He filed one as a member of Hickory Hills Landowners Inc. and has a financial interest. He also filed for Conservation regulation revisions as his property abuts the lake and any revisions to the regulations could affect his residence. However if any regulations affect more than 10% of the population you don't have to file. He filed anyway as this has been past practice. The last form was for trail use. He is not a member of the Lunenburg Snow Riders Snowmobile Club but makes donations of money and time and attends some of their meetings. Ms. Luck thanked Mr. Pease for all his efforts for the Town and Town land. Motion: P. Bertram 2"d: T. Alonzo That the Board determines that there is no conflict and Mr. Pease may participate in administration and revision of the Conservation Commission regulations Vote: All in Favor Motion: P. Bertram 2'd: T. Alonzo That Mr. Pease may participate in matters involving Hickory Hills Lake while serving as a Conservation Commissioner Vote: All in Favor Mr. Ebersole recommended in the case of Mr. Pease coming before the Conservation Commission as a landowner that he recuse himself from any vote involving his property. Mr. Pease acknowledged this was appropriate and thanked the Board. August 22, 2016 Special Town Meeting Articles Review Ms. Lafleur presented details for an adjustment to the fiscal 2017 budget based on the final disposition of the state's budget. There is a net surplus in state revenue in the amount of $114,733. She requested increasing the school budget line by $36,740 because funding from a kindergarten grant has ended. Ms. Lafleur recommended placing the remaining $77,993 in the reserve fund until it can be transferred to the stabilization fund. ===PAGE 3=== Motion: P. Bertram To recommend approval of Article 1 2": T. Alonzo Vote: All in Favor Ms. Lafleur reported Article 2 is a request to fund the first year of the Laborer's International Union of North America, Public Employees Local Union 39 (DPW) agreement. Both negotiating parties have come to agreement and have ratified the contract. Changes to the agreement include a cost of living increase of 1.5% per year of the 3 year contract, an increase in clothing/uniform allowance of $350.00 per year, additional language in the contract beneficial to the employer including management rights, probationary period and conditions of employment. The estimated cost to fund the first year of the contract which is actually fiscal year 2016 is approximately $6,100. Funding has been placed in the salary reserve account. Motion: L. Alonzo P. Bertram To recommend approval of Article 2 2™: P. Bertram Vote: All in Favor Article 3 is a bargaining agreement request concerning the International Brotherhood of Police Officers Local 353, AFL-CIO. There is currently a tentative agreement with the union. Ms. Lafleur expected it would be ready for town meeting. Article 4 will have to be passed over due to a typographical error in the printed mailed warrant. It will be included on the next Town meeting warrant. Articles 5 and 6 concern rooftop solar projects on the new Middle/High School and DPW buildings. Article 5 is the power purchase and net metering credits agreement and article 6 is a PILOT agreement. The power purchase agreement is not 100% completed. The final draft is with the developer. Mr. Ebersole stated he still would like to see what the solar rooftop project would look like before voting. Article 7 authorizes the Board to enter into a 30 year agreement with Borrego Solar Systems, Inc. for purchase of power and associated net metering credits from privately owned solar photovoltaic facilities. The agreement is not completed yet. The only variables on the above three articles (5, 6, 7) will be the cost and escalation. Land Use Director Adam Burney presented on the Planning Board articles. Article 8 and 9 correct typographical errors. Article 10 - 14 revolve around the wording of Article 10. The Planning Board is looking to strike the Whalom Overlay District (WOD) from the zoning bylaw. This is the section of the protective bylaw that allowed for the creation of Emerald Place. Last fall there was an application for 22 units to be placed in the triangle across from the Town beach. This was a dense design and the Planning Board did not believe this was appropriate for that area and the abutting neighborhood. There was a dispute between the developer and the property owner and the application was withdrawn. The property owner considered going forward with a new project and asked for an interpretation letter from the Zoning Enforcement Officer which added additional information. The Planning Board in reviewing that letter and in discussing the WOD merits as it exists felt that it was in the Town's best interest to remove the bylaw as it lacked some specificity. As part of the public hearing on the zoning article and the discussion, the property owner felt aggrieved by having development rights taken away from him by the removal of the district. The Planning Board discussed creating a new WOD bylaw and working over the next few months to craft the district that would be more inclusive in the allowed uses and the mixture of uses with input from the residents of the area. There is some disagreement between the Planning Board and the Zoning Enforcement Officer as to the ramifications of the removal of the WOD. Mr. Burney has contacted Town Counsel for guidance but has not heard back to date. The issue at hand is that the Zoning Enforcement Officer feels that having one property owner being the only beneficiary of the development benefits of the removal of this bylaw may create a situation of "spot zoning". Mr. Burney did not agree. There is no current application so the Planning Board felt this was a good time to remove it and work on an alternative in time for annual town meeting. The subsequent zoning warrant articles are just a cleansing of the remainder of the protective bylaw and the zoning map of references to the Whalom Overlay District. Ms. Bertram stated it was important to get a ruling from Town Counsel before the Special Town Meeting in order to avoid a potential heated debate on town meeting floor. There is also a question on the density allowed in the overlay district as to how many units per acre are allowed Mr. Ebersole asked for clarification regarding the commercial land on Electric Avenue and if that land is under the special permit for Emerald Place. Mr. Burney stated the Emerald Place special permit was a compilation of ===PAGE 4=== parcels under common ownership that was approved as "site specific" and there was some unit calculation. The Emerald Place people were in to speak to the Building Commissioner and they have to reassess their density calculations. In the 2006 special permit there is language that reserves one acre of the 6 acre parcel on Electric Avenue for commercial use. 3.7 acres of that parcel are in the WOD, the remainder of that is zoned Residence A. 2.7 acres was used for density calculation for the Emerald Place development. That is protected under the special permit. Whether the WOD exists or not, there is an active special permit that remains valid as long as development proceeds in a reasonable manner. Mr. Burney believed Emerald Place made some internal decisions regarding the commercial parcel without recognizing the language in the 2006 special permit. He was not at their meeting with the Building Commissioner but his understanding was that Emerald Place needs to reassess what they have on paper and what the special permit says. They have several options which the Building Commissioner presented to them. Further discussion about spot zoning ensued. Ms. Lafleur stated several weeks ago Town Counsel had reviewed this article regarding the spot zoning question and he tended to agree with Mr. Burney and the Planning Board. She had recommended he pass his opinion on to the Building Commissioner. Motion: P. Bertram To recommend approval of Articles 8 & 9 2°°: T. Alonzo Vote: All in Favor Discussion ensued on how to proceed on the Whalom Overlay District articles before and during Special Town Meeting. The Board thanked Mr. Burney. Ms. Lafleur stated Article 15 authorizes a boundary line agreement with Elaine Mroz's Chestnut Street property and abutting town property, Marshall Park. The agreement is still being drafted but will be ready in time for town meeting Motion: P. Bertram 2'°: T. Alonzo To recommend approval of Article 15 Mr. Ebersole stated he would be speaking with the Town Moderator to move this article to follow article 3. Vote: All in Favor Article 16 requests the town authorize a 10% local match towards the purchase of an agricultural preservation restriction approved by MDAR for Lanni Orchards located at 292 Chase Road. The cost for the town will be $58,000. Motion: T. Alonzo To recommend approval of Article 16 2"d:P. Bertram Vote: All in Favor The Board decided to meet at 6:00 p.m. on August 22"° to wrap up any loose ends before the town meeting. Earth Removal Permit Renewals Ms. Lafleur reported all earth removal applications are complete, taxes are current and the Building Commissioner has inspected the sites. His report is attached to the permit applications. She read the permits submitted for renewal: #1 Ralph Montouri Construction Co.; 186 Massachusetts Avenue; 23.5 acres, #54 Powell Stone & Gravel Co, Inc.; 151 Leominster-Shirley Road; 11.36 acres, #32 Raymond A. Bertram To approve the earth removal permits as presented Mr. Ebersole stated he has forwarded articles regarding the Town of Uxbridge and their issues with gravel pits being filled with contaminated fill to the Land Use Director and the Town Manager. He encouraged the Board to include the process on how to close these pits when reviewing the bylaw for amendment. Vote: All in Favor Ms. Lafleur exited the meeting. Discussion of Town Manager Salary Range Mr. Toale stated the purpose of this discussion is for the posting for the Town Manager. He stated Ms. Lafleur's starting pay nine years ago was approximately $110,000 and is currently at $130,000 which includes her merit pay. Mr. Alonzo suggested starting at $110,000 and ending at $130,000. Mr. Toale stated he would be willing to go up to $140,000 to broaden the pool of candidates. Mr. Ebersole stated many job postings state salary is based on experience and qualifications. A point was made to advertise a certain range so those reading the posting would know whether they were actually interested in applying. Motion: P. Bertram 2nd: T. Alonzo To set the salary range for the Town Manager from $110,000 to $140,000 Vote: All in Favor Ms. Lafleur reentered the meeting. Request to Approve FY2016 Chapter 44, Section 33B Transfers This item was rescheduled for the August 23d meeting. Request Comcast Performance Information Cable Advisory Chair Alonzo requested permission to request performance information from Comcast due to the renewal of the cable license coming up in 2017. Motion: R. Ebersole To authorize Tom Alonzo to request performance information from Comcast 2': P. Bertram Vote: All in Favor Warrants/Action File Issues The Board signed the September 8, 2016 State Primary election warrants. They signed an accounts payable warrant in the amount of $45,589.07 and a payroll deductions warrant in the amount of $477,609.48. Action File Issues: Mr. Alonzo inquired about the status of the larger size pay as you throw trash bags. Ms. Lafleur stated she did have the prices; it just has not been presented yet. Committee Reports: Ms. Luck reported the School Committee has a goals workshop meeting tomorrow at the Middle/High School at 3:00 p.m. Ms. Luck attended a steering committee meeting earlier today of the Central MA Regional Stormwater Coalition. They are preparing for their annual meeting in Holden on September 20. They are surveying members on their needs. There will also be a workshop in Millbury in October. There was a presentation on PeopleGIS by Ken Flanders and an update on a $50,000 604B grant awarded to the Central Mass Regional Planning Commission that Central MA Regional Stormwater Coalition is participating in. ===PAGE 6=== There was discussion of a statewide stormwater coalition meeting on September 27 at the Worcester DEP office. Ms. Bertram reported Conservation Commission met last Wednesday. The Woodlands was seeking information on what they can and can't do to improve the shoreline and to provide lake access as well as kayak/canoe access. There was a proposed notice of field change for the Lunenburg High School turf field. This was approved by the commission. The rest of the evening focused on enforcement issues. The 101 Pleasant Street property Notice of Intent was denied at their previous meeting and fines had been set at $600 per day. The engineer for 101 Pleasant expressed dismay stating he was awaiting information from the Conservation Commission on the wetlands delineation plan he had submitted and he was not aware that they were going to take action. The engineer will have to resubmit another NOI. He indicated the property owner planned to remediate the 225 Pleasant Street town property. They are willing to do the work or pay a contractor that does the work. Ms. Bertram requested the enfgineer contact Ms. Lafleur and Land Use Director Burney. A remediation plan for the town property is due by August 17" • The town may need to request an extension. Ms. Lafleur reported Mr. Burney drafted a remediation plan for the town property. It was shared with the abutter's engineer. Due to vacations a meeting will not occur until the 22nd. • The remediation plan will need to be reviewed by Conservation before anything is started. Further discussion on what needs to be done next ensued Ms. Bertram reported at the MPO meeting the Summer Street project remained in the 2017-2018 TIP. She reported a recent Notice of Proposed Rulemaking (NPRM) from the U.S. Department of Transportation (US DOT) has the potential to significantly impact the MPO planning process for the region and its member communities. MRPC is writing a letter opposing this. Ms. Bertram reached out to MRPC Regional Planner Brian Doherty concerning the GIS stormwater tracking. MIKPC 1s looking tor teedback trom communities on this. Any input should be sent as soon as possible Mr. Alonzo reported Cable Advisory meets August 29"i . Finance Committee meets August 11" ". School Building Committee meets tomorrow at 6:30 p.m. Mr. Ebersole reported Sewer Commission is meeting tonight and discussing infiltration/inflow/reduction. They are in the last phases of calculating betterments from the recent sewer installation. Mr. Toale reported Building Reuse meets August 15'h '. No report for Capital Planning. There is no report from the Town Manager this evening. Mr. Toale announced the next meeting is August 16" which will not be televised. It is a brainstorming workshop with board and committee members on improving communication between boards and growing the volunteer base. Public Comment: Dave Rodgers, 82 Highland Street, commented on the proposed elimination of the Whalom overlay district and the legal opinion provided. He did not think there was enough time between now and Special Town meeting to figure out what is best for the town regarding Emerald Place. Ms. Lafleur stated the Planning Board has recently asked for a written opinion from town counsel on leasing versus ownership at Emerald Place. She added there was never any indication in the approval of that project that required it to be ownership occupied even though it was presented and intended that way. Further discussion ensued on what was remembered at the time. Motion: P. Bertram To adjourn the meeting 2nd. T. Alonzo Vote: All in Favor Respectfully submitted, Caine m Peterson Elaine M. Bilotta Meeting Room, Town Hall August 9, 2016 Members attending: Jamie Toale, Chairman; Robert Ebersole, Vice Chairman; Tom Alonzo, Clerk; Paula Bertram, Member, Phyllis Luck, Member and Town Manager Kerry Lafleur Others attending: Attorney Robert Bowen Attorney Bowen reported on the Unitil suit. Discovery has been completed. Unitil has filed a motion for summary judgment and divided their argument into four parts. The first states that contract and negligence claims are barred by existing case law. The second is that the Town cannot prove gross negligence claims because Unitil didn't owe a duty to keep the trees out of the roads. They maintain their duty is to provide reliable service and keep vegetation off the wires not the streets. Tree trimming is reasonable. Mr. Bowen believed motion for summary judgment was not appropriate because a jury is needed to determine if the damages are foresecable. Unitil's third point is that Lunenburg's damages are not recoverable due to another court case that held a municipality can't recover costs. Mr. Bowen stated he will argue the case should be overruled or limited to its facts. Unitil also argued that the Town can't recover under the Consumer Protection Act and can't prove damages were caused by Unitil. Lastly, Unitil argues the Town's property damage claims fail. Mr. Bowen stated he had to concede that they are correct as the damage to the Senior Center occurred when the pipes froze due to power loss. He added they have not addressed the loss of a generator. Mr. Bowen is preparing a response to the motion for summary judgment which must be filed by August 26". Documents will be filed and he expects a hearing sometime in mid/late October. He anticipates the court will enter partial summary judgment on the contract and negligence claims, but will allow some of the claims to go to trial. If they grant complete summary judgment, the Board will need to consider whether to appeal. Unitil has not responded to any discussion of a settlement. Discussion ensued about the possibility of having to pay back FEMA/MEMA and/or the insurance company if the Town receives restitution from Unitil. The Board thanked Mr. Bowen and he exited the meeting. Ms. Lafleur reported the police union had one additional request for an increase of private detail rates from $42.00 to the Sergeant's new over-time rate and they also requested a higher rate for strike details. General consensus was to not agree to that increase. The firefighter's union contract expires at the end of this fiscal year. They have requested to begin negotiations early. Performance reviews were discussed. It was decided not to do so. Ms. Lafleur reported she had met with the Public Employee Committee regarding health insurance coverage. Since the contract has expired, under the law the Town is operating under the existing agreement. The committee wanted to extend the agreement another three years. They also proposed eliminating Medicare Part B reimbursement for spouses and capping reimbursement for retirees at a fixed dollar amount. Discussion on employee and retiree health insurance benefits followed. The Board took no action. Motion: R. Ebersole 2nd: T. She introduced Mark Cappadona from Colonial Power. Ms. Lafleur stated the contract with Colonial Power is for three years for their consulting services. They assist in procuring power supply rates, maintain a website and provide customer service for any questions on the program. Mr. Cappadona added they also prepare an annual report for the state. Their consultant fee is .001 per kilowatt hour which is added on to the supply rate on the utility bill. Ms. Lafleur clarified that there are actually two agreements; one for the consulting services and the other for the twelve month supply (rate) contract. Motion: R. Ebersole To extend the Colonial contract as presented 2"d: T. Alonzo Vote: All in Favor Mr. Cappadona reported rates are historically low right now. But one problem that is coming next summer is capacity. We will be paying more due to that increasing need, actually doubling by then. The new rate is .09661 which runs through the November 2017 meter read. This is 7.46% lower than the contract that is ending. Motion: R. Ebersole znd. P. Bertram To approve the supply contract with ConEdison Solutions for one year Vote: All in Favor Mr. Cappadona thanked the Board and stated it has been a pleasure working with Ms. Lafleur over the last few years. 3. Execute Boundary Agreement - 64 Chestnut Street Ms. Lafleur reported at special town meeting the Board received authorization to execute the boundary agreement with the property owner at 64 Chestnut Street. The agreement was reviewed by both town counsel and the property owner's attorney. Both have agreed as to the form. The agreement recognizes the existing stone wall as the boundary in exchange for the property owner agreeing to a release of claim against the town. She presented two originals of each document. Motion: R. Ebersole 2'': T. Alonzo To approve and execute the boundary line and the release of claim agreements concerning 64 Chestnut Street Ms. Bertram asked for clarification on blank lines remaining in the agreement. Ms. Lafleur stated the "consideration paid of" line would be filled in with $1.00 and the "plan entitled" line is coming from the survey company hired by the Town as it is being modified for recording. It is not known what it will be called until it is received. It will allow the property owner to move forward on her sale of the property. Further discussion ensued on the plan. Vote: All in Favor Ms. Lafleur exited the meeting to have Town Clerk Herrick notarize the agreements. Elaine Mroz, 64 Chestnut Street and 3 Riley Road, stated she was as frustrated as the Board about the lack of promptness on this matter. Review Cost of larger-sized PAYT bags and consider offering Ms. Lafleur reported currently the town offers 15 or 33 gallon, 1.35 mil bags, for pay as you throw. Larger bags re available, a 40-42 gallon bag. i aised the price for bags since 2008. Spresengested increasing prices effective bans ay 2. 17, some the Town cost has increased. There is also opportunity to purchase a thicker (1.5 mil) 15 or 33 gallon bag that would cost more. If the town decided to use 40 gallon bags, 1.75 mil, Ms. Lafleur proposed charging $3.95 per bag. The current issue with larger bags is there would be increased disposal costs. Another issue could be weight and disposal of prohibited items. Bags are limited to a maximum of 30 pounds under the contract. The larger the bag the greater the potential for an over the limit bag. She suggested not implementing any changes until January 1, 2017 or later as we order bags twice per year. 7. Minutes/Warrants/Action File Issues Minutes of August 2, 2016 were approved. Ms. Lafleur thanked each member of the Board for the opportunity to serve adding it's been a lot of fun for her. Bilotta Meeting Room, Town Hall September 6, 2016 The Board of Selectmen met in the Lunenburg Town Hall, Joseph F. Bilotta Meeting Room, as scheduled with Jamie Toale, Chairman; Tom Alonzo, Clerk; Paula Bertram, Member, Phyllis Luck, Member Not present: Robert Ebersole, Vice Chairman The meeting opened at 7:00 P.M. with the Pledge of Allegiance. Mr. Toale announced the main agenda item this evening was to interview the two finalists for Interim Town Manager. Public Comment: Representative Stephan Hay stopped in to inform the Board that he did attend the Special Town Meeting and noted that the new school bullding is spectacular. He added the meeting was educational and informative as well as entertaining. Rep. Hay stated he had met with Ms. Lafleur and they had discussed a few issues. When the town hires an interim he would like to meet with that person to see what Lunenburg Precinct B's needs are. Mr. Toale thanked Rep. Hay, Mr. Toale reported the state primary election is this Thursday, September 8 and polls are open from 7:00 a.m. to 8:00 p.m. Interviews for Interim Town Manager Robert Markel of Charlestown, MA was the first candidate. Mr. Toale asked Mr. Markel to tell them about him and why he was interested in the interim position. Mr. Markel stated he has experience as a town manager and town administrator and is retired. He has been working as an interim in various communities since 2014. He hoped to bring some expertise to the town during the transition to a new town manager. Ms. Bertram asked how flexible his availability as interim would be. He stated he would be getting the job done in a timely way. His time would normally be 20 hours. He stated once you have done things for a long time you get better at them. He added with email and a cell phone he could get most of the job done. The Board asked questions about hours of work, his impressions of the town, budgeting process, community compact, challenges facing an interim manager, methods of communication, performance evaluations, and qualities of an effective town manager. The Board thanked him for coming in. A brief recess was taken. The next candidate was David Marciello. Mr. Marciello stated he was an attorney and a public administrator. He has a Bachelor's Degree in Political Science and a Master's Degree in Public Administration and a Juris Doctorate. He is also certified through the state as a procurement officer and holds numerous other certifications through the state along those lines. He applied for this job because it fits in exactly where he would like to be. He stated Rehoboth is similar in many ways to Lunenburg. Ms. Bertram asked Mr. Marciello about the collapsed dam he had dealt with in Rehoboth. He stated the dam had been partially maintained by the town due to lack of promised funding from the state but they never bonded their amount over a ten year period. The dam kept deteriorating overtime and the town did minor maintenance ===PAGE 2=== and the dam finally burst. He and the local representative went to the Governor and got funding in the amount of $525,000 to repair that dam and did all the maintenance on the other dams. Ms. Bertram asked about the DEP fining Rehoboth for constructing ball fields on a capped landfill. Was Mr. Marciello Town Administrator at the time the fields were constructed? Mr. Marciello stated he was not. Mr. Alonzo asked what are the qualities of a good town manager. Mr. Marciello stated a good manager listens. A good town manager takes all of the tenets of public administration; public participation, economy, efficiency, equality, and sustainability. He stated he comes from both sides; he is a public administrator but also a lawyer. Ms. Bertram asked about his budgeting approach. Mr. Marciello stated he starts early with "0" budgeting. It needs to be tweaked four or five times before you get the actual numbers. Ms. Luck asked about Marciello about how to ensure debt exclusion money for storm water management/improvements and pavement management is being used correctly and being on track and reporting. He stated there is filing for the MS04 to the state and certain protocol as to the filing. As for citizens' information, everyone involved would be on a white board with the progress/updates with round table discussions and updates as well as public meetings. Action plans would be placed on the website and press releases would be sent to local papers. Being a good manager involves bringing every stake holder to the table, being transparent and ensuring conversation and public participation. Further questions ensued regarding the budget process, capital purchases, bond ratings, management style, performance evaluations and documentation. Discussion occurred on salary expectations for the Interim Town Manager position. Mr. Marciello asked about the town's institutional knowledge, town counsel, and auditors. Mr. Toale stated the Board would consider the two candidates and make a decision tonight. They would then enter Executive Session and discuss negotiations. Mr. Marciello thanked the Board and exited the meeting. Facilities Director John Londa reported that Solect Energy received a letter on August 18 from Unitil stating they had received their application for interconnection but were not taking any action on it until after they complete the upgrade of the circuits that are have a current moratorium on them. Mr. Londa called John DiNapoli at Unitil and they don't intend to address any applications until the upgrade. This will impact the town and the Solect Energy installation. Unitil believes they would be done sometime in October and will be taking applications in order of being received. Suggestion was made to write to Unitil and request a timeline of the completion of the circuit upgrade. Mr. Londa stated he could draft a letter for the Board to send. Minutes/ Warrants/ Action File Issues Minutes of August 9, 16, 22, 23, 2016, were approved. An accounts payable warrant in the amount of $136,371.49, a payroll warrant in the amount of $822,812.72 and a payroll deductions warrant in the amount of $514,876.74 were signed. There were no action file issues. Mr. Alonzo wanted to thank both applicants for coming in tonight. They both handled their interviews very well. Discussion of both candidates and the process of hiring a Town Manager ensued. Motion: T. Alonzo 2°°:P. Luck To appoint David Marciello as Interim Town Manager contingent on successful negotiations Ms. Bertram stated she thought Mr. Marciello was qualified but believed Mr. Markel would be a better fit. She finds the task force interesting and is hoping to make a difference in the community. She is also the Chair of the Housing Authority. Motion: R. Ebersole To appoint Liz Murphy to the Green Community Task Force 2"': T. Alonzo Vote: All in Favor Minutes/ Warrants/Action File Issues Minutes of February 4, 2016, were approved. An accounts payable warrant in the amount of $279,708.70 and a single payroll warrant in the amount of $1678.54 were signed. Ms. Bertram requested meeting with the Lunenburg Historical Society in response to a letter sent from them regarding their parking space being affected by the sale of the former primary school building. She also noticed a survey for Chapter 90 funding that she wanted to ensure was completed. Ms. Bertram noted the Town has received a $5,400 grant from DEP through the Sustainable Materials Recovery Program. She requested a future agenda item be a discussion on Town Counsel response time. Committee Reports: Ms. Bertram reported the Planning Board examined site plan approval for an auto detailing shop at 8 Massachusetts Avenue. There was a public hearing to discuss stormwater management for development and associated site work of nine single family home lots on 155 Reservoir Road. There was a public hearing for a special permit for 274 Prospect Street for the proposed development of a 22 unit townhouse development. It was continued to October 24" Conservation Commission met on September 7*' and issued an emergency enforcement order to Hickory Hills landowners to remove sand on the beach which is being used as a boat loading/unloading area due to the boat ramp being closed. The engineer for the owner of 101 Pleasant Street presented a Notice of Intent that entails the construction of a temporary logging road, wetland restoration and installation of a culvert on a perennial ===PAGE 2=== stream. Conservation is looking for a timeline, bonding and review by DPW. Abutter Kinder Morgan is seeking details on the work that is going to be done. Hearing for Kabob-E-Licious Alcohol License #063600048 Mr. Toale opened the hearing and read the letter sent to Kabob-e-Licious, 165 Massachusetts Avenue regarding this hearing being held pursuant to G. L. c. 138, §23 to discuss failure to comply with service training requirements set forth in Section 1.19 of the License Regulations of the Lunenburg License Commission. Motion:T. Alonzo 2"°: R. Ebersole To open the public hearing for Kabob-e-licious Vote: Ms. Bertram-aye, Mr. Alonzo-aye, Mr. Ebersole- aye, Mr. Toale- aye Owner Tarrnum Williams was sworn in by Mr. Marciello. Mr. Toale stated the hearing concerned two issues; failure to provide service training records and lack of response to the request. Ms. Williams stated her certification was valid the entire time however she lost the document stating she was certified. She stated she did provide the paperwork to Executive Assistant Peterson. She apologized for the lack of response because she purchased another business in Provincetown and was busy with that. She stated she has one other person at Kabob-e-licious that is TIPS certified and noted that her certification never lapsed either. She stated she never realized it was not forwarded here. She is waiting for it to come in the mail. Mr. Toale noted that several phone calls were made as well as certified mail that was not picked up, messages were left and no calls were returned and the voice mail box at the business was full. Mr. Ebersole asked if this office had current contact information. Ms. Williams stated it remains the same. Ms. Williams stated she was going to be very diligent moving forward Ms. Bertram stated an email was sent to Ms. Williams requesting her to provide staff TIPS training records. Ms. Williams stated the person was working somewhere else, left there and the owner had discarded their TIPS card. They have requested another copy of it and Ms. Williams should have it by the end of next week. Mr. Alonzo stated the Board takes liquor licenses very seriously so not withstanding why you didn't get it to us right away, six months is six months.TIPS certification is critical to the program and it is your responsibility to keep that up to date. Ms. Williams stated she will make sure she stays on top of it. Mr. Toale added the Board had previously discussed license fees and tries to keep them relative to the cost to the Town to administer. If we have to chase someone with several registered letters, phone calls and messages to get something as simple as a TIPS card, that increases the cost to administer it and would increase the cost of licensing in the future. Ms. Williams stated she would not want additional cost added due to her failure to respond to the Board. She apologized and stated she will make sure it doesn't happen again. Ms. Bertram stated it appears the certified letters were returned and letters were resent using regular mail. Why did you not pick them up? Ms. Williams stated if the mail comes to the restaurant and no one is there, it is returned. She did not get them herself because she was not around. Ms. Bertram stated her concern was if she wasn't there there to pick them up, wouldn't your staff notify you that there was certifed mail to to pick up at the post office? Ms. Bertram expressed additional concern that if you are opening another business and you are not responding to the notifications in Lunenburg, are you adequately managing the business in Lunenburg? Ms. Williams stated the only explanation she has is she has been out of town and not able to get them. They were returned by the time she went to the post office. Mr. Ebersole stated although the business address is correct, the address is ineffective to get notification to you. He stated Ms. Williams needs to have a process by which mail is collected so we can communicate with you. Ms. Williams gave her deepest apologies to the Board, Town and Staff. She stated she will make sure correspondence is immediately attended to in the future. Mr. Toale closed the hearing as there was no further comment. Motion: R. Ebersole 2'': T. Alonzo That there was a violation for failure to provide server training certification for staff at Kabob-e-licious Ms. Williams stated currently it is only her and one other person. The other person is certified but Ms. Williams is the only one who is serving alcohol. The Board does have her certification, would that be considered a violation? Mr. Ebersole read aloud the regulation; Licensees shall provide a current list of employees and shall have it available at all time... A written description of such program, along with a written policy outlining the employees responsibilities and the disciplinary measures which will be taken against any employee for violating ===PAGE 3=== said policy, shall be provided to the Authority as part of the renewal application and maintained on the premises at all times... Ms. Williams maintained the person whose certification you do not have has been certified all along, you just do not have it. Mr. Ebersole clarified that this Board not having that certificate on file is a violation. Vote: All in Favor Motion: R. Ebersole 2"°: T. Alonzo That Ms. Williams provide the server listing and certification documentation by October 13". Vote: All in Favor Mr. Toale stated a letter would be sent to her but noted she had one month to provide the requested documents. Ms. Williams thanked the Board and exited the meeting. CURRENT BUSINESS Appointment of Interim Town Manager Mr. Toale reported this appointment was made last week subject to negotiations. He referred the Board to the employment agreement draft in their packet. He noted the addition of weekly compensation and that item #7 that provided benefits has been removed. Mr. Marciello needs to be recertified as a certified procurement officer. If he were to do that it would require him taking some retraining. There are three (three day) courses that he would need to take, amounting to $1885.00 and they are offered through the Inspector General's office and occur in Boston. This would be a potential expense in the future, if needed. The appointment is for three months and can be renewed for another three months according to the Charter. Motion: R. Ebersole 2^°. P. Bertram To approve the employment agreement with David Marciello and The Town of Lunenburg; compensation is $2050.00 per week, commencing on September 12' for three months with the option to renew for another three months Vote: All in Favor Mr. Marciello thanked the Board. Building Reuse Committee Update Mr. Toale noted committee members present this evening were David MacDonald, Mark Erickson, Damon McQuaid and himself. He called their meeting to order. Town meeting had approved $10,000 for the committee to obtain a market analysis on properties other than T.C. Passios to see if we could generate revenue to convert the T.C. Passios into a Town Hall. It was put out to bid and received four responses. Two gave presentations and the amounts presented was higher that what was appropriated; one was $12,500 and the other was $20,000- $25,000. At their last meeting they discussed putting the unused properties on the market. They have also had one individual come forward with a master plan for town center where these properties would be used to form a downtown-type setting that would include a town hall. This is just an update and at this point in time the committee doesn't believe they should go forward with the market analysis. They do have two other alternatives that they would like to pursue. Dave MacDonald stated they do intend to put these properties on the market to see what they are valued at. Ms. Bertram requested clarification on putting the properties on the market versus finding out a value of the property because she believed town meeting vote is needed to sell municipal property. Mr. Toale stated that is the intent; to find the value of the properties. Discussion about procurement ensued. The Building Reuse Committee adjourned their meeting. Update on 225 Pleasant Street Land Use Director Adam Burney provided an update on the enforcement order on town property located at 225 Pleasant Street. Last time he was before this Board they had approved a scope of services and decided to seek quotes from engineers and contractors to do the remediation work. Mr. Burney was contacted within 48 hours after that meeting by the alleged violator's representative, Mr. Rowe from Whitman and Bingham. The alleged violator had decided he was willing to do the reclamation work on the town property. Mr. Burney informed him that the Board was not going that way but would be happy to let him pay for it. Two weeks ago Mr. Burney, ===PAGE 4=== Mr. Rowe, Conservation Chair Bursch, Conservation Administrator Marro and three contractors met on the site. They discussed the restoration work that was expected from the town. They are supposed to return quotes this week to Whitman and Bingham. Ms. Bertram expressed concern about the deadline for the enforcement order. She requested Mr. Burney submit an outline of what he just reported to this Board to the Conservation Commission at their next meeting on the 21st . He agreed. Discussion turned to who is responsible for the various town properties. It was decided to discuss further at a future meeting. Devens Regional Hazardous Household Waste Agreement; Amendment #5- Town of Pepperell Motion: R. Ebersole 2"°: P. Request to Approve FY2016, Chapter 44, §33B transfers (cont.) The Board reviewed the end of year transfer requests. There was some discussion regarding the top two items as they did not specify funding going to Lanni Orchards. The rest of the transfers address the union clerical sick leave buyout for certain employees. Mr. Marciello will check with Accountant Brochu for clarification. Motion: R. Ebersole 2nd: T. Alonzo To approve the September 8"" request for Chapter 44, section 33B transfers as presented Vote: All in Favor (Post meeting note: The top line of the transfer form was a portion of the Lanni Orchards APR. PUBLIC COMMENT There was none this evening. CURRENT BUSINESS Legal Counsel Response Time The Board discussed occasions that their legal counsel, KP Law, has been slow to respond to ongoing issues when they were time sensitive. Review of traffic rules and regulations has taken over a year, The point was made that even though they have several specialty lawyers, what good is it if the response is not timely? It was suggested to get requests for proposals for general counsel from other firms. The Board requested an update on where KP Law is with the ongoing cases they are handling. Peddler's License -Nicole Richard d/b/a Solar City Ms. Richard presented to request a peddler's license for selling Solar City. She stated she started working for Solar City about two months ago. Pay As You Throw (PAYT) trash bags Mr. Toale noted this was a continuation of a previous discussion. Mr. Alonzo stated he was in favor of a larger bag for bulkier items that wouldn't fit into the smaller size. Ms. Luck was concerned that with a bigger bag the weight limit of thirty pounds would be exceeded. Suggestion was made to have "not to exceed thirty pounds" on the bags. Another suggestion was to track how many bags are not picked up due to exceeding the weight limit. The Board will continue this discussion before January. ===PAGE 2=== Minutes/ Warrants/Action File Issues There were no minutes for approval this evening. The Board approved an accounts payable warrant in the amount of $139,560.40, a payroll warrant in the amount of $747,772.16 and a payroll deductions warrant in the amount of $153,094.02. Mr. Marciello reported Unitil has lifted the moratorium on the two circuits and are now taking applications for solar installations in the order they were received. Mr. Toale read the draft letter, composed by Facilities Director Londa, aloud "The purpose of this letter is to request an update on the progress of upgrading the two circuits that serve the Town of Lunenburg that have had a moratorium for interconnection of distributed generation. We appreciate Unitil making this a priority so that Lunenburg citizens will be able to connect their home solar projects as well as the two Town projects with Solect Energy Development, Inc. With the changes coming to solar incentives, it is important for the Town of Lunenburg to bring its projects to closure this calendar year to take advantage of these favorable incentives. This update will allow us to keep the Lunenburg citizens that are considering solar projects advised of the expected completion of this work. The two Town projects will continue to be advanced as much as possible in the interim. They do need completed interconnection agreements in order to be added to the Massachusetts System of Assurances for Net Metering Eligibility System (Mass ACA). Any assistance that you can provide to Solect Energy Development on our behalf to complete the applications would be greatly appreciated." Motion: T. Alonzo To accept this letter to Unitil and authorize the Chair to sign it on behalf of the Board 2^: R. Ebersole Vote: All in Favor Committee Reports: Ms. Luck attended the MART meeting on August 30*h . The main discussion was on the memorandum of understanding sent to all Councils on Aging regarding the use of MART vans, reporting and insurance. MART is requesting the Towns to take over the insurance for their MART vans due to the increase of accidents and MART's insurance rates increasing. Ms. Luck noted a large attendance of communities due to MIIA stating they would not want to carry the vans under their policy. There is a follow up meeting at MARI on September 22"d that she, Nancy Forest, COA Director Doherty and Mr. Marciello will be attending. The School Committee met on August 24" and September 7h. '. They have established a Lifelong Learning Advisory Commission and want to develop an Adult Education program at the new Middle/High School. They will present a report in May 2017. The Superintendent is researching adding another preschool section to the existing program. She is also looking at adding another kindergarten class due to 25-26 students being in the existing class. William Lasko presented on behalf of the Lunenburg Historical Society about concerns they have regarding the municipal building reuse project. Mr. Toale had visited the society at one of their meetings and inquired if there was any preliminary interest in moving to Town Hall or the Ritter Building once they were vacated. The Board took the request under advisement and thanked the society members for coming in this evening. 72 Leominster Road (gas connection) DPW Director Rodriquenz reminded the Board the Town has finished pavement on Lancaster Avenue, all of Leominster Road as well as the Hickory Hills area roads. He stated a new resident wanted to tie into the gas line on the far side of Leominster Road. Mr. Rodriquenz has denied the request for road opening because of the newly paved road. Mr. Tocci stated he just moved here in June and didn't intend to be introduced to the Town this way. He stated after inspections they found their furnace is from the 1930's and needs replacement. He stated they did consider propane but it is not as efficient and he doesn't want to go through the trench process again in five years as they just had a sewer line put in. Ms. Luck asked if they could install the pipe now and wait for three to five years to be hooked up. Mr. Tocci stated that was up to National Grid. He has already provided a $4850.00 payment to them. He thanked the Board for hearing him out. Discussion ensued on opening the road and other alternatives to heating with gas. Mr. Toale reminded those viewing that if they have any future installations coming up to do so before their road is paved Motion: T. Alonzo 2': P. The program provides for a variety of infrastructure improvement projects related to multi-modal accomodation, such as roadways, sidewalks, bike lanes, ADA compliance, traffic safety inprovements, sign replacements, multi-use paths etc. Complete Streets is one component of the Community Compact. Complete Streets recognizes that all modes of transportation are important. There is a three tier system. Tier One would be the Town adopting a Complete Streets Policy and submitting it to MA DOT. Tier Two involves submitting a Prioritazation Plan. This should include a minimum of fifteen projects over a five year period. Technical assistance up to $50,000 is available by completing the required documentation. Tier Three provides Project Funding for Construction via an application process based on statuatory requirements. Only six communities have been awarded construction funding out of the available $12.5 million to date. Mr. Benevento stated this is good opportunity to get some transportation infrastructure projects completed. He presented a draft Complete Streets policy and a list of eligible types of projects. Mr. Marciello stated he anticipated the plan being returned this week. The Board requested to have the easement for the next meeting. The easement will be signed by the Board and then recorded. Mr. Cole thanked the Board and exited the meeting. Disclosure of Non-Elected Municipal Employee of Financial Interest Interim Town Manager Marciello reported he had filed a disclosure because there is a slight chance his brother- in-law, who owns/works for an environmental company and could possibly do some work in town. He stated if his brother-in-law is hired to do work in the town for a client, his sister would financially benefit. ===PAGE 3=== Motion: R. Ebersole 2"d: T. Ms. Luck informed that the School Committee would be discussing the charter school question and suggested Mr. Marciello should speak to the School Superintendent or the Chairman in advance of their meeting. Mr. Alonzo clarified that he was not lobbying for any particular view but thought people should be informed. Motion: R. Ebersole 2: T. Alonzo Vote: Ms. Luck-aye, Mr. Alonzo-aye, Mr. Ebersole-aye, Mr. Toale-aye Mr. Toale reported the Police Union and Town Manager Lafleur had met regarding the IBPO contract without legal counsel present and came up with a Memorandum of Agreement. The last remaining item to resolve was the detail rate and a special strike detail rate. Since that meeting the union has agreed that they did not need the strike detail rate. The union believes the current detail rate is lower than the standard. The Town detail rate and private detail rates are different. Currently the Town pays time and a half of the officer's normal hourly pay. Private details are currently charged $42 per hour. The union would like to charge the Sergeant overtime rate (currently $54 per hour) so that they don't have to keep coming back and renegotiate a set rate. The question was asked if DPW hires a private contractor and the contractor pays the detail rate, does the Town rate still apply? It was suggested to keep the town rate at time and a half. Mr. Ebersole spoke on behalf of Ms. Bertram who was against an increase as it might have a negative effect on businesses. Motion: R. Ebersole 2"°: T. Alonzo To propose the Town detail rate remains at time and a half and private details at the overtime rate of sergeant Ms. Luck expressed concern of increasing rates right before the Town begins its pavement management projects.
