Carl asked about the policy and if he'd seen it. Carl noted that if the water is turned off, then we can do something. Mr. Emma asked the commission to contirm that we still bill even it there is no usage? He closed on the 1gm, and moved in at the end of the month. Carl restated the policy and the minimum charge. Only if the meter is off and there is no flow is the only time there is no bill. Troy noted on new accounts that it is also the administrative time to be considered. Mr. Emma proposed to have his payment of the invoice to be applied to the next bill. Dave questioned the process, when both owners had 0 usage. Carl said to credit the bill, policy would have to be changed. Troy again pointed out how much time is involved in billing, final read invoices, account set-up, meter #s, owner info and that the minimum charge covers that time. Mike noted that the previous owner was billed through 9/11, and Mr. Emma through 9/30, and minimum charges apply. Mr. Emma summed it up saying he didn't agree, but respects the Commission's time and left the meeting. Troy said that no vote was needed, unless they were to change policy. Discussion continued that even if an owner is in California and has 0 usage, would we credit? No, because the meter is on. Same scenario here: meter on, minimum charge. Carl asked the representative of the Drumm Privilege Fee Abatement Request to come in to the meeting. Susan Drumm came in and she owns the property with her brother Bill Drumm, who had sent a letter expressing his disappointment at the Commission's ruling. She ran through the chronology of events starting in 2008 when they were bettered for a total of 5 units. They tried to develop 5 lots and were told by Szoc Surveying that they couldn't do this with the frontage and wetland issues. They advised the building inspector in February of 2010 and Susan added that part of the land is in chapter. She stated that they have been trying to meet the rules. They have now submitted a plan for 4 lots to the Planning Board, 2 of which have been sold, and the other two are on agreement. They are asking for an abatement for Lot 5. They paid cash for the betterments and are just asking for a refund and not even asking for interest. At this point Troy advised the Commission against getting in to too much of a discussion as this may go to litigation. He stated that per Mass General Law we are prohibited from processing an abatement and that it must through the appeals process. Susan added that on Jan 7, 2010, they were sent a notice of privilege fee assessment, that references the privilege fee notice, and 2 letters from the zoning officer, but she stated that they never received the privilege fee notice or the 2 letters. Barb made her a copy of the notice, and will mail her the 2 letters. Troy noted that since this could go to litigation, communication should be restricted to the party that submitted the request. Barb will send copies of the 2 letters to Bill Drumm. Susan left the meeting. FY16 budget - Barb handed out FY16 draft (copy of rev2-meeting discussion file) and the YTD FY15. Carl started the discussion on revenues. We are assuming of the 80 properties in the sewer project, that 30% will connect. That means 24 new accounts, which is a 5% increase overall. This is the number for the whole town that we'll use for FY16 budgeting as far as new connections just to keep it simple. Discussion followed about not increasing revenues but decreasing expenses, as Carl would like to have a positive to put toward the retained earnings. Dave thought that infrastructure should be increased from $30,000. Discussion turned to outsourcing and SWSS and parts for the repairs. Carl introduced the thought of having the grease trap program outsourced and funded by the permit fees & fines. Troy wanted clarification that infrastructure is for any parts outside the outsource contract. All present agreed that Infrastructure cost should not be reduced. Dave made the case for breaking out the items covered by Infrastructure and making sure generator repair is included next year. Dave stated that just like we increase infrastructure to $40,000, we need to increase Outsourcing as it may not work out with SWSS, so we should increase as a contingency. Troy asked Jack if he was happy with SWSS, and Jack stated their behavior was wrong at the last meeting, but he has no issue with the work they are doing. The Outsource for SWSS was bumped by 2.5% as Deb already agreed, but after FY16, we don't know. Mike stated he accepts outsourcing. Carl proposed that we add in the delta of the Weston & Sampson bid amount of ===PAGE 2=== ask SWSS for quotes to do remaining stations, once this question is resolved. Carl noted if these were done quickly, they d all be online for 2016. We need to account for this in the telephone expense line. Barb will get her answer on whether the phone line can be removed with SCADA, and if so, the expense is a wash. Dave asked about going direct and Jack stated in no uncertain terms that SWSS is our agent for the work relating to the pump stations. Under Engineering, Jack asked that each monetary amount should be spelled out under the heading, not in the descriptions making it easier to understand. Carl reviewed that we should increase infrastructure to $41,000, outsourcing add about $25,000, level fund legal at $9000. The outsourcing line will have Weston & Sampson's RFP price, plus 5%, and $7500 for the generator. All present agreed that Electricity needed to go up by 30%. Discussion occurred on the aggregate not being on all stations, and whether we should consider solar power for the 10 stations. We'll increase Telephone with the potential for 7 more stations with SCADA and the associated wireless monthly cost of $36. Mike would like the diesel cost bumped up in case there is an extended outage and there was a discussion about that type of outage and how it would be handled. Commission determined that fuel should be level-funded. Troy noted that grease trap mailing is mentioned and reminded him that since it hasn't gone out yet, we will need to re-look at fines. In September, fining back to start of fiscal year was reasonable but now it wouldn't be fair. Carl agreed and wants it added to next agenda. On Leominster usage, 5% increases should be based on the Fy15 budget amount. Discussion turned again to the basis of an operating budget and Car's preference to put some away for capital expenditures. We don't necessarily need a balanced budget with the extra going to retained earnings. Carl asked Jack about expenses he foresees, should we have $100,000 available, and what he would see it being used for. Do we build the business or reduce costs? Jack said he'd like to think on the question before answering. Dave brought up the Whalom area issues and getting them resolved. Commission discussed the Board of Health DHCD fund, whether the monies still exist and using it as a fund for homeowners in need. Bob E., who had joined the meeting, said he would look into it, that unless it was voted on at town meeting, the monies are still there. Dave stated that anything we do positive for the community comes back to you. Also, another item to consider is the I/l work so that if Leominster has us switch to meter-based billings, we'l be prepared. Jack mentioned again running the sewer to the old primary school, which would improve the land's value. Bob mentioned VFD's for other pump stations. Commission discussed the potential $24,000 betterment and how we can get it reduced for the residents, and future connections that will have that as the basis for assessing privilege fees. Lancaster Ave. is next on the agenda. Discussion of the Lancaster Ave. extension and the warranty reserve that needs to now be released after the warranty year is passed. Jack wished it could go to the residents but it can't. Carl stated that the amount is about $3600. Troy asked if there is anything that could go wrong, and could the money be used to make it right? Jack noted that we held the money for a year in case there was a problem with the line. There were issues in April not addressed, but he is tired of fighting about it for $3600. Carl stated it was a commitment we made to Elliott. Troy proposed taking the money to make the town whole with identified issues. Carl agreed but stated this was not a clean scope of work, and without that, we don't have much to stand on. Carl asked for a motion on Elliott's request to return $3622.50. Troy made the motion that we give back the money and move on. Carl asked for a second. Mike stated, under the circumstances, he'll second. Vote taken was unanimous. Carl stated that in the policy discussion, there should be a formal sign-off process, like the Dan Proctor project. Bob E. stated that the Board of Selectmen had discussed requiring a bond and that the Town should have specifications that contractors should be held to, that this is a known issue in the Town with other projects, not just sewer. Pratt St/Lakeview Ave SRF project- Barb noted that we had received the Project Acceptance Certificate with the limit based on certificate of title, but Wright Pierce was happy that it had been received. Barb noted that the Easements went out on January gin, and only 1 return receipt received so far, on the Brogna property. Privately funded Extension process - Carl noted Troy's ===PAGE 3=== GIVE CIEN the penn was issued 12/4/13 with the connection fee based on 7 bedrooms. The owner questioned bedroom count at the time, and was referred to the Board of Assessors (BOA) who determines the number of bedrooms that the Sewer office uses to calculate the connection fee. The house was connected to sewer 12/11/13 and quickly sold on 12/17; Barb received a confirmation of 6 bedrooms from the BOA after inspection on 3/7/14. Marcia Boudreau (trustee for Szocik Realty Trust), had recently inquired as to the credit on 12/10/14. The credit for the 7 bedroom amounts to $770. Troy made the motion to credit 65 Fairview Rd. $770.00, pursuant to the Board of Assessor's assessment. Dave seconded. Vote taken was unanimous. Carl said that Privilege to assess the Privilege fee, the resident was sent the notice, and the resident has responded that he wants it apportioned on the tax bill, so a Sewer Assessment Statement has been done to record a lien at the Registry which the Sewer Commission needs to sign. The Commission signed the Statement and Carl will bring it to the Clerk's office for notarization. As for Minutes approval, discussion occurred with Bob E's input, that a majority of the Commission is required to approve the minutes, and not all members present at the specific meeting need to be the ones to vote on the minutes. They can be approved based on Mike & Dave's word that the minutes represent what occurred. Dave made the motion to accept the minutes of 10/28/14, Mike seconded, and vote was unanimous based on their recommendation to approve. For the minutes of 11/18, Dave made the motion to accept minutes, Troy seconded, and the vote taken was unanimous to approve the minutes of 11/18/14. For the minutes of 12/9, Troy made the motion to accept, Dave seconded, the vote taken was unanimous to approve the minutes of 12/9/14. Business Manager Report- Invoices - Barb had 3 invoices which were approved. There were 2 Permits to connect - 12 Joslin St. and 89 Leominster Rd., and SCADA on Leominster Rd. is due to be installed by the end of the month. Regarding the SWSS Pump station reports, Mike stated that he had done the pump station tour on 1/12, and that it was very worthwhile. The Commission discussed the flows of Leominster Rd. versus Dana St.. Carl noted that they are still shoveling sand from Graham St station. Carl added that he talked to Jack about the 37 Graham disconnection and that Mark Flagg hopes to do the work fairly quickly. UPCOMING MEETING - January 27, 2015, Town Hall. Commissioners Comments -Dave brought up the article that was in the Sentinel today where the Sewer Commission made the decision to reduce the fees, instead of the ZBA. Bob said a simple letter to the editor, clarifying the process on 40B's and the ZBA responsibility for determining affordability and that the Sewer Commission remains steadfast with what the charges should be, would go a long way. Carl will do the letter and clarify on TV at the next meeting. Carl asked if there was anything more and asked for a motion to adjourn. Troy made the motion, Mike seconded. Vote taken was unanimous and the meeting was adjourned at 9:55pm. Carl pointed out that any shortfall comes out of retained earnings eventually. Dave asked 'why the shortfall and Carl noted that by leaving a reserve of 2.6 million for the Town and future connections, it reduced the betterment income coming in. Carl, Barb & Karen Brochu, the Town Accountant, will need to look at the timeline of the loan, and the detail on free cash and retained earnings after the budget process is over. Carl stated the revised budget has an overage of $64,000 before the betterment deficit of $147,000 which he feels we can live with. The Commission discussed the Infrastructure line, the history of spending, and that it is the line to absorb any emergency repairs. Also discussed was the overage less deficit leaving $82,000 against retained earnings and the need to raise retained earnings to help pay back loans. Dave asked how the new project will affect the budget. Carl noted that if we assess the total project in betterments, it balances perfectly. But if we take some to set aside, we need to study the result. We won't know the amount until the project is complete. Commission looked at Leominster usage line item and reduced it down to the original budget amount of $235,000. Dave was concerned that Fitchburg might be planning on a rate increase. Carl will check his notes for the negotiations to see if there is any reference to the next rate increase. Legal expense was discussed and the costs for Hollis Hills. Carl had reduced legal to the level that it was initially proposed. Carl asked if he could get a motion to go with the $64,000 budget. Butch made the motion, Dave seconded. Carl asked for discussion. Dave wanted the l/l work reduced, and suggested $5,000, also removing specific contractors' names from the budget document. Reducing the I/l project by $0, long with the reduction infrastructure and Leominster usage, brings the new overage total to $69,775.27. Carl restated the motion to approve the budget with the discussed changes, bringing the proposed budget to a $69,000 overage. Vote taken was unanimous. Private Sewer Extension workshop scheduling was tabled until the next meeting. I/l Spring 2015 project Barb had received the Weston & Sampson contract for $30,000 which mirrored the proposal received and discussed with Pat Cotton at the December meeting. Carl signed the contract. Discussion followed on the use of peer reviews and when they are appropriate and whether we should have a second opinion on our project. None was determined to be necessary when it is our own engineer. SRF Project status -Carl asked for a status on the Easement paperwork. Barb provided the Commission with the latest checklist. She noted 6 owners that haven't submitted the paperwork, which covers 9 parcels. Carl suggested reaching out to Larry Corbett, who initiated the project, for assistance. Carl reached out to the Stevens and will be meeting with them on Saturday. Barb reminded Carl that Jeff Blake, our town counsel, is available for anyone's concerns. Barb will reach out to owners Amburgey & Raboin, Carl will reach out to Hitchcock and Dave will reach out to Kopley & Brogna. Barb will send him the contact list. Brogna lives on Pleasant View Ave. Carl asked Barb to make sure the plan is on the website. Dave asked Barb to send him paperwork that he can bring to people's houses including the plan. Barb pointed out the email received from counsel today regarding eminent domain, and that it can be done very quickly. Carl expressed his preference to do it via easements. We may need to go that route but not yet. Carl brought up the fact that we want to have options for pumps and not just go with E-one, so that we can provide the residents a choice. He has been talking with Kevin Olson from Wright Pierce on this and expects Kevin to provide him the information. SWSS - SCADA progress -Barb noted that for the SCADA system on Leominster Rd, SWSS and First Electric were hoping to be done last week but she hadn't received an update, and with the winter weather, it may have been delayed. We had received a quote as requested for Mass 1 but it did not include the remote access that they are doing on Leominster Rd. so Barb will ask Debbie to get back to us with that included. Barb advised the Commission that Debbie couldn't quickly provide quotes for the remaining 8 since they are all different. Carl asked then that she get us the quotes are she gets them. Dave asked about the progress on the generators. Barb will check. Whalom Luxury Apts. Commission also discussed with Dan whether the line could go up Mass Ave. versus Beal. Dan advised due to line depth and grade, it had to be Beal. Barb noted that both the Betterment bylaw and connection charge policy base the fees on 12 months of water usage. Upon inquiring as to the usage for 12 months, she was informed by the Lunenburg Water Dept. that the facility has much greater usage for 2 quarters of the year. Barb had figured connection charges going ack over 24 months, proposing that, in order to do so, it is required of the WCU agreed to install an irrigation meter, takin ne high usage quarters out of the calculation. This sparked debate, and Carl wanted to provide Dan 'worst case scenario pricing, by pricing the betterment and connection charges based on the last 12 months only. Dan agreed. Butch pointed out that the consensus seems to be that the Commission is in favor of the private extension if WCU wants to proceed. Carl made note to Dan that the privilege fees quoted are based on the last betterment assessment of $11,551.47, but if the Pratt St. project is completed before this extension occurs, the betterment could be based on a figure much higher. Dan understood and will advise the customer of the danger in delaying the decision. Dan stated that the next project proposed was a similar situation to that just done for the Highland Ave. This property is on Upland Ave., the resident's sewer is in failure, and they cannot find another solution on the property. They would like to connect to the sewer on Electric Ave. The house is the first one up from Electric on the right. Dan proposes running a line from the manhole up 50% of the property. Project would be in the Sewer Service Area. Troy asked about the notice to abutters and Commission discussed which properties might quality. Discussion went back to 603 Mass Ave. as well, and whether Sunnyhill or other parcels on Mass Ave. could be served. By putting a manhole on Beal, Dan noted the potential for a lot more users with smaller parcels further up Beal and restated the issue with gravity on Mass Ave. Butch noted that if the line goes by the house, they have the option to connect. Carl noted that Troy's question is still valid and a policy needs to be formed. Dan stated that the peer reviewing engineers would probably do a topographic study, and bring issues to the Commission's attention. Carl asked that the engineer for the plan use the WMP as a guideline, as any extension should be consistent with the master plan. Carl asked that we get back to Upland Ave. As for other residents that might be in favor, Barb noted a survey had been done previously, and she could check the responses for those affected to see if they were in favor. Troy noted that we should not make it a requirement of the contractor to contact residents. Dan noted that his 3d issue was the 17 acre Whitcomb property on Prospect Ave, and Cross Rd. Dan had been asked to check, with sewer going down Cross Road, whether they would be able to subdivide the property and connect to sewer. Barb pulled up the Sewer Service Area map on GIS and noted that only the first 100-150' back from the road is in the SSA. Carl reinforced that they would be unable to connect properties in the back acreage, but having already paid a betterment on the property, that they would not be assessed another betterment. With that Dan left the meeting and, with Sue Bunish present from Pleasant View Ave., Carl asked the Commission's permission to move that agenda item up. Carl introduced Sue and gave a brief history of the street's attempts to get sewer on Pleasant View Ave., along with issues of the water pipe and pavement. Carl is hoping to meet to discuss the issue with the DPW & Kerry. Sue provided more details of her and her neighbors' attempts to get sewer, adding that it has gone on since 1980's. Carl said they just need to get 2/3 of people, and take it to Town Meeting to pursue the extension. Sue noted it should be cost effective, houses are close together. She also noted that they've had major issues with Leominster water and gave a brief history. It was determined that the Commission could send a letter out to everyone to determine interest. We'll need to determine cost estimate. Troy noted it may be in Leominster's interest to upgrade pipe at the same time. Carl agreed, but that would be separate from the sewer project. Troy stated that it looked like it was unanimous to support sewering Pleasant View. Carl summed up saying we would get a letter out, with an estimated cost, and get a placeholder on the warrant for sewering Pleasant View Ave. We will give Sue a 'heads up' when the letters go out. Carl is planning still to meet with Jack and Kerry regarding the road and water service. Pratt St/Lakeview Ave SRF project - Easements - Barb stated that we had received another easement, and expect three to come in next week. Carl updated the Commission on the status of the Stevens and Hitchcock easements and that Dave was going to knock on doors. Carl added that per counsel, we can obtain eminent domain within 48 hours. Wright Pierce had stated that we didn't have to have all easements in place to go out for bid, but must have full title before accepting bids. Pump Specification/ agreements - Carl noted that he is trying to get specs on systems other than E-one to give the residents options. Kevin Olson of Wright ===PAGE 2=== manage the process. Commission discussed outsourcing to collection agencies, or small accounting firms. Mike noted that the letter should state that non-compliance will affect the issuance of your license, and co Kerry Speidel. Carl will work with Barb on the letter, and Troy will research collection agencies in the area. Barb stated it would help to know how other towns manage this, but all present acknowledged that most towns have leverage through their local Board of Health. Private Sewer Extension workshop scheduling - Carl asked for a good time for everyone to attend a workshop, and it was determined that it would be scheduled for Tuesday night, March 3, at 6pm here at the DPW. Barb will check with Dave. FY16 Budget - Carl's plan is to go forward with the budget discussed with the Commission on February 3rd, with the $69,000 figure. This amount can help to offset the $147,000 deficit in the betterment fund. The Accountant had provided the costs through 2047, and Carl wants to look at reconciliation of funds versus loan payment. Bob noted that when the betterments are paid up front, the Town does not get any interest, and discussion followed on not letting the burden fall to the current users. Another issue brought up by John Male from the FinCom a couple years back was that the roads were repaved as part of the project, and that we could also ask the town to help cover costs in return. Carl also wants to look at collecting privilege fees after all the project costs have been covered to offset future expansion. Bob mentioned that he questioned whether the town's payment included interest. Carl noted these are all items for discussion and research. On Sewer Commission Projects -Flow Rate/Metering -Mike noted that the couple of spikes he saw in the report on Summer St. and Mass Ave. were weather related since they both spiked together. Carl has the NOAA link and will send it to Mike. He remembers Weston & Sampson saying that you usually see a spike 5 days after a weather event. I/l reduction project (Troy) - Troy stated that the Sewer Commission had been previously advised the only manhole that had an issue was that on Elizabeth Street, which was to be taken care of at the time the house on Graham Street was disconnected from the sewer. In a meeting a few months later we learned that Jack planned to fix all the manholes on Mass Ave. Troy stated the Sewer Commission cannot make an I/l plan without accurate information. Carl suggested that we have Weston & Sampson do a study of manholes and give a report of what needs to be done. Barb will contact Pat of Weston & Sampson to come in to discuss, prior to starting the l/l project. Barb stated that the Town Meeting warrant is on the agenda to consider any other article besides Pleasant View Ave.. Troy asked Bob if the Board of Selectmen can do anything for Pleasant View. Bob mentioned that the Board of Health fund will be dealt with at Town Meeting, for helping residents with either septic or connection to sewer. It has upwards of $125,000, and applications will be income-based, with the MRPC (Montachusett Regional Planning Commission) administering the loan program. Barb noted that a recent Permit to connect was for 712 Mass Ave., the Poirier property, to be developed by Lorden. Barb had the Q3 Commitment of $217,200.45 for the Commission's signature. Also, the Weston & Sampson contract which was discussed on 12/13 with Pat Cotton, and agreed to, received and signed on 2/3, never had a formal vote to accept the contract. Troy made the motion to ratify the consensus of the board to approve the contract, signed on February 3rd, Butch seconded. Vote taken was unanimous. Barb pointed out the town-wide invitation for the Public Access Open House, and reviewed the upcoming meeting dates of February 24, regular meeting at Town Hall, and the March 3rd workshop at the DPW on private extensions. Carl asked if anyone had anything more and said he would entertain a motion to adjourn. Butch made the motion, Troy seconded. Attendees: Chair, Carl Luck, Vice-Chair, Dave MacDo nald; Members, Mike Nault, Troy Daniels. Butch Bilot ta, Business Manager, Barb Lefebvre. Carl opened the meeting at 7:03pm, introducing Pat Cotton from Weston & Sampson. Pat provided a handout, and advised of the plan to plot all the manholes from the data Jimmy Breault already had on his GPS , apply a numbering system and send to Cartographics to add a nother layer to the town maps and sewer system. Thi s would cost about $1000. Carl asked if he could sen d us an email with that cost and the Commission can vote on it at their next meeting. Pat proposed that aft er that had been completed, Weston & Sampson could do town-wide manhole inspections. Pat estimated that for 350 manholes the project would run around $25,0 00 and would include recommendations for manhole rehab ilitation. Pat noted that Lunenburg’s covers are la rger than others but didn’t recommend making any changes and staying consistent across town. As far as what else could be done to reduce I/I, Pat noted from the pri or report that infiltration is not the problem, mor e inflow. Dave inquired about temporary meters in the Whalom area, especially in Graham St.. Troy brought up the know n issue at 37 Graham with the broken pipe and asked P at how much I/I that could be contributing. Pat sai d it depends on where the pipe is broken and how deep. Tr oy wanted to know if the repair should be done befo re or after the I/I work. Pat suggested another alternati ve for capping the line by mentioning that contract ors, such as NEPCO, can come in and seal the pipe using a bladde r. Carl asked if the bladder can be removed easily once the pipe is repaired. Troy asked if it would be more than $1000 and Pat thought so, but the road would not have to be dug up. He thinks it is deep there. Pat will get the Commission a quote and they can compare to the cost of having a contractor dig. It still may be cheaper a nd we don’t need to repair the street. Dave asked a bout installing temporary meters to monitor flow on Grah am St. Carl reminded Pat that he had suggested usin g the Leominster Rd. pump station to determine flow. Pat would recommend running a drawdown test to check accuracy of flows. Pat said a simple drawdown would work without having to install a temporary meter a nd you can have the subcontractor in charge of the station s do that. We can ask SWSS to do it, or have Weston & Sampson come do it with SWSS there to watch for fut ure investigations. Troy asked if that would be his recommendation over putting in temporary meters. Pa t wouldn’t recommend putting meters in, it is very expensive and estimated it to be around $8000 for 1 0 weeks. Dave didn’t think it was that expensive. P at will check but added that they already did that analysis . Troy added that we need to consider what the Commi ssion would do with the data. Pat said we could study Gra ham this spring during high groundwater, study the manholes and TV all the lines. Dave said there is a situation going on on Graham St. and still getting dirt at the flow meter. He still thinks someone hooked up storm drains to the sewer. Pat said there was no smoke c oming out the storm drains when they did the smoke testin g. Commission discussed how a resident might have g otten around being found out during smoke testing. Pat ad ded that they looked at each residence carefully. D ave still wants to study storm drains in that area. Pat revie wed the process of studying storm drains when smoke is detected using dye tests but none was seen in that area. Storm drain systems are significantly over-si zed. Is there a flooding problem during high rain periods b ecause of a drain system backing up? Dave is just n ot convinced that the dirt at Graham St. meter is not just 37 Graham and would like to send a camera up t he storm drain. Pat stated that the Commission would be bett er served by camera-ing the sewer line during high ground water, to find a service connection that doesn’t ma tch up with a house. Carl agreed that it is a good thought and that he is glad there is an technique to getting th e broken pipe capped off since we do know we have d irt coming in and some of it could be from that. They can then look at the flow differences between the pump stat ion and flow meter. Butch asked Pat for a quote. Carl aske d to move on with the agenda. Pat stated that for L eominster Rd. we’re on target for early April so he’ll be con tacting Barb to get the letters out. He’ll email th e package out for distribution to have the Commission look at it and comment. The only change from last time is that we’l l add a date to the notices. Dave stated that we’re still l ooking to get a 98% signoff rate. Pat noted that i n the agreement that they’ll do their best to get to 80% but the Commission knows what it takes to get more. Pat asked if we wanted to get a proposal to do the manh ole inspections for this spring? Carl noted that it depends on the budget and if we have the money this year or if we have to wait for next year. We do plan to do I/ I work next year. Pat would recommend to study area directly up stream from the Graham St. meter and when we have t he crew come in to do the manhole inspections to TV all those pipes. Carl asked Pat to include that in the quote as an option. To close out the metering question, would W&S do the monitoring of the flow for us? Pat sai d our subcontractors provide the run times daily and all W&S would need is relatively accurate flow rate for each ===PAGE 2=== CL, DM, MN, TD, BB pump. For the ten week period, we only need to do th e drawdown just once. Carl thought SWSS could calcu late the flow rate. Pat agreed that they could do a draw down, get an average and they could run a volume c ount to get the gpd. Carl confirmed with Mike that we could go to SWSS to do this? Pat offered that someone fr om W&S could come out with SWSS to they could give them ac cess. Pat added that they just need to have 2 peopl e for a few hours– one to take the measurements, and the ot her to time it, turning the pump on. Carl confirmed that we’ll talk to SWSS about doing it and see if they are com fortable doing that If not, we’ll have W&S train SW SS. Pat has some things to look into and will get back to u s. Current Business- Pleasantview Ave sewer extension request – Carl introduced Sue Bunish who joined the meeting. Letters went out to 14 residences to deter mine interest, including 1 to Lorden. Current maps have him with a cul-de-sac and 3 lots but subsequent plan mo dification shows they no longer exist. Another prop erty with frontage on Ramgren but more than 50’ on Pleasantvi ew was also sent letter for interest although he wo uldn’t be counted in the 2/3rds or no. The third questionable parcel is the lot at the end of Pleasantview who m ay not want sewer. Commission discussed stopping extension part way. Barb read from Betterment bylaw: “Prior to t he initiation of a sewer project in any Sewer Service Zone as identified on the Sewer Service Area Map, a nd prior to submitting an appropriation request to the Town, the Sewer Commission shall survey the landowners in sa id Sewer Service Area to determine whether a minimum o f 2/3 of all affected owners support the installati on of sewer service.” Dave said he could go and speak to those who hadn’t responded or responded as a ‘no’. Sue made a point for the home in foreclosure that the b ank may be interested in the improvement. Sue noted that it is listed by Foster Healy who is always there, keeping up with maintenance. Carl thought that was a possi bility and that we should talk with the realtor. Dave will ta lk with Brogna and Sue with the realtor. Sue asked if Jack had any discussion with Leominster about the water situ ation. Carl said Kerry was going to follow up with Jack. Sue noted that she just doesn’t want to get all the way to Town Meeting and be shut down because of the iss ues with the water line. Per Carl, Kerry would like to roll all this together. Jack seemed to believe that we could do the work independent of the water issue and it shouldn’ t have to hold up the sewer. The road is another iss ue. Dave pointed out we need to do one thing at a time and g et the people to approve, then put pressure on Leom inster. Carl said it is just a formality to get Leominster’ s to say no again then Lunenburg can take some acti on. Troy asked if we have a placeholder on the warrant which Barb said we did and that we’ll address the warran t articles at next week’s meeting. Dave asked Barb to email hi m the paperwork on those that haven’t responded yet and thought the bank is the best way to go. Butch said there is a lot of red tape with a bank. Carl summed it up saying that we all had some actions to make this ha ppen. Sue left the meeting, thanking the Commission for all their work. Pratt/Lakeview Betterment Project - Easements – Carl noted we are down to the one coming in and the one with the Town. Dave noted that Brogna wa nts to sell the property. On the Bid process, Carl asked for any last inputs before going out to bid and tha t Kerry said it is our authorization. Dave asked th at the engineer’s questions were answered. Barb noted that the email of potential bid dates from Wright Pierc e has everything on it, the room at Town Hall confirmed, and Jack’s request for a pre-bid meeting has been a dded. Dave recommends that someone from the Commission at tends the pre-bid meeting. Carl asked for a motion to release the bid. Butch made the motion, Troy seconded. Vote taken was unanimous. Barb wanted to go back to the Easements for a moment to verify that n ext week, providing we have Brogna’s paperwork, it will be on the agenda for the Sewer Commission to vote to a ccept the Easements and sign all the documents. Als o we will need to vote to authorize counsel to commence the eminent domain process on the ‘Town property’, called that because is it actually ‘owner unknown’ even af ter counsel’s title search. Dave asked why the Boar d of Selectmen can’t just sign off on it but Barb noted that that is because we don’t own it and Troy added ‘nor do we want to’. Carl said that that is fine, just add to the agenda for the meeting. Sewer Homeowner Insurance Plan - Carl said this item is on the agenda per his reques t. He had seen an editorial in the Sentinel by one of the councilors in Fitchburg reporting on the success of a program. A company sells insurance to homeowners to cover the sewer & water lines from the town to the house. Dave asked doesn’t’ homeowners’ insurance c over that? Per Carl, no – that was his first question al so. Butch stated that his cousin in Leominster did this with some success. Carl said that Leominster doesn’t official ly sponsor it. Editorial claimed that it saves the homeowners’ money. Carl handed out sample pamphlets that were sent to him. For sewer it costs about $80-90 per ye ar. By the town helping with the program, they can get 8% of the income returned to them or pass it on to the homeowners. He would recommend we pass the saving t o the homeowners. Troy would want to see a packet of information and check out other companies to see ho w they compare before recommending one company. Car l said we can also talk to Fitchburg and provided some of the endorsements from Westfield and Leominster. We ===PAGE 3=== CL, DM, MN, TD, BB would not be endorsing, just informing. Also, Carl had put in a call to Dave Rodgers to see if the Wat er department would be interested. It was noted that t he Town Caucus is March 16 at 7pm. Carl asked for discussion and advised that neither Dave nor Butch are planning to run. Dave noted that the Commission has done good work, accomplished good community relatio ns and other people respect this board. They’ve gott en a lot accomplished and that it would be good if the w hole system worked like that. He added that ‘what’s good for the Town’ is what it should all be about and noted t hat it has been a joy working with everyone. Troy wi ll not be in Town for the caucus. Carl asked for everyone to c ome up with ideas for people who may be interested. Minutes – Barb provided the minutes for 2/3 and revised minut es of 1/13 & 2/10. Carl asked for a motion to approve the minutes as corrected of 1/13. Dave made the motion, Troy seconded. Vote taken was unanimous. Carl asked for a motion to approve the minutes of 2/3. Dave made the motion to approve the minutes, Troy seconded. Vote taken was unanimous. For the minutes of 2/10 , Troy noted a change in the SRF section. Dave made the motion to accept the minutes with the amendment. Troy seconded. Vote take was unanimous. Carl reviewed the activity with the Lien subordination request for 68 Elm St. Troy stated that he would never support a subordination of a town lien to any lende r or mortgage company. Carl noted that the request was driven by hardship and the HARP program. Counsel wa s contacted and advised that no subordination shoul d occur. Lender withdrew request. Carl noted that the Fincom meeting is next week. Carl is still working through the betterment piece of the budget and is working w ith Karen B. Brief discussion of the project monies and SCADA. Carl asked if there was anything more and asked for a motion to adjourn. Troy made the motion, Dave seconded. Vote taken was unanimous and the meeting was adjourned at 8 :50pm. Attendees: Chair, Carl Luck, Vice-Chair, Dave MacDonald; Members, Mike Nault, Bu tch Bilotta, Business Manager, Barb Lefebvre. Abse nt: Troy Daniels Carl opened the meeting at 7:01pm, and introduced t he 1 st appointment, Kevin Olson and Matt Corbin of Wright Pierce regarding the Pratt St/Lakeview Ave SRF project. Kevin provided a copy of the bid schedule to review the status of the Construction Bid. Dave confirmed that the bid was advertised in the Ledger and Central Register. Plan s are available at Wright Pierce for pickup and at the DPW for review only. On 4/1, there is a pre-bid meeting 10am at To wn Hall for questions. Matt will be there. On 4/15, bids are op ened at 2pm. Wright Pierce will review the bids, ch eck figures, do reference checks. Carl plans to be there and Jack R odriquenz. Once the lowest responsible bidder is ch osen, they’ll send request to DEP to award the bid which they expect b y 5/22, with the notice to proceed issued by June 5 . This has to happen before 6/30 per SRF rules. Kevin assured the group that these dates are not etched in stone. Da ve agreed that Wright Pierce is best suited to go through the bids to select the lowest responsive bidder, that’s why we hired them. They’ll look at the bids and check that the bids have all t he information. Kevin added that it is not necessar ily their decision but a Mass General law ruling. Whether the Sewer Commiss ion needs to vote on it is up to them but not many communities that they’ve worked with bring it to a vote. It is usual ly just the lowest responsive bid but someone appoi nted by the Sewer Commission or Jack can select the bidder also. Carl stated that we’ll target the end of April for anno uncement. It was determined that Wright Pierce will run the bid open ing meeting. Estimated Betterment– Carl asked for Kevin’s input on sending out estimated betterments to help with inte rim financing. Kevin asked whether it could wait un til after the bid opening because cost is the biggest variable and we ’ll have a better sense after we’ve opened the bids . Carl asked for the process in doing this but Kevin had not had any tow n he’s worked with do one before. Also, this is a v ery short-term project. Kevin will check but meanwhile we can check with ou r counsel whether it is something we can do. Matt h anded out the latest cost estimate with bottom line of $1,888,000 . Dave asked whether Wright Pierce is coordinating the work with the water department and Unitil. Matt answered that Lun enburg Water is not involved but they had been in t ouch with Joe Z of National Grid and will coordinate. Dave stated that there had been conversation and that Unitil should share in pavement costs, start with 50%. Kevin said that they would i nitiate the request. Mike noted one line item for replacement of water main and Matt stated it was there for contingency o nly. Matt also provided one mylar and 2-3 paper co pies of the 12/5/14 plan relating to the easements that counsel will li kely wish to record at the Registry of Deeds. Pleasant View Ave Betterment and SRF modification discussion– Carl summarized the Pleasantview issue for Bob Eber sole who had joined the meeting to provide the information to th e Board of Selectmen next Tuesday, adding that the Commission is moving forward on having Pleasantview on the warran t for Town Meeting. Kevin added that there is a def inite upside to both cost and schedule to add this street to the Pratt/L akeview project as you can usually negotiate a good price with contractor as long as the Town and Kerry is okay with adding i t in. Commission discussed having as addendum or s eparate project and how quickly we would have it designed and what the cost would be. Kevin noted that the design cou ld be done in August and handed to contractor and under that scen ario, contractor could get the work done by 11/15. We’ll need to check with Kerry if it has to be done as a separate proje ct or as a change order. Matt noted that DEP needs to approve anything over $100k as a change order and he will check tomo rrow if DEP would be favorable. Carl will check wit h Kerry on the change order and what the bond interest may be. Ke vin stated that even if the change order is approve d by DEP and Kerry, there is always the option to do it as a sep arate project. Kevin noted that there is also a que stion of the water main replacement. Matt provided a quick number for 600’ of $175 per linear foot, for an 8” water main woul d be about a $105,000 project. Kevin added that the contractors would lay the deep sewer 1 st , lay water next and pave only once. Carl noted that it complicates SRF and Matt added that t hey can do it but water would be considered ineligi ble for the SRF so there was no action taken. Matt also brought up th at Leominster currently provides the water to the s treet and who would own the line if Lunenburg fixed the pipes. Dave add ed who would pay for the repair. Carl stated that K erry was thinking this would be a water betterment. Dave requested that th is Commission not get tied up in this issue and tha t it is really between the Town and Leominster. The Water District does no t extend to that area. Carl noted that Jack wants L eominster to handle it. Kevin asked about getting the water item on the warrant. Carl stated that the deadline for placeho lders is March 23, and there is just not enough time. Matt had done rese arch on the comparison of grinder pumps which was handed out. Carl noted that it is good to have an option but the E-o ne proves to be preferable and it may be best to st andardize with the one pump. Kevin noted that there are 7 – 8 different pu mp vendors and Matt reviewed each one. But when the y looked at design it worked better with E-one, adding that they are i ndustry leaders, service is really important, and t hat they are on-call 24/7. Other vendors require residents to pull out the pum p and ship it to the plant for repair. Butch noted that it makes sense to stay with one pump. Kevin noted the value of having all pumps same. Dave notes his concern for taking out competition in the pricing. Kevin stated that the resident doesn’t have to go with the recommendation, but we could b ring in FRMahoney, pre-negotiate and hold them to a number. We could save $2-300 per pump. Carl brought up the extended warranties. Commission discussed other vendors, and their desig n. Carl asked Wright Pierce to find two pumps that would technically work and then negotiate with E-one. They have a gre at reputation adding that Chelmsford requires their use and Harvard lists them in their connection paperwork. Dave want s to do a comparison (i.e. extended warranty, equip ment breakdown, etc) and let the Commission negotiate the best deal for the Lunenburg residents. ===PAGE 2=== CL,DM,BB,MN Kevin will talk to Flygt and do a budget bid, then compare. Carl wants it before the neighborhood meet ing. DEP Tech Assistance Grant Solicitation – Carl would like a grant to help us do more on th e CWMP or at least start discussion, and there is an opportunity to get additional funding. Matt stated that at a DEP pre-proposal meeting last week, he learned that once they rank the priorities, they will give out t he full $30,000 until it’s gone. The priorities wou ld be in asset improvement (hardware) so the chance of getting the money to up date the CWMP is not likely. The fund, originally at $2.7million was reduced to $400,000. Dave asked what we need to go after. Kevin said they would take another look, get more guidance on the criteria. With the pot reduced, not a lot of c ommunities may go after it. Carl asked what asset m anagement needs do we have that would qualify. Kevin noted water drain age, Matt suggested software for asset management. Kevin added that the grant application is due 4/14 which is not a lo t of time. Matt also pointed out the median income for Lunenburg is around $76,000. With the statewide average at $66-6 8K, by being above the town would have to contribut e 25% to the project. Kevin notes he just wanted to manage the C ommission’s expectations, that the percent chance o f winning is low. Carl asked and Kevin noted the proposed changes to the CWMP: Fitchburg IMA, needs areas, SSA adjustmen ts, re-routing flow. Carl stated that it is important to update th e document, at the same level of detail and asked W right Pierce to provide the cost, understanding that the amount of monies a vailable affects the scope. Matt confirmed that the Commission had budgeted $20,000 in FY16. Kevin stated that to do i t right, it could be a bit more, but no more than $ 40,000. Dave asked for the priority. Kevin noted that the Fitchburg re-rou te would be first. Kevin asked if there’d been an y conversation with Leominster. Carl stated we have the capacity, but a sked if there were any issues on the horizon with L eominster. Kevin stated that there are more with Fitchburg. Carl wil l discuss with Kerry and Jack to see if there are o ther areas of town for the DEP assistance grant and pass it along. Kevin noted the DEP tech assistance work must be completed by 12/31/15. Grant of Easement vote - Carl read the motion for the Easements, “That we approve and acce pt the easements granted by the land owners for sewer purposes over those portions of Lakeview Avenue, Sunset Avenue, a nd Harris Avenue shown on a plan entitled “Lakeview Av enue, Sunset Avenue, Harris Avenue, Lunenburg, MA, Drawing Title: Easements & Rights of Way Survey,” d ated December 5, 2014, prepared by Lighthouse Land Surveying LLC. ” Dave stated ‘so moved’, Butch seconded. Vote taken was unanimous. Commissioners signed off on the 14 Easement documents. Eminent domain request for 40 Lakeview Avenue (112- 40)- Carl then read the motion for the Order of Taking, “That we approve and sign the Order of Taking by Eminent Domain of permanent easement for sewer purposes in a portion of Lakeview Avenue in “Easement Area A” adjoining the lot shown as “W haloma Park” on a plan of land entitled “Lakeview Avenue, Sunset Avenue, Harris Avenue, Lunenburg, MA, Drawin g Title: Easements & Rights of Way Survey,” dated December 5 , 2014, prepared by Lighthouse Land Surveying, LLC; and further to award no damages to the property owner; and further to authorize Town Counsel to record the Order of Taking with the Worcester-North County Registry of Deeds within thirty (30) days of this date.” Dave made the motion to accept , Butch seconded . Carl asked for discussion on the verbiage in the Order of Taking document regarding the statement that no betterment would be assessed on this property. Barb stated that that is because up until now, the property has been “owners unknown”, and that counse l has left it open, in case upon further research i t is determined that Ivers is not the true owner. Barb read from the Ord er “Said land is owned or supposed to be owned and/ or formerly owned by the persons listed below, hereinafter collective ly referred to as the Owner. If in any instance th e name of the Owner is not correctly stated, the name of the supposed Owne r being given as of this Order of Taking, it is und erstood that in such instance the land referred to is owned by an Owner or Owners unknown to us.... Owner: Ivers P. Lawren ce and his heirs and devisees under Worcester Probate No. 178810, Pr operty Address: “Whaloma Park,” Lakeview Avenue, L unenburg, Massachusetts”. Barb noted that the name of Ivers s urfaced after this recent title search, but the lik elihood of reaching him or his estate is slim, since the plan was recorded around 1901 and he is long gone. Barb added that th e Town had been unable to do a taking, or collect taxes. Commission discussed and determined to be better to assess be tterments that we had a chance of collecting. Carl asked for a vote. Vote taken was unanimous. Commission signed the Order of Taking document. Current Business Town Meeting Warrant articles – Commission discussed the 3 placeholders to go on th e warrant, which need to be submitted to Kerry on 3/23. Commission first discus sed the Pleasant View placeholder, #2. Carl was con cerned that it would cover the extension if the SRF funding option did n ot happen. Barb will confirm with Jeff Blake. Commi ssion also discussed the highlighted text: “provided that the Sewer Comm ission may expend such funds only if at least __ of such borrowing is through the State Revolving Fund loan program based upon eligibility in Calendar Year 2016” which Jeff had included, and wanted it removed. Barb will advise counsel that we want to take out that clause, and clarify that the placeholder works whether we use SRF or not. Dave made the motion to take out the highlighted section and clarify with c ounsel. He then revised the motion to state that we submit the placeholder for the Pleasant View extension after it has been u pdated and approved by Carl. Butch seconded. Vote taken wa s unanimous. Article 1 is the standard budget request previously approved by the Commission and for Artic le 3, Carl described the Reserve Capacity Fee Stabi lization Fund and ===PAGE 3=== CL,DM,BB,MN the need for the stabilization fund to be put in pl ace. Carl asked for a motion to put the stabilization fund forward. Mike made the motion for Article 3, Butch seconded. Vote taken was unanimous. SWSS was skipped over since it was getting late, and the y have been invited to come to the last meeting in March. Dave wasn’t sure that was good timing. Barb noted that Weston & Sampson had submitted a qu ote for the T own-wide Manhole Project for $25,000. Commission wanted to pass over it unti l the next meeting. Carl added that we had received a formal quote from Pat for the Manhole Plotting job for $1000 and asked for a vote to authorize app roving that work. Dave made the motion to update the manhole mapping in town for $1 000, Butch seconded. Vote taken was unanimous . Sewer Commission Projects update- Carl asked to move quickly through the rest of the agenda as it was getting late. I/I reduction project – Barb noted that we hadn’t yet received a package from Weston & Sampson to start the I/I job. 37 Graham - Barb stated that we’d received a quote for a liner to seal off 37 Graham St from Weston & Sampson for $4750. Jack had provided an estimate of $3500 to have it d ug up to disconnect. Barb noted that per Jack’s ema il of 3/17 that he was in favor of the using this technology f or both 37 Graham and the issue at Elizabeth to mak e it more cost effective. Discussion followed with Dave expressin g his serious disappointment that the issue at Eliz abeth had not yet been resolved. He wanted it on record that he thoug ht that the Elizabeth St. job was done. Mike agreed , and they want the manhole filled. Discussion continued and both Dave & Mike felt the pipe should be cut, and when new o wners take over, they’ll have to pay to reconnect. Carl added there may be additional costs as well, if we are paying f or the disconnection. Carl made the case for the liner, as that would acc omplish stopping the flow in the main. Dave asked to have Proctor or Powell price a bladder as it may be better to have local guys do the work. Carl suggested getting anot her quote for digging a hole and putting in a bladder. Butch made a motion to dig a hole and cap the pipe for $3500. Mike seconded . Discussion continued with Carl stating that the Com mission should hear from Jack as it is on the opera tions side. Dave wants Elizabeth Street fixed and the pipe cut at 37 Graham. Carl is still not comfortable for the Comm ission to be making an operations decision without Jack being present. But ch noted there was an open motion. Vote taken, 3 for, 1 against. Flow Rate/Metering – Barb noted that Flow Assessment is coming out on Th ursday to replace the corroded unit on Mass Ave. Both Al Packard(SWSS) and Mike hope to be ther e. Discussion followed on the unit that had been r eplaced after the accident had leveled it and they had put it undergr ound to prevent the same happening again. But Flow Assessment had informed Barb that because it is underground and sh allow, the moisture will continue to continue to co rrode and Barb has asked for a quote for the above-ground cabinet. Annual Town report submittal – Barb noted we’d received the request, and hopes to have something by the end of the month . Barb noted that she had completed the Public records request for Aro Estates last week. Town Caucus on March 16 – Carl stated that there were no candidates for nomin ation. There will be a Joint Executive Session with Board of Selectmen on Hollis Hills on March 24 at 6pm at Town Hall. Barb noted that there were no Minutes for review. Business Manager report – Barb reminded the Commission of the FY16 Budget Presentation to FinCom on 3/19 at 7:30pm. Barb provided the most recent Fi nCom handout that Carl had provided. Carl noted that the most interesting section is the char ts where the two funds are shown and noted that the funds’ lowest point is in 2018 . He added that this is extremely conservative, howev er, and doesn’t take into consideration privilege f ees, new connections, or the Lorden 40B units. Dave noted ad ditional accomplishments of the Commission that wer e not shown, including public awareness and the SCADA units. Bar b noted that because of the work of the Commission with pump station monitoring and grease trap reports, that th e town saved 2% on the cost of insurance. She reminded the Commission of the Volunteer Appreciation Social on 3/31at 6pm at the Eagle House. She had sent out 172 Q3 demands today. Carl asked for Commissioners Comme nts. Dave stated that as far as Small Water attendi ng the televised meeting on the 31 st , he wasn’t sure that was the best time to have the m come. Commission discussed possibly moving them to a non-televised meeting and Carl sai d he would consider it. Mike thought the $9000 est imate for the 2 nd SCADA was high since subsequent installations were supposed to be cheaper. Adjournment Carl asked for a motion to adjourn. Mike made the motion, Dave seconded. Vote taken was unanimous an d the meeting was adjourned at 9:55pm.
