Bilotta meeting room at Town Hall as scheduled with Chairperson Tom Alonzo, Vice Chairperson Paula Bertram, Dave Matthews, Jamie Toale, Robert Ebersole, & Town Manager Kerry Speidel. Regular Meeting opened at 7:00 PM ANNOUNCEMENTS Mr. Alonzo thanked all who came out to support the Lunenburg Boys and Girls Club "Are You Smarter Than a 6"h Grader" fundraiser and said that it was a successful event. 1. Committee Vacancies: Historical Commission: Mr. Alonzo announced that the Personnel Committee and the Historical Commission are looking for board members. 2. Citizens Party Caucus, Monday, 3/17/2013 at 7:00 p.m.: Mr. Alonzo announced the date and time of the Citizens Party Caucus and reviewed the offices that need to be filled this year. 7:00PM PUBLIC COMMENT - Troy Daniels, 94 Main St. read to the board a letter which he had written concerning his dismay of how the BOS along with Public Access Cable Commission (PACC) appointees have handled current and past alleged Open Meeting Law violations, to which he cited many. He also made mention of what he believes is a lack of transparency in the Town's government accusing a current BOS member of violating the "Conflict of Interest" law in a past Town issue concerning employee "bumping" of a relative and also added that a former BOS member had made a statement with reference to "getting rid of trouble makers". Mr. Daniels said that he was not seeking thanks for his volunteer time, would like for the BOS to do their job, and he will continue to complain about officials who persistently trample the rights of citizens and disrespect the law. Ms. Bertram responded that she takes offense to Mr. Daniels statement concerning violating the "Conflict of Interest" law and explained that as soon as she had found out that there could be a conflict of interest with that item, she immediately recused herself from all discussions relative to that matter. She suggested to Mr. Daniels that he should check his facts before he makes accusations and said that to get things done you need to work together as a community and not blatantly attack people. Mr. Ebersole spoke to say that Mr. Daniels is not the only person to notice Open Meeting Law violations and that he will be recommending that the BOS meet with the Park Commission, which is another board that has agenda and minutes issues. He went on to say that Lunenburg has a problem with how we operate, how we recognize volunteers, and how we comply with the law. Mr. Matthews noted that concerning quorum issues with the PACC they appointed Mr. Daniels to that committee to help bring that board closer to a quorum. Immediately there were attacks to point out all the past and present issues with the PACC as opposed to any effort, on the part of Mr. Daniels, to move that committee forward. Currently the PACC doesn't exist and is being run by the BOS, which is entirely legal and we are looking forward to hearing from the Attorney General, and from the Secretary of State concerning the er, and rom the sacelay the election issues, and we'll see where this takes us. We will continue to serve this Town with transparency as best as we can, find Mr. Ebersole noted that it would have been impossible for Mr. Daniels to continue with the PACC with the violations that were going on. Although the PACC may have accomplished many things they did not adopt policies, have left us open for lawsuits, and for violations of the First Amendment and Discrimination Clauses. Mr. Daniels spoke to say that his issue is not with the people who run the programming at PACC but rather with the committee. He went on to say that the Vice Chair was refusing to be sworn in and meetings were still be scheduled even after he told them they had no quorum and could not meet. He attempted to work with these people but they did not want to work with him. Michelle Belleza, Director of the Boys & Girls Club of Lunenburg spoke to ask the board for their support in proclaiming March 23, 2014 to March 29, 2014 Boys & Girls Club Week. Mr. Alonzo stated that they will not vote on it this week, but it will be placed on next weeks agenda for signing. Ms. Belleza thanked the BOS and everyone in the community for all of their support. APPOINTMENTS 7:00 PM - Request for BYOB, Kabob-E-Licious, 165 Mass Avenue: Tarrnum Williams owner of Kabob-E-Licious came before the board to request a BYOB permit. Ms. Williams has read the Lunenburg Policies & Procedures required for a BYOB permit and is TIPS certified. ===PAGE 2=== Mr. Alonzo noted that the policies & procedures state that application for this permit shall be made at the time of the initial or renewal application. He believes that this Bylaw should be changed and that a business should be able to apply any time that a Common Victualler's license is inforce. Mr. Matthews moved to approve the request for the BYOB license. Ms. Bertram seconded. On vote, motion carried, 5 in favor, 0 opposed. CURRENT BUSINESS 1. Request for Voluntary Toll, Lion's Club, 5/17/2014, 8:00 AM- 2:00 PM, both locations: Ms. Bertram recused herself from this discussion because she is a member of the Lion's Club. There were no representatives present from the Lion's club present this evening so Mr. Alonzo explained that this request was for 5/17/2014 from 8AM - 2PM in the center of Town and at the intersection of Electric Avenue & Whalom Rd. This organization is aware of the safety procedures that are required to run a voluntary toll. Mr. Ebersole moved to approve the request for a voluntary toll for the Lion's Club to be held on 5/17/2014, 8AM-2PM in the center of Town and at the intersection of Electric Avenue and Whalom Road. Mr. Matthews seconded. On vote, motion carried, 4 in favor, 0 Mr. Matthews applauded the Lion's Club for the great work that they do in the community. The School Department will be the entity to determine if a Lion's Club Bake Sale could be held on the school grounds on election day. 2. Request to Amend BOS Policies & Procedures, Section 2.07, Appointments of the Board of Selectmen: Mr. Ebersole proposed to the BOS that an addition to Section 2.07 Appointments of the Board of Selectmen's Policies and Procedures be as follows: "Upon the resignation of or end of term of office for appointees, the Board of Selectmen will send a letter of appreciation for the appointee's service. This shall not apply to appointees whose appointment was terminated by the Board". Discussion ensued among the board members which included the following: Thank you's should be heartfelt, sincere and spontaneous and having language that enforces a thank you, devalues the thank It should be the option of the board or the Chair as to who receives a thank you • This request is more of a directive then a policy Mr. Ebersole spoke to say that a letter of thanks will be sent to a member of a committee with violations and not to one who pointed out those violations. He went on to say that this is a directive, because we want to thank the volunteers who have worked and that he was very disappointed. No action was taken by the board concerning this request. 3. Approve amendment to PEC Agreement; Distribution of Mitigation Fund: Ms. Speidel reviewed the amendment to the PEC agreement concerning the distribution of mitigation fund. The language submitted by PEC is as follows: "The Town and the PEC agree to strike the language in paragraph 7 and paragraph 8 of the amendment dated May 14, 2013. The Town and the PEC agree that the Town, with the mitigation fund of $51,406.00, will provide a premium holiday or a one-deduction premium reduction (based on the calculations) for subscribers enrolled in the Town of Lunenburg's health plans as of June 30, 2013." Ms. Speidel explained that individual subscribers would receive a one time payment of $88.60 and family subscribers would receive a one time payment of $177.26. These payments will be distributed this fiscal year and after these payments are made, the fund will be exhausted, and there will no longer be a mitigation fund for this agreement. Mr. Ebersole moved to approve the amendment to the revised PEC agreement; Distribution of Mitigation funds. Mr. Matthews seconded. On vote, motion carried, 5 in favor, 0 opposed. 4. Discussion of list of Legislative Priorities to forward to Legislative Delegation: Mr. Matthews had prepared a draft list of Legislative Priorities which will be forwarded to the Legislative Delegation. Board members discussed the following to be included: Discontinuing the deflection of lottery fund money • Releasing any funds such as Chapter 90 funds which were allocated by the Governor • Inclusion of the IT Bond Bill Mr. Ebersole moved to authorize that Mr. Matthews complete the draft with the addition of the IT bond. Ms. Bertram seconded. On vote, motion carried, 5 in favor, 0 opposed. Ms. Speidel added that the Special Education costs for FY14 in Lunenburg were $2.2m and the Circuit Breaker payment is $700k and she requested that this be added into the Legislative Priorities list. 5. Discussion regarding Peer Review of MS/HS Building Project: Mr. Matthews reported that the School Building Committee had met with several regulatory groups from Lunenburg and they discussed whether or not the school project needed to go through a plan review with the Planning Board or the Zoning Board of Appeals. At that meeting the Building Inspector noted that school projects are exempt from any plan reviews. Board members discussed the following concerns and thoughts concerning the Peer Review: The risk of paying an engineer to review the plans of the engineer that is already getting paid • The project being too large to ask to have reviewed "Pro bono" • If this is to be done then we would risk the possibility of establishing a debt • Review the process which was followed for construction of the Primary School • Obtaining opinion from Town Council concerning this matter • Possibility of having the Planning Board or MRPC review the project • The size of the roadway/driveway and its impact on the Passios Building concerning possible future business use Mr. Alonzo requested that this item be carried again on next weeks agenda after Town Counsel's opinion is received and other information is gathered. 6. Status Update on Acquisition of Lane Property (Discussed out of order after 7PM Appointment) : Brandon Kibbe, Member of the Open Space Committee came before the board and reported the following concerning the acquisition of the Lane property: ===PAGE 3=== • They are looking to purchase approximately 168 acres of land off of Holman Street • This land will provide the only meaningful access to the existing Town forest land that is currently inaccessible by Town residents • This is eligible for funding which will come from a State Grant program at a 62% reimbursement rate • Total acquisition cost is capped at $400k • They have negotiated a Purchase & Sale price of $3200 per acre or appraised value, or which ever is less • They are currently finalizing the sale with the seller and are in the process of soliciting bids for appraisals All cost information will be final before this goes to Town Meeting The board thanked Mr. Kibbe and the committee for their work on this project. This purchase will be decided at Town Meeting by the voters and the bulk of the purchase will come from State Grant funding. 7. Review /Discussion FY2015 Town Manager's Recommended Budget: Not discussed 8. Review/Discussion of Warrant Articles for Annual Town Meeting: Mr. Alonzo read the Warrant Articles for Annual Town Meeting as follows: Revolving Funds • Union Contracts • Stabilization Fund Transfer • Capital Plan • 3 Enterprise Funds • Operating Budget Sewer Map Amendments/Extension • Lane Property • Amend PACC Bylaw Appropriation from Sale of Cemetery Lot Receipts • Amendment of Zoning Bylaw Concerning Medical Marijuana Dispensaries • School Transportation Fee • Offset Accounts • Monty Tech Stabilization Account • Changes in Conservation Property As. Bertram mentioned the Elmwood Rd. development regarding the earth removal permit. Article 9 Section 9 #12 of the Genera own Bylaw basically exempts a project that is associated with a sub-division from an earth removal permit. The amount of grave eing removed from this project is significant (50,000 cubic yards) and is going to be sold for a profit which makes this a true eart emoval project. Ms. Bertram would like clarification from Town Counsel regarding the wording of this Bylaw and placing this as a Article on the Warrant for Annual Town Meeting. Ms. Speidel reminded all that the Warrant will remain open until 4PM on March 24, 2014. 9. Minutes/Warrants/Action File Issues Minutes: 3/4/2014 Warrants: W#19P-14 W#46-14 W#47-14 $678,033.26 $370,788.15 $513,932.39 Action File Issues: A letter was received by a disabled citizen who is finding transportation to his place of employment difficult due to lack of public transportation in Lunenburg. He requested that the BOS investigate an extension of MART (Montachusett Regional Transit Authority) services for disabled persons. Ms. Speidel will look into this matter further and Ms. Bertram will discuss this at the next MPO meeting with the MART representative. Ms. Bertram mentioned that she could not find the Warrant on the Town website and would like all information concerning the Warrant posted for citizens to see. She would also like to see board members names corrected on the Selectmen's page and would like the link to the "2010" Selectmen's minutes removed from this page. Board members discussed forming a committee to monitor the website for needed changes. Ms. Speidel mentioned that one of the items in the FY15 budget is to restore hours to the IT department that had been cut over the years which has made it difficult to keep up with IT items such as the website. Mr. Ebersole requested that the status of the gas station on Mass Ave be kept as an agenda item. 10. Committee Report: Board of Health; Building Reuse Committee; Capital Planning Committee; Finance Committee; Library Board of Trustees; MPO; Planning Board; PACC; School Advisory Committee on Acceptance & Diversity; School Committee; School Building Committee; Sewer Commission; MA Broadband: Board of Health - No Report Building Reuse Committee - Mr. Toale reported that they have not met but asked for people with appropriate experience, who are interested in joining this committee to come forward Capital Planning Committee- Mr. Toale reported that this committee will be reporting at the Finance Committee meeting this Thursday. ===PAGE 4=== Finance Committee - Mr. Toale reported that this committee will be meeting every Thursday evening to continue review of various Town budget items. Library Board of Trustees- Mr. Ebersole reported that this committee is in the process of evaluating the Library Director and they are using a "360 Degree" review process. MPO- No Report Planning Board- Ms. Bertram reported that this board discussed the following: Marijuana Bylaw along with components relating to it • PDF Media Distribution Storm water management costs • Scheduling of a meeting between the BOS and this committee before their next public hearing • Acceptance of public road at White Tail Crossing PACC- No Report School Advisory Committee on Acceptance & Diversity- Mr. Ebersole reported that this committee is meeting twice monthly until May and have discussed additional training costs. They also have been working on a summary which reads "To encourage and elicit socially responsible behavior that reflects acceptance of all people." School Committee- Mr. Matthews reported that this committee met last week and discussed budget line transfers. Their televised Budget Hearing is scheduled for 4/2/2014. School Building Committee- Mr. Matthews reported the following: Building bid packages will be going out in September • Construction on upgrading the field in front of the Passios building will begin in July Construction behind the school to begin after field is complete Sewer Commission - Mr. Ebersole reported that this commission is meeting this evening and they are discussing: • Infiltration & Inflow reduction Looking at the Whalom area which has some of the oldest pipes Place holders in the Warrant for Sunset and possibly Rennie St. MA Broadband- Mr. Alonzo reported that he along with the IT Director participated in a conference call with MA Broadband concerning the high cost of connection. He asked them to review the numbers and to also provide the wholesale prices which are being offered 11.Town Manager Reports or Department Reports: Ms. Speidel reported that in regards to "snow & ice" the DPW has suspended the free sand & salt program, which was available to the public, because the supply has run very low. Appropriation for the current fiscal year is $250,500, to date we have expended $340,687, and we have another $120,712 of expenses which have not yet been incurred. This is of concern and Ms. Speidel does not believe that there will be money left in the current appropriation to pay for the overage. There is certified free cash that is available in FY15 and she would like to put a place holder on the warrant for a FY14 budget adjustment. Mr. Toale asked if this would affect the Sand for Seniors program which is a collaborative effort between the Council on Aging and Fire Department. Ms. Speidel replied that we will try to cover hardship cases but the suspension is meant to cover all of the materials we give out free of charge. Board members discussed establishing guidelines for public sand pick up but would like to continue the program for senior citizens. APPOINTMENTS/RE-APPOINTMENTS/RESIGNATIONS: None PUBLIC COMMENT: Mr. Ebersole would like copies of Talent Bank forms in the BOS packets for review. Ms. Speidel said that they will be provided prior to upcoming interviews. Mr. Ebersole mentioned that he had received an email from a Town citizen who was having difficulty contacting the Park Department to reserve field time for soccer games for the upcoming season. After looking into this it was discovered the Park Department has not been meeting on a regular basis and although this department comes under the DPW, there is a problem with finding out who is responsible for which property. He would like clarification on who is in charge of the Track & Field and which department (DPW, Park Dept. or Schools) will be taking care of the fields in the future. He is concerned that the citizens are not being served with the taxes that Ms. Speidel stated that she believes that the Park Dept. intended for the track and field to be turned over to the Town, she does not believe that it was, and will investigate this further. She added that the Parks Dept. schedules the fields and the DPW maintains them. Mr. Alonzo added that this has been an issue for a while now and that we need to resolve this. Ms. Bertram spoke to say that she would like to know more about how the fees are collected and what the fees are used for. Mr. Ebersole also said that if the Parks Dept. has been meeting with out and agenda or minutes then they would be violating the Open Meeting Law. The BOS will schedule a work shop meeting with the Park Dept., School Dept, & DPW to discuss these concerns. Mr. Daniels spoke again his concerns about the Open Meeting Law complaint regarding PACC. He said that the complaint had gone to the board in question and has not gone anywhere since. He asked Mr. Matthews to comment on his previous statement that the PACC does not exist anymore. ===PAGE 5=== Mr. Matthews replied that the BOS had a public meeting and at that meeting it was established that the PACC did not have a quorum and without one they cannot operate legally, so they would cease to function, and their duties would fall back to the BOS. The goal of this board is to "reboot" the PACC. Mr. Alonzo added that the BOS did not "dis-appoint" anybody, 2 people have resigned and one person's resignation is in question. Ms. Speidel spoke to clarify that the person in question, of whether or not she has resigned, has not made a decision on that yet, and she has the right to decide on whether she resigns or not. She also did not refuse to be sworn into office. Mr. Daniels responded that he disagrees with that and he has it in writing. Mr. Alonzo added that the current state of this situation is that whatever members are remaining, there is not a quorum, this board has decided that we would not appoint anybody until such time that the proposed amendment to the PACC Bylaw has been approved by Mr. Daniels stated that the violations have to stop, that's the goal. Ms. Bertram spoke to say that if the question is whether or not the violations would continue she would have to say no. Errors did occur but this was a group of individuals who were trying to do the best they could but they made mistakes. She went on to say that she does not believe that this will continue once the BOS have addressed these issues. The goal is to have these issues corrected. Ms. Speidel spoke to inform the board that the applicant had applied for Wine & Malt Beverage with Cordials/Liqueurs Permit but after investigation Ms. Speidel has determined that it is a Local Acceptance for the Town to offer Wine, Malt & Cordials, and the Town has not accepted that provision. This application has been changed to a Wine & Malt Beverage License and if the Town is interested in pursuing Wine, Malt & Cordials it must go to Town Meeting vote. The board can submit a warrant article or the applicant can submit a petition for that particular license. Tarrum Williams, owner of Kabob-E-Licous spoke to the board to say that she understands the change in her license application and she will be pursuing the Wine, Malt, & Cordial License as soon as the Town corrects that Bylaw. He gave a brief history of himself and his family and although he has no experience in PACC or television he is willing to learn and would like to volunteer for this committee. Maureen Dupuis, 173 Highland St., came before the BOS to ask for appointment to the Agricultural Committee. Deborah Lincoln, 46 Hemlock Dr., came before the BOS and expressed her interest to being appointed to the Council on Aging (COA). She gave a brief history of her background and stated her reasons for her interest in this board. Ms. Lincoln also made a suggestion to the BOS regarding potential volunteers who do not come forward due to the fact that they are not good at public speaking or do not ===PAGE 2=== want to be on "live" television. Her thoughts were that perhaps once per year all boards and committees could hold an informal Meet & Greet" with potential volunteers so as they would not be so intimidated to step forward. Mr. Ebersole moved to appoint Debby Lincoln to the Council on Aging. Ms. Bertram seconded. On vote, motion carried, 5 in favor, O opposed. Ms. Bertram commented to say that she liked the idea of a "Meet & Greet" with the volunteers. Pete Lincoln, 46 Hemlock Dr., came before the board and stated that he was here to reapply for a slot on the COA. He explained that he has served on the board before and due to term limits will not be eligible to be appointed again until July1, 2014 and explained that the typical procedure with appointments to the COA is that the COA board searches out the candidates and then recommends them to the BOS for appointment. Discussion ensued concerning the following: • The COA Bylaw which states that they make recommendations to the BOS for appointments • The possibility that the BOS technically may not be correct with the prior appointment Possible rescinding of this evenings appointment to the COA • The rational behind term limits and if they are a good option Mr. Alonzo said that this appointment will be tabled for the time being. The BOS will review further the COA Bylaws regarding appointments & term limits. Rene' M. Lafayette, 48 Williams Dr., came before the board seeking appointment to a Town Committee. Mr. Lafayette has shown interest in serving on the following committees; Personnel Committee, Montachusett Joint Transportation Commission, & Fence Viewer. Mr. Lafayette gave an overview of his work/committee history and stated that if residents can see their way to help out, it's a great thing. Discussion ensued concerning the following: • Re-evaluating the Personnel Committee and the need for it The possibility of Mr. Lafayette serving on the Montachusett Joint Transportation Commission A Steering Committee being formed to look at transportation in the region with Lunenburg participating in it . Having Mr. Lafayette serve on more than 1 committee The BOS will reconnect with Mr. Lafayette after further review of committee openings. Steve Walker, 227 Pleasant St., came before the board seeking appointment to the PACC. Mr. Walker reviewed his extensive work/technology experience involving videography & telephone systems which would be a great asset to the PACC. The BOS were in agreement that Mr. Walkers experience would be welcomed on the PACC and thanked him for coming forward this evening. Mr. Alonzo thanked all for coming forward this evening and told those who were not appointed this evening that they will be notified before they are appointed to a committee. CURRENT BUSINESS 1. Review & Approve Purchase & Sale Agreement; Lane Property (Taken out of order before the 7:15 Public Hearing): Brandon Kibbe representing the Open Space Acquisition Advisory Committee came before the board and informed them that they are not yet in possession of a completed Purchase & Sale agreement and are negotiating the creation of a physical water line which crosses the property that the Town will be acquiring. This is the last item to be negotiated in the Purchase & Sale contract. He mentioned that Town Counsel had suggested that the BOS could vote to approve as presented this evening, then after Town Counsel has approved the final form the BOS could approve or they could wait until the Purchase & Sale agreement is completed. After due and diligent discussion among the board concerning the Purchase & Sale agreement and appraisal process it was decided to table the approval of the purchase & sale agreement until the April 1, 2014 BOS meeting to allow the contract to be completed. The BOS is in support of this agreement and if for any reason the contract needs to be approved before that meeting, then the BOS will entertain posting a meeting for the purpose of approval. valks on this property on April 19 & April 26" 2. MA Broadband- No Report 6.Town Manager Reports or Department Reports: Ms. Speidel reported that she had received a response from Town Counsel regarding a Peer Review concerning the Middle/High School Building project. Town Counsel advised that under the Dover Amendment of the Zoning Act, public and non-profit educational and religious uses are exempt from local use regulation. They are permitted anywhere in the community and are subject only to reasonable dimensional regulations. The project would not be subject to aný kind of special permit review but could be subject to a limited site plan review under the Zoning Bylaw. According to staff in the Land Use Departments the review which was conducted on the Primary School project was done "Pro bono" by David Ross & Assoc., which included: Drainage • Easement Plan Environmental Impact Statement Project Specs & Site Plan David Ross & Assoc. also did approximately 10 other reviews on this project between 5/2002 and 8/2005. After due and diligent discussion, board members decided that a full site plan review of the project was not necessary but that it would be helpful to have other Land Use Boards, particularly the Planning Board, review the project. Ms. Speidel commented to say that she thought it important for the boards and committees to decide whether or not a review is needed regardless of whether or not the work is going to be done "Pro bono". Ms. Bilotta Simeone, Chairperson of the Planning Board spoke to say that the Planning Board had discussed this and decided that they would do a modified site plan review, they support the school and will work whole heartedly to get this project done. Ms. Bertram requested that the Planning Board decide how they would like to proceed with this whether it be at the local level or hire a Peer Reviewer. Ms. Bilotta Simeone said that she envisions a modified site plan review with a Peer Engineer. APPOINTMENTS/RE-APPOINTMENTS/RESIGNATIONS: None PUBLIC COMMENT: Mr. Ebersole requested an update on the Bylaws codification from the Town Manager and also questioned what the status was with the Traffic Rules and Regulations. Ms. Speidel replied that the DPW Director had circulated a draft of the Traffic Rules and Regulations to the Police Department for review. She would like to schedule a workshop in April with DPW, Police and the Engineer on that subject. Ms. Bertram added that MRPC announced a program which looks specifically at signage in relationship to curbs. There is a chance here for professional expertise as well as some grant writing opportunities and she has forwarded this information to the DPW Director. regarding their Warrant Articles for Annual Town Meeting due to the fact the CMR is 53 pages long Ms. Bertram suggested having another workshop with the Planning Board and with the DPW Director regarding Storm Water Improvements associated with developments. ===PAGE 4=== ADJOURNMENT: UPCOMING MEETING SCHEDULE April 1, 2014 April 8, 2014 April 15, 2014 April 22, 2014 Respectfully Submitted, Susan Doherty, Recording Secretary Board of Selectmen ======================================================================================== DOCUMENT : 2014-04-01-agenda-4880.txt BOARD : select-board DATE : 2014-04-01 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/select-board/2014-04-01-agenda-4880.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_04012014-4880 ======================================================================================== ===PAGE 1=== BOARD OF SELECTMEN April 1, 2014 7:00 PM – Town Hall Bilotta Meeting Room, Second Floor Revised AGENDA In accordance with the requirements of the Open Meetings Law, please be advised that this meeting is being recorded and broadcast over Lunenburg Public Access. 7:00 PM PUBLIC COMMENT ANNOUNCEMENTS APPOINTMENTS 7:00 PM – Pedlar’s License for Stephen Gravelle d/b /a Vivant Solar CURRENT BUSINESS 1. Review/Discussion FY2015 Town Manager's Recommended Budget: Ms. Speidel reviewed her recommended budget with the board which included the following: FY2015 Projected Revenues • Projected Revenues • FY2015 Projected Expenses FY2015 Proposed Budget Ms. Speidel noted that there is a one time charge in the Monty Tech Assessment of $49,244 which might be able to be covered in FY2014 with a free cash supplemental appropriation, if the board so chooses. Above Target Requests: 1. Purchase of Lane property, est. of local share is $230k 10 - year acquisition cost (per year) $ 27,025.00 5 - year acquisition cost (per year) $ 50,625.00 2. Pavement Management Plan $800,000.00 3. Lunenburg Public Schools $450,250.00 4. Police Department, 3 Officers $210,000.00 Employee benefits $ 41,839.00 5. Fire Department, 24/7 coverage w/ per diem $210,000.00 6. Land Use Director increase in salary** (reduce Legal Services) $ 12,500.00 7. Street Sweeper $180,000.00 Ms. Speidel stated that she was successful in putting this budget together because there was a 0% increase in health insurance, followed by a less than 1% increase last year. She would recommend against funding for any new positions in the budget because it is not assured that it can be sustainable at this point in time. Discussion ensued among the board members with reference to: • BOS feel that all requests are valid • The $116,100 is not sustainable and the BOS would like to spend as little of it as possible • BOS Support for purchasing of the Lane Property • BOS Support for paying a competitive salary for a Land Use Director ===PAGE 3=== Possibility of using monies obtained from fines/fees through the Police Dept. budget to fund positions • Placing the $116, 100 into the Reserve Fund and revisiting requests at the Fall Special Town Meeting • BOS will wait for Finance Committee recommendations before making final decision Ms. Speidel reviewed the projected debt service for the school building project. This is not yet included in this budget. She distributed two documents to the board, one entitled Maintain Bank Qualifications State House Notes, the other called Maintain Bank Qualifications. Bank Qualification means any year that the Town issues $10m worth of debt or less we are able to maintain bank qualification. By maintaining bank qualification we are issuing tax exempt notes. Once we go over $10m we are issuing taxable notes. One way that we keep our costs as low as possible is to split the borrowing into $10m or less chunks. We are able to do this in this project based on the cash flow analysis in each year except for FY2016. State House Notes is a mechanism through the Dept. of Revenue to issue debt. If we are at $3m or less we can be competitive in the State House Note program or we can go through the traditional financing method. The difference is that if we go through the State House Notes program our expenses are a little bit less. Ideally we will be using State House Notes to keep costs as low as possible but this decision will be made by the BOS at a later date. Maintain Bank Qualifications State House Notes Estimated Tax Impacts: FY2015 $36.43 FY2016 $146.83 FY2017 $457.92 FY2018 $487.79 Maintain Bank Qualifications Estimated Tax Impacts: FY2015 $42.92 FY2016 $218.05 FY2017 $458.69 FY2018 $477.50 5. Ms. Seidel went on to review the changes that were made by the FinCom to theFY2015 Recommended Budget as follows: There is approximately $116,097 available to fund Above Target Requests FinCom recommended approval for purchase of the Lane Property FinCom recommended approval of allocating $113,597 to the Pavement Management Plan rather than the Reserve Fund FinCom moved $12,500 from Legal Expenses to the Land Use Director's Salary FinCom did not vote on the Monty Tech Assessment of $49,244 (Would become available if paid in FY2014) Ms. Speidel recommends that if it becomes available that it stays with Education Mr. Alonzo explained the reasoning behind the FinCom's decision to place the funds in the Pavement Management Plan rather than the Reserve Fund. They felt that the Pavement Management Plan was under funded and that placing the money into the Reserve Fund would limit the Town along with the Town Manager's ability to move things around if shortfalls should come without having to go to Town Meeting. Mr. Alonzo also clarified that the $116,097 is not "surplus" but rather "unallocated" money. Mr. Ebersole moved to recommend approval of Article 18 the FY2015 Town Manager's Budget for the amount of $29,079,384. Mr. Matthews seconded. On vote, motion carried, 4 in favor, 0 opposed. 3. Review/Discussion/Recommendations of Warrant Articles for Annual Town Meeting: Ms. Speidel reviewed the remaining Warrant Articles for Annual Town Meeting with the BOS. Article 14. To see if the Town will vote to raise and appropriate or transfer from available funds a sum of money for the FY2015 Capital Plan, as appearing in the Capital Planning Committee Report, or take any action relative there to. FinCom recommends approval of $1,114,152. 6-0. Mr. Ebersole moved to recommend BOS approval of Article 14. Mr. Toale seconded. On vote, motion carried, 4 in favor, 0 opposed Article 16. To see if the Town will vote to authorize in accordance with MGL Chapter 44, Section 53E, a Student Transportation Offset Receipt Fund, to receive funds for Student Transportation Fees up to $31,000, said funds to be used by the School Department to offset the cost of bus transportation; or take any other action relative thereto. FinCom recommends approval, 6-0. Discussion: Karen Brochu, Town Accountant explained how the Offset Receipt Fund works as follows: Estimated amount cannot exceed prior year actual amount without written approval from DOR (Dept. of Revenue) 2. Receipts are accounted for in a special revenue fund and can be spent without further appropriation 3. Any deficit must be provided for in the current year or raised on the next year's recap 4. Any surplus closes to the general fund at year end Student Transportation Fees: • FY14 $31,604.75 Actual to date Mr. Alonzo questioned what would be achieved by establishing this fund. Ms. Brochu responded that it is a way to separate the revenue that is generated from the students for those transportation fees so it can be used to offset the cost of that contract. Ms. Speidel added that this is typically how bus fees are handled in other communities as an "Offset Account". If we did not do this, we could increase the school's appropriation by $31,000. The $31,000 has been moved into Available Funds. Mr. Ebersole moved to recommend BOS approval of Article 16. Mr. Matthews seconded. On vote, motion carried, 3 in favor, 0 opposed, 1 Abstain (Alonzo) ===PAGE 3=== Article 23. To see if the Town will vote to appropriate the sum of $25,000 from the Sale of Cemetery Lots account to be used for the care, improvement and embellishment of the Cemeteries; or to take any action relative thereto. FinCom recommends approval 6-0. Discussion: Ms. Spiedel explained that the funds would be used for: Tree trimming/planting • Grading & shaping of new roadway to new area at the North Cemetery • Purchasing loam & seed for filling in the new section where grass did not take • Clearing, filling, & loaming on the back side of the South Cemetery • Pricing/Rebuilding of new receiving tomb for storage of winter caskets • Purchase of an entombment wall for cremated remains • Crack filling/sealing of some roads within the cemeteries Mr. Matthews moved to recommend BOS approval of Article 23. Mr. Ebersole seconded. On vote, motion carried, 4 in favor, 0 Mr. Ebersole moved that the BOS sign the Warrant with the changes that were made this evening. Mr. Matthews seconded. Discussion: Mr. Toale mentioned that he had recused himself from voting/discussion on Article 26 and the vote should be changed to reflect that in the Warrant. On vote, motion carried, 4 in favor, 0 opposed. 4. Mr. Ebersole mentioned that Open Meeting Law training sessions have now become "web based" which makes it easier for people and he would like to keep this issue on the table to make this training available for other elected boards an appointed officials. He believes that this is a complicated law and what he is hearing is that there is a misunderstanding of this rather than a misapplication of it. Although there has been headway made with boards/committee updating their minutes we have a long way to go with some boards and 5. Town Manager Reports or Department Reports: Ms. Speidel reported that MassDot has requested a Utilities Meeting on the Summer St. project, we are approaching the end of our contract with VHB (the engineer) and we are awaiting the release of the rest of the design money. We are going to authorize VHB to attend the Utilities Meeting to keep the project moving which will cost the Town approximately $2000. The engineer has advised that the Town go ahead with the Public Meeting on the 25% design. The bigger problem is with State funding. The State funding for the remainder of the design is tied up in the Transportation Bond Bill which the Governor has not spent down. He has put together a Capital Project Plan for FY2015 that does not include the Summer St. project. If we are not on the plan in July Ms. Speidel would like to put it on our own Capital Planning process for FY2016 to keep the project moving or perhaps consider putting something forward at Fall Town Meeting. Our entire Legislature Delegation has been lobbying the Governor to release this funding. ===PAGE 4=== involved sole is project that the Lunenburg Sewer Commission and perhaps the Lunenburg Water Dept, and Water District become APPOINTMENTS/RE-APPOINTMENTS/RESIGNATIONS: None PUBLIC COMMENT: Mr. Ebersole reminded all that the Planning Board will be holding a continuation of their hearing regarding Marijuana Dispensary next Monday evening Mr. Alonzo reminded all that the Zoning Board of Appeals will be have a Public Hearing tomorrow evening regarding the Whalom 40B project. Mr. Toale seconded. On vote, motion carried, 4 in favor, 0 opposed. 7:15 PM - Request to Transfer Liquor License from RNDC, Inc. to KJ Waterfront, Inc., 84 Lakefront Avenue: Mr. Alonzo read into record the Notice of Public Hearing for the Request to Transfer the Liquor License from RNDC, Inc. to KJ Waterfront, Inc., 84 Lakefront Avenue and opened the hearing at 7:15PM. Kenneth Ricker came before the board to request the liquor license transfer. Mr. Ricker gave his business ownership history and what his plans were for the new restaurant, Embers Pizzeria. He indicated that this was not going to be a "Sports Bar" but rather a "Family Friendly" establishment. Ms. Bertram voiced her concerns with the proposed outside seating area and how the alcoholic beverages would be transported from inside of the building to this spot. She would prefer that the alcohol be served from within the restaurant and not leave the establishment to get to this gated area. She would like to see outdoor seating but feels that guidelines need to be established concerning the alcohol serving issue. If the Alcoholic Beverages Control Commission (ABCC), does not have a problem with this, then neither would she. Mr. Ricker said that the server's access to this area would be an approximate 2' walk from the front door to a concrete gated patio. The way this building is laid out makes it impossible to serve from within the establishment to this area. He is able to serve this way at another one of his establishments in Leominster, the ABCC has inspected that establishment and have no problems with it. He stated that If this will cause a problem with the transfer of this license, he will not serve alcohol on the patio and revisit that issue later. Discussion ensued among the board concerning the following: If there is a change in the premises where alcohol is being served, then the BOS must review that Good restaurant policy should be that the servers, not patrons, should be the only ones carrying alcohol out of the building to the patio Public Comment: John Baker, 53 Chase Rd., spoke in support of this request and complimented Mr. Ricker on his other establishments. Ms. Bertram moved to approve the request to transfer the Liquor License from RNDC, Inc. to KJ Waterfront, Inc., located at 84 Lakefront Avenue. Mr. Toale seconded. Discussion: Mr. Ebersole commented that Mr. Ricker also needs to go through this process with the ABCC along with the Town's Building Inspector/Zoning Enforcement in order to make sure that things are done properly. On vote, motion carried, 4 in favor, 0 opposed. 7:30 PM - Public Hearing, Petition of Fitchburg Gas & Electric (Unitil), Pole Location, Chase Road/ West Townsend Road: Mr Alonzo read into record the Notice of Public Hearing for the Petition from Fitchburg Gas & Electric (Unitil), Pole Location, Chase Road/West Townsend Rd. at 7:30PM. Jim Dee, Representing Unitil came before the board to for permission to install 6 sole owned poles approximately 1730' North of the intersection of West Townsend Road in order to get to the entrance to the solar field road located at 651 Chase Road. He explained that the "crisscrossing" placement of the poles is to keep them off of the Central Mass Garden property for aesthetic reasons and that further down, the road curves, and they would need to be "guy wire" installed for stability. Ms. Bertram questioned where the placement of the last pole would be and if there were others where would they be located. ===PAGE 2=== Mr. Dee replied that the last pole would be across from the entrance of the property and that there would be 3 more at that property. Ms. Bertram stated that the permit issued for both the Chase Rd. property & the Pleasant St. property specifically states that there will be no poles on the solar field properties and this will need to be re-addressed by the Planning Board She mentioned that at the Pleasant St. property there is 1 pole that is in the center of the solar farm which is in direct violation of the permit. The Planning Board will be sending a letter stating that there can be no more work done on the poles because of this violation and she would like the BOS to be aware of that fact, because the poles in question this evening, will be connected to additional poles. Mir. Ebersole questioned the "zigzagging" of pole placement and stated that the last pole is the one that he has a problem with. He asked if perhaps the board could recess this hearing until further information from the Planning Board was received regarding the placement of the last pole or perhaps the BOS could approve contingent upon approval from the Planning Board. Ms. Speidel reminded the board that this is presented to the abutters as placement of 6 poles and it would be difficult to only approve 5 of the 6. After due and diligent discussion, the BOS determined to continue this Public Hearing until Fitchburg Gas & Electric (Unitil) submits a revised plan of pole placement along with additional plans of where the underground wire placement will be installed. There was no public comment in regards to this item. Mr. Ebersole moved to continue this Public Hearing until 5/13/2014, at 7:15PM, for further consideration at that time. Ms. Bertram seconded. On vote, motion carried, 4 in favor, 0 opposed CURRENT BUSINESS 1. Review/ Discussion/ Recommendations of Warrant Articles for Annual Town Meeting: Article 9- FY14 Budget Amendments: Ms. Speidel mentioned that she is not ready for the board to vote on this but mentioned that all invoices have been processed relative to the Snow Removal operation and the deficit now is $229,000 and the projected deficit is $8715. • Article 19 - Administrative Reorganization, Land Use Departments: Ms. Speidel reviewed a draft document regarding the Aaministrative Organization Plan with the board. She would like the board to review it, it will remain on the 4/22/2014 BOS agenda and then a Public Hearing for this item will be scheduled for 4/29/2014. She explained that the Land Use Director would fill the role of Planning Director/Town Planner, a new role of Economic Development Director, and also serve as a coordinator of the activities of all Boards and Departments within the Land Use including; Agricultural Commission; Board of Health; Building Inspection (including Electrical & Plumbing); Conservation Commission; Historical Commission; Planning Board; and Zoning Board of Appeals. Ms. Speidel would also like for this individual to serve as the unofficial Town Manager. She explained the benefits of hiring a Land Use Director, the duties or functions of this position, and the qualifications for this position. Also mentioned was that she will be following the Administrative Plan process set forth in Article 5 of the Town Charter but is unsure if this is a requirement. Discussion among the board included the following: • The necessity of developing a Bylaw for the Administrative Plan • Including the Sewer Commission to the list of Land Use Departments • Coordinating with the DPW specifically in regards to Storm Water Management 2. Minutes/Warrants/Action File Issues Minutes: 4/8/2014 Warrants: 4/15/2014 W#54-16 $362,370.60 Action File Issues: Mr. Ebersole requested that the Gravel Removal Bylaw remain on the existing list of outstanding issues to be discussed. Ms. Bertram requested that an update be given concerning the Lake Shirley Dam Inspections. Ms. Speidel replied that this item will be on the 4/29/2104 BOS agenda. Mr. Alonzo reminded board members to complete their Town Manager evaluation forms and to schedule an appointment to discuss them with the Town Manager. He would like to have this completed sometime after Annual Town Meeting and before the Town Election. 5. MPO- Ms. Bertram asked Ms. Speidel if she knew the status of MassDOT's decision on Chase Rd. Ms. Speidel replied that she has a reply via email from MassDOT and will forward it to Ms. Bertram. Ms. Bertram reported the following: • Design money for the Summer St. project has not been released by the Governor • Ifthe design money is not released the cost to Lunenburg will be approximately $333,000 • This is an aggressive timeline & pushing it back a year to deal with engineering will make it questionable on whether or not we will be able to accomplish this project ===PAGE 3=== MassDOT along with our State Representatives & Senator are not optimistic that these funds will be released • Ms. Bertram would like the BOS to be aware that if we are not able to find this money going into this budget cycle it would be a real travesty if we cannot finish this project because we could not finish the engineering. Mr. Alonzo requested that the BOS send a letter to the State Delegation concerning this issue. Planning Board- Ms. Bertram reported that this board discussed the following at their meeting last night: • They closed the Public Hearing regarding the Warrant Article concerning the Marijuana Dispensary Bylaw, which they voted to accept • Whitman & Bingham is willing to do the Site Plan review for the new Middle/High School "pro bono" • Fast tracking elements of the Village District Bylaw and doing an Overlay District to expedite the sale of some of the properties being looked at by the Building Reuse Committee • Highfield Village received an extension of 90 days but the project is still moving forward and there is a plan approved by the Sewer Commission • A & R Plan for 115 Fairview Road. They are 7' short of the frontage for that lot and are looking to extend Fairview to cover this and it was mentioned that they are working with the Town Manager and the DPW Director on this issue. Ms. Speidel commented to say that the applicant had met with her 2 months ago and she referred him back to the DPW Director and Zoning. She recalls that there is a legal unimproved section of that road and if the applicant improved it to Town standards he would have his frontage requirements. Planning Board gave direction to not continue working on the poles at the Pleasant St. solar field Mr. Ebersole questioned if the BOS had approved a pole on Pleasant St. One of the residents stated that a pole was installed on the street and they may have done this without BOS approval. Ms. Speidel replied that the applicant had spoken to her and mentioned that 3 poles were installed on private property. She will follow up on this issue. • White Tail Crossing has had a Peer Review and there are things that need to be done in order to meet the standards There is approximately $5k left of the DLT grant and it was suggested to work on the housing element of the Master Plan • The Elmwood Rd project was extended. Ms. Bertram is concerned with hours of operation & dust mitigation and requested to the Planning Board that they look to the BOS and Building Inspector for input. Ms. Bertram would like to see the Town Bylaw changed which states that if it is an approved subdivision plan, an Earth Removal permit is exempt. She would also like the Planning Board to put stipulations into the permit regarding hours of operation and dust control measures. • Ms. Bertram mentioned that as a citizen, not as a representative of the BOS, she voiced concerns that none of the Master Plan elements take into consideration the explosion of growth that occurred after the implementation of sewers & this needs to be looked at. Mr. Toale moved that Dave Matthews be appointed by the BOS to serve on the Building Reuse Committee as a Community at Large Member. Ms. Bertram seconded. Discussion: Mr. Ebersole requested that it be noted that he had made a point of getting Mr. Matthews on a committee as soon as his term on the BOS was over.
