Bilotta Meeting Room, as scheduled with Jamie Toale, Chair; Robert Ebersole, Vice Chair; Tom Alonzo, Clerk; Paula Bertram, Member; Phyllis Luck, Member and Town Manager Kerry Lafleur. The meeting opened at 7:00 P.M with the Pledge of Allegiance. Public Comment Ms. Luck announced that she, Ms. Lafleur and Land Use Director Adam Burney attended a Stormwater Management Workshop last week. There was a lot of practical and basic information. Mr. Alonzo announced the Boys & Girls Club Fall Rockin' Auction fundraiser on November 7' at 7:00 PM at the Leominster Eagles Club. There will be a lot of fun, dancing, food and raffles. There is limited seating. Ticket information can be obtained at bgcluboflunenburg.org. Mr. Toale announced Halloween Trick or Treat hours are from 6 - 8 PM on Saturday, October 31$t Committee Reports Ms. Luck attended the School Building Committee meeting. There was a report presented on contingency spending. To date, $162,912 has been spent. There was a separate sheet with possible expenses adding up to another $70,000. A final sheet titled discretionary items totaled $4,251,000. This list includes artificial turf for the new athletic field, replacing the existing field for $675,000 and demolishing the Passios Building for $1.5 million. Ms. Luck expressed surprise at seeing this list as she does not recall prior discussion of these items. Ms. Bertram expressed concern about the list as well and requested further discussion on this. Mr. Alonzo stated he did not attend this meeting. He wanted the Board to know none of these items are being pursued at this time; the main goal right now is completion of the building. Depending on where we sit at the end of the project, those other items may be brought forward. Mr. Toale suggested this discussion occur at a School Building Committee meeting. Mr. Ebersole added some of these items may need a town meeting vote as they were not included in the original article. Ms. Bertram reported Conservation Commission meets tomorrow night. One of the items on the agenda will be the approval of the parking lot for the Lane Property. Mr. Ebersole reported there may be possible changes to the state aid formula for Library Aid. It is unclear of the impact of this on the budget. The Library is also installing a new burner and building management system. Sewer Commission continues to update operating policies and procedures. Current Business 1. Review/Comment on Marketing Plan for Community Solar Project Ms. Lafleur reported Joe Fiori and Eric Misbach of Nexamp were present this evening regarding the community solar project marketing. Mr. Misbah presented a brief overview of Nexamp. The community solar project that could provide a 15% savings on residents' electric bill is a 650kw array and is under development in fitchburg. Nexamp's advantages are that net metering project credits are available to homeowners, renters, condominium owners and non-protits. A 15% discount applied to your electric bill is guaranteed for up to twenty years. There are no sign up costs and no service or cancellation fees. Changes can be made every six months. There is no maintenance for the home owner and there is no installation of equipment on the homeowner's property. The ===PAGE 2=== signup process is simple; a person would send Nexamp their electric bill and Nexamp sends you a contract after analyzing whether you are eligible. Nexamp would administer the signup process for Lunenburg residents. In order to spread awareness of this opportunity, Nexamp would like to send out emails via various distribution lists, post information on the town website, use word of mouth, social media and have a Nexamp presentation and sign up event. Nexamp has already signed up 20 customers so far via their website. There are 50 spots remaining plus or minus ten depending on the electrical load of each residence. Mr. Alonzo stated he was in favor of this project and requested reserving a time period where only Lunenburg residents can sign up for the program. Mr. Fiori stated Nexamp executives have expressed that they can't provide exclusivity to Lunenburg residents. They can't turn away other people because they are not from Lunenburg, but they can stop marketing it. Further discussion about the sign up process ensued. Mr. Alonzo stated that residents can go to www.solarizemybill.com or call 800-945-5124 to sign up. He suggested a sign up event for residents. A link will be posted on the town website for ease of sign up. The estimated "go live" date for the project is June 2016. Resident Greg Bittner of 129 Pleasant Street asked how he should refer people. Mr. Alonzo suggested directing them to the town website link. The Board thanked Mr. Fiori and Mr. Misbach. 2. Review & Order STM Warrant Articles Ms. Lafleur asked the Board if they would like to reorder the articles for the Special Town Meeting. The warrant will be finalized this week and goes to the printer on Monday. Mr. Toale invited Police Chief Marino to speak on his articles on the STM warrant. The bylaw articles were originally on the May 2015 Annual Town Meeting warrant, but were not voted on due to lack of a quorum. Since then Chief Marino has consulted with legal counsel and clarified them further. The bylaw regulating the use of motor vehicles, recreational and snow vehicles on Whalom Lake was first. Motion: T. Alonzo 2nd: R. Ebersole To recommend approval of the Lake Whalom bylaw Mr. Ebersole asked if this should apply to Lake Shirley as well. Chief Marino stated there is a separate bylaw for Lake Shirley that needs updating. Vote: All in Favor Chief Marino moved on to the bylaw that restricts the public consumption of marijuana or tetrahydrocannabinol. Chief Marino reported the Executive Office of Public Safety has recommended adoption of this bylaw. The Attorney General's office has passed this version in many towns. Mr. Alonzo stated he has a problem with the wording of ingestion other than smoking, even for someone who has a valid medical marijuana card. Ms. Bertram agreed. Mr. Toale asked if there is a Massachusetts General Law that addresses this it not passed. Chief Marino replied no. Further discussion on the bylaw wording ensued. Motion: R. Ebersole 2°d: P. Bertram To make a recommendation on this bylaw at the special town meeting Vote: All in Favor The next proposed bylaw was to enact a bylaw authorizing the Board of Selectmen to license the business of pawnbrokers, buyers and sellers, or dealers in metal. Chief Marino stated stolen property is brought to pawn shops frequently. We need to be able to control what goes on at pawn shops. Discussion ensued regarding some of the wording of the bylaw. Motion: R. Ebersole To recommend approval of the bylaw licensing pawn brokers 2"d: T. Alonzo Vote: All in Favor Mr. Alonzo complimented Chief Marino on the formatting of the bylaw. He thanked the Board and exited the meeting. Ms. Lafleur reported on Article 1; collective bargaining agreement with the Professional Firefighters. There is still no settlement at this time. Motion: T. Alonzo To make a recommendation at town meeting on Article 1 2"': R. Ebersole Vote: All in Favor ===PAGE 3=== Regarding Article 2, there are no prior year expenses. For Article 3 which amends amounts voted for the FY'2016 Budget, Ms. Lafleur presented a brief update. New Growth has been submitted to the state in the amount of $360,856, but not yet approved. If you add that to the additional state aid minus the cherry sheet charges, there is additional revenue of $93,629 available. Ms. Lafleur stated Veteran's Benefits based on approvals through the end of the calendar year, we will have a deficit of $48,000, which is what was budgeted for the entire year. This is one area she asked the Board to consider for additional appropriation. There is also the potential to add more revenue to the Reserve Fund to deal with overexpenditures with snow and ice or anything else unexpected that comes up. We have had a couple of retirement buybacks to date which has expended 63.3% of the Salary Reserve Account. Ms. Lafleur stated we do expect to see a surplus collection in our investment income as a result of the bond proceeds we have for the school project. We will expect to receive an additional amount of collection in that line item. Motion: R. Ebersole To recommend transferring $50,000 to the Veteran's Benefits Account and the remainder to the Reserve Fund 2"°: T. Alonzo Vote: All in Favor Motion: R. Ebersole To recommend approval of the budget adjustment article 25°. P. Bertram Vote: All in Favor Ms. Lafleur moved on to Article 12 and stated she reviewed this with town counsel and according to the 2012 September Special Town Meeting, Article 1, the Board already has blanket authorization to enter into alternative energy power purchasing and/or net metering credit purchase agreements. Hence, there is no reason to take up this article for Nexamp. Mr. Alonzo stated there may be some people who could say that the September 2012 vote was for a particular project. Ms. Lafleur stated there is no harm going forward with this article. It was suggested to present to voters that going forward these projects are going to come up more often and this authority would address them all. Motion: T. Alonzo To recommend Article 12 for approval 2"°: R. Ebersole Vote: All in Favor Ms. Lafluer moved on to Article 14 which is the request to appropriate into the Stabilization Fund. She proposed moving $2,623 into this fund which would represent the increased spending and conform to the Stabilization Fund policy. Motion: R. Ebersole To recommend transferring $2,623 into the Stabilization Fund 2'°: T. Alonzo Vote: All in Favor Mr. Toale stated there were some open items on the codification project that are still pending so the Board will pass over that for this evening. Ms. Lafleur presented the employment agreement for newly appointed Director of Municipal Finance, Karen Brochu. This item is already included in FY16 budget. This agreement includes an amendment to her current agreement and provides $9,259 for this position. Motion: P. Bertram To approve the amendment to the employee agreement 2nd. T. Alonzo Vote: All in Favor The Board signed the agreement. 15. Jas Payablested the in trd sign the da 5, 6 31, ST er A varano for 19, 9,52ad and a Payrol warrant for $680,094.54. Ms. Lafleur requested the Board sign another copy of the 1" Quarter Lunenburg Water Commitment to the Treasurer as the original was misplaced. The Board signed the warrant. ===PAGE 4=== The Board approved minutes of October 6, 2015. Town Manager Report: Ms. Lafleur referred to the Board of Selectmen pending agenda items list that was updated as of yesterday. If the agenda item is scheduled, a date has been placed next to it. She asked the Board to review the list and inform Executive Assistant Peterson of any items they believe should be on the list. Ms. Lafleur stated she intends to place this into a spreadsheet that identifies the current status of each item. Ms. Lafleur directed the Board to the FY16 First Quarter Revenues/ Expenditures Report prepared by Town Accountant Brochu. The town has collected 27.43% of preliminary estimates through September 30, 2015. Local Receipts: the town has collected 19.14% of the FY16 estimate. Fines: 20.05% collected of estimates through September 30. Local Options Meal Tax: 38.10% of the estimate through the 1"' quarter of FY'16. The average for FY'15 was $24,600. Based on this average the estimate could be increased by $11,000 for FY'16. Motor Vehicle Excise Tax: to date 10% has been collected; the majority of collections occur in the 35° quarter. Investment Income: the current estimate is $15,300. The town has collected 257.31% through September 30. This is partly due to the investment of proceeds received for the Middle School/High School project. Miscellaneous Non- Recurring Income: the town has collected 34.75% of the net metering credits estimate. Fees: the town has collected 30.18% of the current estimate for fees. Taxes & State Aid: the town has collected 25.58% of our tax levy, including $70,791 in tax lien revenue and 24.08% of state aid estimate. Expenditures: the town has encumbered 35.4% of budgeted expenditures. Of note on the expenditure side is the Salary Reserve and Veteran's benefits, the details were already presented this evening. The Wiring Inspector account has expended 65.1% of the appropriation to date. The Wiring Inspector receives a percentage of fees collected and currently there is a large building project going in town. We will probably need to make some adjustment at the end of the year. All other expenditures appear to be at the level they should be at this point in the fiscal year. She asked the Board to review the spreadsheet's line item detail and if they have questions to contact either Ms. Lafleur or Ms. Brochu. Public Comment Greg Bittner stated he is a fairly new member of the School Building Committee and wanted to discuss the school construction contingency list. He was surprised to see the solar panels for the new school roof were not on the list. He asked Facilities Director John Londa about this and Mr. Londa informed him he was working on a Power Purchase Agreement (PPA). Mr. Bittner wanted to bring this particular item up for discussion because he feels it would be a good return on the investment. Mr. Alonzo suggested he bring it up at the next School Building Committee meeting. Mr. Bittner stated four items were prioritized on the list; touchscreens, reproduction of the murals, reconfiguration of the Passios Building parking lot and an outdoor classroom. Mr. Ebersole stated the solar panels may not be on the list due to it being one of the Unitil circuits that has reached capacity. Ms. Lafleur stated if there is a PPA, the school would not own the solar equipment. The town could not afford the capital outlay for the solar panels. Mr. Bittner stated he had an appointment with School Superintendent Calmes to discuss the contingency list and the history behind it on Friday. Mir. Ebersole stated he attended the Lunenburg Water District meeting and the Commissioners met with the Lancaster Town Administrator about the possible intermunicipal agreement. They are moving forward with discussion with Lancaster, possibly leading to negotiations. Mr. Ebersole's public comment at that meeting was their legal counsel has ruled that they have the right to purchase land and or develop water in another town to supply Lunenburg. If they were to supply users outside the district it would have to go back to the water district ===PAGE 5=== meeting. Question was asked if legislature approval would be required as well. Mr. Ebersole believed both were required. Motion: P. Bertram To adjourn the meeting 2nd.P. Luck Vote: All in Favor Respectfully submitted, Elaim Peterson Elaine M. Bilotta Meeting Room, as scheduled with Jamie Toale, Chairman; Robert Ebersole, Vice Chairman; Tom Alonzo, Clerk; Paul Bertram, Member; Phyllis Luck, Member and Kerry Lafleur, Town Manager. The meeting opened at 7:00 p.m. with the Pledge of Allegiance. Public Comment: Ms. Luck reported she had attended a meeting of the Lunenburg Water District and they had discussed the intermunicipal agreement with Lancaster. It was noted that the negotiations with Lancaster for the IMA may require a vote of district members. Another discussion item was the proposed new building at the Massachusetts Avenue property; a survey, drainage plan, location of the building is needed. The Lions' Club Pancake Breakfast at Eagle House is tomorrow since Veterans Day is next week. Mr. Alonzo thanked Mrs. McCullah and her civics class students for coming to Town Hall to hear him speak about town government. They had lots of great questions. He announced the Lunenburg Boys & Girls Club Rockin' Auction fundraiser at the Eagles Club in Leominster on November 7" '. It starts at 7:00 p.m. and features a silent auction, Chinese auction, 50/50 raffle and more. Mr. Toale announced November 5th is the last day to register to vote at the Special Town Meeting on November 16. The Town Clerk office will be open from 8 a.m. to 8 p.m. that day. Eagle Scout Project Owen Parker presented his Eagle Scout project proposal to the Board. He would like to add a new plaque in memory of all veterans to a blank rock in the Veterans Memorial Park. The plaque could be for the War on Terrorism. He would like to refurbish the park benches and add mulch and edgers around all the memorials. The work would start in the spring of 2016. Total cost would run around $1200- $1300 and would require 32 man hours. Motion: T. Alonzo To approve the Eagle Scout project as presented and authorize Owen Parker to remove the park benches to be refurbished 2"d: P. Bertram Vote: All in Favor The Board thanked Owen for his presentation. Disclosures by Non-Elected Municipal Employees of Financial Interest under G.L. c. 268A, $19 Conservation Commission members Tom Bertram, Jack Rabbitt, Brad Kennedy and Carl Luck presented regarding their disclosures. Ms. Luck and Ms. Bertram recused themselves due to being related to Carl Luck (husband) and Tom Bertram (son) respectively. Jack Rabbitt, Vice Chair of the Conservation Commission, spoke first. He stated the commission members were filing these in an effort to be open and honest. He sincerely wants to protect the environment. Over the past year it has become apparent the wetland regulations need updating, specifically the buffer zone definitions and what constitutes being a structure. Four of the seven commission members live on lakes and would be affected by the changes. They contacted the State Ethics Commission and were informed there was a conflict and to file the disclosures. If four out of seven are in conflict, the commission could not discuss changing regulations. They are looking for guidance from the Board. Mr. Ebersole stated he was okay with the request with the understanding that if an issue affects the members' properties they would need to recuse themselves versus rulings that affect all residents. He advised the discussions be televised and proposed regulations be published in the newspaper, and a reporter is invited to the meeting. ===PAGE 2=== Tom Bertram, 225 Island Road, has been a member for one year. He stated the bylaws and regulations need updating and Massachusetts law has been updated this year so new revisions are needed. They would like to clean up the discrepancies between both. Richard Bursch, Chairman, stated his comments are directed at the process not the integrity of the individuals involved. As it stands now, they have a bylaw that was enacted in 1997 and regulations that were updated in 2014 whose general terms and procedures need to be aligned. Ethics has deemed that there are financial impacts to these members that merit exemption. He did not believe the Board should act on a broad exemption. If they do, theoretically four members who live on lakes could abolish the buffer zone. He did not believe they would do so but that would be the reality. Speaking as the Chairman, he would like to see a discussion only. Carl Luck, 50 Sunset Lane, echoed the same request as Mr. Bertram and Mr. Rabbitt. One reason he came on the commission was to review and implement policies. He stated we certainly would recuse ourselves if our properties were affected. He hoped the Board would support the request for determination so they could continue on and do their jobs. Brad Kennedy, 17 Crocker Ave, wanted to make clear the reason that he joined the commission was to make lakes healthier. Mr. Toale stated it is important to note that he also owns property on a lake and considered whether he should recuse himself on this decision. However listening to the statements, he felt comfortable working with the commission regarding cleaning up the regulations and bylaw. He was not comfortable with a blanket exemption. He suggested the Board take this under advisement. Mr. Ebersole asked about the affected commission members using the Rule of Necessity, Ms. Lafleur stated this only applies to elected officials. Mr. Alonzo stated the Conservation Chair said it best when what they are doing is to protect the process. It is not an issue of trust; it has to do with setting precedent and giving power beyond what you should when a conflict arises. He stated he would like to see a narrower definition of the conflict of interest. Motion: B. Ebersole 2"d: T. Alonzo To approve the determination that financial interest in making regulations conforms to the bylaws and not include any discussion regarding changing substantially either of those items for this purpose Discussion: Mr. Ebersole believed it is important the regulations be consistent with the bylaws. He supported a limited process and additional discussion going forward. Mr. Bertram stated the commission would be discussing updating the bylaws over the winter when things quiet down. He suggested placing the buffer zone definitions into the bylaw. Mr. Alonzo stated he would be more comfortable with a town meeting vote about the buffer zone. Land Use Director Adam Burney stated there is no conflict in the bylaw and regulations; the two are separate. He suggested the four affected commission members grant permission for the Board to discuss this with the Ethics Commission attorney. They could hash out the details of the case and get a perspective on individual circumstances to add clarity to how this might play out. Each member has a different potential financial interest depending on where they live and how much land they own. Mr. Alonzo stated he has done this in the past and Ethics has already determined there is a conflict and it's up to the Board to decide. Mr. Rabbitt stated he was also on the stormwater subcommittee; should he resign? Mr. Alonzo stated anything related to stormwater would be placed into a bylaw, so no, he did not need to. Mr. Ebersole requested to withdraw his motion and ask the four parties to resubmit revised requests that limit their participation as it relates to them and the comments presented tonight. Mr. Alonzo proposed the commission members discuss this among themselves and present an outlined document of what they are looking to change. The Board could then proceed from those documents. Mr. Rabbitt asked for clarification. Mr. Alonzo stated one thing preventing the Board's decision is there is not enough information on the parts of the bylaw and regulations that you intend to amend. Mr. Ebersole withdrew his motion and Mr. Alonzo withdrew his second. Motion: T. Alonzo Second: P. Bertram To allow a narrow exemption to discuss for purposes of presenting an outline of those sections of regulations and bylaw that they are looking to adjust for presentation to the Board Vote: Mr. Alonzo-yes, Mr. Toale- yes, Mr. Ebersole- yes ===PAGE 3=== Vote: Mr. Alonzo- yes, Mr. Toale-yes, Mr. Ebersole- yes Ms. Luck and Ms. Bertram returned to the meeting. Parks Commissioner Appointment Ms. Lafleur reported the Parks Commission consists of three members and there is currently one vacancy. Dennis Mannone, 635 Goodrich Street, has requested to be appointed to the Parks Commission. He has worked in the public sector for twenty years. Paul Scheipers, Park Commissioner, welcomed Mr. Mannone's request to be appointed. Parks Commissioner Bob Robuccio could not be present this evening due to a family emergency. Ms. Lafleur checked the Town Charter and it reads the majority of those members eligible to appoint are required. Four members are required and there were more than that tonight so the appointment can be made. Mr. Ebersole asked Mr. Mannone if he intended to run for election in May. He stated he would. Motion: P. Bertram 2": B. Ebersole To appoint Dennis Mannone to the Parks Commission until the next election Discussion: Mr. Toale supported the nomination as he has worked with Mr. Mannone on the Capital Improvement Planning Committee. Ms. Luck thanked him for his interest. Vote: Mr. Toale- yes, Mr. Ebersole- yes, Mr. Alonzo-yes, Ms. Bertram - yes, Ms. Luck- yes, MIr. Scheipers- yes Appointments to Architectural Preservation District Commission Mr. Toale asked if the applicants for the APDC were present. Motion: T. Alonzo 2"d: P. Bertram To appoint Amory Phelps to the APDC as the Historical Commission Representative Vote: All in Favor Resident Jim Laveck, 33 Lancaster Ave., stated he owned a historical home in the APD and thought it was important to be involved. He thought downtown was quaint and he wanted to keep that look for the town. Ms. Bertram asked him his thoughts about mixed use for buildings while maintaining their integrity. Mr. Laveck stated he had a home business when he first moved to town and he believed he had maintained the integrity of that structure while doing so. Mr. Ebersole corrected the mixed use referred to the Historical District. The Board reviewed the composition of the commission. It is a five member board with one member from the Historical Commission, a design professional, a craftsperson or building contractor familiar with historical restoration, one resident of the APD and one member at large. Terms are staggered. Mr. Laveck stated he could be the resident member of the APD. Brian Corcoran, 9 Lancaster Ave., stated he has been involved with the meetings regarding the APDC bylaw from its inception and fits into the resident member designation. He understands the meaning of the bylaw and would like to keep the character of the town as is. Cullen Dwyer, 76 Main Street, Historical Commission member, also lives in the APD. He helped draft the APDC bylaw and wording. He offered to fill the resident designation or the member at large position. Mr. Alonzo stated he is not speaking as a reflection on the people coming forward for the APDC but the process and wanted to keep the Historical Commission separate from this commission. Mr. Toale agreed. Richard McGrath, 22 Cushing Lane, Historical Commission member, stated he could fill the craftsperson category as he is a third generation master stone mason/bricklayer. He likes the idea of making the town accessible; those homes are anchors of the community. He added he is not opposed to development. Motion: B. Ebersole 21°: T. Alonzo To appoint Richard McGrath as the craftsperson member on the APDC with a term ending June 30, 2016 Vote: All in Favor Motion: T. Alonzo To appoint Jim Laveck as the resident member on the APDC with a term to expire June 30, 2017 2'°: B. Ebersole Vote: All in Favor Discussion ensued about advertising for more applicants before appointing Mr. Dwyer and Mr. Corcoran. Mr. Toale stated he did not want to appoint more Historical Commission members as they have their own charge. ===PAGE 4=== Mr. Corcoran and Mr. Dwyer could serve as alternates if there are more applicants or could be appointed if no further applicants come forward. In the meantime, the APDC now has a quorum and can begin their work. The Board is seeking people with design skills and a member at large of the community. Mr. Toale assured the current applicants that this decision is not a reflection on them personally. Mr. Ebersole requested more clear maps of the Historical and Architectural Districts for the May 2016 annual town meeting. Mr. Toale thanked the applicants and asked them to wait a little longer. The Board will get back to them regarding whether the appointments would be as members or alternates. The Minutes of October 13, 2015 were approved and signed. The 2'd Quarter Water Bill Warrant in the amount of $6271.05 was presented. An accounts payable warrant in the amount of $456,236.64;; a payroll warrant in the amount of $702,596.59 and a payroll deductions warrant in the amount of $448,468.20 were presented for signatures. Committee Reports: Ms. Luck attended a School Committee meeting on October 21° and the Financial Report for 2014-2015 was presented. Supt. Calmes mentioned in the discussion that at the Capital Planning meeting about sharing facilities management capability with the town. The next meeting is tomorrow. At a ZBA meeting on the 28th ", a special permit to build a home on a non-conforming lot at 1381 Mass. Avenue was denied, There is a twenty day appeal period. Ms. Bertram reported the Planning Board held a hearing on the 274 Prospect Street development on October 26" '. Residents expressed concerns about bylaws and lack of architectural character of the proposed metal buildings. The hearing was continued to December 14. The majority of the meeting focused on bylaw changes relative to the parking section. The Conservation Commission met on October 28* and held a special meeting onsite at the Lane Property parking lot. Work is commencing shortly. The Lunenburg Snow Riders will be doing the work funded by a grant through the Recreational Trails Program. They are awaiting state approval of the funding. Mr. Alonzo reported Cable Advisory Committee is preparing a survey for residents regarding future uses of the cable resources. Mr. Ebersole reported the Board of Health has a workshop meeting scheduled for November 9" to review the Septic System Loan Program. The Sewer Commission met last week. The Pratt Street/Lakeview Avenue sewer project has five applicants to connect to the sewer as of October 27th. There is a workshop scheduled for tonight on grease traps and compliance. Mr. Toale reported the Building Reuse Committee met and reviewed the first pass assessment for the feasibility study performed by Tappe Architects. They have completed a review of the space and conditions of the four buildings under review. The committee is now working on a criteria matrix comparing potential recommendations based on fit, cost, meeting expectations and marketability. They are also compiling a list of frequently asked questions and will begin to review possible choices with plus and minuses in the next month. Capital Planning met on the 27* and reviewed long range capital needs of the DPW Department, Pavement Management Plan and Town Building capital needs. The committee will integrate and present the long range requests/trend analysis to the Finance Committee, Town Manager and Board of Selectmen for use in budget discussions. Ms. Lafleur reported the Town received an additional amount of 40S funding in the amount of $44,000 via a late amendment filed with the state. She will be sending more information out tomorrow. It is $20,000 under what the town received in fiscal year 2015. She will be looking for an additional appropriation or a reduction in revenue. Ms. Lafleur stated in consulting with Town Accountant Brochu, we could slightly reduce some of our local receipt estimates. Mr. Toale asked for further public comment. There was none. He stated the next Board meeting on November 10th will be a workshop and will not be televised, but it is open to the public. The next televised Board meeting will be on November 17" ". Bilotta Meeting Room, as scheduled with Jamie Toale, Chairman; Tom Alonzo, Clerk; PaulaBertram, Member; Phyllis Luck, Member and Kerry Lafleur, Town Manager. Robert Ebersole, Vice Chairman, was not present. Also present was DW Director Jack Rodriquenz, Police Chief James Marino, Rich Benevento and Mike Pompili of World Tech Engineering This meeting was not televised over the public access channel. Mr. Toale called the meeting to order at 7:00 p.m. Pavement Management Ms. Lafleur stated this workshop was put together to discuss one of the Board's goals. Ms. Lafleur announced there were two consulting engineers present, Rich Benevento and Mike Pompili of WorldTech Engineering, Woburn, MA. She added they were here to discuss the different items the Board identified as important under this goal. Mr. Benevento and Mr. Pompili created a presentation. Mr. Benevento stated there was a reevaluation of the Lunenburg roads over the summer and fall and that is now in the program and available for use to determine the pavement condition index. Lunenburg is a "62" out of "100." In order to determine where the Town wants to be is the level of investment the Town wants to make; pavement management in the Northeast is very dynamic. Roads and bridges worsen with age. Establishing priorities is a town decision, where and how much to invest. Main roadways have the highest priority as they are used the most and cost more to maintain. If you take funding to work on the local roadways, then you are taking away from the prioritized roadways too. What do you want to invest in your program, keep the status quo or something else? You want to be maintaining; preventative maintenance is better than redoing an entire road; this buys you some time. Mr. Pompili presented a summary of the present condition of the various town roads and the costs to maintain them via preventative actions such as crack sealing and overlay. An overlay costs about a quarter of the cost of road construction. He added runoff surface water and overload of structural capacity are the two main reasons roads start to break down. Discussion ensued on various types of roads and costs for restoration. "Excellent" rated roads change to "good" rated roads in an average five years and that is when crack sealing would be warranted. If you do nothing, the roads continue to deteriorate and costs to restore grow significantly. Mr. Rodriquenz stated that success with maintaining the present pavement management plan is to increase funding annually. Ms. Bertram agreed but asked where the funding is coming from? Do we take part of the funding for the main roads to keep up the collector, local and secondary roads? Discussion ensued on how to inform and encourage taxpayers to pay for these roads, as well as how to fund future new improvements while still maintaining current roads. Mr. Pompili stated they could supply scenarios based on certain amounts of funding. Mr. Toale stated the Board needed to know what the actual cost was of getting a road done. Traffic Rules & Orders The Board reviewed current traffic rules and orders as well as draft traffic rules and orders along with Police Chief Marino. One item discussed was increasing parking fines. The discussion will continue at the January 19, 2016 meeting. Animal Control Policy & Procedures ===PAGE 2=== Chief Marino presented a draft of animal control officer scope of service and responsibilities and municipal animal inspector qualifications and duties. The group also reviewed the MRPC feasibility study on regional animal control. Review of Special Town Meeting Articles The Board reviewed Warrant articles for the Special Town Meeting on November 16, 2015. Bilotta Meeting Room, as scheduled with Jamie Toale, Chairman; Robert Ebersole, Vice Chairman; Tom Alonzo, Clerk; Paul Bertram, Member; Phyllis Luck, Member and Kerry Lafleur, Town Manager. The meeting opened at 7:00 P.M. with the Pledge of Allegiance. Public Comment Mr. Toale thanked the town residents who attended the Special Town Meeting last night. He encouraged more residents to get involved. He stated the Cable Advisory Committee is seeking two more members, the Public Access Advisory Committee is also seeking two members; the Architectural Preservation District Commission is seeking two members; specifically one member at large and one member with design experience. The Bylaw Review Committee is seeking one member. The Senior Property Tax Work Off Committee is also seeking one member. The Lunenburg Turkey Hill Family Lion's Club is holding Meat Bingo on November 21st from 7 - 9 pm at the Eastman Club in Fitchburg. All benefits go to the various charities the Lions' Club sponsors. Mr. Alonzo thanked everyone who attended and supported the Lunenburg Boys & Girls Club Rockin' Auction two weeks ago. It was a very successful event. Ms. Luck stated Boy Scout Logan Marshall is still seeking funding for his Eagle Scout project of building a handicapped accessible ramp and walkway connecting the Senior Center to the Teen Center. She encouraged others to contribute to the project. She also attended a conference titled "Elevating Municipal Partnerships," at Holy Cross last week. She reported on some of the informative workshops she attended. Eagle Scout Project Proposal Mr. Toale reported the 6:00 pm Executive Session was postponed to a future date. He moved on to the Eagle Scout project proposal from Steven Hoffmann of Troop 1728. Mr. Hoffmann reported his project is to build a garden and install spotlights for the flagpole at the gazebo. Protocol dictates lighting any flag being flown at night. He also believed a garden around the flagpole would enhance the beauty of the common. He has obtained approval from the Building Department and Parks Commission to date. Mr. Hoffmann has spoken to the Building Inspector and he will need an electrical permit to run power underground to the flagpole for ground mounted lighting. A licensed electrician will obtain the permit and install the wiring. He will use landscaping stone for the garden bed around the flagpole. The garden will be raised around the flagpole and planted with perennials. Motion: P. Bertram 2'd: T. Alonzo To approve the Eagle Scout project as presented by Steven Hoffmann Vote: All in Favor The Board thanked Mr. Hoffmann for coming forward with this project. Mr. Toale offered to be the beneficiary for the project. Mr. Hoffmann will drop off the paperwork for Mr. Toale's signature. Bylaw Review Committee Appointments Mr. Toale moved to the Bylaw Review Committee applicants. Cathy Hennessey, 30 Clifton Road, came forward and reported she was asked to serve on the committee. Ms. Lafleur expanded on this by stating the four candidates coming in tonight were recruited by the Town Moderator. Nancy Gray, 45 Rangeley Road, stated she was asked by Tim Murphy to serve on the committee and she thought it was time she did something like that. Her occupation is as an attorney. Ms. Lafleur reported that Michelle Smith of 19 Redwood Road could not make it in this evening and Rob Bowen, a former selectmen and attorney was coming in later this evening. Two of the five members are appointed by the Moderator. Two members are appointed by the Board of Selectmen. ===PAGE 2=== Mr. Ebersole noted the fifth member serving on the committee is the Town Clerk, who shall serve by virtue of office. Motion: R. Transfer of All Alcohol License for The Bootlegger to Fifty Mass Ave. LLC Mr. Toale read the hearing notice aloud, "The Lunenburg Licensing Authority will hold a public hearing on November 17, 2015 at 7:15 PM in the Town Hall, Joseph Bilotta Meeting Room, 2nd Floor, 17 Main St. Lunenburg, on the application submitted by FIFTY MASS AVE. LLC, for a transfer of an All Alcohol Restaurant license from Cosimi Corp. d/b/a The Bootlegger, 50 Massachusetts Avenue, Lunenburg, MA. The premises are described as a 1 1/2 story building with function room in the downstairs area. I" Floor has 1 main dining room, bar and lounge and kitchen area; 2nd floor has 1 dining room and outside deck." Mr. Toale opened the hearing. Applicants Sean Morrison and Lance Dellogono came forward and stated they were purchasing the business. Ms. Lafleur stated the application was in order but wanted to note as part of the application process a CORI check had come back that contained information that could result in an adverse finding. In accordance with the Town CORI policy, the applicant was notified and provided a copy of the CORI and the CORI policy. The applicant has the right to dispute the finding and was notified in writing on November 10", , but has yet to respond. If no dispute is filed, the record will be deemed to be accurate and provided to the Local Licensing Authority in Executive Session with the required prior notice being provided to the applicant. At this time it is recommended the Board hear the transfer request and provide the applicant with a date certain by which he should respond to the accuracy of the record. If the applicant seeks a more immediate decision relative to the transfer request, the applicant may consent to the release of the information to the Board and the Board may discuss the record as part of the transfer request during tonight's public hearing. The applicant stated he did not receive a letter. Ms. Lafluer reported Executive Assistant Elaine Peterson sent a copy of the letter via email and attempted to contact the applicant by phone. Mr. Toale suggested continuing the hearing to December 1st. Ms. Lafleur stated the Board was free to ask any other questions related to the application. Mr. Alonzo asked if there would be any changes to the business. Mr. Morrison stated he planned on keeping all the policies the same and planned on running it the same as the current owner has for twenty years. Mr. Ebersole asked Mr. Morrison and Mr. Dellogono about their experience in running restaurants and liquor establishments. Mr. Dellogono stated they are keeping the current staff and Mr. Cosimi is staying onboard as a consultant. Mr. Dellogono stated he managed Destare in Fitchburg from its opening for four years. There were no violations or issues with that license. He added ten years ago he had a café called Mocha Alley which he ran for five years. Mr. Toale asked if there was anyone present who wished to speak for or against this application. Alan Cosimi, 24 Field Road, Leominster, and present owner of The Bootlegger, came forward and confirmed that he was staying on to consult and they are keeping everything the same. He stated he had faith that they would do a good job and keep the current systems in place. Discussion ensued on continuing the hearing and the common victualer license application. Ms. Lafleur offered to show the letter to the applicants during a brief recess. The applicants exited the meeting to review the letter sent to Mr. Dellogono. Mr. Toale reported the Conservation Commission members who filed Disclosures by Non-elected Municipal Employees of Financial Interest, were not yet prepared to present tonight, so this will be rescheduled to another meeting. Tax Classification Hearing Mr. Toale read aloud. "The Board of Selectmen will hold a public hearing on November 17, 2015 at 7:30 P.M. as required by M.G.L. Ch. 40 §56 on the issue of allocating the local property tax levy among the four ===PAGE 3=== classes of real and personal property for Fiscal Year 2016. The hearing will be held in the Town Hall, 2"d Floor, Joseph Bilotta Meeting Room, at 17 Main Street, Lunenburg, MA. Jamie Toale, Chairman Board of Selectmen." Rebecca Boucher, Associate Regional Assessor of Regional Resource Group, stated she was here to present the Assessors' recommendation to set a single tax rate to be applied to all classes of property in Lunenburg. The levy to be raised for fiscal year 2016 is $23,536,237.82. There is still some final data to be entered into the recap. The Board of Assessors has calculated the following tax rates needed to raise the tax levy: Residential, Commercial, Industrial and Personal Property at $19.62 per thousand. Values increased 3% in residential classes for single family homes, condominiums, and land; a positive sign of the real estate market's recovery. Commercial and industrial assessments did not show evidence of a market value increase. The average single family home value increased from $246,347 in fiscal year 2015 to $256,969 for fiscal year 2016 and the average tax bill increased by 11.7% from $4,513.08 in fiscal year 2015 to $5041.73 in fiscal year 2016. Of this $528.65 increase, 66% results from the debt repayment for the Lunenburg Middle/High School project, amounting to $349.48 on the average tax bill. Ms. Bertram asked if the entire school project debt is reflected in the tax rate increase now. Ms. Boucher stated this is for this year's payment of the debt; she has not seen the full schedule. Ms. Latleur reported the Town has one additional borrowing to do, sometime in January 2016, ranging between four and six million dollars. This will be the bulk of the project less what is being held in contingency. The contingency may not end up being spent. About 75% of the project is reflected in the fiscal year 2016 tax bills. Ms. Boucher stated that on the preliminary tax bills there was a percentage increase in addition to last year's taxes so that the increase will be spread out over the fiscal year. Motion: T. Alonzo 2"d: R. Ebersole To adopt the uniform tax rate as recommended by the Regional Assessors office Mr. Toale asked for any further comment. There was none. He closed the hearing. Vote: All in Favor Ms. Boucher thanked the Board and exited the meeting. Mr. Toale recognized Robert Bowen, who requested to be appointed to the Bylaw Review Committee. Mr. Bowen, 1686 Massachusetts Avenue, stated he was a former town official and former member of the Charter Review Commission as well as being a lawyer and was familiar with the process. The Moderator had asked him if he would volunteer on the committee and he stated he would. Discussion about Special Municipal Employee status for the Bylaw Review Committee members ensued. Mr. Bowen stated he is currently representing the Town in litigation and for that reason and others who could be represented by him in front of the Town, he would not be able to serve if the members of the Bylaw Review Committee were not designated as Special Municipal Employees. Motion: R. Ebersole To designate the Bylaw Review Committee as Special Municipal Employees 2": P. Bertram Vote: All in Favor Mr. Bowen will be appointed by the Town Moderator accordingly. Mr. Bowen stated he would look forward to hearing from Mr. Murphy. Change of Manager on Alcohol License for Ixtapa Cantina Attorney Nicholas Felici stated he represented Ixtapa Cantina and introduced proposed manager, Marco ronzalez and owner Jaime Brambila, Mr. Felici stated Mr. Camacho, the current manager, is moving on and M Jonzalez has been working as Assistant Manager for the past year. He also had restaurant experience whil living in Colorado and is TIPS certified. Motion: P. Bertram To approve Marco Gonzalez as Manager for the Ixtapa Cantina 2": T. Alonzo Vote: All in Favor The applicant thanked the Board and exited the meeting. The Board signed an accounts payable warrant in the amount of $338,946.13; school construction warrant for $2,976,960.20; payroll warrant in the amount of $722,184.63 and payroll deductions warrant in the amount of $152,581.81. The Board signed the minutes of October 20, 2015. ===PAGE 4=== Mr. Dellogono, Mr. Morrison and Mr. Cosimi returned to the meeting. Mr. Dellogono apologized stating he did receive the email with the attachment and had read it but did not see any urgency in replying to it. He was aware of the CORI but figured the notification was a formality. As Mr. Dellogono started to address the CORI report, Ms. Lafleur interrupted and stated the Board was not aware of the CORI results and if Mr. Dellogono wanted to speak about it, he would be waiving his rights to confidentiality. If he did, she would distribute it to the Board so they could review it. Mr. Dellogono stated he was fine with that. The Board members reviewed the CORI. Mr. Dellogono stated his OUI case has been open since 2012. He has legal representation from Fitchburg attorney Steve Panagiotis. Mr. Dellogono stated he did take a breathalyzer test and it read .08, but believes his case will be dismissed within 3 or 4 months due to faulty machinery readings. The details of the faulty breathalyzer machines have been documented and reported in The Fitchburg Sentinel and Enterprise. Five months ago he and Mr. Morrison were approved for a liquor license elsewhere and there was not an issue at that time so he did think this would be an issue. As far as his reputation at Destare for four years, there were not any incidents under his management and it is a rowdier crowd than at The Bootlegger. On this application, Sean Morrison is the manager on the alcohol license. He is a partner. Mr. Ebersole noted the Town's CORI Policy reads," Unless otherwise provided by law, a criminal record will not automatically disqualify an applicant. Rather, determinations of suitability based on CORI checks will be made consistent with this Policy and any applicable law or regulations." Mi: Alonzo noted some address discrepancies on the Certificate of Organization for Fifty Mass. Ave. LLC; under item #5, Sean Morrison's address is listed as 227 Lunenburg St. Fitchburg, MA 01462 ( the Lunenburg zip code), and on item #6 it lists the same and on #7, it lists the same address with the right address. On #8 it lists 227 Lunenburg St, Lunenburg, MA 01462. So there are three different addresses. Mr. Morrison stated his office is located at 227 Lunenburg St. Fitchburg, MA 01420. He added it was the law office that filed that paperwork. Mr. Alonzo suggested getting it corrected since it is a legal document. Mr. Ebersole stated he assumed for Mr. Dellogono this is a first offense and considering the discussion this evening, he was not opposed to granting this transfer. However he would like to be informed of the final findings of the pending case. Mr. Alonzo and Mr. Bertram stated the same. Mr. Toale agreed. Ms. Lafleur stated it was her understanding that Mi. Cosimi was pledging the license transfer application and if this was the case, it needs to be entered into the record. Mr. Cosimi stated he was not. Motion: R. Ebersole 2"': T. Alonzo To approve transfer of the all alcohol license from Cosimi Corp. to Fifty Mass Ave. LLC Vote: All in Favor Mr. Toale moved on to the Common Victualer License application. Motion: R. There was a presentation by Eric Short on his Master Teacher projects. He runs SAT prep courses in the fall and spring and he facilitates a student leadership course for students in grades 9- 12. One of their goals is to create a virtual tour of the new middle/high school. They are working with P.A.C.C. on this. The Lunenburg MART bus loop had 34 riders in September which is up from the past couple of months. The majority of riders were picked up at White Street, CVS, Emerald Place and Hannaford's. She has asked MART to look at the most used time frames because she is hoping to add a 6:00 p.m. route from the Boys and Girls Club up Mass. Ave. Use of the intermodal transfer option was discontinued due to no one using it. Ms. Bertram reported the November 9* Planning Board meeting had an ANR plan presented for 238 Fire Road 16. There were some access issues, so it was tabled pending more information. The public hearing on High Field Village was continued until December. The Planning Board continues to work on their bylaw updates, focusing on parking. The Conservation Commission met on the 4* and held a Determination of Applicability hearing for Sunset Lane. An update was provided by the Chair on the Disclosures of Conflict of Financial Interest. It was continued to tomorrow night's meeting. ===PAGE 5=== Mr. Alonzo reported the Finance Committee met last Thursday and held their public hearing on the upcoming Special Town Meeting. The Cable Advisory Committee will be meeting on the 30th . There is a town-wide questionnaire out and some are coming in. The School Building Committee met on Thursday. Construction is proceeding well. There are now two out of four buildings that are weatherproof and that will enhance finish work progress. The other buildings will be weather proof by the end of the month. There was a change order (#5) for auditorium grading and bollards installation at the main gas service entrance. Total change order is around $8200.00 bringing the running total of change orders to $170,000 out of the 4 million dollar contingency fund Mr. Ebersole reported the Board of Health held a workshop regarding the septic system repair loan program guidelines. They would like to get the program going forward in the spring of 2016. PACC has two vacancies on its committee. Sewer Commission continues to update its policies and regulations. Mr. Toale had no new reports for Building Reuse and Capital Planning. Ms. Lafleur reported she would be touring the new middle/high school project tomorrow at 3:00 p.m. and invited the Board members to join her. She stated she received drafts of the fiscal year 2015 financial audit today and will be reviewing it for errors and distributing these to the Board in the coming weeks. She thanked the Town Accountant/Finance Director and her team for their good work. We do expect to complete our tax rate recertification paperwork by the end of this week. She also planned to present the financial forecast on December 3'd and kicking off the budget process on December 7" Mr. Toale presented Rhonda Lisio's resignation letter effective November 3ª from P.A.C.C. and Cable Advisory Committee. Motion: R. Ebersole To approve the Common Victualer license for Fifty Mass Ave. LLC d/b/a The Bootlegger 2°°: T. Alonzo Vote: All in Favor Mr. Dellogono and Mr. Morrison thanked the Board and exited the meeting. Committee Reports: Ms. Luck reported the School Committee met on November 4* . Motion: T. Alonzo 2"°: R. Major Garrett stated although their office is in Fitchburg, they are eager to be active in the surrounding communities. The toy drive and tollbooth fundraiser benefits children and people in this community. They have noticed an increase in the applications for help during the holidays. They distributed over 300 Thanksgiving baskets, more than double from last year. She added they appreciate the opportunity to conduct the fundraiser in Lunenburg. Mr. MacDonald stated that all money collected stays in the community. Motion: T. Alonzo 2nd. P. Total of this change order is $8,203 with the contingency amount now at $3,999,659. Motion: T. Alonzo 2'°:R. Ebersole To authorize the Chair to sign the change order documents as presented Vote: All in Favor Ms. Calmes thanked the Board FERC Filing as Intervener (Pipeline Project) Ms. Lafleur reported she received notice from Congresswoman Tsongas' office recently relative to the forthcoming application filing by Kinder Morgan with FERC (Federal Energy Regulatory Commission). The application was filed on November 20" and started the 21 day clock on filing as intervener status. The deadline to file would be December 7". Interveners have the right to participate in hearings before FERC's administrative law judges, file briefs, file for rehearing of a Commission decision, have legal standing in a Court of Appeals if they challenge the Commission's final decision and be placed on a service list to receive copies of case-related Commission documents and filings by other interveners. Interveners have the responsibility to send any documents or communication to other interveners, FERC and Kinder Morgan. There are a number of agencies that are active in this process. The Attorney General commissioned a study on the need for increased gas capacity and the study found that under existing market conditions, there is no electric sector reliability deficiency through 2030 and that no additional gas pipeline gas capacity is needed to meet electric reliability needs. Ms. Lafleur encouraged the Board and others to go to the Attorney General's website to read the entire findings report. Ms. Lafleur reported a resident recommended the Town join the Northeast Municipal Coalition Against the Pipeline. Their mission statement reads as follows: Gathering knowledge and working collaboratively, this coalition of municipalities shall provide representation and information to relevant government bodies and the public concerning the Tennessee Gas Pipeline project proposed by Kinder-Morgan and its effect on our communities. The group meets on a periodic basis and the next meeting is on Monday in Lynnfield, She recommended the Town joining the group. She would be happy to attend the meetings if there is no board interest. Ms. Lafleur stated the Board would need to decide soon if they want to file as an intervener. Ms. Luck asked it there is a down side of being an intervener. Ms. Lafleur stated the cost of using legal counsel to prepare and file the petition is minimal but the expense of legal counsel following the process could add up. The Board discussed filing as an intervener and joining the coalition. The Board concurred that legal counsel could file for the Town but does not want them to review the docket on an on-going basis. The Board members will do this task themselves. Motion: R. Ebersole 2'd:T. Alonzo To file as an intervener to FERC and to join the Northeast Municipal Gas Pipeline Coalition Vote: All in Favor Ms. Lafleur will send out the agenda for the coalition's next meeting. The Board approved and signed the minutes of November 3, 2015. The Board signed an Accounts Payable warrant in the amount of $287,022.04, a payroll deductions warrant in the amount of $42,222.51 and a payroll warrant in the amount of $693,012.18. There were no action file issues this evening. Committee Reports Mr. Ebersole reported the Board of Health met last night and is continuing their septic system loan program workshop. Their goal is to have the program ready for the spring of 2016. Mr. Alonzo stated the School Building Committee meeting is next Wednesday; Finance Committee's next meeting is December 3 and they have scheduled the Five Year Financial Forecast from Town Manager Lafleur. Cable Advisory Committee met last night and reviewed completed questionnaires from town departments on their current and projected use of public access channels. He asked if it was possible to insert a cable survey in the tax bill mailing to inform about the online survey. Ms. Lafleur stated there is one page ===PAGE 3=== available for mailing. She was planning on sending an updated report on the school construction project but they don't have to do that. Ms. Lafleur stated the best way would be to send the survey out with the tax bills. Ms. Bertram reported the Conservation Commission met on November 18* and addressed some routine filings. There were two hearings where the applicants weren't present; one of those was tabled. Some abutters were present for the 155 Reservoir Road, lots 1- 9, hearing, however the applicant was under the impression his hearing was another night. The abutters were allowed to comment since they had waited all evening to do so. Although informed that the plans were available for viewing in the Conservation Commission office, they were not. The abutters' primary concern was the number of homes and the forestry plan. That hearing was continued to December 2nd . They also reviewed their regulations and bylaws and continue to do so. Ms. Luck did not attend the School Committee meeting but read aloud from the article in the Lunenburg Ledger. The committee discussed the health and wellness budget for fiscal year 2017 and the cost of operation and maintenance predicted for the new Middle/High School next year. Facilities Director John Londa met with the committee to discuss predicted costs of utilities at the new school. The committee meets again tomorrow evening. The Zoning Board of Appeals met on November 17" and approved a special permit for a dimensional variation for Darren Specht, 13l Elm Street, to install 84 ground mounted solar panels. The project goes to the Planning Board next. Mr. Toale reported Building Reuse Committee met on the 24*' of November and asked the architect who is finalizing the feasibility study to look at costs involved with their recommendations. They meet again on December 215 and will prepare a presentation to this Board for January 2016. Ms. Lafleur reminded her Five Year Financial Forecast will be presented Thursday to the Finance Committee. The meeting will be televised. Documents for the meeting will be available online. Capital Planning requests are due this Friday. On December 7" the fiscal year 2017 budget packets will be distributed to all departments and will be due on the 31$t Ms. Bertram added the MPO meetings for November and January were cancelled; the next meeting is in January 2016. The next meeting for the Board will be December 8'h. Motion: P. Bertram To adjourn the meeting at 7:50 p.m. 2": R. Ebersole Vote: All in Favor Respectfully submitted, cram Neteroen Elaine M. Ms. Bertram thanked everyone who attended the Girl Scout pancake breakfast this past Saturday. Everyone had a good time. Ms. Bertram attended the Senior Center Christmas Boutique last weekend and stated it was a great event as well. Ms. Luck reminded residents to rake the leaves off their storm drains in their neighborhoods in order for water to drain properly. She attended the COA meeting today, She encouraged seniors to check out the activities at Eagle House. The "Sand for Seniors" program is underway. She also mentioned the Senior Tax Work Off Program is still seeking applicants. Mr. Alonzo announced the Lunenburg family gift mart is open for the season. People can donate gifts or money and eligible applicants in need can shop for Christmas. Donations can be dropped off at any Lunenburg school building, the Boys and Girls Club, Public Library, New Outlooks, Cable Salon, Senior Center and the public safety building until December 10th • For more information, go to www.lunenburggiftmart.com Mr. Alonzo also mentioned the Boys & Girls Club Annual Fund Drive. This is the first year in its existence. Currently the club membership is at maximum capacity and not accepting any new members. There is a waiting list. Mr. Alonzo asked those who can to support the club and its work. He congratulated the Public Library on their ten year anniversary. Temporary License Request for 1134 Northfield Road Tanner Cole, 563 Massachusetts Avenue, presented his request for access to the Town's right of way in order for him to grade for the installation of a septic system at 1134 Northfield Road. The septic system must be installed in the front yard. There would be no structures in the right of way, just grading in order to meet Title V requirements. No trees or stone walls will affect the scenic road designation. Ms. Lafluer confirmed the Board can grant a temporary license but Town Meeting must grant any easement. She added we are waiting for some additional information for Town Counsel. DPW Director Rodriquenz reported he visited the site and there was a precedent set on Rolling Acres Road and Eastern Avenue for the same reason. He saw no detrimental effect to drainage on or off the road or for snow storage. He wanted to make sure the Town is indemnified from any potential future damage. Motion: P. Bertram 2^. P. Luck ===PAGE 2=== To approve the license with the stipulation that language be incorporated into the agreement that indemnifies the Town from any damage Mr. Toale pointed out the license could be approved but must be signed at a later date as it is not ready for this evening's meeting. Mr. Alonzo suggested Ms. Bertram amend her motion to say drafting the license. Ms. Bertram accepted the amendment. To approve drafting the license with the stipulation that language be incorporated into the agreement that indemnifies the Town from any damage during construction Vote: All in Favor Review of the Net Metering Agreement with Nexamp Ms. Lafleur reported the Board had authorized her to negotiate the net metering agreement for the project that was proposed to them. She presented an agreement for consideration and announced Kopelman and Paige Attorney Rick Holland was here to review the highlights of the agreement with the Board and address any questions. Mr. Holland stated this agreement is for twenty years and has an option to renew for two five-year terms based on both parties' agreement. The Town would be purchasing fifty percent of the net metering credits generated by the system. There is a minimum floor price of .08 cents. The overall value of each credit changes over time. There is a basic service charge that fluctuates with the market and there is a transmission/distribution charge. After reviewing the Unitil website regarding net metering credits, the anticipated rate that Unitil would charge the Town would be the small commercial rate. One good thing in the agreement is the Town is not required to pay for credits unless they show up on the invoices. The Town can elect where the credits should be applied. Mr. Alonzo asked what the Town's methods of termination are in the agreement. Mr. Holland stated in section 2.2 there are early termination provisions. Either party may terminate on the default of the other party, such as failure to pay for the credits, or (section 4.2) a change in applicable law or a governmental authority order that materially restricts Nexamp's ability to deliver Net Metering Credits to the Town; that materially restricts the Town's ability to receive or use Net Metering Credits; that disallows the Nexamp's qualification as a Private Facility under the Private Cap, or that occurs before Nexamp secures a Private Cap allocation. Mis. Bertram asked if the timelines have been specified. Attorney Holland stated it would be determined by section 2.2(c); the construction commencement deadline date is within 180 days from the date the agreement is signed; the mechanical completion date is within 270 days of the effective date. This does not mean it's commercially operable until the utility gives permission to commence operation. Ms. Bertram asked for confirmation that the Town could use the percentage that they are obligated to purchase. Ms. Lafluer stated the amount they are talking about would be equivalent to what the public safety building would use. The annual value of this is around $20,000 to $25,000. The annual expense just for municipal buildings outside of the school is around $140,000. Motion: R. Ebersole 2n%: P. Bertram To approve the net metering agreement between the Town and Fitchburg Solar, LLC effective on this Ms. Bertram noted on page 2 a reference is made to section 4.3 and there is no such section, it should be changed to section 4.2. The notation was made. CURRENT BUSINESS 1. 2016 License Renewals: Mr. Toale commended Executive Assistant Peterson for providing a comprehensive renewal package. Ms. Lafleur reported it is time for consideration of approval of business licenses for 2016. It is a very cumbersome process; involving varying requirements for different types of licenses. The process involves the Building Commissioner's office, Fire Department cooperation, and interactions with the Sewer Commission office and the Tax Collector's office. We only have four businesses who hold licenses that are not ready for renewal; one of them is not renewing due to retirement. We are continuing to work with them for the next meeting. Ms. Lafelur noted Ms. Peterson was very diligent in reviewing all of the requirements for renewal and ensuring licensees complied with them; one of which was that the license must be paid for at the time of renewal. All of these license fees have been paid which has not been the case in the past. All taxes, fees, anything that is owed to the Town through June 30, 2015 has been paid. Mr. Alonzo thanked the businesses for their cooperation and making the renewal process easier for all. Ms. Lafleur began with liquor license renewals. She read aloud the list of "doing business as." Vote: All in Favor Warrants/ Action File Issues The Board signed an Accounts Payable warrant in the amount of $376,237.80. Ms. Luck referred to a November 17" memo from School Superintendent Calmes to the Town Manager and the Chairman about budget revision requests/change orders for the Middle/High School construction project. She asked about Ms. Calmes' notation that the project manager stated the Board of Selectmen receives notification of the changes as an acknowledgment that funds were moved from one line item in the budget and not for approval. Is this correct? Ms. Lafleur stated she has requested Supt. Calmes to get clarification from the MSBA on what role the Board of Selectmen takes in that process. Ms. Luck also wanted to know how contingency funds can be expended and on what contingency funds can be used. Ms. Lafleur encouraged Ms. Luck to attend the School Building Committee meeting tomorrow night. One of the agenda items will be what the process is for contingency requests. She added the Town Meeting vote was to authorize the School Building Committee to expend the project budget. Discussion about contingency spending and possible expenditures ensued. Mr. Ebersole suggested holding a workshop with the Zoning Board of Appeals and the Building Commissioner relative to a prior ZBA decision allowing ground mounted solar panels close to property lines. Committee Reports: Ms. Luck reported the School Committee met on December 2n; the three school principals shared their budget requests. They are scheduled for a budget meeting with the Finance Committee this Thursday. Facilities Director Londa requested $228,000 for facilities improvement which included a used pickup truck. Heather Sroka and Wendy Bertram will be meeting with the Clerks and Secretaries Association to begin negotiations. LBA Is meeting tomorrow to consider an auto repair shop at 321 Electric Avenue Ms. Bertram reported Conservation Commission met on December 2'd' . There were several hearings scheduled that evening. When she arrived they were discussing 155 Reservoir Road, Lots 1-9, which had been rescheduled from November 18th " Abutters appeared with concerns about runoff and debris. All nine lots were approved with conditions. A violation order was issued on 101 Pleasant Street. Further investigation is required as work within the 100 foot buffer zone and a town easement is involved. It was suggested Conservation Commission do some public education about what is required for filing when working near wetlands. They continue to work on their regulations amendments outline for the Board. It was suggested to research a state law exemption that if more than 10% of the population are involved that it is a significant portion of the population and an exemption may not be necessary. ===PAGE 7=== Mr. Alonzo reported Town Manager presented her Five Year Financial Forecast to the Finance Committee last week. Finance Committee is meeting with the School Committee this Thursday. School Building Committee meets tomorrow. No report for Cable Advisory Committee. Mr. Ebersole reported PACC continues to work on their strategic plan as well as their business plan and budget for next year. Sewer Commission meets tonight. Mr. Toale reported Building Reuse will be reporting on the Building Feasibility Study in January. Capital Planning requests are due on the 11. Ms. Lafleur reported she attended the Northeast Municipal Pipeline Coalition meeting yesterday. There were about fifteen communities attending. Lunenburg will be hosting the next meeting at the Public Library on January 11** at 10:00 AM. The Attorney General issued a report on the pipeline project which basically says under any scenario increased gas capacity is not needed to meet the state's electric reliability needs. Kinder Morgan did file its official application. There are more detailed pipeline maps available but she is not sure who created them. There are 701 newly impacted property owners on the entire length of the pipeline that are not yet notified. For any change in the pipeline routes after the FERC approval, eminent domain taking of property is not an option for Kinder Morgan. The official docket number is CP16-21. A helpful website is notrackedgasinmass.org. She was impressed by the level of knowledge present at the meeting. DEP is taking the position that the permitting process goes through impacted local conservation commissions. There was a strong sense that municipalities should not cede that right to the state even due to the lengthy undertaking. Ms. Lafleur was unable to attend the Governor's announcement of his Act to Modernize Municipal Finance and Government. It is a lengthy bill to modernize the interactions between state and local government. More information will follow at a later date. Mr. Ebersole noted the Lunenburg Water District Commission is meeting tomorrow night to continue discussion on potential IMA with the Town of Lancaster and to hear a report from their engineers regarding that expansion.
