intended for construction and permanent jobs at the facility. 6. There will be a kiosk placed in a prominent location within the facility to promote local and regional tourism and businesses. 7. There is a Responsible Gaming provision that requires the developer to exercise "best practices" with respect to problem gaming. 8. If the Developer enters into an agreement with any other community that's more beneficial, other than Lancaster, then what ever those benefits are with the other community, Lunenburg will receive also. Ms. Bertram spoke of her concerns regarding the traffic impact studies done by the developer. She anticipates increased traffic traveling from New Hampshire on Rt. 13 to this facility. If we enter into this agreement does that negate our ability to negotiate or reopen the agreement to receive additional revenues, specifically for roads, if we find their studies wrong? Mr. Silverstein replied that by entering into this agreement, the Town would be giving up its ability to challenge these studies now and go through an adversarial process in front of the Gaming Commission. To obtain the Surrounding Community status, because it would not be now be a part of a negotiated designation you would need to petition the Gaming Commission by 10/31/2013 in order for them to designate Lunenburg as a surrounding community. If the commission agreed that Lunenburg would have substantial negative impacts, and Lunenburg was able to demonstrate that to them through the petition, then the parties would have 30 days to negotiate an agreement. The process then will go through arbitration where the last and best offers from each side would be solicited, and the arbitrator will have to choose one of them. This process could bring us into February or March. If we sign this agreement and find that a year from now that we really are experiencing the traffic problems that we were concerned with, under this agreement we will not have the chance to go to the developer and ask for payment in excess of what we agreed to. We would however have the opportunity to go to the Gaming Commission to request additional funds and the applicant under this agreement, would be required to cooperate. Mr. Silverstein went on to say that he is quite certain that we could not negotiate a better agreement then this one. Mr. Matthews spoke to say that he was skeptical with the actuality of State funds being recouped out of the Mitigation Fund. Mr. Silverstein replied that this is not a formula developed by the Governor or by a State agency. This is in the Legislation that took many years to pass. The funds are not administered by an Administrative Agency that's dependent on funding from the Legislature; it will be administered by the Gaming Commission, which is funding from the gaming receipts. This has been methodically set up to be independent from State pressures and there has been a "fire wall" put up around these funds to make sure they go to the intended source. It would not be impossible for the State to get to these funds, but it would be difficult for them to do so. Ms. Bertram asked the Town Manager if there was any information from the Planning Board or from MRPC (Montachusett Regional Planning Commission) regarding what the road impact might be. Ms. Speidel replied that MRPC was required to review the application which included the traffic analysis along with the peer review from the engineer. They identified several different intersections/road ways that were of concern, prioritized them into two different categories, A & B, and Route 13 was in the second category. MS. Speidel asked World Tech Engineering along with the Traffic Engineer representing the City of Everett, where a Category 1 casino is proposed, to review the reports to see if the traffic assumptions seemed reasonable. Based on what they saw, they thought that the assumptions seemed reasonable. Considering the short time ===PAGE 4=== table it seemed to make more sense to focus on what to do if we had impacts once the project was up and running rather than trying to create data at this point. MRPC going forward, has committed to reviewing traffic data on a quarterly basis and reporting back to the surrounding communities that are in the MRPC region. Ms. Speidel mentioned that Lunenburg receives 5 free traffic studies a year and MRPC agreed to monitor some communities on a more regular basis which would not count against Lunenburg Mr. Toale asked for clarification on a previous point made by Mir. Silverstein regarding if another community decides not to go with the agreement, goes to arbitration and wins, does Lunenburg adequately get what they get? Mr. Silverstein replied no. The idea was that if the developer voluntarily provides or negotiates something in access of what the Town was getting, the Town would automatically get that match. They were unwilling to do that knowing that there were a number of surrounding communities that they were negotiating with that would all have that similar matching program. The process is that each side gives its last and best offer and it's designed that way specifically to give each side in arbitration a strong incentive to give the best offer they're willing to give. The last and best offer will have to be matched by the developer, whether it's accepted or not. Mr. Alonzo spoke to say that getting the Surrounding Community status and access to the pool of money is a better avenue than going the arbitration route. Once we have that status it's a lot easier to prove existing traffic patterns then it is proposed traffic patterns. Mr. Alonzo went on to say that he is comfortable with this, he commended Mr. Silverstein for getting the provisions in the agreement and said that he would like to move forward with this tonight. Mr. Ebersole mentioned the clause for reimbursement for negotiating costs and said that the cost for the Town's Attorney would be paid for by the developer. He went on to say that the Gaming Commission has not adopted regulations on how to apply for the Mitigation Fund and believes that the State will not favor one community over the other because there will be pressure from everybody to make everyone happy. Mr. Ebersole also agreed with the Town Manager's comments on the traffic study and feels it is important that we use some of the money that will come in to benchmark the different intersections coming down route 13 from Townsend to Highland St., Main St., Lancaster Ave and Leominster Rd. Mr. Ebersole believes that this is as good a contract that the Town will receive from the developer. He went on to say that this is a slots parlor and is not a huge complex. He is comfortable where the Town stands now with the understanding that they can go against the Mitigation Fund for documented changes. Ms. Bertram agrees with Mr. Ebersole's comments but in addition she feels it is important to document existing traffic patterns so it will show the increases and would like to utilize the funds to show if there are impacts. We will have to document existing traffic patterns and take another look when the facility opens. She went on to say that gaining Surrounding Community status is important but is disappointed in the small amount of $5000 because it will not go very far. Ms. Bertram said that she will vote to enter into this agreement tonight but it is with a strong caution that we utilize these funds and do the homework now. She would like to see the Planning Board and DPW Directors engaged early in this process to start documenting information on what we have. The intersection of Routes 2A & 13 is already a high crash site, which is documented by MRPC, and it is important to look at that data also as this progresses. Mr. Matthews moved to approve the Surrounding Community Agreement with Mass Live! Casino Project. Mr. Toale seconded. On vote, motion carried, 5 in favor, 0 opposed. 2. Approve Criteria 3, Energy Reduction Plan Green Communities Task Force: David Blatt, Chairperson of the Green Communities Task Force and John Londa, Advisor came before the BOS for approval Criteria 3 of the Energy Reduction Plan which needs to be filed by 10/31/2013. BOS members received copies of the Energy Reduction Action plan and Mr. Blatt reviewed it with them. (see attached) Mr. Blatt explained that FY2013 served as the baseline year to base all information on. The data thạt was accumulated for this plan was done using a software program which was provided by the Dept. of Energy Resources/Mass Energy Insight. ===PAGE 5=== The Task Force concentrated on the biggest energy users within the Town which are Town Buildings, Town Vehicles, Street/Traffic Lights, Water/Sewer/Pumping and Open Space. The projected planned energy savings (MMBtu) on each entity are as follows: BASELINE YEAR 2013 MMBtu Used in Baseline Year Buildings Vehicles Street/Traffic Lights Water/Sewer/Pumping Open Space Total 22415 4461 436 45 27364 % of Total MMBtu Consumption y 16.3 .03 1.61 •17 100% Projected Planned MMBtu Savings 3614.3 447.8 4,129.1 10.04 15.37 15.16 The State has asked the Task force to come up with at least 15% of savings outlined in individual projects with dollar figures on the projects. The remaining 5% can be done in other projects as they move forward with the grant money. Also discussed was how to achieve a 20% energy use reduction within the 5 year period following the baseline year along with actions the Town may take to save money in Town buildings such as switching the Public Safety Building to gas instead of oil, and window replacements in schools and Town buildings. Mr. Alonzo asked what would happen 5 years from now if we don't hit the 15% required by the State, would the grant money need to be returned? Mr. Blatt replied that there is no mention of what would happen, they ask that you hit the goal of 20% savings. You can apply for grants each year after your initial grant just by showing the projects that you've accomplished and the projects that you'd like to accomplish. Mr. Alonzo asked Mr. Blatt if they were asking for the BOS approval on this for submittal, and if this would be the final criteria we would be submitting. Mr. Blatt replied yes and that they already have approval on the other 4 and this is the final criteria. If this is approved we will be able to apply for Green Community Status by the October 31% deadline and have grant status by December. Mr. Alonzo asked Mr. Londa if his 5 year savings projections were achievable. Mr. Londa replied that there was one item on there that is overwhelming on whether this plan is successful or not. The biggest energy savings in this plan is the replacement of the High School. Heating of Town buildings is where all the savings are. If the High School project moves forward, we are seeing almost all of the energy savings coming in out of the heating of that building. Mr. Alonzo asked if this plan, the way it is written now, is predicated on a new Middle/High School project Mr. Londa replied correct, which makes this a doable plan because we are not looking for 20% from every building. He said that there are 2 aspects of this plan which are wise things to do which requires that we develop energy conservations plans that are building specific. One of which involves Department Heads getting involved in how they use their buildings and the other is new technology in lighting such as LED. If the Middle/High School project does not go through, we still have 5 years to achieve the 20% by doing a major revision on this plan. Mr. Blatt spoke to say that he feels that 20% savings is very achievable with this plan Ms. Bertram questioned where in the plan does it talk about the measures to implement the 10% savings concerning the vehicle stand point and she suggested that it be added to the plan. Mr. Blatt replied that it is all incorporated under the whole entity, specifically with the anti-idling/fuel efficient plan which was adopted a few weeks ago. Mr. Matthews spoke to say he was glad that energy audits were going to be added as part of the energy policy. ===PAGE 6=== Mr. Ebersole commended the Green Communities Task Force for this report particularly on bringing awareness on how to do things differently in Town Buildings such as lighting conservation. Ms. Bertram moved to approve the Green Communities Task Force Criteria 3, of the Energy Reduction Plan. Mir. Matthews seconded. On vote, motion carried, 5 in favor, 0 opposed. Ms. Speidel said that before we discuss Existing Debt Service & Estimates for the School Building Project she would like to share some good news that was received last week relative to one of the Town's bond ratings. She explained that the Town carries 2 bond ratings from two different agencies, Standard & Poor's and Moody's. Most recently the negative Moody's bond rating which the Town had been carrying has been eliminated. Ms. Speidel stated that she does not think that this will affect the Town's interest rate and explained that back in 2009 the Towns credit rating was increased from both agencies. The Town had an A2 with Moody's and a single A with Standard & Poor's and these ratings were increased based on a review of the Town's financial performance to a AA3 from Moody's and a AA- from Standard & Poor's. Both ratings have moved up and are equivalent now. This was a significant improvement for the Town because we went from an upper medium grade rating to a high grade rating. There are four ratings that are within that high grade rating category with Moody's there is a AA1, AA2, AA3, & a single A1. With Standard & Poor's there is an AA+, AA-, and an At. When we go out on any particular bond issue we are in the high grade category, and where we stand within the high grade category, there doesn't tend to be a difference in the interest rate that you would receive from a particular bond issue. You may see a fluctuation in interest rate based on what else you're competing with that day and the size of your issue. If the Town has a large issue, the Town will receive a very good rating because we are a high grade bond. While the change in the rating is good news, it will not have a significant positive impact on the interest rate. When we go out to market for the High School project or any bond issue we will get a very competitive rate because of that credit rating. Ms. Speidel does not want people to think that we should have a higher rating. All we can do is speculate on how to move up to the next level. According to the Town's Financial Advisor we would need to be looking to have our financial reserves north of 10% upwards to 12 or 15% and currently we struggle to stay at 5%. Ms. Speidel does not feel it makes sense to set this as a goal for this community because she does not believe that it would have a significant impact on an interest rating that we would achieve. She thinks that we need to be realistic about who we are, what we are, and what is achievable. We are doing an excellent job with what we have and she is very pleased to have that negative outlook removed. Mr. Matthews spoke to say that to get an improved rating in 2009 as the economy was at it's bottom and to still improve based on the financial decisions that the Town and the community was making speaks volumes. We are looking at a significant project for the Middle/High School and we're going to market soon for significant borrowing and its good that the negative is off of our rating. We have made a lot of difficult decisions over the forwar many of them unpopular, but it's served a purpose and has given us a good solid base line to move 3. Review Existing Debt Service & Estimates for School Building Project: Ms. Speidel worked along with the Town's Financial Advisor to come up with funding scenarios for the school building project, assuming that the local share for the project would be approximately $37M. Twenty and thirty year scenarios were looked at along with level payment and level principal scenarios. (See attached reports) Level principal scenarios are shown for illustration only. It's typical for public infrastructure projects, except for school projects to finance on a level principal model. This means that the payments are highest in the beginning where the principal is the highest and it is reduced over time as the principle is paid off. There is special Legislation in the State that allows school projects be financed as level payment level debt service projects so that there is predictability in what the cost will be for the tax payer. The level payments are similar to a mortgage where you end up paying more in interest because you are reducing your principal at a lower rate. The projected impact of a 30 year project on an estimated $37M would be approximately $538 annually for a home of average assessed valuation of $248,000. On a 20 year term it would be approximately $625 for a home of the same assessed valuation. For a 30 year term the interest rate would be approximately $25.7M and with a 20 year term it would be approximately $18.1M. ===PAGE 7=== Ms. Speidel reminded the board that by State Law the actual financing of the project is left to the BOS and the Town Treasurer. She recommended that over the next several months the board familiarize themselves with the project in order to make the best decision for the community in terms of how to finance this project. We have some very small non-excluded debt that is falling off our debt service schedule around the years 2017 & 2018. Then we have a significant portion of our exempt debt falling off around the years 2012 & 2015. Ms. Speidel was asked by members of the BOS and Finance Committee to look at some scenarios that would allow some temporary financing to get us to one of those two junctures to potentially lessen the burden of this project to the tax payers. While we have some flexibility to do some short term financing for the project that would carry us out several years. We have an authorization for $750,000 for the feasibility study & schematic design portion of the project We need to do a borrowing before the end of the fiscal year to cover the Towns share. The clock will start ticking on the project at what ever point this fiscal year that we do that borrowing. We have the opportunity to go 2 years out and just pay interest costs associated with that short term borrowing. Once we go past the 2 years we have to start making principle pay down payments even if we continue to just do the short term financing of the project. What happens when you are required to make that principle pay down payment, you're making a payment on interest and principal and you don't have the benefit of having the project permanently financed so the level of payment you're making between principal and interest is essentially the same. Based on what Ms. Speidel has looked at she is not seeing a way through short term financing that will significantly lessen the burden on the taxpayer and we are basically looking at the 20 or 30 year borrowing scenarios. Mr. Ebersole spoke to say that one of the things he would like to look at is if we borrowed at 30 years for 10 years then at that point convert to a 10 year loan which would still get us at a 20 year period, but the first 10 years would be when its layered on the exempt debt and the second would take the place of some of that. He likes the idea of a shorter term with shorter interest and thinks that the borrowing should be some what close to the life of the building. He is aware of the amount of interest between the 20 & 30 years but is also aware of the $95 difference for the people involved. Mr. Ebersole is in full support of the school building project and the only way that this Town can pay for it would be an exempt debt and that's what he would support Mr. Alonzo spoke and agreed that all avenues have to be looked at. The illustration that Mr. Ebersole presented could bring short term satisfaction, we can't predict what the interest rates will be, and we need to hear from the public their thoughts on this matter. Mr. Matthews spoke to say that whether you have kids in school or not, who paid for these schools. His kids went through these schools and the schools were here when he got here and he will pay tor them going forward. He asked if the Financial Advisor knows concerning 20 years out or 30, what is the impact of the value of money, 20 years from now is there a projection we can put on that? If we want to go longer term, could it possibly make sense financially? My initial instinct is no but in this day and age people tend to look at things differently. Ms. Bertram feels it's critical to get public involvement. It makes sense to go for the shorter amount of time to save the Town $10M but we also need to understand that a lot of our citizens live on a fixed income and it could make a difference whether or not they vote to support the project based on that small amount of money. Mr. Alonzo made a plea to the people listening tonight to communicate their thoughts to the BOS either in a letter, email, or in person about this issue. Ms. Bertram suggested putting the Town Manager's spread sheets on the website or perhaps do a simple survey online using Survey Monkey. Mir. Ebersole requested that the 35 option of 30 years down to 10 be added to the survey. ===PAGE 8=== Mr. Alonzo asked that Mr. Ebersole bring the question to the board before it is added to the survey as it appears so that he can make sure it is all predicated, these are hypothetical numbers and it has not been determined that these are in the range that we are looking at. Mr. Toale thinks that it is the board's legal responsibility to make a fiduciary decision. He agrees that it is important to hear the opinions of the Towns people and it is important to take risk out of it as much as we can. He agrees that nobody knows what the interest rates will be 10 years from now but whether you are on a fixed income or not, you plan better if you have a fixed idea of what an expense looks like. The Towns people will decide if they want to make a significant expenditure and those decisions may or may not be impacted on whether or not they have people in school. He believes its part of an obligation when you live in a town to understand your tax burden for all the different things that it pays for. Ms. Bertram agrees that is our fiduciary responsibility but the biggest question is whether or not they are going to be able to afford it. Soliciting public input is going to be critical. Ultimately it is the BOS that will be making the decision but the biggest question is going to be "What is it going to cost me ?" on an annual basis. Mr. Alonzo thanked the Town Manager for her report. 4. Review First Quarter Revenue & Expense Reports with Town Accountant: Karen Brochu, Town Accountant and Shelley McCaie, Treasurer/Tax Collector were both in attendance for this agenda item. Ms. Speidel reported that they have looked at the first quarter results for the current fiscal year and things are looking well. (See attached report Revenues through 9/30/2013 are running at 24.46% of budget. We received 100% of the existing MSBA reimbursement in the first quarter, which represents 6.6% of total revenues received. If this were backed down to represent only 25% of the year, total revenues collected would be 23.5% of budget rather than 24.46%, still higher than what is typically seen at this time of year. Of particular interest is the Meals Tax, which is running at 30.64% of budget. At this rate, it is possible that we will significantly exceed the budgeted estimate. Based upon what Ms. Speidel sees, she has no significant concerns regarding the Towns ability to meet the revenue estimate for FY2014. Some things to look forward to in the second quarter will be building permit issuances for the solar projects which will be approximately $100,000+ for both projects. New growth data from the Assessors office shows an estimate of $250,000 and we are potentially looking at approximately $280,000 in new growth. Expenditures through 9/30/2013 are running at 37.5% of budget, which is typical of the first quarter, as this percentage includes both actual expenditures and encumbrances. There are a number of expenses for which the Town encumbers the full amount of the anticipated expenditure up front, including: Audit, Utilities, and Service Contracts. Additionally, the Town has significant debt services payments due in the first quarter and also pay the full Worcester Regional Retirement Assessment on 7/1/2013 in order to gain an additional savings. Particular items being paid attention to are Legal Expenses; Injury Leave, Veteran's Benefits, Band Concerts, and Health Insurance. Mr. Ebersole referenced the Library budget operation and said that if something is encumbered, this system presumes that it is going to be spent and is 100% used. Is there another report that's there for budget vs. actual without the encumbered? If you take the encumbered part out you are seeing what we are actually obligated to pay at that point. Ms. Speidel deferred that question to the Town Account but commented that if you look at the reports you can see that different departments do things differently. We encumber when a purchase requisition is submitted. Typically the way that I would do that is if I entered into a contract to expend something, I would encumber those funds. Sometimes smaller departments will encumber 100% of their supplies budget, perhaps believing that if they don't encumber, it will be taken away. Karen Brochu, Town Accountant, spoke to say that she doesn't think there is a different report but thinks that the thought process is that if those funds are encumbered the monies will be expended. To the best of her knowledge in the accounting system that we have that's the report that will be generated. ===PAGE 9=== Mr. Ebersole asked as you expend it, is the encumbrance released? Ms. Brochu replied yes. Mr. Ebersole asked Ms. Brochu to describe the staffing in her office and what the status of the MUNIS system was as other departments use it. Ms. Brochu replied that the staffing is herself as full-time and a clerical person that works 24 hrs. per week who's primary function is the account payable warrants. We are looking to roll out the actual requisition portion of the MUNIS module to all departments so they have the ability to enter the pay requisitions in electronically rather than passing papers along. Currently we are in the process of training and setting up the proper securities so we have the ability to do that. As far as freeing up time in her office, this will not do that. Originally the Selectmen's office was in charge of that system and the thought process is that it will free up time in that office so that the person in the Selectmen's office can do the functions that she was originally hired to do and not purchase orders. Ms. Speidel added that in FY2011 we had a full time person that half time did purchase orders/requisitions and the other half would do benefits. This person was laid off and at that point the requisitions were brought to the Selectmen's office which became a good 60% of the BOS secretarial person's function. We are trying to get to the point where we can do this electronically. Ms. Brochu mentioned that the people who are using the system now are very happy with it and once it is up and running will be great. People using it will be able to go in and look at their budgets, run their on reports and check the status on a purchase order etc. Ms. Bertram stated that years ago one of the objectives of the Computer Advisory Committee was to obtain the ability to for individuals to beyond the purchase order requisition and to do their payables online, are some of the departments doing that now? Ms. Brochu replied that the School Dept. and the DPW both have remote access and are entering their own accounts payable. The Accountants Dept. only needs to go through these and verify that what has been entered is correct and is a proper expense. Ms. Bertram asked if there were plans to deploy this to other departments. Ms. Brochu replied that she thinks its something that can be done at the same time that the requisition decentralization is happening. Mr. Ebersole asked if the audit will be coming back to the BOS and will we have another discussion at that point? Ms. Brochu replied that they are coming in to do the actual audit work in the first week in November then drafts should be available within a couple of weeks after that, then hopefully a final audit sometime in January. Mr. Ebersole questioned if the BOS or the Town Manger signs off on that. Ms. Speidel replied that what we have done with the audit is switch off with the Finance Committee. There is no official document that is signed. We have the auditor make a presentation to the BOS one year and to the Finance Committee the next year. This year the presentation will be made to the BOS, hopefully before the review of the FY2015 budget. Mr. Ebersole asked Ms. McCaie when the next status report on the Tax Title will be. Ms. McCaie replied that she received information from Copolla & Copolla on the 6 properties that she had selected for the Land Court and they have been filed with the Land Court. Seventy-five letters were mailed yesterday from her office to residents who still owe money on "2013" taxes, prior to her sending out the letter for advertising to try and cut down the number of people she has to advertise for to save on expense. She is receiving responses from residents that received the mailing asking for assistance. Due to budget restraints she could only do 6 properties for the Land Court filing. Ms. Bertram stated that it is important to look at the Treasurer/ Tax Collector budget because as we go forward with this project, if we put more money into it, it will pay off in the long run. ===PAGE 10=== 5. Status Update: Town Manager Goals: Rescheduled to the 11/5/2013 BOS meeting. 6. Status Update: Board of Selectmen Goals: Rescheduled to the 11/5/2013 BOS meeting. 7. Minutes/Warrants/Action File Issues Minutes: 10/15/2013 Ms. Speidel noted that two board members requested some minor changes and these are not reflected in the minutes before the board tonight. 10/8/2013 Ms. Speidel noted that these were corrected minutes regarding the misidentification of the Vice Chair. Warrants: #9P-14 10/13/2013 #21-14 10/22/2013 #22-14 10/23/2013 Manual Check 10/21/2013 $629,684.40 $458,403.23 $258,536.74 .01 The BOS signed corrected paperwork regarding the Town Managers Contract Renewal. Action File Issues: Mr. Matthews commented on the "Jones House" which was sold to the Marshall Family at low cost. He said that the work that they are doing to it is bringing it back to life, it is returned to the tax role, and it will prove to be an asset to the center of town when it is finished. Mr. Alonzo suggested that the BOS receive status reports on the progress of the renovations to the Jones House. He agrees with Mr. Matthews statements and thinks that the sale of this house was a win for everyone. He also mentioned that the "Right of Way" which was granted for that property has proven not to be an impediment on the Chester Mossman Teen Center. Ms. Bertram requested that a status update meeting be scheduled with RCAP Solutions soon. Ms. Speidel replied that we are not ready to do this yet due to fact that the Assessors and the developers are still trying to put together information to bring to the BOS. The next round for funding has not been announced yet and they may be looking at a different combination of funding sources. The BOS is not the cause for any delays with this project. 8.Committee Report: Board of Health; Building Reuse Committee; Capital Planning Committee; Finance Committee; Library Board of Trustees; MPO; Planning Board; PACC; School Committee; School Building Committee; Sewer Commission; MA Broadband: Board of Health - No Report Building Reuse Committee - Mr. Toale reported that they met last evening and are making progress in narrowing some of the variables down and they feel good about meeting their timeline. Town Manager Reports or Department Reports: No Report APPOINTMENTS/RE-APPOINTMENTS/RESIGNATIONS Resignation: Rob Taylor, Reserve Police Officer: Mr. Alonzo announced that a resignation letter was received from Reserve Officer Rob Taylor. Mr. Alonzo thanked Mr. Taylor for his service to the Town. Resignation: Robert Rand, Personnel Committee: Mr. Alonzo announced the resignation of Robert Rand from the Personnel Committee. Mr. Alonzo commended and thanked him for his work on the committee. Mr. Alonzo requested that this opening be put on the list of vacancies that are being announced every week for different committees/boards specifically mentioning vacancies in the Green Community Task Force & the PACC. Ms. Bertram pointed out that Mr. Rand's vacancy became effective on 9/16/2013. Dave Blatt, Chairperson Green Communities Task force spoke to the board concerning the membership on that committee. He would like the BOS to make the membership a committee of 3 with 1 or 2 alternates. They are finding it difficult to have a quorum at meetings and that the last 2 sets of meeting minutes have not been approved due to that problem. Mr. Alonzo replied that the BOS has taken that under advisement and he hopes that people will get involved before going through the effort of reducing the number of members. Ms. Bertram cautioned Mr. Blatt about meeting without a quorum and that a quorum is based on the total membership. Mr. Blatt replied that they cannot meet now because of the quorum issue. The original membership is 7 and they now have 4 active members, 3 of which show up on a regular basis and 1 that makes it to the meetings when he can. Mr. Alonzo stated that the Green Communities Task Force was created by the BOS and not by a Bylaw so they do have the ability to change the membership. He then made another plea for any interested people to please fill out and return a talent bank form. This item will be put on the 11/5/2013 BOS agenda for further discussion. Mr. Blatt also mentioned to the board that Town website incorrectly lists the BOS officer's names and should be corrected. Being no further business Ms. Bertram moved to adjourn the BOS meeting. Bilotta meeting room at Town Hall as scheduled With Chair Person Tom Alonzo, Vice Chairperson Paula Bertram, Dave Matthews, Jamie Toate, and Town Manager Kerry Speidel. Absent was Robert Ebersole Regular Meeting opened at 7:02 PM 7:00PM PUBLIC COMMENT Mr. Matthews acknowledged a group of Lunenburg citizens who donated labor and material costs for the construction on a Bocce court at the Eagle House Senior Center. Those thanked were Paul Anderson, Mike Nault, Dave MacDonald, Joe Progin, Jamie Toale, Tom Alonzo, Carl Luck, Fred Malcolm, Peter Charpentier, Tom Nowd, Pete Lincoln, and the DPW. Mr. Alonzo congratulated all who organized and participated in the Annual Miles for Myles 5K fundraiser. ANNOUNCEMENTS: APPOINTMENTS 1. Request for Boot Drive, Salvation Army: Dave MacDonald, Lunenburg MA., came before the BOS representing the Salvation Army, to request permission for a Boot Drive to be held on 12/14/ 2013 in the center of Town and by CVS intersection in Whalom, from 9AM-3PM. Mr. MacDonald spoke of the charity work which this organization does and challenged the BOS to come and a "ring a bell" for their Kettle Drives. Both the Chief of Police and Fire Chief have given approval for this event. Participants will be wearing reflective vests while soliciting funds at this event Mr. MacDonald also mentioned that he is in favor of the BOS developing a policy concerning "Boot Drives" in the Town. Mr. Toale moved to approve the request for the Salvation Army Boot Drive to be held on 12/14/2013, from 9AM-3PM, in the Lunenburg Town center and at the CVS intersection in the Whalom district. Ms. Bertram seconded. On vote, motion carried, 4 in favor, 0 opposed. Mr. MacDonald mentioned that he along with other volunteers would like to decorate the Upper Town Common with Christmas lights again this year. The lighting ceremony will coincide with the School's holiday celebrations as well. Mr. Alonzo replied that he had no objection with this and that a vote from the board was not necessary. Mr. MacDonald thanked Mr. Matthews for his recognition of the volunteers who built a bocce court at the Eagle House Senior Center. He said that the Eagle House really appreciated the work that was done and that he appreciated being able to do it for them. 2. Police Chief Marino, Lt. Luth- K-9 Grant Opportunity & Development: Police Lt. Mike Luth spoke to the board and explained that a generous grant from the Stanton Foundation has been received to start a K-9 Program with the Lunenburg Police Force (LPD). This grant is in the amount of $25,000 which will be used for purchasing the dog, training of the dog & handler, cost of conversion of a cruiser for the K-9 team, Kennel at handler's home, training equipment, K-9 Bulletproof vest, Dog food, Vet care allowance, a 10% reserve for contingencies, and reserve for future K-9 skills training This grant will run over a 3 year period and Lt. Luth is looking for a 5 year commitment from the Town of Lunenburg. Lt. Luth mentioned that Officer Tocci of the LPD. has solicited residents and business owners in Lunenburg to see if they would be interested in partnering with the LPD in making this program successful, and has received a very positive response for this program. With local support for this program it will keep the costs low for the Town and will enable the program to continue past the life of the grant. Mr. Alonzo asked what the use of the K-9 would be. Lt. Luth replied that it would be used to track people, follow suspects involved in crimes, be trained in protection of the handler, and would be trained in narcotics detection (dual purpose). Mr. Alonzo asked what the estimated costs would be after the 3 year life of the grant was completed. Lt. Luth responded that other jurisdictions costs were estimated as follows: Food - $800 ===PAGE 2=== Veterinary - $5-600 In-service Training - $500 This program will be deployed similar to the traffic program in a sense that when the handler and dog have to be in service during their training, it would not deplete the patrol force causing overtime. There will be a policy/mutual aide agreement developed on how the K-9 is deployed in regards to requests from other communities, but for the use of the Town of Lunenburg they will be on call 24 hours. Ms. Speidel asked Lt. Luth to describe some instances where the LPD have needed to use a K-9. Lt. Luth replied that mostly for tracking of lost persons, including children, along with narcotic situations where they would need to rely on outside agencies for this assistance. Completion/approval time for the grant needs to be submitted by 11/25/2013. A handler from the LPD will need to be chosen with assistance from the Stanton Foundation along with the Boston Police K-9 Training Academy, who will make the recommendation of the handler. This process to receive the K-9 will take several months to get up and running which could run out to next Spring or Fall. This will be followed by a full-time, 40 hour per week training schedule, for the handler and the K-9 that will run for 14 weeks at the Boston Police K-9 Training Academy. Mr. Alonzo asked Ms. Speidel if the BOS needed to vote on this item. Ms. Speidel stated that the BOS did not need to vote on or officially accept this grant. Mr. Toale spoke to say that after reviewing the grant, he believes that the Stanton Foundation would like to see some sort of support/approval from the Town. Mr. Alonzo spoke in favor of this program stating that it is a well-proven program not only across the country but also around the world. Ms. Bertram also spoke in favor to the program and said that they have done a phenomenal job in approaching vendors in the town and then thanked the vendors for their support. Officer Jason Berthelette, of the Woonsocket R.I. Police Force gave a short demonstration with the K-9 "Tango" which he brought with him this evening and then introduced himself to the board. Officer Berthelette described the training history of "Tango" and his own involvement with the K-9 programs. He explained that depending on how the dog is bred, trained and taken care of, a "duel purpose" dog can have an 8-9 "functional working years" expectancy. The dog is then retired, but will still retain its working habits. Mr. Alonzo thanked the Stanton Foundation for offering the grant and stated that he could not be more supportive of this group. Ms. Bertram thanked Lt. Luth for putting together this program. Lt. Luth also spoke and recognized Officer Tocci for doing most of the leg work for this program. CURRENT BUSINESS 1. Status Update: Town Manager Goals: Ms. Speidel reviewed the status of the Town Manager goals with the BOS as follows: Personnel Institute annual performance evaluations with departments. This has been started and Ms. Speidel is in the process of scheduling meetings with department heads. She expects to have all of the performance reviews done with the metrics established by the end of the month. Implement periodic department head/staff meetings to facilitate communication and teamwork These are occurring on an "as needed" basis and at some point in the future Ms. Speidel would like to get back to having these on a quarterly basis. Formulate a system to document performance issues and specific corrective actions. Each of the collective bargaining agreements and the salary administration plan identifies what the process steps are for disciplinary action which we follow. Explore training and educational seminars. The Massachusetts Interlocal Insurance Association (MIIA) provides training on a regular basis either on site or through webinars. MillA training is free, easy to access online, and the Town receives credits back from MIlA when the Town participates. Last year we received approximately $11,000 in participation credits and Ms. Speidel would like to set up an ===PAGE 3=== "in house" grant program with these funds where they could be redistributed to departments for activities that might not get funded within in the annual operating budget. There are some board members and staff who are participating in the Citizen Planner Program which offers different workshops and seminars across the State on a variety of land use topics. The Personnel Committee has taken this up a number of times but has not made much progress in this area. Ms. Speidel na spoken with this committee about potentially hiring someone to do this work, which is very time intensive. There is ar opportunity for a grant from MilA which would cover the cost of hiring for this project. Ms. Speidel has talked with a consultant who is interested in doing this work but cannot begin this until January 2014. Ms. Speidel believes that a Human Resource Director is needed. Without a Human Resource person, this is something that either the Town Manager or the Personnel Committee takes up or someone is hired on a project basis. Ms. Speide would like to include monies in the FY2015 budget for a part-time Human Resource person. Keeping items such as job descriptions and policies current is difficult due to lack of staff time. Establishment of departmental goals and objectives. This is something that will occur through the Annual Performance Evaluations with the department heads. Finance Implement Performance Base Budgeting. Ms. Speidel is hoping to include some performance measurements within the FY2015 budget recommendations. Providing quarterly budget updates with an Executive Summary to be co-presented with the Town Accountant. The first quarter report was provided to the BOS and to the Finance Committee and the Town Manager was pleased that this was done in a timely fashion. Construct a Budget Retrospective by department of historical funding and staffing tasks performed or eliminated with outsourcing impact note. Ms. Speidel expects to have more detail on this for the FY2015 budget. Ms. Speidel stated that she met with the Finance Committee and they agreed on 12/12/2013 as the date to have the 5 Year Financial Forecast presentation as a joint meeting with the Finance Committee. Operations Operational review and analysis with efficiency improvement plan or affirmation of existing operations. This is done on an informal basis as the budget recommendation is put together. Ms. Speidel noted that the Police Chief has suggested that the Town of Lunenburg explore the possibility of a Regional Animal Control Operation. There is a sizeable Community Challenge grant available from the State which some communities in Western Mass have received for regional animal control. We are not in a position to apply for it this year due to time constraints but will be applying next year. However we will be applying for a District Local Technical Assistance (DLTA) grant through the Montachusett Regional Planning Commission (MRPC) to do a feasibility and initial planning study for regional animal control. The Towns of Lancaster, Pepperell, and Townsend have all shown interest in partnering with Lunenburg for this operation. Develop Project Planning & reporting for annual tasks or special reports. No comments at this time. Plan for future positions, additions, consolidations and/or elimination. This will occur throughout the budget development process for FY2015 Develop, document and implement of 5 year facilities/maintenance plan for both operating & capital. The Department of Public Works (DPW) is currently drafting a plan. The Building Re-Use Committee is gathering and analyzing a lot of data that we would like to incorporate into this plan as well. Develop a plan to codify current Bylaws. The Town had secured funding in FY2013 for this project, a contract has been signed for this project, and it is moving forward although there is no time table for when it will be completed. Work with the IT (Information Technology) Director to develop, document and implement town wide IT policies. These are the IT Director's goals for the current fiscal year. ===PAGE 4=== Mr. Matthews commented to say that before we get into the budget process we need to lay some ground work to look further ahead and flush it out. We have talked about consolidating facilities management operations across all Town functions along with consolidating personnel chart functions. He believes that the Regional Animal Control is a good idea and hopes they can get one that deals with wild animals also. The Regional Lock Up is another item that he would like to discuss further. He added that the Town Manager's goals update was good and that we seem to be going in the right Ms. Speidel stated that the way she has approached efficiencies and regionalization etc...is when opportunities arise. We have tried to create some opportunities such as consolidating Human Resources although there is currently a void there. We've seen opportunities through the retirement of a staff member or through someone taking a position some where else. We've been successful with that but it's been quite a while before we've tried to create an opportunity. Ms. Bertram echoed Mr. Matthews comments and said that looking at it in the budget is part of the budget. She believes that rather than be reactive we need to look at opportunities and she is happy with the progress. She feels that with reinitiating the quarterly department head meetings, maybe opportunities will present themselves. We need to start looking at streamlining operations and she would like to start looking at this earlier in the process rather than during the budget process. Ms. Speidel stated that we are always going to be reactionary, we don't have the staff that we need to have. When she started with the Town the BOS and Town Manager's office functioned with 4 full-time equivalents and we now have 1.75. Although she is the one who brought forward those changes, cuts needed to be done. She believes that the problem is creating the time to be addressing these issues outside of the budget. She would challenge anyone to go to any other community and find anyone doing more regional activity or doing things smarter or better than we are. There is always room for improvement but we are pretty impressive for a community of this size. Mir. Matthews spoke to say that Ms. Speidel is always looking ahead at changes in the workforce and people retiring. He added that he realizes that this is an ongoing thing with the Town Manager and he appreciates that. Ms. Betram spoke and said that she had concerns with the BOS budget last fiscal cycle and she continues to have those concerns. She thinks that if the budget does not support the staff that is needed we need to address that and put in the funding that is needed for a Human Resources person and for whatever staff is needed. She added that the Town Manager is doing a phenomenal job with the staff that she has. A lot of responsibility has fallen upon the Town Manager due to the lack of staffing and we need to look hard at the funding within our own office. Ms. Speidel spoke and said that we need to put together a budget that's responsible and that the community will support. When they are talking about making more cuts in the school, DPW, and Police & Fire in order to have a Human Resource person, it is a hard sell. None of the administrative cuts were done because it was something she wanted to do and it's tough to "beef up" the back office when people are hurting in the other services. Mr. Alonzo spoke and said that we have to recognize what drives the budget. We are not even breaking even, we are going in the other direction. He agrees that taking advantage of every opportunity that may arise is what we need to do, but still the driving force is taking the money and doing the things we need to do is where we always get caught. Mr. Toale commented and said that if the work of Human Resources is viewed as a back office function it will get put into the budget cycle as "do we or don't we" need it. The real work of Human Resources is being done every day because it needs to by our Manager's and the Town Manager. Clear job descriptions, clear goal setting, motivation, and recognition are all parts of what we do when we work for the Town. He added that he would support thinking of it as a much more holistic discussion, dealing with it in each of our jobs, and supporting it in anyway we need to as opposed to a "back office" function. Mr. Matthews mentioned that the Planning Board Director will be retiring next year and he thanked Marion Benson for planning ahead with notifying the BOS. He also thanked her for all of the years that she had donated as a Planning Board member while doing the work of a Planning Director for free. He also recognized the years she has served us since she joined the Towns work force. He mentioned that some of the work she has done has not been popular but you cannot deny that she has "worked her tail off' for this Town. 2. Status Update Board of Selectmen Goals: Mr. Alonzo reported on the status of the BOS goals as follows: Finish Review of the BOS Policies & Procedures Manual. The board has been working on this and are waiting on the final revisions. All policies have been reviewed that we currently have and they have defined some of the hearing procedures. Also being looked at are appointment, re- appointment, and performance review procedures. ===PAGE 5=== Creating a list of Town owned land and chapter properties. There is some work that was done by previous study committees and we said we would make this a more formal document. We will be checking with the Assessors office on those properties for their valuations and then the BOS will decide what to do with them. Ms. Bertram mentioned that in regards to the Chapter land the board was looking for feedback from the Open Space Committee on developing a criteria and she would like an update from them. Economic Development Plan- Discuss and explore how best to attract business and other development to the Town. Discuss further the creation of an economic development team. Ms. Bertram mentioned that we have information from MRPC which was distributed to the Building Re-use Committee and thinks that the board may want to re-visit that and discuss about an economic development team. MRPC is doing work under the Department of Labor and Training (DLT) grant for the Planning Board that she believes will tie into this and would like this put on a future BOS meeting. Approve communications between committees and departments. There was the reinstatement of the regular Chairpersons meeting. Although there have not been regular Chairs meetings, when topics have arisen meetings have been arranged with municipal departments and other elected and appointed boards. Town web site, 3 sub-goals. Establish basic policies for what documents must be on the web site and in what format. Discuss and propose basic framework for those document formats while staying up to date. Explore the possibility of establishing a web site policy committee. We have not approached this yet and it should be done in conjunction with the IT Director. Mr. Alonzo stated that we need to address two of the BOS goals which are the Economic Development Plan and the Town web site. All others are in progress. 3. Set date for Special Town Meeting and Special Election: Ms. Bertram moved to set the dates of January 7, 2014 for the Special Town Meeting and January 11, 2014 for the Special Election. Mr. Matthews seconded. On vote, motion carried, 4 in favor, 0 opposed. Mr. Alonzo reminded the public that while there maybe other articles on the Special Town Meeting, the driving force behind this Special Town Meeting is the proposed school building project, which is not a "done deal" yet. He stated that 2 votes will be needed to make this happen which will be a 2/3rds vote at Special Town Meeting and then it will need to pass at the Special Town Election. He will be speaking at each BOS meeting about this project. Ms. Speidel reminded the BOS that the warrant will be placed on next weeks agenda which will make the warrant open on 11/12/2013 and close on 11/19/2013. She will also have a draft of the question for the Special Election and this will need to be approved by the BOS and the MSBA. 4. Consider reduction in membership Green Communities Task Force: Ms. Speidel explained that this Task Force has problems with meetings because all of the appointed members are having trouble attending meetings and therefore they cannot reach a quorum. Since the last BOS meeting, no one has come forward to serve on this Task Force. Currently this is a Task Force of 7 members, 4 of which are appointed and 3 of which are staff serving as ex officio. The options for the BOS to take this evening include either appointing the staff or reducing the membership. Ms. Speidel recommended reduction of the Task Force saying that she does not believe that staff should become appointed members, their role should be for giving assistance or advice. Ms. Bertram recommended that the membership be reduced to 5 in order to insure that are able to have meetings. She would have preferred that people had come forward to volunteer and in the event that people do come forward at a later date, this can be revisited again. Ms. Bertram moved to reduce the membership of the Green Communities Task Force to 5 to insure a quorum. Mr. Toale Discussion: Mr. Matthews stated that he is bothered by the fact that no one came forward to join this committee. He mentioned how people were upset with the Task Force during the solar discussions and that these people need to get involved with their town. Increasingly the burden is on the same group of people over and over again. ===PAGE 6=== Mr. Alonzo spoke to say that he agrees with Mr. Matthews saying that he had hoped someone would come forward and that it was disappointing and disheartening that nobody did. He stated that he agrees with the Town Managers belief that staff members should not be appointed as voting members. Mr. Toale spoke to say that he agrees that this could be revisited again if people came forward who were willing to serve. On vote, motion carried, 4 in favor, 0 opposed Mr. Alonzo reminded all that the Public Access Cable Committee (PACC) is also in need of 3 more members. He mentioned that you can be a High School student and be on this committee. He thinks that this opportunity should appeal to people who want to be involved in television on all different levels. People interested can pick up talent bank forms either at Town Hall or they can access them online. 5. Accept BOS Policies & Procedures: Tabled to the next BOS meeting. 6. Minutes/Warrants/Action File Issues Minutes: 10/15/2013 10/22/2013 Warrants: Lunenburg Water Dept. Quarterly Bill $5336.31 10/28/2013 #10P-14M $424.63 11/9/2013 #10P-14 $650,217.73 11/5/2013 #23-14 $444,790.62 *11/5/2013 #10P-14V -$2123.15 *Ms. Speidel noted that the payroll reduction is the final approval of disability retirement of one of the Police Officers which went into effect as of 10/30/2013 $314,542.91 Action File Issues: Mr. Toale reported that he had received a phone call from a citizen requesting that in light of any vote to significantly increase taxes that the BOS look into any assistance that might be available for senior citizens. Mr. Alonzo recommended contacting the Council on Aging Director for information. Ms. Speidel recommended contacting the Assessor's office for a any information they may have and she will ask the Assessor to make a presentation on any programs they have available at the next BOS meeting. 8.Committee Report: Board of Health; Building Reuse Committee; Capital Planning Committee; Finance Committee; Library Board of Trustees; MPO; Planning Board; PACC; School Committee; School Building Committee; Sewer Commission; MA Broadband: Board of Health - No Report Building Reuse Committee - Mr. Toale reported that they met last evening and said that all of the preliminary input from the two task groups are in. The next meeting will be on 11/18/2013 and they hope to draft their conclusions along with any recommendations at the 12/2/2013 meeting so they can present them to the BOS at a future meeting. Capital Planning Committee - Mr. Toale reported that this committee continues to meet weekly and will be reviewing the School Dept. capital requests this Thursday. Finance Committee - Mr. Toale reported that this committees last meeting was spent reviewing the School Building project. They plan to return to their review and update of their finance policies at their 11/14/2013 meeting. Library Board of Trustees- No Report MPO- Ms. Bertram reported that the Town is on track with meeting the requirements for the Summer St. "2017" Transportation Improvement Project (TIP). The project is unusual because we were not at the 25% design at the time that they were placed on the TIP, which was with the understanding that they would get there within a certain time frame, which they will meet, and they should be at 25% design in November. There will be a hearing in March. Massachusetts Dept. of Transportation (MassDOT) will have a hearing and the Town of Lunenburg will also need to have a public hearing Ms. Bertram stated that the amount of "Green Space" has been reduced. There will be approximately 10' of Green Space on the side, opposite the tracks, rather than the larger swath. This is due to configurations of the layout as well as property lines etc. They plan to meet with some of the business owners between November and March to make sure they understand how the project is going to move forward and to address any concerns that they may have. There will be sidewalks on both sides of the road along with granite curbing. ===PAGE 7=== Planning Board-Ms. Bertram reported that this board's first meeting in November will not be held due to the fact that they will be attending a meeting at MRC concerning site plan reviews. Their next meeting will be on 11/25/2013. PACC- No Report School Committee- No Report School Building Committee- Mr. Matthews reported that this committee held its first Public Forum last Wednesday and it was fairly well attended. They have been trying to "fine tune" the design to bring some costs back in line. They are the Middle School and High School more clearly defined in their separation. As they looked at this design they would reduce the cost by over $1M, which will significantly lower the cost to the tax payer. The Mass School Building Association (MSBA) will meet on 11/20/2013 to review the plans and hopefully they will approve them then. The committee's belief is not to get too aggressive with design changes because it could upset the progress with the MSBA. Every month the project is delayed costs approximately $150,000. Public Forums are scheduled for 11/16/2013 at the Library from 10AM-2PM, and on 12/5/2013 at the High School at 3PM and 7PM. Ms. Speidel mentioned that she had attended a meeting with the MSBA this afternoon where they went through the status of submittals and what the next steps are. The Town will be receiving a project scope and budget agreement from the legal staff of the MSBA within the next several days. They indicated that ideally, they would like to have the BOS execute that document before the 11/20/2013 meeting. She reminded the board that there are only 2 meetings before that date and is unsure if this can be done. Mr. Matthews voiced his frustration with this process but pointed out that this partnership with the MSBA will save the Town $35M-$36M. Ms. Bertram questioned the changes in the design and asked how this works in with the budget, if we do execute this agreement which sets the budget prior to the 11/20/2013 meeting. Mr. Matthews replied that the budget is being submitted with the changes and reduction in costs already taken out of the contingency lines as opposed to the construction lines. As we get past 11/20 it will be shifted around appropriately. It's still the same size building and capacity but the changes will make better use of space within the building Ms. Bertram commented and said that she was happy to attend the presentation, a lot of good information was received, and she was happy with the number of people in attendance. She had paid particular attention to the number of people who asked what advantages would this new building project bring to the curriculum and moving forward she would like emphasis put on that type of information and how this project will provide more advantages to future students. Sewer Commission- No Report MA Broadband- Mr. Alonzo reported that Ma Broadband is at 100% of the poles surveyed and installed. They are 99% done with the project in its entirety for lines run, and the networking is at about 97%. Lunenburg is set to go online in December of this year. After the community anchor institutions are online, the work can begin on how to address business and resident attachments, which is not yet fully in place. The main focus is to get the Town buildings set before they go on to 3rd party access. Ms. Bertram asked if they will assist with the 3d party access. Mr. Alonzo replied they will act as a liaison. There is a bidding process and an entity will take over from the State. Ms. Bertram asked what is our involvement? Is this going to be 3 parties doing this individually with homeowners or is this going to be something the Town will orchestrate. Mr. Alonzo answered that he is looking to get involved from a Town perspective. He is hoping to have companies that are approved that Ma Broadband has worked with. Once it's available, because it's a public project, 3º parties can bid on getting access, that's why it's not fully defined as of yet. 9.Town Manager Reports or Department Reports: Ms. Speidel reported that the online survey asking what the Towns people preferred for financing of the Middle/High School Building project currently shows that 21 people have responded, 62% prefer a 30 year term, and 38% prefer a 20 year term. She was hoping to get a better response from the Town. Mr. Alonzo reminded all that the final decision on how to finance this project lies with the BOS in conjunction with the Town Manager and other financial committees in the Town. The more people who respond to this survey, the more their influence will be considered. ===PAGE 8=== Mr. Matthews added that when you look at an average property tax bill the net effect would be $2640 more with a 30 year financing as opposed to a 20 year financing. The most fiscally conservative way to approach this is to go for the shortest term possible however the affordability issue is a big deal and going with the 30 year term would be less of a burden on the taxpayer.
