Belliveau; file ______________________________________________________________________________ As a follow-up to the revised agenda for this evening, you have asked for a plan to ensure we use all ARPA dollars as required by statute. At this point I can only give you my thoughts in broad strokes as there are still numerous unknowns. Those are primarily the results of project bidding: Tree Trimming $25,000 Due 10/10 DPW Roof $65,000 Due 10/23 DPW Floor $60,000 Due 10/23 Sewer Manhole Repair $100,000 Due 10/23 Mun. Bldng. Design Comm. $225,000 Target 10/28 Library Teen Room $120,000 Target 11/04 Library Exterior Envelope $60,000 Bid Result $38,000 (w/+15%) Some of these (see Library) may have underruns which then need to be applied elsewhere and the wildcard of getting to contract for the municipal building design committee. While steering a bit off ARPA projects, I do want to also remind you that also have a number of Capital Projects which appear to be underfunded (Adult Activity Center roof by $10k+/-). In order to ensure we fully expend the funds it is my proposal that, to the extent needed, we: 1.) Purchase all DPW trucks w/ARPA reallocating unused funds to capital projects; 2.) Apply ARPA underruns to ARPA project over-runs and then capital over-runs; 3.) Adjust any quantity contracts upwards (Tree Trimming and Manhole Repairs); and 4.) Consider directing funding to foodstuffs for the local food pantry. ===PAGE 4=== Town of Lunenburg Select Board Caesar Nuzzolo, Chair 17 Main Street Michael-Ray Jeffreys, Vice Chair Amanda Moore, Clerk Tom Alonzo, Member Renee Emkey, Member P.O. The Brooks House is an attractive, historic building located at 1033 Massachusetts Avenue. The article seeks to create the conditions for the building’s restoration, renovation, and valuable reuse, using private funds and initiative. In order to achieve this, the article asks Town Meeting to instruct the Selectboard to sell the building along with a minimal lot footprint. The Brooks House has a rich history, pre-dating the Civil War (built in 1835). It is an architecturally significant building, located at a prominent vista approaching the historic Lunenburg Town Center. Its present condition is habitable, but in need of significant repair. The Town of Lunenburg acquired the property in 1946 and it is still owned by the town. In recent times, until around 2011, the Brooks House was used as the office for the Superintendent of Schools, who relocated to the current office in the TC Passios Building. Following that, the property was partially leased to The Lunenburg Ledger for a brief period, until roughly five years ago. More recently, the main area of the house was occupied by the Lunenburg Public Schools Facilities Director, who has since also moved to the TC Passios Building. As a result, the Brooks House is now vacant, though the town continues to incur costs to heat the building, to maintain fire protection, and maintain the envelope of the building. The Brooks House is one of the buildings that the Town Building Reuse Committee, with varying memberships over about 10 years, has been considering for town government purposes. The general consensus has been that it is not well suited for the requirements of town departments. The Brooks House is in the Architectural Preservation District as well as the Village Center District, and falls under the protections and zoning of those bylaws. As such, it cannot be demolished without the consent of the APDC or a ===PAGE 135=== vote of town meeting. These protections are necessary but not sufficient for preservation of this building. Absent a compelling use for the building, the town is unlikely, out of fiscal responsibility, to continue to allocate the funds needed to prevent the building from falling into disrepair. Without private reuse, the building will likely end up being demolished due to progressive neglect by the town, much like the Old Primary School building before it. At present, the building is still overall structurally sound. It is attractive for private mixed-use repurposing due to several factors: ● Permissive mixed-use zoning of the Village Center District. ● The building possesses a fire-prevention system that is required for many business uses. ● Potential for good foot traffic and convenient location with visibility on Mass Ave in Town Center. Therefore, given the following facts: ● The building is desirable for private, mixed-use repurposing. ● The town does not have a public use for the building at this time. ● The size and location of the parcel are in no way essential for further redevelopment of the town’s property for other uses. ● Residents of the Town have consistently prioritized retention of the town’s historic character and structures, both by passing the APD bylaw in 2015 and as recently as 2024 in surveys and public working sessions related to updating the master plan. ● Needed protective repairs and routine maintenance and upkeep are costly to the town. ● Renovating the building would be costly to the town. ● Demolishing the building would be costly to the town. ● Conveying the building and lot for private use would produce tax revenue. ===PAGE 136=== ● Solving the future of this building further simplifies the overall equation for building reuse. ===PAGE 137=== MEMORANDUM – OFFICE OF THE TOWN MANAGER 17 Main Street * Lunenburg, MA 01642 * (978) 582-4144 cterenzini@lunenburgma.gov * www.lunenburgma.gov TO: Select Board FROM: Carter Terenzini, Interim Town Manager RE: Weekly Report DATE: October 1, 2024 CC: Department Heads; file ______________________________________________________________________________ Appointment 1 – Nicholas Green Submitted for ratification, is the appointment of Nicholas Green to the position of Seasonal Cemetery Laborer. This position has been difficult to recruit for this season. We’ve had 2 employees that were hired late in the season but left the end of August to return to school. Since then, the DPW Director and Cemetery Superintendent interviewed 3 applicants and 1 no show. An offer was made to a candidate and ratified by the Select Board and the candidate failed to complete the onboarding process. Nick has some experience maintaining grass. He is a quick learner, works well under pressure and has taken on bigger roles in other positions. Nick is a resident of Lunenburg and is eager to help maintain the cemeteries in any way he can. Appointment 2 – Autumn Buck Submitted for ratification, is the appointment of Autumn Buck to the position of Seasonal Cemetery Laborer. As stated earlier, this position became available once the other Laborers went back to school in the end of August/early September. Autumn is a highly qualified candidate having performed the same work at a State Park and loves working outdoors. Autumn is a resident of Lunenburg and has a conservation background. We are excited to bring Nick and Autumn aboard. They are going to be a great help for the Cemetery Department. FYI – An offer was made for the Administrative Assessing Assistant and tentatively accepted. However the candidate subsequently us they will no longer be accepting the position. ===PAGE 138=== Weekly Update October 1, 2024 Page 2 Project Updates A contract has been awarded for the LAAC Roof Bid. The project will be completed within 30 days of contract award. Award for the RFQ for the Lunenburg Historic Properties Survey is underway and will be reviewed at the upcoming Historical Commission meeting on October 1st. Award for the Library Exterior Paint project is in process. The following bids went out yesterday. Responses are due on October 23 rd: • DPW Flooring - due at 10:00 am • DPW Partial Roof Replacement - due at 12:00 pm • Sewer Manhole Rehabilitation – due at 1:00 pm The Solicitation for Tree Cutting Services were emailed to contractors today. Proposals are due on October 10 th at 10:00 am The Municipal Building Design has been submitted to the Goods and Services bulletin and Commbuys and will be available next week. Proposals are due on October 28 th at 12:00 pm Upcoming scheduled projects are: • Library Teen Room – anticipated release date October 9 th, bids due November 4th. • Town Hall Roof and Chimney - anticipated release date October 9th, bids due November 4th • It’s our hopes to the Ritter Building roof, trim and gutters, as well as the Ritter windows to follow within the next week or so General Matters The TC Passions deficit has now been eliminated by making transfers from a variety of accounts in the Facilities Department and other related accounts. I want to be clear that the School Department is current on all of its rental and operation responsibilities for the building. The staff has begun a series of discussions on how we might best meet space needs in a manner that addresses the repair needs of the building, allocates costs and responsibilities (i.e. cash and in kind) over the near term (which we have discussed as a period of five years) and reduces the understanding to writing so that the general public understands the roles and responsibilities of all the departments. Thanks to an assistant from PACC, I was able to record a 30-minute Talk of the Town Show which introduced our new Waste Hauler to the community and discussed details. You can find that recording on youtube.com/@LunenburgAccess. ===PAGE 139=== I held two listening sessions for employees with 40+/- in attendance. It seemed well received. A fuller report will be forthcoming but as a reader’s digest versions their comments that can be addressed in the near future are: - Status of PD once Chief Gammel retires; - Holiday, sick leave and vacation time for the under 20hrs/wk (PTO); - An employee recognition program; - Sick Leave donations for those in need which has been on a situation-by-situation basis; - Reimbursement process for employees; - IT issues; - Standardized operating procedures Toward resolution of these we have or will be: - Submitting the PTO/Sick Leave Bank and Employee Recognition issues to the Fall Town Meeting and many other required amendments to the SAP; - Bringing the Interim Police Chief and final search process before the SB on 10/08; - Bringing a new reimbursement process (and/or Purchase Credit Card) before the SB by 11/01 (Select Board meeting is 11/05); - Established a team of employees (Annie A; Samantha T; Logan O) to work on organizational wide SOPs, standardizing the document retention process, compiling training material for employees to further utilize platforms such as SharePoint and Opengov; as well as, improving the onboarding process for both employees and volunteers for Boards and Committees. They will be given one hour a week to meet outside of their normal work duties on this matter; and - Had an after-meeting confab between concerned staff and our current Network Liaison and then myself and Suzor to try to set a path forward (some of the issues actually driven by the use of older software not properly licensed to the Town); The Finance Team is very close to being able to close out FY ’24 and submit our trial balance awaiting a few final adjusting entries for one of our larger departments. We are a bit behind what I had hoped for but subject to those final adjustments I think we can get our trial balance out to DOR the week of 10/7 to get our free cash certified. I have reviewed the 925 Mass Ave RFP and had some questions/comments I have circulated to Counsel and Land Use. I hope to get it issued by the end of next week. I will be in the office next Tues/ Wednesday /Thursday. ===PAGE 140=== Town of Lunenburg Select Board Caesar Nuzzolo, Chair 17 Main Street Michael-Ray Jeffreys, Vice Chair Amanda Moore, Clerk Tom Alonzo, Member Renee Emkey, Member P.O. Chair Nuzzolo noted that it was being recorded and broadcast live on Lunenburg Public Access Channel, Facebook Live, and would be uploaded to the Lunenburg Access YouTube channel. BOARD COMMENTS: None PUBLIC COMMENTS George Burden, 39 Cortland Circle, raised issues regarding unfulfilled public document requests directed at the interim town manager. He highlighted issues surrounding a property dispute involving a shed on common land, tied to perceived retaliatory actions connected to potential preferential tax treatment for certain individuals, suggesting a connection to board member Mr. Jeffreys. He expressed frustration over non-receipt of requested documents and alleged obstructions in communication channels. Chair Nuzzolo assured that there would be follow-up on these document requests. ANNOUNCEMENTS Chair Nuzzolo shared announcements including a flu vaccine clinic hosted by the Nashoba Board of Health is scheduled for October 3 rd from 3:00 PM to 5:00 PM at the Lunenburg Library. The clinic is open to all ages and preregistration is required at neshoba.org/calendar. Attendees are asked to bring their insurance cards; however, those without insurance will not be turned away. Additionally, the Lunenburg Agricultural Commission will host an agricultural fair on October 5th, from 10:00 AM to 2:00 PM, at TC Passios. APPOINTMENTS Bicycles Battling Cancer Request to Pass through Lunenburg on September 22, 2024. It was noted that necessary approvals from both the police and fire chiefs had been obtained. Seconded by Member Emkey. All, aye. Passed unanimously (5-0-0). ===PAGE 144=== Page 2 of 5 Select Board Meeting Minutes September 10, 2024 INTERIM TOWN MANAGER REPORT Mr. Terenzini provided a comprehensive update on staffing vacancies, reporting progress in the recruitment of various positions including the land use director, administrative assistant, seasonal laborers, and public safety desk staff. Despite efforts, certain roles such as the assistant sewer business manager remain unfilled. Mr. Terenzini acknowledged the critical role of volunteers in town operations, noting vacancies on multiple boards, including the Agricultural Commission, Architectural Preservation District Commission, Board of Health, Conservation, Cultural Council, Green Communities, Historical Commission, Open Space Committee, and the Sewer Commission. Mr. Terenzini elaborated on ongoing infrastructure projects and funding concerns. He reported on the community's need to find suitable candidates for the Sewer Commission and efforts to schedule a joint meeting between the board and the commission. In discussions with Chris Ruth, facilities director, Mr. Terenzini highlighted operational challenges, particularly focusing on municipal buildings such as the TC Passios, the Ritter building, and the Adult Activity Center roof replacement project. Financial concerns were raised regarding projected shortfalls for planned renovations due to escalating costs over time. Mr. Terenzini underscored the potential requirement to augment the facilities maintenance budget at town meetings to avert deficits. Efforts to streamline certain town processes, for example, making forms fillable online to facilitate volunteer applications, were also underway, promising to enhance operational efficiencies. OLD BUSINESS Review ARPA Funding requests and committed funds: Mr. Terenzini discussed concerns regarding committed funding deadlines related to ARPA. He noted that there had been concerns regarding wage rates, which led to a review with town counsel. Upon review, the conclusion was that the previously thought wage rates did not apply. Additionally, Mr. Terenzini mentioned that the senior center was preparing to order its equipment while promising the board an actual expenditure report by the next week. The interpretation of 'committed' funds under ARPA has been an issue as it changed from defined commitments to being under contract, which affected timelines for certain projects. Member Jeffreys highlighted concerns from the library trustees, who are striving to get their projects to the RFP stage by addressing delays, such as cost estimation, which is seen as the main hold-up at present. The board is very conscious of these deadlines and the need for projects to be under agreement to ensure funding is retained prior to potential reallocation. Mr. Terenzini reassured the board that there were efforts to ensure progress on these projects, with additional input from Chris Ruth regarding cost estimators and assistance from interim town contacts to push things forward. Draft Financial Policy Manual: Mr. Terenzini introduced a draft of the financial policy manual, encouraging members to review and provide commentary within three weeks.
