Documentation: Clerical change to the proposed language to be put forward by Mr. Ebersole • 4.16.5.1.a Criteria 2): This will be enforced by making findings using all four points included in the criteria • 4.16.6.2. Setbacks and Buffer Strips (residential): This will be enforced by having a 200' buffer strip consisting of either screening, fencing, or plantings with abutters input • 4.16.6.4 Waivers: This would only pertain to an applicant who did not have the 200' buffer strip in a residential area and would require input from abutters The BOS complimented the Planning Board on their efforts in developing this Bylaw. Ms. Bertram moved for the BOS to recommend approval of Warrant Article 27, Registered Marijuana Dispensaries, at Annual Town Meeting. Mr. Matthews seconded. On vote, motion carried, 5 in favor, 0 opposed. Article 28 - Right to Farm Bylaw: Doug MacMillan & Jeffrey Mendoza representing the Agricultural Commission came before the BOS seeking approval of Warrant Article 28 and discussed the following changes, approved by the Agricultural Commission, to be brought forth on Town Meeting floor: Section 3. Right-to-Farm Declaration - Strike the word "of" and replace with "on" in the second sentence Strike the words "exclusively" and "commercial" in the 4* sentence • Section 4. Disclosure Notification - Strike the word "duct" and replace with "dust" in the last sentence Addition of the words "and practices" after the word "uses" in the first sentence Mr. Mendoza pointed out the importance of having an Agricultural Commission, the significance of the farmland pictured on the Town Flag and Town Seal, and asked for the BOS support of this Bylaw and Commission. Discussion: BOS recommended the following regarding changes to the Right to Farm Bylaw: ===PAGE 2=== • Agricultural Commission should discuss changes with the Moderator before Annual Town Meeting • Section 5. Resolution of Disputes - Using the word shall" rather than "may" in the last sentence if the intent is to make this • Section 2. Definitions - BOS requested clarification be received back, before the Annual Town Meeting, on the verbiage "lot" vs. "parcel" along with the further research of other community's size requirements for farming on smaller portions of land, in order to properly address any future disputes Mr. Ebersole moved for the BOS to recommend approval at Annual Town Meeting, on Warrant Article 28, Right to Farm Bylaw as revised. Ms. Bertram seconded. On vote, motion carried, 5 in favor, 0 opposed. BOS thanked the Agricultural Commission on their efforts in developing this Bylaw. Article 9 - FY14 Budget Amendments: Ms. Speidel provided the BOS with an updated spreadsheet, which reflects the FY2014 budget mends and supplemental appropriation that will be requested at Annual Town Meeting. Included in her review was the • The deficit has been balanced • FY2014 Monty Tech Supplemental Assessment will be paid & the funds which were earmarked in the FY2015 budget will now be made available to the Lunenburg Public Schools • Transfers will be made from Interest/Temporary Loans; Liability Insurance; Workers Compensation; Health Insurance; Life Insurance; Historical Commission; Reserve Fund; Salary Reserve (after transfers); Unemployment Expense; & Recycling Line to cover projected deficits in Legal Expense; Police Lock up; Injury Leave; Fire Dept.; Snow Removal; & Veteran's Benefits They will be seeking a supplemental appropriation of Free Cash in the amount of $154,563 • Transferring of unexpended appropriations from two articles relating to school planning expenses in the amount of $1500& $2439 Balance of Free Cash remaining is $5230 Ms. Speidel also mentioned that action will be needed by the BOS regarding Article 8. Payment of Prior Year Bills, concerning a Police OD In Duty medical bill of $570 which was received last week. This will be placed on the 4/29/2014 agenda. Mr. Matthews moved for the BOS to recommend approval at Annual Town Meeting, on Warrant Article 9, FY14 Budget Amendments. Ms. Bertram seconded. Noted was that this motion is for Article 9 and not Article 8 • Department Heads, Employees, and Town Manager were all thanked for making the FY14 budget successful despite all the extra expenses incurred throughout the year On vote, motion carried, 5 in favor, 0 opposed. Mr. Alonzo mentioned that the reason why there are not many "no" votes on the board is that they work hard behind the scenes with 1"! drafts, workshops, etc...where their discussion points have all been heard by the possible opposing parties, which has kept us well informed, and has enabled us to work together in order to come to agreements on different items. Article 19 - Administrative Reorganization, Land Use Departments: Ms. Speidel commented to say that after further review she does not believe that this Article requires an Administrative change under the Town Charter, which does not mean that it cannot be presented here or at Annual Town Meeting for full disclosure. She has submitted this to Town Counsel for review but has not heard back from them yet. She intends to move forward with the Public Hearing for next week and hopes to have an opinion from Town Counsel by then. This document has been submitted to the Land Use Departments for comment and the Board of Health (BOH) has been the only department to reply. They voiced their support of the expanded concept but are concerned about a potential conflict of interest with having a consolidated department. Ms. Speidel reiterated the fact that the BOH is specifically excluded because State Law gives them a Separation of Duty & Authority under Massachusetts General Law (MGL). The intent is for a coordinated effort and not to supercede the role of any individual staff member or any board or committee that is a part of Land Use. There has been some interest in this position and if this is approved it will be advertised within the Town for approximately 3-4 weeks in the month of May to be followed by interviews conducted in June, with hiring in July. Discussion among the board included the following: • BOS members voicing support for the Land Use Director position and acknowledged the fact that there may not be a need for a Bylaw but transparency through presenting at Public Hearings & Annual Town Meeting is important Adding the Sewer Commission to the list of departments along with coordinating activities with the DPW • Town Manager will present this at Annual Town Meeting and it cannot be amended on the floor • This does not require a changing of agencies, but rather extending the use of Planning Director to become Land Use Director • If it is determined that a vote by the people at Annual Town Meeting should not be required, then we should not ask them to do SO • Intent of this position is not to delegate appointment authority or to delegate disciplinary action • The BOS will review further the last paragraph on page 3 of the draft document of the Administrative Organization Plan for potential change in language A Public Hearing concerning this Article has been set for 4/29/2014. 2. Request to Abate Ambulance Bill: Ms. Speidel presented the board a request for abatement on ambulance bill #WHITB in the amount of $3947.10. The applicant must meet certain income guidelines in order to receive this abatement, the Fire Chief has reviewed this application and has determined that the applicant qualifies. ===PAGE 3=== Ms. Bertram moved to abate the ambulance bills as noted in the documentation amounting to $3947.10. Mr. Matthews seconded. On vote, motion carried, 5 in favor, 0 opposed. 3. Appoint Designee, Declaration of Support/No Support for FY15 Mosquito Control Funding: Ms. Speidel reviewed the process of how the Mosquito Control Board asks communities in their district to support or not support their budget. Lunenburg's assessment portion for FY2015 is $62,374 and is included in the Town Manager's budget recommendation. The BOH is the designated liaison to the Mosquito Control District and have sent this declaration to the BOS for their support for their budget and to designate the Chairperson of the Lunenburg BOH to officially support, on behalf of the Town of Lunenburg, the FY2015 assessment for the mosquito Ms. Bertram moved to support the budget and to appoint the Chairperson of the Lunenburg Board of Health as the designee for the mosquito control funding. Mr. Matthews seconded. On vote, motion carried, 5 in favor, 0 opposed Ms. Bertram mentioned that if residents have areas they would like sprayed they need to contact the Mosquito Control to request services. 4. Review Q3 Financials; Board of Selectmen Goals; Town Manager Goals: Board of Selectmen Goals & Town Manager Goals will be discussed at the 4/29/2014 BOS meeting Ms. Speidel reviewed the Third Quarter Financials prepared by the Town Accountant with the board as follows: • After review of Q3 Financials, Town Manager found nothing she would disagree with Revenues - As of 3/31/2014 76.44% of FY14 estimates have been collected • Local Receipts - 86.79% of the estimated 3 quarter of FY2014 have been collected Taxes & State Aid - 74% of our Tax Levy and 75% of our State Aid estimate has been collected • Expenditures - As of 3/31/2014 73% of budgeted expenditures have been expended • This report will be presented to the FinCom at their next meeting Mr. Matthews suggested that in regards to Local Receipts he would like to see the $99k received from the Zoning Incentive payment for the Tri-Town Development be set aside to be used for improvements in the neighborhood that surrounds the development and/or for the Summer St. project. 5. Minutes/Warrants/Action File Issues Minutes: 4/15/2014 Warrants: 4/22/2014 4/23/2014 W#55-14 W#56-14 $202,830.03 $257,811.69 $621,863.92 Action File Issues: Mr. Alonzo stated that inquiries are being received from various entities regarding the Open Meeting Law and requested that all questions concerning this should be directed to the Town Clerks office. The Town will continue to hold Open Meeting Law Workshops periodically. Ms. Speidel added that she has received questions concerning agendas and minutes and she has referred all inquiries to the Town Clerk. Mr. Ebersole questioned whether or not these questions stem from people not attending the Open Meeting Law Workshops. He commented to say that the BOS minutes & agendas are a good format for other boards & commissions to use. He receives complaints about people who are not in compliance and all of the Attorney General's information regarding Open Meeting Law is easily accessible through the internet and on the Town's website. Minutes do not need to be detailed but rather simple and to the point. 6. Committee Report: Board of Health; Building Reuse Committee; Capital Planning Committee; Finance Committee; Library Board of Trustees; MPO; Planning Board; PACC; School Advisory Committee on Acceptance & Diversity; School Committee; School Building Committee; Sewer Commission; MA Broadband: Board of Health - No Report Building Reuse Committee - No Report Capital Planning Committee-Mr. Toale reported that this committee will attend the FinCom meeting this Thursday to discuss their policy on Capital spending. Mr. Alonzo added that the Library Board of Trustees and Board of Selectmen will appoint someone to serve until the next election at which point the remainder of the seat will be up for a ballot vote. MPO- Ms. Bertram attended the 4/16/2014 MPO meeting where they discussed the following: There were several amendments to the existing TIP due in large part to the Leominster Rt. 13 project and they are reallocating money to many other projects, which can be reviewed on their website • MART has finalized changes and updates to their funding element • Preliminary discussions were held for the 15/18 TIP. It was thought that there would be money available in FY16 but due to proposed intersection improvements on Rt. 12 in Sterling, the cost for these improvements have gone from $1.3m to in excess of $6.1m. Ms. Bertram will follow up with MRPC on clarification regarding this issue. Many projects which were on the TIP are now dropping off in scenarios 1 through 3, which MassDOT has a problem with They went through a "Universe of Projects" which are considered ranked and Chase Rd. is not included because we were too late in sending it to MassDOT. MassDOT has vetted the project however MRC did not have any details nor has it received a project number. We need to take care of this so it can be put into the appendix of the TIP Ms. Bertram stressed the fact that any project we want considered for funding, needs to be submitted to MassDOT sooner rather than later and she explained the simple process to the board. There are 25 roads in Lunenburg that are eligible for Federal funding and we are not taking advantage of that program. She stated that she cannot lobby for something if she does not have the data. ===PAGE 4=== Planning Board-No Report PACC- No Report School Advisory Committee on Acceptance & Diversity- No Report School Committee- No Report School Bullding. Town Manager Reports or Department Reports: Proposed Tennessee Gas Pipeline Project: Ms. Speidel received a letter informing the Town of this project and will schedule a Public Meeting with a representative from Tennessee Gas to discuss the proposed gas pipeline project within in the next 3 months. Tennessee Gas is proposing the following: An upgrade of an existing pipeline within New York, Massachusetts, Connecticut, and New Hampshire which will result in the construction of approximately 250 miles of pipeline They are looking to locate a significant portion within existing utility easements • They are in the process of surveying for the purpose of soil testing and have contacted some individual homeowners • Homeowners have the right to refuse entrance onto their property This project is slated to begin in the year 2018 Ms. Speidel added that the Town of Lunenburg cannot review any agreements or provide legal advice on any document that a homeowner might be asked to sign concerning this project. Mr. Matthews mentioned problems which had occurred with homeowners concerning liens being placed onto their properties by a sub- contractor, the last time this project came through, due to non-payment to the sub-contractor by Tennessee Gas. Ms. Speidel replied that all of those issues have been resolved. The Town in that instance did provide legal assistance to the Town as a whole, specifically coordinating activities with attorneys that individuals had hired themselves, and this was a highly unusual circumstance. A revised FY2015 assessment letter was received from Monty Tech and it is approximately $17,988 less than what is projected in the budget. Ms. Speidel recommends that these funds be re-appropriated to the Lunenburg Public Schools in FY2015 APPOINTMENTS/RE-APPOINTMENTS/RESIGNATIONS 1. Accept Resignations: Jim Lattanzi, Ag Commission and Joe Levine, Building Reuse Committee: Mr. Alonzo announced the resignations of Jim Lattanzi from the Agricultural Commission and Joe Levine from the Building Reuse Committee. Bilotta meeting room at Town Hall as scheduled Chair Paula Bertram, Dave Matthews, Jamie Toale, Robert Ebersole, & Town Manager Kerry, Speidel. Regular Meeting opened at 7:00 PM 7:00PM PUBLIC COMMENT: Mr. Matthews congratulated the Powell family on the expansion of their business and complimented them on the appearance of their new establishment along with the creative reuse of the existing barn which was on the property. Ms. Bertram reminded all of the upcoming "Drop In" session concerning the purchase of the Lane Property to be held at the Library this coming Thursday. ANNOUNCEMENTS: • Annual Town Meeting will be held on 5/3/2014 at Lunenburg High School beginning at 9AM • Representative Benson will be holding office hours at Lunenburg Town Hall on 5/13/2014 from 5:30PM-6:30PM Lunenburg Boys & Girls Club Town Wide Yard sale will be held on 5/17/2014, 8AM-2PM • Lunenburg Waste Days began on 4/26/2014 and will run every Saturday until 5/31/2014 from 8AM-4PM at the Town Landfill APPOINTMENTS: 7:15 PM - Public Hearing, Administrative Organizational Plan, Town Charter, Section 5-1 (b): Mr. Alonzo read into record the Public Hearing notice concerning the Administrative Organizational Plan and opened the hearing at 7:15PM. At this time Ms. Bertram mentioned that the Public Hearing time for White Tail Crossing was incorrectly advertised to be held at 7PM this evening and mentioned to anyone who was in attendance for that hearing that it will be held at 7:30PM. Ms. Speidel informed the board that Town Counsel has informed her that the need to follow the process which is set forth in the Town Charter is somewhat of a "gray" area and feels that the best way to proceed is to follow the requirements of the Town Charter. Regarding the question of developing a Bylaw, Town Counsel had said that you can choose to present the plan at Annual Town Meeting for a vote or develop a Bylaw. The board has chosen to present this plan at Town Meeting Ms. Speidel then reviewed the draft Administrative Organizational Plan with the board touching on the following points: Position will not supercede any roles or responsibilities of the boards or commissions in the Land Use Departments • Position is intended to coordinate activities within the Land Use Departments • Position will not be responsible for appointments, hiring, or firing Position will not have supervisory responsibility over the Board of Health staff Position qualifications, salary, and recruitment process Discussion among the BOS/Town Manager included the following: • Land Use Director may sit on other Town boards/commissions as a liaison and not as a voting member • Only in the absence of the Town Manager would this position serve as the Assistant Town Manager Sewer Commission and the DPW/Storm Water Management have been added to the list of departments which this position will be coordinating with • Anything associated with roadways should also be coordinated with the DPW Director • The wording of the Direct Functional Supervision would need to be clarified in regards to hiring & firing order to establish what the BOS is expecting. Ms. Speidel mentioned that all Land Use Departments were contacted for their input about this position and a member of the Board of Health responded "While | support the concept of expanding the Planning Directors role to include economic development I'm concerned that making it the Land Use Director is too broad and may even present a conflict of interest regarding expediting development vs. safety/protection of resources. I think a liaison role regarding Land Use matters would be more appropriate." Public Discussion: Matthew Allison, Planning Board Member, spoke his dismay of the lack of professional/technical abilities which has existed on the Planning Board. He mentioned that the Planning Board Director sits on various committees as a member and he thanked the Town Manager/BOS for bringing this new position forward. He would like to see the Administration Organization Plan included in Town documents for people to review. He would like this new position to focus on "Planning" and not be considered for Assistant Town Manager. Mr. Ebersole moved to approve Administration Organizational Plan and to recommend BOS approval at Annual Town Meeting. Mr. Matthews seconded. On vote, motion carried, 5 in favor, 0 opposed. Public Hearing was closed at 7:43PM ===PAGE 2=== 7:30 PM - Public Hearing, Layout of Public Way, White Tail Grossing: Hearing was postponed until the Fall Town Meeting by request of the applicant. Items for Review with DPW Director & World Tech Engineering: In attendance for this presentation were Jack Rodriquenz, DPW Director, Rich Benevento, & Mike Pompili of World Tech Engineering. Mr. Rodriquenz spoke and thanked Mr. Matthews for the work that he has done regarding the School Building project and various other tasks which he has taken on while serving on the BOS Update on Lake Shirley Dam, inspection & maintenance (just requested last night): The dam is in compliance with all inspections and the Emergency Management Plan has been completed. A letter of approval was received from the National Dam Safety Program which included recommendations of making some minor edits to the plan for future yearly submissions. The next inspection will be done in December of 2015. • Update on intersection improvements at Mulpus & Townsend Harbor Roads: A hard schedule has been set to begin reconfiguration of this intersection for 5/19/2014. Powell Excavation has been hired for the construction which is expected to last approximately 2 weeks. The DPW will do the paving for economical reasons. • Update on Pavement Management Plan (World Tech's revisions); a preliminary project list for FY14 Spring/ FY1! Summer & Fall, if available: Mr. Rodriquenz reviewed the following in regards to pavement management Road Repair Funding $122,000.00 Uncommitted Chapter 90 Funds $127,000.00 FY15 PMP $116,000.00 FY15 PMP Addition $63,000.00 Winter Rapid Road Recovery Program $422,000.00 Anticipated FY15 Chapter 90 Allocation TBD $850,000.00 Funds from Operational Budget Anticipated Road Repair Expenses FY15 $850,000.00 ($333.000.00) ($150,000.00) ($63,000.00) $304,000.00 Summer Street Engineering Chase Road Engineering Winter Rapid Recovery Program, Various Locations ($150,000.00) ($140,000.00) PMP- White St.- Fitchburg Line to 2A PMP - Goodrich St - Reservoir Rd to Winter Hill Rd ===PAGE 3=== $14,000.00 Cracksealing - Additional Funds from Operational Budget will be allocated here Discussion: Mr. Rodriquenz stressed the fact that a decision needs to be made regarding the Towns funding of the $333k for the Summer St. project. If this is not done, Summer St will need to be closed due to its drastically deteriorated condition. Ms. Bertram questioned if the Tri Town Incentive money could be used to move forward with the engineering on Summer St. Ms. Speidel replied that there are 2 separate stabilization funds with a current balance on both funds equaling our 5% target. We have already appropriated money out of the Incentive funds to pay for the 25% design of Summer St and in FY12 money was appropriated out of the stabilization fund for extraordinary un-employment expenses. If we appropriate money out of the Incentive fund we will fall below the 5%. We did receive $99k in zoning incentive funds for building 3 in Tri Town and based on how the budget seems to be closing out we will have some free cash, hopefully equal to the $99k, but that is still to be determined Ms. Bertram stated that she wasn't aware that this was a combination of both funds and this is unfortunate because this money was specifically intended for improvements in that area. Ms. Speidel replied that funds are being appropriated out of the proper accounts but the 2 draws together were pretty significant. Mr. Alonzo would like to be assured by the State that should the funds be released for this project, whether or not it has been paid for locally, then those tunds should be returned to the Town and we need to proceed with this carefully. Mr. Rodriquenz strongly recommended to the BOS that we move forward with the $333k from Chapter 90 funding if it cannot come from another source. Ms. Bertram spoke to say that meeting the requirements in the timeline for the TIP (Transportation Improvement Plan) is critical, they are already behind, and waiting until the Fall to see if the Governor will release the funds makes for a strong possibility that we will fall off of the TIP. Mr. Rodriquenz spoke of how MassDOT encouraged both he and Ms. Bertram to put in an application for the Chase Rd project which uns from Northfield Rd to the Townsend line. This project is eligible for Federal funding and there is a good chance that this proje buld be funded for $2.2m for numerous improvements if the Town is willing to pay for engineering Ms. Bertram spoke of her concerns that the Chase Rd project is not included in the Universe of Projects Mr. Benevento spoke to say that the Chase Rd project is not considered a huge project at $2.2m and the State looks for projects of this size to fund when other projects "fall off of the vine" for what ever reason. Ms. Bertram spoke to say that the 15/18 TIP is under funded due to a road project on Rt. 12 in Sterling that went from $1.3m to $6.1m which is throwing other projects off of the 15/18 TIP. After reviewing the potential projects, the Chase Rd project was not on there. She was informed that if this was going to be considered as a TIP project MRPC (Montachusett Regional Planning Commission) needs more information including the project number which has been assigned. Mr. Benevento explained that it does have a Projis number (607770) and the reason it is not on the list is because it is so new. Ms. Bertram is concerned that do to time restraints we are going to miss our window for the 15/18 TIP and we need to move quickly and get MRPC involved. Future Pavement Management Roads FY16 $95,000.00 West St - Hollis Rd to Sunny Hill Rd $187,000.00 Leominster Rd - Prospect St to Kilburn St $62,000.00 Reservoir Rd - Flat Hill to 267 Reservoir Rd $363,000.00 Reservoir Rd - Goodrich St to Flat Hill Rd $188,000.00 $35,000.00 Reservoir Rd - 267 Reservoir Rd to Page St Northfield Rd - Oak Ave to Mass Ave $930,000.00 Mr. Benevento & Mr. Pompili presented their Pavement Management Program Project Overview & Summary of Findings to the board with a slide show presentation that included: Benefits of Pavement Management Scope of Services • System Specifications & Design • Roadway Inventory & GIS • Roadway Profile • Field Inspection Program Existing Conditions Summary Lunenburg's PCI (Pavement Condition Index) number is 67 Average Estimated Road Repair Needs = Approx. $12.3m (Amount needed to reach 100 PCI rating) CIP Development These numbers are based on formulas and will differ from the DPW Director's numbers Project Year 2015 totals = $516,559 Project Year 2016 totals = $1,011,367 System Maintenance Discussion: Mr. Alonzo pointed out that just to maintain where we are the cost is approximately $1m and the chart provided in this report shows $5.8m, over 5 years, the PCI (Pavement Condition Index) overall goes up by .7, which indicates "keep your head at the same level above the water every year". The condition of the roads does not get any better nor do they get any worse. Mr. Benevento explained that a pavement improvement plan should be a "blend" of treatments maintaining what you have and "picking off' roads that are in poor condition a little at a time. Mr. Alonzo added that the Pavement Management Plan is funded to the level that people have decided they wish to accept. Ms. Bertram questioned the large discrepancy between the CIP Development Plan numbers and the DPW Director's numbers. ===PAGE 4=== Mr. Rodriquenz explained that estimation of asphalt on these roads is not an exact science. He is working with numbers from a 5 year old plan and as we transition into the same plan, our numbers will become one. We should be transitioned into the new plan by Capital Planning time in the Fall. DPW will also remain cognizant about potential water line construction on White St. before any paving work is done there. • Update on Traffic Ordinance: Board members were given copies of the updated Traffic Ordinance for review. Mr. Pompili explained that they will be adopting the draft Traffic Rules & Orders in their entity rather than amending and that quite a bit of language in the Standard Ordinance has been revised which he touched on briefly discussing traffic lights, "Stop" and "No Parking" signs within the Town which will change. There is a process to follow if someone has requested a regulatory sign which is that the ruling body of the community will have to vote to adopt and then that will become a part of the Ordinance. If there are stop signs in place that are not in the Ordinance, they are unenforceable. Before adopting this Traffic Ordinance the BOS will need to have a Public Hearing. Discussion: Ms. Bertram questioned if yellow "Cautionary" signs would need to be included in the ordinance Mr. Benevento explained that the yellow signs are "Advisory" signs and are un-enforceable. The only entity that can approve a speed limit sign is MassDOT (Mass Dept of Transportation) and included in the updated Ordinance is a MassDOT list of approved speed • Update on Sign Inventory, If additional information is available: Not discussed • Update on Chase Road and/or Summer Street, if additional information is available: Discussed under Update of Pavement Management Plan EXECUTIVE SESSION: None ADJOURNMENT: Being no further business Ms. Bertram moved to adjourn the meeting. Mr. Matthews seconded. Meeting anourned at 945 in favor, opposed. Lane Property at Lunenburg Town Forest": Brandon Kibbe, representative of the Opens Space Committee Land Acquisition Team, came before the board and informed them that at Town Meeting the positive vote was for approval to purchase the Lane Property at $3600 per acre or at appraised value, which ever is less. The appraisal has identified a price of $2400 per acre which now makes the purchase price $400k rather than $600k which was approved at Town Meeting. He requested that the BOS sign an amendment to the Purchase & Sales agreement to reflect that change. This will codify the agreement which had contingencies such as the appraised value and the fact that the seller is not going to sell another 5 acres to the Town. The seller has also requested that the property be named "The William H. and Saundra B. Lane Property at Lunenburg Town Forest." The Open Space Committee Land Acquisition Team were unanimously in favor of this idea due to the fact that this family was willing to work with the Town on this purchase. If the Land Grant is received, it requires that signage be placed on the The family could also place a plaque or monument somewhere within this property with approval from the Open Space Committee price approximately $150k - $176k. Mr. Kibbe also mentioned that a "Point Person/s" would need to be added to the grant application and requested that he along with Ms. speidel be those persons. This will be an agenda item at a future BOS meeting Ms. Bertram moved to approve the revised purchase and sale agreement and the request to name the property "The William H. and Saundra B. Member Committee Assignments: Mr. Alonzo mentioned that a list of the member committee assignments and what their purpose as liaisons from the BOS are, will be given to new BOS member Ms. Luck for review. This task will be completed at the 6/3/2014 BOS meeting. 3. Request to Review/ approve Middlesex County Interagency Mutual Aid Agreement (Police): Chief Marino reviewed the Middlesex County Interagency Mutual Aid Agreement with the board. He explained that Lunenburg currently has Mutual Aid Agreements with most of the Cities & Towns in Worcester County and this would be for the Towns such as Shirley which are in Middlesex County. This agreement gives the Police the authority to travel over the Town line and gives them the same powers and indemnity that they would have if they were exercising their powers of arrest within in the confines of the Town of Lunenburg. We are signed on to the State wide along with the Worcester County agreement and joining with Middlesex County would cover us completely. Basically this would be used for when a major incident has occurred and would apply to all Towns in Middlesex County. The Chiefs of Police Association is encouraging law enforcement agencies to go with Mutual Aid Agreements and Chief Marino believes this would be a good idea in our efforts to become more organized as a Police Department. Currently we appoint Officers from other communities to be able to work with our Police Department if asked to, and if this is signed, that will no longer be needed. Officers will be able to operate within another Town when it's necessary and it will be self-initiated Mr. Alonzo voiced his concern of giving Police authority within our Town to people who we don't know and he can see how this might cause problems in jurisdictions. Chief Marino assured him that this is only for extenuating circumstances and he cannot recall any incident where another agency did not call to say that they were in this community. This is governed by Department Policy with rules and regulations and is generally only used when another jurisdiction is calling you for help After due and diligent discussion between the board and Chief Marino it was agreed to revisit this request again after further review is done with comparing the Worcester County Mutual Aid Agreement with the Middlesex Mutual Aid Agreement. 4. Review/ discuss Town Manager's Annual Performance Evaluation: Mr. Alonzo reviewed the Town Manager's Annual Performance Evaluation and the Narrative Summary Composite with the board which included 5 scoring sections and 3 essay sections as follows: Scoring sections included: Relationship with the Board • Fiscal Management • Community and Public Relations • Personnel Administration • Professional skills & abilities These sections are further broken into 8-10 skill items with points assigned ranking from 1 being unacceptable to 5 which is outstanding. When totaled, the Town Manager scored an extremely strong "COMMENDABLE" ranking (178.6). Essay sections included: What has the Town Manager done well? • What could the Town Manager do better? • What could the Board do to help the Town Manager/What could the Town Manager do to help the Board? Board members congratulated Ms. Speidel and expressed their thoughts on the evaluation process which ranged from: Process was helpful • Another step forward with this board in the full implementation of the Town Charter process along with full implementation of the position of Town Manager Request to read something of interest from the Town Charter at each BOS meeting Making sure that the different roles of the BOS as policy makers vs. the Town Manager as running the Town, continues through dialogue Evaluation process was a good tool but flawed and needs to be revamped Ar. Alonzo added that a letter was presented to him this evening from Town Department Heads requesting their future involvement i he Town Manager's Evaluation. They feel that their day to day interaction with the Town Manager would be a valuable asset with th Town Manager's evaluation process. She would like for the BOS to review them at their 6/10/2014 meeting at 6PM. Mr. Alonzo would like workshops scheduled before regularly scheduled BOS meeting to review the policies that require additional review and asked that any other policies that may have been suggested but are not included on the list be brought forward also. He also thanked Ms. Bertram for the work that she did with this project and asked all members for their help in revisions. 6. Minutes/Warrants/Action File Issues Minutes: 5/6/2014 (Revised) Warrants: 5/20/2014 W#61-14 5/21/2014 W#62-14 5/22/2014 W#24P-14 $303,604.02 $612,899.39 $619,440.07 Reuse Committee so as they may attend also. Mr. Alonzo reminded all that the next step in the Town Manager's Evaluation is for the Town Manager to review this evaluation and provide a self-evaluation to be discussed at the 6/10/2014 BOS meeting. 3. Committee Report: Board of Health; Building Reuse Committee; Capital Planning Committee; Finance Committee; Library Board of Trustees; MPO; Planning Board; PACC; School Advisory Committee on Acceptance & Diversity; School Committee; School Building Committee; Sewer Commission; MA Broadband: Board of Health: Mr. Ebersole reported that this committee met last night. The Agricultural Commission and representatives from the Mass Farm Bureau were in attendance due to a potential complaint but that appointment was cancelled. However they did discuss the new Right to Farm Bylaw which does not create any new rights but does provide a communication device. The BOH still remains an enforcing authority but the Agricultural Commission can be a source of communication between the parties. Also noted was that there is an online handbook for Agricultural Commissions that explains everything about what it means to be a commission and the Open Discussion: Ms. Bertram questioned if there was a liaison to the Agricultural Commission. Mr. Alonzo replied no. Board members discussed the purpose of liaisons to commissions. Liaisons roles are to attend such meetings not to participate, but to observe and to listen. All official acts such as vacancies on boards, should not be reported to the liaison, and should be reported through the Town to the proper entities. Ms. Bertram added that the MPO is a voting seat, which is different from other BOS liaison duties with Town commissions/boards. Capital Planning also falls under that title. Boards and Commissions will be reminded that the proper way to communicate things such as vacant seats is to the BOS and not to liaisons. Building Reuse Committee: Mr. Toale had no report, but stated that the next meeting will be on 6/2/2014 at 630PM. Capital Planning Committee: Mr. Toale reported that this committee is on hiatus. Finance Committee: Mr. Toale reported that they will meet this Thursday at 7PM, not to be televised Library Board of Trustees: No Report MPO: Ms. Bertram reported that at the last MPO meeting the Summer St. project was moved out to FY18 and the Sterling project was placed ahead of it. She was successful in lobbying for the Summer St. project to remain in FY17 stating that the Town is ready to move forward with design tunding and the community is committed to moving this project forward. This project has been released for public ===PAGE 4=== comment and she recommended that the BOS along with support from our Representatives send a letter of support/commitment for this project. Ms. Bertram informed the BOS that she will not be present at the meeting on 6/18/2014 where this will be voted on and requested that a designee be sent in her place to vote in her absence. There was a meeting last Friday with representatives from MPO concerning the Chase Rd. project. This is currently in the appendix of the TIP and there is strong support for this going forward as a "Book Job" HSIP (Highway Safety Improvement Program) money is available for signage and to correct our signage in Town will cost approximately $44k. There is a potential to incorporate this in the TIP if we move that process forward. Ms. Bertram would like to have discussions MassDOT regarding State funding for some of our paving projects in Town. Planning Board: No Report PACC: Mr. Alonzo stated that we are now looking for people to serve on the PACC and we will be appointing 5 members. Anyone interested should fill out a talent bank form and return it to Town Hall. Mr. Ebersole mentioned that the BOS encourage people who are connected to the cable to apply but that it is open to anyone. Mr. Alonzo mentioned that our cable contract with Comcast will expire in "2017" and we should begin discussions with them concerning the contract. School Advisory Committee on Acceptance & Diversity: No Report School Committee: No Report School Building Committee: No Report Sewer Commission: Mr. Ebersole reported that this commission met last week and they are looking at an extension down Highland St from Oak Ave and Main St. They are moving forward as far as implementing the votes at Town Meeting for the borrowing for the Pratt/Lakeview extension areas. They are visiting various homes in Town regarding the infiltration reduction process. They have discovered 1 sump pump and are working with the homeowner to remedy that situation. MA Broadband: No Report 4. Town Manager Reports or Department Reports: Ms. Speidel reported on the following: The Annual EMS Cookout will be tomorrow at 6PM at the Public Safety Building • A Memorial Service will be held at the Public Safety Building on 6/8/2014 at 9AM • Construction at Townsend Harbor/Mulpus has begun, will continue till the end of May and people should seek alternate routes • A request was received from the Girl Scouts of Central/Western Mass to have the BOS sign a letter of recognition/commendation to the Lunenburg Girl Scouts who will be receiving the "Silver Award" which is the highest achievement that they can receive. MS. Bertram mentioned that concerning the MPO, she has been frustrated with the lack of detail included on projects. She requested at he last MPO meeting that moving forward, she would like to have an overview at the beginning of the projects when they ar onsidering their funding. Tomorrow evening at the MJTC meeting they will be doing this with their projects in this years TIP an APPOINTMENTS/ RE-APPOINTMENTS/ RESIGNATIONS 1. Appoint Acting Police Sergeant Sean Connery to position of Police Sergeant 2. Appoint Acting Police Sergeant Jack Hebert to Position of Police Sergeant Police Chief Jim Marino came before the board to request the appointments of Acting Police Sergeants Sean Connery and Jack Hebert to the positions of Police Sergeant. He gave the work history of both officers and commended both on their work ethics. He introduced Sergeant Sean Connery to the board and informed them that Sergeant Jack Hebert could not be present this evening due to a family commitment. Sergeant Connery spoke to the board and thanked the Town for allowing the opportunity for him to serve the community for 24 years. Ms. Speidel informed the board that Chief Marino had recommended these appointments and that under the Town Charter these would be Town Manager appointments which she recommends the BOS ratify. She also mentioned that Chief Marino has made a Departmental Assignment of Officer Thibodeau to Detective. Ms. Bertram moved to ratify the Town Manager and the Police Chief's recommendation for Sean Connery and Jack Hebert to the position of Police Sergeant. Mr. Toale seconded. Discussion: Mr. Alonzo spoke to say that he has the fullest confidence in the Chief and also with his appointments. He went on to say that the two candidate's service to the Town is exemplary and he is in full support of these appointments. On vote, motion carried, 5 in favor, 0 opposed. Bilotta meeting room at Town Hall as scheduled with, Chair Tom Alonzo, Vice Chair Paula Bertram, Jamie Toale, Robert Ebersole, & Phyllis Luck Absent was Town Manager Kerry Speidel. Regular Meeting opened at 7:00 PM 7:00PM PUBLIC COMMENT: Ms. Luck commented on the Memorial Day Services which were held at the Lunenburg Public Schools saying that all of the children did a great job in reminding all of the sacrifices of our service people. She mentioned the fact of the importance of the "right to vote" in this country and thanked all citizens who either came out to vote or ran for office at the recent Town Election. Mr. Alonzo mentioned that many inquiries had been made about not having a Memorial Day Service at Veteran's Memorial Park. He said that he believed a Memorial Day Committee had been formed and was sadden that there was no ceremony this year and said that it was disgraceful that it did not happen. He pledged that this will not happen again and personally apologized to all Veteran's in saying that this will not fall through the cracks again. Mr. Toale offered his services to help out with the ceremony next year. ANNOUNCEMENTS: Mr. Alonzo mentioned that the BOS had met at 6PM this evening to discuss Board Policies & Procedures and reported that they are making progress and it should be completed in several weeks. APPOINTMENTS: 7:00 PM - Update on Status of Intersection Improvements, Mulpus & Townsend Harbor Roads: Ms. Bertram read a prepared statement which she had written concerning statements that were made by some residents accusing her of using her status as a Selectwoman to "pull strings" for this project to move forward. In the letter she stated that this project was started by petition of residents of the Hickory Hills area who were concerned with the traffic issues at that stretch of road/intersection. After studies by the Police Dept. along with the DPW, this stretch of road was deemed "high hazard" and she did not benefit financially or materially from this project. She is grateful to the residents who made this happen and has benefited only from the improvements through a safety perspective. She is confident that the new traffic pattern will protect the residents as well as all who pass through this area. She thanked all who were involved in bringing this project to fruition. Jack Rodriquenz, DPW spoke to the board and offered his services to help out with the Memorial Day Ceremony next year. Mr. Rodriquenz began his update on the project by saying that while being at the site of this project, some people were driving by and making rude and discourteous statements to him about this project. Mr. Alonzo revisited the original plan and said that what was approved by the BOS was the following Townsend Harbor Rd., coming from a southerly direction would have no stop sign • Townsend Harbor Rd., coming from a northerly direction, there would be a stop sign at the intersection of Townsend Harbor/Mulpus Rd Mulpus Rd. would have a stop sign This was designed to improve site lines and to slow down speed for safety at the curve He went on to say that he had received complaints that this configuration has become more dangerous coming from the non-stop sign area at the curve. He went himself and drove the route several times and concurred with the complaints he had received Mr. Rodriquenz was on vacation at this time and the Town Manager was contacted to investigate this issue. After speaking with the engineers she was told that after the work had been started, it was determined that the original plan was proven to be dangerous and they began to increase the lane area on the curve. He asked Mr. Rodriquenz to explain what the final modifications in the approved Mr. Rodriquenz explained that if the stop area on Townsend Harbor Rd was not curved, headlights from oncoming traffic would shine into the house across the road. They discovered that once the old black top was removed, it looked narrow, and he discussed with the Engineer, before he went on vacation, what should be done. He received numerous complaint calls and had the engineer along with the Chief of Police come to the site to discuss what should be done. It was agreed to that the south bound lane on Townsend Harbor should be widened and a 3d stop sign would be added. Mr. Rodriquenz believes that even without the stop sign, the widening has helped out tremendously. He stated that he was a little disappointed that the engineering was not "spot on" but that it is not unusual for that to happen. Mr. Alonzo spoke and said that the original plan as approved was not fulfilling the objective and it was modified. The additional stop sign was discussed by the BOS at length and they determined that if the flow of traffic did not meet the safety standards, then a 3rd ===PAGE 2=== stop sign would be added. There will be "Stop Ahead" signs installed to warn travelers of the stop signs and this will become a safer intersection. Mir. Rodriquenz added that there will be no parking allowed in that area and the police will be monitoring that. This project should be completed approximately within 1 week depending on the contractor's schedule. 7:15 PM - Application for Pedlar's License, Nicholas J. Tvrdy, sale of education products: Nicholas Tvrdy, college student from Nebraska came before the board to request a Pedlar's License so that he can go door to door selling his education products. He has already applied for and received a State Pedar's License and will provide the board with a copy of it. He explained his process of selling which is working Monday - Saturday by making appointments, going door to door to families to show them his products which are geared towards High School seniors down to infants, and then following up with them at a later time. Mr. Tvrdy stressed the fact that he is not a part of the school district. Ms. Bertram moved to approve the Pedlar's License for Nicholas J. Tvrdy for the sale of education products contingent upon the receipt of the State Pedlar's License. Mr. Toale seconded. On vote, motion carried, 5 in favor, 0 opposed. CURRENT BUSINESS 1. A project plan and budget is being put together for Town Hall renovations. Capital Planning Committee: No Report in terms of who is responsible for it, user fees and what the capital plan is for future upkeep. Mr. Alonzo added that the BOS will be meeting with all involved with the turf field as to who owns it, how fees are determined, and to discuss how the turf will be replaced 3 years from now. Ms. Bertram requested that a report be given by whatever entity is in charge of the field prior to that meeting ===PAGE 3=== Library Board of Trustees: Mr. Ebersole reported that this board completed the evaluation of the Library Director, reviewed their budget, and are looking for clarification on how to connect to MA Broadband MPO: Ms. Bertram reported that she will not be attending the next meeting on June 18'h and she requested that Ms. Luck go in her place. She also asked that the BOS send a letter of support. At the MJTC meeting there was a slight bit of improvement with the description of projects and moving forward Ms. Bertram will request more of an overview on future projects. Planning Board: Ms. Bertram was unable to attend the last meeting but was informed that Master Planning was discussed PACC: No Report. Mr. Alonzo asked all people interested in serving on this board to come forward and fill out a talent bank form. School Advisory Committee on Acceptance & Diversity: Mr. Ebersole reported that this committee will present their report to the School Committee at their 2°° meeting of this month after which they will present it to the BOS School Committee: Ms. Luck reported that this committee had met on May 21 where they welcomed a new member and reorganized after the 5/17 elections. Ms. Luck found the seminar very helpful. School Building Committee: Mr. Alonzo reported that there will be an important vote tomorrow at the MSBA which the Town Manager and the School Superintendent will attend Sewer Commission: Mr. Ebersole reported that this commission met on 5/27 and they are still dealing with the issue of grease trap compliance by various facilities. They have started reviewing the Request for Proposal process for engineering for the Town Meeting approved Lakeview and Pratt streets extensions. They have preliminary approved Capacity Fee Policy for future growth of the system and are sending it to legal for review. At a previous meeting they had taken a position of not waiving privilege fees for the Whalom Rd 40B sub-division in the reconfiguration because this was originally done with the understanding that the developer was going to put sewer down Pleasantview Avenue and this is no longer in the proposal. Ms. Bertram commented to say that she believes that it is not appropriate that these fees come from the Sewer Enterprise fund and hopes that the Sewer Commission does not waive those fees. Mr. Ebersole clarified that it is the Zoning Board of Appeals are the ones who could waive that but the Sewer Commission was very clear in saying that they should not waive them. Mr. Alonzo added that the developer needs to understand that this is not a Zoning issue to overturn and that this is a fee. Mr. Ebersole mentioned that the 40B provides relief from any local rule or regulation and the privilege fee is part of the Town sewer regulation process and that's where they technically have the right to do that. The connection fee which is paid to Leominster technically could be waived also. After discussion board members were in agreement that the 40B law is flawed and needs to be corrected. MA Broadband: No Report 4. Town Manager Reports or Department Reports: Mr. Alonzo informed the board that the Treasurer/Tax Collector has requested that the BOS approve and sign the authorization for the Water Dept. to send out the 4' Quarter Billing in the amount of $5016.96. Mr. Ebersole moved to approve the authorization to bill those amounts. Ms. Bertram seconded. Mr. Alonzo mentioned that there are two bills, one for $5016.96 and one for an adjustment $2066.00 Mr. Ebersole then amended his previous motion to reflect both bills. Ms. Bertram seconded. On vote, motion carried, 5 in favor, 0 opposed. An Alcoholic license, which had previously been approved, was signed by the BOS for KG Waterfront d/b/a as Embers Pizzeria. A request was received from the Planning Board for the BOS Chairperson to sign a traffic count request form for the intersection of Goodrich St. and Lancaster Ave. Ms. Bertram mentioned that she believed that historically, the traffic counts were asked of the DPW Director and the Police Dept Mr. Alonzo clarified to say that the form requests the signature of the chief elected official. Ms. Bertram moved to approve the request from the Planning Board for traffic counts at Goodrich St. and Lancaster Ave. Mr. Ebersole seconded. On vote, motion carried, 5 in favor, 0 opposed. APPOINTMENTS/ RE-APPOINTMENTS/ RESIGNATIONS 1. Appoint Mike Conley, Green Communities Task Force: David Blatt, Chair of the Green Communities Task Force came before the board to ask for their appointment of Mike Conley to this group. He stated that with this appointment they will have 5 members and asked that if anyone was interested in becoming an alternate to please come forward. Mike Conway came before the board and corrected the spelling of his name to Conway. He gave a brief history of his, family. education and work experience with Borego Solar. He is an electrical engineer in the renewable engineering field,he likes the community, and is interested in the Green Communities Task Force. Ms. Bertram cautioned Mr. Conway concerning his affiliation with Borego Solar, that if they did want to build in Lunenburg, Mr. Conway would need to recuse himself from the vote. She believes that his experience and technical abilities will be a welcome addition to that group. Mr. Ebersole informed Mr. Conway that after he is sworn in at the Town Clerk's office, she will give him a copy of the Conflict of Interest Law for review. Mr. Conway disclosed at this time that he is working on a small Solar Project of his own which is currently going through the proper procedures with the Town. If appointed, he has no intentions of using his position on the Green Communities Task Force to further any personal endeavors with this project. Ms. Bertram moved to appoint Mike Conway to the Green Communities Task Force. Mr. Toale seconded. On vote, motion carried, 5 in favor, 0 opposed. ===PAGE 4=== Mr. Blatt informed the board that a letter has been received from the State and approximately 80% of the Green Community Task Force projects have been approved. On vote, motion carried, 5 in favor, 0 opposed Mr. Alonzo informed all that the replacement of Mr. Bakaysa's position will be a joint appointment of the Planning Board and the BOS until the next Town Election next May. He encouraged people who are interested to come forward. PUBLIC COMMENT: Ms. Luck mentioned that the storm drain at the intersection of Flat Hill Rd. and Sunset Lane was full. She filled out a form online to the DPW to have it taken care of and it was done the same day. Mr. Alonzo mentioned the possibility of potentially losing Net Neutrality on the internet. Currently all data transferred over the internet from all carriers is not subject to throttling. The major carriers have petitioned the FCC to allow for a 2 tiered system (slow lane & fast lane). This would put a big wrench in any start up company and allow people to play politics. If this is allowed to go through it would create a "haves & have nots" between different companies and allow people to pick & choose who gets what. We encouraged people to educate themselves on Net Neutrality, to not allow a 2 tiered system, and to make comments on the FCC EXECUTIVE SESSION: None ADJOURNMENT: Being no further business Ms. Bertram moved to adjourn the meeting.
