The Pledge of Allegiance was recited. Chair Jeffreys noted that it was being recorded and broadcast live on Lunenburg Public Access Channel, Facebook Live, and would be uploaded to the Lunenburg Access YouTube channel. BOARD COMMENTS Member Emkey thanked the DPW for their work during the recent double storm, noting she had no problems getting around at 5 AM. She also acknowledged National Law Enforcement Day and extended appreciation to those in law enforcement. Member Alonzo echoed the thanks to the DPW and their Director Bill Bernard for their excellent work. He reminded people of the Water District meeting the following day at 6 PM, encouraging eligible voters to attend. Vice Chair Franco announced the cancellation of the pancake breakfast at the Lunenburg Adult Activity Center due to weather. He provided details about upcoming Master Plan meetings on February 1st at the Adult Activity Center, with sessions from 4-6 PM and 6:30-8:30 PM. Member Franco emphasized the importance of senior participation in the surveys, noting their underrepresentation in responses so far. Chair Jeffreys inquired about accessing the survey for those not on Facebook. Town Manager Lemieux clarified it was available on the town website, with a printable version to be added. Chair Jeffreys announced that due to the weather, the Town Manager was participating remotely. He also noted that Selectman Nuzzolo was unable to attend due to military training. Town Manager Lemieux stated that if weather impacted the opening of town offices and the Adult Activity Center the following day, a notice would be posted. COMMUNICATIONS FROM OTHER BOARDS Chair Jeffreys discussed a request from the School Committee regarding guidance on utility costs for the next fiscal year, given the upcoming expiration of the municipal aggregation for ===PAGE 2=== Page 2 of 4 Select Board Meeting Minutes January 9, 2024 electricity in November. Town Manager Lemieux explained that they would need to consult with their broker but expected to go out to bid in the spring, noting that predicting rates might be challenging given market conditions. APPOINTMENTS Ratification of the Town Manager's Appointment of Facilities Superintendent Don Gagne Town Manager Lemieux requested the board ratify the appointment of Don Gagne as Facilities Superintendent. She provided background on Gagne's work history with the town since 2021 and his performance during interim periods. Lemieux noted that after a thorough search process, Gagne was selected for the permanent position. Board members expressed support for promoting from within and acknowledged Gagne's experience. Chair Jeffreys moved to ratify the Town Manager's appointment of Don Gagne as Facilities Superintendent. Selectman Alonzo seconded the motion. Roll call vote: Member Alonzo, aye; Member Emkey, Aye; Vice Chair Franco, aye; Chair Jeffreys, aye. The motion passed unanimously (4-0-0). Town Manager Lemieux confirmed Gagne's official start date in the new role would be that week. CURRENT BUSINESS Response to Resident George Burden regarding complaints and request for financial audit Chair Jeffreys introduced the topic, explaining that resident George Burden had sent numerous complaints and requests, including a request for a financial audit of the police department. Jeffreys noted he had invited Burden and his associate, Jen, to meet with the board for an official response, but the invitation was declined. A follow-up communication was sent encouraging them to attend, but it was also declined. Jeffreys summarized the nature of Mr. Burden's complaints, which primarily related to living in a condo association and issues with neighbors, snow removal, gun use, police response, and interactions with town officials. A significant portion of these complaints are civil matters between the resident and the condo association, involving disputes related to the rights and responsibilities within that setup. Jeffreys emphasized that these issues fell outside the town's jurisdiction, particularly as they pertain to the condo's rules and regulations. The volume of communications from Mr. Burden has been substantial, with over 500 emails in the past calendar year alone. This prompted a discussion among board members about how to efficiently handle this situation while ensuring that staff time is not unduly consumed. Board members suggested limiting the time staff spent responding to Burden's communications and referring the resident back to the board for specific matters that require more in-depth discussion. Vice Chair Franco underscored the challenge of responding to such a high volume of correspondence, reiterating that the nature of many of Burden’s grievances was unclear and resulted in a significant expenditure of town resources. Member Alonzo expressed a preference for brief and direct responses from staff until Burden addressed previous questions posed by the Town Manager. Regarding the request for a financial audit of the police department, the board unanimously agreed to deny this request, noting Chair Jeffreys’ explanation that the basis for the request appeared to be unsubstantiated claims of embezzlement involving Burden’s condo association and police department officials. Chair Jeffreys stressed that no evidence supported these allegations, and without probable cause, the board saw no need to pursue an audit. Town Manager Lemieux confirmed she understood the guidance to continue providing clear, succinct responses. ===PAGE 3=== Page 3 of 4 Select Board Meeting Minutes January 9, 2024 Class II Auto Dealer License Renewal for The Auto Barn, 53 Chase Road Member Alonzo noted that Mr. Baker, the business owner, has been a long-standing member of the community, being involved professionally and privately with the town for many years. In support of the motion, Alonzo highlighted Mr. Baker's reputable history and contributions to the town. Chair Jeffreys asked if there were any additional discussions regarding the renewal, emphasizing the longstanding business relationship between The Auto Barn and the town of Lunenburg, spanning approximately 30 or more years. All documents related to the renewal had been submitted, ensuring that everything was in order. Member Alonzo moved to approve the Class II Auto Dealer License renewal for Baker Enterprises d/b/a The Auto Barn at 53 Chase Road. Lou Franco seconded the motion. Roll call vote: Member Alonzo, aye; Member Emkey, Aye; Vice Chair Franco, aye; Chair Jeffreys, aye. The motion passed unanimously (4-0-0). Committee Reports: School Committee: Member Emkey reported on the recent School Committee meeting, discussing the fiscal year 2025 budget challenges, including the loss of ESSER funds and increased health insurance costs. She noted that the superintendent presented a potential reduction of 28 positions across all schools and the central office, highlighting the significant impact of health insurance costs expected to rise by 8 to 10%. Member Emkey acknowledged the proactive transparency of the School Committee, which has been addressing these budget concerns since the issue became apparent, through both committee meetings and newsletters from the superintendent. Additionally, the need for community engagement was emphasized, particularly with the anticipated staff cuts resulting from these financial constraints. The next school committee meeting was scheduled to further explore the fiscal year 2025 budget, providing an opportunity for the public to gain a detailed understanding and offer feedback. Stormwater Task Force: Member Emkey provided an update, where Tim Wilsmer from the planning board was elected as chair. The meeting included a presentation by the DPW Director, Bill Bernard, on the current efforts and expenditure pertaining to drainage and stormwater issues. Member Emkey mentioned plans to explore the feasibility of establishing a stormwater utility, ===PAGE 4=== Page 4 of 4 Select Board Meeting Minutes January 9, 2024 noting that expertise from Chelmsford would be sought for insights on implementation. Monthly meetings are scheduled, with the next one set for January 18th. Selectman Franco offered insights from the Master Plan Steering Committee meeting held on January 4th. The primary focus was on boosting responses to the new round of surveys, due by January 25th. Franco detailed the scheduling of public sessions on February 1st at the Lunenburg Adult Activity Center, noting that these meetings aim to foster broader community discussions. He highlighted the importance of participation from the senior community, which is underrepresented in survey responses despite constituting about 30% of the town's population. These meetings are open to the entire public and intended to ensure the master plan reflects a comprehensive cross-section of the community’s input. Upcoming Meeting/Events Schedule The next Select Board meeting will be on January 16th and 23rd. Mr. Toohill stated that 51 Parmenter Road is not being used for that purpose, but it has direct access to the lake. Mr. Toohill said that the parcels are Town-owned and the Open Space Committee has formally recommended that the two parcels be transferred to the Parks Commission. Parks Commission Chair Ana Lockwood called the Parks Commission meeting to order at 7:31 PM. Parks Commission Chair Lockwood informed attendees that the meeting was being recorded and broadcast live and would be uploaded to YouTube after the meeting. She explained that the agenda listed topics that may be discussed, but not all items may be addressed, and other items not listed could be brought up as permitted by open meeting law. Members Present: Chair Ana Lockwood, Commissioner Christopher Sullivan, Commissioner Colleen Shapiro, Commissioner Anita Schiepers, Commissioner Karin Menard Parks Commission Chair Lockwood stated that the parcels have been in discussion since 2019. She stated that Stump Cove was a parcel given to the Town in the late 1980s with a stipulation that required public access because the State agreed to fund the rebuilt dam for Lake Shirley. She stated that the request is to create more formal access for Town residents to access Lake Shirley and to transfer care and control to the Parks Commission. She said that the current use of the 51 Parmenter Road parcel is not being used safely or environmentally, due to erosion. She said that 0 Shirley Reservoir Lake parcel is being used by residents for canoe/kayak launch access, but it is not officially defined with the current use. She noted that parking is not well defined on the side of Reservoir Road. She said that the parcel could be improved to include parking and a picnic area eventually. She stated that if approved, the Parks Commission would formulate a plan for the development and usage of the parcels. Chair Jeffreys stated to that the public already has access to the lake because it is Town owned, under the care and control of the Select Board. Chair Jeffreys asked her why the Parks ===PAGE 4=== Page 4 of 10 Select Board Meeting Minutes January 16, 2024 Commission is requesting a transfer of ownership. Ms. Lockwood stated that the Parks Commission, is better equipped to maintain the parcels. Member Emkey asked about the name of Stump Cove and the tax title search. Mr. Toohill stated that a light tax title search occurred, and the parcel was a part of a tax taking in 1957 and 1974 when the property was foreclosed on. Mr. Toohill stated that in 1957 and 1974 when the property was foreclosed on, the deed was not recorded with the parcels that were underwater or not. Member Emkey asked if there has been community outreach with abutters regarding the Parks Commission proposal. Mr. Toohill stated that several ad hoc meetings occurred with abutters. Member Alonzo asked about the acreage of the parcels. Town Manager Lemieux stated that 51 Parmenter Road has an encroachment occurring; she said that the Town is aware and is handling it. Vice-Chair Lou Franco asked Ms. Lockwood if Lunenburg residents would only be allowed to access the parcels if development occurred. Ms. Lockwood stated that she does not know the answer to that question. Chair Jeffreys stated that the Parks Commission and the Select Board may need to meet for an additional meeting for discussion. Chair Jeffreys stated that the Board will need to review the agreement the Town entered into with the State. Chair Jeffreys stated that GIS visualization may be necessary for the parcels. Chair Jeffreys asked if the Parks Commission has considered ADA accessibility. Ms. Lockwood stated that the Parks Commission does not have the care and ownership of the property and is not able to make design or future considerations for the property. Chair Jeffreys stated that the Board received a letter signed by several residents on Parmenter Road, Round Road, and Ruth Street who are against the transfer of ownership. Ms. Lockwood said that the State required the Town to provide public access 35 years ago, and she said the Town has not provided access. Chair Jeffreys stated that the public is utilizing the lake access. Member Alonzo stated that the Parks Commission doesn’t need care and control of a parcel to make plans for the property. Member Alonzo stated that the Board could provide authorization for the Parks Commission to explore options for the parcel. Town Manager Lemieux agreed with Member Alonzo’s sentiments. Chair Jeffreys stated that the Board received a letter from residents and a letter from Virginia Wolfram stating their support of the parcels to continue to be under the care and control of the Select Board Public Comment John Dombrowski, stated that he is representing Virginia Wolfram, 251 Parmenter Road: He stated that the roads are narrow and would make boat launch access and parking impossible. He said he believes there are ADA compliance issues due to the slope of the bank. He said that there is a potential housing development across the street from the Parmenter Road parcel, and he is concerned about stormwater issues due to the development. ===PAGE 5=== Page 5 of 10 Select Board Meeting Minutes January 16, 2024 Michael Lovelow, 579 Reservoir Road: stated that he is against the transfer of ownership to the Parks Commission. Mr. Lovelow said that he believes the parcels are not suitable for development for a boat ramp. Gerry Brown, 5 Johnson Street: stated that he is a direct abutter to the Parmenter Road parcel, and he agrees with what Mr. Dombrowski stated in his public comment. Gary Spence, 7 Ruth Street (Via Zoom): stated that he lives across from the Parmenter Road parcel and is in opposition to the transfer of ownership to the Parks Commission. Mr. Spence stated that Lake Shirley Improvement Corporation is the entity that maintains the lake, and homeowners pay to maintain the lake. Mr. Spence stated that if the Town was willing to pay to maintain the lake, he would be more receptive to this transfer of ownership. Virginia Wolfram, 251 Parmenter Road: stated that she is a direct abutter to the Parmenter Road parcel. Ms. Wolfram stated that she purchased the property and was not aware that the shed was encroaching on Town-owned property. Ms. Wolfram stated that a proposed dock on the Parmenter Road property would not allow for much room for her dock. Ms. Wolfram stated that she is concerned about ADA accessibility, public safety, enforcement, and parking. Joanna Bilotta, 362 Sunset Lane (Via Zoom): stated that she is against the transfer of ownership to the Parks Commission. Karin Menard, 672 Page Street (Via Zoom): stated that when she moved to the Town in 2004, she was interested in learning more about public access to Lake Shirley. Ms. Menard stated that she does not believe that the public has adequate access to the lake. George Yapp, 28 Oak Ridge Road: stated that the Lake Shirley Improvement Corporation provides invasive species management services for the lake. Mr. Yapp said that the lake may need to be dredged if the Town wants to develop boat ramp access. Renee Raboin & David Osoff, 46 Fire Road 12: stated that they are abutters of one of the parcels. Ms. Raboin stated that the riverbank is marshland. Ms. Raboin stated that they are against the transfer of ownership to the Parks Commission. Alex Yawer, 226 Sunset Lane: stated that he is against the transfer of ownership to the Parks Commission. Ms. Lockwood stated that the Parks Commission has no plans to develop the parcels. Karin Menard, Parks Commission Member, stated that the Parks Commission has worked on these parcels for years. Ms. Menard stated that the Parks Commission’s focus is on providing public access to Town-owned lands. Ms. Menard stated that she believes the parcels could be ===PAGE 6=== Page 6 of 10 Select Board Meeting Minutes January 16, 2024 developed for canoe and kayak access. Ms. Menard stated that the Parks Commission may find, based on their research, that there is no public access available on these two parcels. Member Emkey stated that the Board should not transfer ownership if there are no clear tax titles in hand. Member Emkey stated that she is not in favor of the transfer of ownership to the Parks Commission. Member Alonzo stated that he doesn’t have enough information to decide on the transfer of ownership to the Parks Commission. Member Alonzo stated that he is not willing to transfer ownership prematurely if there is not an outline of a plan. Vice-Chair Franco stated that a site walk of the parcels would be needed. Member Alonzo replied yes and that the 5 year evaluation is a very tight deadline with things getting completed, getting approved by DOR, review by Select Board, printing and mailing the bills on time. COMMUNICATIONS FROM OTHER BOARDS - none APPOINTMENTS Recognition of Police Chief Thomas Gammel as President of the Central MA Chiefs of Police Association – Vice-Chair Franco noted that the Central MA Chiefs of Police Association held their annual installation meeting on December 13, 2023, at the Bull Run Restaurant in Shirley. At that meeting Town Manager Heather Lemieux swore in our Police Chief Thomas Gammel as the incoming President of the CMCOPA. The Association promotes effective development of law enforcement in Central Massachusetts and aids in the education, professional development and welfare of its members, while developing bonds of fraternity, as well as fostering harmonious relations with all public and private agencies concerned with law enforcement in Central Massachusetts. Chief Gammel noted that there are 50-60 municipalities plus 2 or 3 outside of Central Mass. that are represented. Mr. Franco congratulated Chief Gammel on behalf of the Select Board and Town, thanking him for his dedication and service to the Town. He presented Chief Gammel with a Commendation from the Select Board and added that they wish him the very best in his new additional role. Chief Gammel commented that receiving this award was very humbling. He added that the men and women of the Police Department are the heart and soul of the community. He thanked his wife for all her support, as well as his family. Member Alonzo stated he was very proud of what Chief Gammel has done, coming up through the ranks and the teamwork he has fostered. Members Nuzzolo and Emkey congratulated Chief Gammel, thanking him, as well as his department. INTERVIEWS/APPOINTMENTS/REAPPOINTMENTS/RESIGNATIONS Conservation Commission vacancy interviews/appointment-term to expire June 30, 2024 – Vice-Chair Franco stated that they have 3 candidates for the vacancy on the Conservation Committee-Sam Welch, Jenny Pewtherer, and Anthony Nicastro. The Select Board will interview each and pick 1 candidate to appoint. He thanked each candidate for stepping forward to volunteer and urged any candidate that is not appointed to consider other Boards or Commissions that interest them. Mr. Franco pointed out that the other candidates could consider becoming an Associate Member for the Conservation Commission, which is not an official appointment. Anthony Nicastro (88 Whalom Road) – Mr. Nicastro spoke of his love of Lunenburg. He works for a pharmaceutical company located near the wetlands and he deals with state agencies, as well as state regulations. He currently serves on the Architecture Preservation District Commission (APDC) and is currently an Associate Member on Zoning Board of Appeals (ZBA) for 3 years. Mr. Nicastro mentioned that he had a long conversation with Ms. Wilson (Conservation Chair) about the Board. He is familiar with site walks as an Associate of the ZBA ===PAGE 3=== Page 3 of 7 Select Board Meeting Minutes January 23,2024 and understands he cannot be biased when listening to people presenting their cases to the Board. Vice-Chair Franco inquired if Mr. Nicastro would be willing to serve as the Conservation Commission’s liaison to the Stormwater Committee and he replied he will do whatever it takes. Mr. Alonzo clarified that it is up to the Conservation Commission to make any appointment for a liaison. Jenny Pewtherer (10 Sunset Ave.) – stated that she is new to Lunenburg and went before Conservation for a retaining wall issue. After watching some of the Commission’s meetings, she decided she would like to apply for the open seat. She is the IT Manager for a construction/landscaping company, so she is familiar with Stormwater as well as fluid prevention plans. Ms. Pewtherer also spoke to Mary Wilson. Member Emkey acknowledged that Ms. Pewtherer was also interested in the Stormwater Task Force and Green Communities. She inquired if Ms. Pewtherer was aware that the Conservation meetings can be quite lengthy and if she was okay with the time commitment. Ms. Pewtherer replied she is very comfortable with the commitment as well as doing site walks and any classes. Member Alonzo asked what the most important charge was for the Commission, and she answered to follow the laws pertaining to protecting the wetlands as well as other aspects of the Commission. Ms. Pewtherer has not served on any town committees but previously volunteered for many school activities. In addition, she would serve on Stormwater if asked and deal with applicants without bias. Member Alonzo suggested waiting until the next meeting to interview Sam Welch (3 rd candidate) prior to making a decision. He also asked Bob Pease (Vice-Chair of Conservation Commission), who was present, if the Commission will be providing any guidance on the 3 candidates. Bob Pease (11 Wintergreen Court), Conservation Commission – stated that he works closely with Mary Wilson but they have not contemplated making any recommendations. He may reconsider doing so, on a personal level. Mr. Pease noted that none of the present Commissioners are willing to serve on the Stormwater Committee and was encouraged to hear someone had experience in stormwater. TOWN MANAGER REPORT Town Manager Lemieux noted the following board vacancies: Architectural Preservation, Cemetery Commission, Conservation (pending), Council on Aging, Green Communities (1 regular, 1 associate), Open Space and Personnel Committee. She urged any interested candidates to fill out a volunteer application and return it to the Select Board’s office. In addition, Ms. Lemieux stated there are employment openings for digital services/outreach librarian, executive assistant to Town Manager, facilities custodian, heavy equipment operator, land use director, staff young adult librarian, and temporary administrative assessing assistant. Any interested candidates may seek information on the town website under job opportunities to learn how to apply. The Assessor’s board has ratified Lynda McQuaid as the Principal Assessor. She is currently the Principal Assessor in Ayer and has 20 years of residential appraising experience as well as ===PAGE 4=== Page 4 of 7 Select Board Meeting Minutes January 23,2024 MAAO certification. Ms. McQuaid’s start is dependent on the 45 day clause in her current contract and the Town Manager will keep the Select Board informed about her office start date. Request for Proposals and Information for Bids – • Public Safety carpet project was awarded to Atkinson Carpet & Flooring for $43,790 and expected to be completed by March 18 th. It is funded in FY22 Capital plan for $50,000 and they anticipate a surplus. • Assistant Town Manager and Town Manager drafted a personal property cyclical for quotes. The Assessors Board reviewed and accepted this on January 22nd. Quotes will be solicited shortly and have historically used a company called RC. Budget Updates for FY25 – The town’s health insurance company MIIA has announced rate range increases for members in FY25 from 2.2% to 9.95%, with an average of 6.6%. Ms. Lemieux reached out to the representative to inquire on lowering the initial estimate of 10% and was informed that the estimate will be lowered to a maximum of 6.6%. Member Alonzo asked what the difference would be to the town and the Town Manager replied 10% would be $450,000. The new estimate would be almost half. Energy Broker – The current rate for aggregate accounts is .11868/kw and the contract will expire in November 2024. Ms. Lemieux discussed pricing with Tradition Energy (town’s energy broker outside of aggregate) and was told that they can expect lower downside market costs due to the milder weather forecast. She was also informed that if the town comes off, there would be more capacity for residents to join. Member Franco commented that it was huge that the Principal Assessor role has been filled and appointed, since there are very few people that do this. Member Alonzo inquired about the Unitil rate case in front of the DPU and the Town Manager had no update. He noted the current rate is about $0.30/kw which is in the top 2% in the country and residents have received high bills despite the mild weather. OLD BUSINESS Discussion on Draft Board/Commission Handbook – Member Emkey suggested adding a section on how to set up Zoom meetings. She also commented that when Town By-laws and Mass. General Laws do not agree, it could be helpful to summarize what is appropriate or what applies in that situation. Member Nuzzolo mentioned that a couple of links for pdfs are broken, such as the one under Meetings/Open Meetings. The URL is correct but the link to the pdf does not work. The Town Manager will check the links. Member Alonzo stated that he was fine with all recommended changes, except Chapter 13 on remote meetings and agreed the links need to be working. He urged further discussion on the Remote Meeting policy and emphasized the importance of not using remote participation during Executive Sessions. The video policy is the most important to work on since it was written prior to using Zoom and they need to determine what works best in the interest of the public. Member Franco praised the document as a nice resource for questions and rules. He is still going through the chapters in greater detail. ===PAGE 5=== Page 5 of 7 Select Board Meeting Minutes January 23,2024 Review and Discuss bylaws that pertain to the Select Board – will be discussed when there is a full board present. - Chapter C. § 3. 1 General Provisions & § 3.2 Select Board - Chapter 305 Board of Selectmen Policies - Chapter 184 Pawnbrokers and Dealers in Metal Article 1 §184-1 Licensing Authority and requirements - Chapter 74 Select Board - Chapter 5 Administration of Government CURRENT BUSINESS 1. Council on Aging: Member Franco reported: held a V olunteer Recognition Ceremony that was well attended. He was inspired by the number of volunteers and the hours they worked. UPCOMING MEETING/EVENTS SCHEDULE Select Board will meet on January 30 th instead of February 6th. The meeting on February 13th will be to discuss Flat Hill Road and include the invitation to the Trustees. Abutters and interested parties have been notified. PUBLIC COMMENT Town Manager Lemieux commented that she was very grateful for Rena Swezey for her service to the town in keeping the Assessor’s office running. Rena was the only person in the office due to the assistant being out on medical leave. Member Franco echoed her comments and was grateful for Rena stepping in. Dave Passios, 56 Whiting St. – reported that he was 1 of 3 representing the town at the MAA, which had record attendance this year. The conference was fantastic and there were great exchanges with others present. He also attended the MIIA Annual Meeting for the announcement of the new insurance rates. Dave spoke to the director who promised to contact Ms. Lemieux about the increase. There was information that federal money the state has been pursuing will be trickling down to towns. The next conference will be January 24 & 25, 2025 at the Seaport Convention Center. ===PAGE 7=== Page 7 of 7 Select Board Meeting Minutes January 23,2024 Adjournment Member Alonzo made a Motion to Adjourn. He explained that the agenda listed topics that may be discussed, but not all items may be addressed and other items not listed could be brought up as permitted by open meeting law. PUBLIC COMMENT Member Emkey mentioned they are in Budget season now and the School Budget is getting a lot of attention. She urged the public to stay engaged and informed by attending meetings or watching recordings on the town’s YouTube channel. She praised Finance Chair Evan Watters’ presentation on the 25 th in which he explained town revenue, levies and Proposition 2 ½. She also noted the Finance and Planning Board have discussed support for a town grant writer. Vice Chair Franco, building on Member Emkey’s remarks, urged the public to show up to the right meetings and discuss the right topics. Participants should review past meetings to understand terms and topics. Chair Jeffreys thanked Member Emkey for her detailed reflections with regard to the School Committee. Everyone is aware and alarmed by the budget challenges the Superintendent and School Committee are working through. The Select Board will continue to work and support the Schools. He thanked the Town Manager for her support in helping them manage the crisis and arrive at a result in the best interest of the community. Chair Jeffreys commented to the Board that he received an Open Meeting Law Violation complaint for the Cemetery Commission meeting on 11/30/23. It was received in mid-January and named him in the complaint, although he was not at the meeting. He noted that the Select Board does not need to respond or comment since it was against the Cemetery Commissioners at their meeting. George Burden, 39 Cortland Circle – stated he was discussed at the January 9 th meeting and was surprised by comments from Vice Chair Franco and Chair Jeffreys. He held up his phone stating he wanted everyone to know what this was about and noted he was physically assaulted on his ===PAGE 2=== Page 2 of 7 Select Board Meeting Minutes January 30, 2024 street, ending up in 2 hospitals, when there was 9” of snow on the street. On October 31, 2022, he met with the Town Manager for 1.5 hours and expressed frustration that the Town Manager did not get back to him. He had inquired about filing a complaint against the Chief of Police for removing him from private property. He noted he had sent hundreds of emails to the town manager and hundreds of text messages to Chair Jeffreys. Chair Jeffreys replied that Mr. Burden’s time was up and commented that the 9” of snow was on a private street not plowed by the Town and the assault occurred over 10 years ago. Sarah Cammer, 304 Lancaster Avenue – thanked the DPW salt truck driver who threw salt near her this morning. She also expressed disappointment that the Town did not give the Parks Commission access to the land, as recommended by Open Space. Without giving care and control to the Parks Commission, there is no requirement for residents of Lake Shirley to work with them. She hoped the Select Board would reconsider their stance if it comes before them again. Ms. Cammer commented the budget does not reflect the value we had for education in this town and the limitations of 2 ½ do not work with the required mandates. She stated she will not run for the Board of Assessors in May but encouraged anyone dissatisfied with the town to get off their soap box and volunteer. Chair Jeffreys stated site walks with Open Space and Parks Commission have been scheduled for mid-February and there will be a vote on the request before the warrant closes. Rhonda Lisio, 181 Reservoir Road – commented that she attended the Finance Committee meeting and thought the criticism of the 2 ½% budget was unfair. She noted she is not opposed to increasing taxes but adding an over-ride when the economy is bad may give no incentive for middle class residents to stay in town. Ms. Lisio was thankful for the Town Manager’s budget. John Bowen, 162 Highland Street – stated that the Cemetery Commission is a redundant board since the Town Manager and the DPW are responsible for 80% of all operations. The Town Manager oversees the Perpetual Fund and $20,000 is budgeted each year for maintenance by the DPW. The present Cemetery Board is requesting $738,000 through the Capital Plan which they cannot afford. He noted the 4 major budget departments are Police, Fire, Schools and DPW. Mr. Bowen suggested disbanding the Commission, letting the DPW care for the cemeteries and the Town Manager continue to manage the Perpetual Fund. It is up to the Select Board if there should be elected officials or not. ANNOUNCEMENTS Town Manager Lemieux gave the following announcements: • Master Plan Public Forum on February 1 st at Lunenburg Adult Activity Center – 2 sessions of 4-6pm and 6:30-8:30pm • Annual Town Meeting Warrant is open now until March 18th at 4pm. ===PAGE 3=== Page 3 of 7 Select Board Meeting Minutes January 30, 2024 COMMUNICATIONS FROM OTHER BOARDS Chair Jeffreys received a request from the Library Trustees to separate funds for technology from the general IT budget to allow them to have their own IT budget. INTERVIEWS/APPOINTMENTS/REAPPOINTMENTS/RESIGNATION Appointment of Conservation Commission member to fill one vacancy, term to expire June 30, 2024. • Jenny Pewtherer – 10 Sunset Ave. • Anthony Nicastro – 88 Whalom Road Member Alonzo reported that the 3 rd candidate rescinded his application. Vice Chair Franco thanked both candidates, noting that both are qualified but was inclined to support Ms. Pewtherer due to her interest in watching Conservation meetings and familiarity with Stormwater Task Force issues. Chair Jeffreys agreed they are excellent candidates and thanked both for applying as it is an honorable thing to serve your community. Member Nuzzolo supported Ms. Pewtherer for her passion and energy, as well as her experience in going before Conservation on an issue. Member Emkey agreed and asked the other candidate to consider volunteering for another town committee. Chair Jeffreys moved to appoint Jenny Pewtherer to the Conservation Commission for a term to expire June 30, 2024. Seconded by Clerk Franco. Roll Call Vote: Mr. Nuzzolo-aye, Ms. Emkey-aye, Mr. Alonzo-aye, Mr. Franco-aye, and Mr. Jeffreys-aye. The motion passed unanimously (5-0-0). Chair Jeffreys advised Ms. Pewtherer to get sworn in with the Town Clerk, to contact the Commission Chair for meeting materials, and review the Select Board Policy relating to appointment to multi-member boards. He congratulated Ms. Pewtherer and encouraged Anthony Nicastro to step forward for other roles in the town. TOWN MANAGER REPORT Town Manager Heather Lemieux provided a comprehensive list of openings on town boards and commissions, urging interested citizens to fill out an application on the town website. She further noted job opportunities for Executive Assistant to Town Manager, Facilities Custodian, Heavy Equipment Operator, Van Use Director, Staff Librarian (Young Adult) and Temporary Assessing Assistant. The Town Manager reported she had received a spreadsheet from Sean Cronin (Deputy Commissioner for Local Services) notifying the town that there will be a shortage of 40S local aid for education of 40R students in the Tri-Town district. The shortage is due to a reduction of students from 59 to 55 and the big bump in Chapter 70 money last year- making us ineligible for aid. The total for the line item is $342,000 and last year’s increase in Chapter 70 money was about $900,000. Member Alonzo suggested contacting the State Delegation about the loss of aid and Manager Lemieux noted that Sean Cronin said they are looking at it with the legal team. She ===PAGE 4=== Page 4 of 7 Select Board Meeting Minutes January 30, 2024 added that they budget conservatively for state aid and will be ok for the balance of the fiscal year. Member Emkey asked for clarification on the calculation for the Smart Growth reimbursement. Manager Lemieux replied the additional Chapter 70 was $728,577 and last year was $1,290, noting the numbers do not make sense. Local revenue is $20,000 and Mr. Cronin is looking at removing this from the Cherry Sheet. Member Emkey stated that this happens mid- year as a reimbursement. Chair Jeffreys has scheduled a meeting with the state representatives, Carol Archambault (School Committee Chair) and Evan Watters (Finance Committee Chair) on February 20 th to discuss 2 ½ challenges, as well as 40S funding. The Select Board will discuss priorities prior to the meeting. OLD BUSINESS 1. Update on Distribution of ARPA funds for committed project requests and draft Sub- Recipient Grant Agreement Chair Jeffreys reported there is still significant American Rescue Plan Act (ARPA) funds to disperse and the banked money earned $101,889 in interest. They will need to get clarification on whether that interest follows ARPA rules or regular appropriation by the town body. The Town Manager noted what ARPA funds are currently under contract and the Board discussed figures. The Sub-Recipient Grant Agreement is with Town Counsel. Recipients are Water District ($285,000), Boys & Girls Club ($175,000) and Food Pantry/Lions Club ($20,000). They had no issues with the Agreement. Member Emkey commented that Westford is using $20,000 of ARPA funds to test 50 private wells across town for PFAS. Chair Jeffreys suggested using $25,000 to hire a consultant, with the goal of putting solar on the old town dump as a source of revenue for the town. In addition, he encouraged looking into Habitat for Humanity to potentially build deed restricted low cost housing for seniors and veterans on land owned by the town. These units could help the town to achieve 10% affordable housing without looking at large developments. He will contact them about making a presentation. 2. Discussion on Draft Board/Commission Handbook Member Alonzo requested focusing on the remote participation policy and thanked the Town Manager for all her work on the handbook. 3. Discuss Draft Environmental Policies Chair Jeffreys reported the Town Manager is reviewing policies with staff and the Park Commission requested to provide comments. He anticipates this will be on the agenda for a while and expects a substantive discussion in March. 4. Review and Discuss bylaws that pertain to the Select Board - Chapter C. § 3. 1 General Provisions & § 3.2 Select Board Chair Jeffreys pointed out that Chapter C is part of the Charter. ===PAGE 5=== Page 5 of 7 Select Board Meeting Minutes January 30, 2024 - Chapter 305 Board of Selectmen Policies Member Alonzo stated this should be brought in line with the Handbook and was adopted 11 years ago. The Town Manager pointed out that the up to date policies are on the website. The Board will discuss this at the next meeting. - Chapter 184 Pawnbrokers and Dealers in Metal Article 1 §184-1 Licensing Authority and requirements Chair Jeffreys commented this was amended a couple years ago and that they are important to have but need regulations for them. All agreed there are no changes and to take it off the agenda. - Chapter 74 Select Board Chair Jeffreys noted all public parks, grounds and buildings are under Select Board supervision and they can grant use of the Town Hall. The Town Manager has full jurisdiction over the use of town facilities except those under School Committee and Conservation Commission. The Select Board discussed whether to repeal Chapter 74 since it is already covered in the Charter and does not add any clarity, except for section 74-1. The Board was divided as to repealing and tabled this discussion. - Chapter 5 Administration of Government was tabled. CURRENT BUSINESS Discussion on Common Victuallers License Compliance Chair Jeffreys reported Conrads has not come forward to submit a permit request but has continued to operate. They are scheduled to appear before the Board on the 13th. Discussion on Fiscal Year 2024 Budget, Fiscal Year 2025 Budget, Capital Plan, and Annual Town Meeting Warrant articles Member Alonzo commented on discussions at the last few Finance Committee and School Committee meetings, calling for a potential 2 ½ override. He noted the last successful override was in the early 1990’s for the schools and library. Further, he commented that the town’s growth has luckily kept up with inflation. Overrides take a long time to plan and would require putting together 2 budgets while missing a Finance Director, Principal Assessor and Assisting Accounting. Vice Chair Franco suggested waiting until FY26 for an override. Chair Jeffreys pointed out that 30 years ago the majority of town staff lived in Lunenburg but now very few can afford to live here. Several years ago, most staff were moved to 4 work days, less hours and cuts in pay. The staff is continually being squeezed too much. He suggested building in the ability to bump it 3% every 8 or so years. FY25 Budget -The Town Manager reported that they are still waiting for final numbers on health insurance, Monty-Tech assessment in mid-March, Worcester County Retirement Assessment and firm figures from the schools. There are no changes to the Capital Plan and she has no updates for Annual Town Meeting Articles. Minutes/Warrants/Action Items Regular Session Minutes for September 12, 2023; September 19, 2023 Vice Chair Franco was not present at the meeting on the 19 th and asked for separate votes. ===PAGE 6=== Page 6 of 7 Select Board Meeting Minutes January 30, 2024 Motion by Vice Chair Franco to approve the minutes of September 12, 2023. Seconded by Member Alonzo. Roll Call Vote: Mr. Nuzzolo-aye, Ms. Emkey-aye, Mr. Alonzo-aye, Mr. Franco-aye, and Mr. Jeffreys-aye. The motion passed unanimously (5-0-0). Motion by Member Alonzo to approve the minutes of September 19, 2023. Seconded by Member Emkey. Roll Call Vote: Mr. Nuzzolo-aye, Ms. Emkey-aye, Mr. Alonzo-aye, and Mr. Jeffreys-aye. Mr. Franco abstained. The motion passed (4-0-1). Warrants Accounts Payable warrant in the amount of $ 56,563.63. Payroll warrant in the amount of $973,643.41. COMMITTEE REPORTS School Committee: Member Emkey reported that the Superintendent presented a modified budget and announced the Finance Director decided not to accept the position on the School Committee. Board of Assessors: Member Alonzo stated that they met yesterday and were due to meet tomorrow but that is now cancelled. Finance Committee: Member Alonzo reported the Committee met on Thursday but did not have a report yet. Planning Board: Clerk Nuzzolo noted the board met regarding the development at 255 Sunnyhill Road and they have requested a continuance to February 26 th due to issues with DEP. UPCOMING MEETING/EVENTS SCHEDULE Chair Jeffreys announced that the Select Board will be meeting February 13 th and 20th. He is trying to coordinate a site walk with Open Space and Parks Commission. He will also seek a vote on their request after the site walk takes place. PUBLIC COMMENT TOWN MANAGER: Manager Lemieux stated that earlier in the meeting, Mr. Burden indicated she met with him for 1 ½ hours, making only small notations or comments. She clarified that she had emailed him to say she would be happy to meet with him but will reserve comments until meeting with the Chief of Police present. Mr. Burden refused to meet with the Chief present and just wanted to meet with the Town Manager. PUBLIC COMMENTS ===PAGE 7=== Page 7 of 7 Select Board Meeting Minutes January 30, 2024 Dave Passios, 56 Whiting Street and member of the Finance Committee – stated they had a vote to recommend the intention to send a request for hiring a grant writer to the Select Board and Town Manager. He noted the Town Manager has done a very good job of grant writing over the years but she is over-burdened already. Mr. Passios will advocate to add it to the budget next year. BOARD COMMENTS Member Alonzo: commented that the Town Manager informed this citizen on how to file a complaint but he consistently does not follow those instructions. It is a simple form to file, but still no form has been submitted by that citizen. In addition, the Town Manager has responded as to how to proceed with action he wants to take and yet that action has not been followed. Instead he has sent numerous emails requesting identical things. Chair Jeffreys: clarified in response to a previous statement of 9” snow on an unplowed road, the road is a private road and the Town has no responsibility to plow it. If there is 9” of snow in your driveway, you create a safety issue for yourself but the Town does not have the power to go on private property and compel owners to plow their driveways. Earlier there was a compliant about an assault but it happened 11 years ago. They have been very clear they are not in a position to remedy an event that happened that long ago. Homeowners can press lawsuits but Massachusetts has a statute of limitations that likely expired by 6 years. Mr. Jeffreys noted they welcome public comments to inform the Board about things they are not aware of, which allows them to look into things and provide better quality for residents. ADJOURNMENT Vice Chair Franco moved to adjourn. Seconded by Member Alonzo. Roll Call Vote: Mr. Nuzzolo-aye, Ms. Emkey-aye, Mr. Alonzo-aye, Mr. Franco-aye and Mr. Jeffreys-aye. The motion passed unanimously (5-0-0). Meeting adjourned at 9:17 P.M. Respectfully Submitted, Jennifer Warren-Dyment Town Manager These Minutes were reviewed and approved by the Select Board on Tuesday April 15, 2025: Member Alonzo made Motion to Approve minutes from January 23, 2024. Seconded by Vice Chair Jeffreys. All, aye. Passed unanimously (5-0-0). ======================================================================================== DOCUMENT : 2024-01-31-agenda-6388.txt BOARD : select-board DATE : 2024-01-31 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/select-board/2024-01-31-agenda-6388.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_01312024-6388 ======================================================================================== ===PAGE 1=== SELECT BOARD Wednesday, January 31, 2024 6:45 PM AGENDA Bilotta Meeting Room, Town Hall In accordance with the requirements of the Open Meeting Law, please be advised that this meeting is being recorded and broadcast live over the Lunenburg Public Access channel, on FacebookLive on the Public Access Facebook page (https://www.facebook.com/Lunenburg-Public-Access-Cable-157427270975305/) and will be uploaded to the LunenburgAccess YouTube after the meeting. Chair Jeffreys informed attendees that the meeting was being recorded and broadcast live and would be uploaded to YouTube after the meeting. He explained that the agenda listed topics that may be discussed, but not all items may be addressed and other items not listed could be brought up as permitted by open meeting law. PUBLIC COMMENT George Burden, 39 Cortland Circle – commented that he has sent numerous emails and texts but not received any response. He added that the Home Owner’s Association is dysfunctional and was concerned that the 9” of snow was not the town’s responsibility. Chair Jeffreys stated that Mr. Burden is welcome to meet with the Board to discuss his concerns. John Bowen, 162 Highland Street- thanked the Board for giving him time to speak. He noted that Chair Jeffreys communicated with Nancy Yasko (Cemetery Commission) on 8/17/23 and that Nancy contacted Town Counsel on her own, without going through the Town Manager. Further he stated that the Cemetery Commission has no superintendence, maintenance and management powers—these are reserved for the Town Manager and DPW Director. ANNOUNCEMENTS Town Manager Lemieux gave the following announcement: • Annual Town Meeting Warrant is open now until March 18th at 4pm. Articles should be submitted to the Select Board office COMMUNICATIONS FROM OTHER BOARDS Discussion & Vote on ARPA funding request of $2,500 from Economic Development Committee – Chair Jeffreys reported that he has been working with the Economic Opportunity Committee and asked Joeci Gilcrest to make her presentation. Joeci, representing the 1st Middlesex District Economic and Community Development Collaborative, stated they are being asked to contribute $1,200 for development of the Collaborative Website. The amount had been ===PAGE 2=== Page 2 of 9 Select Board Meeting Minutes February 13, 2024 re-estimated from the original $2,500. This website will be the hub for area rural towns to display information that will lead to economic development and growth. They are still in the stage of gathering estimates for building the website. Chair Jeffreys noted that smaller towns experience a hardship in amplifying their needs and identifying what each has to offer for community activities and business. Joeci replied that this website would offer a central hub to display all this information and she will come back with more information as she gets it. They are working on a logo, mission statement and the website. Member Alonzo asked for a written proposal when it is available. Member Nuzzolo inquired about the figure for available ARPA funds and Chair Jeffreys replied that there is $58 K plus the $101K in interest. The Board welcomed the proposal but did not vote. INTERVIEWS/APPOINTMENTS/REAPPOINTMENTS/RESIGNATION • Public Hearing on Conrad’s Drive-In, 835 Massachusetts Avenue for Denial of License: no one present –tabled to later in the meeting. • Limousine License Application- George Kharialla d/b/a MediGo Transportation LLC, 313 Reservoir Road: Mr. Kharialla proposed starting a non-emergency medical transportation company to lessen the calls for ambulance transfers and is applying for a limousine license. His company would also be open for transporting people to do errands such as grocery shopping. He presently works in the ER at Leominster Hospital and has set up liability insurance. Member Emkey cautioned that he would need to set boundaries on the degree of medical conditions handled and Mr. Kharialla replied that he would deny any ER requests. They would transport in surrounding towns and he will check on license requirements for those towns. To start, they will use 2 four door vehicles and would like to add wheelchair accessible vans later. Chair Jeffreys stated he would suggest approval, conditional on proof of insurance and urged Mr. Kharialla to contact the building inspector about the number of vehicles he can have at a residence before needing a commercial location. Motion by Member Alonzo to approve the limousine license application for George Kharialla d/b/a MediGo Transportation LLC, 313 Reservoir Road, conditional on him providing us proof of insurance and liability and all other insurances required by the limousine policy as stated. Seconded by Member Emkey. Roll Call Vote: Clerk Nuzzolo-aye, Member Emkey-aye, Member Alonzo-aye and Chair Jeffreys- aye. Motion passed. (4-0-0) The Board will sign and hold until insurance proof is provided. INTERVIEWS/APPOINTMENTS/REAPPOINTMENTS/RESIGNATIONS Ratification of the Town Manager’s Appointment of Executive Assistant to Town Manager/Select Board, Annie Aubrey: The Town Manager detailed the application process which yielded 5 interviews. Annie Aubrey has been the Assistant to the Planning Board and was the best fit. In the absence of a Land Use Director, she has been keeping that office going. Chair ===PAGE 3=== Page 3 of 9 Select Board Meeting Minutes February 13, 2024 Jeffreys noted that Annie has demonstrated the ability to work well with the public and the Board is happy to see the job filled internally. INTERVIEWS/APPOINTMENTS/REAPPOINTMENTS/RESIGNATION • Meeting with DPW Director and Town Counsel to review and vote on Flat Hill Road Order of Takings for Flat Hill Road Culvert project: Bill Bernard DPW Director reported they are getting ready to advertise the project for the Flat Hill Bridge over the Catacoonamug Brook at Lake Shirley. They need to move the utility poles and lines upstream 10 feet and requires easements, in order to bring a crane in for the project. Town Counsel referenced the map showing the easements and added that Bill was successful in getting 2 of the 4 property owners to do voluntary conveyances. He did not have success with the 3rd property and the 4th property is subject to a mortgage which would be complicated. He is proposing an order of taking for 890 & 914 Flat Hill Road- areas 1 and 3. Mr. Costa explained the wording for the vote and noted the rates for compensation to property owners based on appraisals – 890 Flat Hill Rd.- $3,000 and 914 Flat Hill Rd- $2,100 for easement awards. His office will contact those residents. Motion made by Chair Jeffreys that the Select Board acquire by eminent domain for the necessary health and welfare of the inhabitants of Lunenburg for municipal purposes, specifically for improvements to the bridge on Flat Hill Road over the Catacoonamug Brook, as authorized by Article 10 of Lunenburg Special Town Meeting of November 16, 2021 and that it further authorize the Board’s Chair, Michael Ray Jeffreys, to execute and enter into any and all documents necessary to effectuate the acquisition of the following property: a temporary easement located at 890 Flat Hill Road, Lunenburg, Massachusetts, depicted as temp. easement #3 area about 1,803 sq. ft. and a permanent easement located at 890 Flat Hill Road, Lunenburg, Massachusetts, depicted as perm. easement # 3, area about 667 sq. ft. on the plan entitled “Easement Plan of Land of Lunenburg, Massachusetts”, prepared by VHB, Inc. comprised of 2 total sheets dated January 6, 2023 and to be recorded with Worcester North District Registry of Deeds, together with the order of taking and a temporary easement located at 914 Flat Hill Road, Lunenburg, Massachusetts, depicted as temp. easement # 1 area about 1,104 sq. ft. and a permanent easement located at 914 Flat Hill Road, Lunenburg, Massachusetts, depicted as perm. easement # 1, area about 81 sq. ft. on the plan entitled “Easement Plan of Land of Lunenburg, Massachusetts”, prepared by VHB, Inc. comprised of 2 total sheets dated January 6, 2023, and to be recorded with Worcester North District Registry of Deeds, together with the order of taking and that still further, the Board award damages for said eminent domain takings in the total amount of $5,100.00 to ===PAGE 4=== Page 4 of 9 Select Board Meeting Minutes February 13, 2024 the affected record owners of said land, the amount per record of owner being specified in aforementioned order of taking. Seconded by Member Alonzo. Discussion: Member Alonzo asked why there were irregular shapes on the map and Bill Bernard stated that is where the telephone poles are being moved back. Roll Call Vote: Clerk Nuzzolo-aye, Member Emkey-aye, Member Alonzo-aye and Chair Jeffreys-aye. Motion passed. (4-0-0). The Board signed the sheets. • Meeting with Village at Flat Hill Trustees to discuss and review Stormwater Maintenance Plan: Chair Jeffreys noted that this is a discussion of the Flat Hill Road and Page Street drainage. Wayne Gariepy, 32 Cortland Circle (also Flat Hill Trustee) stated they want to get permission from the Conservation Commission to do the maintenance dredging on the retention pond. After the work is done, they will ask the Engineer, contracted by the town, to check the work and make further arrangements. They will be contracting with Powell Stone & Gravel for the dredging after receiving permission from Conservation. Mr. Gariepy added that the Trustees were looking for assurance that the town will not use this opportunity to add more requirements. Member Alonzo mentioned the possibility of water getting into the pipes. Mr. Gariepy replied that after the engineer makes his conclusions, they can address that issue. Member Emkey suggested asking the engineer for a scope of work and Mr. Gariepy stated they would be open to that. Chris St. Germain, 268 Flat Hill Road and member of Conservation Commission- said he did not think the retention pond was wetlands. They can contact the Conservation Admin. for clarification. Brian Marchetti – (Engineer contracted) – commented that the first step is to do an as- built survey of the basin and compare it to the design plans. The basin is not wetlands but it is located within the buffer zones to the resource area and should be an RDA with Conservation. Matt Allison, 188 and 305 Flat Hill Road – noted the issue was that the basin was not done correctly and questioned if the study was already done with suggestions. He added that Mr. Marchetti stated previously that the structure was in failure. He also confirmed there is still $40K in the Capital Plan for this project. Susan Whalen, 377 Flat Hill Road – expressed concern about water coming across the St. Germain property and down the road. She questioned if the water may be coming from the vacant lot and if it could be detained prior to entering the road. Chair Jeffreys noted the engineer did suggest adding a pond there to deal with the water. Karen Menard, 672 Page Street – thanked Mr. Gariepy for working with the neighbors. She added that she also has water in her yard along with flooding in her basement. David Melvin, 655 Page Street – stated that the drain is not handling the water coming from Flat Hill Road to Page Street and suggested there may be a blockage between the 1st and 3rd drain. He asked if they could put a camera through to check for that and suggested adding drains were the water is collecting. ===PAGE 5=== Page 5 of 9 Select Board Meeting Minutes February 13, 2024 Bill Bernard – replied the Jetter truck came out twice and the catch basin truck cleaned the catch basin. The Jetter went through but it appears the pipes are undersized. They also have had similar flooding at Electric Ave. and New West Townsend Road. Bill has put in 3 Capital Plan requests for Stormwater related issues in these 3 areas. They just need to find money to do the upgrades. Brian Marchetti – reported that Whitman & Bingham (now Haley Ward) did a right of way survey 2 years ago of Flat Hill from Cortland Circle down to Page Street and a right of way survey from the intersection of Page down to Beaver Brook. They looked at the drains and did test pits for stormwater but it did not make sense. The findings report included deficiencies in the outlet structures. He stated that the as-built survey of the basin will give them a better understanding of what condition the pond is in. Brian added that no closed pipe system can deal with the 100 year storms we are now getting. Chair Jeffreys summarized they will work collaboratively with the Village of Flat Hill, provide some engineering to evaluate their scopes, perform assessment to identify what the as-built is compared to what it was meant to do, converse on other sources of water contributing to this and how to mitigate it. Brian Marchetti- suggested engaging a hydrogeologist to do borings and ground water testing. The most realistic solution is to collect stormwater at the source and pipe it underground to the detention basin. Chair Jeffreys- further summarized that the Village of Flat Hill will be cleaning out the detention basin and the engineer will evaluate the scope of work to confirm if the basin is as it should be. They will ask Mr. Marchetti to use a camera to look for blockages in the drains. • Public Hearing on Conrad’s Drive-In, 835 Massachusetts Avenue for Denial of License – No one is present for this hearing. The Town Manager stated that the Board can act on the denial of license. She added that the owner has not paid the back taxes and had a payment agreement. Member Alonzo pointed out that their license expired on December 31, 2023 and they did not apply for a renewal. The Board discussed giving them due process and whether to open the public hearing. Motion by Chair Jeffreys to continue the hearing until February 20, 2024 at 6:45 pm. Seconded by Member Alonzo. Roll Call Vote: Clerk Nuzzolo-aye, Member Emkey-aye, Member Alonzo-aye and Chair Jeffreys-aye. Motion passed. (4-0-0). She stated this year’s calculation was based on FY23 when they received a large bump of $730,000 in Chapter 70 money as a foundation community. Due to this, Lunenburg was disqualified from receiving aid now. They may be able to close out without a deficit due to conservative estimates for local receipts.
