He said his goals for the Commission have not changed during his 15 years of service. He has and will advocate for the users and implement the Comprehensive Wastewater Management Plan (CWMP), even if in the minority. Carl added that in regard to the resident seeking betterment relief, he was against approving the request to forgive $4,000 of the betterment, as it would add to the debt to be paid by the remaining users. Also he was concerned this could lead to other requests that could cost users over a hundred thousand dollars. He added that the legal costs that resulted were not due to his seeking legal counsel during open hours which are free to the Commission. He never made a motion to overturn the vote. In regard to the Cross Rd. extension, he said the driving force of the resident was to extend the Sewer Service Area, so the property could be subdivided and developed. Carl said he believed this was in conflict with the WMP and the Commission's policy on development. He spoke at Town meeting to make the public aware of the history, the WMP and Development Policy. He added that he has always sought to be a team member and to fight for what he believes is right, even if he is a single voice. Carl announced that he will not run again and hoped that a sewer user would consider running for this office. He noted that he will send a copy of his comments to Barb for the minutes. Dave said that Carl had 1 more year in his term. Carl thought his term was ending and he will let Barb know what his intentions are. Dave told Carl he wanted an answer as soon as possible as to what his decision is going to be. Business Manager Report - Barb reported that she has received all the 1st Tuesday reports for Grease Traps and she will have a draft for the Annual Report at the next meeting. APPOINTMENTS John Londa, Facilities Director for LMHS -54 Oak Ave. Appeal of Commission decision re: Reconsideration request - John Londa said he contacted Barb to dispute the invoice he received. He noted that the school's irrigation usage is 9 times the water usage for the rest of building. He stated one problem was the irrigation meter reading is not done at the same time as the water reading. The irrigation meter shows more usage than the water reading. John would like the water district to read both meters on the same day or to read the irrigation meter a day before. Secondly, the invoice he received for the period ending 9/30/20, was based on 12,436 cu.ft. of water usage, but there were only custodial staff in the building for that period. John L. said they would pay the existing invoice for $1,573.16 and recommends that the usage from 4/1 - 12/31 be reviewed to ensure the numbers are good. They have a responsibility to make sure the numbers are right. Barb replied that she understands John's concern and will again ask the water district to read both meters for the schools at the same time. She added that we did not have a good starting point as we did not know when the irrigation meter went in, so we billed the schools the minimum charge for the 4/1 to 6/30. We made the adjustment and are getting good readings now. Since it is a meter, usage will be corrected as they go through the year. Rob O. agreed with Barb and noted the next reading should reflect normal use. John R. and Carl agreed it will be good if both meters were read at same time. Carl suggested checking the numbers again in 3 months to see if there is a significant discrepancy either way. Brett and Dave agreed to look at it after another cycle. John L. agreed they will pay the existing invoice and come back after the next cycle. CURRENT BUSINESS - 384 Mass Ave connection discussion - John Esposito - Rob reported he talked to John about the work done and has reviewed John's pictures, which show everything was done correctly. They also discussed the need for a surveyor and John said he works with an engineer who could produce a plan. Rob added he is more confident after ===PAGE 2=== confirmed for Carl that the line enters the laterals correctly. Rob also noted that property owners are responsible if something happens up to where they connect to the main, even in the right of way. Barb asked John E. if the little house at 386 Mass Ave was involved and he replied the only one involved was the big house to the right 384). John noted the Water District will be meeting the next day. concerning the addition of the Aro Farms development to the water district and all are welcome to attend and see the new building. FY22 Budget discussion - Barb will send the preliminary figures to Heather at the end of the meeting. The Commission discussed the figures in the draft budget provided by Barb. She added they are anticipating about 10 new connections. Barb has suggested an assistant position in the sewer office for backup and cross training to take over when she retires. She added that this request would need to go through the personnel committee and Town Meeting. Regarding Purchase of Service, Barb noted that Al (Empey) is doing a great job but they need to leave some leeway for future costs. Legal costs are noted as $10,000 which is the figure from the past 2 years. Barb reported the charge for Leominster went up for the last quarter, so she increased the amount for Leominster to $400K. The final figures for Indirect Costs will be determined by the Town Accountant. The 3% Capital Reserve transfer of $30,929.43 and the $ 656 OPEB Trust were noted. Dave suggested planning a workshop to just work on the budget. Carl suggested discussing the John Fitch Highway Transfer, the Capital plan/strategy and the Infrastructure plan. Barb clarified the last 2 Leominster billings were based on the flows and were built into this budget. John R. agreed with having a special budget meeting. Brett asked if Carl could make a list of his comments to discuss. Dave added they need to set money aside for the Maintenance Plan, along with Covid related uses to add in. He agrees they need a part time assistant for Barb and would want to have money to add to Retained Earnings. Barb noted that with this draft, they have $ 7,800 for retained earnings and seem to be doing well for FY21. Carl said he will go through the budget and send a list to Barb. All agreed to plan on a workshop on 2/2 and finalize the budget at 2/9 meeting. Fitchburg Sewer Use Ordinance updates - Barb received a notice from Fitchburg that they have updated their Ordinance and Lunenburg is required to look at theirs, per the IMA, to make sure they are equal or more stringent as Fitchburg's. She added that there are a lot of updates to review and they are asking for a response in 30 days but was assured by counsel that they could ask for an extension. Barb asked for a commissioner to look at the regulations. John and Brett said they would volunteer if they can get an extension until late February. Barb will ask Adam Costa (counsel) to send a request to Fitchburg for an extension. Access to Town Counsel Policy - Dave said he would like a motion to change the policy wording from notification to permission. Motion: John R. Second: Brett R. To change the wording in the Access to Town Counsel Policy from notification to permission. Discussion- John said he would like to wait until there is a full commission for the vote and Brett agreed. Carl proposed an amendment to the motion to change the wording from permission to advance notification. John withdrew his motion in order discuss at next meeting with a full commission. The Commission discussed whether they would waive the fee in FY22, and that the Commission does not incur any fees currently for inspections. Rob noted that a lot of towns do not charge a fee and would be in favor of waiving the fee again to help the local businesses. Motion: John R. Second: Brett R. To suspend the Annual Grease Trap Renewal Fee for FY22. Roll Call Vote: Mike-aye, Carl-aye, John-aye, Brett-aye and Dave-aye. Barb continued, explaining the remaining revenue figures. The Commission discussed the Reserve Capacity, Flow Capacity transfers and Capital Reserve Funds. Rob suggested increasing the Capital Fund from $20K to $50K since replacing a pump costs $17-18K. Barb noted that payroll figures are provided by the Town Accountant. The Commission discussed Barb's proposal to hire a part-time Assistant for the Sewer office. Motion: Brett R. Second: Mike D. To approve a part-time assistant for 19 hours/week, without benefits. Discussion: Carl noted he is not against a part-time person but does not support hiring an assistant as a back-fill person, who would later move into Barb's high skilled business manager position. Roll Call Vote: Mike-aye, John-aye, Brett-aye, Dave-aye and Carl- no. Barb read a list of the expenses for Infrastructure under Purchase of Services. Rob suggested increasing Capital for major repairs and replacement to $50K. He would like to come up with a plan for repair work. The Commission discussed Rob's suggestion and Dave suggested taking $100K from Retained Earnings to fund Capital Expenditures. Rob also suggested doing another pump station evaluation, since the last one was completed 10 years ago. Dave said he still wants to talk to the Leominster mayor and also look into alternatives to solve the Inflow/Infiltration(/l), such as grants. Mike said he agrees with putting money into the budget for items such as new pumps. John agreed with starting with $100k. Carl noted the Wright Pierce report had a lot of information on the pump stations. Capital expenses were clarified as being fixed items costing over $5K. The Commission discussed Capital expenditures and expenses for the Maintenance Plan. Motion: John R. Second: Mike D. To pull $100K from Retained Earnings to put into the Capital Expenditures. Discussion: Barb wanted clarification that Capital Expenses would increase from $20k to $120K and the Commission agreed Roll Call Vote: Mike-aye, John-aye, Carl-aye, Brett-aye and Dave-aye. The Commission discussed Engineering Services and agreed to $10K for the Flow Metering contract and increase Consultant expense to $10K. Regarding Utilities, Barb reported they are starting to get credits from the Nexamp solar program, but they will not know the total until they go through a full year. Barb said the Miscellaneous Expenses include the Capital costs to Fitchburg for John Fitch Highway project and the debt service to Leominster, which began in FY21. She noted that this was part of the reason for the FY21 rate increase. The Commission discussed the figures for the Fitchburg and Leominster Usage, along with Connection Fees. Barb added that the Indirect Costs amount comes from Karen (Town Accountant). Dave suggested discussing adding an automatic 2% increase every 2 years. Rob commented that it is a great idea but prefers a larger increase every 4 or 5 years. However, he added ===PAGE 2=== Motion: John R. To adjourn at 6:38pm. Respectively submitted, You k. Barb reviewed the changes in the FY22 Budget made since the last meeting and noted that Karen (Town Accountant) suggested changing Miscellaneous Expenses (under Expenditures) as Other Departmental Expenses and created a new account for the Capital Expenditure transfer under that category. The Grease Trap permit fee revenue was reduced to $0 since the Commission agreed for FY22 that it be waived. Engineering was raised to $20K and Leominster Usage was bumped up to $500K. Dave Passios suggested, when making the presentation, they give a breakdown and quick explanation of the Other Departmental Expenses. Barb said that she will provide the usual budget copy with descriptions for FinCom's review. Dave M. reminded all that at the last meeting they advised the DPW Director that they will commit monies to fund the Maintenance Plan and will take $100K out of Retained Earnings. Therefore the amount for the transfer from Retained Earnings went from $120K to $300K. Rob added that some added costs depend on the precipitation that comes in Spring and Summer. He may not need all of that transfer, but he wants to plan ahead. Dave noted that they need to work with Leominster to find out what the Commission will be paying so that they can budget accurately. He also would like to work on fixing the Whalom area's I/l (Inflow/Infiltration) with a grant or cooperation with Leominster. John said one of the reasons for the $100K in Capital Expenditures is to work on getting the Leominster costs down. Dave M. reminded all that the presentation to the Finance Committee will be March 11t. and the Commission will vote on the budget later in the meeting. Fitchburg Sewer Use Ordinance Updates- Barb reported that John and Brett reviewed the Ordinance changes and due to the number of regulations to review, John had asked if they could get an extension. Barb talked with Town Counsel who thought it was a reasonable request and agreed to compose a letter to ask for the extension. Barb noted that John and Brett's draft of changes will need to go to Fitchburg for approval and then it will come back to Lunenburg for the public hearings required for updates to the Regulations before the changes become official. In regards to getting the extension, Barb said that the Fitchburg Commission needs to approve our request. Dave asked Barb to keep the Commissioners updated Maintenance Plan discussion- Dave recommended going through the Maintenance Plan at the next meeting in order to give Rob some direction and suggestions. He added that the Commission will rely on Rob's expertise. Rob said he has gone through the Maintenance Plan, and in reviewing the I/l plan put together by Woodard & Curran, his immediate plan would be to address some specific l/l items that would be most cost effective and have a quick return. They should have a plan going forward for big-ticket items. Dave added that they will use Capital Plan transfer to fund Rob's maintenance projects. Rob noted that one pump at Meadowwoods is near its end of life and that a replacement pump has been ordered. Dave suggested that the Commissioners go with Rob to see the pump stations. Mike suggested taking the Maintenance Plan in chunks, such as looking at I/l or pumps and asked Rob for suggestions on where to start. Rob replied to focus on sections 2,3, and 4. Dave recommended that we have a mini workshop on the Maintenance Plan at the 2/23 meeting Annual Report submission for FY20- Barb explained that this report goes into the town annual report which is distributed to residents at the Town Meeting and that this Report covers FY20, which ended June 2020. Barb thanked Jane for writing the report and thought it was well written. ===PAGE 2=== Motion: John R Second: Brett R. To accept the minutes of 1/26/21 with the corrections suggested. Barb confirmed that the Commission is not on DocuSign, that she notes when invoices are approved by the Commission and that we may need to go back and sign documents after in-person meetings start. Grease Trap 1st Tuesday reports-all January logs are in except 3 and 2 will be bringing reports in on 2/10. Dave asked if establishments were notified that the renewal fee will be waived again. Barb replied that she will put it on the website and will also note it when she sends out the request for permit renewals for FY22. Member Agenda Inputs for Future Meetings - Dave asked if there was an update on 384 Mass Ave. and Rob replied the work will probably be put off until spring due to the snow. Public Comment- Regarding the access to town counsel, Dave Passios commented that it is a very important tool for those sitting on multiple commissions and boards. He said that a lot of questions come up as boards are trying to make decisions. He strongly agrees that the privilege should not be abused, so he is following what the Commission is discussing. There is nothing that he strongly disagrees with, but he wants to make sure the Sewer Commission's policy does not "drag other Boards and Commissions down a rabbit hole that they do not want to go down". John noted that Carl's graph for retained earnings is a useful tool and should be updated annually to be used in our budget discussions. Motion: John R. Second: Brett R. Carl said he hope everything works out well for John. Carl also noted that he sent his resignation letter to the Select Board Chair, with his resignation from the Sewer Commission effective April 30th. He wanted to make sure that there will be an opening on the town ballot and he sincerely hopes someone on sewer will step forward to run. In his 15 years on the Commission, there have been only 3 members that were sewer users. Brett also wished John all the best and said he is available for help. Dave thanked Mr. Luck for his 15 years of dedication to the Commission. He wished Carl all the best and hopes he enjoys his retirement time. Barb thanked Carl for all his years of dedication to the Commission. John added that Carl may need to be available for future consultations. Barb noted that the town election is in May and Dave added that there is a live town caucus on March 15th. CURRENT BUSINESS - 711 Mass Ave- ZBA project proposal -Barb reported that this is a proposal for a new development of 8 townhouses. She has not been contacted by the engineers or others but there is a public hearing on 2/24. Barb added that the parcel has been assessed betterments and they have been advised that additional privilege fees will be due. They also know that they will need to come before the Commission. Access to Town Counsel Policy - Dave asked for a motion to change the wording in the policy from notification to permission. Motion: Brett R. Second: Mike D. To change the wording in the Sewer Commission's "Access to Town Counsel" Policy from notification to permission. Discussion: Carl said he is not sure that the new commissioners understand why this is in place and that other commissions use it quite effectively. Carl played an excerpt from the presentation of Mead Talerman to the Selectmen on 4/18/2017 regarding open legal office hours. The recording noted the open hours are successful in other towns because it gives municipal staff an opportunity to ask questions and get ahead of problems. Carl added that this was a preventative model to reduce litigations in the future. It helps protect the town because litigation is not included in the town fee. For sewer, litigation would affect the Enterprise Fund. Carl suggested the Commissioners think about it a little more and attend open hours. He added that to get permission, it will have to be added to the agenda then schedule open hours. He also asked what the problem is that would be solved by this and what would be a reasonable reason for not giving permission to someone to not go to open hours? Dave said no one is taking any rights away from anybody or being restricted. It is to keep the policy from being abused by a member going to talk to the attorney behind their backs. A member can just say in a meeting that they want to talk to the attorney. Mike agreed that if we have a question, they can bring it up at a meeting. Brett agreed, but asked why it has to be on the agenda. Dave said they could add it to the members' agenda inputs. John said no one has a problem with a Commissioner going to Town Counsel, but it would be good to know if anyone has an issue. Carl said Dave never gave an example of how he went behind the board to Town Counsel. Roll call vote: Mike-aye, Brett-aye, John-aye, Dave-aye and Carl-nay. Fitchburg Sewer Use Ordinance updates status- Barb reported she got a response back from Fitchburg and they approved an extension to May 28', which will give the Commission time to review the changes, go back to Fitchburg for their approval, then back to us to go to Legal. Then we will need public hearings to accept the changes to the Regulations. Dave will work with Brett and Barb on the updates. Maintenance Plan- review and discussion - Rob reviewed the plan's latest version and has a list of general comments but needs to compile everyone's comments to send to all. Dave said he would like to look at section 2, 3& ===PAGE 2=== Motion: John R. To accept the minutes for 2/4/21 Meeting. Second: Brett R. Roll call vote: Carl-aye, Brett-aye, John-aye and Dave-aye. Business Manager Report - Barb reported that the FY22 Budget draft has gone to the Town Manager and the next step is the FinCom presentation on March 11th. 384 connection issues- John Esposito is still working on trying to get the survey done. Invoices- Fitchburg Usage- $ 19,401.38 which is based on Flow metering information that we sent to them. Barb added that it is high but usually is at this time of year. Grease Trap reports- all January logs are in and the February logs are due 3/2. The Annual report has been submitted and will be included in booklet given out at Town Meeting. Member Agenda Inputs for Future Meetings- Dave suggested changing the wording for this item and Barb suggested "Members Requests for Future Meetings/Counsel Hours". Dave requested Barb ask the Town Manager to send out the schedule of events coming up regarding the caucus and town election, etc. and if she receives it to share with the Commission. Public Comment- Dave Passios (56 Whiting St.) said he was disappointed with the vote on access to Town Counsel. He cherishes his access to Town Counsel and agrees that they need to deal with abuse, but it is unfortunate that vote was taken. Dave M. again thanked John for what he has done and offered any help if needed. He also thanked Carl for his service. PUBLIC COMMENT- none CURRENT BUSINESS - FY22 Budget - Retained Earnings projection- Dave thanked Barb and Rob for all their work on the FY22 Budget. Barb noted that she sent out the projected Retained Earnings report for the Betterment Income vs Debt Service. Barb screen-shared the Retained Earnings report, which included a projected Retained Earnings graph. Carl asked to clarify the figures, in light of taking $300K out in 2022. The Commission discussed the Retained Earnings projection. Barb estimated that Retained Earnings would be around $1.4million after this transfer, but they still do not know how FY21 will end—it is all estimated at this point. The Commission agreed that it is important to have a clear picture of the financials. Barb will update the spreadsheet with the known transfers and send out an updated Retained Earnings projection, along with the planned FinCom presentation. The Commission discussed Barb's summary of the FY22 Enterprise Fund Budget. Rob added that the presentation to FinCom provides more detail for the category Other Department Expenses'. Dave suggested adding the maintenance plan to the presentation. He added that we are increasing money for the Leominster usage, but may not use all of it. Dave summarized the presentation to the FinCom. Carl noted that we have line items for the day to day but the proposed capital costs are not earmarked yet. Dave said he still wants to sit down with Leominster to discuss I&l. The FinCom presentation will be 7:30pm on 3/11 on Zoom. Town Meeting draft articles-Barb noted that the 3 articles need to be approved and are the standard budget articles with transfers to the Capital Reserve and OPEB. She clarified that the actual numbers will be part of the motion made at the Town Meeting. Barb screen-shared the list of articles. Motion: Mike D. Second: Brett R. To accept the 3 Draft Town Meeting Articles for the Sewer. Roll Call Vote: Mike-aye, Carl-aye, Brett-aye and Dave-aye. Fitchburg Sewer Use Ordinance-Barb reported that John dropped off a folder with his work on the ordinance update. Dave and Brett will finish working on it after the Budget presentation is completed. Minutes of 2/23 meeting- Motion: Brett R. Second: Carl L. To accept the minutes of the 2/23/21 meeting. Discussion: Carl asked why the handout was noted as a recording rather than a hardcopy. After discussion, he said he accepted the wording. Roll Call Vote: Mike-aye, Carl-aye, Brett-aye and Dave-aye. Carl Luck's resignation letter dated 2/23/21, effective 4/30/21 - Dave thanked Carl for his many years of work and hopes that he enjoys his retirement. He also hopes people come out to attend the Town Caucus. Carl encouraged someone on sewer to run for the open position. Business Manager Report - 88 Mass Ave meeting- Barb reported there will be a hearing on 3/10 at 7pm for a Marijuana establishment at that location. Barb has updated the Website with current news, updated applications, ===PAGE 2=== agenda, which is a known Inflow problem from a residence, potentially costing $3-5K per year. Rob noted a letter went out to the property owner and can follow up. He also talked to Patrick Cotton at Weston Sampson. Carl added the Commission needs to decide what action they will take. Carl asked about a line that was jetted and found issues which was mentioned at Jack Rodriquenz's last meeting. Barb replied that they are waiting for the weather to improve so they can have camera and jetting companies come out to the Mass. Ave. site. Dave asked Carl to bring up any items that haven't been addressed. Carl asked about the pump station algorithm, that he would like to get the numbers from the last billing to see results from the last analysis. Barb noted the counsel hours will be on the 23ra. Public Comment - Brett said he would like to learn more from Carl before he leaves, and he thanked him for his many years on the board. Dave noted that today marks 1 year from the start of Covid 19 crisis. He said it was a tough, nerve wracking year with lots of changes. He is very proud of all the Commissioners, DPW staff, Barb and Jane. He cannot wait until they can meet in person. PUBLIC COMMENT- none APPOINTMENTS - Rick Blanchflower, 5 Chestnut St. to expand the sewer service Area - Jamie Rheault (Whitman & Bingham) - Jamie did a screen-share of the plans for the property and showed the area that they would like to have redistricted into the Sewer Service Area (SSA), to enable development in the future. They did a survey to flag the wetlands and dug 9 test pits. In each test pit, they hit ledge between 3-4 feet, so all the soil on the property is not suitable for septic systems. Jamie asked the Commission to confirm the area in the SSA. Rick Blanchflower has filled out a citizen's petition to get on the warrant for the Town Meeting and they are looking for support from the Commission to include the property in the SSA. Dave asked what the frontage is for the property and Jamie replied 152 feet. Rob said the land is developable but if it is ledge, they cannot build septic systems. Rob asked how many units they want to build, and Jamie replied one option is 10 lots with 4 condo units/lot, but they have other options too. John asked if the property was land-locked at one time. Jamie said the property was owned by the Paton family and always had the 152' frontage. Brett said he would like to see it included in SSA and asked if they have paid betterments over the past years. Barb replied they were assessed 1 betterment and if expanded, they would be assessed additional ones. Carl noted in 2005, the Board of Selectmen were planning to sewer the whole town, but residents objected, feeling it would have a negative effect. The Commission had a Comprehensive Wastewater Master Plan done to establish the areas that needed sewer and determined that the front part of the property was developable, but had not wanted to enable the larger section in the back to be developed. The Commission discussed the history of the boundary line for the SSA in that area. Carl added he is strongly against adding it to the SSA as it would take a piece of property that is otherwise not developable and put 40 units on it. Jamie said they could test the section of the property near the road for a septic system, but no soil exists on the other side of the line to support septic systems. Brett asked to clarify that the Sewer Commission does not control population growth or construction, but whether a property can be added to the sewer system. Jamie said they would still need to ask for an extension for a single house as it would need to be placed turther back to where the property is 175 teet wide to meet zoning requirements. Carl said he might support moving the SSA line back for 1 house, but a 40-unit condo complex would increase everyone's taxes. The Commission continued to discuss options for the property. Rob said if they allowed the extension, he would need to make sure they have capacity and Barb noted that it would flow to Leominster. Jamie clarified it would not be a 40B. John said he was concerned about capacity down the road and the town should be able to vote on it. The Commission reviewed the similar situation with the old Whalom Drive-In property that Unitil developed on Electric Ave. Carl read a section from the Sewer Commission's Regulations on development. Barb added that the property would need the Sewer Commission's vote to allow expansion of use in the SSA. Jamie said he will discuss the issue with Rob (DPW Director). The Commission did not take a vote, and the discussion will be added to the agenda for 4/13. CURRENT BUSINESS - 183 Whalom Rd request for credit - Barb received a request from the residents to get some forgiveness on the large bill, which was due to a toilet leak, and added they are senior citizens. She said that they have paid the bill, but added that we don't usually make adjustments for a toilet leak since the flow has gone into the system and we pay for that flow. The Commission discussed the request, agreeing that it is a tough situation but now they are paying for all ===PAGE 2=== 19 Whalom Rd request for credit- Barb reported that this is a well customer and the standard charge for well customers is $ 231.87/quarter. The standard charge was set many years ago and that there are no adjustments usually done. The customer is a 90-year-old woman who lives alone and is asking for an adjustment to the minimum charge. Barb added that there are 8 well customers in Lunenburg and noted that in Fitchburg, they give well customers an option to install a meter. The Commission discussed the request agreeing that it is another tough situation. Brett asked the cost for installing a meter and Barb estimated that it is at least $1000. Carl suggested revisiting the policy and the minimum rate. Dave suggested, looking at the flat rate, that it could be based on number of people or a payment plan. Barb noted that the resident is asking to pay the $107 minimum going forward. The Commission agreed to discuss a new policy and add it to the next agenda. Rob agreed it is a good idea to redo the policy, possibly based on size of the family. Barb will update the customer and add the policy to the next agenda. (John left the meeting.) Fitchburg Sewer Use Ordinance changes- Brett and Dave will be meeting with Barb to discuss the changes. Commitment approvals- Barb reported a correction for the amount of the Q1 FY21 Quarterly Billing commitment. The amount submitted was $212,461.81 but the corrected figure is $222,461.81. Motion: Brett R. Second: Carl L. To approve the corrected numbers for the Q1 FY21 Billing Commitment. Roll Call Vote: Brett-aye, Carl-aye and Dave-aye. Business Manager Report -Barb reported that the FY22 FinCom Budget presentation on 3/11 went smoothly and there were no issues. Dave thanked Barb and Rob for their support, along with FinCom. He wished Terry, who will leaving FinCom, well. Maintenance Plan- Barb and Rob met with Carl to discuss changes and Barb will be sending out an updated version for review. Carl added he appreciated Rob and Barb's time to discuss it. Rob added that it went well, that they based some decisions on compromise from both sides and that the end product will be good. Invoices- Fitchburg-$17,708.48 was reviewed. Elizabeth St.- Rob reported that he talked to Pat Cotton at Weston & Sampson regarding the l/l study they did and their recommendations. He will be reaching out to contractors that Pat recommended, to get some quotes for following the recommendations, such as to clean, camera, and seal leaking joints. Carl added that are 2 issues- the remediation of the pipe going down the street and the specific lateral that has 1,440 gallons per day (gpd) coming from a residence. Rob said the report noted 3 or 4 pipes were leaking at the service connection, which are different from the one that Carl referred to. Carl clarified that it is a homeowner issue because it is beyond the lateral. The I/l inflow is 1,400gpd, costing $3-5K per year. The homeowner needs to fix it or disconnect the lateral and there may be clay pipes in that area. Legal had identified a 5-step process and the Sewer • ===PAGE 3=== Public Comment - Carl asked Barb to send the flows for the algorithm. Paula said she has questions about total capacity under agreement with Leominster, total utilized and reserved capacity, existing peak flow analysis, allowance for groundwater I/l and the total percentage of the Leominster wastewater treatment plant. The 40-unit project is only 1 of the proposals, and they are looking for approval without a specific proposal plan. She would strongly be against this proposal at Town Meeting and strongly discourage the Sewer Commission from supporting the project without a clear, well thought-out plan for the parcel. A single-family home would be ok but there is not enough frontage for more. She urged the Commission to look at the regulations and not entertain the proposal at this time. CURRENT BUSINESS - 5 Chestnut Street- request to expand Sewer Service Area (SSA)- Jamie Rheault reported that he met with Rob Oliva who said there is plenty of capacity, but was concerned about I/l (Inflow and Infiltration) at the pump station. He noted that the frontage on Chestnut St. is 150 feet and they are proposing a road with 11 lots to be developed under the mixed residential development rules. The flow calculations are based on 22 2-bedroom units and 22 3-bedroom units for a total of 12,100 gals/day(gpd) at 110gpd per bedroom. They expect to remove 4 gallons of I/l for every gallon that flows. There are 23 acres in the parcel, and what they are proposing is less than 2 units/acre. Jamie had submitted the test pit data and out of the 9 test pits done, none met Title 5. They are asking for the Commission's support for their warrant article at Town Meeting to expand the SSA. Barb read Rob Oliva's comments, stating that all test pits are unsuitable for the SDS design. He added that there was one additional area not tested but did not believe the results would be any different. John asked for the clarification on flow amounts and Jamie replied it would be 12,100gpd. If they add 12,100gpd, they could remove up to 12,000gpd, which increases the capacity. Regarding capacity, Barb stated that the Leominster IMA allows for 500,000gpd and in the last year, Lunenburg averaged 158,000gpd, which is why Rob said there is plenty of capacity. Barb added that the flow is determined by the flow meters, not billing data. Carl asked Jamie how they would remove I/l. Jamie replied the Sewer Commission would hire a contractor to calculate the manholes leaking, and applicants would pick the manholes they would fix. Carl noted that there is a big difference between this project and the expansion of the SSA for Unitil on Electric Ave, which was a single commercial development. The Town did not want to enable land that could not be developed without sewer but would bring sewer to encourage commercial development. Jamie clarified that the plan did call for 40 units, so it would be 202-bedroom units and 20 3-bedroom units, with an 11,000gpd flow. Carl noted that Jamie had mentioned that this is 1 of several options and clearly the plan is not final. Jamie said the project still needs to go to the ZBA, Planning Board and Conservation boards. Barb stated there are 287.5 units that can still connect, and they are holding about 95,000gpd in Reserve Capacity. Jamie added that once they get the support of the Sewer Commission for the expansion, they are able to go to Town Meeting for the vote to extend the Sewer district to include the property. Next, they would go to the ZBA for the special permit, then the Planning Board for site approvals and back to Sewer Commission for plan approval. Dave noted the Commission's prime directive is that they are not able to control development. Jamie added that they also have a project at 711 Mass Ave for 8 units and Barb noted that the Planning Board hearing on that project will be May 10m. Paula Bertram said she understands the Commission cannot control development, but their bylaws clearly state the 150 frontage would support 3 units - not 40. Paula added that the Planning Board does not control growth, and that sewer controls growth. Dave ===PAGE 2=== do not have the soil to do it and also anything over 10,000 gals/day would require a treatment plant. Carl asked if there was any area that would be compatible using alternate/innovative options and Jamie replied that there was not because they still need the 48" of soil. Carl agreed the town should decide at Town Meeting concerning the SSA extension. He does not support recommending approval because it is against the regulations and it is up to the community. He suggested that we continue to gather more information and defer any recommendation. Barb read from the regulations under Allocation of capacity for change or expansion of use: " the Sewer Commission may allow for increased allocation for the change of use, or expansion of use which results in an increased sewage design flow, in existing facilities within the Sewer Service Area subject to available capacity and subject to the assessment of privilege fees by the Sewer Commission." That's why any proposal comes before the Commission again for approval of increased usage. Carl stated that this is not a change of use, but a new development,. John said he is concerned about daily capacity and would like to hear legal's opinion. Dave suggested waiting until the 4/27 meeting to get legal's opinion and also make sure we have the reserved capacity. The Commission discussed that the town will make a decision at Town Meeting. Dave noted that the Commission can neither control or enable development based on policy and that he recommends approval at this meeting, based on our policy. Carl disagreed, stating that what is before the Commission is the decision whether to recommend that the Town approve it, or recommend disapproval or defer the recommendation until Town Meeting. Dave asked for a motion either to accept it or hold it until the meeting on the 27th meeting. Motion: Carl L. Not seconded To defer recommendation on the article until Town Meeting. Motion: John R. Second: Carl L. To defer decision to 4/27, until town counsel has had an opportunity to be consulted. Discussion: Barb noted that she will out until 4/26 and asked to amend the motion to meet on 4/29. John and Carl accepted the amendment to the last motion. Amended motion: To defer decision to 4/29, until Town Counsel has had an opportunity to be consulted. Roll Call Vote: Mike-aye, John-aye, Brett-aye, Carl-aye and Dave-no. Dave stated that the meeting will be 4/29 and suggested all Commissioners review the sewer policy so they can have an answer on 4/29. Paula Bertram said she disagrees that the Sewer Commission does not have the ability to enable development, which is what this proposal does. She would like to know from town counsel, if in accordance with current policy, would they be entitled to 11,000 gals/day or would they be entitled to 3 units @330 gals/day. (John R. lett the meeting.) Well Policy Review- Barb read comments from Rob Oliva regarding revising the well policy. "If we are to make the cost of sewer fair and equitable among users that are on wells we would have to have water meters on their well supply line. Not sure how you go about doing this. You would also have to consider if a property then also has an irrigation system because they would likely need a second meter. Perhaps it's worth some research into what other communities do in this circumstance or try to come up with a policy that would have homeowners billed on a tiered system based on their individual situation." Dave suggested putting this on the back burner until Rob can attend. Brett suggested putting a Ton the pipe coming from the well, going to the irrigation and put the meter on the pipe going to the rest of the house. Carl suggested having a policy with the option that users can put a meter in if they are not happy with flat rate. ===PAGE 3=== To approve the new Control Panel, contingent on Mike and Rob's approval based on what they see, to get this moved forward and more dependable. Discussion: Carl noted that there is obsolete equipment and asked for Mike's input. Mike said the relays are simple but would like to see if can upgrade to a PLC. He also would like to see what relays and enclosures they will use. Roll Call Vote: Mike-aye, Brett-aye, Carl-aye and Dave-aye. Elizabeth St. I/l issue remediation- Barb noted that Carl had sent out a copy of a 2018 letter from Town Counsel to the Commissioners which detailed the regulations for handling violations and that, based on her communications last year with Counsel, Adam had recommended the next step of sending a "nasty gram" letter to the new owners. Carl suggested the letter include the regulations that notes the homeowner's responsibility when a fault is tound, along with the Commission's options. Barb will bring it up to counsel for his current recommendation. Maintenance Plan- no update. Federal Aid programs- capital expenditures - Barb talked to Rob, who said there is not alot on the Federal Infrastructure stimulus. Rob likes the idea of discussing funding sources with Leominster for going after I/l and would need to reach out to the new person in Leominster. Fitchburg Chapter 147 Sewer Use Ordinance-Barb said that the Commission should have received a tracked and a clean copy of the proposed changes to the Regulations. Brett and Dave and Barb had met on April 1 to go over the updates from Fitchburg and incorporate them into the Regulations. Barb reviewed the changes made and recommends going to Town Counsel first before sending to Fitchburg. Carl asked for clarification of removing the Building Inspector sign-off on our connection permit, questioning who determines if a lot is buildable. Barb clarified that they continue to work collaboratively with the Building Inspector, but it is through the online permitting, not hard copy sign-offs. The Commission discussed the changing the wording. Barb said that the changes will go to Town Counsel next, and she will send out a copy after legal reviews it. Billing Algorithm- Barb reported that she has the numbers but has not had time to put them into the program. Minutes- 3/30 Meeting Motion: Carl L. Second: Brett R. To approve the minutes from the 3/30/21 meeting. Roll Call Vote: Mike-aye, Brett-aye, Carl-aye and Dave-aye. Business Manager Report - FY21 YTD Budget- Barb had sent out the year-to-date budget which looks good. The expenses look high, but includes the full-year Leominster usage amounts and indirect costs. Barb corrected a formula and confirmed that the Fitchburg costs are 83% of full year. Invoices-Empey proposal of $5K for Control Panel and the new Meadowwoods Flygt pump for $17,012.39. Barb thanked Jane for her work on scanning the tie- cards found for Lower Mass Ave.. Grease Trap Logs were due were 4/6 and there are 3 outstanding. The Planning Board sent notice of a hearing on 5/10 concerning a project at 711 Mass Ave., which is 4 buildings- 2 units each. They are aware that they will need to come to the Commission for approval of the increased usage. Barb said she will be on vacation and the 4/27 meeting will be moved to 4/29, with just 5 Chestnut St. on the agenda. Member Agenda Inputs for Future Meetings - Dave asked Barb to cc Heather (Town Manager) on the meeting package email. Public Comment- Dave Passios (Park Commission) reported that Earth Day week is coming up and the Lions Club will be sponsoring several work projects. Also the DPW will be supplying trash bags for neighborhood clean-ups. Dave added the Salvation Army will be serving coffee for cleanup at the gazebo for the clean-up on Saturday. ===PAGE 4=== Respectively submitted, Jane he faul / Jane L. Input on Montachusett Regional recent call in regards to Federal Aid programs - capital expenditures - and Dave wanting to sit with Leominster to discuss grants to help pay for I/l remediation I sat in on the informational session that MRPC held. There was no specific information available for the upcoming federal infrastructure stimulus. I'd recommend meeting with Leominster to see if they are aware of any funding sources or other opportunities that we could go after jointly (or on our own). Any update on 5 Chestnut? Conversation with Jamie? The 8" sewer main in Mass Ave should have no capacity issue with an additional 40 townhouse units. From conversation discussed this, and he questioned if the Commission has any policy on new development contributing to I/l removal. Other than addressing the potential source of I/l, there are no capacity issues. Also asked Jamie to supply soil testing logs for the test holes that were performed on the site. Well policy - your recommendation? If we are to make the cost of sewer fair and equitable among users that are on wells we would have to have water meters on their well supply line. Not sure how you go about doing this. You would also have to consider if a property then also has an irrigation system because they would likely need a second meter. Perhaps it's worth some research into what other communities do in this circumstance or try to come up with a policy that would have homeowners billed on a tiered system based on their individual situation. Control panel re-desing for $5k by Empey Given that the existing panels are no longer available and new Flygt panels are more costly and would require other upgrades, the solution presented by Empey is a more cost effective, simpler option. Future maintenance of the panel gear installed under this scenario is with all readily available, off the shelf equipment. I recommend having Empey do the upgrade as presented. Elizabeth St - any update on recommendations, (W&S or otherwise) I've reached out to three Contractors to provide quotes to do the cleaning, inspecting, joint sealing, and service connection sealing based on the W&S I/l Report. In reviewing the l/l report, the I/l rate into the problem service (33 Elizabeth) is estimated to be 1,440 GPD. Assuming that /l conditions exist for 6 months out of the year, the annual I/l from the service in question would be about 35,000 CF (262,080 gallons). At $5. 18/100 CF for Leominster's sewer rate that totals $1,813/yr in charges to Lunenburg. The W&S report estimated the cost to line the service to be $15,000 to $18,000 which would result in a 8 to 10 year return on ===PAGE 8=== 978-582-4160 x8 (fax 978-582-4152) "This email is for the distribution of materials only, not for discussion purposes." ======================================================================================== DOCUMENT : 2021-05-11-agenda-5701.txt BOARD : sewer-commission DATE : 2021-05-11 KIND : agenda OUR COPY : https://lunenburgbudgetproject.org/docs/minutes/text/sewer-commission/2021-05-11-agenda-5701.txt TOWN PDF : https://www.lunenburgma.gov/AgendaCenter/ViewFile/Agenda/_05112021-5701 ======================================================================================== ===PAGE 1=== SEWER COMMISSION May 11, 2021 5:00pm Regular Meeting via Zoom AGENDA In accordance with the requirements of the Open Meeting Law, please be advised that this meeting will be recorded and can be found on Lunenburg Access channel on YouTube within 48 hours of the meeting. He started with the Commission's inception in 2006, served as Chair for 5 years (2012-2017) and again for some of 2020. With Carl's support, the Commission had the Comprehensive Wastewater Management Plan completed in 2010 and updated in 2016. Through that process, the sewer district bylaw was created, and the Sewer Service Area was determined. He always fought to control the sewer expansion to protect lakes and groundwater, looking for alternative solutions. He also fought to present a balanced budget at Town Meeting and held rate increases for 7 years. Carl helped to negotiate the latest Fitchburg IMA and Highfield Village Allocation agreement, along with many other projects. Barb added that the Commission wanted to thank Carl for all his service and that the success of the Sewer Enterprise is due in no small part to his efforts and dedication to the task. They will be delivering a gift to him personally. Barb thanked Carl for all he has done. Brett also thanked Carl for all his years of service. John added that Carl has done a lot over the past 15 years and he considers Carl his walking history book. He will personally miss him and thanked him for all he has done. Mike D. wished Carl well and Dave thanked Carl for all he had done. Dave added he is looking forward to working with the new team, expanding sewer where they can and letting Barb and Rob do their jobs. Fitchburg Chapter 147 revisions - Barb reported she has not received an update from Town Counsel. She will need to get an extension request from Counsel to send to Fitchburg. The review from Counsel will go to Fitchburg for their review and then it will come back to Lunenburg for 2 public hearings. She has also been sending updates to Fitchburg. Control Panel work by Empey for Electric Ave Pump Station- Rob noted Empey sent over wiring diagrams for the electrical panels. He added if the Commission is ok with it, they will go ahead to replace the panel at Electric Ave. If it goes well, they will consider doing others. Mike noted it was a good set of drawings and they did a good job. CTE (Chad Empey) Year 2 Contract to commence 7/1/22 - Barb reported the 1st year contract was just 9 months through the end of the fiscal year and they need to get the 2nd year renewal contract going. She said there are a couple edits, including 1 for the Exhibit A, adding reference to response to a SSO (Sanitary Sewer Overflow) and the coordination of jetting. If the changes are ok with Empey, they will have it reviewed by Town Counsel. Dave asked about taking out the simulated power failure from Exhibit A. Rob replied that Al said it was not necessary, since he tests them regularly. Mike asked about exercising the generators regularly. Rob replied that he thinks Al does it weekly and is very knowledgeable about generators. Dave and Barb agreed that the contract has been very good. Rob noted the jetting is in the Maintenance Plan and he would want Al to coordinate getting the jetting setup and done. Barb added that there will be a new contract for year 2. The Commission discussed adding the jetting to the contract and agreed to put it under Hourly Services (section E). Barb said that the Maintenance Plan would be incorporated under the umbrella of the O&M contract. The Commission discussed whether to have a separate contract for Maintenance in the future, with possibly more than 1 contractor. Elizabeth St I/I- Rob reported he is still trying to get quotes from 3 or 4 contractors, and he ran some questions by Pat Cotton(Weston & Sampson). He added that the problem on Elizabeth St. is I/(Inflow/Infiltration). There is 700' of pipe that Weston & Sampson noted needing cleaning, inspection and grout sealing of the joints on the main. Rob added there are 3 specific services to grout and seal the service at the main. One contractor he talked to said they could do the work during the day and not at night as originally told. ===PAGE 2=== will be on 5/20 and they are still by Zoom. In regard to Paula Bertram's questions on capacity, Barb repeated that an applicant would need to come back to the Commission for increased usage. Dave asked Barb to send an official response to Ms. Bertram, with co to Adam Burney and the Town Manager. Rob noted the regulations start with 330 gal/day unless the Commission approves more. Barb reported the Bright Farms Peer Review was done by Graves Engineering and there were no issues regarding sewer. Barb noted that there was a Planning Board Public Hearing for 711 Mass Ave 8 Condos project on 5/10. Rob noted that he'd studied the plans and had suggested an alternative layout for the sewer. Dave said he believes it was denied and they will be coming back with corrections to water and drainage. Invoices- Mead, Talerman - $551.32 (for bylaw review and opinion on 5 Chestnut St.) and Fitchburg Usage- $ 16,478.38 (usage through end of April). Dave asked Barb how the budget looks, and she replied the budget is doing well. Barb noted that she'd recently updated the Website with new office hours, added links for pool and lawn waiver information, Carl's resignation, town meeting results, drain layer lists and updated forms. She will also update the website after the town election. Policy update work - Barb said when they get the Fitchburg revisions back, there are a few other policies to discuss and update during the public hearings, such as final reads, wells, easement restriction, and the reconnection permit. Dave added there are alot of other items to look at and asked the Commissioners to start making a list for discussion. He also would like to fix the billing cycle for Barb and to ask Barb, Rob and Al what they need to make the business more profitable. Dave noted that Mike Nault, who is running for the Sewer Commission, is a sewer customer. Public Comment- Brett asked if they could discuss moving meetings from 5pm to 5:30pm. John, Brett, Mike, Dave and Rob all agreed to 5:30pm but Dave wanted to put it on the next agenda when they have a full Commission to discuss it. Dave added that the Town Election will be on 5/15 - 7am to 5pm and that at the next meeting on May 25, there will be a reorganization of the board UPCOMING SCHEDULED SEWER COMMISSION ACTIVITIES: May 15, 2021 - Town Election May 25, 2021 @ 5pm - Regular Meeting, Remote Participation June 8, 2021 @ possibly 5:30pm - Regular Meeting, Remote Participation Motion: Brett R. Fitchburg Sewer Use Ordinance-Barb reported that she'd received a reply from Town Counsel regarding changes to the sewer regulations today. She also informed Mike Nault regarding the ordinance updates. Barb suggested the Commission review counsel's comments, ask for any clarifications needed, and we could send it right to Fitchburg. Dave asked Rob to review it and he thanked Brett and John for their work. Dave also asked Barb to email Fitchburg Sewer Commission with an update. John pointed out the biggest updates were written for Fitchburg Policy change discussion - Barb suggested looking at several policies to update while doing the public hearing process for approving updates to the Regulations. -- Sewer pro-rations with a change of ownership - Barb noted a new property owner is billed for the portion of the quarter they own the property. In 2010, the Commission decided there would be no pro-rating and all new owners are billed the minimum charge of $107 at the minimum for the quarter when they took ownership. A couple new owners have come forward in the past to say that it was not fair, so this would be an opportunity to make changes to the policy. John asked to clarify if someone closes on week 10 of the quarter and paid the minimum, would the new buyer, in week 11, need to pay for the whole quarter? Dave answered correct. John replied that it did not seem fair, and Rob agreed. Barb recommended prorating monthly, instead of weekly or daily. The Commission discussed the policy and agreed to monthly prorating. Barb will work on the proposed policy for the Commission's review. -Well policy - Barb noted the current flat rate for well owners is $231.87/quarter 1833cf). She added Lunenburg's rate is lower than Fitchburg and Tyngsboro. Rob suggested installing a 2nd meter on the well. There are currently 9 houses on wells with sewer connections. The Commission discussed the hardship case of an elderly sewer customer looking for relief. Dave suggested requiring a meter for the well or pay the flat rate. The Commission continued to discuss the meter option and look at options for assistance with the cost. Barb noted the total cost to install a meter would be about $1,000. Rob suggested talking to Fran at the Water District. - Easements- Rob pointed out the current regulations do not allow a sewer service in an easement over someone else's' property and they are doing a disservice to not allow them to connect via an easement if they have no other option. John agreed that if a resident is willing to grant an easement, he would like to allow it. Brett and Mike D. ===PAGE 2=== Dark anu now will tell l -.-Expansion of sewer area (SSA)- Barb noted that requests for expansion come to the Commission, prior to the Town Meeting vote. She suggested adding something like "by recommending expansion at Town Meeting, it has no impact on future projects that may happen at that location" to the Regs. It would be just a recommendation for the expansion, but the change of use or increased usage would be dealt with at a later date. Barb added if it was more clearly spelled out in the regulations, it could avoid confusion. The Commission discussed the wording and agreed to it would make it clearer. Dave added it would be good to make everything, including the budget, simpler. -Barb noted that other changes were either previously approved or are just typos to correct. She added that the Regulation changes need to go through 2 public hearings and an official vote to accept them. The changes for the sewer easement and SSA expansion wording would need to go to the Town Meeting, as they are in the By-Laws. Howard Street 40B proposal- Barb reported she received a heads-up from Adam Burney (Planning Board) that a developer will be coming forward with a proposed 40B project for Howard Street, which does not follow town board rulings -just needs approval from the ZBA. The Commission could be forced to include it in the Sewer Service Area, with sewer coming down Howard St. to Chase Rd. It would either go down Beal St. to connect to Leominster or down Mass. Ave. to connect to Fitchburg. They would need to consider capacity and rates, along with approvals from Fitchburg and Leominster. When the project is formally announced, the Commission will have 30 days to respond. Brett asked if this project would entail running a new sewer main down Mass Ave? Rob replied yes - it would be a large, expensive project with sewer and water for 200 units in the 40B development plus another 100 subdivision lots. He has not seen plans yet but recommends the Commission require the developer hire a peer review consultant to look at the capacity and technical aspects of what this development would do to the Lunenburg system, along with any upgrades needed. He added the Commission should start thinking about it now as the process can move quickly once the ZBA has it. Brett suggested requiring sewer go through the commercial district on Rt. 13 and require the system be able to handle additional customers. Dave noted Meadowwoods was developed as a dedicated line and others cannot connect along road. Rob added the developer still needs to get all the permits from the state and will need to ask for waivers for anything they will not address on the local level. First the subsidizing agency would need to look at the site before approving it to go forward. John suggested the Commission keep the project in their minds as 40B project can take off quickly. Dave asked to add it to the agenda for discussion and Brett suggested bringing it to Town Counsel to cover the Commission. CTE O& M Contract - Barb reported that Chad TEmpey is coming up to year 2 of the contract and she sent out her recommended changes. She added jetting coordination under hourly services as it is a billable service. She would like to incorporate the Sanitary Service Overflows (SSO) and jetting to make the contract consistent with the Maintenance Plan. Also Heather (Town Manager) was concerned at the time of the RFP which was the basis for the Year 1 contract that the RFP reference what is asked for in the Maintenance Plan. After Year 3, it will be going out for bid again and would be good to have it in the contract to use as a basis of the RFP. The Commission discussed Barb's changes, and all agreed. The 2nd year of the contract begins on 7/1/21. Elizabeth St. I/I (Inflow/Infiltration) - Rob reported he received 2 quotes - National Water Main Cleaning was around $18K and Green Mountain quoted $6,500 for labor plus grout cost per gallon for under $10K. He will be going ahead with Green Mountain, who said they can do the work fairly soon. The Commission discussed the work and Rob said the cost will come out of I/l expense line. Barb added they will see if the contractor finds something at 33 Elizabeth St. before they proceed in contacting the resident, and the Commission agreed. Dave suggested sending a ===PAGE 3=== change. Dave said the next meeting, June 8, will start at 6pm Brett modified his motion: To continue all further meetings to begin at 6pm. Second: John R. (Brett withdrew his previous motion.) Roll Call Vote: John-aye, Mike N.-aye, Brett-aye, Mike D.-aye, and Dave-aye. Minutes for May 11, 2021 Motion: Brett R. Second: John R. To approve the minutes for 5/11/21. Business Manager Report - Barb noted Adam (Town Counsel) will attend the meeting on 6/8 and she will confirm he can still attend now that it's at 6pm. Invoices -Fitchburg for $20,046.87 (3/26-4/25/21) and Leominster for $116,591.55 (12/26/20-3/25/21), which are based on flow meter readings. John asked how the Leominster costs compared to last year. Barb replied that at this same time, last year's costs were $309K and this year $362K, with 3 quarters of flow meter readings. Barb reported the FY21 Budget looks good, with Revenues up ($927, 133) and Expenses within range ($909K). The FY21 Budget ends 6/30/21. Barb said she spoke to Town Counsel regarding Paula Bertram's previous questions on 5 Chestnut and will send the response to Paula when she receives it from Counsel. Also they received a request for a sewer extension at 410 Hollis Road which will be on the next agenda. Barb added that the next Counsel hours will be in June, date to be determined. Public Comment- Mike N. said it is good to be back again. Brett agreed it was good to have Mike N. back and thanked Dave for re-upping for 3 years. Dave said he is looking forward to working with all and thanked Carl Luck for his 15 years of service, hoping he is enjoying his retirement. The Commission will meet the second Tuesday of the month at 6pm via Zoom until next April. The last Tuesday of the month, they will be meeting live at the Town Hall at 6pm. PUBLIC COMMENT- none APPOINTMENTS - Wes Flis (Whitman & Bingham) and Don Dobeck -re. 410 Hollis Rd. Sewer Extension request - Wes provided a large version of the draft plan for a sewer extension as well as tabletop versions for the Commissioners. He stated they are looking at running a sewer extension (approximately 939 feet), from the Pond St/Prospect St. intersection (Lake Whalom Rotary) to service a single lot on Hollis Road. They would run a service under Pond St. to a lot at the corner of Pond St. and Hollis Rd. Since Pond St. was recently paved, he talked to Rob Oliva and the suggestion is to run the service along the southerly shoulder of Pond St. They would tie into the existing manhole at the rotary, pave it and infrared seal the sections to match the new pavement. He added Rob suggested leaving stubs for the 7 other potential properties and getting the opinion of the Sewer Commission. Dave asked why they would go down Pond St. instead of Kimball St.? Wes replied it would be easier construction going down Pond St., as there are more utility poles, slopes and drains on Kimball St. Rob said his preference would be to go down the center of the road in order to service as many properties as possible. Wes replied if they ran down the center of the road, the developer would need to re-pave the whole road, which would be cost prohibitive. Rob added it is 5 years - or longer-before opening a road after paving. John asked if it would be privately funded and Wes replied yes - they would install it themselves, with the 8" main going to the town. John asked if they approached any other property owners and Wes said the owner of the southern property would be interested after the fact. Brett asked what their preferred route would be and Wes noted Kimball St. would be shorter but Pond St. would be easier construction. He said abutters are not willing to connect now to share the cost. Mike Nault agreed he would also like to see it go by more properties and Mike Deveikis asked if they looked at going down Hollis Rd? Wes replied they did not look at it but asked if the sewer went down Prospect St. by Hollis Rd. Rob stated it did and confirmed Hollis Rd. had been recently paved. Mike D. asked if provisions would be made for future extensions down Hollis and Kimball? Wes replied they could pick up at the corner of Kimball and Pond. Don Dobeck noted they could move the manhole up at the corner of Pond and Kimball, adding a stub & cap for future purposes. Dave added he would like to see it go down Kimball and Hollis, as he knows people in need of sewer in that area. Rob suggested contacting the Board of Health regarding residents in the area with septic problems. Wes said the issue is the cost for the developer unless residents are willing to pay their fair share. Don said they have no problem coming down Kimball- the issue is the cost of paving. John suggested sending letters out to residents and Dave said the Commission would take care of sending those letters out. Rob suggested having the Lunenburg Water District look at the plans. Don noted this will be for his own house and will not be sold. Wes confirmed that it will be less than 1,000 ft. which only requires an as-built plan and they will look at both streets. John noted the letters to residents should have a short response time. Rob added if they could look at hugging the side of Kimball St. it would benefit more residents. Wes asked if they could get a temporary easement across the triangle lot on Prospect and Kimball. Rob said they could do a temporary construction easement but would check the regs. CURRENT BUSINESS - CTE O&M Contract extension for Year 2- Rob reported CTE has submitted the contract and the Sewer Commission signed it. ===PAGE 2=== Bright Farms status - Rob said he has not had any updates and Dave said he put a request out to Adam Burney (Planning Board) for an update. FY21 TD Budget review- Commission discussed the FY21 budget and agreed it looks good. Rob noted that Revenues are up. Dave commended Barb's work on controlling the budget during a difficult year. Minutes of 6/8/21 - Motion: Mike Nault To accept the minutes for 6/8/21. Second: Brett R. Vote: Brett-aye, Mike N.-aye and Dave-aye. Business Manager Report - Rob reported CTE installed the Electrical panel for Electric Ave., and it is running great. The Nameplates were provided by Mike Nault. Invoices: Fitchburg Usage - $17,586.68 and Mead Talerman - $1,470.67. Rob said he had no updates on the Howard St. 40B project. Carl Luck's retirement- Rob reported that Carl sent a thank you note for the sign and gift card from the Commission. He read the note out loud for the minutes. 5 Chestnut St. response from Town Counsel was sent to Mrs. Bertram. Regarding the electrical panels, Mike D. asked if others will be installed and Rob replied he would like to look at conditions at the other stations before installing a new panel. Mike D. said he would look at the new panel. Dave asked if the stations were on the Solar program and Rob said he would need to ask Barb. Member Agenda Inputs for Future Meetings/Counsel hours - look at the Maintenance Program. Dave thanked Adam Costa (Town Counsel) for attending the last meeting and Commissioners can make an appointment for counsel hours. Public Comment - Rob noted he had more items for the Commissioners to sign. Dave thanked everyone for helping get through the past difficult year and wished all a Happy Ain of July. Citing the meeting discussion concerning the need for sewer in that area due to failed septic systems, Rob reached out to Jim Garreffi (Nashoba Board of Health) but has not heard back yet. In consideration of the town's needs and the property owner's need, Rob said they will go down Kimball St. just to the main and leave stubs for the properties on the eastern side of Kimball. They will not extend into the road, which was recently paved but will have accommodations for future hook ups. Rob added Clean Basins will be coming on 7/15 to camera the lines just jetted on Mass. Once she has 1 full year of information, they will know how much of an impact that there will be on their electric bill. Dave added it should be about 15% credit. Dave also mentioned the recent heavy rain could have a big impact on the flow meter readings. Barb said Flow Assessment will have data for July after the 26' but could be later. Rob pointed out the groundwater should be down (Infiltration) but could be concerned about sump pumps connected(Inflow). He said he could ask AI (CTE) if he has some data from the run times at the pump stations. CTE Bond- Barb-received a bond from CTE (Chad Empey) which has a signature line. She consulted Town Counsel, who said the signature just confirms that the bond is $ 41,053.02 and that the Chairman could sign it. Dave said he has never signed for a bond and others agreed. Barb said that Counsel advised if it needs to be voted on, it should be on the agenda. Dave suggested a vote and Barb will check with Town Counsel if it was done correctly. Motion: Brett R. CURRENT BUSINESS - Pledge of Allegiance at Sewer Meetings- John suggested the Sewer Commission say the Pledge of Allegiance before starting the meetings. Dave and Brett agreed it was a good idea and Dave suggested starting it at the next meeting. Brett suggested discussing it at the end of the meeting and voting. Pond View Commons, LLC (Howard St. 40B) - Barb noted the site visit will be 7/28 at 1pm. There will also be a 40B strategies workshop on 8/3 at 7pm at the Middle/High School, led by Adam Costa (Town Counsel). 419 Whalom Rd - Barb stated this was the connection request for the Whalom property with no frontage. Adam Burney (Planning Board), Adam Costa and Heather (Town Manager) are working on finding a way to make it work. Brett asked to clarify if it was the property noted with the "paper road?" Barb agreed and said that she'd contacted the Assessors and although the town's GIS system notes it as "Town of Lunenburg- owner unknown", the town does not have control of it. ARPA funds (Coronavirus Local Fiscal Recovery Fund) monies - Barb reported that the town had received the first payment of $ 614,000 and Heather has met with department heads, to start discussing how to make the best use of this money. Rob Oliva had suggested a pump station evaluation and upgrade. Heather is looking for proposals and they will go before the Select Board. Dave asked to add this discussion to a future agenda. Barb added there is no deadline yet and the proposals would be for investment in infrastructure. Grease Trap Program Renewal Fees-Dave noted the fees were waived last year and it costs $5-6 per year to do that. Barb stated they have 18 customers, and Compliance has been good, with grease logs usually filed on time. Brett said he is leaning towards waiving the fees again since many restaurants are still trying to recover. There was discussion whether non-compliant accounts could be charged and compliant accounts' fees would be waived. John stated they need to be consistent and either they charge fees or not, but he would be inclined to waive them. Mike D. agreed to waive fees again as restaurants are trying to get back on their feet. Dave would agree with waiving fees, but restaurants must be compliant with logs and pumping. Barb also agreed with waiving fees and will note in the letters that they need to stay compliant. Dave asked Barb to send a copy of the letter to Heather (Town Manager) and Brett suggested taking a vote. Motion: John R. Second: Brett R. She added they are still interviewing candidates for the Part-time position. ===PAGE 2=== for further action since Chad Empey and the insurance company had signed the bond. Barb has had no updates on the Fitchburg Sewer Ordinance. When they respond, the Commission can look at updating the other policies and review all during the 2 public hearings. Barb noted that she'd updated the website with election of officers, updated forms and changes to meeting time/place. Dave mentioned that we should put something on the website to tell residents in the Sewer Service Area that they can contact the Sewer Commission if they wish to hook up to Sewer. Brett noted that he'd talked to the gentleman that owned P&S Truck on Chase Rd, who has some potential buyers for the property and hinted that sewer access would be good. Dave added that the future of Lunenburg would be to run sewer on Chase Road, in order to service other businesses, including the DPW building, but they need to resolve the 40B issue first. Barb had the FY21 Encumbrance form at the office that needs to be signed and sent to the Town Accountant, whenever they had time to stop by. Member Agenda Inputs for Future Meetings/Counsel hours- Commissioners can sign up for Counsel hours in August. Dave suggested getting information out to potential sewer customers with betterments/tie-ins. John suggested getting a mailing list of potential customers. Dave suggested discussing Budget improvements and having the Town Accountant attend a zoom meeting. Also, Rob Oliva is scheduled to give Maintenance Plan updates at each in-person meeting.
