CURRENT BUSINESS - Pond View Commons, LLC 40B discussion- Dave reported he represented the Sewer Commission at the site visit and Barb attended the 40B workshop, held by Town Counsel. Barb sent the Commissioners the handouts from the site visit and also the link to the video recording of the workshop. Any comments are due to the Select Board by 8/23. Dave pointed out that the Commission is just concerned with how they will be getting sewer and utilities to the 40B site. There are no engineered drawings as of yet. Barb screen shared a list of comments she put together with Rob. The Commission reviewed the list and discussed the fact that the project is not in the Sewer Service Area. Dave noted the sewer will be put in by the developer and they need to determine who will pay for the upkeep of the system. Rob added once the application is approved, they will get engineered drawings and the project will be submitted to the Zoning Board. Dave asked the Commissioners to send any additional comments to Barb. Mike N. noted the developer will probably want to include the future development of 120 other houses. He added right now the flow to Leominster is cheaper and Dave pointed out they will need to consider this volume when negotiating the IMA. One option could be looking at Townsend, but Rob said Townsend has no sewer. John asked if Leominster or Fitchburg are aware of this project and Barb replied that she had not communicated from this office yet. Dave also noted the project has several 2- and 3-bedrooms apartments, which could add a lot to the flow. Mike asked if either city gets to say 'no' to the flow. Barb replied that Town Counsel said since they have IMAs, a 40B project does not have any sway over contracts. Also Leominster & Fitchburg will need to approve the flow and plans. John asked how many pump stations would be needed. Rob replied it would probably be multiple pump stations (2-3) and may require additional upgrades to the system. He added that they should seek additional financial contributions, beyond user fees, to maintain the stations. Also since the area is not in the Sewer Service Area, the town should not be on the hook for extra cost. Rob noted that since this is residential, the flow metering should be based on the water use not metering for outflow as discussed for Bright Farms. Barb said that Emerald Place and Whalom Luxury Apartments do not have pump stations and that the metering is done by building. Dave suggested installing a Grease Trap of some sort, but Rob said they can't separate the grease from other waste on residential developments. 384 Mass Ave plan discussion- Rob reported Mr. Esposito submitted an acceptable as-built for this property. If the Sewer Commission agrees, he will send it out to the state DEP. He added that the drawing shows the connection going from 384 and crossing the property at 362, but the town does not allow easements. The Commission still needs to discuss this and he suggested making the property owners grant an easement. Dave suggested putting it on the deed and the Commission needs to address the issue. Barb said she will check with Town Counsel. The Commission discussed and agreed Rob can send the plan to the DEP. ARPA Monies (American Rescue Plan/Coronavirus Local Fiscal Recovery Fund) - Rob reported there will be about $600K coming to the town for use on infrastructure. He suggested upgrades to the system such as rehabbing pump stations, Inflow/Infiltration (I/I) projects or feasibility studies to see what each pump station would need. Rob asked Commissioners to send him other suggestions and said another $600K will be coming in another year or 2, but noted the money will be shared by the Town. Dave suggested getting input from Al (CTE) and also working with Leominster on I/l grants. 419 Whalom Rd requested sewer connection- Barb reported they are working with Adam Burney (Planning Board) and Town Counsel. She added the buyer's realtor went to an attorney and she also heard from Unitil, who is an ===PAGE 2=== noted the readings were done through the end of July and they were slightly up but not doubled due to the rainfall as feared. Rob added that they did not see a lot of I/l because the ground water level was low to start. DPW Director's Maintenance report will be presented at the last meeting of each month. Rob reported that they have jetted and camera'd on Mass Ave. in the area of the large bend, where they suspected a break in the line. They did not find a break but found quite a bit of grease and a blockage from Riley Rd. The vendor will come back with a spinning whirligig to completely clean out the lines. Rob would like to send out flyers to the homeowners' association to let residents know about dumping grease. Elizabeth St- Rob is still waiting for the contractor to fit the job into their schedule. Hollis Rd/Kimball St. extension- Rob met with the engineer and looked at it. He also asked Jim Garreffi (Nashoba Board of Health) if there are any properties in need of sewer and he was not aware of any failures. Jim was ok with going down Kimball Street. Member Agenda Inputs for Future Meetings/Counsel hours - none Public Comment- Dave announced pancake breakfast at Senior Center on 8/11. Barb reported there have been no new candidates for the assistant position. PUBLIC COMMENT- Dave sadiy reported Peg Gorman of Hickory Hills passed away. She was a dear friend, a big supporter of the Lion's Club and loved watching the Sewer Commission meetings. She will be greatly missed. ANNOUNCEMENTS - Barb noted the Town Manager sent out an email regarding signing up for automatic notifications when any minutes and agendas are posted or updated. Also the Q1 bills are out and are due at the end of next week. If anyone has not received their bill, they should call the office. Barb reported that major work had been done due to grease buildup in the pipes and she reminded all customers not to dump grease down the drains or toilets. The 9/28 meeting will be via Zoom as the Select Board will be using the Town Hall meeting room. Discussion followed on assessing a fine for dumping grease down the drains and whether it would be enforced through the Sewer Regulations or through the Board of Health. CURRENT BUSINESS - Maintenance Report- DPW Director, Rob Oliva reported Clean Basins has augured the line on Mass Ave. which they thought was a grease build-up, but the technician said it looked like joint compound. The line is now freed up and running clean. CTE would like to replace the panel at the Mass 2 station and the cost will be about $5K- the same cost as the Electric Ave. panel, so they will go ahead to do that. Rob received an estimate from CTE to replace the impeller, gasket & seals on the Dana St. station pumps for a cost of $10,900. Since the cost is over $10K, he is asking for the go-ahead from the Commission. Motion: Brett R. Second: Mike D. To approve the $10,900 for repairs to the Dana Street pump station. Discussion: Rob noted they will be repairing both pumps and this will be the first time they have done minor rebulld since installation in early 2000. Mike D. asked if they use a megohmmeter to test the motors and Rob replied he will talk to CTE about it. Brett asked if there is a life expectancy for the bearings. Rob said he will ask AI (CTE) and check if this is part of the Maintenance Plan. Dave suggested revisiting the Maintenance Plan every couple years. Mike D. asked about a spare motor for Dana St. Mike N. added preventative maintenance is good and they should have spare parts on hand. Roll Call vote: Mike D.-aye, Mike N.-aye, Brett-aye and Dave-aye. ARPA funds - Rob reported there has been no further discussion or updates. Assistant to the Business Manager - Rob reported, in discussion with Heather (Town Manager), the assistant position may need to be more than 19 hrs. and should offer benefits. He suggested changing the position to 24 hrs./week with benefits to attract qualified candidates. They would need to move forward with an amendment to the budget at the Fall Town Meeting. Barb explained that the estimated cost for the 7 months of FY22 would be $14,400 (salary) and $14,000 (benefits) for a total of $28,400. They have budgeted $19,600 and would need to add approximately $8,640 to the budget. Mike N. calculated the yearly cost would be about $49,000. The Commission discussed the costs and Rob added the goal is to hire someone who can take over when Barb retires. In the future, they could adjust the assistant position back to 19 hours. Dave suggested being flexible with the hours and the Commission agreed the hours should be fixed. Barb agreed with hiring an assistant for 24 hours/week and noted that, because of different tasks throughout the fiscal year, it would be good to give that person a full year to learn the job. Motion: Brett R. Second: John R. To approve the suggestion of Barb and Rob to hire an assistant for 24hrs/week with benefits. Roll Call vote: Mike D. aye, Mike N.-aye, John R.-aye, Brett-aye and Dave-aye. • Special Town Meeting November 16, 2021- warrant articles- Barb read the placeholders for the warrant articles that are due on 9/28 and had sent out the draft for the Commission review. These will still need to go to the Town Manager for review. #1 article - to increase the current year (FY22) appropriations from Retained Earnings by $8,640, and further that $14,000 be included from the general fund for indirect cost, to allow for addition of a benefited 24 hour/week position. Dave wants the FinCom to be made aware of the changes to the budget. #2 article - To see if the Town will vote to transfer $14,875.50 from available funds into the Capital Reserve Stabilization Fund. Barb noted that they only spent $ 5,121 in FY21 on Capital of the $20,000 transferred from the Fund, and she proposes transferring the remaining $14,875.50 back ===PAGE 2=== into the Capital Reserve Stabilization Fund, so it is earmarked for Capital expenditures. Dave asked Rob for how much has been spent on the Maintenance Plan and Rob replied that he will have that for the next meeting. Motion: Mike D. Second: Brett R. To approve the articles for the Special Fall Town Meeting. Roll Call vote: Mike D.-aye, Mike N.-aye, John R.-aye, Brett-aye and Dave-aye. Grease Trap annual permit renewals FY22- Barb reported the Annual Grease Trap Renewal requests went out August 1st. She has received 14 back but has 4 still outstanding. Last year, they sent a letter to the late filers, with $50 invoice and notice that $25/day fines can be assessed if the renewal is not received. Barb has emailed twice and called the owner without email. The Commission discussed whether we should call the late filers or just send a letter. Dave gave the go ahead to send the letters with the first phase of fines but added that it was still his preference to call the establishments first. Q1 FY22 Commitment $250,422.07 - Barb asked for the Commission's verbal approval for the commitment, which is the amount billed to sewer users. Motion: John R. Second: Mike N. To approve the Q1 FY22 Commitment of $250,422.07. Roll Call vote: Mike D.-aye, Mike N.-aye, John R.-aye, Brett-aye and Dave-aye. Minutes for 7/27 - Motion: John R. Second: Mike D. To approve minutes of 7/27/21 meeting. Roll Call vote: Mike D.-aye, John R-aye, Brett-aye and Dave-aye. Minutes for 8/10/21- To approve the minutes of 8/10/21 meeting. Roll Call vote: Mike N.-aye, John R.-aye, and Dave-aye. Business Manager Report - Pond/Kimball extension request-Barb reported the owner is passing on pursuing the extension due to the betterments and connection fees involved. Also she has heard no updates regarding the Comments on the proposed 40B development. Dave complemented Barb & Rob on the comments put together on behalf of Sewer. Barb noted the 419 Whalom Rd. connection is moving forward because they were able to obtain permissions from the abutters. They have submitted a permit and Rob has requested an engineered plan. Barb has not heard any updates on the Fitchburg Ordinance, and she has made several updates to the Website. Invoices- Fitchburg Usage- $17,714.24 (7/26-8/25), Leominster Usage- $ 117,729.89 (quarter) and Mead, Talerman - $394.06 (for work on 419 Whalom Rd, DEP and Flow Assessment Contract). Dave asked about the rate increases for Fitchburg and Barb replied they have budgeted for the increases already. Fitchburg's increases were stated in advance and this year the rate went from 9.11 to 9.75 (7% increase). Leominster also had a 6% increase. Dave asked Barb to resend a copy of the budget to Commissioners with the increases noted. The Commission began the meeting by saying the Pledge of Allegiance. PUBLIC COMMENT- none ANNOUNCEMENTS- Dave announced the 1s quarter bills were due 9/27. If anyone has past due amounts, they need to pay them or it will be added to your December tax bill, if they remain unpaid. APPOINTMENTS: Parks Commission - Marshall Park request- Dave Passios- Rob reported the Parks Commission would like the Sewer Service Area (SSA) expanded to include Marshall Park and they may do a warrant article for the November Special Town Meeting. Dave Passios noted the warrant article is the same as the one passed over at the Spring Town Meeting for Chestnut St. He added the park is about 28 acres and the Parks Commission is starting to plan a renovation of the entire park. He noted the old bathroom building was torn down and they found during testing the old septic system would not be useable. They are doing test holes to see if they can put a new septic system in, which is one option the Parks Commission has for restrooms on the property. Dave P. noted the Board Of Health has money for soil testing. They are looking to get the park into the Sewer District with a line out to Mass Ave. He added there are pros and cons for both options. Dave M. said he would want to put Marshall Park in the sewer district so they can have flexibility to go septic or sewer. John asked if they know that a septic cannot be put in and Dave P. replied a septic could go in as a repair, in the exact same location. Brett asked how long a repaired system would work and Dave P. guessed about 20 years. John asked how they would determine the cost of the betterment. Dave M. replied sewer would just be just for the bathrooms, and he would like to add. sewer connections at every park being used. Rob said he did not know if the regulations had an exemption for a municipal connection. Right now, they are looking at just adding the park to the SSA. Mike N. said he would like to accommodate the park but asked if it would have an effect on other properties. Rob noted the vote is to just add it to the SSA- not for a connection. He added it is good for the community; it will always belong to the town, and it is not developable. Dave P. noted they are looking for a septic location in order to determine the space needed. With a sewer connection, they could have multiple lines in the park. John said he supported adding it to the SSA but adding a connection would depend on the circumstances. Motion: John R. Second: Brett R. To approve the request from the Parks Department to add a special article to the Special Town Meeting to add Marshall Park to the Sewer District. Roll Call Vote: Mike N.-aye, Brett-aye, Mike D.-aye, John-aye and Dave-aye. Dave M. noted Dave P. and Karen are doing a great job on the Parks Commission and Dave P. said he appreciates the support of the Commission so they can take the article to Town Meeting. (Mike N. & Mike D. left meeting.) CURRENT BUSINESS - 711 Mass Ave Condo project-Rob stated this is an 8-unit condo project and the site plan was approved by the Planning Board on 8/23/21. He had added some comments to the plan and the Planning Board approved the plan with conditions- one being they had to come to the Sewer Commission for final approval. Rob screen shared the approved site plan and noted they approved it with 8 sewer connections. He does not see any problems but asked the Commission to be aware of his comments when they do come before them. Rob noted the Whitman & Bingham engineer for the project did not address his comments, but that may have been an oversight. Rob said he will discuss his comments with them prior to their coming to the Commission. John asked if this transpired before Whitman & Bingham was sold to Maine engineering firm and Rob replied it was before the sale. Upland Ave extension discussion- Rob was contacted by a party that wants to purchase 71 Upland Ave. and would like to run an E1 pump system down Upland Ave, past the house next door. He added 61 Upland Ave. put in an E1 pump system and ran the force main for the pump in the shoulder, down Upland to Electric Ave. for the sewer connection. The person looking to buy 71 Upland would like to do the same thing, but Rob told him they cannot continue to run multiple force mains down the shoulder. Rob suggested looking at making sewer available to everyone on the road. Jim Garreffi (Board of ===PAGE 2=== Health) confirmed there are septic problems on Upland Ave., and he noted another property on Upland may need a fight tank in the near future. Rob added both Upland Ave, and Eastern Ave. have a lot of ledge on properties, slope down from Hollis Rd. and are prime candidates for gravity systems. He noted a survey of residents was done several years ago, with half of the residents interested in sewer. Rob suggested doing another survey as more could be interested now. Dave and John agreed to ask Barb to send out another survey letter. John pointed out it could be an expensive project due to the ledge. Dave M. suggested looking at other areas of need in town. Rob also suggested putting a list together and said it is the tight tanks that concern him most. Motion: John R. To have Barb and Rob send a survey to residents on Upland Ave. Discussion: Rob suggested adding Eastern Ave. also. John modified his motion accordingly. Motion: John R. Second: Brett R. To have Barb and Rob send a survey to residents on Upland Ave, and Eastern Ave. for a sewer extension. Roll Call Vote: John-aye, Brett-aye and Dave-aye. Brett asked Rob if he could put together a list of other roads to consider for sewer need within the Sewer District and Rob agreed to do so. Special Town Meeting warrant articles- Dave M. reported the warrant closed at 5pm today and Barb had sent out a copy of the Sewer Commission's articles. Maintenance Plan report - Rob reported there are numerous manhole covers on Mass Ave., Leominster Rd and other areas that need repair and will talk to a contractor about repairing 8-10 of them. He has already purchased several manhole covers. The Commission discussed previous manhole repairs and others that need to be done, including some on Mass Ave. Rob added they are still good on the budget. Dave Passios asked if the 4 manholes done at Paton's corner were done by the state and Rob replied he thinks they were just cut and patched FY22 Budget updates- Leominster's rate increase- Dave M. noted there was a 7% increase between Fitchburg & Leominster and the extra was figured into the budget. Rob agreed Barb did well in her projections. Dave added the part time assistant position will be changed at town meeting to a 24 hrs./week position, with full benefits. This will add about $50K to FY22 budget. Minutes of 9/14- Motion: Brett R. To approve the minutes for the 9/14/21 meeting. Second: John R. Roll Call Vote: John-aye, Brett-aye and Dave-aye. The Commission began the meeting by saying the Pledge of Allegiance. PUBLIC COMMENT- none ANNOUNCEMENTS - Barb announced the Q1 delinquency notices have gone out. Anyone who has outstanding balances from the past fiscal year which ended June 30th, will need to pay them, or those amounts will be added to their December tax bills. The next meeting on October 26i will be in-person at the Town Hall. Rob reported he received an email from Green Mountain Pipe, regarding the crack sealing work on Elizabeth Street. They will be coming on October 18 & 19 to do that work. He added that the street will be blocked off to all but local traffic for those days. CURRENT BUSINESS - Upland Ave/Eastern Ave Extension discussion - Barb reported that she discussed surveying the residents with Rob. Her concern is the ledge in that area and possibly having an engineer look at it, to weigh in on the estimated costs. Barb added that they could look at other streets which might help offset the costs. She asked the Commission to consider getting an estimate from an engineering company. Rob noted that he had discussed Upland Ave. with Bob Proctor who is familiar with the ledge issue and has put in tight tanks in that area. Rob added it would be good to get a rough cost for construction to let residents know what their share could be before they commit to doing the work. He suggested contacting engineers that the Commission had used in past, to get quotes on preliminary design, such as Wright Pierce and Weston & Sampson. Rob said he could solicit several engineers for estimates on a conceptual design which would be well worth the investment. Motion: Brett R. To have Rob reach out to engineers and get estimate quotes for Upland Ave/Eastern Ave. work. Discussion: John joined the meeting and asked if Rob could estimate how much the engineering estimate would cost and Rob replied about $6-8K for a conceptual drawing from available information, including a construction estimate. The Commission could discuss it again when they have the engineering quotes which should be under $10K. John asked Barb how they approached it in the past and she replied that previously some members preferred not to incur costs until it was confirmed that it could be included in a betterment. Barb added that she'd received multiple requests from Upland residents and that there are several residences with tight tanks. She added that she'd received requests in the White St. area too. Rob said he would go with a limited scope of work to get a preliminary plan and quote. Motion: Brett R. Second: Mike D. To have Rob get at least 2 or more quotes for the cost for engineers to estimate the potential cost for the construction of an Upland Ave./Eastern Ave, extension. Discussion: John suggested amending the motion to include White St. Brett amended the motion to include White Street and John seconded it. Roll Call Vote: Mike D.-aye, Brett-aye, John-aye and Mike N.-aye. Fitchburg Response to Regulation changes - Barb noted that she'd sent the Commissioners the attachment from Fitchburg, Jeff Murawski, with his suggested changes but hadn't included the email with his concern regarding the wording in Article IV, Section IV-3 regarding Discharge Documents. She would like to discuss this section with Town Counsel, along with the other changes. Barb will come back to the Commission with Counsel's input and they can vote on it. She clarified that the Commission will need to go through the notes and detinitions to see if the Commission also agrees. The Commission agreed that Barb should discuss it with Counsel. ===PAGE 2=== Grease Trap permit renewals for FY22 - Barb reported all annual permits have now been received, including one today with a late fee. The 1st Tuesday logs were due 10/5 and there are 3 still outstanding. Barb has reached out to them by email or phone. She noted that Donnelly's log is outstanding but that they still appear to be operating. Maintenance Report- Rob noted that Dave had asked about capital and maintenance expenditures so far. He said that out of the $100K budgeted for Capital, they have spent just under $17K, which includes the Mass Ave 2 panel and the impeller work at Dana St. Barb noted that the first panel was done in FY21. The Maintenance Account has spent about $26K out of $64,425, which has $ 38,500 left. The work on Elizabeth St. was encumbered from FY21. Rob is also trying to get Martinez Road Construction coordinated to do re-work on manholes on Mass. Ave. and Leominster Rd. They have already purchased the castings from Pipe Plus and will get all work done this fall. Mike N. asked if this work includes the cover on Mass Ave., at the town line which is over the meter and Rob replied it is not on the list, because others are much worse. FY22 YTD Budget - Barb reported the Revenues, so far, are $298,097.50 and Expenses are $345,991.30. The Expenses are currently higher since they include the annual transfers to the town for Indirect Costs insurance and benefits). Minutes for 9/28 - Motion: Brett R. To approve the minutes from 9/28/21. Second: John R. Roll Call Vote: Mike D.-aye, Brett-aye, John-aye and Mike N.-aye. Business Manager Report - Barb reported she has 3 invoices- Fitchburg Usage - $14,325.20, Fitchburg Debt Service - $20,965.40 (which was budgeted) and Mead Talerman- $340.65 (August bill for mostly 419 Whalom Rd issue). Invoices were verbally okayed by the Commission. Barb noted that there is one Conflict of Interest exam still outstanding from the Commission. The Commission began the meeting by saying the Pledge of Allegiance. PUBLIC COMMENT- none ANNOUNCEMENTS - Dave reminded all the Special Fall Town Meeting will be November 16'h and it is very important for everyone to attend to vote on what happens in our town. Barb also reminded anyone who has outstanding amounts from the last fiscal year which ended June 30", they will be put on the tax bills very soon, so it is important to pay them quickly. CURRENT BUSINESS - Elizabeth Street Inflow/Infiltration Remediation -Rob reported Green Mountain Pipeline came in to address the 600' of sewer main identified in the Weston Sampson report. They filled joints with chemical grout to address I/l in 3 services. The operators reported the main in the street was not bad, but the services needed grout. Rob is waiting for the report to determine how much grout was used. John asked if the amount of grout used determines the amount of 1/l (Inflow & Infiltration) and Rob replied the amount of grout would tell him how bad the services were. Green Mountain questioned why he was looking at the main since not a lot of grout was needed. Rob told them the main was identified in the Weston Sampson report and he was just following through. The older services needed more grout, and the report will tell him more. Upland/Eastern Ave/White Street extensions - Rob reported he put together an informal RFP for preliminary design and cost estimating for Upland, Eastern Ave, White St., and Maple Parkway. He reached out to 4 firms: Weston & Sampson, Wright Pierce, Woodard & Curran, and Tate & Howard. Rob received 3 proposals back, ranging from Wright Pierce @ $13,200, Tate & Howard @ $19,800 to Weston & Sampson @ $42K. He is still waiting for a price from Woodard & Curran and will forward them all to the Commission when he has received all. Rob added that Wright Pierce seems anxious to work with the Commission. They are all good firms, but he would likely go ahead with Wright Pierce when he receives the final proposal. The proposals all included soil explorations for ledge and 2 days' worth of about 20 soil probes. They will have a good idea of the cost for the project and the biggest factor will be the ledge. Rob talked to all 4 firms, and noted that he was open to suggestions if they have done a similar project differently. He was surprised with the high price from Weston & Sampson and assumed it was their way of saying they were not interested. Dave asked Rob to send Barb the proposal request so she can send it to the Commissioners and Rob replied he will send that along with the proposals he received back. Fitchburg Sewer Use Ordinance-Barb has not received any updates back from Counsel. She just heard that Jeff Murawski has left Fitchburg and our current contact will be Tony Maressa. Barb will be meeting with Counsel soon and will press him for the complete review of what Jeff had sent out. Dave suggested asking the new person to come to Lunenburg to meet with Barb and Rob. Dave added he still wants to meet with Leominster to discuss grants. American Rescue Plan Act (ARPA) funds- Rob stated they are still waiting for an update from the state and how the money will be divided amongst the town agencies. Barb noted Heather said they are waiting to see what the state and Federal Government will be doing with the funding. The Federal Government is still debating the Infrastructure bill and Heather would like a list of infrastructure projects from the Sewer Commission. Dave asked to add it to the December agenda. Minutes of 10/12 - Motion: Mike D. To approve the minutes for 10/12/21. Second: Brett R. Roll Call Vote: Brett-aye, Mike D.-aye, and John-aye. Business Manager Report - Grease Program- Barb reported there is a new food establishment - Lunenburg Diner. She has sent out the information packet to them, which is due back by 11/15. John asked if they have both an ===PAGE 2=== internal and external trap? Barb clarified they do and that the prior restaurant, Whalom Kitchen, was overdue on their pump-out. She told Lunenburg Diner they need to do an external pump-out ASAP, or the landlord will need to show the pump-out occurred but did not forward the report to her. Barb will have an update for the FY22 YTD Budget for the next meeting and she noted they are doing as well as planned with the budget. Invoices- Fitchburg Usage for $19,030.75. Barb noted this was one of the highest invoices, but the next invoice will be back down to $15K. The Commission agreed with invoice. The Conflict-of-Interest Certificates for the Commissioners have all been submitted to the town clerk's office. Action Items- Dave asked for an update on the Pond View Commons 40B project and Rob replied the town manager has had no updates. Barb stated she is working on billing, and they will be working on transfers for delinquent amounts to the tax bills. Public Comment - Dave invited all to the pancake breakfast at the Senior Center on 11/10 and wished all a safe, happy Thanksgiving We also said he is proud of the job everyone did intestantanked rall his work since starting in Lunenburg. The Commission began the meeting by saying the Pledge of Allegiance. ANNOUNCEMENTS - Barb noted the bills that were sent out in November were due on 12/13. If anyone has not received theirs, they should call the Collectors to get a payment in because the demands have already been processed. Barb reported that all 3 sewer-related articles were passed at the Special Town Meeting on 11/16. The articles were: budget article to increase hours for the Assistant position, the transfer to the Capital Reserve Stabilization Fund and the Parks Commission's request for inclusion of Marshall Park in the Sewer Service Area. Barb said the delinquencies from the prior fiscal year have been processed and transferred to the owners' tax bills. John asked it there were many in that category and Barb replied there is $30,000 in back payments due, which was less than previous years. PUBLIC COMMENT- Dave asked Rob for an update on Marshall Park and Rob replied a landscape architect firm has been hired. They are organizing public meetings for public input, and they will come up with some conceptual plans. The plans will be reviewed by the Parks Commission with input from the public, to come up with a refined plan. John congratulated Dave on a great job on the Salvation Army boot drive. Dave thanked all that participated and noted they have served 1200 families. Mike Nault added it was nice to see Michael Ray and Todd Dwyer at the drive. Dave noted they collected tons of toys and helped a lot of kids that day. CURRENT BUSINESS - DPW Director Report- Rob noted that the Commission was sent the RFP for preliminary sewer design for Upland/Eastern Ave, and White St. He received proposals from Wright Pierce, Tate & Howard, Weston & Sampson and Woodard & Curran. They were all fairly similar. Wright Pierce bid $13,200, Tate & Howard bid $19,800, Weston & Sampson bid $42,000 and Woodard & Curran bid $15,000. Based on Wright Pierce's proposal for soil exploration with 21 probes to search for ledge on Upland & Eastern, Rob would recommend going with Wright Pierce, as the low bidder and their proposal was exactly what he asked for. Motion: Brett R. Second: Mike N. To accept Rob Oliva's recommendation to use Wright Pierce for the preliminary design. Discussion: John agreed with using Wright Pierce but asked if the cost would be included in the project. Barb replied it would be included in the cost, as long as the project goes forward. Dave suggested having some of these engineers come in to meet the Commission in January. Rob agreed and wanted to introduce Tatum & Howard as a new resource that he is familiar with. He also noted Wright Pierce was very interested in working with the town again and they have a new associate on staff who is very knowledgeable on sewer. Dave added he would like to make a commitment in 2022 to work on expansion and customer service. Roll Call Vote: John-aye, Brett-aye, Mike N.-aye and Dave-aye. Rob also reported they have completed work on Elizabeth St. I/l and have filled joints with 7 gallons of chemical grout. He received a video of their inspections but will not be getting a report. Rob noted Barb reached out to Fitchburg and Leominster to set up a meeting with the heads of the waste-water divisions. There is a new person in Fitchburg and hopefully they will get together after the holidays. Rob reported that he received the as-built for 384 Mass Ave. and had submitted it to Mass DOT. Because the as-built showed work was not done in the right of way, he asked to withdraw the permit app. The DOT obliged and the project has been closed out. American Rescue Plan Act (ARPA) funds (Coronavirus Local Fiscal Recovery Fund) - Barb reported the federal government has approved funds but they are waiting on the state. Dave asked Barb to add compiling an ARPA funds wish list to the January agenda. Rob noted the biggest needs would be the pump stations and the Commission agreed. Dave said he is concerned about the flow meters and would like to discuss upgrades with Rob. Rob noted that they recently have done 10 more manholes and have addressed the most critical ones. John suggested doing ===PAGE 2=== more investigation on I/l (Inflow/Infiltration). Dave reiterated he still would like to sit down with Leominster and would not want to spend any more money on studies- they need to get solutions. Rob agreed they can go back to the studies for suggestions/recommendations. Grease Trap Policy- Dave noted he talked to the new Lunenburg Diner owner about the grease trap fees, who questioned why he needed to pay someone to inspect the traps. Barb replied originally the fees were to pay for the cost for inspections and the fees were less if they are compliant. The Commission discussed the grease trap policy, fees and inspections. Barb noted that there is a lot of administrative time spent tracking compliance. Rob agreed there is still a cost to implement the policy and an annual fee is appropriate. Mike pointed out the fees were put in place so the restaurants would take the policies seriously and maintain the grease traps. Dave suggested talking to the Chair of the Board of Health. He added that they should charge large fees for dumping grease. John noted if they have large fees, they need to follow through. The Commission agreed to discuss the grease traps at a future meeting. Barb noted that Jane also puts in time, helping her with entering logs and 1st Tuesday reports. She added that with the Fitchburg Chapter 147 changes, they will be looking at several policies and will add the Grease Trap Policy to the list so that all can be taken care of in the same public hearings. Barb stated for the record that the Annual fees for Grease Traps are: Internal trap - $150 if compliant, $ 350 if non-compliant, External Interceptor - $450 if compliant, $ 650 if non-compliant. Barb confirmed that all fees have been waived for the last 2 years by the Commission. 1st Tuesday report-all logs are in for November. Barb added that the New restaurant, Lunenburg Diner, has submitted all that was required. Victuallers Licensing with Select Board- Barb has communicated with the Select Board that all are compliant, and she is just waiting for the external pump out report from A&D Crossroads Plaza. She received the invoice, which confirmed it was done, but is just waiting for a report. Fitchburg Sewer Use Ordinance-Barb noted that Rob mentioned Jeff Murawski has left Fitchburg and Tony Murrasa is interim. Adam Costa (Town Counsel) has not submitted his recommendations yet. He is answering from a legal standpoint, but said some questions need to be answered by someone with technical knowledge - possibly a consultant. After Adam responds, they can discuss if they need to be reviewed by a consultant or just sent on to Fitchburg. Q2 Commitment of $266,302.46 - Barb asked for a verbal approval for the Q2 Commitment. Motion: John R. Second: Brett R. To accept the Q2 Commitment for $ 266,302.46. Roll Call Vote: John-aye, Brett-aye, Mike N.-aye and Dave-aye. Commissioners will come into sign. FY22 YTD Budget - Barb sent out the budget for review and noted they are right on target. Revenues are ahead (54%) and expenses are right where they should be. Barb confirmed that Fuel is good, and the pump stations were just topped off for the winter. She has not received the bill yet. Transfers to Delinquent on FY22 Real Estate taxes $30,593.35 - Barb noted she worked with the Assessor's and Collector's offices to move any FY21 Sewer delinquencies to the FY22 Real EstateTax bills. Minutes of 11/9 meeting review/approval- will be put on the next agenda. Business Manager Report - Invoices- Fitchburg: $15,498.33 (9/26-10/25/21) and $ 18,978.61 (10/26-11/25/21) and Leominster: $119,387.06 (6/26-9/25/21). All invoices are based on flow meter readings and the Commission agreed with paying them. John asked Barb if she has an updated billing comparison spread sheet and Barb replied she needs to do biling algorithm first. She added that Leominster billing for the same period in 2020 was $74,265 but noted that this had been a very rainy summer. FY23 Budget and tentative 3/24/22 FinCom appointment- Barb received a tentative date from Heather for an appointment with FinCom on 3/24/22. Dave suggested working on the budget in mid-January and noted that it was a good presentation last year. ===PAGE 3=== Assistant to Business Manager - Barb reported they are trying to get the position re-posted but has not had an update from Julie (Asst. Town Manager). Barb read a memo draft to Julie from the Commission, asking to post the 24-hr./week benefited position, as soon as possible and to have all resumes forwarded to Barb and Rob for review. Motion: John R. Second: Brett R. To have the formal memo sent to the Asst. Town Manager/ HR to have all the applicants for the Assistant position be reviewed by Rob Oliva and Barb Lefebvre.
