Bob asked if the policy is consistent with those of the Board of Health and Planning Boards. Paula affirmed that it is and stated that it involves the details of taking in a project review fee and placing it in a special account to be used to cover the costs of a professional engineering review. Paula asked for any comments from the public. Dick Marceau asked how soon can they do the project to install sewer in his area? Paula stated that this policy allows interested parties a process of coming forward to propose a sewer project. No other discussion was forthcoming. Paula stated she would entertain a motion to adopt the Project Review Fee & Policy. Carl moved the motion, Bob seconded and the vote was unanimous. Public Hearing was ended and the regular meeting commenced at 7:15pm. Before starting on agenda items, Paula asked if Dick was present on any particular item of interest. Dick asked how soon sewers will come to his area on Eastern Ave. Paula responded that there is no timetable, the issue being that the CWMP states an estimated cost of $$24,000 to each resident impacted by a sewer project and that 2/3 of the people in that area must agree to the project moving forward per the bylaw. Paula noted that if 2/3 were in agreement, then we would move forward and take it before Town Meeting. Mr. Bowen, who had brought the petition to the Commission, wanted the Commission to hire an engineer to estimate the true cost of bringing sewer in -but the Commission feels strongly that they have invested in an engineering tirm already (Wright Pierce) and can't go before the Town to pay more to get another quote. If an individual group wants to pay to hire a different engineer to get a different estimate, that is up to them. Dick's contention was that the $24000 figure was an estimate across the entire town but he is only talking 1 street - with approximately 9 homes - and asked how much that would be. Paula replied that she wouldn't know and that the preference of the Sewer Commission was to install sewer in entire zones but that it isn't required that they do. Dick stated that Upland and Eastern Aves would be a gravity drain. Carl added that if it were him, if there were interest, that the group approach Wright Pierce who did this work and ask what they'd estimate that the cost would be for that area. Steve said a new eye on the project may be helpful also. Paula stated that we can't at this point go into the Enterprise Fund and pay to have the cost re-estimated. Steve also noted that, knowing what we know, Dick's area would cost probably even more due to the fact that it is all ledge. He recalled the laying of the lines on Electric and how long it took to drill down through the ledge to lay the pipes they did. Dick asked what's the next step - do we have hire an engineer? Paula replied that if you are questioning the $24000, then you would want to get your own engineer. But, if you are comfortable with the $24000 and can get 2/3 interest, we would go to Town Meeting and start the process. Dick asked if he was getting an engineer only to get an estimated cost. Steve agreed and Bob noted that it cannot be just a contractor but a professional engineer. Paula agreed and noted that even though one provides an estimate to the group, they may not be the engineers to do the work. Every engineering firm would have to go through the formal bid process to be awarded the contract to install sewer. Dick stated that we were back where we started. The estimate seems very high but agrees the area is all ledge. Steve pointed out that Eastern was at the high end, lower Mass Ave. wouldn't be as bad. Eastern & Upland would be 2 of the hardest streets to lay sewer lines. Paula noted that the figure in the WMP is only an estimate and without specific knowledge of specific areas, the $24k figure is merely an estimate. She also acknowledged that the Commission wants sewer customers, so it is not that we don't want to lay new sewer lines but it is about the cost and that we are sorry we don't have a better answer. Dick replied that for now, most systems are working and it isn't a problem. But it will become a problem. Weston & Sampson - Fran Yanuskiewicz and Steve Peterson from W&S came forward. Fran informed the Commission that Steve had worked on Fitchburg's rate structure and may have knowledge helpful to the Commission. Fran recounted that he had sent his proposal in last week which focused on the IMA negotiation but it is subject to change and that is what they were here to discuss. Paula stated that she and Fran had had a conversation earlier and the amount we had raised at town meeting ($15,000) had been solely earmarked for the IMA but we have many other issues for which we need W&S help. Steve D. repeated the issues from the conversation with Joe Jordan on why their rates are so high - that it was funded by the General Fund, not an Enterprise, so all improvements are on the backs of the users - and that Joe understands the problem. Paula stated that we have issues not only with the verbiage of the IMA, but in understanding the costs going forward. She noted that we need to raise our rates again, but need to understand the costs to do it correctly. Fran discussed the verbiage of the current IMA - no conflict resolution clause, need to know if we pay on improvements just until loans paid off - these need to be spelled out. Carl agreed that, as far as using the entire allocation of $15000 on a current IMA, he is more interested in what happens next. We need to be prepared going forward. Paula said we need to look at other issues (i.e. grease). She can come up with 4 more issues in addition to the IMA that we need W&S's expertise on. Steve D. reiterated that the IMA is the most pressing. We do not have capacity and if a couple big properties come forward, we owe them capacity. Fran pointed out that we'll need to discuss how we want to pay for what we're getting. Carl asked why we have to pay for some capital improvements. Bob brought up the question -to lessen the amount that W&S charges, what can we do ourselves? Fran repeated that this is an estimate and IMA negotiations can be short and others drag on - that it all depends on the parties involved and how close in agreement they are. Steve D. said there is no issue talking to Joe in ===PAGE 2=== Charter, we advise only - Selectmen will sign the agreement. Fran noted that hell need to know who is at the table - Joe, Sewer Commission or City Council. Bob added that we need to know the Selectmen's issues with the agreement. Paula contirmed that they agreed with the hiring of a consultant. Bob made the motion to approve the contract with Weston & Sampson subject to the revision of the amount for the IMA to no more than $10,000 and $5,000 for other issues and, once revised, to authorize the Chairperson to sign on the behalf of the Commission. Carl seconded, vote taken was unanimous. Paula asked if we could have the final document back by Tuesday, in time to be brought before the Selectmen at their Tuesday meeting. Fran agreed and noted that this project will take a lot of work on the Commission's part. Paula agreed it will be a lot of work, and Steve D. added that everyone knows it is needed. Fran pointed out that often it is the behind-the-scenes discussions can be very helpful to keep it moving forward. If it continues to be a friendly, cordial discussion, it works out a lot better for all. Paula noted that they need to move quickly and efficiently as both she and Steve D. are going off the Commission soon. Fran stated he will provide some bulleted items - conflict resolution, flow cost, capital costs, legitimate support costs- and added that alot of towns pay for the department on the back of the Enterprise fund, passing fees along. Bob asked again, what can be done in the meantime - what type of physical process or information needs to be compiled? Fran said he would put together a list of things we need and what Fitchburg needs to provide. He asked if they have ACO (Administrative Consent Order)? Paula answered that they do. Fran said we could ask for the 1) ACO, 2) Capital Plan - years, etc. 3) Recent Budget with Chart of Accounts - which would list indirect costs & capital expenditures and will also show where they stand with their bonds, the principal and interest. Fran said that if Barb could get these from Fitchburg and forward big chunks of information, it would help. He will talk with Barb on what needs to be requested. Paula re-stated that we will expect the revision and asked Fran when he thought a workshop would be useful. Discussion ensued and decision made to have W&S come back on 2/10 to the Ritter, not as a workshop, but part of the regular meeting. Paula said she would let the Selectmen know in case they wished to attend on 2/10. Stone Farm -Paula asked Fran for his advise on the issue with a condo development contesting betterments, and gave him a brief history of the Stone Farm issue, adding that the liens were all placed properly and that the new owner is questioning our authority to put liens on the un-built condos. Paula asked Fran, "any knowledge of betterments being overturned"? Per Fran, issues always seem to arise on multi-family and on change of ownership and that this is a question that is better to ask of town counsel. Bob stated that the liens were recorded at the Registry so Fran agreed that the new owner took ownership fully aware of the liens. Paula reiterated that the time for filing abatements has long passed and this was told to him at a meeting last fall. Fran stated that even though a unit may not be built, they can arrange to pay interest only. Paula asked for the clarification that they can't ask for a reduction in the amount of the betterment. Fran advised her to check with Koppelman & Paige. Steve D. said to not spend any more time or money on it until we get a letter from the attorneys. Bob noted that he had studied the title and the application of the betterments. Discussion followed on how taxes and betterments are applied.. Paula stated that we will deal with the attorneys if contacted. CWMP-Paula asked everyone to look at the list of issues' and add any that they may still have. Barb noted that the 2nd MEPA filing and the EIR still needs to be discussed. Paula stated that we need to know the cost estimate for the of filing with MEPA and will call Kevin on the MEPA filing items on the list. Paula still wants to look at Table 2-5 with the proposed developments and be sure there are no changes. If anyone has issues to add to the list for Kevin, please send to Barb by Wednesday 1/20 and she will compile the list for Kevin. Lunenburg Village 40B - Barb informed the Commission that Lisa Normandin had sent Barb's email of 1/8 with our concerns and request to Brian Milisci of Whitman & Bingham and that she had not heard anything back as of 1/13 but that the next hearing on the 40B was not until February 10. Paula noted that for now there is nothing to do. Paula asked if Lunenburg Village was included in the flows in the CWMP? Barb confirmed that it does appear on the proposed development table she had from Marion as of 12/16. Paula still wants to check the table in CWMP. Mass 2 Pump station - Barb reviewed the recent activity by Corey Down, trying to get pump repaired - whether to rebuild or purchase new - none of the pumps are the same voltages to allow for swapping between stations, nor are they standard, even to the manufacturer. Paula asked about the status of the Purchase of Service account. Barb pointed out that there is the budget sheet in the packages and that we still have a substantial amount in Purchase of Service account. Steve asked about the vetting of the lines. Barb mentioned that both Jim B & Corey D feel it would be better email to Kevin O. 1/12/10 ===PAGE 3=== approval from the Sewer Commission nor Selectmen and only the allocation approval. In fact, in one document, it was made quite clear that only an allocation had been approved and that a plan had never been received for review. Hence, if there was no plan, there was no approval. Emerald Place-Barb clarified that, after the discussion at the last meeting, she confirmed with the Collectors office that only betterments billed to date have been paid - they did not pay off the entire betterments up front. Sewer bylaw - Paula stated that she had missed the email of 12/22 and is doubtful whether our bylaw will be totally covered under H3468. Paula will follow-up with Jeanne by email and copy Barb Tri-Town 40R-Barb reviewed the activity earlier that day with the representative of the developer and that, presented with the request to sign off on the Building Department's form, we have no issue with the project as it stands, but that our approval was contingent upon receiving the agreement between Fitchburg and Great Bridge, to confirm that sewer will be handled directly with Fitchburg. Barb will follow up with Mike to be sure he understands that nothing should move forward without a copy of the written agreement. Other towns - Barb noted that included in the package was information from Pepperell, Westminster and Ashburnham, and their processes in assessing betterments and fees with subsequent developments. Paula asked everyone to review and we would discuss again at the 2/10 meeting. Administrative matters: Minutes of 12/29/09 were discussed. Bob clarified that although it is in the minutes that as of July 1, Paula and Steve are off the Commission, it is actually as of the May election they will be off the Commission. Carl confirmed that he would be running as did Bob, ensuring there will be at least two Sewer Commissioners after the May election. Discussion followed as to what would occur if no one else runs for the election and lack of quorum, that the Board of Selectmen would have to appoint members to the Commission for the period remaining before the next Town Election, that the change to the Charter occurred because of a concern as to a possible conflict for a Selectmen to be on the Commission and that the Sewer Commissioners were not even consulted on the change to agree or disagree. Bob stated that it was his opinion that, with the new Charter, although the Selectmen would "appoint" the members, currentiy elected officials would not be able to be appointed to a second elected position (i.e., Paula or Steve cannot be re-appointed to serve on the Commission after the Town Election). Bob made the motion to approve the minutes, Carl seconded, a vote was taken with 3 agreeing to accept the minutes, with one abstention. Sentinel subscription - Barb asked if the Commission would mind if she subscribed to either on on-line subscription or delivery because there were articles that were important to the Commission that she was unable to access. All present thought that just reviewing them online on a daily basis would suffice. Sample invoice -In answer to a question from last meeting, Barb confirmed to the Commission that we charge 12% interest applied on amounts outstanding after 30 days Town report- Barb informed the Commission that she just received the notice today, reminding the Town Departments that they will need to submit their departments section to the Selectmen's office by 2/26. Discussion followed as to what could be in our submission and that the Town Report mostly covers the calendar year and it is only the Accountants, Collectors & Assessors offices for whom the Town Report follows the fiscal calendar. Some ideas of what should be included were: WMP nearing completion, hiring of a consultant, and the upcoming openings at Town Election on the Commission. Flow meters- it was requested by the Commission that Barb obtain the current flow meter readings from Jack to bring to the next meeting. Motion to adjourn was made by Steve, seconded by Carl, and the motion to adjourn passed unanimously. Meeting was adjourned at 9:13 pm Respectfully submitted, Barb Lefebvre, Business Manager for the Lunenburg Sewer Commission ======================================================================================== DOCUMENT : 2010-01-26-agenda-5379.txt BOARD : sewer-commission DATE : 2010-01-26 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/sewer-commission/2010-01-26-agenda-5379.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_01262010-5379 ======================================================================================== ===PAGE 1=== Town of Lunenburg Town of Lunenburg Town of Lunenburg Town of Lunenburg SEWER COMMISSION AGENDA SEWER COMMISSION AGENDA SEWER COMMISSION AGENDA SEWER COMMISSION AGENDA JANUARY 26, 2010 JANUARY 26, 2010 JANUARY 26, 2010 JANUARY 26, 2010 REGULAR MEETING 7:00 PM REGULAR MEETING 7:00 PM REGULAR MEETING 7:00 PM REGULAR MEETING 7:00 PM Regular Meeting 7 pm Bilotta Meeting Room 2 nd Floor, Town Hall Current Business Weston & Sampson Tri-Town 40R Drumm property Lunenburg Water Dept. Paula invited the Selectmen to come to our meeting with Fran from W&S on 2/10. We will still have a separate workshop with W&S and the Board of Selectmen at a future date. Paula asked for a motion to accept the Weston & Sampson proposal, Steve moved, Carl seconded. Vote taken was unanimous. Tri-Town - All members had received a copy of the agreement between Great Bridge and the City of Fitchburg. Barb noted that the plan had been received and would be in the office if anyone wanted to review it. The Commission received a copy of Jim Garff's memo to the Building Inspector regarding the use of E-one pumps and Barb was asked to make sure the Planning Board receives a copy. Drumm property - Discussion of the status of the compensatory privilege fee document to be recorded as a lien against 419 Sunnyhill Rd. Barb had heard through the Building Inspector that an engineer contracted by Drumm would submit that there was only 3 possible building lots. No plan indicating this was received as of yet. Bob and Barb will work on the recording of the document if an abatement application is not received within the required 30 days. Lunenburg Water Dept. - Commissioners discussed the recent rate hike. Barb noted that we receive minimum charge bills and our bills went from $52.50 to $60.00 (14.23% increase) but not a big impact to the budget. Also discussed was a quote through the Water Dept. from their software provider for 3 hours at $140/hr to work on the file they send to us for billing to include usages. Issue, beyond the cost, is with the change to the file input to cause Paula to have to re-work the new program. Put on hold for discussion later. Paula would prefer to work on getting Munis input automated before she leaves the Commission in May. Dietrich Industries building reuse - Discussed United Solutions proposal as a storage facility for their plastics manufacturing facility in Leominster. Paula wants the Board of Health to look at the floor plan and get an estimate of the Title V usage. Also wants the Planning Board and the principals aware that, in the case of a change of use, the Sewer Commission must be apprised and give approval, and that Fitchburg will also need to approve Pleasantview Ave. Reviewed a resident's email to Jack Rodriquenz asking for sewer to be brought up Pleasantview Ave. and discussed that a professional engineer would need to review what is needed for that road. Barb is to respond to resident, referencing the CWMP, with the estimated cost of $24 - 27,000 and their need to employ a professional engineer. Bob reiterated that, in the Summer Street improvements being reviewed, the proposal to extend sewer up Pleasantview should be included. The proposed 40B, Lunenburg Village, was also brought up and it was re-stated that the Commission has yet to receive a new plan. Pleasantview could also be considered in the proposed design of that development and the laying of the sewers. CWMP -email had been sent to Kevin with our issues, including the 2nd MEPA filing and we are awaiting Wright Pierce's response. Highfields Village -Kent Oldfield had contacted Barb to request an informal meeting with Paula. When memo was received, it was learned that Kent would be accompanied by 3 other principals. Steve agreed to attend with Paula, as long as it was made clear that this was an informal meeting to discuss concerns, and that Paula and Steve would bring these back to discuss with the full Commission. Barb to get a meeting date. Pump stations - Paula stated that we haven't heard back from Kerry yet as to the funding of the FD's through the Meadowwoods grant. Also, Barb reported that Mass 2 pump was operational again after being repaired. Sewer by-law - Paula will contact town counsel to check on where the bylaw stands. Project Review Fee & Policy - Paula reviewed what was presented at the Public Hearing on January 13 and advised that the fee and policy had been formally adopted as of January 13, 2010. With this policy, once a proposed plan for development is received, a fee would be collected and deposited in a special account. From this money on account, the Commission would be able to pay the costs for a professional engineer to review the plans on behalf of the Sewer Commission. ===PAGE 2=== Motion to adjourn was made by Steve, seconded by Carl, and the motion to adjourn passed unanimously. ======================================================================================== ===OCR macOS Vision=== ===PAGE 1=== United Solutions - Pat Slattery, of Patrick J. Slattery Architects came in representing United Solutions. United Solutions had gone before Planning Board for approval and had a Public Hearing on the proposal on 2/22. He discussed what United Solutions' plan was for the old Dietrich Industries building, stating that the flow, once the manufacturing aspect is begun, will be about the same as it was with Dietrich since the number of employees (60) and activity is very similar. He had provided the Sewer office with the original plan for Dietrich from 1992, showing with 64 employees, with the flow estimated at 971 gpd. They wish to retain the same allocation going forward. Paula read the February 10' letter from Jim Gareffi, Board of Health, which also indicated an estimate of the 900 gpd for the proposed 60 employees. Discussion followed on the requirements under the inter- municipal agreements, that we are required to provide the receiving town a clearance plan on any commercial enterprise for any change of use or tenant, so they know what is going into the pipes. Paula noted that we had received communication from Ed Zephir, President of United Solutions, stating that he was working on getting us a clearance plan and the Manufacturing layout plan. Pat had provided the office with the manufacturing plan today which Barb had for the Commissioners to review. Paula noted that first, the allocation needed to be approved and asked for a motion to approve an allocation of 900 gpd for United Solutions. Steve made the motion, Carl seconded, vote taken was unanimous. Secondly, Paula stated that the Commission needed to vote to approve going to Fitchburg to get approval of the clearance plan. United Solutions will provide the clearance plan to the Sewer office and we will take it forward to Fitchburg. Steve made the motion to go to Fitchburg to request approval of the clearance plan, Carl seconded, vote taken was unanimous. Paula noted that we are in negotiations with Fitchburg in order to obtain additional capacity and wanted to make sure United Solutions was aware that that is an issue. Discussion followed on what constitutes a clearance plan and determined that the manufacturing layout plan, the diagram of the closed loop system, the proposed flow and the as-built of the sewer connection which Pat believes he had from Whitman & Bingham. Barb will also check with Jack Rodriquenz about the connection and the as-built. Once we have received all the components, the Sewer office will compile the information and send it to Fitchburg for review. Stone Farm - The Commission has received a letter from Stone Farm LLC's attorney, Ken Gurge, requesting information and access to our files. We have up to 14 days to respond on a request for public records. Letter was received on February 17, and we need respond before the 14 day window. Kerry & Tom Alonzo were also copied on this letter and Barb will check with Kerry if they will provide any of the information requested. We have no issues with them looking through our files but advise them there would be a cost to make copies, which we need to determine by checking with other offices. Barb had already requested copies of any MC's for Riley Road from the Collector's office based on a prior conversation with Paula. We will send them copies of the betterment notices of 9/17/08 and provide to them the exact 6 month abatement period dates. Discussed whether we wanted to involve counsel at this point and decided that it wasn't necessary. We also discussed that any issues regarding balances due should be responded to directly by the Collectors office. Town Report - The Commissioners had received a draft of the submittal for the 2/10 meeting for their review, with the proposed addition of the rate increase paragraph from the website. Discussed whether sewer district map approved at December Special Town Meeting should be included and determined that no graphics are to be included in the Town Report, so we will leave it out. Commission approved the submission with the addition of the rate increase information with 1 edit and adding the business manager's name at the bottom. Highfields - Paula reviewed the discussion at the informal meeting on 2/22 between Kent Oldfield, John Godfrey of Highfields, Paula, & Steve. Elone pumps are not an option for this development due to the topography and a pump station is required. Kent & John were advised that all components must reside within the sewer district per our bylaw. They plan to come back for our meeting on 3/10 with a revised plan. Once received, we will have a peer review done by Weston & Sampson. Steve noted that it is obvious that the Sewer Commission must be involved in these projects from the ground floor - that we would have had more say in the design if we came in at the Development Plan review. Discussed the ongoing cost of maintaining a pump station, needing to obtain maintenance cost of a similar-sized pump station (29,000 gpd) and if there is any way to recoup the costs with a fee to the developer or to the residents of the subdivision without impacting other sewer users with the cost. Discussed development and/or impact fees and the steps necessary before adopting them. Paula noted that their original design called for a much larger wetwell to accommodate future growth and they made it clear to Kent that they want it designed for the 66 homes only. Lunenburg Village 40B Discussion of Brian Milisci (Whitman & Bingham) email received 2/9 with proposed flow. Plan was received by the office today from the ZBA. No pump stations with this plan - all gravity system. Regarding the newly adopted project review fee, the Commission is unsure we can invoke that on the 40B project. Barb to check with ZBA on whether the project would be able to cover the peer review. The ZBA is holding ===PAGE 2=== Peer Reviewers - Paula discussed the proposed policy change to make peer reviewers "temporary municipal employees", originating with the Planning Board. It was the agreement of the Commissioners that they would not be in favor of such a change. Basic conflict of interest policies should be followed, eliminating the need for such a change. CWMP - Kevin Olson will be providing the Commission with an electronic copy of Phase IV reflecting the changes requested. Kevin and Paula are working to set up a time to discuss the 2nd MEPA filing and the proposed cost. Sewer by-law - Paula is waiting to hear back from Jeanne who is waiting on Jen Benson's office. The legislation has been filed, but we are unsure of what was submitted and whether it touches on all the points that we intended to cover by the passage of the Sewer districting bylaw, approved at the May 2009 Town Meeting. Tri-Town 40R - Jim Gareff's memo to Mike Sauvageau was copied to Marion 2/1 & Jack as requested at the last meeting. Weston & Sampson's concern of 2/23 that this development will never be our issue (backups, pipes replaced, etc) was discussed. Paula mentioned that Fitchburg has expressed interest to Kerry in Lunenburg handling the sewer & billing going forward. Administrative matters: Betterment deferral application- A Betterment deferral application had been received on 2/8/10 for 15 Hamlin St. This is the 2nd year of application. The Statement of Entry was recorded last year, but an application must be filed each year once the actual bills have been sent out and requires approval by the Commission each year. Bob made a motion to approve the application for the deferral, Steve seconded, the vote taken was Emerald Place - Carl Pearson, Global Properties, had been in to the office on 2/23 for sign off on building permit form. The building permit application is for 144 units, but their plan was to obtain permits to connect to sewer with Jack on 2/25 for 34 units only (1 building of 20 units, and 14 nust be obtained it they want the permit to construct for 144 units. Barb will advise both Carl Pearson and Jack of their request, and also verify wit Jack that he has no outstanding concerns regarding the plan submitted in 2006. Compensatory privilege fee for 419 Sunnyhill Rd - Commission reviewed the correspondence from Bill & Susan Drumm, owners of 419 Sunnyhill Ro., regarding apportionment and the claim disputing the number of possible building lots, but no new plan has been received. The Collectors office was copied 2/9 on the recording of the lien and the Drumm correspondence regarding apportionments. No formal abatement requested, but duly noted that the correspondence was received within 30 days of the notice. Bob to check the abatement period per our betterment bylaw. 140 Leominster-Shirley Rd - Commission reviewed the chronology of events regarding Gitto Global/S&E Polymers billing history at 140 Leominster Rd. Steve made the motion to forgive the interest on the account if S&E agrees to pay the principal of $4120 on the 2 outstanding invoices. Bob seconded the motion. Vote taken was unanimous. Discussion followed on the format and content of the MC's produced by the Collectors office and the Commission wishes to be sure that all costs, including the Sewer Usage, be included on the MC's. Also, the Commission requests that the MLC's note that the Final Readings be obtained for sewer upon a change of ownership and asked if the business manager would send Jeff Ugalde, Collector, a memo regarding the same. Bob agreed to work with Barb and talk with Jeff also on the MLC issue Minutes of 1/26/10 - Minutes of 1/26/10 were reviewed. Steve made a motion to accept the minutes, Bob seconded. Vote taken was unanimous. Warrants/bills for signature - Commitment/Warrant from January billing and the Koppelman & Paige invoice, adjusted with the removal of legal counsel for the betterment recording on the Meadowwoods project, were signed off by the Commission. 357 Electric - The notice of auction for the JCJ property at 357 Electric Avenue was discussed. The site has access to sewer and a betterment, but Workshop with W&S - It was noted that the workshop with Weston & Sampon regarding the Fitchburg IMA is scheduled for this Thursday at 5:30pm. It will be short as there is a budget meeting at 7pm at Town Hall that both Steve & Paula need to attend. Budget FY11 - Barb will be working on the Activity reports for the budget process and plans to focus next week on the budget to begin discussion at the meeting of 3/10. Commission requested that we ask Jack to attend that meeting on the 10th so we can discuss in depth the expenditures on the budget. Not sure if Kerry needs to attend at this point. Paula pointed out that with the IMA negotiations before us both the costs of the IMA's and the costs of sewer usage will change. Not sure if they will be impacted in FY11 or FY12. We may have to have a budget workshop between the ===PAGE 3=== Barb Lefebvre, Business Manager for the Lunenburg Sewer Commission ======================================================================================== DOCUMENT : 2010-03-10-agenda-5382.txt BOARD : sewer-commission DATE : 2010-03-10 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/sewer-commission/2010-03-10-agenda-5382.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_03102010-5382 ======================================================================================== ===PAGE 1=== Town of Lunenburg Town of Lunenburg Town of Lunenburg Town of Lunenburg SEWER COMMISSION AGENDA SEWER COMMISSION AGENDA SEWER COMMISSION AGENDA SEWER COMMISSION AGENDA MARCH MARCH MARCH MARCH 10 10 10 10 , 2010 , 2010 , 2010 , 2010 REGULAR MEETING 7: REGULAR MEETING 7: REGULAR MEETING 7: REGULAR MEETING 7: 00 00 00 00 PM PM PM PM Regular Meeting 7:00 pm Ritter Memorial Building Lower Level Confere nce Room 7:00 pm Highfields Village 7:30 pm Robert Proctor Current Business Emerald Place United Solutions Lunenburg Village 40B Budget discussion CWMP Town meeting warrant 419 Sunnyhill Rd Old Business Sewer by-law Stone Farm Meadowwoods Administrative Matters, Minutes / Warrants / Bills EXECUTIVE SESSION ADDRESS ANY/ALL OTHER BUSINESS TO COME BEFORE THE C OMMISSION ======================================================================================== DOCUMENT : 2010-03-10-minutes-5382.txt BOARD : sewer-commission DATE : 2010-03-10 KIND : minutes OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/sewer-commission/2010-03-10-minutes-5382.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Minutes/_03102010-5382 ======================================================================================== ===OCR macOS Vision=== ===PAGE 1=== Paula formally opened the meeting at 7:04 pm. Highfields Village (George Smith, John Godfrey, Kent Oldfield) - Kent started by reviewing the 2/22 informal meeting between himself, John Godfrey, Paula and Steve in regards to the Highfields development and the proposed 66 units. He also did a brief history of the project, from the original plan to have the access on Mass Ave, and having to move the access road to Northfield Road. He discussed that the sewer access point will be down Pope Road, which is also the emergency access to the development. He noted that prior to the meeting on 2/22 their plan was to have the pump station on Northfield Road, until they learned that that was outside the sewer district and it would have to be moved to within the district. John Godfrey spoke about being the financing behind the project, and described how when the developers were told they could not have access to Mass Ave, he went to John Saliba and arranged the option for a right of way through Saliba property to access Northfield Rd. A stipulation of his agreement with Saliba was that there would be a sewer to which he could connect, although he made no promise to connect. With that agreement in place, they re-designed the development, adding the area known as Blueberry Hills to give them 66 units. Since the meeting on 2/22 they have re-located the pump station to the junction of the Blueberry Hills lot and the Leverone property and within the sewer district. They have also reduced the size of the pump station to accommodate only the 66 homes as was requested 2/22. Discussion followed as to why E-one pumps were not chosen, which would alleviate the need for the pump station. Kent stated that E-one is better for smaller developments and that gravity pipes are less likely to break than 2 low pressure pipes. Jack Rodriquenz agreed with Kent that for this development, E-one's would not be a feasible option. Paula inquired whether we'd found out what the cost to maintain a similar sized pump station was and Barb said she had referred that question to Weston * Sampson. Kent noted that he was sensitive to the cost of the pump station and mentioned there may be some creative financing options to hold some monies in escrow for ongoing maintenance. Discussion followed on the number of homes that could be gravity or low-pressure which led into the discussion of gravity line to Maple Parkway. Kent had no issue feeding gravity sewer down to Maple Parkway, but believed it was over-ruled previously by Conservation as the pipes would have to cross wetlands. Jack said the wetlands could be circumvented, that we would like to solve as many issues at the same time as we can. Maple Parkway needs help, and with this project that could be accomplished. Paula asked Kent to do a cost analysis, comparing the 2 options to see if it would be possible to help Maple Parkway which is in dire need of sewer and road repair. Discussed the entry point at White Street & Mass Ave. John Godfrey spoke to the fact that they can't take on the road repair, but they could put in the sewer and we could pave the road - win/win. Paula asked for a followup meeting once the cost analysis had been done. Kent will get back to the Commission. Lunenburg Village 40B - David Sanderson representing PSC was present to discuss the 40B and their peer review of issues with the project. They originally had issue with lots of individual pumps and had recommended a pump station, but after listening to the previous topic, knew that that may be an issue for the Town. Several issues present themselves: 1) pump station vs gravity pipes and 2) connection fees. Paula asked Jack to speak regarding his concerns for the project. Jack had it clarified that these were single-family homes (not condos) and eventually the road would become a public way, so there was no "association" to take over ongoing costs of maintaining a pump station. He also brought up the connection to sewer at Piedmont and stated that they'd like to connect Pleasantview - again, a road in dire need of repair and sewer. Sewer was designed to be brought to head of the road and Dave believed that they planned to bring sewer down Pleasantview. Paula asked that, at a minimum, they would like to see a cost analysis to consider sewering Pleasantview at the same time. Dave stated, per the plan, 5 houses were to be connected to the Piedmont connection, 6 to the Lesure Ave & 53 to Whalom Rd.. Jack added that Ramgren Road abuts the land and has the same topography as Pleasantview. A copy of the plans were pulled out and looked over. Steve inquired why all homes could not be tied into gravity sewer and Jack suggested ½ could go down Ramgren and ½ down Pleasantview, and not down Piedmont. Steve pointed out that easements are not permitted per the bylaw. Paula asked that they look over our sewer bylaw and we have another meeting. We need to put together a list of issues, bring them before the peer reviewers and have another meeting with Jack and the Commission, along with PSC. Question arose how long we had before a decision would be made. Fran noted that it could be extended if the proponent requested such. Paula asked Dave to communicate their issues to the ZBA. Jack also brought up the drainage and stormwater issues and discussed the issues to consider. Paula stated that the Selectmen and Kerry need to do up a memo on the stormwater issues. Dave asked if the Commission had a response and Paula noted that we'd just received it that evening, would need time to review and that we would put together a memo back to PSC of our issues. ===PAGE 2=== praise for Jay. Bob Ebersole reminded Jay that the caucus was on Monday, March 15 and there is a total of 5 positions, 2 for 3 year terms, 2 for 2 year terms and 1 for 1 year term. Jack asked Carl if he was running for the Commission. Carl answered in the affirmative. Jay stated he was interested in the one year term position. The Commission welcomed him and thanked him for his interest in serving. Emerald Place - Barb stated that 34 permits were taken out and paid for, and reviewed the issue in the prior week with the developer wishing to take out 144 bullding permits but only 34 sewer permits to connect. Paula reiterated that it is necessary to have a sewer permit in hand to obtain a bullnerm a tell be ten ply. ned hat an applicant cannot obtain a building permit without an approved septic system through the Board of Health and that this is the same thing. Jack thought that the only approval needed prior to building permit being issued is to confirm that sewer is available. Paula asked that a motion be made that connection fees must be received prior to an applicant receiving a building permit. Steve made the motion, Bob seconded. Discussion followed regarding the control we have in receiving connection fees once a building permit is issued. Jack stated that he is present at every connection, even at Stone Farm or when each connection is made at Emerald Place to ensure it is done correctly. Bob asked if we didn't do it prior to the building permit, when would we catch it. Jack stated we would catch when occupancy permit was requested. Barb pointed out that in the package, she had updated both the Sewer Rules & Regulations and the Connection Charge policy to review with the proposed change: An Application for Permit to Connect must be submitted, approved and appropriate permittee paid before the Sewer Commission representative signs off on the Building Permit checklist, issued by the Building Department. The Commission reviewed and Paula asked that the clause "for each unit to be constructed" be added. Commission also determined that it only needed to be added to the Sewer Rules & Regulations/Section 7, and not the Connection Charge Policy. Paula asked for a vote to approve the addition to the Rules & Regulations with the stated amendment. Vote was unanimous. United Solutions -Barb noted that Jack had brought the United Solution package of information to Joe Jordan in Fitchburg for approval on 3/5 and we had gotten an email back today from Joe that they are okay with the plan but request walk-through when manufacturing is being introduced. Barb will advise Ed Zephir at United Solutions. Jack mentioned he had already spoken with Pat Slattery and conveyed the same message. CMP-Paula stated that she had talked to Kevin Olson today and discussed the 2nd MEPA filing. Paula reviewed the events of the Notice of Project Change filing that Wright Pierce did on the town's behalf for Jay, and that Wright Pierce had sent a letter requesting additional monies for work done outside the original scope of work, including $4000 for the 2nd MEPA filing. Kevin agreed to subtract another 12%, which is their profit amount, and they will do the 2nd MEPA filing. We will have to pay $4000 - 12% ($3520.00). Paula was concerned if we had money in Purchase of Service for this amount, but Barb pointed out a portion of that was included in the money we raised from Retained Earnings at the Special Town meeting in December 2009. Paula asked if there was a motion to approve a second MEPA filing. Steve made the motion, Carl seconded. Vote taken was unanimous. Paula asked if everyone had reviewed the electronic version of the amended WMP and response to MEPA comments sent to them earlier and if there were any issues or concerns. All agreed that no issues remained. Paula asked for a motion to tell Wright Pierce that they can finalize the CWMP. Steve moved, Carl seconded. Vote taken was unanimous. Barb will advise Kevin that he can go ahead and finalize the CWMP and move forward with the second MEPA filing. Lunenburg Village 40B - Barb asked to return to Lunenburg Village to request Weston & Sampson's aid in determining what the privilege fees for the project would be. Paula pointed out, per the ZBA's draft decision received, that the developers of the 40B have agreed to pay the privilege fees in addition to the connection fees. Barb noted also that the connection fee was transposed as $1670.00 and we need to let them know. The current betterment bylaw was read aloud and major discussion followed on betterments and privilege fees, condos vs single family, extensions vs. 40B. Bob E. pointed out that the $1,000,000 that we put aside at the time the betterments were assessed applies to those parcels having current access to the sewer and we can collect no more than that amount on the development of those properties. Properties, such as those Bob Proctor is proposing, were not on the original line so would not be subject to that cap since those properties were not originally assessed a betterment. Fran confirmed that Lunenburg Village would be a privilege fee, not a betterment, since the development was above the use originally assessed, and that Bob Proctor's homes would also get a privilege fee, due to the fact those properties were never assessed a betterment. Discussion continued that the Commission needs to devise a formula and asked Fran Y. of Weston & Sampson if his firm could help the Commission to determine formulas for each of these types of situations. Paula asked if Fran could find out what other towns that they work with have done. Paula stressed that what we do now will affect many other hookups in the future and we need to have a well thought-out plan. Budget discussion - Paula asked Fran what they should expect by way of IMA costs for FY11 and Fran was unsure this would be resolved in time to be considered in setting up the FY11 budget. There is still another conversation with Joe and they will be sending Fitchburg a list of issues. When ===PAGE 3=== just received, but it was inconclusive. In her conversation with Mike Sauvageau, Building Inspector, he stated that the plan still shows that 5 lots are possible. Plus, it was not an approved plan, containing no signatures by the Planning Board. Sewer by-law - Paula reviewed the recent activity regarding the Sewer bylaw, passed at Town Meeting last year which went before Special Legislation in an edited form. It became evident that the wrong draft was submitted to the legislation for approval. House counsel has since approved of the changes and it will go before the House for vote again. Paula reviewed for Fran and Jay that the bylaw limits capacity to 330 gpd (or 1 unit) for undeveloped lots and is based on available capacity. Paula stated that the legal fees from this recent flurry of activity might be of good size, both with her conversations with Jeanne McKnight, but also Jeanne's time spent on the legislation and with house counsel, Joanne Campo. Stone Farm - Barb advised the Commission that a letter was sent to Atty. Ken Gurge who was not actually invoking a formal public records request. It is still on an informal basis for now. In the letter, Barb did state that they may have to pay for copying and labor if it is necessary. Meadowwoods - Barb reported that Karen had not yet heard from Jim Lavin to confirm whether the costs of the FD's at Mass1 would be covered by the project. Barb also mentioned to Jack that the Commission had hoped that Weston & Sampson could look at the specifications that Hall Pump was proposing to ensure that it will be a design to maximize the benefits for the pump station. Fran said he and Jack could talk offline. Jack also mentioned that with the recent weather the heavy rains had tripled the flow through the flow meters. The Commission discussed with Jack & Fran what tests can be performed to determine the problem areas. Also discussed was the potential I/l in Leominster from the residents who never swapped out their old clay pipes from the previous system for the PVC piping. Administrative Matters Barb will be away for the meeting on the 14th. Paula asked if we should re-schedule. Bob stated that he would take notes. They will discuss at the next meeting if the meeting on the 14th will take place. Barb reminded those present of the Town Caucus on 3/15, and discussed how the notice about the Commission was on our website and also the Town's home page. Carl confirmed he was running, as did Jay Simeone. All 3 plan to attend the Caucus. Barb noted that the Sewer Project application form originated by the Planning Board was in their package to review and discuss at the next meeting. Barb asked about the minutes of 2/23 which were sent to the Commission for review 3/8. Not enough members had read them, so they were tabled until the meeting on 3/25. Barb advised the Commission that the principal on the account at Leominster-Shirley Leominster-Shirley Rd account/S&E Specialty Polymers had been paid and the interest forgiven. Payment was received on 3/8. Flow meter readings had been entered onto spreadsheets and were provided to the Commission and Jack. Barb will send them to Fran electronically. Activity reports for 9/1-3/8/10 were in the package for review by the Commission in advance of the budget discussion at the next meeting. Koppelman & Paige invoice was approved for payment. Bob brought up that he had spoken with Jeff Ugalde regarding Municipal Lien Certificates (MC's) and that they will include sewer usage and betterment amounts, and will refer people to call the Sewer Department for final readings. Barb handed out a copy of a current MLC. Motion to adjourn was made by Bob, seconded by Steve, and the motion to adjourn passed unanimously. Meeting was adjourned at 9:53 pm Respectfully submitted, Barb Letebvre, Business Manager for the Lunenburg Sewer Commission ======================================================================================== DOCUMENT : 2010-03-25-agenda-5383.txt BOARD : sewer-commission DATE : 2010-03-25 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/sewer-commission/2010-03-25-agenda-5383.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_03252010-5383 ======================================================================================== ===PAGE 1=== Town of Lunenburg Town of Lunenburg Town of Lunenburg Town of Lunenburg SEWER COMMISSION AGENDA SEWER COMMISSION AGENDA SEWER COMMISSION AGENDA SEWER COMMISSION AGENDA MARCH MARCH MARCH MARCH 2222 5555 , 2010 , 2010 , 2010 , 2010 –––– rescheduled from 3/30 WORKSHOP 6:00 PM WORKSHOP 6:00 PM WORKSHOP 6:00 PM WORKSHOP 6:00 PM REGULAR MEETING 7: REGULAR MEETING 7: REGULAR MEETING 7: REGULAR MEETING 7: 00 00 00 00 PM PM PM PM Workshop 6:00 pm Ritter Memorial Building, Lower Conference Room Budget workshop Regular Meeting 7:00 pm Ritter Memorial Building, Lower Conference Room 7pm Tom Houston, PSC (Lunenburg Village 40B) 7:30 Fran Yanuskiewicz/Weston & Sampson Current Business Town meeting warrant Extension request Drain layers application Stone Farm CWMP Connection Charges Old Business 419 Sunnyhill Rd Highfields Village Emerald Place VFD’s Sewer by-law Administrative Matters, Minutes / Warrants / Bills EXECUTIVE SESSION ADDRESS ANY/ALL OTHER BUSINESS TO COME BEFORE THE C OMMISSION ======================================================================================== DOCUMENT : 2010-03-25-minutes-5383.txt BOARD : sewer-commission DATE : 2010-03-25 KIND : minutes OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/sewer-commission/2010-03-25-minutes-5383.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Minutes/_03252010-5383 ======================================================================================== ===OCR macOS Vision=== ===PAGE 1=== Lunenburg Village (Tom Houston (PSC), Dick Heaton (H&H Assoc.) - Tom Houston reviewed the copy of the memo that PSC provided the Commission prior to the last meeting on 3/10. Dick Heaton introduced himself as the 40B consultant, hired by the ZBA, to help them through the 40B process. He mentioned that Lorden wished to get the permits for the 40B before June 30. The plans were reviewed by all present, showing a system of on-premise E-one pumps and discussed that pipes would not be under the roadway. Jack noted that we would like Ramgren & Pleasantview considered for sewer hookup as part of this development, integrating the necessary road repair for these roads. Carl noted that the Commission's first choice would be to have it all gravity - no pumps, second choice - several pumps to 1 pump station, and thirdly, all these individual pumps requiring easements that our bylaw does not allow. Dick Heaton pointed out that 40B's can usually override the Town's bylaws. teaton pointed out that 40s canusualyoveride the Towns bylaws. Tom agreed but stated that there is a lot of "horse-trading" with 40B's. Jack expressed that he also had major concerns with drainage. Dick noted that Lorden planned to initially present the development as condominium, and when about 80% is complete, to come before the Town to accept the roads & utlities as public. Power outages were a concern and discussion followed regarding the generators. It was discussed that we need a ruling - can this system be designed as gravity only and minimize the mechanical aspect of the system as much as possible. Tom Houston noted that the plan does also have forced main and gravity but the plans are not highly detailed as they are preliminary. He added that the type of system using individual home e-one pumps is generally used for private septic systems and that he would also prefer a pumping station. Jack agreed that less mechanics means less failures. Carl pointed out that our WMP suggests use of E-one pumps in several areas for various reasons. It was noted that the current plan connects 53 homes down Whalom, 5 at Piedmont & 6 at Lesure and that one pump could handle that. Otherwise each homeowner would be responsible for each pump, or would it be the homeowners association? Discussed incorporating requirements for annual maintenance and inspections into condo documents. Jay inquired if the town would have to accept the system? It would be a Town meeting vote. Tom stated that the original project was twice as dense - was originally at 120 homes - now at 64. Applicant wants the town to accept the roads eventually - water department will maintain their own lines. Tom stated that a gravity main to 1 municipal pumping station option had not been explored. Tom noted that one issue is a sewer line crossing wetland which the applicant would like to avoid. Right now, it empties to a connection on Whalom Rd. Steve would like to see sewer installed, as part of this project, in the streets in serious need (Ramgren & Pleasantview). Jack re-stated there are stormwater issues. Bob asked if there was a recommendation to the ZBA? Dick asked that we write a recommendation to the ZBA and tell them what is wanted. Carl needs more information on these low-pressure vs gravity systems. Also with these systems on homeowners land, we need to know where the responsibilities lay. Tom wants to address the issue of power outages and generators. Discussed the placement of the lines --within the right of way, or alongside? Applicant has them outside, in easements, running parallel to road. What happens if multiple owners' lines need to be flushed? Bob wants to look at total gravity and if it can it be done without a pump. Bob made a motion to recommend to the ZBA to require gravity mains in the system, ideally without a pumping station. Carl seconded the motion. Discussion followed and vote taken on the motion was unanimous. Jack asked what next, if engineering doesn't allow for all gravity? Question raised as to the timing of the 40B. Per Dick Heaton, public hearing was continued til April 14, then if hearing is closed, it would be 40 days from that date. This date can be extended if the applicant approves. Bob stated that, if Whitman & Bingham proves that all gravity system is not possible, that he'd prefer 1 pump station under Town control. Dick asked if the commission wanted applicant to come to their next meeting? Carl wants to gather all information before that occurs. Bob noted that the applicant did not propose a gravity system with a pump station and Tom stated that there were cost issues. Steve noted that a second motion needs to be made. Bob made an alternate motion - for a gravity system with pump station. Carl seconded for discussion only. Discussion followed on pump ownership switching from homeowners association to the Town. Also discussed was how the flow, created by the development, would occur whether the Town paid for the upkeep of a pump station or not. Carl stated he would vote "no" for an additional pump station and that it is not in the town's interest to have to bear the cost of another station. Bob agreed to withdraw his motion, Carl withdrew his 'second'. Dick asked again if applicant should come to a meeting and discuss the plans and Carl suggested that the Commission may need an extra meeting, but that they need to discuss some of the issues from this evening with their engineers. Tom said we should have an answer from Whitman & Bingham quickly. He would also like more details of the on-lot pumping facilities and the provisions for on-site storage for power outages. Dick stated 40B is only required to provide preliminary plans and applicant has provided a lot more information initially than required. Discussion followed of the concern for the costs of maintaining another pump station and whether it could be written into the condo documents that the association would maintain the station or pay the town an annual fee for its maintenance. Bob suggested that we wait until the next meeting when Paula would be back before making any decision. Dick stated that the Commission doesn't have to approve the design, only that sewer is available and that they also need to advise the ZBA of the fees to be charged. Commission noted that they needed to discuss this with their consultants before responding. Discussion followed regarding condos vs. single family homes and when the current connection charge policy was accepted. Tom referenced pg 8 of Sewer Use Regulations, asked that we respond to items 30, 31, 32 of his memo. Jack confirmed with the Commissioners that they are okay with him talking to Brian Milisci of W&B. Tom stated he could be here on April 14th and will also be prepared to discuss stormwater at that time. ===PAGE 2=== to whether this was a connection or an extension and steve P. stated that mis is cleariy a connection. ritenburg ImA -steve recounted tel meeting with Joe Jordan on 3/22 and reviewed the key issues. Fitchburg is firm on the $2000 per connection charge to be implemented. There may be wiggle room on the 4hr. inspection fee that they would not be providing, which we would turn around and charge our residents tor. Our new arge to be inter du here may connection fee would then be $2000. They have waived the I/l clause and fee. They currently charge new developments 2 gallons for every to cover I/l. Fitchburg's current rate is $5.80 to us. They charge their residents $4.15 and there has always been that $1.65 delta. It has been penny for penny all along. Reviewed capital costs and the pay-as-you-go policy which is a plus. Only thing they insist on is the portion of our costs for the improvement of John Fitch Highway. Joe needs to have the flows (from the WMP) and we will be charged the percentage of what their flow is to ours when the improvement cost is known, one time expense, to be spread over 20 years. Once agreed, we have basically purchased capacity and do not need the sunset clause Reviewed Table 2-7 on page 2-19 from the CWMP. Was 258,500 before, now 251,800. Is that the number we will be going with? Current flow = 104,000 gpd, 25% contingency =130,000, 2026 buildout is 258,500. We still have the right to shift flow to Leominster or Summer St, but costs to do so will not net any saving to the Town. As far as meter readings, they would like to have them, but will stick with our current method of water usage. Tri-Town - Jack brought up conversations with Joe in regards to Tri-Town and how Fitchburg would like us to take over the billing. Their plan was to run a dedicated line from the project to Fitchburg line, running parallel, now propose we bypass the Youngs Rd manhole and take it down to Summer. Fitchburg determined that they would have no leverage on collection of bills. Discussion followed on the merits of taking on the billing - no benefit to us at all. Steve P. thought maybe we could reduce our overall rate of 5.80 in negotiation for taking it over. Other than that, our preference would be to resolve IMA first, and deal with Tri-Town later. Jack stated they are installing the pipes in a month, so we need to let them know. Steve D still has issues with JF Hwy. Fran stated it really was not a bad deal, not requiring a chunk of money for future capacity. Bob Proctor extension - Commission discussed with Fran and Steve the request by Bob Proctor to extend sewer up to 7 properties, and whether it would be considered a betterment, compensatory privilege fee or for no charge, since Bob was laying the pipes. Jack added that this is a similar situation to Pleasantview. Fran made the suggestion that you take the figure from the WMP for future growth and divide it by the 2.6 million held back from the betterment assessment, resulting in about $2000 per home you could charge. Discussed the need for a policy to deal with this extension of sewer line - policy proposed would read something like" For the extension of sewer lines if paid by private enterprise will comply with policies and will be charged a general benefit fee of $2000 at time of connection in addition to the connection fee". Discussed that Highfields will need another type of agreement to charge them another fee. How to determine 0 - 100%? Barb to type up and Bob suggested that we have Paula, Weston & Sampson & counsel review proposed policy to make sure it is a "legal fee vs. illegal tax". There is no answer for Bob P yet - we need to do this right. Per Fran, using the flows from CWMP gives you a valid basis for what you are charging. Betterment bylaw changes - per Fran, no change at this time is really necessary. Any elaborations done at a policy level is preferable. Fran suggested however that we start documenting everything we do to arrive at a decision and why. It is important to keep good records of policy changes so you can go back and understand why a policy change was implemented. Workshop - Fran had originally suggested to Barb that there should be a working session between the Commission and Weston & Sampson. Barb asked if tonight's meeting sufficed for now and Fran agreed that it did. Summary of tasks - Jack will talk with Brian Milisci of Whitman & Bingham regarding the grinder pumps. Steve P. will get the Commission a memo to review and agree to in response to Fitcburg's proposed IMA. Barb will check if there is an electronic copy and will forward to Steve P. Jay Simeone-Steve D. noted that Jay had now come to his second meeting and suggested that we make a motion to recommend to the Selectmen that they appoint John J. Simeone (Jay) to fill the vacancy on the Commission until town election on May 15. Carl made the motion, Bob seconded, vote taken was unanimous. Barb will send email to Laura Williams, asking that this appointment be put on the next Selectmen's agenda. Meeting ran late so Barb reviewed quickly other items in the packages: Drain layers application - there is a new initial application and new renewal application in their packets for review. Stone Farm - Barb reviewed the latest activity for a closing at 14 Riley Rd. on 3/25 and that a permit for an application to connect must be filled out. She had advised John Scribner of total building permits issued and that the associated connection fees were short by 3 permits. CWMP - we have received 10 copies, the remaining 10 will come after the 2nd MEPA filing. Barb gave Phase IV binders to Steve, Carl, Bob, Jack and Fran. Kevin won't send copy to DEP until after the MEPA filing is complete. Barb had their invoice for $700 for approval, with a spreadsheet to show that it is not the final invoice. Commission agreed to okay this payment. Connection Charge - quick discussion of the cost for a duplex to connect - not clear on current connection charge policy. Commission to review and revisit at next meeting. 419 Sunnyhill Rd -Barb stated that MikeS. had talked with Bill Drumm 3/19 and confirmed his opinion that 5 lots are possible. Drumm said ok. ===PAGE 3=== Motion to adjourn was made by Bob, seconded by Carl, and the motion to adjourn passed unanimously. 10:50pm. Next meeting is April 14 at the Ritter. Members Steven DeBettencourt, Carl Luck and Robert Ebersole also attended. Lunenburg Village 40B The commission reviewed the proposed plans and heard from Brian Milisci from Whitman & Bingham about the general design of the subdivision and the proposed sewer system. Gravity would serve many of the lots and connect to the existing town sewer at Lesure Avenue, Whalom Road and Piedmont Avenue. The remaining lots would be served by E-1 pumps. Brian estimated the cost for a force main and central pumping station to be $250,000 which would be more expensive that the proposed system and would have to be paid all upfront, while the E-1 pumps would be installed as each house was built. Jack Rodriquenz, DPW Director was asked for his recommendations. He noted his appreciation for the applicant's process and willingness to consider various options. Jack has confidence in the E-1 pump system and would be open to the pipes being located under the streets. He asked that sewer be installed in Pleasantview and that the street be reclaimed and graded by the developer, followed by payment and drainage installed by the town. There was general discussion about the estimated costs for this request. The commission noted that part of the 40B process includes a calculation of the reasonableness of required standards and that the project should not be rendered unteasible. Specifically, the applicant asked the Commission to waive the privilege fees for the affordable units. The commission noted that it has its role and the ZBA has its role in the process, but was willing to discuss the request. After further discussion, it was voted unanimously as follows: 1. To authorize the developer to connect to the sewer system and to accept the proposed design of a combination of gravity and E-1 pumps, with lines located ithin the paved way. The final system design must be approved by the Sew ommission before any site work is started and must be in accordance with th Town's current bylaws and regulations. Upon said submission, the Applicant will pay all fees to the Sewer Commission to retain an engineer to conduct a peer review of the final design. 2. To not waive connection fees for the project, as the Sewer Commission is required to pay both Fitchburg and Leominster for any new connections, said fees to be paid upon application for a building permit. 3. To consider waiving a portion of the privilege fee on the affordable units, depending on further review of the proforma. 4. To request that sewer be installed on Pleasantview and the street would be reclaimed and graded by the developer. ===PAGE 2=== Public Discussion David Kenny, owner of Lot M, 1790 Massachusetts Avenue noted that he has the water shut off at this property and the water department is not billing him while the water remains shut off. He was requesting that the Sewer Commission follow suit and not bill during the same period. The Commission took this request under advisement, noting that we would research how many owners are in this same situation to determine the cost. We would discuss this at our next meeting and get back to Mr. Kenny. Fitchburg IMA Weston & Sampson presented a memo detailing the final proposed IMA draft and will follow up with an electronic version tracking the changes. We noted the requirement for our charges to be based on metered flows of sewerage as opposed to metered flow of water. This will require work to avoid Infiltration and Inflow (I&I), to keep costs down. FY 2011 Budget The Commission reviewed the budget prepared by Barb and made the following changes: Increased User Charges to 445,173 to reflect a 20% increase, but noting that we will only take in three quarters of that during the fiscal year. Decreased Sewer Business Manger to $48,681 to reflect a 2% increase and not 3% Increased overtime to $15,000 to deal with I&l investigations Increased Infrastructure to $68,000 to cover costs for I&I Decreased Legal to $6,000 projected less usage next year Increased engineering costs to $20,000 noting the Leominster IMA will be due as well as need to deal with several other issues. We noted that the budget includes an increase in the demand fee from $5 to $10. We noted that the additional infrastructure ($50K), engineering ($10K), and overtime ($3.5K) were not expected to continue in future years, and would be appropriate to be covered by retained earnings. However, even with the 20% increase and taking out the one time expenses, we would still be running a deficit of about $12,000. As part of the budget discussion, I & I was discussed and Jack will be developing a proposed workplan to address it including meter flow readings in the middle of the night, reviewing various buildings to see if there is ground water coming through their pipes, possible camera-ing of pipes to see if there are poor connections or breaks, as well as developing a protocol to enter resident's homes to assure that sump pumps are not connected to the system. The board unanimously voted the budget as finalized, with a 20% increase in rates effective July 1, 2010, including the increase in demand fee, and to take $75,743 from retained earnings to balance the budget. We need to send out a letter announcing the rate increase with an explanation. Bob will attend the Finance Committee meeting with Barb on Thursday, April 29th Administrative Matters 1. Paula asked for the motion NOT to require backup generators, Bob so moved, Steve seconded. Vote taken was unanimous. Paula sent Dan Hill, attorney for the ZBA, an email as they were meeting this evening at Town Hall to discuss the 40B and advised him of their decision. Fitchburg IMA - Commission continued the discussion from the workshop of sections of the IMA that Weston & Sampson had adjusted. Discussed that the total flow estimated in 2026 to Fitchburg per the CMP is 251,800gpd. I/l charge from previous IMA was removed and replaced with "excessive" language. Fran reviewed the 1.65 surcharge, metered flow, and getting a copy of the Fitchburg's budget currently and then annually. Fran will provide Barb the wording to send a letter to Joe requesting the budget information. Paula asked when the Selectmen should be involved and Fran recommended that it be before we go to Joe Jordan. Fran pointed out it should be in executive session as a contract negotiation and not a workshop. Agreed to do it at 6pm before the next meeting 5/25, if the Selectmen are agreeable. Steve said it should be a de-briefing since they have signatory authority. Barb needed to confirm that it would be an executive session, not a workshop. Fran confirmed that, even if we hadn't received anything budget-wise from Joe Jordan, that we would go ahead with the meeting. All agreed and determined to discuss moving ahead with the IMA if the budget information is not received with the Selectmen. Dave MacDonald (candidate for election to the Sewer Commission) asked to revisit Section 16, connection charges and the timing for payment to Fitchburg. He would like to recommend that we pay Fitchburg at the issuance of the certificate of occupancy, otherwise we'd possibly be paying a year before the connection. Point was raised that not all connections are for new construction. All agreed that we would change it to when the sewer Certificate of Completion was generated. For a project the size of Emerald Place, we could issue a blanket certificate of completion for the project. Commission discussed a cap on Capital Costs, that it appears in the Leominster IMA, but not Fitchburg, but we will have the John Fitch Highway cost instead Connection charge definition - The commission was provided a copy of the memo to Jim Lavin of (RD-Rural Development) containing description of the charge, backing out the labor that Fran had helped us develop. Memo spells out the minimum connection charge of $1760 could be reduced by $100 for the inspection fee & $10 for the permit fee as the only labor costs in the connection charge, leaving $1650 per unit that we expect for reimbursement. Barb had not been able to confirm with Karen that Jim had received it and what the feedback is. Fran has more ideas if they require more info, but his belief is that this will be sufficient. Sewer extension policy - Fran spoke in regards to the request from Bob Proctor to extend sewer up for 4 homeowners. In Fran's experience, he knows of no other town that allows people to do this. Only 2 ways sewers are extended is 1) town does it, bettering properties, getting portion of the capital costs, project approved at Town Meeting, and 2) developer comes in, extending sewer to get up to their property, and along the way there might be people to tie in. That's it - no other way. Too complex to do it for a handful of people - who's in, who's not, paving, minimum area, reimbursement, etc. Bob asked about the 40B with Pleasantview, where we agreed to waive fees on affordable units if they installed sewer on Pleasantview, and confirmed with Fran that that is okay to do this. We can charge the people on Pleasantvew, and it is up to us to form a policy for where we want to extend it and under what conditions the DPW Director stipulates. Fran clarified that the word betterment is only used when the town builds a sewer. With a private developer, it's a separate fee and you should have a separate agreement, noting everything you expect him to do and pay. Paula pointed out we can't as this is a 40b. Lunenburg Village - Paula asked to return quickly to Lunenburg Village and noted their correspondence states that we require lines to be outside public way and that is not what was voted, so Paula sent them an email for their hearing. Bob raised concern that it says to extend sewer to end of Pleasantview Ave. and doesn't specify which end in the Comprehensive Permit decision provided by Dan Hill today. It should state extend sewer service on Pleasantview to its terminus at Graham St including laterals to all abutting properties. It was noted that it does appear in Section J5, but nothing about grading in road which was #4 of our memo of 4/28/10 to the ZBA. Paula sent Dan an email of our issues including that Pleasantview needs to be reclaimed & graded. Sewer extension policy - Bob pointed out that we have an extension policy in place that states that the developer would present us with plans that the DPW would have to approve, and the developer would have a list of requirements to fulfill. Bob Proctor has 2 people that wanted to tie in and would pay to install the line. Commission discussed what happens for those that don't want to tie in, and Jack stated that laterals still need to be installed and discussion followed on whether or not they are obligated to pay the privilege fee and the different types of fees. The 40B was assessed a Compensate paws assessed a betterment and now the use is increased. The other privilege fee is up to the max of last etterment assessment for the privilege of connecting to the sewer. Bob Proctor's situation would be the latter. Jack asked about bonding for the b. Steve noted that if we make it too expensive we won't increase the customer base unless it is a development. Paula pointed out that we create a sewer service area to try and stop these miscellaneous extensions, and to do planned growth of the sewer system. Anyone wanting an extension will have to abide by the extension policy rules and pay a fee. Commission needs to determine a formula for that fee. Fran noted that the assessment bylaw was fashioned after Chelmsford's policy which Weston & Sampson had developed and encompassed 2 costs. If a developer is ===PAGE 2=== could be charged a privilege fee. Steve had issue that the 4 guys who put the money up getting charged the same amount as those on the street that didn't pay anything to lay the sewer line down. Alternative is to come to Town meeting and request a project, and betterments, and they would need 2/3 of the people on the street to agree. Steve reminded those present about Summer Street, where one property owner paid $48000 to bring the sewer up the street, with no help from abutters, and after the line was in, the abutter signed up with no cost to himself and that it isn't right. Paula noted that trying to charge different percentages for people, depending on whether they paid to run the line or not, is too confusing. Bob said everyone that is going to connect has to pay a sewer privilege fee and that is why it is a percent, but that it won't be $11,551 because they had to pay the cost of laying additional line. Bob noted we had 40% discussed and 60% - how about making it a 50% privilege fee? Paula asked if there was a motion. Bob made the motion that we establish a privilege fee of 50% of the prior betterment amount of $11,551.47 for all private sewer extensions of the sewer line, payable at the time of connection. Steve seconded for the sake of discussion. Steve maintains that 50% is too high. Paula reiterated that they couldn't even connect to sewer if we hadn't put in the system. Bob stated that what they are doing is they are buying into the system which says they are going to pay for prior construction which then helps the overall future capital structure which will help them and the existing owners. It is equity for the existing owners to say 'you've already paid into the system'. Carl said he could agree to 50% and noted that it was 40% and the town meeting raised it up to 100%. Paula asked if we were ready to vote. Vote taken. 4 were for, 1 against. Bob asked where this notation of percentage would be noted? Paula suggested we draft a policy for private extensions, and Barb pointed that we have a sewer extension policy. Bob read from current extension policy, page 2 of 3 that says all extensions would be assessed a privilege fee to be determined by the Sewer Commission, consistent with the sewer assessment bylaw. It was determined that we would add to Section 5 and say "as of this date, the Sewer Commission voted to make it 50% of the last betterment amount:" Pleasantview was brought up again for clarification. Per Paula, we will be charging the people along Pleasantview the 50%. Bob said that we waived certain fees within the 40B as a mitigation measure. All agreed that the fee would be 50% to everyone on Pleasantview. Every neighborhood will be different and at least a policy is established. Discussed that it can be changed later. So Paula confirmed 50% and if Bob Proctor comes in with properties that will have laterals to be installed, the Commission will determine how many properties affected and each will get a privilege fee and we will send them a notice of assessment of privilege fee - if not paid within a certain period, we will have to record something at the Registry. We can't bill until connection since the privilege fee is payable at the time of connection. A recorded lien will just protect us for assessing a sewer privilege fee, payable at the time of connection, when new owners are involved. We will need to talk to counsel. Steve mentioned Jack White and Whites Woods and that he'd never paid a thing. He is extending the sewer and paying for it, and Bob confirmed he will have to pay $5500 per unit. We need to let planning board know, building inspector, etc. that this impacts "changes of use". We do need to check with counsel first. Fran reaffirmed that you need to do liens to prevent it from being missed in the future. Carl pointed out, in the interest of full disclosure, we need to make sure everyone on a proposed sewer extension is aware that there will be a lien. If there is a line in front of your home, meeting with the Selectmen on the 25'h. Jay will be gone 5/29-6/5. I/I - Steve asked Jack for update on the I/l. Jack stated that this week the DPW is back on full duty since furlough. They had a meeting with Weston & Sampson and have started researching flow meters. Step 1. They will be talking with the schools -- all is starting this week. Bob asked Barb to check with Marion for the Walmart plans and their drainage plans. Paula said the Planning board should have all the drainage calculations. Neither Steve nor Jack thought it likely that they are draining into the sewer, but Bob wants to go with the big possibilities first. Need to look at all big oot areas: schools, I win City Baptist, Crossroads Plaza, etc. that may have inadvertently hooked up the pipe to sewer. Jack said it was unlikely ut so is a new sewer system to have an l/i issue. Everything was camera-ed, pressure-tested when it was built. Bob confirmed it should all be PVC pipe? Paula noted except for an area in Whalom. Bob noted his house on 94 Main had cast iron pipe from the house to 15' from the street. Not just Whalom that may have old pipes. Is it in the regulations to require PVC? If not, it needs to be there. Per Dave, building code updated and it is supposed to be the law as of June to bring PVC up to the meter on the house. Barb & Paula confirmed that it is not yet in the rules & regulations. Bob made the motion that we amend the appropriate section of the Sewer Rules & Regulations to require that when a house is connected to the sewer that PVC pipe is installed from the street to the plane of the foundation of the house. Steve seconded. Vote taken was ===PAGE 3=== Parkway, reconstruct the road to the point of pavement, bring down White Street and connect at 2A. Bob confirmed we would get $5500 per property along White Street. Per Jack, it is 850' as opposed to 750' on Pleasantview. Steve asked for the cost analysis vs pump station. Jack said that Kent wanted to run sewer down Maple Pkwy years ago. We are happy to have it. It is more flow to Fitchburg and Bob Bowen will likely have Sewer by-law -Barb asked Paula if she had had any further communication with Jeanne on the House Rule? Hearing was 3/9 -Paula has not heard anything more on it. We'll have to follow up with Kerry or Laura on it. 419 Sunnyhill Rd -Bill Drumm has conversed with Mike S. on numerable occasions regarding his assessment of 5 units for 5 buildable lots. Mike has looked at a plan and he and Matt Morrow (Conservation) went out to inspect wetlands on 4/27. Mike has no question that there are at least 5 lots. No change to the decision to assess 5 units. Emerald Place - they have paid for an additional 62 units for approximately $109,000. Quick discussion on FinCom's recommendation to put connection fees into a fund for future capital expenses. Paula also discussed the betterment fund issue raised by the Mass DOR. Fran questioned it and when the enterprise fund was voted in. Bob asked if it was prior to the sewer debt? Paula affirmed. Bob stated that they did temporary borrowing for several years. Fran questioned whether it has to be separate or not. Barb will send him a copy of the letter. Fran said at some time down the road we might want to have someone attend a course on Enterprise Funds run by Mark Abrams. Cost is $199.00. VFD Mass 1- Barb noted the memo for the connection charge has been discussed, as it pertained to the makeup of the connection charge. At ear to Samson on the type VD - Fran said it was all under control.. We just need an invoice. Then we'll just be waiting for Jim Lavin. Jack wants to get the money in hand before ordering the device. Jack and Barb can figure out the timing. Stone Farm - Barb received a check for $5280 for the 3 outstanding connection permits and Atty. Ken Gurge had picked up the copies of the documents he had requested. There has been no further word about challenging the betterment. Stone Farm is still investigating. Barb provided requested copies of documents 5/10 and voucher for labor & printing Administrative Matters • Commitment/Warrant from April billing was signed. April billing did go out today, May 12, with the rate increase insert. • Mr. Kenny from Meadowwoods had come to the meeting April 14 to get his invoice waived, but in the April billing there was usage so he was billed. We will communicate and let him know that if he had it disconnected and there was no usage, that he wouldn't be billed in the next billing. • Paula said she would be back in to work on the billing system • Weston & Sampson invoice was signed by Paula Bob wanted to state before meeting was adjourned and acknowledge the work of Steve deBettencourt & Paula Bertram for their years of service on the Sewer Commission. Thank you. Motion to adjourn was made by Bob, seconded by Steve, and the motion to adjourn passed unanimously. Meeting was adjourned at 9:14 pm. Next meeting is May 25 at the Town Hall. CONSENT AGENDA The Board noted the items on the consent agenda and had no questions: Rate increase - effective 7/1/2010, included in article in Sentinel Fitchburg IMA - awaiting budget information Sewer Districting bylaw - still ongoing in state house process Privilege fee policy - clarification of Sewer Commission policy change sent to Town Manager, DPW Director, Building Inspector and Planning Director Highfields Village - Communication with Planning Director regarding status of peer review funds CWMP - 2nd MEPA filing to occur mid- July, corrections to various tables communicated to Kevin, confirmed all parcels in Sewer Service Area included in flows (except 10 in Cross Street area.) Overdue town building acct bills - sewer bills not paid given to Town Manager. Meadowwoods reimbursement - backup info given to Town Accountant, awaiting reimbursement. DISCUSSION WITH DPW DIRECTOR 1. Jack noted that Janet Lane in Whites Woods does not have pipes in the ground, hence would be subject to a privilege fee if pipes are installed. 2. I/l & flow meter work update: GPS location for every manhole has been established, some installed during heavy rain. Baseline done on schools visually Wal-Mart roof drainage not tied to sewer. Will verify Hannaford's as well. After July 1str, will set a baseline at wet wells at each pump station and at questionable down gradient locations; portable meter required (probably by September). Readings will create direction of next steps. 3. Sean Patrick's Restaurant expansion - They installed a 2000 gallon grease trap outside which will be inspected regularly. Need to find out if we have an inspection fee and is the inspection coordinated with the Board of Health inspection of the inside grease trap. 4. Status of grease traps for school and use of Weston & Sampson. Jack will contact W& S in the new fiscal year. 5. Sewer Rules and Regulations clarification Jack clarified that it was never the intent to require a homeowner to replace their sewer pipes inside their building. Schedule 40 or cast iron must be present at the foundation. It will be the inspector's decision, should another material be present. New construction shall be schedule 40 or equal. 6" SDR 35 will be connected to the existing lateral of each residence and the line will remain at a 6" diameter until connected to the 4" PVC/Cast Iron at the house. Jack will communicate with Barb to assure that the wording in our regulations follow this understanding. Jack stated that for inspections the tasks involved include certifying that plan/sketch is acceptable regarding bends, cleanouts, etc., Provide contractor with lateral location, inspect lateral connection before backfilling, be sure old tank is pumped and decommissioned, inspect at the very least a portion of the "run" and the connection to the existing pipe at the foundation. 6. Drain layer's insurance requirement Jack provided that general liability should be $1 M each occurrence, $1 M personal & Adv injury, $2 M general aggregate; Auto $1 M, and Worker's Comp at $100,00 each accident. The Commission was satisfied with this listing. 7. Drain layer/'s cash bond requirement Jack recommended $1,500. The Commission questioned this level - Bob Proctor and Jack noted that Worcester requires $15,000, Fitchburg $5,000, Leominster $5,000, all of which are released after two years passes from the last installation of a system. The Commission will review this at a future meeting. 8. Variable Frequency Drive Motor - has been installed in the Townsend Harbor Road pump station, financed through Meadowoods grant. ===PAGE 2=== by-law definition of a dwelling unit. After discussion, this was voted unanimously. BILLING ISSUE 27 Whalom Road - It was discovered that while this site was connected August 2006, a certificate of completion was just discovered on June 14th. As a result, there is an outstanding amount due of $1,610.86 which was never billed to them. After discussion, it was voted to allow the homeowner to make quarterly payments over a year's period without interest. ADMINISTRATIVE MATTERS The Commission voted to approve the minutes of May 12, 2010 (Carl, Bob and Jay). Open Meeting seminar will take place on Tuesday, July 6t at Leominster City Hall. The next meeting is July 14t. EXECUTIVE SESSION The Commission voted to go into executive session to discuss strategy as relates to pending litigation. Carl, Bob, Jay, Butch and Dave voted in the affirmative. The regular meeting adjourned at 8:30 pm. CONSENT AGENDA Hollis Hills - - moved to General Discussion I/l - moved to General Discussion Emerald Place modification - moved to General Discussion Budget FY11 - Commission reviewed the YTD expenses for FY11 back next meeting 8/31. Wright Pierce had been hoping to submit to MEPA on 8/16, but will have to wait to give Commission time to review. Once SC approves, KS must sign 3 copies and get to Boston- next possible date was 8/31 - next submittal is 9/16. Commission provided with screen prints of CMP on our website that had been updated with Phase IV and sewer map. Lunenburg Village - Barb advised Commission that she had emailed Don Bowen 7/20 and again 8/5 for update, as to whether and what was recorded on the 40B, to know whether we will need to record liens. Per Don Bowen, the decision had not yet been recorded. Highfields Village -Barb advised Kent Oldfield of the estimate of $2500 for peer review 8/5. We will need set up escrow triparty account and do up agreement with Weston & Sampson. Kent had sent letter to Planning Board requesting extension from Planning Board. Per Marion, Planning Board needs letter from SC discussing the request and subsequent need for Highfields extension NDES permit-Barb advised Commission that she had emailed Kevin Olson on 7/28 to review electronic copy of NDES permit and advise the Commission as to the implications. She forwarded electronic copy of the permit to Wright Pierce on 8/5, cc'g SC. Fitchburg IMA - Barb advised Commission that she had called Joe Jordan 8/5 on the status of the budget information - he was hoping to have something, probably not everything we asked for in the letter of May 18, before the meeting on the 11th. However, he is on vacation this week and nothing was received. Billing Averages worksheet - Commission was provided the Billing averages from the latest billing for Q1 FY11. 2009 Town Report -Commission advised that the 2009 Town Report is available online, but not yet available in print per Selectmen's office 8/11. GENERAL DISCUSSION Grease traps-Bob spoke with Loxi Jo Calmes, Superintendent of Schools, after the last meeting to advise her that it is a focus items for the Sewer Commission this year. She did confirm that the grease traps are cleaned annually at end of school year and that John Londa had discussed the issue with her. Bob & Loxi discussed that it was the Commission's understanding from multiple sources that the frequency will be determined upon condition of grease traps, and could possibly need to be weekly. However, with diligence, these cleanings may negate need to install outside trap. Bob pointed out that in regards to the regionalization discussion on the table, nothing will happen for over 3 years and we cannot wait if an investment is necessary. Discussion followed as to the responsible party to do the cleaning. Butch asked can we count on their word that they've been cleaned? Bob stated that it should be part of the food inspection by the Board of Health - and that the first time it is opened, that the Health agent should be present. Dave pointed out that in shrewsbury, inspection is done once a month. Steve deBettencourt interjected that the Board of Health is responsible for interior traps. Bob presented the general question on Centre Pizza - where is the grease trap (used to have a tight tank) and also same question of Village Grill, Hadwen's Market (added meat counter), Congregational church, United Parish - both have kitchens, the Lunch Box, Bangkok Hill, Conrad's. There should be communication between the Sewer Commission and Board of Health. We need to inventory all non-residential buildings with kitchens tied into sewer. Bob is planning to attend the next Board of Health meeting. Dave stated he will check the laws. Bob said he is doing all this so we can possibly save the Town $30,000 just by doing timely inspections. Steve D. asked if Weston & Sampson had done any further work. Bob stated that they are planning to come in for a workshop on 8/31. Steve handed out a design of a grease trap from Sani-Tank in Fitchburg which goes for about $5000, a much simpler design than Weston & Sampson had presented for the high school, and doesn't have to be 5 in depth. Bob stated that it may be a capacity issue - need to identify where it is coming from and the storage required. Bob stated that we need to identify the possible sources before spending money and the other properties that need to be checked out - Public Safety, Trudies, Eagle House, all churches, the Harley House. Discussion followed that a grease tank installation at the high school may have to be funded through Capital planning. Pool policy - Barb noted the receipt of a letter from a resident at 27 Lesure Ave requesting adjustment for the filling of his pool, and that the office had received a 2nd request by phone for 862 Mass Ave. Discussion followed and it was determined that we would come up with an application that a resident would need to complete to fully fill a pool (we would not adjust for topping off a pool). They would state the size of the pool, and we would waive that portion of the sewer bill, but the application must be received at least 7 days prior to the filling. We need to get a list of the pools and bring a draft application to the next meeting. We could then send a notice out to all pool owners of the new process for an adjustment. Barb asked what to do with the current requests received? We need to figure out the size of the pool and the associated credit due. 27 Lesure was 11,000 gals. (or 1467cf) or about $118. We'll re- visit at next meeting. 27 Whalom Rd - Barb had received a letter from the resident taking issue with the back-billing from 2006 for usage. Discussion followed that the resident was aware she was hooked into sewer and would know that there was a cost to that. Resident owes $1600 going back to when she connected, adding $400 to 4 quarterly bills, in addition to actual current usage. Bob wants to check if we can legally back-bill. Barb will verify that she was billed the full amount. She ===PAGE 2=== antonio tease we ending send Pleasantview. Bob asked for a motion to bill the property owners the privilege fee at the time the extension is completed, and give them 10 years to pay it off, and that such extension will require 2/3 vote of the affected property owners. Butch so moved, Carl seconded. Discussion continued and decided that we would insert the language from Section 2 of the Sewer bylaw stating "prior to the initiation of a Sewer Extension project in any Sewer Service Zone as identified on the Sewer Service Area Map, and prior to submitting a Sewer Extension application to the Sewer Commission, a petition must be received indicating that 2/3 of the affected property owners approve of the extension", and that once the extension is completed, the affected property owners will receive a bill for the privilege fee, which they can determine can be apportioned over 10 years." . Vote was taken and unanimous. Barb will send a memo to the Planning Board regarding the 2/3 vote required for any sewer extensions. Capital Planning - question brought forward as to why we must submit, if we are not incuded in the general Capital Planning process. Bob stated Kerry and the lown need to know long-range plans. In the planning, we should include 1) grease traps - Jack to talk to John Londa on grease traps. Depreciation was discussed and a municipal method of accounting, which uses a stabilization fund instead. Bob stated that 5% of our budget should be slated for capital improvements. Request was made again to have Karen Brochu attend our meeting. Dave asked about the portable meters that have been discussed for I/l remediation. Sewer truck purchase was put out for discussion and whether the truck is leased. Next time Jack comes to a meeting, we need to talk with him about capital improvements. Barb raised the possibility of hiring a billing service - currently folding and stuffing over 400 invoices. Whether the Water Dept could receive a stipend for producing our sewer bills at the same time was raised as a possibility. Barb brought up the possibility of the investment of contracting with Cartographics, who already administer the Town's maps, to install GIS for the Sewer Department and Commission agreed that they would like to have him come present to the Commission at our next meeting. Barb will contact Cartographics to request they attend. 40B's - Commission reviewed Jeanne McKnight's response to the question from the meeting of 7/14 as to whether our bylaw can protect us from 40B's outside of district.- Jeanne's response was determined to be too vague to provide a definitive answer to the question. Whalom Mobile Park - Barb had produced a spreadsheet showing a comparison of 2 different billing methods - billing for the entire water usage or per account (as is currently done) It behooves the enterprise to continue billing as we do, and as such, no change will be made. Hollis Hills - Bob reviewed the history that the ZBA had originally disapproved the 40B and the developers appeal. Commission reviewed Dan Hill Appellee's Supplemental Opposition to Hollis Hills' Motion for Enforcement and Bob's Affidavit that was received 7/29/10 Emerald Place modification - continuation of hearing was held 8/9 and modification has passed. Per Bob, they are not changing the sewer design. There is no affect to the Commission or to flows. The number of units was actually reduced from 240 to 238. Barb restated that the principals are aware that they will need to attend a Sewer Commission meeting to present the modifications and obtain the Sewer Commission's approval. Steve wants to have confirm the direction of the sewer flows and whether that has changed. / - Dave MacDonald reviewed his tour taken with Jack Rodriquenz around town and the handout he had done up as a result of that tour. They discussed I/l, roof runoff, drain placements, retention ponds. Barb will contact Marion Benson about the retention pond in front of Hannaford and its need for better maintenance. Bob pointed out that with the NPDES permit, we will need to document everything we do to remedy I/l issues. Barb will start a log. Dave also produced a brochure from the Lunenburg Water Department and the concern of the drawdown of Hickory Hills, and the potential for further issues. Bob also wants to talk with Jack about the school roof drains and where all the water is going. Steve brought up the timing that this is when we should be checking how many times the pumps are recycling. Jay questioned whether the pump stations had flow meters installed. Barb has data from the Unitil bills she can Administrative Matters Commitments for Q1 billing $86,231.10, and final commitment on FY10 adjustments $578.81 were signed. Work session with Weston & Sampson was confirmed for 8/31 at 6pm. Irrigation meter posting to be put up on website today was reviewed. Delinquent town accounts are being taken care of by the Town Accountant. Interest will be forgiven, as it is for all town accounts. ZBA hearing tonight-Carl Flinkstrom -Barb pointed out that there was a ZBA hearing at the Town Hall this evening for the proposed veterinary clinic across from Twin city. The Commission will have to review the plans as it is a change of use. Executive session minutes of 6/29 were reviewed. Butch made the motion to approve the minutes, Jay seconded, vote taken was unanimous. Marketing of Town Sewer - Dave pointed out we could do a much better job at promoting connecting to sewer. The website could be vastly improved, and we could do a media blitz. Consider even sending a coupon to connect whenever a home is purchased like Welcome Wagon. Motion to adjourn was made by Butch seconded by Jay, and the motion to adjourn passed unanimously. Meeting was adjourned at 9:57 pm. Next meeting is August 31 at the Town Hall.
