PUBLIC COMMEN T & ANNOUNCEMENTS – Ed McSweeney introdu ced himself and stated that he was interested in the discussion on extensions. He owns land in town that he would like to develop for 4 single family homes and ha s perc ’d the land. He would like to see if they could connect to town sewer but would need to be allowed to do easements across the lots. The 4 homes would be entered through a common driveway. If they do septics for each, it would be hard to do future upgrades to the septics without tearing everything up. Ed noted the town allows common driveways as long as all requirements are met. He referred to a development in Ashburnham where they brought in a line from the main road and had a dded a 25 ’ service easement for each property to connect to sewer. They will use F .R. Maho ny to d esign the plan and service the E-1 pumps. Ed is just looking for information at present but would like to present a plan to the Commission. Brett stated that the Commission allows easements on a case -by- case basis and suggested Ed put together a package to present at a meeting. Roll Call Vote: Dan-aye, Scott-aye, and Brett- aye. ---DPW Director/Sewer Business Manager Updates– i. Town Counsel meeting and ADUs- Bill reported he, Andrew and Dan met with Town Counsel, who gave them a high level review of the ADU law. It is silent on utilities and he recommended the Commission come up with a new regulation as to how to handle them-especially regarding fees. Bill noted that the Commission can add a Regulation but a By-Law would require a Town Meeting vote. Dan added that an ADU is up to 900 sq ft., on a pre-existing lot and cannot be sub-divided. It can be rented to anyone and zoning is not an issue. Town Counsel stated that if the Sewer Commission desired, they could vote to not allow ADUs. The Commission can also detail how the connection is made. Scott asked if they discussed using direct tie-ins in case the unit is sold later and Bill replied Counsel said the parcel cannot be subdivided. Scott questioned what would happen if a unit is later made into a condo and sold. Bill noted what Scott is suggesting would require a change in the state law. The Commission discussed ideas for the regulations and fees. Brett questioned if it would be possible for someone with a septic to add a sewer line for the ADU and Bill said it is a possibility if they are in the Sewer Service Area but not connected. The Commission discussed connection scenarios, Board of Health requirements and adding a water meter to an ADU. Bill noted they cannot require an additional water meter but if the ADU is a rental, they may want the additional meter. Andrew will reach out to Leominster and Fitchburg about their regulations. Dan suggested each come up with some ideas to give to Andrew for discussion. Bill noted an easement requires a waiver and they discussed the language with Town Counsel. An applicant has to meet all 3 criteria before they can grant a waiver. Bill stated the first criteria would be some kind of emergency such as a backup or to correct a mistake made in a previous connection. The other two criteria are: Is it in the best interest of town and Is there a hardship? ii. Touch-A-Truck- Bill gave a huge thank you to Scott for providing the cotton-candy machine which was had 10 deep lines all day. It was a big turnout and PAC has posted a video. Bill added that school supply donations filled up the whole backseat of the police truck. Brett thanked all involved, especially the DPW, Fire Department, Police and Scott Dall. Bill also gave a big shout out to Dave McDonald, a former Commissioner, for suggesting the idea and getting the event all pulled together. iv. Manhole Repair IFB- Bill reported the manhole framing gates have been ordered but are on backorder and not due in until October. v. 17 Rennie Street adjustment- Andrew stated they found out that 17 Rennie St.’s water meter was assigned to 10 Rennie and vice versa, which meant #17 was overcharged $79 on her bill. In order to do a credit, the Commission would need to vote to allow it. Motion: Scott D. Second: Dan P. To vote in the refund request for the incorrect billing at 17 Rennie Street. Roll Call Vote: Dan-aye, Scott-aye, and Brett- aye. ADUs- Scott asked what the procedure would be for regulation changes. Bil replied the Commission would put together the regulation and send it to Town Counsel for review. Then they would need to advertise and hold a public hearing, followed by a vote by the Commission. Commissioners will send any ideas to Andrew. ---Future Agenda Items- ADUs, Manhole Repair IFB PUBLIC COMMENT – Scott thanked Bill for including him in the Touch-A-Truck event and added it was great to see the smiles on the kids. Brett thanked Scott for sharing the cotton candy and said it was a great event for the Community. To accept the minutes of 8/26/25 . Roll Call Vote: Scott-aye, Arthur- aye, and Brett-aye. --- DPW Director /Sewer Business Manager Updates – i. ADUs – Bill gave the Commissioners lists of ideas supplied by Dan Proctor and Andrew , which the C ommissioners reviewed. He noted that they will need to write a new regulation concerning ADUs and Andrew said it would be added in Appendix G of the regulations. S tate law limits the size to 900 sq.ft. and Dan suggested a $500 fee to tie in , with a $330 fee for the extra bedroom. Dan further suggested t he ADU unit sewer line must tie into the existing sewer line on the property , with no new connections on the street . Connections would be into interior plumbing or from a detached unit via a TY connection underground into the existing line going out. Bill noted a clean out would also be added and t he work would be done by a licensed drainlayer . Bill would inspect the pipe and if it is bad, it would require replacement. He clarified the lateral and pipe in the street is the town ’s responsibility but the rest of the line is the homeowner ’s . Scott questioned what the fee would be for a new construction with a propos ed ADU. Bill suggested there would be the fee for the new home and the fee for the ADU. It would be up to the homeowner if they want a separate water meter for the ADU , which will be noted in the regulation. The separate meter would have the tenant ’s name on the bill , similar to how they bill for apartments. (Dan P. joined the meeting .) Next steps would be tying these ideas together and discuss it at the next meeting , before sending it to Town Counsel for review . Dan questioned where the ADU fees would be allocat ed and Andrew responded probably to F low C apacity . Arthur asked if easements would present a problem and Bill noted the regulations s ta te no easements but there are waivers for emergenc ies. T hey can plead their case but there are criteria and it is ultimately up to the Commission. Dan added the ADU would be tied to the existing house so it should not involve a n easement. The Commission discussed possible scenarios requiring a direct connection for the ADU , such as the main home being on septic. It was suggested that the house along with the ADU would be connected to sewer and the usual connection fee charged. Bill noted there is one being permitted right no w. The Commission agreed to fine tun ing the verbiage at the next meeting or two before sending it to Town Counsel. ii. Manhole Repair IFB - Bill reported they are still waiting for the manhole cover fram ing to come in. iii. 45 Riley Road Bill Credit - Andrew noted he received a call from the resident that the water department was chang ing her meter and increased her usage but later gave her a credit . He said her usual bill is around $174 but the last bill was $2 83.24. Andrew asked if the Commission would vote to c redit her next bill for $83.24. Motion: Dan P. Second: Arthur K. ===PAGE 2=== To allow Andrew to credit the next bill for 45 Riley Road for $83.24 . This left the Commission without a quorum so the hearing could not proceed. The Commission agreed to table the hearing until later in the meeting in case Arthur was able to attend. CURRENT BUSINESS – ---Minutes of 9/30/25- Motion: Scott D. Second: Dan P. To approve the minutes of 9/30/25. Roll Call Vote: Dan-aye, Scott-aye and Brett-aye. ---DPW Director/Sewer Business Manager Updates– i. ADUs- Bill summarized that the Commissioners agreed to send the ADU regulation draft to Town Counsel for review. Bill, Andrew, Scott and Brett will meet with Town Counsel on 10/23 to discuss the draft. ii. Manhole Repair IFB- Bill reported the frames and covers for the manholes had arrived and the repair of the 26 manholes will tentatively start on Friday, October 17th. He added that the device they bought to measure I/I was not able to get a signal so it could send data on the flow level. They would like to try it again in the Whalom area near John Street. Bill clarified it is a flow tilt meter which was designed for monitoring online if the flow is high or low but it did not work. Dan asked if any of the 26 manholes are on state roads and Bill replied none are, so they did not have to go for a state permit. Tango Construction was hired as the subcontractor to do the framing and Insituform will come back to do the inside of the manholes. Bill noted that a lot of the manhole problems occur where they have the adjustment at the top and sometimes with the pipe coming in and out. Dan questioned why they keep using bricks to extend the manholes since the bricks wear out. The Commission discussed some new products that could prolong the life of the concrete inside the manholes and issues with the bricks. Bill noted Insituform will seal the manholes also. --Future Agenda Items- Bill stated that the budget is looking a little tight and suggested they may want to add to their Capital Line at the Fall town meeting, noting the Wright Pierce price of $83K for the mapping was not expected. However, they discovered the deadline for warrant articles was 10/2. Bill will talk to the Town Manager about it and the Commission will discuss it, as well as vote, at the 10/28 meeting. --The Commission discussed how to proceed with the first hearing and tabled it until after the second hearing. b. Easement Request for 792 Mass. Ave. – Brett opened the second hearing at 7:40pm. and introduced Daniel Sheehan from Haley Ward. Daniel noted the property was the old Stone Farm and they are proposing 3 duplexes on 3 individual lots. Everything will be tied into a combined system with 1 connection tab into Mass. Ave. Lot 3, closest to the funeral home, will be tied in with some pump chambers and forced system to 1 collection system. 763 Mass. Ave. – the old funeral home – will also be 3 duplexes tied into 1 collection system, with 1 tab into Mass. Ave. Daniel S. clarified that they will use the existing stub from the old Stone Farm, so there will not be any work on Mass. Ave. The Commission reviewed and discussed the plans supplied. There will be a driveway for each of the 3 lots. Bill noted the plan will require easements because they will be crossing lots with the sewer lines. Daniel S. stated the request meets the criteria of a preventative Emergency because the waiver would prevent shutting down Mass. Ave. 6 times in order to do the 6 connections. In addition, that section of Mass. Ave. is curved and could be hazardous while work is going on. He added that there would be a hardship if they had to install 6 tabs since the Mass DOT would require they do an overlay from frontage to frontage. Bill stated the configuration is fine with the easements for the 3 lots. Daniel S. noted the easement line would be 15-20 feet. Dan P. pointed out the stormwater basin on the plan and the sewer line is outside of the stormwater basin for maintenance such as jetting. The Commission discussed the waiver request and agreed the request met the criteria of emergency, hardships and in the best interest of the town. Daniel S. added they will need to upgrade from existing 6” stub to 8”. There were no public comments. Motion: Dan P. Second: Scott D. To grant the waiver as requested by FWP Realty for 792 Mass. Ave. Roll Call Vote: Dan-aye, Scott-aye and Brett-aye. Daniel S. asked if the Commission wanted a presentation on 763 Mass. Ave. but Bill noted it was not on the agenda. Brett closed the hearing for 792 Mass. Ave. at 7:59 pm. a. Easement Request for 830/832 Mass. Ave. continued discussion- The Commission discussed how to proceed with the easement request and agreed to continue the discussion at the October 28 meeting as an in-person meeting. Motion: Scott D. Second: Dan P. To continue the 830/832 Mass. Ave. hearing to 10/28 at 6pm. Roll Call Vote: Dan-aye, Scott-aye and Brett-aye. The Commission began the meeting by saying the Pledge of Allegiance. PUBLIC COMMENT/ANNOUNCEMENTS - none PUBLIC HEARINGS – Chair Brett read the ground rules for conducting the public hearings. --- Easement Request, FWP Realty Partners for 763 Mass. Ave., represented by Steve Ballard (Haley Ward). (This hearing was continued from 10/14/25 and opened at 6:13pm.) Steve noted this project is at the old funeral home and is similar to 792 Mass. Ave. previously reviewed by the Commission. They are proposing to have 3 lots connecting into 1 manhole, flowing to sewer on Mass. Ave. This would avoid shutting down Mass. Ave. 3 times, which would also involve crossing under the existing water main. It would be better to do this just once--not 3 times. The easement would come from lot 3 across to lot 1 and to Mass. Ave. Steve clarified the lots and access points on the site plan, noting that all driveways will access from Chestnut St. They will take part of the existing building out to create a duplex. Scott questioned if the lots could be hooked up to sewer on Chestnut Street. The existing house was on septic and not connected to sewer. Steve clarified there will be 3 new manholes. Bill pointed out that there is no sewer on Chestnut Street but it is in the Sewer Service Area. The Commission discussed whether they should entertain running an extension up Chestnut. Dan stated that their Bylaw requires they go halfway through the furthest lot and someone else could take it from there. Scott suggested possibly petitioning everyone on the street. Dan noted that there should be a sewer stub for the funeral home. He asked Steve to verify where the stub is located and if the 6” stub be big enough or do they need an 8”. Steve stated there will be 6 units but he did know how many bedrooms. Dan added that the plan should show where they will connect and note if it will be an 8” rather than 6”. Bill pointed out how an extension could go up Chestnut Street and the Commission discussed this idea, along with other proposed building in the area that may be interested in connecting. Brett suggested continuing the hearing until they get the location of the stub, what the size pipe will be and Scott asked for the number of bedrooms. Dan added that he did not love easements going across multiple properties that have addresses on Chestnut Street. Steve noted that Lot 3 does not have any frontage on Chestnut St. Arthur suggested in the interest of the town, getting a consensus from residents on Chestnut about adding sewer. Dan noted that some people on Chestnut Street would need to pump with an E1 pressure line. Brett questioned if they would then need a pump station. The Commission discussed how to proceed, what further information they need and looking at extending on Chestnut Street. Steve said their client would want to do 3 tie-ins on Mass. Ave. rather than going up the street. Bill added that they cannot deny him access to Mass Ave. Dan noted that when they pull the building permit, the address is updated. Bill clarified that this hearing was for a waiver to grant an easement to tie into one and this is what they need to vote on. Steve stated they can continue it in order to come back with answers on the stub and show it on the plan. Scott asked to compare the costs for tying in on Mass. Ave. vs a spur on Chestnut St. Dan noted the hill is all ledge. Motion: Dan P. Second: Scott D. To have Haley Ward get additional information for the next meeting so they can discuss it. Roll Call Vote: Dan-aye, Scott-aye, Arthur-aye and Brett-aye. Motion: Scott D. Second: Dan P. To extend their permitting to the next meeting. Roll Call Vote: Arthur-aye, Scott-aye, Dan-aye, and Brett-aye. The Commission will meet next on November 25th in person. Easement Request - Waiver 830/832 Mass Ave. represented by Ryan Proctor (Dillis & Roy) – Brett opened the hearing at 7:32 pm. Ryan stated they are seeking a waiver to allow a sewer connection through an easement which he indicated on the site plan. He added that 830 Mass. Ave. was subdivided a couple years ago into 2 lots with # 832 as the back lot. It was discovered that the sewer stub for # 830 is now on the # 832 lot. Instead of making curb cuts ===PAGE 2=== to connect # 830 to Mass. Ave., they are proposing to add a manhole within the easement to tie into the existing stub. They would also add a stub for any future connection to the # 832 property. Utilizing the existing stub, all the work would be done on the back side of the sidewalk, about 13’ after the manhole. It would be a gravity run to the 2nd manhole. The Commission reviewed the lots and site plan. Ryan stated they meet the 3 requirements for a waiver. The house has a 60 year old septic system in the back. When the ANR was done in 2022, the previous owner was required to hook up to sewer but did not. The current owners want to sell and the easement would be a less intrusive way to connect. This meets the emergency criteria. Ryan clarified that the easement is on # 832 to benefit # 830. Both properties are in the SSA and they are trying to consolidate services. If the waiver is not granted, they would have to cut into Mass Ave with DOT permit, which is holding up the sale of # 830. The Commission discussed and voted. Motion: Scott D. Second: Arthur K. To accept the waiver request for an easement at 830/832 Mass. Ave. Roll Call Vote: Scott-aye, Arthur-aye and Brett-aye. (Dan recused himself from the hearing and voting. ) Brett closed the hearing at 7:41pm. CURRENT BUSINESS – ---Minutes of 10/14/25 Motion: Dan P. Second: Arthur K. To approve the minutes of 10/14/25. Roll Call Vote: Dan-aye, Scott-aye, Arthur-aye and Brett-aye. ---DPW Director/Sewer Business Manager Updates– i. Town Counsel on ADU Bylaw- Andrew, Scott, Brett and Bill met with Town Counsel regarding the waiver language and ADU bylaw. The biggest discussion was on the waiver language and the emergency wording will change to unusual and extraordinary circumstances. Bill noted the Commission can vote to change the regulation wording but in order to make that change in the By-law, it would need to be brought to Town Meeting in May. The Commission discussed the wording. Bill read the verbiage on waivers, which noted that if the Commission grants a waiver it would not set a precedent for another waiver. Bill suggested putting the wording vote on the next agenda. ii. Manhole Repair IFB- Bill reported that the frames came in, but when they opened the first manhole, they realized the frames were too small, so the project is on delay again. ---Future Agenda Items- Continuance of 763 Mass. The Commission began the meeting by saying the Pledge of Allegiance. PUBLIC COMMENT/ANNOUNCEMENTS - none PUBLIC HEARING ---Easement Request, 763 Mass. Ave. (Continued from 10/28/25)- represented by Daniel Sheehan (Haley Ward)– Brett reviewed the ground rules for the hearing and opened it at 6:04pm. Daniel summarized the project and noted the changes requested by the Commission. The property at 763 Mass. Ave. will be separated into 3 lots with a duplex on each lot, with the existing building retrofitted into a duplex. Daniel noted they shifted over the location of the stub by 6’ on the updated plan. Also the manhole behind one of the duplexes is now a drop manhole. The duplexes will have a total of 19 bedrooms and they calculated the total flow to be 2,090 gal/day, which the existing 6” pipe can handle. If there is an issue with the integrity of the existing pipe, they will replace it. Scott and Arthur noted they had not provided the cost figures for adding sewer to Chestnut Street for tie-ins vs making 3 connections to Mass. Ave. The only update Haley Ward provided was related to relocating the stub on the plan. Bill asked Daniel if he received the Commission’s list of questions and Daniel replied he did but was not aware they asked for pricing. He stated that going up Chestnut Street would be significantly more expensive -especially if there is ledge-- than hooking up to the stub. The property owner would rather get the DOT permits from the State to connect each lot to Mass. Ave. Scott noted that 2 lots are on Chestnut Street and it would have to be a real financial hardship for the Commission to grant an easement waiver. He added that they would be missing their biggest opportunity to add sewer to Chestnut St. Brett summarized that either they connect through the existing stub or force them to go 3 times to Mass Ave. Arthur questioned whether it is better for the town to have properties with easements or without easements. The Commission discussed the easement request and the benefits of adding sewer to Chestnut Street but agreed they cannot force them to extend the sewer. Brett asked for a vote. Motion: Dan P. Second: Scott D. To vote on the waiver request for an easement at 763 Mass. Ave. Roll Call Vote: Dan-nay, Arthur-nay, Scott-nay and Brett-nay. The motion did not carry and the hearing was closed at 6:32 pm. CURRENT BUSINESS – ---Minutes of 10/28/25 Motion: Dan P. Second: Scott D. To accept the minutes of 10/28/25. Roll Call Vote: Arthur-aye, Scott-aye, Dan-aye and Brett-aye. ---DPW Director/Sewer Business Manager Updates– i. ADU amendment – Bill summarized that Town Counsel reviewed the admendment, the Commission agreed with the wording and they are ready to vote. Arthur asked to clarify the connection charge was a one-time fee and Dan inquired if an ADU could have 2 bedrooms. The answer to both questions was yes. Motion: Scott D. Second: Dan P. To accept the Sewer Connection Charge Policy for ADUs. Roll Call Vote: Scott-aye, Dan-aye, Arthur-aye, and Brett-aye. ii. Manhole Repair IFB – Bill reported that the frames they received were the wrong size and they reordered new ones but they are not in yet . The roads cannot be opened up after 11/15 and the contract was over on 10/31. They are granting the company an extension to June 30, 2026. ===PAGE 2=== ---Future Agenda Items- Bill noted they will need to go to Town Meeting to change the waiver language in the by- law. Dan suggested discussing and making a change in their by-law or regulations to state that a property needs to connect to sewer on the street of their address. Brett will add it to the next agenda and Bill said they will need to discuss it with Town Counsel. Bill will also ask Town Counsel when the new ADU policy will be in effect. The Manhole Repair will be added to spring agendas. PUBLIC COMMENT – Scott noted that other towns have had increases in their sewer and water rates. He asked if they will be looking at increases and Andrew replied they will need to look at raising the rates as an agenda item.
