Seconded by Member Emkey. Roll Call Vote: Clerk Moore – aye; Member Alonzo—aye; Member Emkey—aye; Vice- Chair Jeffreys—aye; Chair Nuzzolo—aye. The motion passed unanimously (5-0-0). RE-ENTER OPEN SESSION AND PLEDGE OF ALLEGIANCE The Board re-entered Open Session and re-opened the meeting. Chair Caesar Nuzzolo called the meeting to order at 7:35 PM and led the Pledge of Allegiance. Chair Nuzzolo informed attendees that the meeting was being recorded and broadcast live and would be uploaded to YouTube after the meeting. He explained that the agenda listed topics that may be discussed, but not all items may be addressed, and other items not listed could be brought up as permitted by open meeting law. PUBLIC COMMENT Board Member Alonzo announced that the second of five Monday night band concerts had been held the previous evening on the lawn in front of TC Passios at 7:00 PM. He noted that three additional concerts were scheduled for the next three Mondays, with the fourth Monday reserved as a rain date, and encouraged residents to attend. Public Dave Blatt, 411 Goodrich Street, speaking first as a resident, thanked Town Manager Heather Lemieux for her service to the Town and wished her well in her next chapter. Mr. Blatt then spoke as a member of the Green Communities Committee. He reported that the Town’s LED streetlight conversion is saving approximately $3,000 per month in electricity costs, noting that a recent bill was about $700 compared to roughly $3,700 prior to the upgrade. He stated that this resulted in an expected payback period of less than two years. He explained that the Green Communities program allows the Town to apply annually for up to ===PAGE 2=== Page 2 of 13 Select Board Meeting Minutes 7/16/2024 $150,000 in grant funding for energy-efficiency projects. He noted that the Town did not apply in the recent spring round because there were not enough ready projects. He asked the Board to help encourage departments and boards to submit project ideas for the upcoming fall grant round. Mr. Blatt outlined a proposed timeline: by August 15, departments should identify potential projects so the Green Communities Committee can review them for feasibility and eligibility; by September 15, projects should be finalized with supporting data so the Town can submit for the October deadline. He highlighted potential projects such as mini-split systems for the schools and noted that state-authorized contractors can help complete the required grant forms. He stated the Committee would like to see 12–20 projects in the pipeline over the next several years and emphasized that the funding represents “free money” for the Town to support capital and energy- related needs. Member Alonzo, serving on the Capital Planning Committee, noted that at its most recent meeting, the Committee agreed that any capital project with an energy component (from schools, DPW, police, fire, or other departments) should be reviewed by the Green Communities Committee. The Board member suggested sending an email to the superintendent, facilities directors, DPW, and other department heads asking them to coordinate with the Green Communities Committee when developing such projects. Mr. Blatt expressed support and reiterated that no project is too big or too small for consideration. Karin Menard, 672 Page Street, speaking on behalf of the Parks Commission, provided an update on the Town Beach. She reported that water testing conducted on July 8, 2024 showed elevated E. coli levels, and the results received on July 9 led to an immediate closure of the beach that Tuesday afternoon. She stated that the water has been tested multiple times since then and results show improvement, but the mean values must be within state standards before reopening. She noted that another sample had been taken earlier that day, with results expected the following afternoon, and that the beach would remain closed at least through the next day. She expressed hope that the beach might reopen by Friday and observed that this was one of the longest bacteria-related closures she could recall during her time involved with the facility. Chair Nuzzolo asked if there were any additional public comments in person or via Zoom; there were none. ANNOUNCEMENTS No additional announcements were offered by Board members. ===PAGE 3=== Page 3 of 13 Select Board Meeting Minutes 7/16/2024 COMMUNICATIONS FROM OTHER BOARDS The Chair stated there were no communications from other boards to report. APPOINTMENTS 7:15 PM Joint Interview and Appointment with Parks Commission to fill vacancy until next Annual Town Election (May 2025): Tim Lawless, 53 Whiting Street The Select Board met jointly with the Parks Commission to interview Tim Lawless, 53 Whiting Street, regarding appointment to fill a Parks Commission vacancy until the next Annual Town Election in May 2025. The group explained that the funds raised would support the continued development of the Skatepark project and provided an overview of the logistics, safety plan, and prior successful tollbooth fundraisers. Motion by Vice-Chair Jeffreys to Tollbooth Fundraiser request for August 11, 2024, by the Lunenburg Skatepark Project. Seconded by Member Alonzo. Call for the vote: Clerk Moore – aye; Member Alonzo—aye; Member Emkey—aye; Vice- Chair Jeffreys—aye; Chair Nuzzolo—aye. The motion passed unanimously (5-0). CURRENT BUSINESS Discussion on Police Department Policies 4.13 Sex Offender Posting and Dissemination and 4.14 Sex Offender Audits The Police Chief was present and discussed the Police Department policies related to the posting and dissemination of sex offender information and the audit process conducted by the Massachusetts Sex Offender Registry Board. He reviewed notification requirements, compliance expectations, and how the Department ensures legal standards are met while balancing public awareness and safety. Board members asked clarifying questions, and the Chief provided additional explanation regarding procedures and timelines. Motion by Member Alonzo to I move that we approve the policy the police department policies 4.13 sex offender posting and dissemination and 4.14 sex offender audits as presented by the chief with the word change of bi- annual to twice a year. Seconded by Member Emkey. Call for the vote: Clerk Moore – aye; Member Alonzo—aye; Member Emkey—aye; Vice- Chair Jeffreys—aye; Chair Nuzzolo—aye. The motion passed unanimously (5-0). Discussion on Flat Hill Road Petition The Police Chief summarized recent and prior traffic studies conducted on Flat Hill Road in response to speeding complaints. He reported that an earlier study using a traffic trailer showed an average speed of approximately 23 mph, and that a new 7-day study is currently underway, with preliminary data over five days indicating an average southbound speed of 24 mph. He stated that officers conduct regular enforcement in the area and emphasized the importance of discretion and education rather than a “zero-tolerance” ticketing approach, noting that residents of the neighborhood would also be subject to citations. He explained that while advisory signs ===PAGE 5=== Page 5 of 13 Select Board Meeting Minutes 7/16/2024 (e.g., “thickly settled” or “pedestrian area”) can be used, advisory speed postings below the legal speed limit are not permitted, and permanent electronic speed feedback signs are costly (estimated at $6,000–$10,000). He recommended waiting until after the bridge on Flat Hill Road is repaired and reopened to conduct another full traffic study to better understand long-term conditions and determine whether additional measures are warranted. Norma Wells, 914 Flat Hill Road, stated that she regularly walks her dog from Spring Street to Reservoir Road and frequently has to jump into the poison ivy along the roadside due to vehicles she believes are traveling at excessive speeds; she described the situation as frightening and requested that another traffic study be conducted after the bridge repair. Nathan Jones, 878 Flat Hill Road, described organizing an earlier petition due to concerns for toddlers and new families in the neighborhood and recounted multiple near-miss incidents, including being forced off the road and nearly struck by vehicles on blind hills and curves; he argued that the road is too narrow and unsafe at current speeds and urged the Board to reduce the speed limit to 25 mph before the bridge reopens. Sue Ropiak, 833 Flat Hill Road, agreed that vehicles travel too fast and noted that an average speed of 24–25 mph necessarily means some vehicles are traveling faster; she stated that she supports tickets for anyone speeding, including neighborhood residents, and stressed that the combination of narrow pavement and a blind curve makes it difficult for drivers to see pedestrians or stop in time. James Jordan, who lives at the corner of Flat Hill Road and May Street and identified himself as a disabled veteran, stated that he has been advised to walk daily but does not feel safe walking on Flat Hill Road due to high speeds, blind driveways, and vehicles quickly approaching from behind as he pulls out of his driveway; he urged the Board to lower the speed limit to at least 25 mph, noting that Reservoir Road is wider, straighter, and already posted at 25 mph. Ray Kodkis, 5 Spring Street, concurred with comments of previous speakers. Mitchell Jordan, 2 May Street, spoke in support of the prior speakers and described frequent trips to his parents’ home to assist his disabled father and wheelchair-bound mother. He stated that vehicles regularly travel much faster than 25 mph down the hill near their home, that it is difficult and often unsafe to pull out from May Street, and that there is no safe place along Flat Hill Road for his parents to walk. He expressed concern that nothing will change until someone is seriously injured and urged the Board to lower the speed limit and consider additional traffic calming measures. Chair Nuzzolo thanked the residents for their input and stated the Board will revisit when they have more data. TOWN MANAGER REPORT Town Manager Heather Lemieux provided the following updates. ===PAGE 6=== Page 6 of 13 Select Board Meeting Minutes 7/16/2024 She announced that the town beach remains closed due to elevated bacteria levels. Testing was conducted on Friday, Monday, and Tuesday, with results showing improvement, and it is anticipated the beach may reopen by the weekend. Representative Scarsdale will hold office hours on Monday, July 22, at 3:00 p.m. at the Lunenburg Adult Activity Center. Current Board and Committee vacancies were reviewed, including openings on the Agricultural Commission, Architectural Preservation District Commission, Board of Health (joint appointment), Capital Planning Committee, Cultural Council, Green Communities Committee, Historical Commission, Open Space Committee, Personnel Committee, and Sewer Commission (joint appointment). She noted that due to two consecutive Conservation Commission meetings, further progress may temporarily slow while staff prepares for hearings. She thanked Brian Gingras and support staff for their assistance. She reported on Requests for Proposals and Bids currently underway. Library solar shade installation bids are due July 31; trash and recycling service bids are due July 24. Work continues with the OPM on the Marshall Park Redevelopment design services RFP for Phase I, to ensure grant funding is expended by June 30, 2025. The RFP will be advertised June 17 and due August 8. The Mass Historical Commission provided guidance for an RFQ for historical property survey services related to the Town’s $12,500 grant; the RFQ draft has been completed and returned to MHC for approval. The Senior Center roof project IFB has completed staff review and is pending final administrative review with a goal of posting prior to her departure. She provided an update on Unitil’s Electric Sector Modernization Plan. Planned improvements include a substation upgrade at 934 Massachusetts Avenue to begin in 2025 and become operational in 2026, improving reliability and permitting additional solar expansion. Unitil is also planning a new substation in the Leominster–Shirley Road area, expected to begin in 2027 with a two-year construction period. Unitil will hold both in-person and virtual informational sessions in August. A payroll processing change has gone into effect as of July 15, moving from advance pay to arrears payroll. Employees were previously notified in June. ===PAGE 7=== Page 7 of 13 Select Board Meeting Minutes 7/16/2024 She reviewed Smart Growth Funding requirements, noting deadlines of September 1 for the Board of Assessors to report qualifying tax revenue and September 15 for filing the Chapter 40S reimbursement request with DLS. The Local Reporting Officer is appointed by the Select Board. An update was provided on Chapter 90 and Fair Share roadway funding. MassDOT has preapproved $119,020 in sidewalk engineering (including Oak Avenue) and $24,000 for an air compressor, along with $710,312 in roadway work. FY24 funding received $618,547. FY25 Chapter 90 allocation is $418,227. She noted that with her pending departure, Chief Procurement Officer responsibilities will be delegated to the Assistant Town Manager/HR Director effective August 1 to ensure continuity of procurement authority. The draft Financial Policy Manual has been distributed to relevant boards and committees for review and feedback. Responses are requested following their next posted meetings. Town Manager Lemieux concluded by reporting on the recent Employee Appreciation Luncheon, intended to recognize staff contributions and years of service. Service milestone certificates were awarded to employees with 5, 10, 15, 20, 25, 30, 40, and 45 years of service to the Town. She thanked staff for their dedication and ongoing work for the community. Board members thanked the Town Manager and expressed appreciation for her comprehensive reports and communication throughout her tenure. OLD BUSINESS Review Amendments to Draft Teen Center Lease Agreement Motion by Member Alonzo to approve the Teen Center Lease Agreement as presented and amended. Seconded by Member Emkey. Call for the vote: Clerk Moore – aye; Member Alonzo—aye; Member Emkey—aye; Vice- Chair Jeffreys—aye; Chair Nuzzolo—aye. The motion passed unanimously (5-0). Interim Town Manager Search The Board discussed interim Town Manager compensation parameters. Members reviewed comparable interim placements and discussed a likely three-month contract period. There was a discussion regarding the range for Interim Town Manager services and what questions would be asked during the interview. Town Manager Salary Range The Board discussed salary expectations for the permanent Town Manager position. It was noted ===PAGE 8=== Page 8 of 13 Select Board Meeting Minutes 7/16/2024 that prior compensation analysis completed during the most recent Town Manager contract negotiations placed the market median at approximately $175,000 at that time, and that municipal executive salaries have increased since then. Comparable communities are now generally offering salaries in the $180,000 to $200,000+ range, with higher compensation in some cases depending on experience, education, and market competitiveness. The Board discussed the need to balance competitive compensation with fiscal responsibility, acknowledging that many municipalities are currently recruiting for Town Managers and that salary may affect the quality of candidates. Differing perspectives were expressed regarding the risk of setting expectations too high versus the importance of offering a salary capable of attracting experienced leadership. The Board also discussed whether a salary range should be included in the Town Manager Screening Committee’s recruitment materials. Following the discussion, the Board agreed not to publish a salary range and instead indicated that salary will be commensurate with experience, with final compensation to be negotiated following finalist selection and subject to available funding. Discussion on Tax Investigation Report No update was provided. Vice-Chair Jeffreys stated that he still owes the Board additional information. Discussion on Outdoor Dining Policy Chair Nuzzolo reported that the draft outdoor dining policy was not yet ready for Board review. Review remaining ARPA funding and committed funds Town Manager Lemieux stated that ARPA accounting had been updated to reflect additional accrued interest. The available uncommitted balance increased from approximately $295,000 to approximately $313,000. She stated that notice was issued through the town-wide email system inviting funding requests and that the IT Administrative Assistant shared the announcement on social media for nonprofit awareness. Town Manager Lemieux stated that requests should be submitted to a designated Select Board email distribution group, which routes to all five Board members, the Town Manager, and the Administrative Assistant. Board members noted that funding commitments must be made within approximately five months, and they expect to begin receiving proposals shortly. ===PAGE 9=== Page 9 of 13 Select Board Meeting Minutes 7/16/2024 Draft Financial Policy Manual Chair Nuzzolo stated that the draft Financial Policy Manual has been distributed to relevant departments and boards for comment. Town Manager Lemieux recently met with the Finance Committee, which raised clarifying questions, including whether adoption of the new manual would supersede prior financial policies. She stated her view that adoption would replace prior policies, while also recognizing that certain policies involve multiple boards and should be coordinated. Boards will review references and submit comments back to the Town Manager for compilation. Board / Committee Handbook Town Manager Lemieux stated there was no update at this time, but she intends to keep this item on the Board’s radar and still plans to distribute the handbook to all boards. Disposition of 925 Mass Avenue Town Manager Lemieux explained that before the property can be issued for disposition, the Board must formally declare the property surplus. She reported that the engineering review indicated the building structure is salvageable and could potentially be renovated, and that disposition preferences may be included in the vote. A Board member asked about historic district jurisdiction and whether any historic restrictions apply. The Town Manager stated that the APDC reviewed the matter and determined it was not within their purview. Motion by Member Alonzo to declare 925 Mass Avenue surplus property for disposition with preference for renovation consistent with the structural report. Seconded by Member Emkey. Call for the vote: Clerk Moore – aye; Member Alonzo—aye; Member Emkey—aye; Chair Nuzzolo—aye; Vice-Chair Jeffreys—abstained. The motion passed (4-0-1). Public Communications Policy Vice Chair Jeffreys introduced a proposed new policy (Section 2.13) regarding public communications and press releases, stating that written public communications unrelated to emergencies, community services, or community events should require Select Board approval. The member stated the goal was to ensure Select Board oversight of outward-facing public messaging. Town Manager Lemieux noted that an existing Select Board policy (Section 2.11) assigns certain communications authority to the Town Manager and expressed concern about potential policy conflict. Member Alonzo stated they would have preferred more time to review the proposal. ===PAGE 10=== Page 10 of 13 Select Board Meeting Minutes 7/16/2024 Motion by Vice-Chair Jeffreys to adopt Public Communications Policy Section 2.13 as presented. Seconded by Clerk Moore. Call for the vote: Vice-Chair Jeffreys-aye, Clerk Moore-aye, Chair Nuzzolo-aye; Member Alonzo-nay, Member Emkey-nay. The motion passed (3-2-0). CURRENT BUSINESS Draft Letter to Representative Scarsdale re: Meeting with Department of Elementary and Secondary Education on July 19th The Board reviewed a proposed letter to Representative Scarsdale regarding an upcoming meeting with DESE. Chair Nuzzolo summarized the content of the letter, which included two primary requests: (1) increased Chapter 70 education funding, including an inflation correction either through supplemental FY25 funds or during FY26 budget development; and (2) support regarding transportation funding, including reimbursement for non-regional schools, addressing the lack of competition in school bus contracting, and regulation of bus companies as essential service providers. Vice-Chair Jeffreys stated that although they may not personally agree with the state policy perspective on regional school transportation funding, the Board’s responsibility is to advocate for Lunenburg’s financial interests, and they supported the Town requesting reimbursement assistance. Motion by Member Emkey to approve the letter to Representative Scarsdale as presented. Seconded by Clerk Moore. Call for the vote: Vice-Chair Jeffreys-aye, Clerk Moore-aye, Chair Nuzzolo-aye; Member Alonzo-aye, Member Emkey-aye. The motion passed unanimously (5-0-0). FY 2025 Select Board Goals Chair Nuzzolo began the discussion on establishing FY25 Select Board goals. Members reviewed the prior year’s goals and agreed that several initiatives were not completed, in part due to shifting Town priorities and financial issues throughout the past year. Board members expressed interest in reassessing priorities and returning to the discussion at a future meeting when the Board could dedicate more focused time, possibly in a workshop format. No goals were finalized at this meeting, and discussion will continue. Minutes/Warrants/Action Items Minutes Motion by Member Emkey to approve the minutes of October 24, 2023. Seconded by Vice- Chair Jeffreys. ===PAGE 11=== Page 11 of 13 Select Board Meeting Minutes 7/16/2024 Call for the vote: Vice-Chair Jeffreys-aye, Chair Nuzzolo-aye; Member Alonzo-aye, Member Emkey-aye, Clerk Moore-abstained. The motion passed (4-0-1). Warrants The Board reviewed and acknowledged the following warrants: • Accounts Payable Warrant: $953,809.13 • Accounts Payable Warrant: $468,185.93 Action Items Member Emkey requested that meeting materials be available in the Google Drive at least one day prior to meetings whenever possible. Clerk Moore stated they would prefer additional time when feasible, acknowledging that some items arise at the last minute. Committee Reports Budget Task Force Member Emkey stated that the Budget Task Force met the prior week and will meet again next week. The first task is benchmarking both municipal and school spending. She reported that Mr. Sculimbrine was elected Chair, Ezekiel Vice Chair, and the reporting member is Clerk. The Finance Committee appointed Jean Russell as its alternate. Capital Planning Committee Member Alonzo stated that the Capital Planning Committee met and reorganized as follows: Chair – Peter Beardmore; Vice Chair – Tom Alonzo; Clerk – Matt Brenner. The Committee discussed capital submission timelines, departmental scheduling challenges, and the need for earlier review of complex capital requests to allow adequate time for questions and responses. Town Manager Screening Committee Member Alonzo stated that the Town Manager Screening Committee met to review the recruitment advertisement and will meet again to finalize posting details and discuss potential use of a recruitment consultant. ===PAGE 12=== Page 12 of 13 Select Board Meeting Minutes 7/16/2024 Council on Aging Chair Nuzzolo stated that the Council on Aging met earlier in the day and discussed ARPA funding ideas, long-term planning initiatives, expanded programming opportunities, meal service expansion, and potential renaming of the director position to better reflect service responsibilities. The retirement of the Council on Aging Director was also discussed and will be reflected in public communication. Planning Board No report; the Board did not meet the prior evening. UPCOMING MEETING/EVENTS SCHEDULE Wednesday, July 17, 2024 – Special Select Board Meeting at 6:00 PM to interview Interim Town Manager candidates. • Tuesday, July 23, 2024 – Regular Select Board Meeting. Town Manager Comment Town Manager Lemieux announced that the Council on Aging Director has submitted her intention to retire effective December 31, 2024. She noted the Director has provided exceptional leadership, and she will forward the retirement letter to the Board. Town Manager Lemieux then expressed disappointment in the Board’s earlier vote to adopt the Public Communications Policy. She stated that the policy conflicts with existing Select Board Policy Section 2.11, assigning communications authority to the Town Manager, and she believes the action was connected to a personnel matter outside the Board’s jurisdiction per labor counsel. She expressed concern that the vote was political in nature rather than administrative. Public Comment Dave Passios, 56 Whiting Street, addressed the Board. Mr. Passios commented on the earlier discussion regarding the Town Manager salary range and encouraged the Board not to “give away the bank.” He shared general salary research indicating a wide range of Town Manager compensation levels statewide and urged fiscal restraint when setting salary expectations. Board Comment Member Emkey expressed appreciation to Town Manager Lemieux, noting this was their last meeting together. She thanked her for her dedication, work ethic, professionalism, ===PAGE 13=== Page 13 of 13 Select Board Meeting Minutes 7/16/2024 compassionate leadership, and commitment to the Town, and wished her well in future endeavors. Member Alonzo also provided closing remarks to the Town Manager, praising her integrity, diligence, and service to residents and staff, and expressing regret that recent challenges contributed to her decision to leave. Clerk Moore offered clarification regarding their support for the newly adopted Public Communications Policy, stating that with two Board members expected to be absent at upcoming meetings and with the Town Manager’s planned departure approaching, it was important to ensure Select Board oversight of public communications during the transition period. UPDATE FROM THE PARKS COMMISSION Anita Scheipers, Chair of the Parks Commission, provided an in-depth update on the Marshall ===PAGE 3=== Page 3 of 8 Select Board Meeting Minutes 7/23/2024 Park Project. She confirmed that Phase 1 of the project is fully funded, consisting of $1.643 million in American Rescue Plan Act (ARPA) funding, a $500,000 Parkland Acquisitions and Renovations for Communities (PARC) grant from the state, and previously allocated Town Meeting funding for design. The total funding allows the Town to move forward with critical infrastructure and recreational improvements within the park. Phase 1 of the project includes the construction of a new pavilion, installation of basketball courts, pickleball courts, a modernized playground area, and a fully accessible bathroom facility. Ms. Scheipers stated that the bathroom facility would be constructed using prefabricated, poured concrete materials and would be delivered in two sections before being finalized on site, providing an efficient and durable solution. This building is expected to be fully ADA compliant. Ms. Scheipers further stated that the Town had contracted Skanska as the Owner’s Project Manager (OPM) to oversee project implementation and coordination. The project is currently in the designer procurement phase, with design Request for Proposals (RFPs) due by August 8, 2024. The selection of a qualified design firm will enable the Town to move into the permitting and final planning stages. Pending final design and permitting approvals, construction is expected to begin early 2025. In addition to the funding secured, the Parks Commission has submitted applications for two additional grant opportunities to further support and enhance the project. A $1 million federal Land and Water Conservation Fund (LWCF) grant, which would supplement and potentially expand project scope, and a $136,000 grant from the Massachusetts Office on Disability, intended to enhance the accessibility of recreational features and ensure ADA compliance across the entire park design. Ms. Scheipers stated that these grants, if awarded, would not only reduce the local funding burden but would also significantly improve inclusivity and usability for residents of all ages and abilities. She also highlighted the broader community engagement and support that has helped propel the project forward. Chair Nuzzolo expressed appreciation to Ms. Scheipers for the detailed update. INTERVIEWS/APPOINTMENTS/REAPPOINTMENTS/RESIGNATIONS TOWN MANAGER REPORT Town Manager Lemieux reported on vacancies across multiple boards and committees. She detailed current employment opportunities, including positions in assessing, conservation, sewer, IT, interim Town Manager, and public safety. She noted the resignation of Conservation Administrative Assistant Stephanie Dondero, effective August 1. Updates were provided on ongoing hiring efforts, RFPs, and capital projects, including Trash and Recycling Bids, due July 24, Library Solar Shade Project, due July 31, Marshall Park Designer Services, due August 8, and Senior Center Roof Project due August 29. Work continues with MRPC to support Planning functions and with MassDevelopment on the 925 Mass Ave. redevelopment project. ===PAGE 4=== Page 4 of 8 Select Board Meeting Minutes 7/23/2024 CURRENT BUSINESS Select Board Staff Appreciation Chair Nuzzolo raised the idea of informal or organized staff appreciation efforts by the Board. Members expressed support and discussed options for increased engagement, recognizing staff morale and the transition to a new Town Manager. Recreation Director: Increase in Hours The Board considered a request to increase the Recreation Director’s hours from 19 to 28 hours per week, to be paid from the Parks Revolving Fund. Town Manager Lemieux noted the increase was needed to meet job responsibilities, process invoices for the Marshall Park project, and expand programming. Motion by Member Alonzo to approve the additional hours for the Recreation Director as presented by the Town Manager. Seconded by Vice-Chair Jeffreys. Roll Call Vote: Member Alonzo—aye; Member Emkey—aye; Vice-Chair Jeffreys—aye; Chair Nuzzolo— aye. The motion passed unanimously (4-0-0). FY24 Third Quarter Financial Report Town Manager Lemieux reported that all revenues and expenditures were tracking appropriately. The Finance Director will provide a full presentation to the Finance Committee later in the week. OLD BUSINESS Public Communications Policy Discussion The Board revisited the Public Communications Policy adopted at the previous meeting. Members Alonzo and Emkey raised concerns that the vote violated Select Board policy requiring four affirmative votes to adopt a new policy. Chair Nuzzolo and Vice-Chair Jeffreys disagreed, asserting the policy remained in effect. Following extensive discussion, the Board agreed to revisit the matter at a future meeting when all five members are present. Interim Town Manager Search: Possible Vote on Interim Town Manager Contract The Board discussed the contract for Carter Terenzini to serve as Interim Town Manager, which had previously been reviewed in Executive Session. Chair Nuzzolo confirmed there was no further discussion and the Board proceeded with a vote. Motion by Member Alonzo to approve the contract as discussed in Executive Session, contingent upon review and approval by labor counsel. Seconded by Vice-Chair Jeffreys. ===PAGE 5=== Page 5 of 8 Select Board Meeting Minutes 7/23/2024 Roll Call Vote: Member Alonzo – aye; Member Emkey – aye; Vice-Chair Jeffreys – aye; Chair Nuzzolo – aye. The motion passed unanimously (4-0-0). Town Manager Salary Range The Board reviewed comparative salary data for Town Manager positions in other communities. However, Town Manager Lemieux explained that the examples available were not ideal matches due to differing community sizes and budgets. Member Alonzo, who serves on the Town Manager Screening Committee, indicated that the group plans to consult with the recruitment firm for guidance on setting a market-appropriate salary range. The Board agreed that it would be best to await feedback from the recruiter before finalizing any decision. Outdoor Dining Policy Chair Nuzzolo stated that some administrative components, particularly how applications would be reviewed and approved by staff, were still being finalized. As the temporary policy remains in place, the Board agreed to postpone further review of the permanent version until the full Board is present. Review ARPA Funding Requests and Committed Funds Town Manager Lemieux provided an update on the American Rescue Plan Act (ARPA) funding. She explained that all ARPA funds must be obligated by December 31, 2024, meaning they must be under a signed contract or agreement, and fully expended by December 31, 2026. Chair Nuzzolo stated that several new ARPA proposals have been submitted in response to the Town’s call for additional requests, but the Board agreed to hold off on evaluating them until the application window closes in early August. Town Manager Lemieux confirmed that most previously approved projects are under agreement and on track to meet federal deadlines. However, she advised that the Board review all allocations to ensure that any at-risk funding is either confirmed or reallocated in time. Vice-Chair Jeffreys proposed allocating $15,000 in ARPA funds to support the Town Manager Screening Committee’s engagement of a professional recruitment firm. Motion by Member Alonzo to allocate $15,000 in ARPA funds for recruiting services and to request an equivalent reserve fund transfer from the Finance Committee, allowing flexibility to shift the funding source later if approved. Seconded by Member Emkey. Roll Call Vote: Member Alonzo – aye; Member Emkey – aye; Vice-Chair Jeffreys – aye; Chair Nuzzolo – aye. The motion passed unanimously (4-0-0). Draft Financial Policy Manual The Board noted that the draft Financial Policy Manual had been distributed to department heads ===PAGE 6=== Page 6 of 8 Select Board Meeting Minutes 7/23/2024 and relevant boards for review and feedback. As of the meeting, no formal comments had been submitted. The Board agreed to keep the item on future agendas for continued review. Board/Committee Handbook Chair Nuzzolo stated that the handbook had been distributed for feedback, but no comments had been received. The item was continued to a future meeting. Sign Intermunicipal Agreement with Leominster for Wastewater Collection, Treatment, and Disposal Town Manager Lemieux presented the revised Intermunicipal Agreement (IMA) with the City of Leominster for wastewater collection, treatment, and disposal services. She explained that legal counsel had reviewed the agreement and recommended only minor adjustments, primarily formatting and legal citations. The Lunenburg Sewer Commission had already approved the agreement. Motion by Member Alonzo to approve the Intermunicipal Agreement with the City of Leominster for wastewater collection, treatment, and disposal as presented. Seconded by Vice-Chair Jeffreys. Roll Call Vote: Member Alonzo – aye; Member Emkey – aye; Vice- Chair Jeffreys – aye; Chair Nuzzolo – aye. The motion passed unanimously (4-0-0). MINUTES/WARRANTS/ACTION ITEMS Minutes The Board postponed approval of the July 16 minutes. Members noted that the draft, generated using an AI tool, requires additional review for accuracy. The Board emphasized that while AI may expedite the process, all minutes must be carefully reviewed to ensure they are complete and correct before approval. Warrants The Board reviewed and signed two accounts payable warrants. The first was in the amount of $479,454.47, and the second totaled $151,597.12. Only two signatures were available at the meeting; the remaining board members were asked to visit Town Hall to complete the signatures as soon as possible. Action items Vice Chair Jeffreys requested that the Board revisit the request from Flat Hill Road residents to lower the speed limit, citing continued resident concerns despite recent traffic data. He also raised an urgent issue on behalf of Chapdelaine, a longstanding local business that is currently ===PAGE 7=== Page 7 of 8 Select Board Meeting Minutes 7/23/2024 unable to operate due to an error on its license. He urged the Board to consider an expedited correction process. Member Emkey requested that Town Manager Lemieux follow up with Town Counsel regarding the Board’s public communication policy to clarify the current procedure. Town Manager Lemieux confirmed that she would do so. Board members agreed to continue reviewing these items at upcoming meetings. COMMITTEE REPORT Member Alonzo reported that the Finance Committee met the previous week to review budget items and discuss scheduling for fall meetings. He noted that the committee plans to continue its review of the financial policy manual in coordination with the Select Board and the Town Manager. Member Emkey reported that the Stormwater Task Force and Budget Task Force have resumed meetings to address regulatory compliance and long-term financial planning. She also noted that the School Committee will be discussing ARPA at their next meeting. Vice-Chair Jeffreys shared that Library Trustee Bob Conroy had recently passed away. He noted that services would be private, though a public memorial may be held. He expressed condolences to the Conroy family and members of the Library Trustees for their loss and acknowledged Mr. Conroy’s longstanding service to the community. Chair Nuzzolo reported that the Planning Board met the previous evening and continued its public hearing for stormwater approval related to 255 Sunnyhill Road. Although no vote was taken due to the absence of one board member, it is expected that the project will be approved at the next meeting. The hearing was continued solely to allow for the vote. UPCOMING MEETINGS/EVENTS SCHEDULE The Board confirmed its next meetings will be held on August 6, August 13, and August 20, 2024. There will be no meeting the week of July 29. PUBLIC COMMENT Town Manager Comment Town Manager Heather Lemieux offered heartfelt remarks during her final Select Board meeting. She expressed gratitude to residents, board members, staff, business owners, and state officials, reflecting on her seven and a half years of service. She outlined major accomplishments, including long-term staffing plans for public safety, significant capital ===PAGE 8=== Page 8 of 8 Select Board Meeting Minutes 7/23/2024 improvements, enhanced ADA accessibility, and infrastructure projects such as Complete Streets initiatives, Summer Street improvements, and bridge funding. Town Manager Lemieux emphasized that her proudest achievements were the relationships built during her tenure. She clarified that her resignation was not requested by the Board and attributed her decision, in part, to a loss of trust. She concluded by thanking her family for their support and reiterated her commitment to having served Lunenburg with dedication and integrity. Public Comment Resident John Bowen, 162 Highland Street, expressed appreciation for Lemieux’s service and raised concerns about a town policy he believes violates public employee speech rights and open meeting law. He criticized recent actions by certain board members and objected to the use of AI in preparing Select Board minutes. Resident David MacDonald, 155 Island Road, stated that he sees it as political manipulation on the Board and reiterated support for Lemieux. He called on a board member to resign and expressed disappointment in the direction of Town leadership. Board Comment Board members thanked the Town Manager for dedication and contributions to the Town of Lunenburg and wished her well in her future endeavors. ADJOURNMENT Motion by Vice-Chair Jeffreys to adjourn. Seconded by Member Alonzo. Roll Call Vote: Member Alonzo – aye; Member Emkey – aye; Vice-Chair Jeffreys – aye; Chair Nuzzolo – aye. The Pledge of Allegiance was recited. Chair Nuzzolo noted that it was being recorded and broadcast live on Lunenburg Public Access Channel, Facebook Live, and would be uploaded to the Lunenburg Access YouTube channel. BOARD COMMENTS: None PUBLIC COMMENTS George Burden, 39 Cortland Circle, raised issues regarding unfulfilled public document requests directed at the interim town manager. He highlighted issues surrounding a property dispute involving a shed on common land, tied to perceived retaliatory actions connected to potential preferential tax treatment for certain individuals, suggesting a connection to board member Mr. Jeffreys. He expressed frustration over non-receipt of requested documents and alleged obstructions in communication channels. Chair Nuzzolo assured that there would be follow-up on these document requests. ANNOUNCEMENTS Chair Nuzzolo shared announcements including a flu vaccine clinic hosted by the Nashoba Board of Health is scheduled for October 3 rd from 3:00 PM to 5:00 PM at the Lunenburg Library. Seconded by Member Emkey. All, aye. Passed unanimously (5-0-0). ===PAGE 2=== Page 2 of 5 Select Board Meeting Minutes September 10, 2024 INTERIM TOWN MANAGER REPORT Mr. Terenzini provided a comprehensive update on staffing vacancies, reporting progress in the recruitment of various positions including the land use director, administrative assistant, seasonal laborers, and public safety desk staff. Despite efforts, certain roles such as the assistant sewer business manager remain unfilled. Mr. Terenzini acknowledged the critical role of volunteers in town operations, noting vacancies on multiple boards, including the Agricultural Commission, Architectural Preservation District Commission, Board of Health, Conservation, Cultural Council, Green Communities, Historical Commission, Open Space Committee, and the Sewer Commission. Mr. Terenzini elaborated on ongoing infrastructure projects and funding concerns. He reported on the community's need to find suitable candidates for the Sewer Commission and efforts to schedule a joint meeting between the board and the commission. In discussions with Chris Ruth, facilities director, Mr. Terenzini highlighted operational challenges, particularly focusing on municipal buildings such as the TC Passios, the Ritter building, and the Adult Activity Center roof replacement project. Financial concerns were raised regarding projected shortfalls for planned renovations due to escalating costs over time. Mr. Terenzini underscored the potential requirement to augment the facilities maintenance budget at town meetings to avert deficits. Efforts to streamline certain town processes, for example, making forms fillable online to facilitate volunteer applications, were also underway, promising to enhance operational efficiencies. OLD BUSINESS Review ARPA Funding requests and committed funds: Mr. Terenzini discussed concerns regarding committed funding deadlines related to ARPA. He noted that there had been concerns regarding wage rates, which led to a review with town counsel. Upon review, the conclusion was that the previously thought wage rates did not apply. Additionally, Mr. Terenzini mentioned that the senior center was preparing to order its equipment while promising the board an actual expenditure report by the next week. The interpretation of 'committed' funds under ARPA has been an issue as it changed from defined commitments to being under contract, which affected timelines for certain projects. Member Jeffreys highlighted concerns from the library trustees, who are striving to get their projects to the RFP stage by addressing delays, such as cost estimation, which is seen as the main hold-up at present. The board is very conscious of these deadlines and the need for projects to be under agreement to ensure funding is retained prior to potential reallocation. Mr. Terenzini reassured the board that there were efforts to ensure progress on these projects, with additional input from Chris Ruth regarding cost estimators and assistance from interim town contacts to push things forward. Draft Financial Policy Manual: Mr. Terenzini introduced a draft of the financial policy manual, encouraging members to review and provide commentary within three weeks. Board/Committee Handbook: No current updates were provided. Mr. Terenzini indicated the handbook would become a focus once financial policies were reviewed. ===PAGE 3=== Page 3 of 5 Select Board Meeting Minutes September 10, 2024 FY’25 Select Board Goals: Interim Town Manager highlighted the importance of involving various departments to identify necessary resources for achieving board goals in the fiscal year. The board considered implementing workshops, either within regular meetings or as separate sessions, to ensure in-depth discussions on aligning goals with actionable steps to establish a clear path for future town planning. Chair Nuzzolo: • Emphasized the need for strategic budget management, focusing on staffing and municipal buildings to meet financial and infrastructure challenges in the town. • Staffing and employee development were prioritized, with an emphasis on staff recognition, ongoing training, and structured annual performance evaluations to encourage continuous improvement. • Municipal buildings were a focal point; particularly the Ritter building and TC Passios, which face funding shortfalls and rising renovation costs due to aged infrastructure. • Maintaining alignment between select board and administration efforts on budgetary goals, project timelines, and staffing remained a discussion priority. Member Moore: - Goal-Setting Process: • Establish a formal annual goal-setting process • Engage town departments and key stakeholders. • Foster community involvement through public forums, surveys, and digital tools. • Establish clear and measurable objectives for transparent progress. - Staff Retention, Development, and Communication: • Create a town-wide employee recognition policy. • Conduct regular surveys to assess job satisfaction and identify improvements. • Offer training programs, workshops, and educational opportunities. • Enhance communication between the select board and town employees, within charter limits. - Transparency and Accessibility: • Launch an informative public dashboard for easy access to town data. • Guarantee timely posting of meeting agendas and minutes. • Make Select Board Meeting materials available to the public. • Enhance communication via social media, local media, and town website. • Establish regular public office hours for select board member-resident interactions. • Offer "Lunenburg 101" sessions to educate and engage residents in governance. Flat Hill Road Speed Limit: Mr. Terenzini informed attendees of ongoing discussions with key departments about addressing community concerns while adhering to regulatory requirements. ===PAGE 4=== Page 4 of 5 Select Board Meeting Minutes September 10, 2024 CURRENT BUSINESS Minutes/Warrants/Action Items Minutes: Continuous use of AI-generated minutes was criticized for its quality, with instances highlighted where the content was deemed unintelligible, underscoring the need for accurate and comprehensive meeting documentation. Mr. Terenzini apologized for the oversight and highlighted ongoing efforts to address the backlog.
