John noted he was more concerned about oil down a floor drain than the container of waste oil and agreed that it may not be worth the effort to regulate. Discussion turned to floor drains and whether they are connected to sewer and if so, that should be more the focus. Carl asked whether code wouldn't require that floor drains go into an interceptor, and that we need to learn more. All agreed we have more control on new establishments, but questioned what we could do retro-actively. We need to obtain plans and that may not be easy on older accounts. Troy brought up the issue before the Commission several months ago of a restaurant where there were floor drains and the town paid to camera the lines and determination going forward was based on the past activity, stating he wasn't sure that was the way to go. He didn't see where a previous establishment and what they did mattered and would like to see policy developed going forward. Carl stated that there is no floor drain at 1 Main, and that we did follow policy based on the terms ' if we see grease in the lines'. The new owner did upgrade the grease trap but didn't put in a floor drain. Troy questioned the use of the word may' in policy and said it leaves a lot of room for discretion. Carl noted that that is better as requiring an interceptor may or may not be necessary, and in some cases, may or may not make the business feasible. He'd vote for not requiring an external interceptor for any change of use. Troy noted that it depends on the business and when it is for pizza and French fries, that the location may require the external interceptor. Troy wanted to know the policy on when they may need an interceptor. Carl stated that there isn't a policy that can cover every 'may' and that it is more important for the commission to set up a policy for how to decide - a checklist with projections, significant change, a list of questions to go through... John believed that the state's CMR has the requirements, based on amount of liquid and rate of flow. Carl noted that the 3 bay sink was the only requirement. Troy noted that the main reason for tonight - is that our requirement is too burdensome. First topic to discuss was our requirement for monthly inspection of external grease traps/interceptors and the difficulty of the physical inspection. Troy asked how the records differ between what we've received on internal vs external. Troy asked how the IMA's and even how Leominster and Fitchburg deal with the issue. Carl noted that it falls mostly on the Boards of Health in those cities. Carl did note that he had talked with Jim Gareffi about a situation where the Commission, due to non- compliance, could remove the permit to discharge to sewer and Jim agreed that then the BOH would have to remove their ability to serve. It can be done as a process, but Carl was unsure if it would work. Troy noted that the sections in our regs dealing with Board of Health should be updated. We should leave the language in Section V, but in Sections N or J, we should remove BOH language as it is too arduous. Discussion turned to the requirements and the accounts' willingness to comply. Barb noted how many restaurants took issue with the monthly external requirements and the likelihood of getting compliance. She noted that Carl at the Bootleggers had a lot of good points, but that she has been unable to get him to come to a meeting to present them to the Commission. Sue added that in her opinion, we should leave it to the professionals, leaving the inspections bi-annually and only do monthly inspections that are necessary based on their submitted paperwork. Commission discussed just charging $250 and covering the costs of inspections with the funds. Carl would like this area of responsibility to be self-funded. He added that if we can't get the professionals to do it, we could contract with SWSS to do the check and make this its own enterprise fund, passing the costs on to the customers and not the sewer customers. John suggested having SWSS do the inspections once a quarter. Sue added that once we have the requirements for each tank, we then pass it on to the owner to maintain. John stated that we use SWSS to compile data on the tank and determine the frequency. Troy confirmed that this only applies to the external interceptors. All agreed. Sue suggested that we talk to SWSS -have them identify the external interceptor, get the specifications, and set up a plan going forward. By going to every one of the site, we'll learn what needs to be done. Troy asked about getting rid of reporting for now. Carl agreed, saying that we should get the data in line with the regs and how it is written. We have a regulation that people aren't complying with anyway. Troy agreed saying that it would be tough to enforce non-compliance fees and then change the rules. We should adopt a policy soon, and backoff the external requirements for now. Carl said that it bothers him to look the other way but we can tell the restaurants that we need them to work with our supplier to get a better process in place. Troy asked what to do about seasonal or those accounts who no longer needed equipment but still had on site. The Commission reviewed those customers, past and present, who needed to come off the list: Harley House, Twin City, Centre Pizza, Conrads. Sue noted that we are overdue for an external for Centre Pizza and Conrads was behind as well. ===PAGE 2=== Troy brought up the email he had sent regarding automotive waste oil, and that the DEP and Fire Dept. seem to have it well covered. Plus, the Fire Dept has assured Troy that they will keep us informed of any discoveries or spills that occur that affect the sewer and that if we are suspicious of anything, or Leominster or Fitchburg alert us to excess oil in the wastewater, that we can contact the Fire Department to investigate. Based on what he'd heard with DEP and Fire, he did not feel it was worth changing regs, addressing the issue of waste oil or pursuing compliance. Commission discussed and based on this agreed that we could take Walmart off our list. Barb noted that shell contact SWSS for a contract to cover preliminary inspections of external interceptors to obtain the sizes, capacities and measurements. Also to inventory floor drains in each restaurant. Commission discussed where in the regs we could add the issue of taking an account off of the compliance list, and determined that Section VI was the best section to add details about reviewing accounts to determine if they still qualify for requirements under the Regulations. Troy may try to work on the wording. Discussion turned to the paving responses on the sewer project and whether we actually can remove paving from the contract and if there would be any legal basis for a challenge if we did so. Sue noted we have another week to take in Troy, in absence of the chair, asked for a motion to adjourn. Sue made the motion, John seconded. Meeting was adjourned at 7:38pm. Ine real connection to the sewer shows one stub at the corner but there is uncertainty about the accuracy. The business is not currently hooked up to the sewer and they were informed that there will be a different process and fees. The layout of the new building was reviewed. There was concern raised about pet hair getting in the pipes. Nick explained that a standard drain is used and very little hair gets down the drain but they are willing to put in an aftermarket tilter. It was proposed having a sign by each drain stating that hair cleared needs to be thrown in trash and not down the drain as a simple solution. There were no other concerns, relative to sewer, in the peer review. The Commission went on to discuss the privilege fee and when it should be assessed. Motion: Mike N. Seconded: Troy D. To accept the Change of Use for 339 Electric Ave, which included the Petlift Machine Vote Unanimous The Commission decided to vote at the same time to assess the privilege fee for 339 Electric Avenue for the additional usage. Motion: Mike N. To assess a privilege fee in the sum of $11,551.47 Seconded: Sue B. Vote Unanimous Twin City Baptist Request for waiver - Grease Trap Non-compliance fees Stan Dill and Janna Moritz from Twin City Baptist Church came to request a waiver from Grease Trap requirements. There is currently a 3bay sink that is not used and Stan has stated that there has been a physical disconnect. They do not want to get rid of the bay sink because the status of the kitchen might change one day and they would need it. There was concern that it could be reconnected without the Commission's knowledge. The requirements for an internal trap and an external one was clarified. Janna confirmed that they are aware if they take out the 3bay sink, it takes out their responsibility. The Commission noted that the disconnected 3bay sink cannot be kept onsite and must be moved to storage. Twin City will need to notify the Commission that the 3bay is out and get the plumbing inspector to sign off on the plumbing permit. Once it is submitted, it would be considered disconnected. Janna confirmed that until then they would submit reports monthly and she asked what to do about the fees. The Commission agreed that everything would be put on hold until this is resolved and Twin City becomes compliant. At that time, the Commission will decide what to do with the fees and will notify Twin City in writing. Peter Dulchinos, Meadowwoods Trailer Park- Request for waiver - Reconnection fee Peter Dulchinos came before the Commission to request a waiver for reconnection fees. He stated that there is a high turnover at the park and that in general the trailer is left in place and the connection is there. The Commission clarified that if the trailer is left in place, than there is no reconnection fee. But because Lot 26 had the old trailer removed and a new one brought in there will be a reconnection fee. Peter asked if that reconnection fee could be reduced or waived. He has found people to move in but the grants received were not as good as they would have liked when water and sewer were brought in. Peter stated that the park is owned by the Gonynor Trust but there is a potential buyer. The people own their trailer but rent the lot. There was discussion on who pays the fee. The Commission noted that Lot 26 is like any other property in town that burns down. If the reconnection fee is waived than it sets a precedent that others will seek. It was noted that a compelling reason would be needed for the Commission to grant a waiver. The Commission agreed that they have no interest in revisiting the reconnection fee. CURRENT BUSINESS Pratt/Lakeview Project status- Connections, Paving response - There are seven permits to connect. An email has been sent out to those with a known email address and it has also been posted on the website that connections could commence for the Pratt/Lakeview areas. The permit still needs to be updated with the pump specifications and the Commission would like to make sure the manufacturer and model number are also added to the permit. Paving Response - Out of the eighty residents contacted only eleven have responded and of that eight did not want paving to be their cost. Pleasantview Ave Project schedule - Construction is to commence on November 12th. Wright Pierce - Contracts - 1) Grinder Pump - The Sewer Commission approved the task order for $2000. 2) CWMP update - The proposal was discussed and would cost $19000. It was approved by the Commission and it will be put on the ATM for ===PAGE 2=== e problem nas to de stopped e interest fale tonte tod wil de de cas desse making people aware or tre grant through advertising and announcements. There is no other update. The EOCD will be followed up on. Flow Rate/Metering - The Commission discussed ways to get a handle on number of gallons billed versus gallons of flow. It was agreed that all needed data was present. Business Systems and Process Improvement - It was discussed brining someone else in to do the minutes. It will be advertised to town employees to add hours. Irrigation meter discussion-new technology - Will be discussed at next meeting. Permits to Connect - There are nine permits to connect. A substantial completion submittal has not been received. Barb will check with Matt on this. Highfield Village-allocation agreement questions/clarification There are concerns with the Allocation Agreement and whether it is at the capacity that is needed and also with whether privilege fees were appropriate. Troy D. stated that he could not remember anything that would link the allocation to whether the privilege fee would be assessed. Discussion followed on the history of the Mass Ave sewer installation and how the line was gifted to the Town by investors. It was determined that the Commission will go to counsel to look at the agreement and get a reading on whether or not Highfield will need to pay privilege fees. It was proposed that Carl L. and Troy D. would draft a request for counsel review. Grease Traps - The proposed posting is being tabled for now as it may be edited further once the procedure is changed. It is now proposed that Small Water System Services be authorized to do inspections on the interceptors and provide training to people. It is hoped that by the end of 2 to 3 months there will be a better understanding and more tools to help clean up current requirements and that people will be better trained. The original draft of scope was reviewed. The first step is SWS will meet with the Commission and the second is to make the inspections and provide reports. The cost was discussed and it was decided that Carl L. and Barb L. Will negotiate with Deb from SWSS Motion: Troy D. Second: Sue B To authorize SWSS for scope of work not to exceed 36 hours or 2500 Vote Unanimous As directed by the Sewer Commission Minutes Assistance - Administrative Clerk Barb noted that there were two candidates, both employed in the Lunenburg school system. One appears to be full-time and is paid $21.87/hour, the other part-time and paid $15. Carl asked if we have to pay overtime. Commission discussed whether we are required to pay them at the same rate as their day job. Barb will check with Kerry. Troy said he'd rather see someone in town get the job rather than go outside if they are interested. Barb pointed out the option of contracting with them both - maybe one to do current minutes, and the other to do backlog. Troy would rather we pick one person for consistency and not employ both. Carl asked to take a vote to allocate the funding. Carl noted that if we had to pay the higher paid candidate time and a half, that we would be paying her double the amount of the other candidate. Commission wants to leave it up to Barb to select. Carl added that he is not in favor of paying anyone $30/hour and that we should go outside if that is necessary. Motion: Troy D To authorize Barb to initiate hiring of a person for assistance with minutes Second: Sue B Vote Unanimous and other duties for up to $200 per month as administrative assistant. Sewer Commission Projects Private Extension -Troy suggested that paragraph 3 in Section 10 under privilege fees be omitted and discussed at a later time and to submit the rest. He also stated to make sure that surety bond could cover performance as well. Otherwise, remove surety and have them be post bonds. A clean copy that strikes the paragraph and surety will be presented for approval at a later meeting. SCADA system - Wright Pierce came and looked at Leominster Road and Dana Street and came back with a low estimate. The Commission discussed the quantity, discounts and timing for doing it all. Debbie will look into an update of the quote again. ===PAGE 2=== for 459 Sunnyhill Rd and1205 Mass Ave. Pump stations -The costs for DPW were discussed and whether Small Water System Services could help with jobs such as raking and cleaning outside. Business Manager Report Commitment for Q2 billing - Q2 is currently $189,483.42. CWMP - The proposed updates were discussed. Wright Pierce will strictly focus on changes made to strategy and review the cost estimates. Motion - Troy D To approve the Wright Pierce contract for $19,800 for 198 hours as proposed 12/7/15 to be signed by town Vote Unanimous Manhole Inspections - The manhole agreement with Wright Pierce was discussed. The technical assistant grant from the state, that will help fund this, was also discussed. Motion - Troy D. Second -Sue B. Permit to Connect form update - The form has been updated to reflect the addition of asking which grinder pump is going to be used. Invoices - Six invoices were presented for approval. An invoice from Koppelman and Paige, Fitchburg and Leominster were approved for payment. There was a question on jobs coming in under with the three invoices from Wright Pierce. They will be contacted on where we are on the contract. Website updates - No update. License renewal - The letters sent out had a great response. Only four food service enterprises are still s sent to the Board noncompliant: Dario's, Ixtapa, Donnelly's and Ugly Omelet. A list of the outstanding accounts was sent to the Board of Selectman on November 20t. It is hoped that by the first of January everyone is in complianace.
